in california. also we'll find out if today is a furlough friday for thousands of californians. mornings on 2 begins right now. and good morning to you. welcome to mornings on 2. i'm dave clark. >> i am tori campbell. let's get to the top story. the big rig crash causing backups on interstate 580. >> this crash has been going on since about 4:30 this morning when a truck flipped over and blocked the lanes. we have live pictures for you. you can see the traffic backup is huge stretching all the way back beyond 205 stretching to the central valley. westbound 580. let me put it on the map for you. it's westbound 580 at portola.

the road centers are very slow. the traffic on the southbound side is effected. let's go to ali rasmus who is on the scene. >> reporter: we're on westbound 580 and the good news out here is that that 18 wheeler that created this whole mess is now back upright. a short time ago there was a giant tow truck with a crane to put it on its side. the other good thing is the cleanup is well underway. even though the two left-hand lanes are still blocked off. there's only one lane of traffic passing through on westbound 580. caltrans crews are here. they are sweeping up me pounds

of manure it was carrying. we looked at the driver of the 18 wheeler. he was able to walk away. he said he was going about 55 miles an hour when his front right tire blew out. that caused him to lose control of the big rig. it flipped over. good news is no other cars were involved and no one was hurt. this is what he told us in spanish. [ speaking foreign language ] >> reporter: and he said that was the most important thing to him is no one was hurt. the truck was carrying material stuff. the important thing was no one was hurt. the cleanup has begun. crews are loading and picking up the leftover bags of bark and manure that this truck had been carrying. let's give you another look at what traffic looks like. there's one lane of traffic that's moving westbound on 580.

if we pan around over here, you can see behind this accident scene -- it is just headlights as far as the eye can see. the backup goes way beyond 205. if we show you the eastbound lanes of 580, you can see traffic is moving well. traffic moving well on eastbound 580. but let's show you what the access road looks like. the westbound access road as people learn about this accident and learn how to avoid it. there's also a backup on the westbound frontage road by portola avenue. the estimated time for this cleanup and the lanes to reopen is going to be another two hours or so. we're going to continue to monitor the situation out here and bring you more updates and give you that information.

ali rasmus, ktvu channel 2 news. >> thank you. we'll check back soon for an update. an investigation is underway into a shooting in antioch. tara moriarty joins us now with an update. >> reporter: good morning. authorities say that a burglar shot one of their police dogs while he was inside of a home. they say that suspect paid the ultimate price with his life. it happened around 1:15 this morning near d and lotten streets. a neighbor reported a break in and the burglar was inside the house when police arrived. gunfire erupted, the suspect was shot and killed. the canine was also shot aside his handler. >> he was one of the officers involved in this incident and he was the person that transported the animal to the vet. he's very relieved that his

canine is going to survive. >> reporter: dozens of investigators have sworn the -- swarmed the area here. it is standard protocol to have this many involved when it is an officer shooting. you can look at it, it's the big white truck parked behind the group of trees there. you can see is that officers are milling around the area. the body is still inside the house. we have not seen the coroner arrive yet on scene. we are still checking on train service in the area to see if it is impacted baa -- because the crime tape is still up. we know the suspect is from east contra costa county. ktvu channel 2 news. >> thank you. time is now 7:06. well, thousands of state employees will go to work today and get paid. but the fight over furlough

friday is far from over. the governor's office had ordered three unpaid days off a month starting today until a budget is passed. but an appeals court upheld an order to block it. the governor's office will file on appeal to that today. depending on how quickly the courts act, they could place furloughs the last two friday of this month. the stage is now set in the next round in a battle of same- sex marriage in california. a judge ruled they can start marrying at 5:00 p.m. next wednesday. yesterday's ruling gave marriage opponents time to take their case to the 9th circuit court of appeals. legal experts are making their predictions. >> i think the safe bet is

continuing the stay. they will facilitate the full hearing of the case without a sense of emergency. >> gay marriage opponents have already filed their appeal. saying the ruling undermines the voting of the people. >> he wants to muck things up bauds -- because he's a liberal judicial activist. he's not a defender and supporter of the constitution. >> there are three judges on the appeals. a reagan appointee and two appointed by obama. gavin newsom says she city will be ready for a rush of marriages if they lift that stay next wednesday. many same-sex couples tell me they'll go back to city hall to

beyond 205. this is westbound 580 before airway. a truck crashed with fertilizer all over the place. it was determined not to be hazardous material. it's ground cover, it's bark, a bit of fertilizer. even though it smelled bad, it is not hazardous. no one was hurt but the truck is actually going to be okay. as a matter of fact, as they're holding traffic up right now, looks like they temporarily stopped all the lanes. they will be doing that as they do more clearing. and the backup is huge. let's go to other pictures now. westbound bay bridge, that traffic is light. no major problems. let's go to steve. >> thank you. good morning. happy friday, everybody. some fog yesterday burned off around noon. even some tweets saying it's sunny here in the financial district. so i think we'll see a similar pattern today. there was a couple areas

concord, livermore, san jose. little warm up today from those away from the coast. we'll go 65 san fransisco but at least once that fog burns off after a cold, chilly morning then we'll see sun. 70s around the bay. mid to upper 80s inland. 51-56. and that 56 is popular. 40s in the valley. excuse me. 40s in the mountains, 50s in the valley. temperatures bounced up yesterday. the fog keeps temperatures on the coast in the 50s, 60s or low 70s. there's a low dropping down from telenorth that might drag across saturday for a cooldown. today i think we'll carry over thursday's weather into friday. more fog today. then sunny and warm.

fog will burn off sooner today. here's dave. time now 7:14. we may know very soon whether bp's ruptured well is sufficiently sealed. results are expected later today on whether last month's static kill when they pumped in mud and cement into the well, we'll find out whether it is holding. if it is holding, officials say they may not have to finish the relief well to plug it from below. it is 7:15. new deadly mudslides are being reported in remote northwest china. 14 people have been killed and another 20 are missing. days of torrential rain have caused flooding and mudslides that have killed more than 1100 people and left 600 missing. the rain will continue.

a u.s.-bassed sink tank is calling the removal of rubble the single most important step toward reconstruction in haiti. released the steps needed in haiti following january's earthquake. the report says while the humanitarian response was quick, the second stage has been slow. it faults the haitian government for failing to make basic decisions. time now 7:15. wiki leaks website is getting ready to release more of the afghan war documents. the government is saying it could put soldiers' lives in danger. allison burns in live with that story. good morning. >> reporter: good morning to you. i just checked the wiki leaks website and there are no new documents. the first release was on july

25 that raised questions about killing of civilians, operations against the taliban, and pakistan's cooperation. the pentagon said the documents put troops in danger. now wiki leaks founder says he's getting ready to release 15,000 more documents. they'll soon be often the site. we talked to an afghan war veteran that says it's time for the military to address the problems on the ground. >> the idea here is to bring to terms what can we walk away with and fix rather than how do we moan the fact that this information is out now. >> reporter: wiki leaks founder has maintained that releasing these documents will actually save lives. allison burns, ktvu channel 2 news. >> thank you. time is now 7:17. president obama is expected to sign a bill today providing $600 million in emergency aid

to help secure the u.s.-mexican border. that bill among other things funds the hiring of 1000 new border patrol agents. $14million in new communications equipment. plus new un-manned aerial surveillance vehicles. the bill is funded in part by imposing higher fees on the companies who bring in foreign workers. 7:17. uc berkeley's plan to collect genetic information on its incoming freshman class has been scaled down. they're in the process of taking and testing samples. it will show a profile of the class. but because the state department of public health objected to releasing personal genetic tests, students won't get their individual results. the question of what bart will do with an estimated $8 million budget surplus is not

answered this morning. they put off a vote yesterday. a plan to cut fares in the short-term may not happen. the fare cut would have amounted to 10 cents on a trip between walnut creek and san fransisco. the other possibilities include delaying a fare hike in 201 or using that money to clean up trains. a vote against a law that would legalize marijuana. yesterday it came out against prop 19. it said the law would hurt businesses. the chamber says its analysis indicates it would lead to more work place accidents. and could lose federal contracts because businesses would have a tougher time prohibiting marijuana use on the job. >> an employer can no longer have the ability to have a drug- free work place based on prop 19 because we are creating a new protected class of individuals in california.

>> however, prop 19 supporters say the measure would allow employers to continue to enforce their current work place rules. it is 7:19. businesses could soon be stopped from charging customers a fee from using their debit cards. the measure narrowly passed yesterday. now it's on the governor's desk. the author says it would prevent businesses from advertising one price and then hiking the cost at the register. the governor has not said if he'll sign the bill. still ahead: drug agents say it's weed worth $80 million. we received video of a record- breaking pot bust in one california community. also california's plan for a high speed rail system is now tied to the horrors of nazi germany. we'll explain. good morning. 880 northbound looks okay. as a matter of fact, traffic

it is 7:22. this morning we know the identity of a man whose shooting death led to the chase with the suspected killer. hector sanchez was shot to death wednesday inside a home in the 1900 block of calavars boulevard. it was part of a dispute between sanchez and the suspect rubio. they have busted one of the largest indoor marijuana growing operations they have ever seen. authorities say a tip led deputies to nine green houses on 50 acres of private property between highway 101 and the

pacific ocean. this is new video sent to us by sheriff's deputies. they say they found up to 20,000 marijuana plants worth up to $80 million. they also seized several hundred pounds of processed marijuana. the grow houses had a sophisticated heating and ventilation system. the companies who bid on california's high speed rail project may have to provide some very controversial information. the state senate yesterday passed a bill requiring those companies to reveal if they transported holocaust victims or prisoners of war to nazi camps during world war ii. this bill now goes to the state assembly. they expect to take bids on the project next year. it is 7:24. we want to check in with sal on the commute and a progress report on the livermore crash. >> they are making progress.

they're cleaning it up really quickly. the truck is gone. they said it was going to be at about -- at 5:30 this morning they said it would be there for three hours. so it looks like they may clear it up early and have all the lanes open soon. ali rasmus is on the scene. we will let you know as soon as that happens. but the traffic backup on 580 is huge. it's well beyond 205. let's take a look at is the 880 freeway. traffic may actually be lighter on the east bay because so much traffic comes in on the 580 freeway. we have people just not getting to 880 or the toll plaza. the toll plaza is a light commute right now. here's steve. >> thank you very much. and just a little change yesterday. got the fog to burn off and temperatures rebound rapidly. today similar pattern. fog down on the deck.

so by the ast still on the 60s. a couple of tweets came in by the noon hour that it was sunny in the financial district an the giants game. inland, once that fog burns off, temperatures do warm up. i tweeted yesterday that yuki was 92. there are areas that you get a little sun and no fog and it warms up fast. the city 65. that's the same as yesterday. three degrees warmer than yesterday. 50s again on the lows. they've been there for the longest time. sacramento they'll be in the low 90s. today about the same. then a cool down before we rebound sunday. morning fog. then sunny and warm for some. cool for others. anywhere from 60s and 70s by the beaches to upper 80s and

good morning to you. time now 7:29. we're going to a developing story. we've being following this all morning in the morgan hill area. police are waiting for the fog to clear. they're investigating a body found in a remote area off watsonville road. police got that call shortly after 2:00 a.m. but they told us the thick fog and brush in that area have made it tough to investigate this. we have a ktvu crew on the way. they'll continue to -- and we'll give you updates as soon as information becomes available. an investigation is happening right now following an overnight raid in fremont. ktvu's jade hernandez is out there right now. she's back with a live update. good morning.

>> reporter: good morning. several neighbors in this area didn't know what happened here last night. but one man told us he was told to stay inside of his home while police searched an apartment building across the street from where he lives. that building's just behind me this morning. ktvu watched last night as fremont police collected evidence in bags and brought those outside. this is a very quiet neighborhood off alvarado boulevard. officers in full s.w.a.t. gear monitored the perimeter after the warrant was served. and san fransisco police were also involved at the scene. officers served the search warrant at the apartment on the corner of great salt lake drive. we don't know what that was for or what the agencies were looking for. we're also waiting to hear how san fransisco units are tied into this. we're told fremont's involvement in this is done. >> i came out of my house and the police told me to stay in

and stay inside for a while. and i went back to my house. so they said for a while and i came out again and see if it's gone. i wanted to go. >> reporter: that man was afraid that he was going to be late to work so police allowed him to leave he -- the area. we're waiting to hear back from a detective from the department to hear official word on what happened here last night sometime after 9:00. but we do know that a search warrant was served in an apartment complex and evidence was pulled out of that apartment late last night. jade hernandez, ktvu channel 2 news. it is 7:32. san fransisco police are asking for help this morning in identifying three men they say kidnapped and sexually assault a woman. 3:30 a.m. saturday, the man picked up the 25-year-old woman. they then took her to a spot

near highway 101 where they sexually assault her. the woman described her attackers at latino and they told her they were from san jose. they were in a black volkswagen gulf. police have a new sketch of the rapist who's been attacking women at walnut creek. the three assaults happened on oak street. investigators believe the same person raped one person and attacked two others over the past two months. the suspect is described as an african-american, 20-30 years old, about 6'2" and weighing about 200 pounds. the incidents have changed how some residents live. >> i'll put towels in my window and reinforce that. i have pepper spray. >> fliers alerts residents are reminding people. and officers are reminding people to lock their doors and

windows. in san fransisco, the weekend party that ended in that tragic shooting death of a german tourist was held inside a makeshift dance hall that did not meet the city fire codes. it happened outside the native suns of the golden west building near union square. the building was leased out to a private promoter. but officials say a large public assembly requires a fire permit to make sure of the safety of the occupants. on sunday, a german tourist was shot by a stray bullet during a shoot out of rival groups that showed up for that party. fremont dedicated a new fire house but it will remain empty because of budget cuts. it has room for three fire engines and six firefighters. but now there's not enough money in the budget to keep them working there. it's unclear at this point when the fire house will open. crews are working quickly

to clean up that big rig accident that's been snarling traffic in the east bay for several hours. more than 20,000 pounds of fertilizer and other landscaping materials were on board the truck when it overturned on highway 580 this morning. ali rasmus is on the scene with new information about how long the lanes will be closed. >> reporter: good morning. the latest estimate we got from the chp sergeant out here is all westbound lanes of 580 may be reopened in the next hour or so. just in the last 20 minutes, chp was able to open another lane of traffic going westbound. when this zapped -- accident happened, the far left lanes were blocked by the 18 wheeler. now that's moved out of the way and the cleanup is just about complete. chp telling us all lanes could be opened sometime before 8:30.

now, the debris is that the truck was carrying, that's what's created some of the hassle here. that 18 wheeler that overturned when this accident happened was carrying about 20 tons of fertilizer, manure, and bark. and that's what caltrans cleanup crews had to come out here to clean up. they had their sweepers and a lot of crews sweeping the asphalt. the accident happened about 6:30 this morning. the driver said he was able to walk away unhurt from the accident. he was driving about 55 miles per hour in the right-hand lane when one of his front tires blew out. he lost control of the trunk and it flipped. no other cars were involved and no one was hurt in this. [ speaking foreign language ] >> reporter: the driver told us in spanish that that was the

most important thing to him, the fact that no one was hurt. he says the material stuff he was carrying, that stuff doesn't matter. he's just glad no one was hurt. let's show you another look at what traffic is lye like over here. as we pan over here going west on westbound 580, things are moving along. there's three lanes of traffic open versus two lanes that had been open all morning. again, the good news for people in this traffic -- it is slow going though it is moving nicer than it was this morning. it's still going to be at least another hour before all the lanes of traffic are opened up. but the good news for commuters is that they are making progress on this clean up and some time probably before 8:30 is when they estimate all four lanes will be back open. now let's check in with sal castaneda who's going to tell

us more about the commute. >> ali, does it smell? i'll be ali. yes it does. all right great. westbound as you drive past the toll plaza, no major problems this morning. problems on the bridge, no stalled vehicles, just a will the of people showing up. i have a feeling a will the of people had been stuck in that back up on 580 just making it to the toll plaza. let's look at 880. that is more crowded as the morning wears on. we are here in the middle of the morning commute. and this morning's commute on northbound 280 looks good. today it definitely has been improved. at 7:38, here's steve. >> thank you very much. and happy friday, everybody. we made it. get you pointed in the right direction for what looks to be a weekend where if inland it'll be warm to hot. if you have a boat, it's been a tough summer. it's been cold and windy.

warmer weather sunday. might have a cooldown saturday. had a very strong low plunge southward. like that the fog disappeared and temperatures warmed up a bit. we'll continue to theme today. which is kind of a push. so it'll be close to yesterday's highs. airport runs about 4-5 degrees warmer. san fransisco 65. finally out of the upper 50s. that's a heat wave compared to where they've been this week. 70 in oakland. 72 today. then 80 in san jose today. temperatures below average but they're close. more fog being reported today. just looking on the web cameras, very foggy right now including san jose which was

time is 7:43. oracle is taking google to court for patent infringement. the company claims google's android system violates the patent on java technology. that makes it possible for applications to run on smart phones and other devices. oracle owns the patent on java. google says it has not reviewed the lawsuit yet and will not comment. hewlett-packard says they are cooperating with u.s. and german official that are investigating bribery charges. $10million in bribes to win a contract to sell computer equipment to the russian prosperous cuter's office.

the wall street journal says officials joined the investigation after complaints that hp had failed to provide relevant documents. talk show host dr. laura is apologizing this morning for racially offensive comments she made on her show. our reporter is in washington now with the latest. >> reporter: good morning. she dropped the offensive word 11 times tuesday when she took a call from an african-american woman. the very next day, dr. laura called her comments wrong and issued an apology saying i messed up. i used the n word on air and i regretted it as soon as it was over. while it was using that word as a way to show for the people who think it's funny or acceptable, it was hurtful. i used it to prove a point.

the apology isn't enough for some people like al sharpton. >> her first reaction was well, people use the n word all along. i think you're being too sensitive or something to that effect. at no point until after the outrage that followed did she come back today and say it was wrong. >> reporter: dr. laura posted on her blog the next morning that she regretted saying the word the minute the call was over. she said she pulled herself off the air 20 minutes after that call. she called the woman too sensitive when her family makes comments. dr. laura said black men and comedians say it all the time. if the caller couldn't have a sense of humor about race, then she shouldn't have married outside of her race. i'm nicole collins. >> thank you.

so dr. laura apologized. how do the listeners react? do you have any comment on that? >> reporter: well, certainly there's outrage from many people. dr. laura read a letter and got numerous letters from people. she said that they were disappointed with her but that they showed friendship. whatever that means. perhaps that these had been loyal listeners 37 and the one e-mail that she shared, the woman said she didn't believe that dr. laura was a racist just that she made a poor choice there and this listener hadn't decided if she will listen on. so maybe others feel the same this morning. >> thank you. time now 7:47. well, the jet blue flight attendant who became nationally famous with his resignation now says he wants his job back. slater says aviation is his life and he was under stress.

still not clear if his return to the skies is even possible. jet blue is investigating his status as an airline employee. and the prosecutor's office says he still may face criminal charges that could put him in prison for seven years. the vector control district will conduct its third aerial survey over urban areas to check for neglected pools. they will fly over north san jose, santa clara, mount view, and palo alto today. the pools could harbor mosquitoes. a poor contained pool could carry millions of mosquitoes that could carry the west nile various. environmental authorities say they've had to close some public pools because the facilities are not in compliance with federal safety regulations.

under new rules, pool and hot tub owners are required to install drain covers so people won't be sucked into drain. there is a plan for san fransisco to become the first city in the country to ban the sale of pets. last night a standing room only crowd debated with pet store owners on one side and animal rights activists on the other. to prevent the animals bred in puppy mills. but critics say small businesses will be hurt. >> mom and pop pet shop is what we are. been around for years and years in this country. that's where people first make contact with animals as young children. >> don't exclude small pet shop owners from this. some of the worst

investigations i've covered happened in small retailers. >> last night's meeting ended with animal control commissioners postponing their vote until the beginning of next year. in the meantime, they're urging both sides to try to come up with a compromise. 7:49. some high school students from oakland are heading to costa rica today. they are part of a program funded by the afar media team. they want to experience more about the people and culture in the places they visit. it is designed to help the students use what they learn during their travels to become engaged citizens. >> they're jealous. you get to go to costa rica. i'm happy too. >> the impact could be something they'll really for the rest of their lives. they look beyond the here and now of this microcosm of the community they live in. >> they will spend ten days

good morning. i'm tori campbell. >> i'm dave clark. it is friday, august 13. caltrans just reopened interstate 580 after that big rig crash but traffic is still messed up for miles. >> sal's been monitoring this situation and joins us with an update. >> we have a look at what went on earlier this morning. 580 westbound about 4:30 this morning a truck flipped over. the back, the trailer part was loaded with fertilizer, filch and other organic material. not a hazardous material. the driver was interviewed and said the left front -- one of the front tires blew out and that's why the truck flipped over. that's what he told chp. no one was injured but the traffic is really bad.

figure out who called in the report. they have set up a perimeter and are waiting on more officers to come and help. there's no word on whether the body a male or female. time now 8:02. investigators are still at the scene of an early morning officer-involved shooting that happened in antioch. tara is back now with more. >> reporter: the coroner has just left the scene. authorities wheeled out the body of a man they say burglarized a home nearby here earlier this morning. moments ago police were able to give us a little bit closer look at the scene. they say a burglar shot one of their police dogs after he was caught inside someone else's home at 1:15 this morning. and that is when police stormed inside and the suspect was killed. >> there was an exchange of gunfire between the suspect and the officers. the suspect was hit.

he was pronounced deceased at the scene. none of the officers were injured but the canine was shot. >> reporter: the canine's handler was the officer involved in the shooting. he took the dog to a veterinary clinic and the canine is expected to survive. no word on the suspect's identity. we've seen dozens of investigators with the police and the da's office come in and out all morning long. it is standard protocol toll have so many on scene when there is an officer-involved shooting. the crime lab is here. it's the white truck parked near the trees near the house. we've seen a lot of investigators leave here over the past half hour. no word yet on when they will begin to wrap up their investigation. we've seen no trains come through here since we've been here this morning at 4:30. there's crime tape up there. we are trying to get more information on whether or not train service has been interrupted.

tara moriarty, ktvu channel 2 news. it will be work as usual today much to the relief of 200,000 state workers. but the fate of furlough friday is far from final. today the governor's office plans to appeal yesterday's appellate court ruling upholding an order to block the plan. the plan calls for three unpaid days off a month for state workers. until a budget is passed. depending on how quickly they act, state workers can still face furloughs the last two friday of this month. even though state workers will be on the job, they're still showing anger with governor schwarzenegger. they're calling for a boycott of the movie the expendables because the governor has a cameo in it. they are outraged he would take time to appear in a movie in the middle of a budget crisis and they're mad he took a trip

good morning to you. welcome back. we've got an update on developing news we've followed all morning. in the morgan hill area, we want to take you live. the pictures as police are investigating reports of a body found in a remote area off of watsonville road. there are still patrol cars out there. the call came in at 2:00 a.m. but it was too dark and foggy for police to get close enough to that scene. heavy brush out there is also

causing problems. it's about a mile and a half of where we are standing at this point. about halfway through, it's a paved road. but from there it turns into a dirt road where you can still drive but you will probably have to bring in an suv vehicle. in a regular standard it's going to be hard to travel through that road. >> the police have established a perimeter out there. they're waiting for more police officers to arrive to help out. we don't know yet if the victim is a man or a woman. investigators are also trying to figure out who called in as a tipster and filed that report. we're also learning new information about an overnight police raid in fremont. jade hernandez just talked to the police. she's back now with a live report on the latest. what do you know now? >> reporter: dave, we now know that fremont assisted the task force in serving a search

warrant to the complex you see behind me. we know the fbi was also involved. ktvu watched as police pulled evidence from the apartment in bags last night. we were told no one was arrested but that the gang task force was looking for someone. while the warrant was issued 9:00 last night, officers told neighbors to stay inside their homes if they could. they searched for the suspect they came to the area for. they pulled over a car but eventually let the couple go. one neighbor told us around 10:00 last night police still had the street blocked off and he could see police searching across the street. we a waiting to hear back official word on what officers were investigating. at this point, we only know that the gang task force served a search warrant and evidence was taken from the complex you see behind me.

jade hernandez, ktvu channel 2 news. >> thank you. it is 8:32. san fransisco police are asking for help this morning in identifying three men they say kidnapped and sexually assault a woman. investigators say at 3:30 a.m. saturday, the man picked up the woman on california street. they then took her near highway 101 where they sexually assault her. the woman described the attackers as latino and said they told her they were from san jose. one man was named oscar, the other named johnny. police are released a new sketch of the rapist who has been ataked women at a complex at walnut creek. investigators believe the same person raped one woman and attacked two others over the past two months. the suspect is described as an african-american, 20-30 years

the only place you will find the slowdown is off to the right. you see the freeway onramp getting on to westbound 580 is bumper to bumper up there. that accident happened around 4:30 this morning. an 18 wheeler carrying 20,000 pounds of bark and manure flipped over. after that, traffic was snarled. caltrans tried to tow away the truck and cleaning crews had to arrive to bring out sweepers and clean up the mess. truck had been carrying bags of bark and fertilizer. for people in the area and anyone in the area could certainly smell the cargo that that truck had dropped. we spoke to the driver of the truck who was able to walk away from this accident unhurt. he told chp investigators he was going about 65 miles per hour in the right-hand lane when his front right tire blew

out. he lost control of the truck and it flipped. he didn't hit any other cars. they said how lucky it was that no one was hurt. >> it happened at a time where the commute was just getting ready to start. if it happened any later, no telling what could have happened. to predict. but one of the things i know you've been watches is all of the procedural things that could happen as we look into what happens next. the procedural things. explain that if you can break it down. >> there's so many puzzle pieces. the immediate next step has to do with the court of appeals. now that there's a decision that marriages can take place next wednesday unless there's a decision otherwise, the prop 8 proponents will try to get an emergency decision by next wednesday. if they lose at that level or if they decide they don't have time to hear it, you can be sure the prop 8 proponents will file for a stay in the u.s. supreme court. there's going to be a lot going ton procedural that could keep the marriages from stopping. >> among the 9th circuit court of appeals leans towards the liberal. is that a fair way to think? >> i don't think so. it's a very large circuit.

and the first step is a panel of three judges. now, the flee judges who are likely to hear this next step just having to do with next wednesday's decision are two clinton appointees and a reagan appointee. you can't predict on what administration appointed the judge. so to sort of label the entire circuit as liberal is not payings attention to the individual judges each step of the way who are going the make the decisions. >> supposing same-sex couples show up next wednesday we're getting married. would it be official? >> if there is not a decision -- well, it would be official according to judge walker's order. and it would be legal until there was a ruling otherwise which would probably take some time. and there would be some very vigorous arguments as if 18,000 couples are already legally

married before prop 8 that these couples would join that group. >> comment briefly on -- i think the supporters own both sides have been awakened. what's your feel on either side of the issue about the intensity that's building? >> well, it makes california the center of a debate that has been going on for some time. there are legal marriages of same-sex couples in other states. but the fact this is in the federal court makes it extraordinary because that means it could go up to the united states supreme court and there are very mixed feelings about what would happen on both sides if it should get there. >> would you make a prediction? >> if it goes to the u.s. supreme court? >> about how this is going to end up. >> well, i think it is -- given the events of the last couple days, it is possible there will be these procedural issues that wind up providing the reasoning for judges to decide rather than actually the merits of the
