story starts right now. >> this is ktvu -- [ inaudible ] >> good afternoon. we begin this noontime with a raid in fremont involving the fbi and san francisco police. they were searching a townhome overnight and we have learned there is a connection between this police activity and the fatal shooting of a german tourist near union square. jade hernandez joins us from san francisco with an update. good afternoon, jade. >> reporter: good afternoon. we just finished talking with san francisco police, who tell us they were fondling a promise inch lead which led them to fremont. we caught them in action raiding an apartment last night. free nonet police pulled evidence bags from this apartment on lake tahoe terrace. neighbors were told to stay inside or leave the area. once officers left a neighbor described his fears. >> i took my baby from the upstairs and brought him downstairs because i didn't know if there was gunfire or not. they were all in their body

armor and weapons drawn. >> reporter: author ramirez told us the apartment raided has been problematic for him little did he know at the time earlier this evening the gang task force alerted fremont police they were going to serve a search warrant there at that apartment and would need swat back up, which included fbi assistance. no one was arrested but police told us the gang task force was looking for someone. we spoke to police sergeant troy dangerfield a half-hour ago. he told us they were following a lead into the investigation into the shooting death of a german tourest on sunday. >> i don't know what time they actually got out there. i know the warrant was served around 11:00 last night. the information that i have. >> reporter: she died on sunday night when she got caught in rival group's cross fire standing outside with her husband a half a block from her hotel deciding on a place to eat. an 18-year-old was arrested but released. we understand from police the fbi was looking for a suspect

last night during the raid. they pulled over an suv but vet cheal let those people go. david stevenson is going to have more for you tonight because the city attorney is taking legal action against the owner of a building and the comedy club owner near where she was killed. live from san francisco jade hernandez ktvu channel 2 news. >> we have new information right now about a body discovered in the morgan hill area overnight. the santa clara county sheriff's office tells ktvu it was a man's body found on a ridge in a remote very off watsonville road. they got the call before 2:00 a.m. but had to wait for daylight to investigate properly. now they are waiting for the coroner's office to work on identifying the man. residents on their morning walk were greeted by officers who had set up a perimeter. >> it is peaceful and quiet. we have never had any trouble

except for some teenagers partying at night and leaving some beer bottles but that is about it. >> detectives have also tracked down the man who reported the discovery and are interviewing him. traffic is smooth now but it was a real mess this morning after a big rig overturned spilling its load. chp says it was traveling westbound around 430 when its front tire blew out that caused it to hit a railing and flip over, sending bags of bark and fertilizer into the road. they say it could have been much worse. >> it happened at a time where the commute was just getting ready to start. if it happened anylater no telling what could have happened. >> there are no reports of injuries. most of the westbound lanes were shut down for three hours as crews cleaned up the mess, that created two hour delays and a massive back up all the

way to 205 in the tracey area. getting new information on an officer-involved shooting in antioch, police shot and killed a burglary suspect after he shot and injured a police dog. tara moriarty joins us live now with the latest. good afternoon, tara. >> reporter: well, good afternoon, tori. we are learning more information about the suspect, described as a 29-year-old from east contra costa county with an extensive criminal record. that record ended today when he allegedly shot a police dog. police released these cell phone images of thor, an eight year veteran of the police department. you can see two red shots where a bullet entered and exited. >> there was an exchange of gunfire between the suspect and the officers. the suspect was hit. he was pronounced deceased at the scene. none of the officers were injured however the canine was shot. >> reporter: officials say he was trying to apprehend a burglar when he was shot. his handler and another officer

pulled the trigger on a prowler. the cosh near wheeled out his body this morning. the ordeal began around 1:00 this morning when he broke into a house. he had piled up a bunch of appliances when police stormed in. within minutes dozens more officers swarmed the scene. >> we are using our -- the protocol we have in this county for officer-involved shootings or critical incidents and its an investigation conducted by the antioch police department, the contra costa county d.a.'s office and the crime lab. >> the man who lives here happened to be staying at a friend's house in hayward last night. we spoke to him who said off- camera he feels lucky to be alive. the canine was rushed to the hospital and is expected to make a full recovery and is now resting. tara moriarty, ktvu channel 2 news. >> thousands of state workers are on the job today and will

be paid for their work but the fight over furlough fridays is far from over. the governor's office had ordered three unpaid days off a month starting today, until a budget is passed. but yesterday a san francisco appeals court upheld an order to block it. the governor's office plans to file an appeal today, depending upon how quickly the courts act state workers could face furloughs the last two fridays of this month. the battle over same sex marriage is now headed to the federal 9th circuit court of appeals in san francisco. >> it comes after district court judge vaughan walker announced yesterday that next wednesday he will lift the stay on his ruling that california's gay marriage ban is unconstitutional. if the backers of prop 8 don't get a stay from the appeals court same sex marriages could begin at that time. margaret russell a constitutional law professor says it is all part of the complex appeals process. >> if they lose at that level

or if the 9th circuit decides simply that they don't have time to hear it, you can be sure that the prop 8 proponents will file an emergency request for a stay in the u.s. supreme court. >> legal experts say there is still some ski on whether prop 8 opponents have legal standing to appeal the ruling. norm peal that would fall to the state but the governor and the attorney general have said they will not defend prop eight because they, too, believe it is unconstitutional. read more about the case on the channel 2 website ktvu.com, plus see the video evidence presented during the trial. the attorney representing a former catholic priest accused of sexual abuse is set to go to court today to try and get him released on bail. 74-year-old patrick joseph mccain lived here in alameda before he turned himself in on july 30th. his attorney wants him out of the jail because of his chronic health problems.

federal authorities are taking steps to extradite him to ireland where he is accused of sexually abusing boys in the 1970s. the highway patrol just wrapped up a cell phone use crack down this week and the chp has another one planned for next week. on tuesday alone almost 800 bay area drivers were cited for talking without a hands free device or texting while driving compared to 650 during a similar crack down last year. the next campaign is planned for wednesday, august 18th. it may soon cost a little less to use your debit card. we will tell you why. also president obama signs key legislation aimed at securing the u.s. border with mexico. and a warm up just in time for the weekend. we will have the complete bay area forecast when we come back.

president obama signed a new border security bill into law, it beefs up patrols along the border by increasing border agents. greg boswell has more from washington. >> reporter: with little fanfare president obama signed the $600 million border

security bill that funds border agents, customs and enforcement agents and other agents. the president says it will help target gangs that operate along the bill. others call it a good first step. >> i still think we need more than a thousand agents. >> reporter: the new law provides more equipment and increases the use of more drones. they asked for help to stop the flow of illegal immigrants and stop drug trafficking. >> the cartels are in control of the border out there, there are secret cameras filming them carrying drugs across the border. >> the border area itself needs to be safe and secure, but as a nation we also need immigration

reform. >> reporter: breaking a deadlock over broader immigration reforms is likely an uphill battle as they focus on midterm elections. in washington, greg boswell, fox news. >> the united states is sending firefighters quinnment to help battle 500 wildfires burning across russia. the president called the russian prime minister yesterday to send his condale lances. the death rate is 700 people. they are sparked by the highest temperatures ever recorded in russia and are struggling with smoke and fog. the most important steps needed in haiti is the removal of rubble. the report says while the humanitarian response was quick, the second stage of rubble removal has been slow. it faults the haitian

government for failing to make many basic decisions. some good news for shoppers, fees to use your debit card could soon by illegal. the measure outlawing such fees narrowly passed the state assembly yesterday and is now on the governor's desk. it would ex-tpped the consumer proax available for credit cards to debit cards. its author says it would prevent businesses from advertising one price and hiking up the cost a the register, the governor has not said if he will sign it. getting ready for school is a daunting time for low income families who cannot afford all the supplies. but there is help today for hundreds of families in santa clara county. allie rasmus has more in this live report from san jose. good afternoon. >> reporter: good afternoon, there are hundreds of parents and children lined up out here in front of the sacred heart community center here in san jose, here to pick up a free backpack with school supplies. they do this every year for the

past four years and organizers say there is a greet need for this service when it is time to go back to school, especially during a recreation. kids got to pick out a backpack of their choice for the school year. we saw some of the children's faces light up when they found a backpack with their favorite character on it. they are age specific to that means the kindergarteners get crayons while some of the high school kids have calculators. approximately 1700 people stood in line for hours just to register to be here to pick up a backpack today. the director says that is a record breaking number. >> what was shocking was seeing the line wrapping around the block, the corner, the demand we had never seen before, especially from families that had not been reaching out for help in the past. >> this is the first year i am getting them because i stopped working. i am retired. my daughter just got laid off her job.

>> it helps a lot. i am taking honors classes so that is a lot of help and pretty fun. >> reporter: the organizers say the money came from private donations from bay area businesses and from people in the community who wanted to help out. again, everyone who is here picking up a backpack today registered for this program last week, so unfortunately, it is too late for people to just show up and pick up a backpack today. however, the organization again doing this as a non-profit called sacred heart community services offer other community health and social services throughout the year. >> the san francisco zoo announced today it had to euthanize one of its polar bears. officials say the 27-year-old female bear andy was in the final stages of liver failure. they say the average life for a polar bear in a zoo is 20 to 25 years. she was born and hand raised at the atlanta zoo before the came to san francisco in 1985. the san francisco zoo has two

other polar bears both in their late 20s. the santa clara county vector control district today is set to conduct its third aerial survey over urban areas to check for neglected pools. the district will fly over milpitas, north san jose, santa clara, and others. this operation aims to detect neglected swimming pools and other possible sources that could harbor mosquitoes a single poorly maintained pool can produce millions of mosquitoes. people here in the bay area may not believe it but worldwide last month was the second hottest july on record. the average temperature was 61.6 degrees only july, 1998 was warmer than that. january to july of 2010 was the warmest first seven months of any year on record, averaging 58.1 degrees. it may be hot in other parts of the globe but here in the bay area it still cool but we are starting to see a

warm up, right, steve? >> inland tori, we had one of our coldest julies since 1944. we have seen it carry into august. we have fog burning back to the coast. west-southwest 21 at fairfield. temperatures inland concord- livermore two degrees warmer today than yesterday. the fog burning off. still low clouds in the distance. sunshine now starting to splash over san francisco. fog hugging the coast there. the reason is that we had the fog compressed. high pressure moved in yesterday. burned it off the same time so pattern today similar to yesterday. there looks to be more fog this morning. still every reporting station this morning had fog. breezy and windy, fogs, then sun, mild to warm inland. temperatures 80s to low 90s.

ukia, lake county, vacaville, antioch brentwood, around the bay and other areas 70s and 80s, temperatures have beenly lowe for the long he was time and today noise exception, getting close to average but not there yet, san francisco 65, should be 70. oakland 72. should be 73. santa rosa 79. they are only 64 now. 82 is average. 75 mountainview and san jose should be 84. they will by 80 today, so even though we are warming up it is not near average -- it is near average but not above yet. 60s and 70s. san jose is at 70, palo alto 68, tahoe 76, that beats anybody here. reno 83. 100s in the desert, up and down the coast 56 to 68 from eureka down to san diego, the coast stays cool with all that fog and low clouds. it will be back and might get a cool down tomorrow. a low might enhance that fog bank for saturday but sunday does look warmer and will carry

airports already has it. also as more and more airlines make the move to in flight wi- fi it is believed that same customer resistance to pay as you go wi-fi is growing. state workers are protesting the governor's fight to implement furlough days by boycotting a new movie staring the governor. some workers are protesting the movie because the governor has a cameo in the film. they are outraged he would take time to appear in a movie in the middle of a budget crisis. coming up on ktvu channel 2 news at 5:00, last month five horses died in san joaquin county when they were left without access to water. the owner is blaming an inadvertently locked gait put the humane society reports there has been a recent surge in horse abuse including malnourishment and killings that could be due in part to the economic downturn. that story and more in our next newscast at 5:00.
