up. 6:01. police officers say they had no choice but to shoot and kill a young burlingame man but this morning his mother is disputing the police report. tara moriarty is in that neighborhood where that shooting occurred and she has the latest on the investigation. good morning, tara. >> reporter: good morning. gladis says she wishes she never would have made that 911 call. the mother of the man shot and killed by police is now saying that her son would be alive if she had not. now monday night around 8:30 she says she called police in desperation. her son suffered from mental illness and had been drinking she says and refusing to take his medication. she called a social worker earlier in the day to see if he could be placed on psychiatric hold but was advised to call authorities. now when police arrived at the house they say he would not cooperate with them. they used a taser on him but he

continued to lung at police with a knife, that is when they shot and killed him outside the house. gladys however, tells a much different story. she says her son did not have a weapon and the two officers should never have shot him. the district attorney's office as well as the police department are launching an vision. meanwhile those two officers or on paid leave. we are waiting to speak with gladys herself this morning coming up later in the show. live in burr link gym, tara moriarty ktvu channel 2 news. >> san jose police are investigating two stabbings to see if they are connected. the first one happened last night at payne avenue and south winchester boulevard. police say a 17-year-old boy and a 19-year-old man were stabbed in the parking lot of a fooft food restaurant. for 1 victim the injuries are life-threatening. an hour later a 34-year-old san jose man was stabbed and he is expected to survive. police believe the attacks are gang related. the investigation continues. it is eviction day for the

san francisco dance club where a man was killed last month. the lease for jelly's was terminated after 39-year-old lee farley of richmond was shot to death outside the club. police say it started with an argument inside the club bull jelly's is denying that. attorneys for the club says they will continue operating despite the eviction notice. the issue is expected to end up in court. >> 6:03. sheriff's officials used a taser on a man who say they resisted arrest inside a courtroom. angel was jailed yesterday on theft related charges but as deputies were taking him into custody there was a struggle and a taser was used to subdue him. he is now facing extra charges of resisting arrest and battery on a peace officer. an autopsy will be performed they on an unidentified northern california man found dead while vaxing in hawaii. the body of the 38-year-old man was found in his hotel room.

his six-year-old son was in that same room but he was not hurt. police say there is no sign of foul play. >> a marin county resident could face severe penalties for the cutting of several trees at mac near's beach. the resident, whose name is not being made public, could be charged with vandalism and trespassing in connection with the cutting of the trees. a neighbor called sheriff's deputies after hearing investigators were looking for whoever cut branches without a permit. they could also reassess the property value of that home because the view improved av the trees were cut. >> police in venetia say daytime burglaries are on the rise. four homes burglarized last month. the latest on monday afternoon on west 14th street. witnesses say they saw a small gray suv near this house around 2:00. now the other burglaries happened on cambridge drive, casa grande street and cooper drive. all between 10:00 and 3:00.

>> today chp officers are conducting the second part of a crack down on drivers using cell phones. 900 drivers were cited during the first day of the campaign last week. today officers will for the only pull over people talking or texting. they say drivers will also be stopped for simply looking at their phones. violations include a fine of 20 dollars for the first offense, 50 dollars for convictions after that. s a saul pointed out earlier, its not really a 20 dollar ticket. >> it adds up. >> more like 100 dollars. right, sal? >> yeah, it more like 100 dollars, if it is your second could be up to 250 dollars. >> bottom line it is dangerous anyway. >> what if you are looking at your ipod? you know what? they can cite you for that too. >> -- road. >> -- unsafe. let's take a look at -- yeah, you can put off that metallic a song for a little

tough votes to support a stimulus that frankly has not created jobs that many american people were hoping for. >> reporter: but republicans are not fairing any better, in fact the polls show democrats are slightly more popular than republicans. live from washington, d.c., alison burns, ktvu channel 2 news. >> well, some scientists are disputessic the government's claims about the amount of oil that remains in the gulf of mexico from the bp oil spill. they released this video 40 miles south of panama city, florida. it shows droplets of oil floating in the water. they say they believe as much as 80% of the oil still lurks below the surface that contradicts the government's claims half of the leaked oil has either been collected or dissolved. there has been a shake up within the san francisco police department. two high ranking officer have been demoted. the president of the police officers association says assistant chief kevin cashman

and investigations commander john loftis were moated by the chief. both have ties to the crime lab where a former technician is accused of stealing drugs. both have more than 20 year, experience with the department. >> 6:15, alameda's fire chief is under fire, accused of gassing up his personal cars and having the city pay for it. david cap already, who earns more than $195,000 a year cass caught on camera filling up his bmw convertic and his honda pickup truck at the so i's gas pump. some firefighters took those photos thenceforwarded them to the mayor, who called cap already for an explanation. cap already says the free gasoline is part of the deal he made with the then city manager when he signed on as fire chief in 2007. >> 6:16 is the time. let's check back in with sal.

fog right down on the ground compared to what we had yesterday and the last couple of days. there are, though, cloudy skies above. the low clouds have lifted and temperatures are in the mild category. everything associated with that system right there spinning right up in the oregon area and tailing across northern california. so temperatures today now at the coast clear yesterday. the coast is clear. that was yesterday. santa rosa 77, we will go 75 today. 65 in thee city. there is too much of a west wind today. walnut creek from 83 we will go 79. oakland hit 70. we will go 68. san jose from 76 to 74. mt. tam is nine degrees cooler. the cool air aloft is in there. that will start to wipe out the fog. look at the lows, upper 50s, menlo park atthere ton 57, 58 pleasanton, that low goes through and another stronger system on tap for the weekend so slightly warmer tomorrow. today is kind of a push, 60s, 70s, low 80s, rather breezy plussery, the weekend looks on

flying that plane. the suit claimsly was negligent and should not have taken off in heavy fog. the family of the other victim may still file a similar lawsuit. well, hearing loss is on the rise among teenagers in the united states. a new study fins that 1-5, 12 to 19-year-olds have some trouble hearing, up significantly from 30 years ago. it hasn't been proven yet but some doctors suggest that listening to loud music through ear buds is to blame. they are urging teenagers to turn down the volume on their music players. a federal appeals court says a law that makes it a crime to lou about receiving military medals is unconstitutional. they sided with a southern california man agreeing the law violates free speech. two of the three justices there is no evidence that falsely claiming to receive a medal from the u.s. military is harmful. the u.s. attorney's office in l.a. is considering whether to

appeal. >> vandalism allegations have stirred up controversy in a city council race in san jose. councilwoman madison ngyuen n is running for eelection in district seven. min wong is looking to unseat her. someone tore down the signs. she showed us a text message she received she says indicates foul play. >> madison your volunteers or you have placed signs on my latino supporters. these signs will be removed tonight. >> there was a harm ms heat of the moment message that was sent out and my opponent took advantage of it and spin it off in the wrong way trying to convey herself as the victim in all of this. >>min n wong denies any wrongdoing and says it referred to signs at specific holes. police are still considering whether to launch an investigation. >> 6:26. people are being warned avoid

night at the home of an aunt. this happened in front of his 13 year old brother, who was not hurt. police say that gun did tot be long to his aunt. the boy's mother says she doesn't know how her sons got ahold of that gun. >> she just don't know if it is loaded or not and i don't feel anyone should have a loaded gun around the house. >> now yesterday family members and friends gathered on the football field of emery high school remembering him. he just had his 15th birthday this past saturday. he was supposed to begin the 10th grade this 340. >> this morning the chp is launching a second wave of its crack down on drivers using cell phones illegally. jade hernandez is in oakland with this new campaign. >> reporter: good morning. the california hands free cell phone law took effect a couple of years ago in 2008 put the chp says it is time to crack down on drivers ignoring the law. joining us this morning is trent cross with the chp, thank you for joining us this

we are live on the air now looking at an accident, a pedestrian was hit, apparently right near here by a police cruiser, a port motorcycle, near on brotherhood way. quite an extensive police investigation going on here. and let me just do this again. ask her to pull out, will you? can you pull out erica? i want to see a wider shot, please? all right. this is a look at the scene. i am just trying to figure out if they have this area closed off. and indeed they do. you can see that the street is closed here. at the very least one lane is closed for the police investigation. the person injured has already been taken to the hospital. the bay bridge toll plaza westbound up to the toll plaza middle of the parking lot not a big delay into san francisco. this morning on 880 north and southbound that traffic is moving along very well. 6:36 now.

here is steve. >> sal, thank you. good morning to you all. look at the visibility. seriously, i mean the fog right down here yesterday you could barely see your hand in front of your face has lifted up around 1500, 2 now feet and i am getting reports of i can see today. i can see out there this morning. reports from the city, from mt. tam. you can see mt. diablo, a low cloud deck. 1500 up to 2000 feet. there is also cool conditions in the higher elevations mt. tam and some of the others have dropped 10 degrees. so temperatures today inland upper 70s, low 80s, on the coast 60s, bay 70s, so low clouds, sunny breezy and windy. temperatures the coast cleared yesterday and temperatures warmed up. san francisco and oakland had decent weather finally.

the reason i am cooling it down is because more of a west wind. it will take the edge off some of the temperatures so santa rosa yesterday down three, 77, to 74, the city 64, san jose from 76 to 74. there is mount attach. 62. yesterday they were 71. that is a big drop. san enselmo 55 to pleasanton's 58. the lows have come up a good 5- 7 degrees san francisco two observations of 58. usually they are 42 the last couple of weeks. 60s up in the mountains, temperatures on the desert in the 80s, even southern california warming up, l.a., san diego, that is a heat wave compared to the summer they have had. those are the current temperatures. that low moves in and you can see a little band of that starting to move in, that is going to enhance some of that wind later on. after that goes through tomorrow does look warmer. not a lot. a very strong system digs down in for a rather significant cooling trend. i think it will be more wind than anything else towards the

of foul play. >> former governor rob black mag says he plans to appeal after being convicted of just one count in his corruption trial. the jury was deadlocked on 23 other counts. sandra endo is in washington to tell us why that the legal battle is not over yet. >> reporter: well, pam, it is certainly not over yet because let me break it down for you, 24 counts, 14 days. a jury finally came to the conclusion this convict the former governor for only one count. he says he is still fighting. former illinois governor rob black bag with just one vote shy of being found guilty for trying to sell president barack obama's old senate seat of the out of 24 counts the only charge that stuck, lying to the fbi. >> every charge except for one, they could not prove that i did anything wrong, that i did break -- that i did break any laws, except for one nebulous charge from five years ago. >> reporter: after 14 days of

deliberation the jury could not come to an agreement on the more serious charges which could have put him in prison for 20 years or more. instead the maximum prison he faces is five years in prison and a $250,000 fine. >> we did everything in our power, some people feel we were cheating the taxpayers or wasting the government's time but we all agreed there was nothing else we could have done. we have gone through things four, five times expressed our views were ri that have vowed to retry the case but he is not backing down. >> because this fight is a lot bigger than just me and my family this, a is fight for the freedom we as americans enjoy, the right to be able to be innocent -- the right to be able to do your job and to not be lied about so we are going to continue the fight. >> reporter: he declares this

good morning to you all. changes today. how so? high fog. the last couple of days-weeks it has been foggy drizzly. now the low clouds have lifted. significantly cooler temperatures in the higher elevations but at the surface mild conditions all osocietied with that low. that has kind of pushed in low clouds well inland. it has been a noticeably cooler summer but what everyone us talking about, at least a lot of people, the old water cooler conversations, the air quality and the visibility is unbelievable. you can see forever. the air quality has been great. the fire danger is low. your air-conditioning bill is low and your water bill as well. the negatives are those tomatoes are having a hard time and the -- [ inaudible ] >> -- san francisco 58. now i mean i.e.,-i think the

last three mornings, three weeks i should say, the low pat this time has been about 52. that is a huge jump. 58. so very mild conditions. the water temperatures have actually come up. sea surface temperatures mid to upper 50s. 59, 62, then 65. yesterday was 66. just a little bit more of a west wind. inland we will take the biggest drops in the temperatures. that is what happened yesterday. 60s, 70s, upper 70s to low 80s. mt. tam is 11 degrees cooler today than yesterday at this time. this is a huge drop. that cool air is moving in. the temperatures at the surface mid-50s, upper 50s, menlo park atthere ton 57, please son tan 58, tahoe 61. ukia 53. southern california temperatures are warming up. those are the current temperatures, usually in the 50s, now mid to upper 60s, so a mild pattern at the surface, a cool pattern aloft associated with that low is going to increase the low clouds and fog but also going to give as windy day later on. tomorrow we will get a slight
