what's at issue before the richmond city council tonight is not just about keeping schools open but about keeping students safe. candy high school is one city council vote away from closing at the end of the school year. the problem is money, the school district doesn't have enough to keep it and two elementary school open, so it's asked the council for a bail out. if the council votes no, linda elementary school and kennedy high would close in june. the students would go to school elsewhere and school officials worry that could cause more problems. >> tensions, and i'm concerned. >> it could create problems, moving thousands of people, seating would be a problem. >> reporter: kennedy high seems to be the biggest concern. many students worry about going to a school in what they perceive as a hostile

neighborhood. >> schools other than richmond, don't like people from this region. we would create a melting pot between two schools, there'll be a lot of fights and differences would come about. >> reporter: though richmond city council bailed out the schools last year. she's open to having the city enter into a partnership with the school district. the district has money but it can only go toward construction and repairs. >> the school district will help schools on their projects. such as a new roof for our richmond swim center. >> reporter: the mayor says the city has the funds to help the utility settlement with chevron. the vote again is expected this evening. reporting live, rob roth ktvu news. just two weeks into a new school year some nevado students are being moved around

because their classrooms were overbooked. the nevado school district says 20 to 30 students are being transferred this week. the district is limiting kindergarten to a 20 student minimum. the man accused of shooting an undercover freemont police officer was met with a sea of blue today at his arraignment. 70 off duty officers packed the courtroom as the attorneys for andrew baientos waived the reading of his charges. barrientos admits to committing the crime but says he didn't know young was a police officer because young was not wearing his uniform. >> whether this is a tragic misunderstanding or a tragic incident remains to be seen. >> reporter: officer young

remains hospitalized in serious condition. the pain staking search of a landfill in pittsburgh will continue tomorrow as investigators attempt to bring closure to the family of fredrick sales. today was the fifth day the teams combed through trash searching for clues or the body of sales. his disappearance is likely linked to a strange string of killings last week. efren valdemoro is accused of killing sales father, his girlfriend and two women. the chp says tran's cell phone records prove she was alive during the chase. investigators say valdemoro managed to strangle her with a rope while evading officers. six newly sworn in officers

are hitting the streets in richmond. >> congratulations. >> reporter: just graduated from richmond's police academy. three of them are former vallejo police officers. the city of vallejo has lost 13 officers over the past year due to budget cuts. a day after mark hurd took a top job with oracle, hewlett packered is suing hurd. he received a $12 million pay out but apparently did not sign aagreement to prevent him from going to a rival for a set period of time. >> the question arises why did they not get a noncompete agreement from mr. hurd that could have been enforced against oracle and mr. hurd. >> hp is trying another approach now and that is to approach an agreement hurd has with hp to trade secrets. hp says hurd's job is a

conflict of interest. just minutes after it started, the board of supervisors meeting came to a screeching halt and a long list of agenda items including some votes were put on hold. david stevenson is in san san francisco now to explain what happened. >> reporter: a clerk's simple problem led to a problem with this newspaper and an embarrassing cancellation. the san francisco board of supervisors first meeting after a summer recess was overjust seconds after it started. >> mr. president, before you hit the gavel i would like to apologize to the members of public for this error and the resulting cancellation of this meeting. >> reporter: the problem, notice of the meeting was not published in the examiner newspaper. board clerk angela calvillo said they hit send for the posting but the e-mail didn't

make it. the sudden cancellation caused confusion. >> i can hardly believe it. >> reporter: supervisors were supposed to hear arguments on a new store and were supposed to hear a tax on alcohol. >> we were looking forward to vote today but we will definitely get this thing passed. >> we will take all these agenda items and have a really long meeting next week. >> reporter: supervisors say the delay won't endanger any legislation and said it'll be business as usual next week. >> the city and county of san francisco is going to continue to function perfectly fine without the board meeting on this particular tuesday. >> reporter: the board had the operation of schedules an emergency meeting for friday but that would have meant a posting for the meeting by

tomorrow. they opted to move all business to next week. the issue of furlough and state workers goes to the state supreme court. the high court will hear oral arguments on whether the government has the right to furlough state employees because of the budget crisis. over 2,000 workers could be affected. if the governor wins, the executive branch would get unprecedented authority. if the court sites with workers, they stand -- if the court sides with workers, they stand to -- >> they have to bring down the level of spending to sustainable level without

raising taxes. the latest budget in california history was passed on september 16th 2008, so far this legislature ranks second on the list of late budgets. governor arnold schwarzenegger put his money where his mouth is sort to speak in an effort to get people to eat california grown eggs. the governor visited a sacramento market, and he ate two deviled eggs which he seemed to enjoy. california eggs have taken a hit because of the salmonella outbreak. there are new develops tonight involving whooping cough. a new report shows doctors were slow to diagnose eight infant whooping cough cases that resulted in death. now the state's health department is urging doctors to be more aggressive when it comes to diagnosing the

bacterial disease. sal castaneda has this story. >> reporter: we found out that san mateo health officials are being more aggressive with the whooping cough epidemic hoping to stop more cases. going to the doctor may not be enough, the doctor has to properly diagnose the problem. >> he recently had a big cough and we took him right to the doctor's office and make sure something more serious was not going on. >> reporter: california immunization officials found some of the deaths may have been avoidable if physicians had administered immunizations sooner. >> it seems to me it should be much more incorporated into routine visits. >> reporter: in san mateo county there have been 61 cases

a key metropolitan transportation board will vote tomorrow on whether to allocate $20 million for building a tram. today two transit advocacy groups rallied against the project saying bus express lanes would be cheaper. >> we're now talking about $500 million for a little 3-mile cable car that takes you to a parking lot. and to help pay for it, bart is

going to go into debt and charge you a higher fare. >> reporter: the law requires all ships entering or leaving the bay be under the command of a bar pilot. today those bar pilots did drills to save themselves off the treacherous waters where they board and unboard those ships. >> reporter: man overboard, in midday early this morning, san francisco bar pilots conducted drills with the latest equipment available. >> this helps us become familiar with the equipment we use during an emergency. >> reporter: the bay is a warm bathtub, out there it's dangerous 24/7. whether loading or disenbanking, the pilots must use rope ladders.

import and export make it to port. i'm consumer editor, tom vacar, ktvu channel 2 news. the department of fish and game says so far no wildlife has been affected by an oil spill in the petaluma river. crews worked overnight to remove the remaining oil from anology tug boat that leaked over 600 gallons yesterday. officials say the sheen which stretched for about 2 miles mostly evaporated. the crews will remain on the scene until the area is restored. word is starting to surface tonight about possible negligence, we'll have more on that tonight on bay area news at 7:00 on tv 36. police have released a sketch of a man they believe is a firebug. he's described as a slender

latino male, 19 or 20 years old. the fire's first started in may, they involved outside debris, dumpsters and vehicles. in one case, a man sleeping in a car had to be rescued by fire crews. at this hour, firefighters are working to contain a 700- acre wildfire burning in humble county. it has already consumed one home. the fire which started yesterday is burning on buckeye mountain just east of petrolia. right now officials say it's only 5% contained. no injuries have been reported, the cause is under investigation. now early this morning a calfire strike team from sonol was deployed to cover duties for crews headed to the fire. >> it's very steep country, very rugged, very remote. sometimes very hard to get some kind of containment on fires up there. >> the batallion chief says the area provides the perfect combination of fuel, timber and brush. we were baking yesterday.

today the temperatures really came down. we were talking earlier, possibly some drizzle in the area. >> that's sort of the buzz in the weather center. the chance for precipitation. it will be cooler still tomorrow, you can see the heat being chunted to the east. the cooler air is moving into the region. we have clouds over most of the area. partly cloudy, mostly cloudy. the forecast as we go through time will be a little cooler tomorrow. that chance of a sprinkle as high pressure weakens. a low pressure comes in that keeps the cooler trend in place. numbers will come up just a little bit as we head into thursday and friday. cooler in san jose tomorrow. don't anticipate drizzle in san jose, anticipate drizzle right
