and accessory were revealed. john is live in oakland tonight outside of police headquarters with the report. >> reporter: later this week andrew is expected to return. he's coming back from san diego where investigators say he confessed to shooting officer young. the 20-year-old man was arrested with a 23-year-old on saturday with insight of the mexican border 24 hours after officer young was shot. >> this is a dangerous person. it shows you mismind set as officers contacted him. he decided to shoot it out instead of coming peacefully. we are lucky no one is dead. >> reporter: saturday morning crime task force moved into union city hoping to find him and anyone helping him. today we went to the house where an alleged accessory was arrested. her family declined to comment about the case. police tell me this neighborhood is well-known for generations of gang activity.

we are still doing an investigation on other people that could be assisting him on getting their way. >> reporter: officer young is still in the hospital where he underwent another surgery yesterday. as of late this afternoon hospital officials say he remains in critical but stable condition. his fellow police officers continue to hold vigil for him. >> he has possible damage to his stomach and large intestines. i think they'll approach the stomach issue tomorrow. >> reporter: we found these court documents that indicate he has a history of resisting and running from police. we do not know when they are returning from san diego. but he is scheduled to appear in court for arraignment tomorrow. live in oakland ktvu channel 2 news. a community meeting is taking place in san jose following a recent spike in violence. it comes as the city continues

its search for a new police chief. deadly violence began last friday night when a woman was killed in a domestic violence dispute. saturday night two young men were shot to death in a parking lot. officers shot and killed a man sunday morning when he allegedly confronted them with a 10-inch knife. family and friend top victim say they hope a new chief will stop the violence. >> anywhere you go -- you might not know, it might be your last day or not. people are just gone like that. >> the surge of violence expect expected to be a topic at the mooting tonight. a man has been sentenced for killing matt garcia. he received 50 years in life. the other suspect's sentencing

was delayed. the council man's mother told the killer he was the person garcia wanted the help. garcia was shot in september of 2008. he was mistaken for a drug dealerring over $50. the state assembly passed legislation that will wrap up penalties for sex crimes. chelsea's law goes to the governor for the signature. it will increase penalties for a wide variety of sex crimes. it includes life in prison without parole. it was back to school today for thousands of students in the oakland school district. this school year, despite serious budget problems and the possibilities of a teacher strike school administrators say there is reason for optimism. we are live in oakland with the report.

>> reporter: oakland schools begin the new year with a $120 million less than last year. teachers are still working without a contract. officials say last evening they tagged the middle school of east oakland. school district staff worked into the earlying morning removing most of the graffiti before the students arrived. >> this is a place to learn. not to have to worry about gangs. >> reporter: despite the challenges that appears to be on the rise. for once a low-achieving school with a bad reputation they increased test scores in reading and math. the history class will be high-tech. >> we'll get net books forking every kid. we have smart boards here. this changes teaching big time. >> it will be a wonderful year. >> reporter: as the

of this year's legislative session lawmakers are prepared 8vsmotions z trying to pass a new budget. democratting and republican party leaders say tomorrow there will be vote on the opposing budget plans but neither proposal is expected to get two thirds vote needed to pass. this is now the fourth longst delay in getting a state budget in california history. if nothing is passed by this friday it will be the third latest budget on record. food and drug administration released third findings in the on-going investigation of two iowa farms linked to the tainted egg recall. reports say both farms have g9éq numerous violations including rodent, bug and bird infestation infestation. uncontained manure could be factors in 1500 cases of salmonella poisons. positive samples of salmonella were found another at the farms. in the bay area another
