oakland teenager overnight after his brother was found shot to death. ktvu's jade hernandez joins us now with reaction from the family. jade. >> reporter: guilty good morning. it's hard to imagine the family's distraught. two sons together, a gun goes off and one of the brothers doesn't survive. we're live at police headquarters in oakland this morning where investigators wrapped up talking with a 13- year-old who survived. the older 15-year-old brother did not. the boy you see in the footage wearing a white hoody is the victim's brother. oakland homicide investigators arrested him and released him into custody of his parents. at the time of the shooting the incident happened around 8:00 last night near san pablo avenue at the boys' aunt's house. we don't know how they got hold of a gun, whether they brought it with them or found it at the house. what we do know is police went back to the aunt's house and

pulled out a vest and what appeared to be numb chucks. ktvu spoke to the parents and they told us they are not sure if they can afford to bury their son at this point. ktvu, channel 2 news. it could now be months before gay and lesbian couples in california can marry. a federal appeals court put same sex weddings on hold indefinitely while it considers the constitutionality of proposition 8. arguments are now scheduled for the week of december 6. and a ruling in this case is unlikely before the end of this year. reaction to the ruling is mixed around the bay area. even though same sex weddings are now on hold, the plaintiffs in the case say they're pleased panel agreed to expedite the hearing for appeal. san francisco mayor newsome also says he's satisfied by the time line but calls the decision bittersweet. >> a lot of hearts are broken and a lot of families are

disappointed. certainly the city's family is disappointed because we were ready to go. >> those who oppose applaud the decision to grant an emergency stay. >> delighted that the appeals court has decided to uphold the votes of seven million californians and allow this to be argued at the appeals court in december. >> some attorneys argue allowing same sex weddings to take place during the appeals process would have created legal chaos if the ban is eventually upheld. and you can find more about the ruling on our channel 2 website. go to ktvu.com and click on the gay marriage tab on the front page. san francisco police are reviewing surveillance video this morning to try and identify the person who stabbed a passenger on a muni bus. it happened just before 8:00 last night at sunset boulevard on a number 29 bus. police stopped the bus at 25th and fullton but the suspect had already gotten off the bus and fled. the victim was taken to the

hospital with nonlife threatening injuries. the investigation is underway into an officer- involved shooting in burling game. ktvu news has learned that an officer shot a man near the high school last night possibly during a robbery. one witness says police first tried to use a stun gun on the suspect then one officer shot the man. he was taken to san francisco general hospital where he was listed last in critical condition. thousands of aspiring singers are expected at at&t park this morning. in fact they're already there to try to land an audition for "american idol." this is the first time tryouts are being held in the bay area in two years. registration for the audition started just a few hours. contestants will be able to sign up through thursday morning and ch is when the actual tryouts will begin. right now 6:04. sal you asked a question earlier about who is judging at this level and she's trying to get to the heart of that.

sunny today but cooler as temperatures come down with a pretty good sea breeze kicking in. looks like another cool weekend on tap as another system drops into the north. right now we have an area of low pressure right there weak as it may be shows up on the water vapor site. doesn't on the infrared. but as that moves in that is just taking the fog bank and kicking up the sea breeze as well. 54 san francisco right now. 58 at noon. yesterday's high was 62. temperatures coming down inland. can't really go too much farther down on the coast although santa cruz reported 77 degrees. that's the warmest i've seen in a long time. 74 today. there's the 61 at san francisco. walnut creek 85 yesterday. 79 today. oakland from 70 down to 66. and san jose 79 drop you five to 74 degrees. mt. tamalpais and some higher elevations still running on the warm side. low 70s. but i suspect as the low ushers

in from the north cooler temperatures. crockett, san carlos running the warmest at 57. stanford in there as well. 90 at this hour in las vegas. 86 palm springs and a cool day along the coast in southern california. 56 sacramento and the bell that breeze is up to 30 miles an hour at travis and vacaville has a sea breeze. that tells you that things are taking shape because that low right there weakens as it moves in but doesn't stop the fog from reinforcing itself from that low. and as that low begins to move in that picks up the sea breeze and it's going to be a sunny day inland after the fog burns off but cooler. four, eight, maybe ten degrees cooler. seeing wind right now with fog about 10 or 15 or 20 miles an hour. fog, drizzle, sunny, breezy, cooler away from the coast. 50s, 60s, drop santa cruz about ten. i think there's too much fog there today. 56 oakland. 80 concord. santa rosa, san jose, fairfield

81 after yesterday's 91. fog, sun, mild and warmer on thursday but then looks like a huge cool down as we get towards the weekend. thanks, steve. walnut creek searching for two thieves who have been targeting popular shopping areas in the early morning hours. car breakins all happened near businesss on oak grove roads. we're live with more about the suspect's description. tom. >> reporter: what police are looking for are two white males youngish white males. both have shaved heads. and a whole lot of daring do. >> they're associated with two separate vehicles. one was a dark colored vw pass at and the other a gray sedan with some sort of wave symbol in the back window. >> reporter: even before 7:00 a.m. this stretch near oak grove is busy. nonetheless, two criminals were able to smash windows in a half dozen cars in broad daylight

yesterday morning and take valuables left in glove boxes and under seats. unlike many car boosts where an obvious valuable piece of property such at gps, laptop was visible police say there was no such temptation in these cases. the warning it doesn't have to be in your car, don't keep it there. >> as opposed to seeing stuff lying in the vehicles, i think they're breaking in the vehicles and searching for items. >> reporter: look over here in the parking lot now the safeway just opened up. so a few cars have pulled in but when we pulled in here at about 5:00 this morning the fact of the matter was there were at least half a dozen cars, maybe ten, parked here completely unattended and the lot was pretty much dash. bottom line is this. if you don't have to have things in your car it pays not to have them. we have two problems going for us. we have a recession meaning more desperate people out there and more importantly we have a lot of folks saying it's not my

government lawyers reacting to this morning's news about cia tapes that have surfaced that show interrogations of one of the men involved in the 9/11 attacks. we're live in the washington d.c. newsroom with a look at what those tapes reveal. allison. >> reporter: well, good morning to you. you know the c.i.a. had said that all of these interrogation tapes had been destroyed. but get this, these tapes were discovered not under lock and key but under someone's desk in a box at the national counterterrorism center. on them 38-year-old. u.s. prosecutors believe he is one of the key 9/11 plotters. the tapes, two videotapes and an audio tape, reportedly show him being interrogated at a secret prison in mother rocco. officials familiar with them say they don't show water

boarding or harsh interrogations just a guy sitting at a desk answering questions. this is video we took of one of the interrogation rooms at guantanamo bay where he's being held now. government lawyers have twice denied to a judge that the tapes existed but recanted after they were discovered. lawyers for him say they are going to be extremely relevant if he ever gets a trial. reporting live from washington d.c., allison burns, ktvu channel 2 news. the iraqi military is blaming al qaeda for an attack overnight. police say at least 60 people have been killed in a suicide bombing targeting army recruits in baghdad. there are at least 100 injuries. this is some video of the bombing victims. the attack comes days after the u.s. formally announced it is sticking with its plan to end combat operations in iraq at the end of the month. today president obama makes his first visit to the state of washington since his inauguration when he appears at

a democratic fundraiser in seattle. he raised an estimated $1 million for democratic congressional candidates. he's on a three day, 8,000 mile, fund raising trip across the country. california assembly has passed a bill intended to prevent another controversy like the one that erupted earlier this year when sarah palin spoke at cal state stanislaus. it would force organizations linked to public universities to disclose how much they pay speakers. the csu stanislaus foundation refuse today reveal how much it paid palin for her speech last june. okay. sal is here with more traffic. take a look at the toll plaza first right? >> that's right. traffic is actually doing okay. first day of school yesterday for many school districts and more people suddenly got on the road. so we're watching that for you. we want to see what we can see here. it's not a big crowd so far that have now turned the metering lights on just yet. traffic is okay on to the

bridge. also this morning we have a look at interstate 880 in oakland and that traffic is looking okay. if you are driving in to livermore valley westbound 580 looks okay so far. a little bit of slow traffic as you come into the main part but after that a nice drive to dublin. a lot more fog out there as we just saw in the traffic shots. decent day yesterday if you don't mind warmer weather. look at the gray skies over us and a lot of drizzle. another cooling trend kicks in. in fact a big cooling trend on tap for the weekend. temps remain below average. near average yesterday for some inland areas but still for many it was a couple degrees below. morning fog, drizzle, cooler breezy today. cooler weekend looking up. if it was september i would say maybe rain but because we're still in august it doesn't look like a rain event it does look

like a cool event though. low clouds, sunny, breezy from that low coming in over the oregon border. temperatures come down today. drop a good maybe even ten degrees. out of the 80s for some like walnut creek and mid-70s san jose and santa rosa after pushing mid-80s yesterday. 52 to 58 is where they've been for the past four or five weeks. cooler pattern today. the wind has picked up. already 30 miles an hour at fairfield. 230g, drizzle, gives way to sunny but breezy conditions today. 50s mid-80s unless you're far away from the fog bank. if more it will be a cooler day, slightly warmer thursday. but then there's the big cool down by the weekend. thank you, steve. there's mixed news on the housing front this morning. commerce department reports that new construction increased slightly in july but the drops during may and june were deeper than previous estimates. and building permits a leading indicater of future housing

construction fell to its lowest level since may of last year. the treasury department says rescuing mortgage giants freddie mac and fannie mae has caused $148 billion and costs are expected to continue to grow. so today treasury secretary is expected to tell mortgage and banking executives that the government wants to shrink its presence in their industry. no details for an exit strategy will be announced until next year but two possibilities are privatetizing fannie mae and freddie mac or phasing them out. passengers recall what happened just moments before the remarkable plane crash in columbia. also some big names will be on treasure island today to take part in an historic event. good morning. southbound 680 traffic looking okay heading to the south bay. we'll tell you more coming up. >> so, ah, your seat good?

speak at the lake tahoe summit which is an annual event which focuses on preserving the lake against threats such as wild fires, invasive species and pollution. on the eve of the summit researchers released new data that shows the lake is not losing clarity. according to the numbers lake water is clear to an average of 68 feet deep. that's no worse than it was a year ago. still that is much worse than the results of the first survey conducted 42 years ago. then lake tahoe was clear to an average depth of 102 feet. today treasure island will be officially turned over to the san francisco city of san francisco. house speaker, the u.s. secretary of the navy and mayor new som will be on hand for the ceremony. an ambitious plan to erect a new neighborhood on the grounds of the old naval base. offices, shops and stores and homes. construction scheduled to begin some time next year. also this morning the bay area ship pilot who went to

prison in connection with the but san fuel still is free. he was supposed to guide the container ship safely across the bay in 2007 but the vessel struck part of the bay bridge three years ago leading to a disastrous 53,000 gallon leak of heavy bunker fuel. investigators blamed his use of medication and low visibility caused by heavy fog. >> i would say that one of the biggest areas of risks that we still have is we have a lot of single hulled ships going in and out of the bay. >> but now the coast guard requires a half mile visibility before a pilot can take a ship near one of the three major bridges. he was the first bar pilot in the u.s. history to be sentenced to prison. he served ten months. sheriff officials say the woman accused of starting a fire at a courthouse has committed suicide. the 40-year-old was one of two people arrested in connection with the june fire. she was found dead in her jail cell on sunday.

authorities say she used bandages from a pre-existing medical condition to hang herself. she pleaded not guilty to arson and other charges. she was due in court for a preliminary hearing this friday. aviation experts are closely studying that plane crash in columbia being called by many a miracle. the boeing 737 broke into three pieces as it was trying to land yesterday. remarkably one person out of 131 on board died and authorities say she may have suffered a heart attack. six people were seriously hurt. most of the other passengers only suffered minor injuries. experts are now trying to figure out how people survived. >> the escape slide was deployed. what you also see over here is that a pretty clean break on the knew sill lodge. i think what you're going to determine is that this aircraft impacted the ground, split apart because of the severity of the impact. there was no fire. >> survivors recall everything being normal prior to the crash and all of a sudden without any

warning the plane plunged to the ground. while the cause of the crash is still being investigated, authorities are looking into reports that the plane was hit by lightning. a 27-year-old man drowned while swimming in a quarry pond in american canyon. the victim identified at neilly richard the third. he was swimming with a group of friends yesterday afternoon in a pond off south napa junction road. friends called police after he disappeared under the water. divers recovered his body almost four hours later. police say the quarry is on private property that is fenced off and has no trespassing signs posted. we are now hearing from the owner of the suv that was involved in a deadly accident in danville. it happened late sunday night on glen road. investigators say he died after he hitched a ride on the outside of a friend's suv. the 19-year-old then lost his grip and fell to the pavement. 54-year-old that owns the suv declined to say who was driving

but he says he along with his friends are still in shock over the tragedy. a livermore mother who was accused of having sex with two teenage boys has delayed entering a plea. the 42-year-old made her second court appearance yesterday. her lawyer asked the judge for more time because he and the prosecutor are still exchanging evidence. outside court her husband spoke publicly for the first time. he says the couple's three children are doing as well as can be expected. she returns to court on september 3rd. family and friends showed up in court to support a man accused of sexually assaulting three women at an apartment complex near walnut creek. 22-year-old antonio charged with rape, attempted rape and burglary. police say that dna evidence links him to at least one of the attacks at the park regency apartments and the contra costa times reports his mother lives in the area. he is scheduled to return to court next week to enter a plea. 6:26 is the time right now.

>> they did. expectations on cost cutting. >> that is good. time now 6:30. good morning and thanks for joining us on ktvu channel 2 morning news. it's tuesday august 17th. dave has the day off. >> good morning. i'm pam cook. time now 6:30. homicide investigators interviewed a 13-year-old boy after his brother was found shot to death. we're at the oakland police station with details of the evidence the police have uncovered in this case. jade. >> reporter: good morning. investigators pulled quite a few items out of the aunt's house where the shooting took place. first we watch the family's heart ache as they walked out of here oakland police headquarters last night. two brothers, a gun goes off and the oldest does not survive. investigators wrapped up last night. oakland homicide investigators question the young boy and released him into the custody

of his parents. all we know is the brothers were together at the time of the shooting and the incident happened at 8:00 last night near san pablo avenue at the boy's house. what we don't know is how the boys got hold of a gun, we were l they brought it with them or found it at the house. after midnight police went back to the aunt's house and pulled out what looked to be like a bullet proof-type vest and what appear to be none chuck. we don't know when or if charges will be brought against the brother. police spoke brother. the parents don't even know if they can bury their son at this point. as soon as we have more information, we'll pass that along to you. hayward police are investigating a drive by shooting that left one person injured. it happened about 10:30 last

night at a home onty riel avenue. the shooter fired as many as three shots at the home. a person inside was grazed by a bullet but not seriously hurt. hayward police are also investigating a shootout near downtown that happened in broad daylight. police say two people or people from two different cars that is arted shooting at each other at the intersection of foothill boulevard and city center drive at about 3:30 yesterday afternoon. witnesses reported an argument followed by as many as five gunshots. no one was hurt. fairfield police released surveillance void video of an attempted robbery at a cell phone store. two men walking in the store you see them there they demand cash, one armed with a handgun. but the store owner quickly turned the tables and he pulled the gun on the two men and fired several shots. two robbers then ran away apparently uninjured. one bay area kayaker has a real life shark tale.

45-year-old adam came face to face with a gray white shark over the weekend while kayaking off the san mateo coast. the shark chomped onto his boat for several minutes after flipping it over but the man managed to escape the close encounter with just a few cuts and scratches. the long line outside at&t park continues to grow. many of the "american idol" hopefuls have been camped out for hours. ktvu is there. have you found next season's winner? are they among the hopefuls out there? >> reporter: there are certainly a lot to choose from. this line keeps going. we've been trying to do unofficial estimates of how many people are in line. it stretches back as far as we can see we can tell you thousands of people are out here which is pretty interesting given the fact they didn't really have to camp out here. they've been out here since about officially midnight but really many of them have said they have been out here much longer waiting to get in line,

waiting to get wristbands. the actual auditions aren't until thursday morning. what they're going to do is get wristbands this morning and then come back at 5:00 a.m. and the auditions will get underway. lots of people in this crowd trying to brave the cold weather. i want to talk to you first. you're not singing but you're a mom. and i love the fact that all these parents are out here. tell me how far you guys came and why you came out here. >> we came from man teak, california. we came out here because she's the next "american idol." >> reporter: you're convinced. >> i'm very convinced. >> reporter: so convinced you will stay out here in the cold. >> until it snows. whatever it takes. >> reporter: that's awesome. there are a lot of people out here who want to sing out here. you'll give me a couple of notes. ♪ [ music ]

thank you very much. good luck to you. we have a huge crowd out here. i know you've been wondering about the judges. we don't have anything official on who the judges will be technically. the only judges that are still officially judges are cara and randy. we can tell you here's how it all works. all these people will head into at&t park on thursday morning at 5:00 a.m. they will try out, give their auditions before producers. if they make it past the producers they will go to another round of executive producers. if they make it past the executive producers then they'll actually go before a judge's panel. when that will happen we don't know and who will be on the panel we don't know. fox keeping a lid on that as they wait to make an official announcement. but that's the three step process before what you see actually gets on tv. >> and the third step.

we see some of the preliminary on tv when they begin the idol. that's the third step when they have the judges. >> reporter: when they actually go in front of the judges at that point they've performed in front of producers and executive producers and then go before the judges. a lot of steps to get to that point in particular. they'll sing on thursday and sing again past that round and then again and then again before they finally -- >> i thought she was out though. >> reporter: well, that is -- well, talking to fox people this morning that is what everyone was talking about that that was the rumor going around that she was out. >> found out through a news report. >> reporter: well , and so the fox people said out here that's officially not the case yet. no. >> all right. thank you. getting to the bottom of all of this. >> reporter: no problem. >> and sharing talent. all right. she's going to be out there all morning. who's going to judge is definitely a big part of the

show. everybody's anxiously awaiting. >> i want to see it. i want to see who's going to do it. good morning everybody. let's go outside and take a look at what we have now with the morning commute out to the live pictures. we will look at traffic moving along okay. but it's getting more crowded at the bay bridge toll plaza. as a matter of fact you can see traffic is moving along okay once you get on to the bridge because we have cameras on it. but for the most part we haven't had a big delay at the toll plaza. if you look at northbound and southbound 880 also more people as this is now what we were thinking now that school is back in we would see more people on the roads. as a matter of fact no major problems on 880. in the south bay 280 northbound that traffic moves along pretty well getting up to highway 70. oh, and there goes cal train just for steve paulson. some of the best tweets i've ever had were from angry people on cal train. but today we don't see any of those and cal train is on time.

imagine that. now go to steve. >> they do that for us, sal. you and me. >> i read them any way. >> i know. we have low clouds and in the fog again. now yesterday the inland areas warmed up. today they'll cool right back down. and the reason being there's more fog. southwest 24 at travis they have been up to 33 miles an hour yesterday was about 14. they've doubled that. west-southwest 6 at vacaville. napa west at west-northwest calm. everything calm in santa rosa. west at sfo and west at oakland. there's your sea breeze even with the low clouds making it out to fairfield. they're done. they'll drop ten degrees today. by the coast wasn't much of a warm up though santa cruz warmed to 77 yesterday. it's been a long time since i've seen over a 75-degree reading in santa cruz. yesterday was one of those days. today they'll cool right back down. this low coming in right there looks weak. that's coming in and ushering in a picking up sea breeze.

61 for a high in san francisco. that's below average as you might imagine. temperatures which were near average yesterday come right back down. average 68 for the city. not close today. 66 oakland. should be 74. santa rosa 74. should be 82 on the high side. mountain view 7 below average and san jose 10. 74, average is 84. warmest temperatures 99 and 100 for 1999 for santa rosa and san jose. mt. tamalpais and other areas running warm 72 degrees. if you're taking a hike or bike ride and leave the valley where it's 53 start heading up you're going to run into warmer air aloft. i expect that to cool down rapidly though. mid-50s for everyone else. in the mountains seeing low 40s low right there means a cooling trend as that begins to punch in and that is right near the oregon border. as it does that sets the stage for more fog and a stronger sea breeze. we're seeing both of those and that spells cooler today. good form maybe ten degrees

cooler. sunny, breezy to windy. cooler the biggest drops in temps away from the coast. 50s, 60s around the beaches. low to mid-80s inland. and lake county low -9d 0s. everyone else cools down. slightly warmer thursday and a big drop in temps friday and saturday. all right. 6:41. up next we'll have new information from investigators about the officer-involved shooting in burling game. >> reporter: car burglaries with a twist in the east bay have lessons for all of us no matter where we are. that story coming up as the morning news continues.

investigators say officers were forced so shoot and kill a 20- year-old man who threatened them with a knife. police have not yet released the name of the man killed nch police are asking for the public's help in tracking down two men who have been breaking into cars in a popular walnut creek shopping area. all happened at businesses at oak grove roads. ktvu is there collecting all the information on the story. good morning, tom. >> reporter: take a look other here. this is where some of the stuff happened where two shaved head white male criminals broke into about half a dozen cars about this time yesterday. today folks are being extra careful. and here's why. >> as opposed to seeing stuff lying in vehicles, i think they're breaking the vehicles and then searching for items. >> reporter: near oak grove before and after sunrise is busy. nonetheless, for two to three early daylight hours yesterday two crooks smashed windows to find swag.

>> i just usually put my things in my car, i mean in the trunk of my car and keep things out of sight that way nobody has a reason to break into my car. >> reporter: but previous victims of other boosts know it's mostly just the luck of the draw. >> they shattered the whole passenger or the driver's window. it was almost like they used some kind of device because it literally shattered into millions of little pieces and then they just went in and grabbed it. i don't think they opened the door. >> keep your car locked. laptops, your video stuff put up, cell phones, absolutely. i think those are the ones that probably the cars get broken into. >> reporter: now i did do a little walking around here earlier and what i found out was a lot of people have done exactly what has been suggested. there's very little in the cars in the way of gpss or even little cords sticking out of lighters that might suggest gpsa laptop or cell phone. they're doing a good job but reality is when you have random

lead time to answer. northbound 280 getting up to highway 17. that traffic is moving along very well getting into the valley. at 6:48 here's steve. i would say yes. also drizzle. low clouds, fog and much bigger fog bank today. and the sea breeze is really kicked up. it's double what it was yesterday. so that means inland areas will cool down. we have the system, that low right there spinning in. it's weakening as it moves in but heading in right near crescent city and eureka. that's starting to pick up the fog bank and increase it and also the wind. 54 in san francisco. 58 for 9:00 and at noon 61 for a high. 60s on the coast. 70s around the bay. low 80s for many areas that were in the upper 80s and 90s yesterday. inland still warm to hot. 52 napa to santa rosa. 90 las vegas at this hour. 56 sacramento. but fairfield's had gusts out of the west-southwest to 33

miles an hour. even vacaville has a sea breeze. that means sacramento will cool down a little bit. you can thank or blame however you want to look at it the low beginning to move in looks to be the first of three coming in over the next five to seven days. a very strong system on tap for the weekend to the north of us. cooler away from the coast. santa cruz 77 yesterday. 50s and 60s by the beaches. low to mid-80s inland. temperatures coming down a good five or ten degrees for some. slight bump up for temperatures thursday in advance of the system which digs in for a cooling trend friday and saturday. 6:50 is the time right now. home depot stock up more than 2% this morning after reporting second quarter income jumped 7% to nearly $1.2 billion. the home improvement retailer credits modest sales increases in north america along with improving sales in mexico and china. a decline in home sales hurt home depot a bit since home buyers tend to spend money on

items like new appliances and paint shortly after mortgages close. check in on wall street. home depot part of the dow jones index as is wal-mart which also reported a profitable second quarter. and taking a live look at the big board the dow jones up 58 points. and i'm taking a look at the nasdaq and s&p 500 where both of those indexes are posting gains as well. just about half a percent each. mcdonald's is looking for about 1,000 new workers today. the hamburger chain is holding what it calls a statewide hiring day. all the jobs are part time. but anyone who works 20 hours or more a week qualifies for the company's medical benefits. managers will conduct interviews and hire at most of the chain's 500 restaurants here in northern california. the jobs range from cooks and cashiers to management positions. time now 6:51. coming up on ktvu channel 2 morning news tell you about a new scam making its way through

see you then. facebook users should be on the look out for a new scam involving a fake dislike button. experts say there's a link making its way around prompting users to down load the nonexistent feature. but in reality it's being used by scammers to gain access to personal information. right now facebook does not have an official dislike button but chief executive said it might add one in the future. deadly accident is raising safety questions about a dangerous san francisco intersection. a suspected drunk driver ran over and killed a bicyclist friday night. many people who live in the area say the intersection could be the most dangerous in san francisco. it's a very busy street especially during commute hours. northbound it crusts into a blind intersection. >> just come over this little hill and you can't see these guys coming. it's terrible corner. >> we're aware of all of those concerns. we want to move as fast as we can to address those
