i'm pam cook. >> i'm dave clark. >> reporter: thank you very much pam and dave. only patchy fog this morning. cool for some. sunshine for almost everybody. a little bit warmer temperatures. they have been coming up just a teeny bit every day. some mid-60s. upper 70s around the pay. now here is sal. >> reporter: traffic is moving pretty well if you are driving out to the east shore freeway. the morning commute looks good if you're getting to the toll plaza. let's go back to the desk. an investigation continues right now into an early morning officer involved shooting in concord. this happened about 2:30. police say they spotted a suspicious man walking down the street and believed he was wanted. he took off and when police approached him officers say he shot at them. police officers returned fire

and wounded that man. there could be a big hotel strike in san francisco. that's because hundreds of workers have voted to authorize a strike and they could be joined by workers from as many as 60 other hotels. 9000 people have been working without a contract for 13 months now with key sticking points being health care costs and wages. >> if they don't move from where they are the chances of a strike are absolute. >> we also need to be able to have contracts that are fair to the people who not only work in the hotels but who own them as well. >> union leaders have planned a pleating for tomorrow to decide if there will be a strike and if so when. we are still following several new developments in that pipeline fire and explosion in san bruno a week ago. this morning disaster teams have a very important warning for the fire victims. governor schwarzenegger is promising a full investigation

after taking a tour of the disaster zone. also a rosary service will be held for the mother and 13-year-old daughter killed in that fire and explosion. san bruno police arrested four suspected scam artists. they are accused of trying to cash in own if disaster by claiming they lost their homes in the fire. investigators say their homes were miles away from the disaster zone. they were booked on suspicion of burglary, perjury and other charges. officials at pg&e tell us

they decided to delay repairs on a section of pipeline. >> reporter: the short answer you'll hear from pg&e president in just a second. the short answer is it was a matter of priorities. a lot of questions about that pipe that failed in san bruno. this time the questions being asked. we know there's a section of pipe located in san francisco. according to documents made available to the media by utility watchdog turn pg&e applied for and was given permission to raise our rates to pay to replace a section of pipe in south san francisco. that was back in 2007. pg&e told regulators at the time that the risk of failure of that pipe was unacceptably high. the utility collected nearly $5 million and supposed to replace

the section last year but did not. >> some things happen when we're going down and a year later maybe some other item becomes more emergents that we need to fix. that's why we will redirect funds to take care of the things that are urgent today and then go back and look and say what are the things that are urgent tomorrow. >> re: it's not clear right now pledging to do work and not doing it is illegal. according to these same documents they submitted construction problems to the p. u. c. the pipeline under san francisco is on that list. pg&e wants the p. uc to put up an additional $5 million. the people in south san francisco don't seem to be as outraged about that as they are or worried about a section of pipeline under the city that

poses a risk. very interesting. thank you. we will check back in with cylinder in just a little bit. you can get updates by going to our channel 2 website, ktvu.com. pleasant hill police warning parents about two reports of men approaching young boys. an 11-year-old boy told police a man in a blue toyota prius tried to lure him into the car yesterday morning. the man described only as white with tan skin and heavy basic sent. on monday two boys said four men in a green jeep cherokee

repeatedly offered them a ride near pleasant hill middle school. a 5-year-old san francisco girl recovering after being shot in the leg at a china town playground. this happened last friday evening on pacific avenue. police detained several juveniles who were nearby and one of them a 17-year-old allegedly had a gun on him. that gun is being tested by police who determined if it was used in that shooting. let's go back over to sal. it's 6:06. how is the commute? >> reporter: doing pretty well. it's nice to not have a lot of things to report. we're looking at 237 to start off this report. traffic looks good. also this morning's commute is going to be okay. no major problems. the traffic continues to move along very well into the south bay.

this morning if you are driving on southbound 101 or southbound 880 down the bay area it does look good. here is steve. >> reporter: thank you very much. kind of a real tough tricky little forecast as we head into the weekend. not today. today it will be warmer. i have warmer today but for the weekend. it's going to cloud up and the possibility of rain will be there. only patchy fog this morning. sunny and warm and cooler weather comes back on friday. it will cloud up. i realize many of you have plans. the best way i'm going to cut this up is saturday afternoon and evening, everybody could see some rain. it will be gone by the 49ers home opener on monday. system is aligning itself more north to south. we get more of a high pressure system today which means less

fog, sunny and warmer. we'll go for a high of 65 today. fog burning off a little sooner. there are a few thaw are in the upper 40s. wood side as well. 30s in the mountains. 50s or 60s in the valley. we had some 40s and now low 50s. this whole low will take its sweet time getting here. we're in line for a lot of clouds and a little bit of rain. it will be sunny for most except for over parts by the coast. 80s through the interior. 67 by the coast. 70s and some upper 70s and low 80s as you start to work your way inland. drizzle returns friday. i think saturday afternoon

evening for the north bay, rain. some union leaders are angry with willie brown. we'll tell you what they accuse the former san francisco mayor of doing. i'll tell you whether president obama has the votes in congress to raise taxes on wealthy americans. that's coming up as the morning news continues.

there's a new poll that

shows almost half the country poses tax increases for the richest americans. that's in the really good news for president obama who is trying to get congress the raise taxes on the wealthy. allison burns is live in our washington, d.c. bureau. she has the e details. >> reporter: it's an issue that's desiding dividing democrats and the rest of the country. >> they want to hold these middle class tax cuts hostage until they get an additional tax cut for the wealthiest 2% of

americans. >> let's cut spending back to 2008 levels. we save about $100 billion in the first year. >> reporter: if this fight keeps congress from voting on this everyone's taxes go up at the end of this year. reporting live from washington, d.c., allison burns, ktvu, channel 2 news. the u.s. senate is close to passing some long delayed legislation that will open up credit lines to small businesses. they are also incentives for businesses to expand and hire new workers. republicans have a posed this loan fund comparing it to the bail out of the financial industry. the white house is expected to name elizabeth warren to oversee a new federal protection bureau. it will enforce regulations for

mortgages, credit cards and other financial products. president obama may appoint warren any day now. state lawmakers in sacramento are headed towards setting a record that probably won't improve their approval rating among voters. today the state budget is now 78 days late. the record was set back in 2008. that's when the governor didn't sign a new budget until september 23rd, 85 days late. this year on this 78th day democrats and republicans seem nowhere near an agreement. willie brown has angered some long time union supporters by supporting a pension reform measure for pension employees. that measure will require san francisco city employees to pay 10% of their salaries toward their pensions. willie brown defends that

position saying he's not antilabor but the pension system needs to be fixed. the jockey injured in that horrific fall remains in critical injured. 24-year-old michael martinez was thrown from his horse during a race on sunday and the horse rolled over him. his spinal cord was severed making his paralyzed from the waist down. police hope a 17,000-dollar reward will lead to the arrest in the fatal shooting of a berkeley man. he was shot and killed last sunday. police say he was walking with his fiance, when two robbers attacked them. the shooters were seen driving away in an older model two tone suv. time to check in with sal. >> reporter: driving down from richmond and you're heading west, ultimately you want to make it to berkeley, it is

crowded but there are no major problems on the way. it does start getting busy after 6:30. you start getting stop and go traffic. right now would be a pretty good time to go if you can get out there early. this is a look at the bay bridge coming up from the toll plaza. not a big delay yet. we're sure to have more traffic in a few minutes here. this morning's commute getting some slowing. fremot traffic looking nice. 6:17. here is steve. >> reporter: we have some changes today in the form of less fog, not as much wind. it's going to be warmer today. most areas will see the sun. you see how the system is still pretty far out there. it will be two parts to it.

they opened fetzer vineyard. she and her children operated the vine yard until they sold it in 1995. she was 88 years old. 6:19 is the time. one hero of the disaster in san bruno is telling his story. >> right where that light post is right there in my neighbor's yard is where i saw him walking at me begging for help. >> he describes how he came to the rescue of a man dealing with a truly horrific situation. a poor report card for some of the levees. we'll tell you where the problems are and what could cause one of them to break. we'll tell you more about morning commute and the bay weather.

san bruno. the vigil begins at 7 p.m. tomorrow the funeral will be held at that same church. the memorial for jessica morales will be held at the church of the highlands. last night her mother made an emotional visit to the disaster zone. she's in that red jacket right there. she was allowed to visit the site where her 20-year-old daughter died a week ago. she was watching football with her boyfriend at the time of that deadly explosion. jessica's boyfriend almost died that night as well, but he survived thanks to the brave actions this this man. he spotted him running out of his burning house. he was seriously injured and begging for help after witnessing his own girlfriend's

horrifying death. >> he had watched his girlfriend -- retried to save her and he couldn't. >> he is now in the burn center in st. francis medical center in san francisco. there's no official word on his condition but family members say he suffered serious burns on 4% of his body. time now 6:24. b.p .'s blown out oil well is said to be permanently sealed up sometime today. the federal government says the relief well should intersect the ruptured well today. mud and cement will be pumped in there sealing the well once and for all by sunday. a temporary cap stopped it from leaking in the middle of july. unacceptable, that's the rating for seven of ten levees. they don't meet the safety criteria and at risk in a flood

and storm. the unacceptable levees were found in yuma city to stockton. some other levees have been repaired with money from a bond measure that was passed four years ago. time now 6:25. they're not exactly flying under the radar. we'll tell you what bart police say is baffling about the people who jump fares. good morning. concord police are investigating a shooting that involved two officers this morning. one man was sent to the hospital. we have new details and pictures to show you straight ahead.

but wholesale prices are up. that report on inflation came in this morning right before the -- just about an hour ago. that is probably going to weigh heavily on the market and as they get ready to ring that opening bell i'm looking at european markets as well, they are mostly down. all of those things point to probably some losses this morning. there's the opening bell live. we'll get to those numbers in just a moment. we'll watch that and say good morning to you. thank you for joining us here on the ktvu morning news, thursday september 16th. i'm dave clark. >> i'm pam cook. police say they were forced to shoot a man early in concord this morning. jade hernandez has been talking with officers. she joins us now with the new information. jade. >> reporter: good morning. it's been four hours since the shooting took place officers are still out here. they have moved media away as far back as two blocks. we have new pictures to show you

right off the top. concord police have brought in the sheriff's office because the shooting involved two officers from within their department. the officers were not hurt. both have been placed on paid administrative leave. we have a better idea of how this shooting happened right now. two officers in a squad car patrolling the neighborhood around 2:30 this morning noticed man who matched the description of a suspect who was wanted on outstanding robbery warrants. the officers tried to make contact with the man and he ran from them along clayton road. at some point the offers got out of their car and ran after the man who is only being described as man in his early 20s. we're told the man pulled out a gun. officers both opened fire wounding the suspect. what we don't know at this point is whether or not the suspect actually fired on the officers or if he just pulled out that handgun. either way paramedics rushed the

man to the hospital in walnut creek. police do not have an update on his condition to release right now. >> the officers wanted to stop the subject. as the officer tried to contact the subject he immediately ran down ashburr drive and the officers pursued in their vehicles. >> reporter: the man was indeed the man who officers thought was wanted on the outstanding robbery warrant. police have pushed us back. the yellow crime tape right at the intersection. you can also see where there's crime tape pulled upright behind the crime lab this morning. concord police are working with the sheriff's office and district attorney's office in this investigation. it's not complete. we will continue to bring you an

system banging drums. for what reason i can't really answer. >> so far this year 2100 fare evasion sixties have been issued. uniformed and plain clothed officers will continue to keep a close watch. police say they have arrested a woman six times since june on suspicion of vandalizing luxury cars. she was arrest monday afternoon after an officer saw her scratch the side of a parked mercedes in a shopping center. at the time of her arrest she was out on bail following an arrest of a similar incident. how are they doing at the toll plaza? >> reporter: it's going to be busy dave and pam. why don't we just show it to you. the magic of television. it's about a 15 minute delay.

it's getting busy here. also this morning we're looking at interstate 880 north and southbound. traffic is moving along pretty well here past the coliseum. let's take a look at the south bay. the road sensors not showing a lot of activity. as we move over to livemore it's not quite the same thing. we have a little bit of red already. 6:35. here is steve. >> reporter: thank you. a good morning to you all. some fog out there but not nearly the coverage we have seen the past couple of mornings. it's still some but mainly hugging the coast and in the bay. san jose now showing a few little cloninger clouds. the last couple of mornings they have been overcast. headline warmer today. that is for the weekend. we're not going to hold this warmer. it's going to change on the weekend. drizzle returns tomorrow. mostly cloudy.

looks like some rain on the weekend. my philosophy, i don't say chance. either it is going to rain or it isn't. i think it will rain and a possibility from san jose north sunday morning. tomorrow we'll fine tune all of this but it's real tough call right now because the system has slowed down, stalled out. today high pressure winds and the system as it deepens, it's a teeter totter effect. there's less fog and it will burn off sooner. there's the first part of that system. the first one that comes through doesn't do much. highs are coming up a little bit. napa 76 yesterday. san francisco 61 to 65. walnut creek 80. oakland 68. san jose was only 73 yesterday. that one was a little surprising. i thought they would be warmer

welcome back. here a quick look at some of the stories we're following. san francisco could be hit with a big hotel strike. hundreds of workers voted to authorize a strike and workers from several other hotels may follow. union leaders meet tomorrow. they will decide if they will call the strike and if so, when. this is day 78 for california without a budget. state lawmakers are now approaching an infamous record set in 2008. that's when governor schwarzenegger signed the budget 85 days late. pg&e's own record show that three years ago the utility company raised its own rates in order to pay for replacing part of very same natural gas pipeline that blew up last week.

however, that very important project was put on hold. police say scam artists are taking advantage of the san bruno disaster victims and the relief efforts. >> reporter: it's been one week since this fire ball swept through this neighborhood and every single time the sun comes up no matter how many times we have seen the pictures it's striking to see the magnitude of the devastation. they are concerned that the victims could be victimized again. over the past 24 hours we have seen an army of contractors coming through this neighborhood. you have hundreds of people in this area who are trying to get back in their homes but who need their homes checked. they have a lot on their plate. that makes them a prime target

for scam artists. there are a lot of legitimate folks working in this neighborhood. contractors hired by insurance companies and hired by pg&e. will are also folks coming through who aren't who they say they are. >> a lot of contractors will say pg&e sent them there to do an inspection and that's not true. the only companies are certified on the list for pg&e. they can call pg&e and get one of those lists. >> reporter: the state lining board has been posting signs in this neighborhood. they are also holding a jnt press conference this morning to warn people about possible scams. all you have to do is take a look t what they are dealing with in and around this neighborhood to know this has been a tragic and terrifying time for them. everyone has to make sure they don't become victims again. health experts are now

warning of the the toxic dangers tied to the disaster there in san bruno. they say the debris left behind from the fire and explosion is a cease pool. health agencies are racing to remove the toxic ash been the start of next month's rainy season when it could all run right into the san francisco bay. it was an emotional journey back home for some victims of last week's fire and explosion. yesterday they returned to their home for the first time to see what, if anything, was left. they were wearing protective. gear. >> she lost everything her mother had. we just wanted to see if we could find something. >> many long time residents say the memories are just too painful to rebuild and they will never move back into their old neighborhood. time now 6:44. new damage estimates are around $38 million in that san bruno

explosion and fire. city building and planning officials say it's more than $31 million in damage just to homes and private property. the additional cost is for damage to public infrastructure including the streets. right now efforts to restore the neighborhood are in the starting stages for those whose home suffered light damage. 37 homes were destroyed. 19 others suffered a lot of damage. city officials say 321 homes have cosmetic or no damage at all and most of the homeowners have returned. we'll continue to bring you live updates this morning on the investigation into that gas pipeline explosion. you can also get additional information on how to help the victims at our channel 2 website, ktvu.com. just click on the san bruno tab. so far a fire has burned

more than 6100 acres and destroyed one home. the u.s. forest service says the fire got very active yesterday but a fierce air and ground attack kept the flames away from other homes. sarah shourd is staying out of spotlight for a second day. she will not be speaking to the media except for a statement immediately before she leaves the country. in her last public comment she became emotional about leaving behind the other two americans detained with her. >> all of my efforts starting today will go into helping procure the same freedom for my fiance and for my friend. >> she's spoken with the mothers

of the two men in a conference call. in a television interview he said he will not intervene in the court case against the two americans still in prison. he says the two men will need to prove that they didn't want to commit any offense. the three americans were detained along iran's border back in july of last year and later accused of spying. the new book is out and in it the first lady of france it reveal what is she says how michelle obama really feels about life in the white house. in the book she details a conversation she said she had with michelle obama at the white house during an official visit in march. she says she asked michelle how she felt about her role as being wife to the president of the

united states. she said michelle responded she can't stand it. back here at home commuters may soon relief in the commute. that's because the first express toll lane is about to open. the lane will run on southbound 680 and highway 237. the lane will be free for car poolers. there's going to be a kickoff celebration. that is set for 10:00 this morning. sal is starting in the east bay. how does it look? >> reporter: it looks okay although there are some slow spots already pam and dave. you see my twitter address below my name if you want to send me something especially public transits information. let's move to the east bay and talk about 880. traffic moving well but when you

doing well. >> reporter: it's not. we'll follow this and the other bay area bridges and the rest of traffic because we are now getting to the basic of the commute and seeing some things going on. let's go back to the desk. thank you, sal. a new federal survey shows that illegal drug use last year jumped to its highest level in a decade. it shows marijuana use jumped 8% and remained the most commonly used drug. the use of ecstasy rose 37%. one federal drug control official blames eroding attitudes about the dangers of drugs. gavin newsome is praising the success for helping the homeless. he says 12,000 people have been helped off the streets. he wants to expand the efforts all over the state if he is
