it is thursday, senate 9th. a fight outside an oakland home. we have more from the open police station. >> the woman remains in critical condition this morning. she opened her door last night and was shot three times. they don't believe -- police don't believe she was the intended target. we're live. we're waiting for an update. we know that a fight in front of this woman's house, involving someone who lived there may have led to the woman opening that door and being shot. about an hour ago, we drove to the house where she was shot and spoke to a man who lives across the street. he told us he heard 30 shots from what he thought was an assault rifle. and says he hit the ground immediately. it was around 10:30 last night in the 1200 block of 87th avenue. after getting up and making his way outside, he saw family members running out of that house, screaming, they shot mama.

police are not releasing any information about the woman. but the neighbor told us, he thought she was in her 50s, living with her large family, along 87th avenue. the man said he had just moved into the neighborhood and hadn't had any problems. so this scared him. paramedics did take the woman to the hospital. and as i mentioned, she's in critical condition. we're live at police headquarters this morning. notice arrests so far. but again, we are waiting for an update from police. reporting live, jade hernandez, ktvu channel 2 news. police in oakland are looking for two other leads. they both took place about 9:45 last night. and one of the shootings was deadly. the fatal shooting happened near a gunfight at 45th and international. police say one man was killed, another was wounded in exchange for the gunfire. the wounded man drove all the way to the hospital in tracy

for treatment. his condition is not known. the victim of that second oakland shooting drove himself to highland hospital. police say he was wounded in a shooting on the 4200 block of foothill boulevard. he is expected to survive. as we mentioned, both shootings happened at about the same time. but police do not think they are connected. time now, 7:02. fireinvestigators want to know why an oakland apartment complex went up in flames twice. for the people who live there, it is a devastating loss. kraig debro is live at the scene. >> reporter: good morning. fire investigators are trying to figure out the cause of both fires. one was accidental, the second, they're not sure. meanwhile, one of the people who lives here, he just returned to the scene. he feels like he's been victimized twice now. >> we were worried about that. because i was like, is there anybody in there? i don't know. and then he stopped and said, i thought it was cool to watch, as long as you knew nobody was getting hurt.

>> now, this morning, fire started around 3:00 a.m. in the morning. and firefighters responded here. they put the fire out, between 20 and 30 empties. 30 minutes. nobody was inside the building at the time. that's because there was a fire in this very same building yesterday at 1:30 in the afternoon. i spoke to the man. he told me he had put a roast in the microwave and came back three minutes later to find that part of his apartment engulfed in flames. he got his mom and two brothers outside of the apartment as well as one of his nephews, who has a physical disability. and knocked on a neighbor's door out of the building. they come back here this morning, in order to pick up the rest of his belongings, only to find out that they are gone now, too. >> i'm a little upset now. because i was planning on coming back to get my mom's clothes and stuff. so it's kind of hurting. when we seen her this morning, she started crying again. and it kind of hurt me. that's why i came over to merely see if i could rescue

anything that is left. >> we were worried about that. i was like, is there anybody in there? and he stopped and said, i thought it was cool to watch, as long as you knew nobody was getting hurt. >> if you take a lo at a live picture, you'll see the man i spoke to. his name is al barfield. he lived in the upstairs apartment with his two brothers and his mom. and as i mentioned, there was a nephew here as well, with a physical disability. he had come back here this morning to pick up the rest of his belongings here. as you are looking at the apartment building, just the debris of the fire, it's people's lives, their clothes, their bed, even creature comforts like stereos and tvs. it's all right here. mr. barfield told me that the red cross put them up, they got him a voucher and gave hims him a place to stay. but now he's finding out that more of his life is down here on the ground, destroyed.

reporting live, kraig debro, ktvu channel 2 news. a woman was hit by a car, when she ran into the street, chasing a toy. antioch police say yesterday evening, the girl darted into west 6th street, near c street, right into the path of an oncoming car. the driver tried to stop and swerved, but still hit the girl and knocked her to the ground. the girl was flown to uc davis medical center. time now, 7:05. pro football super star tom brady who was a bay area native, was involved in a car accident this morning. in fact, a short time ago, we received this video from the crash scene. you're looking at downtown boston. tom brady was reportedly shaken up, but he was not seriously hurt. he was treated there at the scene. police say he was driving a sedan that collided with a van. emergency crews had to use the jaws of life to get the driver of the van out of the wreckage. but his injuries are not considered to be life- threatening. now, the new england

patriots say brady will be at the team practice today. the superstar quarterback grew up in san mateo. he's a graduate of sera high school. he's led the new england patriots to three super bowl championships. several people will be inspecting the truck today, to see what went wrong when it lost control on an off-ramp. it happened on a grand avenue off-ramp. the truck driver, who only identified himself as "tony" says he was on his way home and was traveling about 45 miles per hour on the exit ramp when his brakes went out. and he scrambled to try to avoid the vehicles in front of him. >> i just watched it go out of my way like this. but i could see the people in the cars looking back at me, like oh. okay. scares the daylights out of me. >> four victims were transported to the hospital. none, though, suffered life-

hashanah, the celebration of the jewish new year. police are now asking for help to identify the person responsible. the state supreme court refused to order governor schwarzenegger and attorney general jerry brown to defend controversial proposition 8. the conservative legal group, pacific justice institute, filed the lawsuit last week. they wanted the court to make schwarzenegger and brown appeal last month's ruling to strike the voter-approved ban on same- sex marriage. but attorneys for the governor and brown said the two should be able to choose which laws they challenge or defend. a six-day trade mission to china, south korea and japan. he's going, even though there is no agreement in sacramento or the new state budget. the governor says this was scheduled months ago, and that international trade is an important source for new jobs in k. the governor and -- in california. the governor and legislators are saying they will be able to

year. but that's after much debate over whether the rule will apply to the council itself. while some felt they should follow the same rules, most felt because they are elected and not hired, that fingerprints were not necessary. senator barbara boxer is distancing herself from an economic adviser who was arrested on marijuana charges at a senate office building in washington. the capital police say marcus stanley was trying to hide a leafy green substance, as he was going through security yesterday. that substance later tested positive for marijuana. stanley quickly resigned. senator boxer says his actions are unacceptable. all right. 7:20. 75. silicon valley leaders want to play ball. they're putting their influence together in a new effort to get the a's to the south bay. also, the one reason organizers say they're being forced to call off a popular san francisco festival. northbound 101, traffic is

well, san mateo health officials have given the all- clear to this redwood shores lagoon where 48 gallons of sewage spilled two weeks ago. they say the water now meets the minimum qualifications for safety and is safe for people to use the cleanup has cost about $140,000 so far. but the city is expecting more bills for pipe repairs and testing of the water. they are using influence to help speed up the process of trying to move the oakland a's to san san jose. just signed a two-page letter for commissioner bud selig, urging timely approval of the

a's relocation. includes john chambers, yahoo's carol barts it is prachtion the most they are studying a move about whether the a's would encroach on the san francisco giants' territorial turf. not getting much love from the city this year. organizers decided to cancel this previous years because of overcrowding and other security concerns. the city says that the event was dangerously overcrowded. organizers say there is just not enough time to adequately plan it there. sal, are you showing love to the morning commute.

>> you want me to? >> yes. >> well, yes, i am kind of showing some love. it's not as bad. yesterday, we had that meltdown on 580. as a matter of fact, if you look at some of the traffic pictures here, it's going to be okay. as a matter of fact, we don't have too much going on. it's out of the ordinary. although certainly things have fired back up again for the fall commute. not technically fall yet. but i think a lot of people on their schedules it's fall. you can see that there's some sort of a stalled vehicle there. in the middle, there's flashing lights out of the way at the toll plaza. moving along to 880, north and southbound. that traffic is okay here. at the coliseum, with no major issues. as a matter of fact, we have been looking at the commute on 880 and 580 on oakland. and we haven't had any big traffic problems. 280, on the other hand, getting some slow traffic into the valley. northbound 280 traffic is backed up out of downtown. and it doesn't get better until

it is 7:30. police say a woman was critically wounded during a shooting in oakland jade hernandez has more on what led up to the attack. good morning, jade. >> reporter: good morning. it is bad enough when you hear gunshots outside of your home and then you find out it's your neighbor. this man lives across the street from a woman who was shot around 10:00 here in

news. concord police are investigating a shooting at a parking lot of a strip mall, on monument boulevard. the incident started last night, with an argument between two groups. police say at some point, a man grabbed a gun from his car and opened fire. but there is no word if anyone was hit. the shooter and his friends fled in a dark suv. they were last seen driving east of monument boulevard. in the meantime, concord police may have a hard time identifying two armed robbers. witnesses claim the gunmen wore pillow cases over his head at a mcdonald's. it happened at the park mall. investigators say the two gunmen walked in, jumped over the counter and cleaned out the cash registers. despite being linked to a bizarre homicide case. charms writtenhouse posted bail, after it was dramatically

reduced. ktvu's claudine wong joining us to tell us why the bail was reduced. >> reporter: good morning. it has been a quiet morning here. behind me is the home of charles rittenhouse. there are gloves on the driveway. private property signs and no trespassing signs that have been put up. and even some crime tape still on the fence. no sign of rittenhouse. but i can say he has rejected requests for interviews. he is out on bail this morning after posting a $25,000 bond. that $25,000 dramatically different figure from the $2 million bail that had been originally set. the number was reduced yesterday after the prosecutors told the judge that the office would not be filing any additional charms, at least -- charges, at least not any time soon. that did surprise rittenhouse's attorney. what that means is he is only facing charges for having explosive chemicals in his home. he is not facing charges in connection with the death of his wife and her friend.

the bodies of those women were found on august 31st, one inside the home and one in the backyard. rittenhouse had filed a missing persons report for his wife earlier. that night, he returned home from work, and police showed up a few minutes after to follow up on the report. but once inside, police found the bodies and initially believed that rittenhouse might have been living there for days with the decomposing bodies. but rittenhouse's attorneys argue that the bodies were placed in the house while he was out that day and told the chronicle that he had no involvement. and said the fact that he's been put in jail while mourning the death of his wife, is just unimaginable. a friend new rittenhouse. but neighbors say he had been stalking the couple for years. police are still trying to figure out how baldemmoro, who

was fatally shot last week, could be connected to the death of the women. they believe in the days surrounding their discovery, baldemmoro killed as many as three other people. live in vallejo, claudine wong. a week-long search tied to the case is about to resume in about 30 minutes from now. crews will go back to a pittsburgh landfill at 8:00 a.m. they'll keep looking for the body of a missing hercules man. frederick has been missing since his father was found dead on august 27th, inside their home in hercules. investigators say baldemmoro may have killed both men and then disposed of frederick salas' body in a dumpster. it has been 90 days since someone shot and killed a respected community activist in the parking lot of a hillsdale shopping mall. and the case is still unsolved. last night, about 40 people held a vigil, remembering the victim. 54-year-old david louis. louis was well-known for his

work in helping recovering addicts and parolees, trying to reenter society. police say that night he was shot in the back as he was going into that mall. >> i think it was somebody that actually was still in the disease of addiction, and you know, probably couldn't help the guy. >> the volunteers also went through the shopping mall, passing out flyers and letting people know there's a $50,000 reward to solve this case. louis's friends say they will not allow this case to go cold. 7:36. a plan to open a new center to help state parolees is causing some real concern. in one oakland neighborhood. planning commissioners have already approved the project on telegraph avenue at 33rd street. it's in the koreatown, northgate neighborhood, north of downtown, which is home to an increasing number of new restaurants and businesses. the neighborhood's district board has voted to appeal the planner's decision, saying the

center would hurt revitalization efforts there. those for the nonprofit centers say it will ultimately reduce crime in the neighborhood. the nonprofit center is designed to give parolees training and skill to find housing and jobs. time now, 7:36. a santa santa cruz man is waking up behind bars this morning. this happened about 6:00 between watsonville and moss landing. surprise witnesses say they saw things being thrown from a white vehicle, and the door opening and shut several times, before the woman was allegedly thrown out. 48-year-old james pollard was arrested after a short chase on several charges, including do domestic violence, and drunk driving. that woman suffered scrapes and bruises. a former member of the golden state warriors is now facing charges of domestic violence. matt barnes, who you see in this picture, was arrested

after sacramento sheriff's deputies received a call from his home that was interrupted. when they got to the house, they found both barnes and a woman with injuries. barnes was taken to the county jail. he did post bail, and he was released. he is scheduled to appear next monday. matt barnes is now a member of the los angeles lakers. 7:37. the number of people killed in a number of traffic accidents has dropped dramatically to its lowest level in 60 years. the transportation department says about 34,000 people died in crashes last year. that's almost a 10% decrease from the year before. the drop is due to more people wearing seat belts, fewer drunk drivers, and vehicles with better safety features. >> that's good to hear. >> yeah, it is good. time now, 7:38. let's see what sal is doing on the roads. how are we doing. >> we're doing okay. i think today is a better commute than we had yesterday. today, we have routine backups

and freeways that are not doing all that well. we're starting with 280. it's a little slow coming out of the valley and getting up to highway 17. now, 85 is also slow. in fact, i would say 85 is slower than 280. so i would still opt for 280 if i were driving that route into the valley. moving along and taking a look at the commute here on the approach to the bay bridge. looks pretty good here. driving out to the toll plaza. we're looking at interstate 80. pinol and richmond. it's beginning to slow down to about el cerrito. it's going to be mostly under the speed limit, as you can see by our road sensors. no major problems, though, when it comes to accidents or stalls. 7:39, here's steve. >> all right. thank you, sal. and before i forget, tracy in petaluma says it's chilly at 51 degrees. but they are mostly clear in the north bay. head a little south. and more clouds and fog. there was only patchy low

clouds. san jose, kind of a mixed bag. some low clouds and some sun. we have low clouds that will be mostly sunny today. breezy. as we head into the weekend, the fog will still be hanging out by the coast. we will see warmer weather inland. especially back into the 80s. probably not the 90s. next week, another low will drop into the negotiate again. cool. and another possibility of a stronger one thursday. let's jot it down. that's what our forecast models are doing. and they're both in sync on that. they're both saying, yeah, we'll get another cooldown next week. look at the low clouds, screaming down the coast, coming out of the northwest. there was yesterday's pop of rain. pretty cool. that moved out. and the low clouds left behind, along with cooler temperatures. 57 and 62 at noon. high today of 63, which is one warmer than yesterday. low clouds and cool. temperatures, they bottomed out yesterday. they were in the 90s monday. remember? oh, yeah, i remember.

are likely to stay for the rest of the year. the new issue of the farmers almanac predicts that the earth will continue to cool in the coming months. for california, this really won't bring a drastic change. we'll likely see a mild winter with average rain. the eastern half of the country, though, will experience lower-than-normal temperatures with less snowfall. good news this morning about jobs. and as another disturbance breaks out in l.a., over an officer-involved shooting, there are troubling reports about the officer in this case. and a disturbing trend in urban violence is the fact that so many young people are involved. but there is one basic key that is needed to reduce that.

checking a live look on the big board on wall street. numbers are up this morning. mainly due to a drop in jobless claims. we'll have more on that in a moment. right now, the dow is up 53 at 10,440. nasdaq is up 12. and s&p up 7. and apple is higher now, as is adobe after an announcement that the use of adobe flash for iphone and ipad applications. the cupertino company will now low -- allow the use of flash for design. but that does not people on the devices will be able to see flash animations. it only means developers can build apps in flash, and then convert them to apple-friendly

code. and adobe is up 9% on this news. and the labor department reported good news on the labor front. first-time claims for unemployment insurance dropped to $451,000. that's -- 451,000. that's down 27,000 from the previous week. and continuing claims were also down slightly. 4.48 million americans are now collecting unemployment benefits. but the jobs market is still weak. and an increase in hiring is unlikely to happen soon. a long-debated plan to extend bart to the airport is still on track. the board of directors has approved spending, $20 million in state funding for the $480 million project. it was actually the metropolitan transportation commission that approved it. the new rail line would replace the current bus shuttles. and supporters say it has the potential to create up to 5,000 jobs. i'm excited.

i am so happy. this project has had more stalls and now we are moving on track. >> but opponents say the project is too expensive and can put bart further into debt. bart says the next step is to get approval from the california transportation authority. and they need federal funding. about $130 million in grants and loans. there was more protesting in los angeles overnight about the death of an armed man, shot and killed by a police officer. now, for the third straight night, this was the scene in downtown l.a. yet officers out there trying to control the situations while protestors were setting more fires. all of this comes as the l.a. times reports that the police officer who shot that man was involved in two previous shootings, while on duty. >> an oakland teenager has been charged with murder for shooting a skyline high school student who was killed, celebrating his 18th birthday

last spring. the suspect, john michael martinez, was 17 years old when the victim was killed, though he is being charged as an adult. police believe martinez tried to crash erics tocano's 18th birthday last march. police say when he was turned away, he opened fire, killingsings to -- killing toscano. martinez has been charged with murder and a special circumstance for the drive-by shooting. he's in jail now, being held without bail. time now, 7:48. according to the statistics, there is a new rise in the area of teenagers getting shot or doing the shooting. but more than 400 shootings in oakland so far this year. 115 of the victims were minors. and about a third of the suspects were under the age of 18. police say both teens and police say part of the problem is it's too easy to get their hands on guns. >> i could do it right now.

>> how would you do so? >> you would just go ask around. even though there are people. like, i need to buy a gun. and they're like, okay. i got you. i'll hit you back later. >> activists who were involved in finding solutions in this say half the battle of keeping children safe is making sure they stay in school. they're suggesting tougher truancy policies and more after- school programs to keep young people out of the crossfire. it is 7:48. we've got an update now on a story we have been following. the san francisco planning commission has been voting to allow the only gun store to reopen. but with certain conditions. opponents fought to prevent high-bridge arms on mission street from reopening, saying the store is too close to schools and homes. the store's gun dealer license expired in january. the commissioner decided the gun store owner must provide extra security, including security cameras and gun safes when it reopens for business. well, a popular oakland bakery that closed down last

july is back open under a new name, as of this morning. but with many of the same employees. what was once melvin's bakery on telegraph avenue is now called a taste of denmark. three former employees formed a cooperative and reopened this bakery, just about 45 minutes ago. and they're giving away free samples, by the way, just to remind people about what they have been missing. >> we'd like to broaden our horizons, too, and pick up new customers. by offering stuff we didn't do in the past. that there's a calling for stuff, new product lines that we're going to try to appeal to those people, too. and retain as many of the old ones as possible. >> they say several of the former employees are also back on the payroll now. they're hoping to have a bigger grand opening celebration in october. 10 minutes now before 8:00. a grammy-nominated rocker from the bay area says he has lost

arriving police, a handful of people running from the scene. they arrested five people, though later one was released. the four remaining suspects, all between the ages of 18 and 24, are being held on $50,000 bail. a famous bay area rocker is now offering a reward to get his two treasured guitars back. rob flynn is the heavy metal band on tuesday. someone ransacked his family's home in martinez and made off with two of his guitars. flynn used one to record his album. the other was given to him by heavy metal pioneer, dime bag darrell, the late guitar player for pentara. >> i had my dime bolt here. i had the guitar i wrote and recorded my first album over there. >> flynn is certain he was targeted and is offering a $3,000 reward to get his two

prized guitars back. in the meantime, martinez police are checking out the fingerprints discovered at his home. c p say -- chp says statewide, the number of auto thefts fell last year. it is actually a 15.4% drop from the year before. and the largest annual drop in decades. officials say 88% of the vehicles reported stolen were recovered. investigators are giving the credit to more enforcement, to better education, and technology for that drop. well, guess what. faith car has come to san francisco. it's the reality tv show. they equip cars with cameras and other special devices and leaves them as bait to catch car thieves. once the car is stolen, the police who have been sitting

good morning. welcome back to mornings on 2. i'm tori campbell. >> and good morning, i'm dave clark. it is thursday, september 9th. a fight outside of a home may have led to the shooting of an innocent woman. jade hernandez is live outside the oakland police station. what's the latest, jade? >> reporter: oakland police say this woman opened her front door and was shot three times. this morning, they say she may not have been the intended target. we're live and waiting for an update from the department on this investigation. we know that a fight in front of this woman's house, involving someone else who lived there, may have led to the woman being shot. a couple of hours ago, we drove to the house where she was shot and spoke to a man who lives across the street. he told us he heard 30 shots from what he thought was an assault rifle. and he said he hit the ground immediately. it was around 10:30 last night in the 1200 block of 87th avenue.

he was scared last night and said he didn't feel comfortable going on camera this morning. but he did tell us he got up and made his way outside after the shooting. and he saw family members, running out of the house, across the street, screaming, they shot mama. police are not releasing any information about the woman this morning. but the neighbor told us he thought that she was in her 50s, living with her large family. he could not tell us how many people lived there. he did say that he had just moved into the neighborhood and hadn't had any problems up until this point. paramedics did take the woman to the hospital. we're told she's in critical but stable condition at this hour. and no arrests so far. we are live at police headquarters this morning in oakland. jade hernandez, ktvu, channel 2 news. >> okay, jade. thank you. also this morning, oakland police are busy, looking for leads in two other shootings. they both happened about 9:45 last night, not far apart. and one of those shootings was

deadly. the fatal shooting happened during a gunfight near this taco truck at 45th and international. police say one man was killed, another was wounded in an exchange of gunfire. the wounded man actually drove all the way to a hospital in tracy to get treatment. his condition is not known. now, the victim of that second oakland shooting drove himself to highland hospital. police say he was wounded in the shooting in the 4200 block of foothill boulevard. he is expected to survive. now, as we mentioned, both shootings happened about the same time, but police don't know if they're connected. a week-long search, tied to the valid mar case is set to resume at any moment. crews will return to a pittsburgh landfill to continue looking for the body of a missing hercules man. these are live pictures now from news chopper 2 of that landfill. 35-year-old frederick salas has been missing since his father was found dead on august 27th,

inside their herc leaselies -- hercules home. he may have killed both men and disposed of frederick salas' body in a dumpster. meanwhile, a vallejo man, linked to that case, is out on bail this morning. ktvu's claudine wong joins us this morning on why his bail was suddenly lowered. good morning, claudine. >> reporter: they have seen no sign of charles rittenhouse after he was released on bail about 12 hours ago. they did tell me they have obviously noticed that he was gone. they have spent the last week feeding the couple's cat, who has been roaming the neighborhood. and as we take a look at his home, we do see signs of the some of the police activity going on. there are still gloves on the driveway. the atf was here and a lot of activity, removing chemicals from this home. there are a lot of no trespassing and private property signs put up. we have not seen rittenhouse. he has turned down all requests

for interviews. he posted his bond about 8:00 last night, that $25,000, dramatically different than the $2 million figure that had been originally set. the bail was reduced yesterday after the prosecutor told the judge that the office would not be filing any additional charges, at least any time soon. what that means, that he's only facing charges for having explosive chemicals in his home. he is not facing charges in connection with the deaths of his wife and her friend. now, the bodies of those women were found on august 31st, inside the home in one of the backyards. rittenhouse had filed a missing persons report for his wife, just days earlier. that night, he returned home from work, and police got to the home just minutes after to follow up on that report. but once inside the home, police discovered the bodies and initially believed rittenhouse might have been living there for days, with those decomposing remains. so that bail was set very high. because they anticipated there might be possible charges filed in connection with that. rittenhouse's lawyer, however, has argued that she believes

the bodies were placed in that house, while rittenhouse was there that day. and said they had no involvement, saying that he has been put in jail while mourning his murdered wife is just awful. if he's not connected, what happened tothose two women? it's still a mystery at this point. but police believe at this point, efren validemmoro was involved. rittenhouse's lawyers say he has been stalking the couple for years. police are trying to figure out how valdemoro was connected. they believe he was connected to the deaths of several other people, including the elderly man in hercules, his missing son and girlfriend. neighbors say things have been quiet over the last week. live in vallejo, claudine wong. ktvu news. a 7-year-old antioch girl is in critical condition after being hit by a car when she ran

into the street, chasing a toy. antioch police say it happened yesterday. the little girl darted into west sixth street, near c street, right in front of an oncoming car. the driver tried to stop and even swerved to avoid her. but hit the girl, knocked her to the ground. she was flown for treatment. football super star and bay area native, tom brady was involved in a car accident this morning. about one hour ago, we received video of the crash scene. brady was reportedly shaken up but not seriously hurt and treated at the scene. police say he was driving a sedan that collided with a minivan. they had to use the jaws of life to free the driver of the van. the van driver was taken to the hospital but his injuries are not considered life- threatening. the new england patriots also say brady will attend practice today. he grew up in san mateo.

he has led the new england patriots to three super bowl champions. the patriots open their season at home sunday against the cincinnati bengals. back here at home, an out- of-control car ran into a fire hydrant and unleashed a geyser of water, 70 feet high. >> and there it is. police say it appears the driver was speeding, about 2:00 this morning, on 98th avenue, and san leandro street. after ramming into that hydrant, the car flew into that intersection and landed on some railroad tracks. the air bags were deployed. the driver actually ran away. police are now trying to find the car's registered owner. it is eight minutes after 8:00. and sal, boy, 280 in san jose is having a tough time, huh? >> yeah, it was light last time. it was busy now. busy again. it's kind of an up-and-down commute. there goes cal train.

california regulators want to slap a $9.9 billion fine. the state is claiming pacific care violated california's insurance code, 992,000 times between 2006 and 2007. and each violation carries a fine of up to 10,000 dollars. state investigators claim pacific care routinely failed to disclose benefits, time limits and other policies. pacific care. and this morning, britain ordered goldman sacs. they started to look into the matter last april, after the fcc filed civil fraud chargeses

against goldman for allegedly misleading buyers. goldman celted the charges by agreeing to pay a record $550 million fine in this country. hundreds have burned an american flag and chanted "death to christians." it's one of the protests in response to a small florida churnlg with plans to burn a the muslim holy book. this morning, they are trying to get the florida minister to call off his plans. allison burns has more on what the president had to say. >> president obama is calling on the florida pastor to, quote, listen to those better angels angels and halt his plans to burn the koran this weekend. reverend terry jones showed camera view crews the stack of muslim holy books he says were

ban on same-sex marriage. attorneys for governor schwarzenegger and for jerry brown said they should be able to choose which laws they challenge or defend. >> 8:19. today, governor schwarzenegger begins a six-day trade mission to china, south korea, and japan. he's going, even though there is still no agreement in sacramento on a state budget. the governor says the trade mission was scheduled months ago and that international trade is an important source of new jobs for california. the governor and legislative leader says they will be able to continue the budget negotiations via teleconference while the governor is on the trade mission. and the issue of furlough friday is now in the hands of the california supreme court. attorneys representing governor schwarzenegger and state workers faced off in a san francisco courtroom yesterday. employees say that state constitution does not give the governor the power to force workers to take unpaid days off. but the governor's office says

well, good morning to you. welcome book. time now is 8:23. this morning, authorities are still searching for a man they believe is behind a massive marijuana-growing operation in the east bay. there was a huge pot bust yesterday in a remote regional park, between moragga and san ramon. more than 1800 pot plants with a street value of a quarter million dollars was seized. this big raid followed a three- week investigation. officers arrested one of two men believed to be running this pot farm. the other suspect was still out there on the loose this morning. senator barbara boxer is

distancing herself from an economic adviser who was arrested on marijuana charges on a senate office building in washington, d.c. police say marcus stanley was trying to hide a leafy green substance. the substance tested positive for marijuana. stanley quickly resigned. boxer says his actions are unacceptable. time now, 8:24. members of the mountain view city council are exempt from a fingerprinting rule. they require the fingerprinting of all new city employees. now, according to the san jose mercury news, it's going to cost the city an extra $5,000 a year. but that's after a lot of debate over whether the rules should apply to the city council itself. while some felt they should follow the same rules, most felt that because they're elected and not hired, fingerprints just aren't necessary. >> all right. it is 8:25. and we want to check in with

police say at one point, a man grabbed a gun from his car and started shooting. but there's still no word if anyone was hit. the shooter and his friends escaped in a dark suv. they were last seen driving east on monument boulevard. in the meantime, concord police may have a tough time identifying two armed robbers. witnesses claim the gunmen wore pillow cases over their heads while wrob -- robbing a mcdonald's. this happened last night at the park and shop mall. investigators say the two gunmen walked in, jumped over the counter, and cleaned out the cash registered. no one was hurt. it's 8:34. it has been 90 days since someone shot and killed a community activist in the parking lot of san mateo's hill dale hop shopping -- hilldale shopping mall. 40 people came together to remember the victim. dave lewis. he was well known for helping

recovering addicts and parolees try to reenter society. police say that night he was shot in the back as he was i wanting the mall. >> i think it was somebody that actually was still in the disease of addiction. and you know, probably couldn't help the guy. >> volunteers also went through the mall, handing out flyers and letting people know there is a $50,000 reward. david lewis's friends say they will not allow this case to go cold. a plan to open a new center to help state parolees is causing real concern in one oakland neighborhood. planning commissioners have already approved the project on telegraph avenue at 33rd street. it's in the koreatown north gate neighborhood, north of downtown, which is home to an increasing number of new restaurants and businesses. the neighborhood's district board has voted to appeal the planner's decision, saying the center would hurt revitalization efforts there. those for the nonprofit center

say it will ultimately reduce crime in the center. the nonprofit is designed to give parolees training and skills. a santa cruz man, accused of pushing a woman out of his car, is in jail this morning. this happened about 6:00 on highway 1, between watsonville and moss lands. now -- moss landing. now, surprised witnesses say they saw a door being opened and shut deferral times before the woman -- different times before the woman was allegedly thrown out. now, he is charged on domestic violence and drunk driving. the woman suffered scrapes and bruises. a former member of the golden state warriors is facing charges of domestic violence this morning. matt barnes, who you see in this picture, was arrested after sacramento county sheriff's deputies got a call from his house that was interrupted. when they arrived at the house, they found both barnes and a woman with injuries.

barnes was taken to the county jail. he did post bail and was released. he's scheduled to appear in court next monday. matt barnes was born in santa clara. he's now a member of the los angeles lakers. this morning, the u.s. labor department reported good news on the labor front. first-time claims for unemployment insurance dropped to $451,000. that's down 27,000 from the previous week. continuing claims were also down slightly. 4.48 million americans are now collecting jobless benefits. but analysts say the job's market is still weak. and an increase in hiring is unlikely to happen soon. stock for both apple and adobe are moving higher right now. in fact, adobe stock is up almost 12%, after an announcement about the use of adobe flash for iphone, ipod, and ipad applications.

cupertino company will now allow the use of flash to design and build applications. but that does not mean people who cruise the internet on their apple devices will be able to see flash animations. it only means that developers can build apps in flash and then convert them to apple- friendly code. and i should mention, apple stock is about 1%. but adobe is really shooting up. sal, can you get everybody to where they need to go? >> yeah. and we're finding out about breaking news just coming into the ktvu newsroom. police are on the scene of a search here in san francisco. this is on blithe dale into the sunnyvale area. the biggest street nearby is geneva avenue. but police are looking for a man who has committed some sort of a crime with a gun or a knife. and they've called tactical units. that's a fancy word for the s.w.a.t. team into this area. this is on blieghtd -- blithe

and it's left behind also some fog. low clouds still on parts of the coast. you can see just south of point reyes. heads down toward san mateo coast. and pulls right back off and heads back in toward monterey. and also, pacific grove and pebble. and then a little bit stretches off toward the east. north and south, it's mostly sunny. but from west to east, there's a lot of low clouds and fog. it definitely felt like fall yesterday. the low clouds left behind, also cool, mostly sunny, breezy today. reports of fog right down on the ground. mendocino county, sonoma. and even truckee, quarter-mile- an-hour visibility there. that's a tough morning. our system is long gone. there goes -- flew out of here. but we did have showers yesterday. redding had good showers there. look at that. and it will fill in probably tonight and tomorrow. it will start to get a little warmer inland. tomorrow, i think you'll notice it more than today.

we will decrease the winds. we'll go for a high of 63. and that's one warmer than yesterday. when they were 62. 50s, across the board. the santa rosa, napa locations were down to 40s and they've come up a little bit. 57, san jose. livermore, concord. 48, ukiah. fog in anderson valley. and 3-mile visibility. some of that fog continues to work its way in the inland areas. i guess we're getting to that time of year. mostly sunny and breezy. the high builds in. and next week, looks like another low drops in. and there's a hint of a stronger system thursday. today, though, low clouds. mostly sunny. a little breezy. 60s and 70s for everybody. then tomorrow, we'll start to see that fog on the coast again. inland areas will get back into the 80s, with temperatures starting to rebound all the way to saturday. maybe sunday. then we'll start to back off as another low backs off for another cooler next week. new information is coming into our newsroom about the

but what really happened? cnn -- not me -- cnn says his assertion about his tax record was "just plain wrong." jerry brown went out there and took credit for the fact that the people of california voted for proposition 13, which lowered taxes, which he opposed. and now he's going around taking credit for it. he raised taxes as governor of california. he had a surplus when he took office and a deficit when he left. he doesn't tell the people the truth.

it is 8:44. we continue to follow breaking news, concerning three uc berkeley graduates held hostage in iran. pam cook is joining us with the latest on the breaking details. several news sources are now saying that one of the three uc berkeley graduates being held in tehran will be released on saturday. the word apparently came from a top iranian government official who wants to remain anonymous. now, one of the americans will be released. but there is no word on which american that will be. we know that the three were seized by iranian authorities while they were on a hiking trip near the northern iraq border, back in july of 2009. the iranian authorities accused them of espionage and illegally

crossing the border. we also know that sarah shore called her mom last month to say she found a lump in her breast. and her mom has been concerned about her daughter's health. she has contacted the red cross and u.n. for help. reporters were told of this news by text message this morning, that they will be able to witness the release at a hotel. it's apparently a same hotel in tehran, where the three detainees were allowed to visit with their parents back in may. again, one of the three cal graduates will be released. there is no word which one. there is speculation that it might be sarah shore because of her health concerns. reporting live from the newsroom, i'm pam cook. our time now is 8:46. let's bring you up to date on some of the other stories we're following now. a woman is in stable but

critical condition after being shot last night. police say the people who live in the same house with the woman have been unwilling to cooperate with investigators. a vallejo man, connected with a bizarre, east bay homicide case, left this morning. charles rittenhouse left just hours after the judge reduced his bail. the 72-year-old man was behind bars for possession of explosive materials. police say his wife and another woman died during efren valdemorrow's killing rampage. and president obama is calling on this florida minister to drop his plan to stage a koran-burning event this weekend. there was another angry protest today in afghanistan, where hundreds of people burned an american flag in response to that planned koran burning. and we're also getting word out of iraq now, that four prisoners with questions to al qaeda have just escaped from a

maximum security prison in baghdad. part of the prison the inmates escaped from is guarded by american soldiers. it is not clear yet how the men escaped. it is 8:47. there were more protests in los angeles overnight because of a deadly officer-involved shooting. for the third straight night, officers set fire in a downtown area. this comes as the l.a. times reports that the officer who shot the man was involved in two previous shootings while on duty. your time is now 8:48. an oakland teenager has been charged with murder now for shooting a skyline high school student who was killed while celebrating his 18th birthday. the suspect, john michael martinez, was 17 years old when the victim was killed, though he's being charged as an adult. police believe martinez tried to crash eric toscano's 18th birthday last march. police say when martinez was turned away, he returned a half

hour later in a car and opened fire, killing toscano and wounding 14 others. martinez, who turned 18 himself last month, has been charged with murder and a special circumstance for that drive-by shooting. he's in jail now, being held without bail. san mateo health officials have given the all-clear to a redwood shores lagoon, where 48,000 gallons of sewage spilled two weeks ago. they say the water now meets the minimum qualifications for safety and is safe for people to use. the cleanup of that sewage spill has cost redwood city almost $141,000 so far. but the city is expecting more bills for pipe repairs and water testing. time now, 8:49. well, 75 silicon valley leaders are using their influence now to try to speed up the process of moving the oakland a's to san jose. they signed a two-page letter, urging the timely approval of the a's relocation.

signatures include cisco systems' john chambers, yahoo's carol bart, and ebay's john thon donna ho. -- donahoe. bud selig has been researching whether a move by the a's would encroach on the giants' turf. they are also making plans for the am-jam tour. they say they want to continue but only as a stage finish. for the past yoo 2 years, san jose has been the starting point. but they say that doesn't attract the attention the city deserves. tour officials hope to announce the tao host cities next mont. a new report says the bay area trails other cities when it comes to internet speeds. according to the wall street journal, san jose posted the fastest speed of 50 u.s. cities. but slower speeds in san francisco and oakland dragged down the bay area's overall

average. the bay area posted a download speed of 9.1 mega bits per second in a recent 30-day period. that compares to 12.4 in minneapolis, for example. and 11.6 megabytes per second in new york. people who feel the need to update their facebook status, even while they drive, may soon be able to safely do that. that's because general motors is testing software right now that would allow drivers to talk to their cars to either update their facebook status or listen to facebook messages. the verbal updates will be made through gm's on-star safety network. it is also testing a message that would read cell phone text messages to drivers. netflix has signed a deal that would be available only on cable tv. netflix is teaming up with new images. and millennium group which
