the ktvu channel 2 news at noon starts right now. good afternoon. we begin with breaking news out of fremont where a motorcycle officer was hit by a van. it happened near warm springs road and interstate 880 just about an hour ago. police say the officer was checking on a stolen vehicle when the us dent incident happened. the suspect fled the scene and has not been apprehended. part of warm springs road is also closed right now. we'll have an update as soon as we learn more about the situation. a short time ago, the court has unanimously upheld the governor's order to furlough state workers for two to three days a month. kraig debro joins us now with

details and reaction. good afternoon, kraig. >> reporter: good afternoon,er tory. we're at the dmv on feld street in san francisco. workers at the the dmv and their coworkers are gonna be affected by this ruling. the union at first challenged the concept behind furloughs they say they are disappointed but they say it's a split decision. the governor ordered about 200,000 state governors to take a day off without pay. the idea was to save money and help with the budget. the court says the governor doesn't have the unilateral authority to implement furloughs. >> but then they said the the legislature gave them that authority by putting the cost savings into the project. so it was a split decision in that sect. >> reporter: the furloughs for

those who supervise work on the bay bridge and other highway state projects. but 95% of those workers are paid from federal money and not the beleaguered budget. unions representing the workers say the governor's violates the bargain agreement already in place. and it has the practical effect of cutting salary by 27%. >> well, we have to balance the budget some way. i don't know. i brought some work to do. so i'm okay. i've been standing here since 9:00 this morning. and it's ridiculous. >> reporter: in its unanimous ruling the state supreme court court said the state legislature in their budget

session validated this. we made calls to the governor's office for comment but calls were not returned. reporting live in san francisco, ktvu channel 2 news, kraig debro. >> thank you, kraig. the state is finally close to getting a new budget. lawmakers will vote on thursday. the details for the closing of the state's $19 billion deficit errorredly include $7.5 billion in spending cuts. that's down from the $12 the governor asked for. the deal anticipates getting $5 billion from the federal government. >> reporter: the governor is still reportedly in negotiations over paid pension form, which he has says is mandatory for him to sign the budget. the debate for the two

governor candidates have been cancelled. the brown camp said they were only in the discussion stages of this and never confirmed. both sides confirmed their candidates will not be on the show tomorrow. there were heated exchanges about whitman's housekeeper. the face-off at fresno state university saturday was the first-ever spanish language debate in a governor's race in california. the issue of immigration reform came up repeatedly and whitman was asked about the undocumented housekeeper she employed for nine years. whitman blamed brown for the controversy. >> jerry, you should be ashamed. you put her deportation at risk. you put her out there. you should be ashamed for sacrificing nikki diaz on the altar of your political ambitions. >> don't run for governor if you can't stand up and say,

good afternoon, claune. >> reporter: good afternoon, tori. yes. at this hour, police are still searching for this 18-year-old san jose woman. but the question remains has she actually been kidnapped. her mother doesn't think so. but police say this the man -- man she was with has already proven he can be violent. until they hear from her they are gonna work nonstop to find her and get to the bottom of this. 18-year-old julie la lives in this san jose hole. she was there yesterday asleep according to her mother. the problems started, according to her mother, when judy's on again/off again boyfriend, this man, came to the house. >> the boyfriend come to check on her and look through the window. >> reporter: he got jealous? >> yes. he saw. and he got jealous. >> reporter: according to neighbor, the 28-year-old stabbing victim, who has yet to

be identified, went door to door bleeding and pleading for help until finally a neighbor opened the door and called 911. he's in the hospital. judy's mother says she took off with her boyfriend. so she left on her own willingly? >> yes. >> reporter: do you think she was kidnapped? >> i don't think so. he says, do you want to go with me? >> reporter: and she left? >> yes. >> reporter: la said she asked her daughter where she was going but got no response. >> a lot of information here to decypher. we weren't certain who we were dealing with, was this a kidnapping? was it not a kidnapping. at this point, even this long in to it, we're still not 100%%. it's better to err on the side

of caution. >> reporter: what police say they know for sure is attacker is with judy. judy's mother, too, would like answers. >> yes, because i don't know what's going on right now. >> reporter: police believe the two may be in the suspect's car which is a black lexus. ktvu has learned that the suspect has a violent record. they've learned he is violent and can be violent. they want to track down these two as soon as possible. a kidnapping suspect is in the hospital and a mother and baby are safely back home. this is after a terrifying incident that ended on 280 on woodside saturday night. police say a 26-year-old kidnapped his ex-girlfriend and the couple's 11-month-old daughter from the san jose home. they say he then raced up and down the peninsula before

intentionally crashing his car and jumping off a 30-foot overpass. the suspect is at stanford hospital. his condition is not known. today japan and sweden joined the u.s. and britain in issuing a warning about a possible terror attack. britain's foreign office warned travelers that the terrorist threat there was high. yesterday, the state department advised american citizens and travelers in europe to take precautions about their personal security. the japanese and swedish messages were similar but there are no details about specific targets. >> it has the ring of, look, the government knows there's this threat and it is an increasing problem. what they really want to do is protect themselves that they warned you. >> we're told the air has not kanged any procedures and travelers told ktvu they are

for the fifth time since june, a woman has been assaulted at an apartment complex in unincorporated walnut creek, a few blocks from the pleasant hill b.a.r.t. station. now, some of those living in that complex say they want to get out of their leases. >> reporter: a security guard stood a the front gate of the apartments. guards now patrol the apartments. >> i'm leaving. i'm leaving on friday. they can take us to court on

monday if they -- to court for our money if they want. >> this is obviously a specific place targeting specific people and the management people won't let them leave without penalizing them. >> reporter: a man tried to force a woman in an apartment and tried to rape her. the woman tried to free herself, falling down stairs, as she vam belled away. she did manage to get away. >> i have not seen anything like this. >> reporter: investigators are looking into whether saturday's attack is tied to the sexual attacks of september 15th. >> the big question is whether or not it's the same pentagon. we just can't answer that right now. >> reporter: the complex manager would not comment on the lease policy. in connection with the three attacks, authorities arrested this man -- antonio moutoul. he's pleaded not guilty but no

arrests have been made in the latest two attacks. saturday's victim gave a vague description of the attacker wearing jeans, a t-shirt and a ball cap. authorities say the attackers were both described as white men, about the same height, with facial hair. in walnut creek, jade hernandez, ktvu channel 2 news. the state department of fish and game is working to contain the diesel spill in the guadalupe river. the diesel came from a tank on top of at&t corporate building on south all maddon boulevard. it leaked fuel and part of the fuel was cleaned up. but some fuel went into storm dreams and the guadalupe river. so today crews are placing womans until it evaporates. the supreme court is back in session with its newest member. the high court convened at 7:00 a.m. our time with elena kagan

the condo complex owner on esplanade avenue say they've learned from their past mistakes. they are planning to spend millions of dollars to make sure their buildings don't fall in the ocean this winter. the apartments are still vacant due to safety concerns. let's check in out with our meteorologist, mark tamayo. boy, a lot cooler than a week ago. >> that's right. temperatures have really dropped off the last few days. i'm tracking rain outside of the region, primarily to the north and east. and also the southern sierra. we have some snow to authority for the higher -- snow to report for the higher terrain. we still have lower clouds especially for the southern half of the bay. san jose is reporting cloud cover, milpitas and los gatos. we can show you some of the clouds in place. current hi san jose only in the lower 60s.

whether workers at the pipeline monitoring center were either tired or poorly trained. investigators are also looking at whether welding or corrosion could have caused the deadly explosion. starting today, the commute is a little faster for light rail commuters in san jose. the valley transportation authority launched its computer express light rail service this morning. six new trips are being added between the santa teresa and bay point station. trains are making fewer stops which is expected to shave five minutes off riding time between downtown and south san jose. muni may have found a cure for reducing the number of employee sick calls. "the examiner" reports the management is requiring a note from the driver every time a driver calls in sick. sick-in calls have plunged 42%.

the justice department announced this morning it is suing american express. attorney general eric holder accused the credit card company of engaining in anti- competitive practices. a number of states attorney general have joined in the lawsuit. this comes as visa and master card settled similar anti-trust charges by the justices d. some of san francisco's most popular annual visitors arrived today. the navy's blue angels are scheduled to land at san francisco international airport at 1:30 this afternoon. the precision flying team will practice over the bay and city on thursday and friday. they will perform in the fleet week airshow on saturday and sunday, if weather permits. last year, cloud cover forced the blue angels to limit their acrobat aches but as mark mentioned, the forecast looks nice for this week.
