good morning. welcome to "mornings on 2." i'm kraig debro. dave clark has the day off. >> i'm tori campbell. it's tuesday, august 17th. an investigation is underway into the shooting death of an oakland teen. overnight homicide detectives interviewed his 13-year-old brother. ktvu's jay hernandez is at the police station right now with reaction from the family. good morning, jade. >> reporter: good morning. it's hard to imagine, the family is so distraught. a gun goes off, one brother doesn't survive. we're live in police -- in oakland at police headquarters. investigators are wrapping up talking to the 13-year-old who survived. the younger brother, you see here in this footage, wearing this white hoodie is in the

victim's brother. oakland homicide investigators released the 13-year-old into custody to his parents. we know the browers -- brothers were together when the shooting happened on filbert street. what we don't know is how the boys got ahold of the gun. we don't know when or even if charges will be brought against the brother. ktvu spoke to the parents and they told us that they are not sure they can even afford burying their son but they ask for everyone's prayers this morning. an autopsy report should be pending. reporting live from oakland police headquarters, back to you in the studio. we have new information on a story from the peninsula. burlingame police are now saying a man wounded in an officer-involved shooting has now died.

it happened near burr ling gate high school. investigators say officers were forced to shoot and kill a 23- year-old man who threatened them with a knife. burlington police have not released his name yet. san francisco police are reviewing surveillance videotape this morning to try to identify the person who stabbed a muni bus passenger. this happened before 8:00 last night at sunset and yorba street on the number 29 bus. police stopped the bus at 25th and fulton but the suspect had already gotten off by that time and fled. the victim was taken to the hospital with non-life- threatening injuries. it could now be months before gay and lesbian couples in california can legally marry. a federal appeals court put same-sex marriages on hold indefinitely while it considers the constitutionality of proposition 8. arguments are set for the 6th. reaction to the ruling was

mixed around the bay area. even though same-sex marriages are on hold, the plaintiffs are pleased they decided to execute the hearing for the appeal. >> i mean, how would you feel if you couldn't go in and see your husband if he were in the hospital, if he were in intensive care? >> those opposed to gay marriage applaud the decision for the emergency stay. >> i think everyone should have the same rights to do what they please. probably the division around it is calling it "marriage." >> some attorneys argue that allowing same-sex marriages to take place during the process could are would have created -- process could have created chaos. you can find more on the ruling at ktvu.com. click the gay marriage "tab on the front page. thousands of people are

lined up outside of at&t park in homes of becoming a star. ktvu's claudine wong has been talking with "american idol" hopefuls this morning. claudine? >> reporter: good morning. we're seeing some movement. we told you at 7:00 there would be wristband distribution. they've sectioned them off. these folks have been out here for hours this morning. the first of this group started lining up at dnight, although we're told that around 8:00 a.m. people started lurking around. i think they were only at midnight because that was the only time they were technically allowed to line up. we're making our way up and down this line because a lot of "american idol" hopefuls are here. this is season 10. if you want to tryout, this is the last chance to do it. a lot of folks are out here.

on what's happening on the roads. what's it like at the toll plaza? >> it's crowded. it's getting more crowded. it's backed up to the 880 overcrossing. metering lights are on. schools are in session. i think more people are on the road. also checking to see if there's anything reported on the bay bridge. it look likes the metering lights are on but they are slow. so that means there is a crowd. west 80 at treasure island. there is a stall, a minor delay, that was up there for a little while. not sure if it's still there. san mateo traffic looks okay. some of the planes coming into san francisco airport, if this overcast continues, may be delayed. if you have someone coming in or if you are taking a flight, go ahead and check on it. they may be instituting a ground delay. once you make it into

livermore, it's much better. if you are starting off in dublin, it's a nice drive to castro valley. highway 101 and 280 are off to a good start. here's steve. thank you, sal. the oakland airport hayes drizzle. it's heavy drizzle. so we have mist and drizzle along the bay. san jose, which was 79 yesterday, we'll go 74 today. just should be 84 this time of year. you can see the fog has moved well inland. even fairfield, southwest 26. they've had gusts over 33 and yesterday was about 14 miles an hour. that's about a big difference. oakland west at 9. sfo west at 9. napa west-northwest at 10. the low clouds are in place, the sea breeze is in place. temperatures will remain below average. they warmed up a little bit inland yesterday. the coast stayed below average. but today everybody donees right back down. cooler, breezy today. it looks like another significant cooldown as we head to the weekend as a really

strong system digs down from the pacific northwest. our cooldown is associationed with that low near cretin city and arcadia. it picks up the fog, squeezes out some of that drizzle and kicks up the sea breeze. san jose, 74. should be 84. 99, 1939. the record. mountain view, 70. oakland, 66. should be 74. not even close. in the city, it's 61. 53 to 58 here. 53 napa and santa rosa to 58. temperatures stuck due to the cloud cover. this time of the morning they are all in the 50s. it looks like the last couple of months. 50s and 60s up and down the coast. cool pattern for everyone from eureka dawn to san diego. sacramento will cool down. it may take another day before ukiah and lake county cools

there's a problems in the santa cruz mountains with an overturned vehicle, northbound 17 just north of redwood estates. this is being reported as an injury crash at -- just north of big moody curve, involving a tractor-trailer. the trailer is on its side. it's blocking both northbound lanes and also blocking one of the southbound lanes. this has now been turned into a sig-alert. so big trouble now in the santa cruz mountains. please give yourself extra time. if you drive, let's say, from santa cruz over to the valley,

this is going to ruin your commute. just be aware of it. 7:14. back to the desk. >> all right. we'll check in with you for updates. four u.s. servicemen were killed in afghanistan overnight. the pentagon says two of the americans were killed in a bombing in the east. the third died in a deadly explosion in the west. these latest deaths bring this month's u.s. death toll in afghanistan to 15. the iraqi military is blaming al qaeda for an attack in america's other war zone. sixty people have been killed in a suicide bombing targeting army recruits. there are at least 100 injuries. this is video of some of the victims. the attack comes days after america announced it's sticking to ending combat operations there at the end of the month. tapes have surfaced of one of the men involved in the 9/11

attacks. alison burns is live in washington, d.c. with a look at what the tapes reveal. allison? >> reporter: good morning. u.s. officials familiar with the tapes say they don't show water boarding or harsh interrogations, just a guy sitting at a desk answering questions. that guy is al-shabi. the tapes, two videotapes and and audiotape reportedly show him being interrogated at a secret prison in morocco. what makes this so significant is the cia had said all of the terror interrogation tapes were destroyed. but these were found hidden under a desk at the national counterterrorism center. the suspect is being held at guantanamo bay now. this is video we shot of one of the interrogation rooms there. his lawyers says the tapes will be extremely relevant if he ever gets a trial because they can show his mental state at the time. his lawyers maintain he has

schizophrenia. he reportedly provided information during these interrogations about a plot to crash planes into london's heathrow airport. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> thank you for the update. today, president obama makes his first visit to washington state since his inaugust gas station. when he appears -- inaeration. when he appears at a fund- raiser. he stopped in los angeles last night where he raised $1 million for the democratic candidates. he's on a fund-raising state across the country. 7:17. a little later this morning, the sonoma county board of

supervisors will consider approving a new hospital in santa rosa. sutter health wants to build a new 82-bed facility north of town near the wells fargo center for the arts. the company says it needs a new hospital because the old community hospital does not meet current earthquake safety standards. the new location would also provide easy access for medical helicopters. the site received preliminary approval at a meeting this month. today, treasure island will be officially turned over to the city of san francisco. house speaker, nancy pelosi, the u.s. secretary of the navy and mayor gavin newsom will all be on hand for the ceremony at 2:00. san francisco has a plan to erect a brand-new neighborhood on the grounds of the old naval base. there will be thousands of new homes along with offices, homes and stores. construction is scheduled to begin sometime next year. this morning the pilot of the container ship that hit the bay bridge three years ago is out of a federal prison.

john cota served a it ten-month -- served a ten-month accident that served 53,000 gallons of oil into the bay. cota was never tested for using medications. they blame heavy fog before the accident. solano county sheriff officials say the woman accused of causing a fire at a vallejo courthouse has committed suicide. the 40-year-old was one of two people arrested in connection with the june fire. she was found dead in her cell on sunday. authorities say she used bandages from a preexisting medical condition to hang herself. she pleaded not guilty to to arson and other charges. she was due in court this friday. alameda county sheriff deputies are looking through missing person reports this morning after human remains were found in the east bay

hills. a hiker diovered a human skull sunday afternoon on dublin canyon road near pleasanton. a jacket and blanket were also found near the bones. police are trying to figure out if foul play was involved. the wife of a slain virginia man is expected to be in oakland tomorrow night for a fund-raiser and to thank community members for their support. 45-year-old jinghong kang was shot during a robbery on webster street last month. he was in the bay area for a job interview at google. police have arrested two suspects. tomorrow night's fund-raiser will be held at the oakland asian cultural center on 9th street. it begins at 6:00 p.m. a popstar in trouble with the law. what charges the singer is facing because of a relationship she had several years ago. and google is facing more trouble due to its streetview mapping service.

mountains. >> not good because there was a truck that flipped over on moody curve, 17, santa cruz mountains. a lot of people, this is kind of the stealth commute. most of the time we don't have problems. foggy there, a truck flipped over and now the commute really is not doing very well. if you drive to your job in los gatos or san jose or anywhere in the valley from cruz or any of the cities nearby or towns nearby, this is a major delay. even going the other way, one lane is blocked. northbound 17 is the big commute direction. this problem is north of redwood estates right here big moody curve. let's take a look at 237. some stop-and-go traffic, driving to 101. at the toll plaza today, we have kind of a big backup. it's backed up for about a 15- minute wait. those metering lights are on. cooler today for inland areas. temperatures coming down. we have an increase in the fog

and also the sea breeze. received a tweet from someone who just ran by lake merced and said, man, it's cold. well, yeah, it's 53 and there there is a northwest wind at 12 to 17, gusting to 17. and there's drizzle. oakland airport says light rain. it's drizzle. even fairfield, west-southwest at 23. they've had gusts to 33 miles an hour. morning, fog, drizzle. cooler, breezy today. it looks like a big cooldown for the weekend. i mean, to the point where i looked at the projections on how big this system is digging into the north. i said okay, for august, that deserves a wow! everything is on track for it and everything is on track for the cooldown. fog, cooler, breezy to windy. mount tam, 72 degrees yet million ville and tiburon are 53. if you leave mount valley and head up to tam, you will go

in oakland, homicide police interviewed a 13-year-old boy overnight after his 15-year-old brother was found shot to death. no arrests have been made. it happened just before 8:00 last night on filbert street near san pablo avenue. police say the boy and his 13- year-old brother were at an

aunt's house when a gun went off. it's not clear how the teen was shot. police are still investigating. hayward police are investigating a drive-by shooting that left one person injured. it happened around 10:30 at a home on tyrone avenue. police say the shooter fired as many as three shots at a home. a person inside was grazed by a bullet but was not seriously hurt. hayward police are investigating a shootout near downtown that happened in broad daylight. police say people in two cars started shooting at each other at foothill boulevard and city drive. witnesses reported an argument followed by as many as five gunshots. no one was hurt. the man accused of sexually assaulting three women at a walnut creek apartment complex reportedly has family who lives nearby. 22-year-old-year-old antonio made his first court appearance

facing rape, reported rape and burglar charges. prosecutors say he had access to his mother's apartment but she says he hadn't been to her home lately. his girlfriend spoke about the charges. >> this is not his personality at all. these charges are ridiculous and just hearing him talking on the phone today, i know -- i know that he didn't do it. >> police say that dna evidence links muton to at least one of the attacks. he's due back in court and is expected to plea at that time. federal agents arrested two sex offenders when they touched down at sfo. the two men arrid from the phillippines on two different flights. one is accused of repeatedly abusing a sexual minor. the second is wanted for a warrant. 7:32 fairfield police have

released video of an attempted robbery at a cell phone store. it happened friday on north texas street. two men walked into the store and demanded cash. one was armed with a handgun. the storeowner quickly turned the tables on the two men, pulled out his own handgun and fired several shots. the two would-be robbers ran away apparently uncan injured -- uninjured. tom vary cars joins us with the latest on an investigation and reaction from shoppers. >> reporter: take a look over here. a lot more people are being a lot more careful keeping their eyes on their cars, because at this time yesterday, two white, shaved-head males smashed windows in a half-dozen cars in broad daylight. >> two white male suspects in their early 30s, they are asocialed with two separate -- associated with two separate

people's lives and they are driving people to do hurtful and bold things. >> reporter: it doesn't take much to tempt somebody. this isn't anything more than the end of a charger. if that's out in the open, it is suggested there could be a cell phone or laptop nearby. this could cause you to lose valuable information. be careful and don't carry things you don't need to. if you can bring them when you leave the car, all the better. tom vacar, ktvu channel 2 news. new this morning, general motors has issued a recall for 250,000 of its vehicles because of problems with their seat belts. the recall affects the traverse, the enclave, the gmc arcadio and the saturn outlook. all 2009 and 2010 vehicles. the problem is the second-row seat belts in those vehicles that could easily imagine -- damage and may not latch.

thousands of aspiring singers are lining knupp front of at&t park. auditions are not until thursday. but today, wristbands are bees drib butted -- distributed and they started to hand out the bands about a half hour ago. those people have been out there since midnight. after they get the wristbands they will be asked to come back next thursday. signups will continue through thursday morning at 8:00 a.m. around the clock. we'll check in live with some of the "american idol" hopefuls later this morning. we're also posting clips at ktvu.com. as students head back to the classroom, some high schoolers may be surprised to learn that they are facing new graduation requirements. the 4200 freshmen in the san francisco school district will now have to complete all

college prep classes before they can graduate. that means they have to pass 15 courses -- four years of english, three years of math, through advanced algebra and two years of foreign language. the school board approved the requirements last year and the class of 2014 will be the first affected by this. state education schools released results from the standardized testing and reporting program known as s.t.a.r. in spite of budget cuts, students approved two points by verbal and math schools. the s.t.a.r. program measures performance from the 2nd grade to the 11th. you can check out these s.t.a.r. test results for your area on our channel 2 website. just go to ktvu.com and look for the "right now" section. 7:37. we want to check in right now with sal castanedo for an update on that crash in the

santa cruz mountains. >> that's right. we have that problem in the santa cruz mountains on 17 northbound at big moody curve just north of the redwood estates. this crash involving a truck that overturned the back of the truck, the trailer flipped over. it's in the lanes and no major injuries. the commute is here -- is terrible drive. southbound there is one lane blocked. emergency vehicles are there. again, 17 big moody curve, big crash. moving along and taking a look at the been top. kind of a -- bay bridge toll plaza. kind of a big delay. now that school is back in we'll see more traffic here. once you get on 880 if you're drivenning on 880 -- driving on 880 this morning in the oakland area, i want to show you that traffic is going to be -- i guess we don't have 880. i will tell you that 880 near high street report of debris. someone sent me a tweet about all kinds of plywood in the

taking a live look at the big board on wall street, stocks are rising today after reports show wholesale prices climbed for the first time since march. there was a big jump in industrial productions. and good news from walmart, their section quarter profits grew 3.6%. ryeright now, the dow is up 5. the nasdaq is up 19, at 2201. there's mixed news on the

housing front this morning. the economist department reports new construction of houses increased slightly in july but the drops between may and june were deeper than previously estimated. housing starts rose 1.7% in july which is less than analysts had forecast and building permits, a leader indicator of future housing construction fell 3.1% to its lowest level since may of last year. mcdonald's restaurants around the bay area are looking for hundreds of workers today. the hamburger chain is holding a state-wide hiring day. anyone who works 20 hours or more a week qualify force the medical benefits. 500 restaurants in northern california and the jobs range from cooks to cashier to management positions. the post office will offer priority mail and express mail

previously available and the postal service is looking for ways to continue serving customers despite cutting 37,000 full-time workers. it's also looking to close hundreds of post offices and drop saturday mail delivery as cost-cutting measures. bay area police have an important warning for consumers. more and more identify thieves are using credit card skimmers. the numbers they use are getting more and more sphift kateed. over the -- sphift kateed. gas station atms are becoming an especially favorite target for skimmers. stanford university is celebrating the unveiling of the world's most powerful x-ray laser. the light source is a $420 million project funded by the department of energy. the ultrafast x-lay laser will allow scientists to take

pictures of adams and molecules. scientists hope the x-ray beams will get them a greater understanding of the fundamentals of chemistry and technology. a setback for wildlife in the gulf. scientists say they've now found toxic oil and dispersants on the floor of the gulf of mexico along the coast of florida. that means the impact of the oil spill has spread further than -- further east than anyone had thought. they found infected marine organisms 40 miles south of panama city. those organisms are found -- they are the foundation of the food chain. >> feeds and fuels the ecology of the ocean. and if those guys are in trouble, then the ocean's in trouble. >> so far, federal government scientists have downplayed the impact of microscopic oil making its way up the food chain. officials haven't responded to these latest scientific findings. one place where marine life is getting a clean bill of health

is louisiana where commercial fishermen are calling the first day of the shrimp season a success. shrimpers who went out say the fish were plentiful and there were no signs of oil in the fish. the fishermen do worry that no one will buy the seafood. louisiana's fishermen's industry bring in 2.5 billion a year. 7:47. today, senator dianne feinstein will speak at the lake tahoe summit. that's an event that focuses on preserving the threat from threats -- the summit reserving the -- preserving threats such as wildfires. they say lake clear is an average to 60 to 50 feet. lake tahoe 40 years ago was clear to an average depth of

rest of the truck coming up minutes. let's go back to the desk. homicide investigators interviewed a 13-year-old boy overnight after his brother was found shot to death. ktvu's jade hernandez is at the scene of the shooting with more of the family members. jade? >> reporter: well, actually, kraig, we moved from the scene back to police headquarters. but we did speak to the boy's uncle. he didn't feel comfortable going on camera. in fact, he expressed his shock over what happened. instead, he wanted to drive by where the shooting happened. that happens to be his sisterrary house -- sister's house. he says he still hadn't spoken with his sister about the shooting yet this morning. investigators pulled quite a few items out of his sister's house this morning. but at this point we don't know when or even if charges will be filed in the case. the family left oakland police headquarters last night. investigators wrapped up talking to the youngest

investigator who survived. he's wearing a white hoody. we know -- two brothers, es 15 and 3, were hanging out tooth at their aunt's house -- together at their aunt's house on filbert street in oakland. a gun goes off and the oldest brother does not survive. oakland homicide investigators questioned the surviving brother and released him into the custody of his parents. what we don't know is how the boys got ahold of the gun. ktvu also spoke to the parents last night and they told us they are not sure if they can even afford to bury their son and asked for prayers this morning. an autopsy report should be pending. we contacted oakland police and were waiting to hear back for more details in this investigation. reporting live in headquarters this morning, back to you on the desk. >> thank you, jade. two minutes after 8:00. we have new information on the story we've been following from burlingame. police say a man wounded in an officer-involved shooting has now died. it happened last night on

myrtle road near burlingame high school. investigators say officers were forced to shoot and kill a 20- year-old man who had threatened them with a knife. the shooting came after one officer fired his taser at the man. police have not yet released his name. several agencies are investigating, including the san mateo county d.a.'s office. san francisco police are reviewing surveillance video this morning to try to identify the person who stabbed a muni bus passenger. it happened just before 8:00 last night at sunset boulevard and yorba street on a the number 29 bus -- on the number 29 bus. police stopped the bus at 25th and fulton but the suspect had already gotten off and fled. the victim was taken to the hospital with non-life- threatening injuries. it could be months before gays and lesbians in california could legally marry. the court put the weddings on hold while it considers the constitutionality of proposition 8. arguments with

8:44. breaking news of a shooting at and near a dough campus near dallas. collin couy community college is about 30 miles north of dallas and there are reports of a shooting at the campus and near the campus at a police department. we hope to -- these are live pictures over the area. the campus is on lockdown right now. an e-mail alert sent about an hour ago to students and staff said shots fired, campuson lockdown, cops on the scene,

ring. they are reporting the suspect was shot and killed by return fire from the police. just moments ago police released new information about a deadly shooting in oakland. investigators are calling this a tragic accident. they have now determined that the 15-year-old boy accidentally shot himself in front of his younger brother while at their aunt's house. police say it's unlikely the aunt will face charges in this case. burlingame police say an officer wounded in an officer- involved shooting has died t happened last night near burlingame high school. investigators say the police were forced to shoot the 24- year-old man who threatened them with the knife. and police are reviewing videotape to determine who

stabbed and injured a muni bus driver. that last night -- that happened last night. gay marriages are on hold while the court considers the constitutionality of proposition 8. arguments are now scheduled for the week of december 6th. a ruling in ts case is not expected before the end of the year. now, following the case closely, margaret russell, joins us now to talk about the ruling. thank you for joining us. >> good morninging. >> what do you think about halting the marriages until the a decision is made? is it the right thing to do under the constitution? >> well, i think that judge walker's decision last week to say that the marriages could go forward was very sound and based on his reasoning in the case. however, i wanted to stress that it's not usual for the 9th circuit to do what it did, which is essentially to freeze the status quo before the

original decision was made to give them a chance to look at the issues. they didn't make any comment one wayor the -- one way or the other. >> which is interesting they didn't make any comments. as a professional law professor, tell us how is this case different from what we had prior to 1967 when the supreme court ruled and allowed interracial marriages. >> well, that's a very interesting question because the 967 decision had to do with virginia law that was actually used to criminalize interracial marriage and the couple in that case, a white man and a black woman had actually been told that they had to leave the state. they had to go reside in another state. so the parallel here i think is that the couples who are bringing the challenge are saying, we have a constitutional right that's equal to those. you're not criminalizing.

you can't criminalize our behavior and we don't want to be discriminated against just as that couple didn't want to be discriminated against. >> and then what do you think with this being a state-by- state matter, which it is right now, or will this or should this go all the way to the supreme court oe this is a united, federal decision all over the state. what makes this case different is that by arguing that all state laws have to comply with the united states constitution and treat same-sex couples equally it's making a very different argue that will apply across the board, just like the decision in 1967 applied not just to virginia but to every state. >> i mean, it takes it very difficult for a couple -- you know, a homosexual couple gets

campus near dallas. collin community college is on lockdown. according to one news station down there, no injuries have been reported from the campus but we're getting word from the police station in the same town that their building came under fire. we have suspects set to draw people out of the building and then used semi-automatic rifles to shoot out the front of the building. we've heard from a spokesman from the town of mckinney, that the police nay have shot and killed one of the suspects. we don't know if the two shootings are connected at all. no injuries reported from the college campus but one source down there is reporting that at least one suspect at the police station in the same town was shot and killed. 8:55. they've already lost their world cup bonuses. this morning several members of france's soccer team have learned they've been suspended. the french fed federation told
