well, good morning to you. welcome to "mornings on 2". i'm dave clark. >> good morning. i'm tori campbell. it is friday, september 24th. a new theory this morning points to a destructive colony of bacteria, as the possible cause of the san bruno explosion. the chronicle reports that a phenomenon, called microbiological influence corrosion is now being examined. that's when bacteria comes to light in water, sometimes found at the bottom of a pipeline and begins eating away at metal. the paper says pg&e has found a small amount of water in the san bruno pipeline in the past. just about an hour from now, crews will return to the site of the san bruno explosion to begin cleaning up what's left of the homes destroyed by the blast. ktvu's claudine wong spoke to

the environmental director about this task. and she joins us live. good morning, claudine. >> reporter: yes, i just spoke with dean peterson, who is the director of the environmental health division of the county. he wants to get crews back to work. i want you to take a look behind me. we are on clairemont and vermont. and you can see the devastation throughout here. work is going really three home sites at a time. so you can see kind of in distance where there is an excavator and bulldozer over there. we assume that that's where some of the work will be going on. they are going piece by piece back here. and that process does continue. this morning, dean peterson told me that operations yesterday, which was the first day of demolition, went well. the first to actually finish yesterday as planned. but they are expected to be cleared up sometime this morning. and crews move onto the next three. there were more than three dozen homes destroyed. and so far, the county has been

given the go-ahead to clear the sites. health concerns, a big issue out here. but the air is being monitored, both right next to the demolition area, and the perimeter. one monitor did register a hit yesterday. and work at that site was stopped so water could be put on the site. >> it was on the site, right at the zone that they were digging. around the perimeter of the site was fine. it was just a small little hit there. and it immediately shut down. >> reporter: work continued soon after that without a problem. and they actually had the air quality folks apparently through this area yesterday as well. and they gave their stamp of approval on just air quality and health concerns out of here. again, you have asbestos concerns and particulate matter that all are causing some level of, just concern enough to make people want to take precautions. back out live here, you can see the neighborhood. the way we're actually able to tell and everyone can tell how this progress is being made on these home sites. they actually put checklists on each and every one of these

home sites, so as they go through what turns out to be a six-step process, you can see it because they'll get a sticker and a green light before they get final approval. we are at a point here this morning, where they are going to let the media come through here. really for the first time in days. talking to some of the crews that will be working. that's going to happen later this morning. really, the first access we have been given in a long time. that's because they have been letting the insurance agents and the other folks trying to go through here access. that should be a new look at the work being done. right now, the safety meeting just about to get under way. work here will get under way in about an hour. live here, claudine wong. ktvu news. campus police at city college say they have increased their patrols, following two attacks on women. but some say they knew nothing about the recent crimes. kraig debro is back live with details. good morning, craig.

>> good morning, dave. so what we did was drive around the other side of the campus, next to the science complex. because on september 14th, that's where the rape occurred. the two assaults here. one a rape, one a sexual assault. this is the science lot right here. these spaces right here for students. there are some up there for staff. we wanted to show this to you. look how open it is. not only do you have the lot here. but have you -- you have this access road here. 880. even though it was 5:30 in the morning. here's what police are saying. they say the woman was getting out of her car at 5:30 this morning. and this person came by and pushed her out of the car and raped her. a lot of people we talked to said they hadn't heard what happened. i want to show you this is the college campus. i wanted to search sexual assault. when i got here, i saw the safety alert at the top. it's supposed to go to the safety alert here. that didn't workute.

-- work out. but the safety alert gives you the description of what happened. again, the student we talked to said she found out from another student what had happened. >> i actually heard about it. thursday -- was it thursday? yeah, thursday, when i had a class. i didn't even know about it. no one informed us. i heard through other students. >> now, the second attempted sexual assault took place a week after the first one. so a couple of days ago, on a thursday. now, in that particular instance, we're told that a woman was going to her car in the second floor of the lee avenue parking garage, when somebody came up behind her, pulled up her sweatshirt behind her, pushed her against the wall. she fought back. the woman broke free and ran to her car. and the suspect ran away. the suspect in that particular attempted assault is described as a latino man, between 40 and 50. and he did not follow. and here's what we tried to show you earlier about the

alert on the campus website. and down here, there is a description here. says here, possibly hispanic, or african american male, 6 feet. last seen wearing a black zipup style pant suit. even though this alert is on the campus website, i went through the buildings, there is no posting, no posting of a description or a sketch. so there is reason to believe that a lot of students don't even know what happened here. coming up, i'll talk to police about that and see what they have to say. reporting live in san jose, craig debry, kt -- kraig debro, ktvu news. a man suspected of attacking a female jogger in san jose. he's described as latino, mid- 20s. 150 pounds. warning signs are up around snell avenue and colleen drive,

where the jogger says she was attacked sunday. investigators say he pushed the woman into an aqueduct ask and assaulted her. but she fought him off and ran away. for the first time, we're hearing the california record budget stalemate may soon be over. after a hearing yesterday, the governor's private office in southern california, the so- called big five announced they have the framework for a deal. they did not digs close de -- disclose details of how they plan to close the state's $19 billion budget shortfall. but the talks are set to continue through the weekend to put the finishing touches on a deal. a spokesman for the governor said they hoped to have it finalized by late monday afternoon. he says the big five plan to meet monday at the governor's office in sacramento. if they finalize an agreement, the legislature would then have to draft the language for a budget. once that happens, the budget heads to the debate floor and a vote. it's a process which could take several more days. when a budget is finally

passed, it will be the latest in state history. now, this budget stalemate has frozen billions of dollars in funding for public infrastructure, like roads and freeways. almost $4 billion in projects are on hold. they include improvements on highway 101, san mateo county, highway 17 in santa clara county, and on interstate 680 in contra costa county. it is 7:08. let's check in with sal, because there's a big problem, trying to get to the airport. >> hagen berger road, which runs just across 880 there. and a lot of people take the off-ramp from 880. iment to put it on a -- i want to put it on a map there. there is a crash there, right west of 880 at the first intersection, where the gas station is there. you know it there. it's a motorcycle crash. it's going to take a while for it to clear up. so for now, what you need to do is go down to 98 instead. use 98th avenue, which will get to you the oakland airport. you don't want to miss your

flight or be caught up in this unnecessarily. so just be aware of that. it's not moving freely now. let's move on to the toll plaza. hasn't become full strength. it's a pretty decent commute, getting into san francisco so far. and this morning, we have video of a crash, this truck that came off the off-ramp at 3:00 this morning, didn't negotiate the upon turn. flipped over and spilled sod all over the place, you can see. the truck was righted. and they towed it away a little while ago. they are still making cleanup. they're making progress, but it was a big mess, as you can see from the earlier pictures. that ramp they tell us, the columbus parkway off-ramp should be affected. 7:10. let's go to steve. >> all right, sal. oh, my gosh. everything is bright. look at this. put your shades on. convertible time. get that boat fired up. it's looking like a sunny and warm day. weekend and early next week as well. not a cloud in the sky.

7:15. a federal judge in san jose will rule today on whether to lift a nearly five-year moratorium on executions in california. the ban was issued after a legal claim that lethal

injections inflict cruel and unusual punishment. but the state says it has since upgraded its execution process by building a new death chamber and retraining its staff and is now ready for lethal injections to resume. if the ban is lifted, a man who murdered the 15-year-old girl in riverside will be the first to be put to death on wednesday. fbi is helping new york city police investigate the apparent murder of a nicaraguan diplomat. the body of cesar was found when his driver went to pick him up for meetings at the united nations. his throat had been slashed. two bloody knives were found inside his apartment. he worked at the u.n. for eight years. president obama is wrapping up a three-day visit to the united nations general assembly today. the president, along with other

members is condemning controversial statements by iran's president before the general assembly. ktvu's allison burns is live with that story. good morning, allison. >> reporter: good morning to you, dave. president obama was not there for the iranian president's speech. but he's calling it outrageous and offensive, especially when you consider how close the u.n. is to ground zero. members of the u.s. delegation and 27 other nations walked out of ahmadinejad's address yesterday as he said the u.n. orchestrated the september 11th attacks to insure israel's survival. >> some segments within the u.s. government orchestrated the attack to reverse the declining american economy and its grips on the middle east, in order to save the zionist regime. >> reporter: and the protests against the iranian president continued outside of the united nations, where demonstrators

carried pictures of an iranian resistance leader and called ahmadinejad a terrorist. now, the prime minister is condemning ahmadinejad's claims. meanwhile, president obama is still in new york, where he'll be attending a special u.n. meeting today on voting rights in sudan. reporting live, alison burns, ktvu channel 2 news. it is 7:17. we're now hearing more about sarah shourd's 10 days in an iranian prison. she said when she was first taken to the prison, she was interrogated several times a day. she was told to write down the answers. and if her questioners didn't like what she wrote, they would tear it up and tell her to write it again. she said in the course of a couple of months, she wrote hundreds of pages. she said she was not physically abused. >> it's all psychological.

and the hardest part, of course, is being so alienated from your fami. i begged and cried for a phone call. and i didn't get it until, i think, the 7th mont. >> shoure -- she said the bright spot was when joshua proposed to her. she says she is desperate to win the release of bower and fatal, who remain in prison. a federal judge in san diego may decide today whether to issue an injunction against the military's don't ask, don't tell policy on gays in the military. earlier this month, the same judge ruled that not allowing gays to serve in the u.s. military is unconstitutional. the obama administration does not want an injunction. they say it's up to congress to repeal the ban. oracle ceo larry ellison says they will not be buying up service companies, the way rivals have done.

oracle said they are content to sell its product through other service companies. he added, oracle is interested in buying semi conductor and software makers. on a separate note, he sold a total of 4 million shares of company stock, worth more than $108 million in the last two weeks. those sales come as oracle reached its highest share price since 2001. meanwhile, the bmw racing team is working out unresolved issues with san francisco about the upcoming america's cup sailing race. the city is one of three locations under consideration for the 2013 race. but according to the examiner, the city will likely miss a self-imposed deadline to come up with an official bid because of ongoing negotiations with the team. the city says team officials have been flexible about the deadline. a series of short picket lines have disrupted business at several major san francisco

two san jose hospitals are the first in northern california to offer emergency room wait times by text. the new good samaritan hospital in the regional medical center in san jose are offering the program to help residents determine which emergency room has the shortest wait time. users just have to text the letters "er" to the number 23000 from a cell phone. the wait times are also posted on hospital websites. they're updated every 30 minutes. 7:24. palo alto-based facebook is apologizing for the worst outage in four years. many users were unable to access their facebook account for almost 2 1/2 hours yesterday. almost 25% of users were getting a message that read dns failure. facebook says there was a problem with an automatic checking system. that was turned off to get the site back up and running. facebook is exploring ways to

police to report the crime. an employee we talked to said, sometimes, police aren't around when students need them. >> people waiting to get in on the inside of the classroom. and i think it's kind of dangerous. campus police should be here early because classes start at 6:00 in the morning. >> now, here's the description of a man in that rape from september 14th, possibly hispanic or african american male. approximately 6', 250 pounds. last seen wearing a black zipup style windbreaker. here's the reason police think this might be a homeless man. the victim said he was probably a transient man because his clothing was soiled and dirty and the victim reported the suspect had a foul smell. i contacted police to see if they could talk to me about one other thing i wanted to talk to them about. and that is the building here,

where this rape happened in front of the parking lot, doesn't have a sign or even a description or sketch. i got the campus p.i.o. and i left a message with her. reporting live from san jose, craig deb row -- kraig debro, ktvu channel 2 news. and a pipeline explosion, there is word that it was caused by a destructive colony of bacteria. microbiological influence corrosion. that's when bacteria comes to life in water, sometimes found at the bottom of a pipeline, then starts eating away at the metal. the chronicle says pg&e has expressed concern about corrosion and has found a small amount of water in the san bruno gas pipeline in the past. a memorial service will be held today for three members of thsame family killed in that san bruno explosion. 85-year-old lavon bullis, her son, 50-year-old greg, and his son, 17-year-old william, with three of the seven people

killed in that september 9th blast. the memorial service begins at 4:00 this afternoon, at the first prez presbyterian church in burlingame. that's going to be followed by a reception. that's where william bullis had just begun his senior year. another tragic accident overnight. a bicyclist was hit and killed on a bay area freeway. this happened on interstate 505, north of vacaville, north of midway road, just after 1:00 this morning. police aren't sure why. but they say this unidentified bicyclist, believed to be in his 20s, somehow rode the bike right into traffic and was killed. the driver who hit him flagged down a chp officer a mile down the road saying he thought he hit a deer. the chp is investigating. two people were shot and wounded overnight in oakland. it happened around midnight, near market and 32nd street. police were called when two

shooting victims, one of them in critical condition, sought treatment at highland hospital. a police search at the crime scene showed bullet casings scattered through the state and an undisclosed amount of cash. the investigation continues. oakland is getting money held from the government to help fight crime. the city just received a $3 million federal help to help fund some of its violence prevention programs. about $2 million will be set aside for a program to keep at- risk youth out of trouble. $750,000 will help put teenagers released from juvenile detention back to school. an additional $750,000 will help young adults find jobs after getting out of jail. phillip garrido is due back in court today for what could be a very important hearing in the jaycee dugard case. lawyers could announce that the accused kidnapper may be

mentally incompetent to stand trial. if such a move is made, and if the judge agrees to a mental evaluation, it would put an immediate hold on the case. >> time now, 7:35. state budget negotiators say they are finally close to a deal. governor schwarzenegger and legislative leaders say they plan to work through the details over the weekend. and come to a final agreement on monday. the state of california has never had a budget this late before. now, the state budget impasse could soon have a very unwelcome consequence if you visit state parks. no toilet paper. park officials say the parks near big cities, they should be fine. but the rural parks could possibly run out of toilet paper and won't be able to buy new supplies by the middle of october. if a budget is not passed. those parks are reportedly coming up on 90 days without paying their bills. and banks are threatening to cut them off. 7:36. today is the official start of what is being called the

centerpiece of a multi-billion- dollar overhaul to the hetch hetchy water system. there is an impressive plan for a tunnel under the bay. >> reporter: good morning. this morning, we can only show you this construction site from afar. crews told us no one is allowed back there on the side until later this afternoon. that's when an official press conference will be held. but we're told officials, workers, they will be out there. and there will be a lot of action going on. and this is why. construction of a tunnel under the bay from meno park to newark. try to imagine on the 14-acre construction site, the work of a 81-foot tall claim with a bucket for the 41-foot deep tunnel shaft. all of that will take place in order to commemorate the work which will take place. this is a first. it's the first tunneling project underneath the bay. it's a five-mile long passage

way between menlo park and newark. many say carrying passengers under the sea. but actually, the transit tunnel is a sunk tube, anchored to the bay floor. this new passage way will transport billions of gallons of water to dozens of cities up and down the peninsula. and ensures bay area residents will have water after an earthquake. the five-mile, 15-foot diameter tunnel will cross the san francisco bay at depths of up to 141 feet. it will be part of the hetch hetchy water system. now, the pamg passage way -- the passage way, bay division is expected to be done in 2015. the cost, $4.6 billion. reporting live in menlo park this morning, jade hernandez, ktvu channel 2 news. time now, 7:38. the nba who has coached more games than anyone else won't be coaching. don nelson is out of a job. although it's not clear if he

news chopper 2 over this horrible accident in oakland. this is a crash west of interstate 880 in oakland. the crash involving a motorcycle and a van. looks like it was a high-speed collision. and i want to ask our news chopper 2 helicopter photographer to pull out a little bit. i want to see the area a little more. so you can see exactly what is blocked. so this is hegen berger road, right near the interstate 880 freeway. and you can see that there is a large police presence now. erica, you tilt up a little bit. i want to see if that's -- or actually, yeah, tilt up a little bit. and i want to see what relationship this is with the freeway nearby. yeah.

alongside immigrant farm workers. reporter nicole collins is there. >> fresh off what colbert calls his fallback position as a migrant apartment worker. he issued a very tongue-in- cheek, rather entertaining, but still serious testimony, regarding immigration issues. particularly the united farm workers take our jobs campaign. that's what you referred to when colbert went to this farm in upstate new york. and it was on his show. it talked him packing farms and picking beans. most americans would never take those jobs. well, colbert did, sort of, for one day. but the united farm workers say 3 million people have visited their website on this issue. but only seven people have taken them up on the offer for a job. this morning's hearing got off to kind of a rocky start when the house judiciary chairman,

democrat john conniers asked colbert to leave the hearing room. he said that he liked colbert. but he thought the media attention that this issue garnered was just too much. colt cot colbert said he would stay as long as the democratic chairman did not rescind the invitation. she said she wanted him to stay. and he did. delivered his testimony. pretty funny, but still serious. unclear if he delivered it in charactero if he was delivering it as steven colbert, the american citizen. >> thanks, nicole. 7:49. nine of the 10 candidates for mayor of oakland faced off for their deplate. they packed in to hear from the candidate. it showed them as the front runners in the race. they went head to head last night when asked what they

would do to fix this. part will be renegotiating the pensions. but also will be to do this. >> who gave the raises over the years to the people that pushed the numbers to where they are? the other lesser-known candidates include real estate agents, educators and business owners. we have posted raw video of the oakland debate. just look for the election tab. a funeral will be held for the funeral. he was a passenger in this car with four of his classmates when it crashed into a big rig last friday. three other passengers were

hurt. the driver, a 16-year-old, is charged now with vehicular manslaughter while intoxicated. he's due in juvenile court next week to enter a plea. a san mateo nonprofit organization is offering what it calls a responsible way for drivers who have been drinking to get home. >> the main thing we're doing is prevention, offering people the alternative to making sure they can get home and get their cars home safely and in one piece. >> the organization, my sober drivers, says it will provide professional, licensed drivers to pick you and your car for about the same price as a taxi. the dmpsz is, you -- difference is, you won't have to worry about finding a ride back to your car the next day. the service is available, 24 hours a day, seven days a week. you can get more details about rates at our website ktvu.com later this morning. 7:51. in about an hour, lindsay lohan will face a judge. and she could be sent back to jail.

lohan admitted to failing her court-ordered drug test, less than a month after she was released from rehab. tmz reports she tested positive for cocaine and amphetamine. the judge previously said he would sentence lohan to a month in jail for each month she skipped in jail. but it's also possible he could send her back to rehab. this could be the scene of a showdown with her parents. lohan's mother is threatening to have her ex-husband arrested if he shows up for violating a protective order. michael lohan apparently wants to ask a judge to send his daughter to rehab and not to jail. figures were just released on new home sales in august. we'll tell you what those numbers say about the nation's economic recovery. an accident in oakland has a major street closed. it's a very serious crash, with a large police presence. we'll tell you what happens.

7:54. there are mixed economic reports out this morning. but stocks are surging after news that manufactured goods orders rose sharply last month. nasdaq up 42. however, also newly released figures that showed homes had their second worst sales in august. they were essentially unchanged from july. sales were down 29% from the same month a year earlier. the only time they were slower was in may, when the sales pace was at 282,000. the number remains a severe weak spot for the economy. time now, 7:55.

a new theory about the san bruno pipeline explosion and what may have contributed to the blast. and a new warning following two recent attacks. what steps students and the police say they're now taking. consult's budget negotiations may finally be are in a deal when the impasse may final leap be over. the second hour of "mornings on 2" starts now. good morning. welcome back to mornings on 2. i'm tori campbell. and good morning, i'm dave clark. it's friday, september 24th. we have a big story now. sal is following what is happening near oakland airport. bring us the latest. this crash, dave, and tori, has been there for going on an hour here. a van and a motorcycle got into a high-speed collision on this road on the way to the oakland airport. and this is an investigation.

a lot of police presence. hegenberger road. you're going to have to go to 98. if you happen to get off the road, you'll be diverted. so it's a good idea to not each head west because of this serious crash. from all accounts, it was a high-speed collision between a van that was used for airport food service. and motorcycle. looks like either was going really fast at the time. we'll let you know more about this. we'll have a regular traffic update coming up in a few minutes. at 8:0 twenty 1. let's go back to the desk. new theory is pointing to a destructive colony of bacteria the crojicle is reporting a

phenomenon called bacterial microcorrosion. it starts to eat away at the metal. the chronicle says pg&e has expressed concern about the corrosion. and they found a small amount in the past. this is a day 2 of the massive cleanup in the more than three dozen homes destroyed by the san bruno explosion. it is expected to start any minute now. ktvu's claudine wong is out there now. it appears the safety meetings are over. and they are arriving here on scene to start their work. you can see these water trucks, pretty critical to this process. what these are used for is to keep all of the dust down. remember, there are health concerns from asbestos and particulate matter.

water trucks try to get everything clear. and they're marked by the heavy machinery in the place. they're really only going three sites at a time. three crews in flee zones. you can see that site across the way. back hoe in place to start the work there. remember, this is going to take time. it is expected to last a few weeks. this morning, the director said the first day of demolition went really as well. they are expected to be cleaned up this morning. and crews will move on to the next three sites. there were more than three dozen homes destroyed in this explosion and fire health concerns, as i said, still an issue out here. the air is clear. no problems to speak of. but they are monitoring the situation. next to the demolition and the perimeter homes. one was stopped immediately.

so more water could be put on the site to cut down on the ash. >> they indicated that they thought the operation was going very well. and they thought they were happy with the operation. so a lot of eyes on this operation, as are a lot of eyes on just the investigation into this. the cleanup is something that everyone is watching very closely. san mateo county is handling and heading up this whole process. and again, really three sites at a time. they are working 8 to 6 every day. the only day they take off is sunday. and the only thing that would stop them, they say san bruno is known for its winds. that would shut it down. if they find anything under, one of these broken walls they say something under there might be salvageable.

we are on complairmt and vermont to give you a little perspective from where we are, where you can see all of these streets are affected, obviously, by the explosion and the disaster. what they're going to do here in a couple of hours is walk us through the bear tour, which is something they have not done in several days since all of this happened. we are finally going to get a chance to go in and take a close look at what we're doing. that will be a development we'll watch throughout the day. live here, claudine wong, ktvu channel 2 news. time now is 8:05. we're now hearing that california's record budget stalemate may end soon. after meeting yesterday in southern california, you see the mayor, the so-called big five announced they have have a plan. they did not give details. talks are set to go through the weekend to put the finishing touches on the deal.

he saws the big five plan to meet at the governor's office on monday. the legislation would then have to draft a language for the budget. once that happens, the budget goes to the floor for debate and possible vote. this process could take several more days. when a budget is finally passed, it would be the latest budget in california history. students at san jose city college are concerned about their safety this morning, following two attacks on women. ktvu's kraig debro has been on camp us all morning. and has more on what precautions some students now plan on taking. good morning, kraig. >> good morning, tory. there's these two incidents. don't know if these were the power of suggestion. but this is the parking lot.

back on september 14th, it was a tuesday. a woman arrive here at 5:30 in the morning. she parked her car. she was getting out of the car. a man approached her, pushed her back in the car and raped her. she reported this to san jose police about two hours later police are investigating the incident. unlike the science complex, the students at the cosmetology schools say there are signs of about at least one of the instances posted. that's not the case at the science complex center. i walked in earlier and they didn't have any signs. i talked to some of the students and they said there was a man in a bathroom who had bitten a woman's hand. the students say what the signs say on the inside is great. but it's still not enough. and they say that they're considering extra measures. i think they could have done a little more to make us

aware of what was happening. other than just a safety alert. >> i don't know. do you bring pep -- bring pepper spray? they're escalating what they're doing. they don't talk to us about what they can be doing or telling us to be safe or anything. >> now, here's the description of the man involved in the rape. hispanic or african american male, 6'tall, 200 to 300 pounds. wearing a black wind breaker zipup suit. he is believed to be a homeless man because the woman reported that he had dirty clothes on and he had an odor. the other instants involved a woman going to her car in the second floor of the parking garage. that is near the football field there. she was just about to her car in the stairway. somebody came up behind her,

pulled up her sweatshirt, pushed her against the wall. she fought back. the man ran away. then she ran to her car and left. the man didn't take her any further. so there's at the least two things that happened here. but some students are concerned, they're hearing about more than two. and they want campus police to alert them more firmly. reporting live in san jose, kraig debro, ktvu channel 2 news. eight minutes after 8:00. there is now a police sketch of the man suspected of trying to sexually assault a female jogger in san jose. he is described as latino, in his mid-20s, fight'6" tall. the jogger says she was attacked on sunday. investigators say the suspect jumped out of some bushes and pushed the woman into an aqueduct, where he tried to assault her. but she fought him off and ran away. time now, 8:09. your commute may be affected this morning. sal, i know you in chopper 2 have been very in keeping an

good morning to you. welcome back. a federal judge will decide whether to lift a nearly five- year moratorium on executions here in california. the ban was issued after a legal claim that lethal injections inflict cruel and unusual punishment. however, the state says it has upgraded the execution process since by building a new death chamber and has retrained its staff. the state says it's now ready for lethal injections to resume. if the ban is lifted, the ban you see in this -- man you see in this picture, who murdered a little girl in riverside, will be the first to be put to death on wednesday. the san francisco medical examiner has concluded that an obese jail inmate, named josiah downs, died at the hands of sheriff's deputies last september.

the medical examiner ruled that the 31-year-old's death was a homicide. that does not indicate criminal activity, only that step downs died because of the actions of others. downs was forcibly restrained twice, just before his death. the coroner says he died of positional asphyxiation. the sheriff says the department procedures were followed. all of this is still under investigation. it is 8:16. the fbi is helping new york city police investigate the apparent murder of a nick rag nicaraguan diplomat. the body was found in his apartment yesterday. his driver went to pick him up for meetings at the united united nations. his throat had been slashed two bloody knives were found in his apartment. he had worked at the consulate in new york for the last eight years. president obama is spending his last day at the united nations general assembly and meetings with other world

leaders. he is also condemning the inflammatory comments made by the president of iran and his address to the general assembly. president obama mahmoud ahmadinejad suggested the u.s. president may have been involved in the september 11th attacks, in order to help the u.s. economy and assure israel's survival. he did not explain what he meant by that. members of the u.s. delegation and 27 other nations walked out of the room. time now, 8:17. we're hearing more about sarah shord's 418 days inside a prison. shoulder describes life in the 10-by-5-foot cell. she said when she was first taken to the prison, she was interrogated several times a day. she was told to write down the questions. and if the questioners didn't like what she wrote, they would tear it up and tell her to write it again. sarah shourd said she was not physically abused. >> it's all psychological. and it's just -- the hardest thing, of course, is being so

alienated from your family. i begged and cried for a phone call. and i didn't get it until, i think, the 7th month. >> shourd said there were a few bright spots, like when shane bower asked her to marry him and also her 32nd birthday, which was last month. somehow, bower and their friend, josh pital, persuaded their guard to bring her a cake. she said she is desperate to win the release of the other two who are still in iran. may decide today whether to issue an injunction against the military's don't ask, don't tell policy on gays in the military. earlier this month, a same judge ruled that not allowing gays to serve openly in the military is unconstitutional. the obama administration does not want an injunction, however, saying it is up to congress to repeal the ban. well, entertainer eddie fisher has died at the age of 82. and we'll tell you about that story in just a moment.

california to offer emergency room wait times by text. the good samaritan hospital and a regional medical center of san jose are offering the program to help residents determine which emergency room has the shortest wait times. users just have to text the letters, "er "to the number 23000 from a cell phone. the wait times are also posted on both hospital websites. they are updated every 30 minutes. time now, 8:23. palo alto's facebook, apologized for the worst technical outage for four years. many facebook users couldn't get on their accounts for 2 1/2 hours yesterday. most were getting a message that read "dns failure." facebook said it was a problem with an automatic error- checking system. facebook is investigating what happened. a transit agency says, "just fire the bus driver" who appears to be reading a kindle and video that was shot by a passenger.

recent campus crimes ktvu's kraig debro is out there. >> we saw a patrol car coming through this area where we are now where one of the incidents happened 10 days ago. one of the students even said she is considering wearing pepper spray. it might be a complimentary option. the apartment complex, where the female student was attacked and raped, she was getting out of her car and she was forced back in. campus website says the victim waited to report the crime. and when she did, campus police say she reported the crime to city police. but according to an employee we spoke to this morning, campus police don't even clock in until 7:00 a.m. and this happened at 7:30. i just started here the end

of august. and there's already like three incidents already happened. it's crazy. >> it's kind of scary. i don't know why it would be happening so close to us, you know? it's not very comforting. >> reporter: earlier this week, on tuesday, a female student was assaulted on the second floor at the lee avenue parking garage. the victim was walking to her car, when a suspect grabbed her sweatshirt from behind and slammed her into the wall. the suspect then grabbed her by the hip and hushed his body into hers. the suspect did not follow. she called police to report the crime. now, this first incident that happened on september 14th, here's a description of the suspect and that crime, possibly african american or hispanic, 6'in tight, 250 to 300 pounds. last seen wearing a black zip- up style windbreaker. they think he might have been homeless, because he was

described as being transient, wearing dirty clothes and having a smell. reporting live, kraig debro, ktvu channel 2 news. we have an update on developing news we have been following this morning. that motorcycle accident in oakland. it happened a few hours ago on hegenberger road, near lite drive, close to the oakland airport. police are still on the scene. and traffic is still being diverted because of this accident. the motorcycle crashed into a van. we don't yet know the condition of the drivers involved. but it's causing a backup in the area. people trying to get to the oakland airport should take 98th avenue. that is the exit to the south of hegen berger, as an alternate route. another tragic accident overnight. a bicyclist was hit and killed on a bay area freeway. it happened on interstate 505, north of vacaville, north of midway road.

police say the unidentified bicyclist, believed to be in his 20s, somehow rode into the lanes of traffic and was killed. the driver who hit him flagged down a chp officer a mile down the road, saying he thought he had hit a deer. the highway patrol is investigating. time now, 8:33. two people were shot and wounded overnight in oakland. this happened around midnight. police were called when the two victims, one of them in critical condition, sought treatment at highland hospital. a police search of the crime scene showed bullet casings scattered over the street and an undisclosed amount of cash. that investigation continues. well, oakland is getting a lot of help from the government to help fight crime. the city just received a $3 million federal grant to pay for some of its violence prevention programs. about $2 million will be set aside for a program to keep at- risk youth out of trouble. $750,000 will help put teenagers getting out of juvenile detention, back in school.

an additional $750,000 will help young adults find jobs, after getting out of jail. 8:34. phillip garrido is due back in court today for what could be a very important hearing in the jaycee dugard kidnapping case. the sacramento bee reports that lawyers could announce that the accused kidnappers may be mentally incompetent for the trial. if such a move is made and if the judge agrees to a mental evaluation, it would put an immediate hold on the case. there is heightened awareness in contra costa county, following three separate incidents where strangers tried to lure some off the streets. the past attempts in brentwood, pleasant hill and walnut creek. brentwood police say a man tried to lure them into that city, by telling them, their parents asked him to walk them to their soccer games. similar incidents have taken place near pleasant hill middle

there this afternoon. and this is why. construction of a tunnel under the bay from menlo park to newark. it is a five-mile long tunnel. it will ensure that residents will have clean water after an earthquake. this is expected to be done in 2015. i want you to take a lock at news -- look at news chopper 2 which is above the construction site this morning. this is the first tunneling project underneath the bay. many think that the transbay tube carries passengers underneath the sea. but the transit tunnel is actually a sunken tube, anchored to the bay floor. this new underthe bay passage way, will actually transport billions of gallons of water to cities up and down the peninsula. the i don't know is -- the hope is to deliver the water to two- thirds of the residents within 24 hours of a catastrophic event. >> many of these pipes were built, the original ones, in
