vulnerable in our society. my son can't defend himself, he didn't use his voice to express himself. >> reporter: it contained more than $73 that people had already donated. evergreen market also had a box for a few days but someone picked it up. the store owner showed us this surveillance video that showed a man taking the box on monday morning. >> i don't understand what's going on in people's mind to take advantage of people and people's hearts. >> reporter: as to where the picture was taken from, it was on the website of the autism foundation until this afternoon. police say they always want people to donate to reputable charities. john sakaki, ktvu news. the man accused of shooting an undercover police officer pled not guilty to attempted murder, carjacking and eight other felony charges.

the courtroom was filled this morning, cameras were not allowed at this morning's arraignment. freemont's police chief says officer todd young has more surgery again this morning. and has been undergoing physical therapy. a new gang crack down is under way right now in san francisco. it comes after a court issued another injunction today targeting two rival street gangs in the city's visitation valley neighborhood. ktvu's david stevenson joins us now, he's in san francisco with the story. >> reporter: some are skeptical it will help curve crime. >> i doubt it'll do any good but you know nothing will happen if you try. >> reporter: the city declared an injunction against two

gangs. the injunction targets 42 alerts of the down below gangsters. >> the vast majority of the people not only live in the area of the safety zone, oftentimes in this case similar they don't even live in the city and county of san francisco. >> reporter: a dozen young people arrived at court just after the ruling but declined to talk. joshua calls the injunction bias against those who can't afford an attorney to fight it. >> something is very wrong when you are accusing people and then saying, but by the way we're going to make it civil so that you cannot get an attorney. >> reporter: others in the injunction zone say it's worth a try. >> it's best off that you have a barrier there to where it'll

keep people doing a lot of negativity around the area. >> reporter: the city attorney says other gang injunction here have demonstrably lowered street crime. the men must be notified by the police of the ban first. drug agencies some 3,000 marijuana plants from a corn field in brentwood today. an anonymous tip led alameda contra costa authorities to that site. the marijuana was planted among the corn stalks, the encampment was also found. the people fled before authorities arrived. the national transportation safety board has a 27-foot long section of the natural gas pipe that ruptured on september 9th

as well as two surrounding pieces at s training center in ash burn. eight people were killed as as a result of the explosion and fire that destroyed three dozen homes. in san bruno the demolition and clean up continues. it is very careful work as crews try to contain potential toxins in the debris. the clean up began a week ago and is expected to take another couple of weeks. san jose police are alerting the public about a robber targeting atm users. a brazen robber to return to the same spot, all by surveillance cameras. >> reporter: we're outside the chase bank at capital expressway. chase wants says it is

reviewing surveillance camera. police investigators say they believe the same man came to the same atm location twice to conduct the same type of robbery. security camera pictures shows the suspect following their victims into the chase bank vestebule. >> you would think it would be more secure but at the same time because you have to walk in, somebody can walk in right behind you and now you're trapped in that little room. >> reporter: on august 28, a man covered up in dark clothing grabbed a woman from behind at knife point as she conducted her transaction and fled with her money. days later, police believe the same man attacked another one at the same atm. >> there was a brief struggle where the victim ended up on the ground. it appears he was frustrated at that point and he fled the scene without robbing her. >> reporter: police describe

the suspect 5'seven to 6 feet tall, thin, wearing a dark hooded sweatshirt with black or dark shoes. possibly with a mustache and dread lock hair style. >> i try not to come to atms at night. really don't use atms that often. but i imagine from now on i'll look over my shoulder more. >> reporter: anyone who believes they have information on this suspect is asked to call police investigators. live in san jose, robert handa, can,ktvu news. ktvu has learned joe biden is expected to arrive in the bay area tonight for a campaign event. the vice president will attend a private 9:00 a.m. event tomorrow in oakland with congressman jerry mcnurry. the vice presidt's office won't say what time he's arriving but ktvu has learned flight restrictions are being put into place at 7:30 this

evening over oakland. the scandal surrounding republican meg whitman and former housekeeper escalated today. diaz' attorney gloria alred released a copy of a social security administration letter sent to whitman in 2003 notifying her that diaz number did not check out. >> we never saw the letter, nikki did bring in our mail and sort the mail. >> meg whitman should be ashamed. embarrassed, she has lied. >> reporter: whitman says she dismissed diaz in 2009 after finding out about her immigration status. diaz' says she was abruptly fired after asking help getting a green card. the budget is now a record

92 days late. that is near a quarter of the new fiscal year. the so called big five met last week in southern california and announced a flame work for a tentative agreement but there are still several sticking points including the governor's push for pension reform. california is facing a $19 billion budget gap. lawmakers are expected to resume their budget talks tomorrow. in oakland, hundreds of people looking for work lined up today for a job fair hosted by several state and local agencies. about 35 companies were there at the alameda county conference center including comcast, union bank and manpower staffing. job seekers say finding a position is extremely tough. >> i've been on some interviews, i was told i was overqualified and i haven't figured that one out. and it's just, just a little tough. >> reporter: in addition to talking to perspective employers, job seekers also

from california to new jersey, bullying has turned deadly three times in the past week. these three young men are all from different parts of the country but it's believed all three committed suicide after being bullied because they were gay. ktvu's patty lee -- patti lee bringing the story. >> reporter: the three suicides bring the problem into the spotlight, problems that are being addressed locally. >> you're going through these

frustrations, you know exactly what it's like. >> reporter: 11 and 12-year- olds may seem too young to deal with these issues. >> i deal with bullying on a daily basis, i deal with gay problems on a daily basis. >> reporter: now 18-year-old college freshman tyler clemente have jumped off a bridge after images of him having sexual relations with another man hit the internet. >> because it is just out there. a whole bunch of people can

read it and get hurt. tonight a support group for gay, lesbian students. hundreds of parents are gathering at 7:00 and talk about ways to keep problems like bullying at bay. patti lee. a los cados mother accused of having sex with a minor is out of jail today. she posted $30,000 bail and was released this morning. police say she had sexual relations with an underaged boy earl this summer and that he was a family friend. sara cole made news on ktvu after she was in an accident and the vehicle crushed her legs. at that time the community

rally around her and her family. and fisher-price has issued a toy recall. there are three problems. >> number one they do it because they want to keep the name that they have. and number two they have to to protect themselves. >> so far fewer than 50 children have been hurt. all the injuries were minor. and you can see a complete list and photos of those recalled products on ktvu.com. just click on the recalls tab. new playground equipment is causing a bit of a stir at elementary schools in nevado. the new state of the art equipment at eight elementary schools was off limits to students. six children have been injured after using the equipment which was unveiled at the beginning of the school year. >> until we can get the

manufacturer here next week and have our board meeting, i thought it would be better for us just to close the playgrounds for right now. the equipment cost about $1.6 million to install and comprise with all safety standards. people who cause a car accident in san francisco will soon be hit with a clean up fee. the department plans to start collecting the fee in two weeks. the board of supervisors approveed the plan in july. officials say the insurance company of a driver found to be at fault in a traffic accident will be charged up to $500. some other california cities are already doing this. san francisco will be the first big city in the state to charge the accident clean up fee. well on to the weather now and our chief meteorologist bill martin. you called it. you said it was going to continue to cool off through the week and it sure has. >> it definitely has cooled off. it wasn't a real tough forecast in that because when you are up 105 as we were in the last

couple of days it has to cool down. the fog is pushing into your neighborhood tonight. let's go a back about an hour, i want you to see where the fog is. you have fog out toward pacifica and half-moon bay. there's pillar point harbor. you have pacifica, you're in the fog right now. most of us will see fog tomorrow morning out by the bay and peninsula. more fog tonight, cooler tomorrow and a cooler weekend: but do not change your weekend plans, because here's the deal, it's going to be cooler but it's still going to be a nice fall weekend. certainly cooler than it has been in the last week. this low pressure center will impact us by bringing clouds up from the north. that's not supposed to be down south like this.

usually they come from the north. it's a different kind of low. as it comes down it'll bring showers, the clouds will seep into our area. i don't think we'll see showers, we'll just see more mild weather because that low will take the fog and just push it inland. so four degrees to 6 degrees cooler inland. maybe some showers will show up down here as i mentioned down around fresno. i don't think as far north as modesto. we are looking for our temperatures tomorrow, take a peak and you can see at noontime it was in the mid-80s in the warmest spot. as we head into the afternoon hours, you're going to find temperatures a little bit cooler than those. here's the forecast, you have the fog. 7:00a.m., big push of it. then you take a look there and you have the fog that burns down very, very rapidly. the five day forecast looks like this. plenty of sunshine, cooler as we go through time.

and disregard that one graphic that came up. it said 96 i hope you didn't notice it. >> forget that one. >> forget the 96, daytime highs mid-80s. september is almost over and the bulk of the grape harvest is yet to get going in the in the napa valley. an unusually cool summer meant grapes mature slowly. napa grape growers say they are yet to start harvesting any grapes. a ground breaking was held this morning at the north king road site for the new san jose family shelter. the $16 million project will create a new facility with bigger rooms and private bathrooms. >> the only place in santa clara county that families with dads or boys over the age of 11 can go. a dad by himself with children,

dad and the family or older boys. >> a new shelter will be located, or the new shelter will be located in a neighborhood rather than a commercial district. stocks slipped today as investors decided to not invest in falling stocks. apple has taken its legal battle against nokia to the uk. nokia has already filed a lawsuit. nokia is seeking royalties but now apple has filed a separate lawsuit over the issue in britain. a governing trade body in the united states is expected to weigh in sometime next year. well a crucial afternoon gain for the giant, did they

about his latest performance. >> i'm giddy, but it was a factor to get the job done. it felt good to get the first one here. i was probably more relaxed, trying to keep myself from getting excited here at home because it's easy to do sometimes. i felt i was a little more relaxed tonight than i had been. >> tomorrow we're going to go out there and try to do our best. tomorrow we're going to play like it's our last game. that's how we've been doing all the time. >> everybody knows that they have really good pitching. it's been their strength as well as with ours throughout the course of the year. it's going to be a battle. you just go in and you try to move guys over. do the little things, you have to do the little things right to beat these guys. >> it'll be an incredible weekend. meantime the voting the complete. the game of the week will be acaladas and mira linda.
