no. danville this afternoon police have a theory about what killed a 19-year-old man, but this afternoon their friends have a different theory about how that happened. a violent night in an east bay city leaves four people injured including two teenagers. and today was the first day of school for a san jose elementary school that was badly damaged during a devastating summer fire. we'll have reaction coming up.

good afternoon. we begin this noontime with a tragic street accident in danville that claimed the life of a 19-year-old. it happened shortly after midnight on glenn road not far from san a moan valley high school just west of interstate 680. we have spoken to friends of the victim and joins us with the latest on the investigation. good afternoon, craig. >> reporter: good afternoon. the high school where the young man actually graduated from in the spring of 2009. and this afternoon the police chief here telling me there thereby an autopsy performed on that young man. he says representatives of the police department will be there to witness that procedure. now all this is happening as some of the friends of the young man have a different theory about how he may have died. they say they believe that young man fell off that first vehicle and then was struck by a second vehicle following closely behind. and that is what killed the 19- year-old man. >> clearly it's a horrible tragedy. >> reporter: and according to the initial investigation it was also a horrible accident.

19-year-old justin young died overnight after falling off an suv being driven by a friend. police say a group of friends pulled up in a white suv and stopped next to him. the friends were going down the street to one of their party and justin wanted to go with them and jumped on the side of the vehicle. >> as they were pulling away very slowly a short distance a way and very slow speed away he either lost balance or fell from a car. >> reporter: later this morning a group of young men who knew justin from high school told us they believe justin died when another vehicle following closely behind the suv hit justin as he fell. >> i was coming out to my car and heard these screams yelling please stop. >> reporter: his friends tell us there was a party down the street. so when they heard the sirens coming they assumed police were coming to break up the party. >> turned out little did we know later that night the signs were for justin. >> reporter: police say the unidentified driver of the suv

tested negative for alcohol. and they'll ask for a toxicology report for young. but right now it appears neither drugs nor hall were involve. >> mission trips to like middle -- like south america countries and taught spanish kids english and stuff. >> reporter: the family of justin was too distraught with us to on camera. i spoke with his father and a cousin outside their home. both the father and cousin has been crying. they've expressed sadness at one social network and meeting places all over town. ktvu channel 2 news. >> thank you, craig. authorities in san bern din no county focusing on safety

measures at a crash during an offroad truck race. eight people were killed during that accident. the chp says seven victims were from southern california. the eighth was from las vegas. the crash happened saturday night during the california's 200 race. about 100 miles northeast of los angeles. witnesses say one driver lost control of his truck which then smashed into the crowd. oakland police have investigating three separate shootings that happened within three hours. the shootings in different parts of the city left four people wounded. one happened just before 9:00 last night at a park near a recreational center in east oakland. investigators say there were at least two gunmen in that attack. the two victims in this incident are 16 and 18 years old. both are from antioch. neighbors say they're tired of the violence. >> i just hope they get it together. we're losing too many young

people. the best thing to do is get out of oakland. >> the victims were taken to highland hospital. the motive for the shooting is under investigation. police are still looking for the gunman who shot one man several times at 32nd and magnolia streets in west oakland. this happened around 11:30 last night. that victim listed in critical condition. an hour earlier there was more gunfire during an attempted robbery on 59th street near berkeley. one victim was taken to the hospital with several gunshot wounds. he is expected to survive. police are still looking for the gunman in that case. police do not believe any of the shootings are related. it is still summer but some bay area schools opened to including san francisco school district. classes also started at san jose schools. and a special day for an elementary school because it had suffered serious damage from a fire last month. let us know how the first day

of classes have gone so far at trace elementary. >> reporter: good afternoon. yes. things seem to be going very well. parents we talked to this morning say they really weren't sure if their kids would start the school year here at trace elementary after a fire devastated this campus in july. but the first day of school did get underway and the superintendent says that's thanks to a heroic and miraculous effort on the part of this community. sandra has spent 23 years teaching. and yet today as the first day of school got underway at trace elementary school this veteran teacher was they nervous. >> because everything's so new. >> reporter: this was not a normal day. she's teaching in a classroom that didn't even exist three weeks ago. teaching on ground that used to be a baseball field. she is what they call a fire teacher. a teacher who lost everything in this july fire. a fire that investigators believe was arson. a fire that devastated the building that housed the first and second grade classroomings.

but today isn't a story of loss. it's one of rebuilding. >> without question this community, the business community, the parents, the entire community not just in san jose but throughout the bay area have come through and rallied to the rescue of this school. it's been remarkable and fantastic. >> reporter: in just six weeks an entirely new first and second grade wing has been created across the street. this will be the home for those first and second graders at least for the next couple of years. >> it's kind of overwhelming everything to see everybody and how the community all came together. it's just very nice. >> reporter: and as john watched his second graders settle into their new classroom, he is filled with pride for both his daughter and his community. >> it's more of a story of hope. you always hear about bad things on tv and news and everywhere else, to see all the things happen the kids and parents hugging and kissing n is the kind of thing you need to see more. >> reporter: there are still hurdles to overcome. but on this first day of school

she looks to the slide show of pictures of her new room taken over eight hours as she created a classroom for these children. she watches the transformation and she smiles. >> it makes me really happy because it was family and friends coming together and making the room really nice again. very happy. >> reporter: some parents are pushing for sprinkler systems and fire alarms for trace elementary. something it decide not have at the time of the fire and does not have now. the superintendent is convening a task force to look at the issue. when i asked him what possible down sides there could be, he said he just couldn't think of any. live in san jose, ktvu news. >> thank you. study by researchers found good news and bad news about childhood obesity rates around california. public health cam pains are helping steer caucasian, asian and latino children away from unhealthy foods but they say

obesity rates among african- americans and native american children are still going up. researchers say public health initialives that are designed to combat need to be conclusive of all communities. defenders of california's ban on gay marriage filed papers this morning formalizing their appeal of a federal judge's rulingover turning proposition 8. district court judge said last week he will lift his stay of his ruling on wednesday effectively making same sex marriages legal in california. backers have asked to put the idea on hold saying marriages should not be allowed during the appeal process. and papers filed today they argued that gay marriages would harm the state's interest in promoting responsible procreation through heterosexual marriage. go to our website at ktvu.com and click on the gay marriage

look into reports the plane was hit by lightning. it happened this morning as the boeing 737 was landing. that resort island is part of columbia. later today president obama will arrive in southern california. mr. obama helped raise money for the democratic congressional campaign committee with a dinner in los angeles. seats are reportedly priced at $2500. a few minutes ago the president left the midwest after a stop to talk about the economy. he toured an energy plant in milwaukee and talked about his administration's efforts to create new jobs. the president said he hopes his energy policies will help generate 800,000 new jobs in 2012. >> a year and a haling a this economy was shrinking rapidly, the economy is now growing. a year and a haling a we were losing jobs every month in the private sector. we have nowed ad private sector jobs for seven months in a row.

that means the worst mistake we could make is to go back to doing what we were doing that got us into the mess that we were in. >> wisconsin is the first stop on the president's three day trip across the country over the next three days. the president will be raising money for democrats in five states: states. small businesses generally not feeling good about their business' prospects in the future. but we begin on wall street and not main street. >> reporter: the dow jones industrial average hit its all time high in october of 2007. just 16 months later in march of '09 it lost a scary 54% of its value. but a year and a month later just last april it had one of its best rallies in history and hit its post recession high closing within 11% of the all time high. since then it's lost some 900 points and began today 27%

lower than its all time high. the culprit, lack of job gains and a housing market still pretty much in shambles. even though most leading indicators are up, small business owners, the nation's largest employer, are in a sour mood. >> we're seeing an economy growing but in a very lackluster way, not generating enough demand and not generating enough jobs. >> reporter: a recent survey found that just more than a third of small business owners say that the economy was excellent, good or at least fair. the rest say it's poor or don't know what to say. when asked about the potential for a double dip recession, 75% say that's likely to happen. only 15% think the worst is over. while one in ten don't know what to say. >> and on top of that the last three or four recessions have given rise to longer terms of unemployment. more retooling if necessary to bring the displaced workers back into the work force. and that retooling is taking a

lot longer. >> reporter: nonetheless the latest gauge of consumer confidence that just came out was unexpectedly up proving one thing that in recoveries there are all kinds of cross winds, real and imagine. ktvu consumer editor, ktvu channel 2 news. normally this is a big day for louisiana fishermen as the shrimp season opens today. seafood from the gulf has been declared safe by the state officials who say there are no signs of oil in the fishing zone. but shrimp prices are already low and fishermen are worried no one will want to buy their seafood after the massive gulf oil spill. the pilot of container ship caused a disastrous oil spill in san francisco bay in 2007 is due to get out of federal prison today. he took a number of prescription drugs before the accident. currently bar pilots are screened for marijuana and other illegal drugs but they are not tested for prescription

drugs. a board committee is reportedly looking into whether they should change that policy. checking now with meteorologist steve paulson to see what the weather's like out there. still foggy? >> not too many. it's starting to retreat back to the coast. that means temperatures are beginning to rebound inland after another foggy morning. what's new? the northern wind there in santa rosa helps get rid of the fog and we have numerous reports of sunshine unless you're right by the coast. even parts of sonoma trying to get some breaks in the fog. san francisco at 60 degrees. the fog still out there and it's going to be back in a big way i think by tomorrow morning. we had a foggy morning. and warmer temperatures inland today had a little warmer air loft slightly less of a sea breeze we expect both of those to pick up. temperatures will plunge tonight in the higher elevations and the fog will ramp up and it will be very windy through the delta tomorrow. end of the week looks very cool. below average temperatures continuing. i know it's tough on your tomato plants this cool pattern

also if you want to go to the beach it's been downright freezing at times but our fire danger remains very low, air quality also continues to be outstanding. the visibility is great as well. and this cool pattern has been locked in for now four and a half months. it also means you probably haven't had to use your ac as much or your water billower as well. there are some benefits. but some of the negatives few areas could use a little heat. no heat even in modesto you know there are some issues. we get a series of lows coming in. there's another one coming in. we had more fog this morning than anyone else. some record lows on the coast continue in southern california. these are the highs yesterday. ocean side harbor only 62. that's a record low maximum temperature. one of the coolest patterns they've seen in years down in southern california. even long beach a record low. record lows, record low maxes we've had those here and in southern california too.

6 0z, 70s and mid to upper 80s inland. san jose at 70. 74 livermore, concord. 80 sacramento. they'll be in the 90s same for lake county. and it's hot through the interior in southern california but on the coast it's not bad. so much fog up and down the coast. cooling trend on the way that's for right there can't get cooler on the coast. they'll start to get socked in ain as this is the warmest day of the week probably. brief area of high pressure pattern comes in looks like the pattern we've had for a long time. enhance the fog, pick up the wind and a lower pattern. coastal fog hanging out there. sunny, mild, not as breezy over the weekend. coast and bay mid-80s to upper 80s unless you're far inland. but i think everybody starts to cool down tuesday if not tuesday and wednesday take that right into the end of the week. get that time of year if this
