just a short time ago, fire investigators arrived on the scene of a large year night fire in oakland. the flames destroyed a restaurant. ktvu's kraig debro joins us now with new information. good morning, kraig. >> good morning, tori. this is 29th and park street. in fact, i'm standing on the bridge. if you take a look at the building, as the sun starts to come up, you can really start to tell the extent of the damage here. it's a lot worse than what i looked at it earlier when it was completely dark. you can see the fire caved in that roof. a fire investigator arrived on the scene here about 10 empties ago. i talked to her. she said she would like to go into the building. but if it is not safe enough, she will not go in until they get a building inspector out here. so it can be safe enough for them to go inside the building. i want you to take a electric at this building we saw a little while ago. this boat caught fire, about 50 yards down from the building. the boat was tied up to the

back of the restaurant. firefighters said it had burned and sunk. but it broke loose and floated down about 50 yards down the estuary. the fire that burned that boat started in a restaurant called tiki tom's. a lot of folks knew it as pier 29, but that moved. when firefighters arrived, this is what they saw. the building was fully engulfed in flames. initially, firefighters worked inside the building. soon they had to move outside because the building was too unstable. in addition to the three alarms on hand, the deputy chief called in a fire boat that usually sits idly, unless there is a major disaster. >> played a significant role in putting this fire out, in terms of the amount of water it has the ability to pump from the estuary. so it helped knock down the fire, which is going to be able to help us get in this control much quicker. >> reporter: firefighters say it was part of station 2. but the station was shut down in

about 2004 because of budget cuts. they maintain the boat for help in combatting fires. the fire boat captain just happened to be on duty overnight. otherwise, the boat would have stayed put. the cause of fire is under investigation. i've also just learned that according to some neighbors, the restaurant was not open last night. but nobody is sure if it was just last night or two nice ago. -- nights ago. they also had a cell phone number for the restaurant's owner that the neighbor had. firefighters say they called the number, but it was turned off or not working anymore. let's come back to a live picture. firefighters are now spraying water on the top of the building. there was a steady stream from the time we got here around 4:30, until about 6:00, or 6:30. now it's intermittent. there have been hot spots here. and that's one of the things. you want to get inside, see if you can shoot up at the flames. they're going to be doing this the next few hours. could be a traffic problem this

morning, park street bridge is very popular. people tend to stop and look. so if you have to get in there from alameda, get in here from alameda, might want to take another route. reporting live from oakland, kraig debro, ktvu channel 2 news. time now, 7:03. california may soon have a new budget. state lawmakers worked all night long, trying to pass a budget deal. and right now, they're scruftd -- just one vote short. ktvu's jade hernandez is live in sacramento with the latest. good morning, jade. >> reporter: good morning. we know now that the state senate has been voting since late yesterday afternoon. and dave, as you mentioned, they are one vote short of passing this budget. so the state senators are in caucus right now, they're trying to decide what to do next. we are live in sacramento this morning. we're giving you a look from inside senate chambers. as voting continued early this morning. the state senate passed a main budget bill at 5:00 this

morning. the vote this morning would go through the impasse. we understand the process has been strained because of the absense of some lawmakers, and even one lone democrat who refuses to vote for the budget this morning. this delay has left california on the verge of issuing ious and ending funding for road projects. this is a massive budget, make no mistake. more than two dozen bills make up the $87.5 billion budget. it does count on the state receiving $5.3 billion from the federal government and assumes the state revenue would bring in an additional $1.4 billion in tax revenue. it would also defer payments to k through 12 schools and community colleges until the next fiscal year. >> we know what a struggle it has been to get here. and i point out, and i point to my colleagues and to the public, that given the tools we

have at our disposal, given the two-thirds vote, given the fact that we really govern with one arm tied behind our back, we could only deal with the cuts side. then we do our best with the rest. i think we've done remarkably well. >> the state law -- >> reporter: the state assembly has officially adjourned about an hour ago. they finished up their work. but as i mentioned, we're still waiting for the state senate to vote. and we did speak to the governor's spokesman this morning, he says he is, like everyone else, waiting for a final vote. and we should hear from the governor's office, as soon as that vote comes down. reporting live from sacramento, jade hernandez, ktvu channel 2 news. governor schwarzenegger is also burning the midnight oil. in fact, he posted this photo on his twitter page. this is at 1:30 in the morning. he said he was talking with legislators during the budget

have a better cab thing here. there you go. let's take a look at the south bay commute. northbound 280, better than it normally is. coming up. moving along, taking a look at the westbound bay bridge. getting heavier. and another play-off game in san francisco. 43,000 people or so. at&t park. tough parking on a friday night. can you imagine? it's going to be tough. this morning, in san francisco on california street, injury crash. these are live pictures. california at scott. may actually be impacting the muni lines there. it was an injury crash. now, some of the injured have been taken away. you can see they have completely cleaned it up.

and this car is still blocking the street apparently. give yourself extra time in san francisco. and some of the muni lines that run there, some of the electric lines, may be delayed. this is california street at scott. and it's going to be affecting some of the traffic. in fact, looks like they're turning traffic off of california street. here comes the number 1 california. and i think they might let that bus through. we'll see what happens here. are they letting it through? yep. i guess it's going to get through. there you go. it's going to be a slight delay, but getting through slowly. on this friday morning, a little cold out there for some. we have a couple of upper 30s. that's right. it is cold out there. higher clouds coming in. mainly from san francisco north, just patchy fog. but there are a few areas showing fog. chilly morning will give way to mostly sunny friday. nice to warm on the weekend. and the next seven to 10 days looks like a very quiet pattern. a little warmer, a little cooler, a little warmer. but there's no rain in sight. and no extreme one way or the other. we'll be getting to the 18th of

october if this verifies. but sure looks like everybody is on board with it as far as our forecast models are concerned. stronger part of the system is heading north, way north. that's going to allow the high to build in. and the teeter totter effect. that's a good-looking system. but it's way out there, and it's going north. the system that gave southern california, the sierra, the sacramento and san joaquin valley. a lot of rain has moved out. left behind a lot of cool air, though. lows are mainly in the 40s and 50s. now they're in the low 40s. so we're dropping a good 7 to 10 degrees on these lows, compared to yesterday. highs, they'll come up a little bit. we have to compensate for the cooler lows. 75 in nap a. 68, walnut creek. 74. i thought yesterday was perfect. i really did. yesterday's weather was so nice. 70 -- 74 in san jose. we'll go 76 today. 50 at mount tam. that's only three degrees warmer. you need to see about five or 10 before you see a good

but today's report certainly puts president obama and democratic leaders on the defensive. here are the details. the unemployment rate holds steady at 9.6%. but 95,000 jobs were lost last month, mostly due to widespread government layoffs. the private sector did add about 65,000 jobs. but that is not enough to give much encouragement about the economic recovery. i recently talked to a small business owner who says more hiring is the last thing on her mind. >> i've gotten to the point where for the last couple of years, i pay more to my employees than i pay to myself. >> president obama weighs in on a statement. and in today's report, in about an hour and a half, he told a campaign rally in chicago last night that he, too, is impatient with the economy. reporting live from washington, d.c., alison burns, ktvu channel 2 news. it is 7:16. the chinese government is reportedly enraged about this year's pick for the nobel peace

prize. it was awarded overnight, to imprisoned chinese dissidents. lee jalboa. last december, he was sentenced to 11 years behind bars for writing a 2008 manifesto, along with other activists, that calls for free speech and multiparty elections in china. china says the decision will hurt its relations with norway. one name that had been mentioned as a possible peace winner was missing dissident, gao zhisheng. there is a website dedicated to supporting him. his wife now lives in sunnyvale, after recently being granted asylum. she says she has not heard from her husband since april and is increasingly worried about his safety. time now, 7:17. well, jerry brown's campaign is apologizing to his republican rival in the governor's race, after an offensive remark. an audio recording captured either brown or one of his

aides, calling meg whitman a whore. they were implying that whitman sold out to special interests. well, brown thought he had hung up and disconnected the phone call, but a private conversation between brown and some of his staff was still being recorded. a spokeswoman for meg whitman said while it's hard to make out what is on the tape and who said what, this is an insult to both meg whitman and to the women of california. 7:18 this morning. some people in the castro district are surprised to see an image of former alaskan governor sarah palin beaming down on them. she has a speech next thursday. and the liberty and freedom foundation put up a banner about the event at a gas station at the corner of market and castro. foundation members say that castro is all about tolerance, so they thought it was the appropriate place to advertise.

others are wondering just how long that sign will last. gavin newsom and abel maldonado had some sharp exchanges in their first tv debate. the two traded their harshest words when discussing illegal immigration and the rights of diverse groups. maldonado criticized san francisco's liberal city policy. >> then after that, if that didn't work, he would send them to san bernardino. >> we have very different point of views that relate to the rights of our diverse community. he opposed not once but four times, domestic partnerships. >> the two have another debate scheduled in los angeles, a week from today. time now, 7:19. earlier this year, san francisco's crime lab scandal made headlines. now are there's a similar case across the bay. oakland's police chief anthony bats says his department is

investigating allegations of miss conduct by a crime lab technician. the unidentified employee analyzes drug and evidence. but chief bats says he's found no evidence of wrongdoing and no crim cases are in jeopardy. classes are expected to be back to normal at uc berkeley, following yesterday's national day of action. >> walk out! >> walk out! >> now, hundreds of students, professors, and workers, staged these protests at schools nationwide, in response to the drastic cutbacks, tuition increases and layoffs. at uc berkeley, one group took over two classrooms in doey library, but eventually left on theiron. -- their own. campus police are reporting no arrests. some frightening moments at a southern california amusement park. the accident that sent several people to the hospital. also, the new owners of the golden state golden state warriors, paid $450 million to buy the team. but a court mediator says they

7:22. breaking news right now from sacramento. california lawmakers have finally passed the long overdue budget. 100 days late. supposed to have been passed back on july 1st. the debate has been going on all night in the senate. it passed earlier in the assembly. but there was a lot of caucusing and debating in the senate. they were one vote short. apparently now they have gotten that vote. and the budget has passed. governor schwarzenegger was up all night also. he said on twitter he was going to sign the budget the minute lawmakers approved it.

ktvu's jade hernandez is in sacramento, and she joule will join us -- she will join us shortly for a live report. but finally, 100 days late, california has a state budget. an accident at a southern california amusement park. two roller coaster trains collided at knott's berry farm yesterday. some of the victims were rushed to the hospital. but their injuries are described as minor. investigators say the train leaving the station didn't make it over the first hill. then it rolled backwards and smashed into the other train. the golden state warriors are said to be behind in their rent. that's according to the agency that runs the oakland coliseum and arena. the coliseum authority says the team owes almost $11 million in rent and other fees. however, the warriors' new owners say the team is owed money by that agency for installing a new scoreboard. a mediator has ordered the team to pay up, and says the

warriors could be held in contempt of court for refusing to pay. it is 7:34. we want to check in once again with sal castaneda, keeping a close eye on the friday commute. friday light out there at all, sal? >> reporter: a big problem in san francisco. i want to mention it because there is a problem on california street near scott. and i do think we have a picture of that. this is an injury crash, with, you can see some of these cars going by. a car was smashed into. and they have towed another car away. in fact, looks like the other car is just about to be taken away, or they have put it onto a tow truck here. it was a red light commission. so one of these two vehicles, according to police, ran a red light. and it was a pretty high-speed crash here. again, california at scott. and the muni buses are getting through, but the police are still investigating. again, police say it was a red- light collision, someone blew through a red light. let's take a look at westbound bay bridge.

the many supplemental bills. the state assembly passed the main bill yesterday afternoon and finally adjourned after 6:00 this morning. this is after a record 100-day impasse without a budget, and it closed a $19 billion deficit with no new taxes or fees. and the state was preparing to issue i.o.u.s to state contractors. the governor now has to sign the budget in order for it to become official. and he said he will do that the minute that the state lawmakers are done with it. again, the state budget has now passed. and ktvu's jade hernandez is in sacramento. she'll have more for us coming up shortly. time now, 7:31. back here at home, fire investigators say it is still not safe to go inside of a restaurant that burned down in oakland last night. ktvu's kraig debro is there now with the very latest. good morning, kraig. >> thanks, dave. this is 29th and park. the park street bridge, going

from alameda to oakland. you can see the firefighters on the roof. they cut through the roof. when they do that, they find a hot spot, spray water in, put it out. very difficult job. but they are doing what they have to do. there are still some hot spots that can hide in the pockets. there is a fire investigator out here. but as we said earlier, fire investigators and the other firefighters aren't going to go into that building yet because of the instability of the building. they got the call around 11:15 last night. to come out to this address. it's called tiki tom's restaurant and bar. when they got here, the building was fully engulfed in flames. you can see the pictures right here. tremendous flames. apparently, they have been going for at least a little while before they got the call here. fire crews got here. initially, they were inside the building. then they had to fight it from the outside. because the building was simply too unstable for them to stay inside safely. >> they initially made an attack, an interior attack and quickly backed off and we went all defensive. the fire quickly went to a

third alarm, at which time, it was all defensible at that time. >> trained personnel were assigned to the fire boat. moved to the estuary, where we were able to extinguish a large body of fire. >> reporter: now, this fire boat is actually sort of on a hiatus because of budget cuts. it remains idle. they use it usually for disasters, to fight fires after disasters. now, there was a 50-foot cabin boat out back of this restaurant that caught fire. but when it caught fire, it was right next to the restaurant, it came loose and drifted about 50 to 75 yards away. now, hours after firefighters thought this boat had either sunk or the fire was out on the boat, it rekindled. so they had to call an engine out. the engine was actually here, went down a couple of blocks and the firefighters began to put out the fire on the boat. nobody was inside the restaurant. that's the word we're getting. talked to firefighters. they said they spoke to a maybe

neighbor -- to a neighbor who said the restaurant was not open last night. the neighbor had the owner's cell phone number. the number was either not being answered, or not turned on or perhaps was not working. again, the investigation is being slowed because of the building is not all that safe. they'll get a building inspector out here to determine when f they can go in any time soon and determine a cause. reporting live in oakland, kraig debro, channel 2 news. a tragic overnight accident killed a 24-year-old milipitas man on southbound highway 20. the chp says the blue nissan was going too fast and collided with a tractor-trailer. that nissan was spun across two lanes. the passenger inside that nissan was also hurt. however, the drivers of the two other vehicles were not injured. a fatal crash involving a muni bus and a bicyclist is under investigation this

morning. san francisco police say a man was killed just before 5:00 last night, on 6th avenue near clement street in the inner richmond district. police say the bike was beneath the front end of the 44 o'shaughnessey bus. the victim's name has not yet been announced. federal agents are patrolling amtrak at this hour. ktvu's claudine wong is there with a look at this. >> reporter: we are seeing an increased presence out here at the oakland amtrak. several agencies out here. we have amtrak police, oakland p.d. came through here, tsa, and homeland security, all out here patrolling the station. it is a pretty impressive showing. but that is the point. and this is just the beginning. amtrak told me this all came together pretty quickly. but law enforcement agencies stepped up to the plate to be a part of operation rail safe. the idea is pretty simple. a large show of force, just to keep people on their toes. that means riders and anyone

looking to cause trouble. sergeant, riders -- certainly, riders we talked to said they noticed all of the extra security. and one man said he does think these types of measures are effective. >> it's effective for me. because i never know when they're here. i'm surprised to see you here and searching the trains. and i don't think it's very invasive. so i don't think it affects my ride at all. >> definitely makes you think when you see them? >> makes me think. and i think it is a nice show of force and nice sign that they're trying to keep the trains safe. >> reporter: so this is happening here and across the country and internationally. rail systems in europe are also on board with this action day. this is actually something that has been happening more frequently on the east coast. but there's now a push to do it more often here on the west coast. this operation is being publicized today. but there will be many more, according to amtrak, more unannounced efforts like this in the future. police say this is not in response to any threat. but they say everyone needs to be on alert at all times if we

well, tonight, at about, oh, i don't know, 4:00 or so, 4:30, it's going to look like this again. because a lot of people come in to town for those play-off games. and i know not everyone is a baseball fan. people come into the city, perhaps to do dinner or a club or whatever. just be aware it's going to be a lot more crowded in san francisco because of the giants game. northbound 101, that traffic looks okay, coming up to the 80 split yesterday in the afternoon, we had a lot of people on 101 trying to get into san francisco. on friday, today, i think it's going to be even worse. make plans, take transit, whatever you're doing tonight in san francisco. also, we're looking at the commute. we're going to go to the maps if we can, fellas. it might be a little confusing. we're showing you antioch and concord and walnut creek. and the traffic is slow. southbound 680 is also slow. pleasant hill to walnut creek. and east shore slowing between richmond and berkeley. and a very happy friday morning. big weekend, you know.

stocks are mixed this morning. after the unemployment report came out for the month. and there are some traders looking for silver lining. they say after that weak report on unemployment added to expectations, the federal reserve may step in to prop up the economy. and that's helping the dow right now. at least the dow is currently up 10. at 10,959. nasdaq is down 7. s&p is flat.

this is about jobs for september. 95,000 jobs were lost last month, which is much higher than the 8,000 economist his predicted. most of those now out of work were seasonal workers, hired by the government to help with the census. but the national unemployment rate remains unchanged at 9.6%. economists had expected the rate to up to 9.7%. there is good news about jobs on the local front. the los angeles times reports, google is expanding its operations in san francisco. the search engine will add 63,000 square feet of office space at its spear street complex, by taking over office space previously used by a biotech firm. google is looking for 50 new workers in the office. including customer support, soft wear engineering, advertising, and sales workers. tes lasays it plans to hire about 250 new workers in the coming months.

the bay area electric-based car maker currently has 800 workers at its palo alto headquarters and the former muni plant. but it hopes to top 1,000 in the next year. most of those hired will be engineers. but it will also need people to help build its new model s sedan at its production facility in fremont. time now, 7:46. there are reports this morning, the social security administration sent out 89,000 stimulus checks that were either dead or in prison. it was part of the $13 billion economic stimulus package. it's believed about $22 million in checks were mistakenly sent to people whom the government didn't know had already died. the inspector general says about half of those checks have been returned. mexican president felipe calderon is weighing in on california's proposition 19 on the upcoming ballot.

it would legalize marijuana for recreational use. calderon says the ballot measure represents hypocrisy for encouraging consumption while at the same time demanding that mexico and other countries crack down on drug trafficking. in chile, the minister of mining is announced. the shaft being drilled into the copper mine could reach the 33 trapped miners as soon as tomorrow. if all goes well, the miners could be two to 10 days after the shaft finally goes down to where the miners are. engineers need to determine if the rescue capsules will work smoothly, or if some reinforcement of the shaft needs to be done first. the miners were trapped in august. and at first, it was feared that they would be stuck there in august. an organization is trying to raise money now. thousands of dollars. they want to replace pieces of a vandalized sculpture.

this week, vandals hit the memorial for the 1991 oakland hills fire. a member of the oakland landscape committee says he first noticed the vandalism tuesday when four sculptors were debt. the next day, two more branches have been damaged. and then a police report was filed. yesterday, they noticed that eight branches had been cut off. one was on the ground. seven more were gone. the committee believes the vandals may have stolen the bronze for their cash value. >> disappointing, i guess. the function of the economy that we have that people are desperate and will do whatever, regardless of its impact on people. >> now, mr. piper says it appears the culprit used some kind of heavy machinery to saw through those branches. this, by the way, is not the first time the memorial has been damaged. but this is the worst vandalism they have seen there. in san bruno, residents paused to remember the victims

of last month's fire and explosion for an impromptu memorial. ♪ [ music ] >> about 100 people gathered at the spot where the pipeline ruptured, four weeks ago. the fire following the blast killed eight people, injured dozens more, and destroyed 35 homes. crews are expected to finish the cleanup by monday. the san bruno fire and explosion caused an estimated $55 million in damage. and governor schwarzenegger is appealing the federal government's decision to deny disaster funds to san bruno. the governor sent a letter to president obama, asking that fema reverse its decision. fema has agreed to reimburse california for up to 75% of firefighting costs, but nothing else. this morning, we are finding out more about a sewage spill that fouled the shores of redwood city in august. a pipe burst near daffit lane

straight since yesterday afternoon. the state assembly had already passed what is named officially sb870, 5:00 yesterday evening. this is a massive budget. makes up to 87.5 billion budget plan. approving the budget has taken lawmakers $100. it has been a long day and night here. just to remind everyone, this contains no new taxes or fees. biit does count on receiving $3.5 billion from the federal government and the state generating an extra billion or so in tax revenues. also, under the deal, nearly $2 billion allocated would be delayed until the next fiscal year. lawmaker little now are waiting to pass a few more bills, which has to go through this process before the actual main budget bill can be enacted. but again, the official main budget bill has been passed in

safety reasons. this morning, we have a little activity. behind me. see that gentleman right there. they are with the county here. and they are expecting -- inspecting that bridge. they're inspecting the bridge to make sure that it is okay before they have to make some repairs or perhaps even shut it down if need be. behind the building, you can't see now, there is fully a -- actually a coast guard building here. those firefighters just came out from inside the building. don't know how deep inside the building they were. but earlier, we were being told that because of the integrity of the building, the fire made it unstable. and they were not able to get in there. for now, that has changed. we have a little mystery here. talked to a couple of people here who said the restaurant was supposed to be open last night but it wasn't. now they can't reach the owner. neighbor says the owner also goes by the name tiki tom, which was the name of the restaurant. the roof has caved.

meanwhile, firefighters are cutting holes in the roof. and when they find a hot spot, they douse it with water. the fire was called in at 11:00 last night. but when firefighters arrived, the building was simply smothered with flames f. the condition of the building forced them to fight it from the outside. a neighbor who lives on a boat on the other side of the water, actually on the alameda side, said he watched the building go up. but the owner's boat, docked out back of the restaurant as well. >> i looked directly across from my boat and what used to be tom's boat, i guess, caught on fire, and the ropes had burned. and the boat floated down and landed on the rocks. and it was right across from my boat. and i was going, oh, no. i hope it don't come towards my boat. because otherwise i'll number big trouble, you know? >> reporter: so the boat was parked out back. and it came loose and floated 50 yards down the way. at one point, it was out. but then it rekindled, probably around 6:00 or 6:15.

so they had to send another engine there to put it out. in this particular fire, they actually got a fire boat out here, from station 2. station 2 is now closed. but they maintain this boat. actually, it's supposed to be for fighting fires after disasters. but the guy who runs the boat happened to be on duty last night. it was a big help in fighting this fire. we're still trying to get a hold of the owner. people around here say it's very unusual for him to not be here. the fire department, when they went in last night, said they are confident nobody is inside. so they don't think anybody is inside here. they're not looking for anybody badly injured or perhaps someone who died in the fire. but we will try to get more information on the owner later on. reporting live, kraig debro, ktvu channel 2 news. 8:05. scary moments in san francisco, as a senior citizen center caught fire. it happened in the mission district, just before midnight. no injuries have been reported. and only the first floor was damaged. an investigation continues. time now, 8:05.

cab drivers are gathered outside of at&t park tonight, demanding a new cab stand for giants fans. currently, there is a cab stand at second and king streets. but the luxor cab company wants a temporary stand authorized for third street and willie mays plaza for the play-offs. >> after the game, comes out the elderly, the senior citizens that are coming out on the third street side of the park. it's hard for them to get over to get a cab. >> reporter: luxor says right now, cab drivers have to circle until they can get a spot on second street. this morning, the cab company plans to make pickups and dropoffs on third street to demonstrate how a new stand will improve play-off traffic. always a lot of traffic, but especially now, with the play- offs and all of the other events going on in the city this weekend. >> sal was talking about that last night. and overall, sal, how is our commute this morning? >> reporter: well, it's actually okay. and i think that brings up a good point. because you should be aware that tonight, another game at

gavin newsom and abel maldonado had sharp exchanges in their first debate. the two candidates faced off yesterday in sunnyvale. they traded their harshest words when talking about illegal immigration and the rights of diverse groups. maldonado criticized san francisco's sanctuary city policy. >> and then after that? >> if that didn't work, people sent them to san san bernardino. >> we have very different points of view for the rights of our diverse community. he opposed not once but four times, the rights of domestic partnerships. two hazardous materials incidents involving packages delivered by fedex in sacramento have been traced to leaking formaldehyde. employees at the state department of fish and game and another business, reported suspicious packages that caused eye irritation and breathing

8:22. 10 people are recovering this morning after an accident at a southern california amusement park. two roller coaster trains collided at knott's berry farm yesterday. some of the victims were taken to the hospital. but their injuries were said to be minor. investigators said the trains leaving the station didn't make it over the first hill. then rolled back and smashed into the other train. the golden state warriors are in trouble with their landlord. the agency that runs the oakland coliseum and arena says the team is behind in its rent. the coliseum says the team owes nearly $11 million in rent and other fees. but the warriors' new owner says the team does not owe money because it paid for a new scoreboard.

a court has ordered them to pay up. and says the warriors could be held in contempt of court and could be ordered to pay. buildings to -- helping close a $19 billion budget gap. among them, the civic center, home of the california state supreme court and the public utilities commission. the state would then lease those buildings back. critics say the plan will actually cost more in the long run. the associated press reported earlier this year, the state would pay an additional $5 billion in rent over 20 years. well, riders who take muni's j church train, you're in for a change this weekend. construction starts at 7:00 tonight. with a $1 million project to improve the line. traffic will be diverted over the next three weekends. now, this weekend, a bus will preplace part -- replace part of the j church route. auto traffic will also be

it was all part of operation rail safe. it's an effort to increase the presence of uniformed officers, just to keep riders on their toes, and to let any kind of criminal element that might target the nation's rails know that they are being watched. this is not being organized by the department of homeland security. amtrak says this is something that has been done a lot on the east coast. but expected to be a more common occurrence on the west coast. >> they will be coming up. and general public. you just never know when they're going to show up at the station. >> i can see, you know, it is a nice show of force. and a sign that they're trying to keep the train safe. >> reporter: so today, we do know about the operation. but they say there will be more planned that we do not know about. amtrak police told me that today's today's operation was

brothers from anaheim. police say 4-year-old jacob and 2-year-old justin quinones were snatched from outside of their home last night. police suspect the boy's father and grandfather took the boys. investigators think they may be headed to texas. police are looking for a gray dodge van with tinted windows and a dent in the right front door. >> time now, 8:32. a tragic overnight accident killed a 24-year-old milipitas man on southbound highway 101, near sunnyvale. the chp says a blue nissan was going too fast and collided with a tractor-trailer. that nissan was knocked across two lanes before being hit by a second car. the passenger in the nissan was also injured. however, the drivers of the two other vehicles were not hurt. a fatal crash yesterday, involving a muni bus and a bicyclist is under investigation this morning. san francisco police say the

cyclist was killed just before 5:00 last night, on 6th avenue, in the inner richmond district. police say that bike was beneath the front end of the 44 o'shaughnessey bus, when they arrived on the scene. the name of the victim has not yet been released. a sea lion shot in the face by a fisherman is scheduled for an unusual surgical procedure this morning. the 650-pound adult, known as sergeant neves, will have plastic surgery to repair his muzzle at 10:00 this morning at six flags discovery kingdom in vallejo. he's now a permanent resident at the amusement park because of his injuries. he was named after a yellow county sheriff's deputy who helped rescue him. the surgery is expected to last about two hours. park rangers are still undecided about what to do with the body of a dead whale. it's been almost one week since the pregnant blue whale washed ashore. researchers believe it died after it collided with a ship.

the whale's body may be left to decompose and wash out to sea. time now, 8:34. an oakland organization is trying to raise donations, thousands of dollars to replace parts of a vandalized sculpture. this week, vandals attacked the memorial for the 1991 oakland hills fire. a member of the oakland -- landscape committee said he first spotted it tuesday, when four branches of the bronze sculpture were bent. the next day, two more were bent. yesterday, eight branches had been cut off. one was on the ground. seven more were gone. the committee believes the vandals may have stolen the bronze for their cash value. >> disappointing, i guess. a function of the economy that we have that people are so desperate and will do whatever, regardless of its impact on people. >> mr. piper says it looks like

belong to a biotech company. google plans to hire 50 new workers in the san francisco office, including customer support, software engineering, advertising and sales employees. tes lasays it lan -- plans to hire about 250 new employees in the coming months. the bay area electric car maker right now has 800 workers at its palo alto headquarters and the plant. but it's hoping to top 1,000 employees in the next year. most of nose who -- those who will be hired will be engineers. but they will also need people who help build its new model s sedan in fremont. >> speaking of tesla. we are just getting word that the electric car maker is recalling more than 400 of its 120 roadsters. the company say its is to address potential fire hazards, connected to its battery cable. they say the recall involves roadster 2.0 and 2.5 vehicles.

8:42. right now, president obama is set to comment on the new unemployment numbers. the labor department reported this morning, the unemployment report remains stable last month at 9.6%. let's listen now to the president. >> in all, more than 850,000 private sector jobs gained this year, which is in sharp contrest to -- contrast to the almost 800,000 jobs we were losing when i first took office. but that news is tempered by a net job loss in september, which was fueled in large measure by the end of temporary census jobs and by layoffs in

state and local governments. i should point out that these continuing layoffs by state and local governments, teachers and police officers and firefighters and the like, would have been even worse without the federal help that we provided the states over the last 20 months. help that the republicans in congress have consistently opposed. i think that the republican position doesn't make much sense. especially since the weakness in public sector employment is a drag on the private sector as well. so we need to continue to explore ways that we can help states and local governments maintain workers who provide vital services. at the same time, we have to keep doing everything we can to accelerate this recovery. yes, the trend line in private sector job growth is moving in the right direction. but i'm not interested in trends or figures as much as i am interested in the people behind them. >> one of the reasons this

shores lagoon. a private consulting firm says there was no evidence of pipe corrosion, so it must have been some buildup of pressure. several possibilities are being looked at. and cleanup is ongoing. the tab so far? at least $150,000. in san bruno, residents paused to remember the victims of last month's fire and explosion for an impromptu memorial. about 100 people gathered at the spot where the pipeline ruptured, four weeks ago. the fire following the blast killed eight people, injured dozens more and destroyed 35 homes. crews are expected to finish the cleanup by monday. the san bruno fire and explosion caused an estimated $55 million in damage. and governor schwarzenegger is appealing the federal government's decision to deny disaster funds to san bruno. the governor sent a letter to president obama, asking that fema reverse its decision.

fema has agreed to reimburse california for up to 75% of firefighting costs, but nothing else. time now, 8:47. alaska was hit by a strong earthquake last night. it was a magnitude 6.4 quake. struck over a remote part of the alushian islands. that was centered in the same area. no tsunami alerts were issued. and there have been no reports of damage. that red toxic sludge in hungary has reached the danube river now. officials say the volume has topped the gulf oil spill. emergency officials declared a local river is now dead. they're gathering hundreds of dead fish and wildlife from all of this. the reservoir that caused it burst at a nearby toxic metals plant on monday. at least four people were killed. many more were hurt. 8:48. three of the four suspects in

the tracy teenage torture case are due back in court today. the san jose mercury news reports, they may be ready to accept a plea deal when they appear before a judge this morning. however, a gag order prevents lawyers from discussing the case. the four suspects are accused of imprisoning and torturing a teenage boy at a tracy home for more than a year. a south san francisco woman has been sentenced to 30 days in jail for allowing her 4-year- old daughter to eat a brownie laced with marijuana. 19-year-old mare cella -- marisella barassa must also attend parenting classes after pleading no contest. she was arrested after her sister noticed barraza's 4-year- old had slurred speech and glossy eyes. a redwood city cal train station. investigators say 51-year-old

jerry brown's campaign is apologizing. after an offensive remark. an audio recording captured either brown or one of his aides, calling meg whitman a whore. it was implying that women sold out to special interests. it asked for the endorsement. brown thought he disconnected the phone call, but a private conversation between brown and some of his aides was still being recorded. >> a whore. >> cut a secret deal. >> a spokesman for meg whitman said that while it is hard to make out the words on the tape and exactly who said what, this is an insult to both meg whitman and the women of california. the social security administration reportedly sent out 89,000 stimulus checks to people who were either dead or in prison.

the checks are in payment sent out last year. it is believed $22 million in checks mistakenly went to people who had already died. the inspector general said about half of those checks have been returned. 8:55. depositing checks is getting as easy as taking a picture with your cell phone. pay pal launched a new iphone app this week that lets you take a picture of a check and deposit. they deposited $100,000 in the first 36 hours of the app being available. mayors gavin newsom and casim reed agreed to raise the winning city's flag over the losing city hall. that would happen at the end of the next week. the losing mayor also has to welcome the winner to his city
