news. let's go to mark ibanez. neither starting pitcher tonight has ever pitched in a postgame. >> that's right, this place is always hopping for home games, already the buzz has started. but you mentioned hanson of the braves, cain of the giants, neither has started a postseason game. they're starting batting practice behind me a little before the game. both of those pitchers will have a tough act to follow. of course tim lincicum stole the show, 14 strike outs, gave up only two hits, he was masterful and giant fans have a little bit of a painful memory from exactly one week ago tonight. they were going to try and clench against the padres and matt cain, tonight's starting pitcher got hit real hard by san diego. he is hoping to completely erase that from his memory bank

and come out here and win game two for the giants against the braves. here's the managers thoughts about the starting pitcher matt cain. >> we all have hick ups and matt did there but he's been as consistent as any starter we've had and he has washed that off as we always say after a tough game. matt, he's a tough kid. he's got that ability to put those games behind him. >> tell me a little bit about matt's make up and his start. i'm guessing he has some nerves. >> any time you step out there in a postgame line up, you are a little nervous. he's the guy that's going to go out and give you a quality start and get you deep in the game. we look for him to do that tonight.

necessary 2/3 majority. the $87.5 billion spending plan was approved in the senate chambers just before 7:30 this morning. 14 hours after it had been passed in the state assembly. lawmakers had to overcome some obstacles including one decenting democrat who refused to budge on the bill. >> those individuals negotiated this particular budget should have looked at how do we raise taxes. how do we increase revenues, every time the republicans say that there's no new taxes, we then end up cutting, you know why can't we just simply say no we're not going to cut anymore. >> while the new budget does not include any new taxes or fees it does include pension and budget reforms. the plan also counts on $5 billion of federal money, far more than the state has received so far. it also assumes the state will generate an additional $1.4

billion in tax revenue. governor arnold schwarzenegger was in san jose where he touted the budget passage as a victory. but what does it mean for that city? robert handa has that part of the story. >> reporter: we're here at the san jose convention center, the city has been wanting to expand this facility to attract more business. but that plan stalled after the city went into the budget. why was the governor happy to see a budget, because any budget is better than none. >> we all together democrats and republicans fought through all the mine fields, fought through all the obstacles but we got the job done. >> the fact the state cannot

pass a budget in 100 days is bad. it's good to have that behind us. >> reporter: the governor push through state pension reforms, state workers will soon pay more toward retirement benefits and the retirement age for law enforcement will be raised to 65, 60 for other employees. it ends spiking, and new employees will see a two tier pension is. >> system has been taking away stealing from the parks, stealing from education, k through 12. teachers and counselors in san jose say the budget comes on top of hundreds of lay offs. >> we've been hit extremely hard. this will still mean a lot of cuts for us. this new revision does not help us abstain what we're doing this year. >> when you get basically five minutes a year with each student you don't have the time that they need to learn

everything they need to know about getting into college, about being successful in life. >> reporter: mayor reed says there is still a lot of parts of the budget that need to be worked out. and it'll time some time to winners and losers, but when the facts emerge, there are usually more losers. the legislature spent send -- or rather sent much needed help to the victims of the san bruno gas pipe explosion. victims will get a $7,000 property tax exemption. it's a common move by the state during emergency declarations. testla says it is recalling 439 of its 2010 roadsters. the company says the recall is to deal with a fire hazard

involving battery cables. the roadster sells for more than $100,000 and is the only vehicle currently being sold by the palo alto based company. the nation's unemployment rate remained unchanged. the september unemployment race was 9.6%, -- unemployment rate was 9.6% the same as in august. that is the weakest showing since june. the nation also lost 95,000 jobs which is much higher than the 8,000 that economists had predicted. president obama talked about the jobless rate during a visit to a small family owned business in maryland today. he says it could have been much worse. >> i should point out that these continuing lay offs by state and local governments, the teachers and police officers and firefighters and the like would have been even worse without the federal help that we provided the states over the last 20 months.

>> about 15 million americans are out of work, some have just given up looking for jobs in many other cases, they've been looking for a new job for several months or everyone longer. well it was a big day on wall street. for the first time in five months, the dow jones industrial average closed above 11,000 after gaining 58 points. the stock markets rallied across the board despite a less than positive jobs report. the s & p raised 11 points, the nasdaq added 18. for more financial news, just go to ktvu and click on the business tap. cal osha is investigating the death of a worker. christobal re reyes after he fell off a beam. that was around 10:00 a.m. the center is located on peninsula avenue. the man was working on a

renovation at the time. another accident is raising the question about bicycle safety in san francisco. a sign now hangs at the spot where 22-year-old derrick alan was killed at last night after being hit by a nummi bus while riding his bike last night. the accident happened around 5:00 yesterday evening on sixth avenue in the richmond district. police say that alan road off the curb and tried to cross in front of the 44 bus which swerved but was not able to avoid him. the driver has been taken off the road pending an investigation. a public apology tonight because of what someone in jerry brown's campaign called meg whitman after they thought a phone had been hung up. and a big bay area weekend ahead, temperatures, they're going to be warmer. i'll tell you which city and which days will be the warmest.

it started with a phone call, jerry brown asking a police union for its endorsement. he thought he had hung up the phone, he hasn't. and what happened next is making headlines. one of the staff members called meg whitman a wore. priya david clemens has the story. >> reporter: after it was released that jerry brown's staff member called meg withman a wore, he is announcing a new deal. >> what about it saying that

she's a wore. >> reporter: whitman's complain beleaguered pounced on the comment calling it an appalling and unforgivable smear. >> we think it's more about the politics of personal distraction that a career politician like jerry brown is involved in. >> reporter: we spoke with several voters but the comment didn't seem to sway them much. >> i'm not a jerry brown fan, but i think i would rather see meg win on the issues not on the fact that somebody in his campaign called her a name. >> i'm going to vote for meg whitman no matter what they call her. i think it was a stupid thing to do. and they should apologize. >> reporter: the comment will be little more than a blip. >> i think a few people will be

offended by it. and they move on and next week it's the next comment they'll talk about. >> reporter: words that seem to be doing little damage even in a campaign where the candidates are currently neck and neck. live in oakland, priya david clemens, ktvu. stimulating small business growth was the topic of barbara boxer's senate campaign today. boxer visited a plant in oakland. boxer is running against fiorina a republican. the gop is throwing out $1 million at the senate race. although boxer is leading in the polls, it believes fiorina

can win. the national economy has pumped a total of $3 million into the fiorina campaign. six months after it was swallowed up in a sink hole a car was recovered today from beneath tons of debris and dirt. ivonne nicoles reported it missing after the sink hole opened up in april. crews were another car but did not find nicoles. the insurance company finally paid for the car and she says the company can do whatever it wants with what's left of her car. here in the bay area, it's been chamber of commerce weather. let's go to chief meteorologist bill martin for what we're seeing. >> they're going to see san francisco in this beautiful glow. great air quality, great air

the faa says that airport runways across the country are getting safer. the number of collisions on runways dropped to six, that's half as many as the year before on run ways across the u.s. it's a dramatic drop from 67 in 2000. it credits the decline to lights and signage and markings and improved pilot training. if you road amtrak today here in the bay area you likely saw a lot of local police

officers and federal agents on the trains and in the stations. they were out in force as part of a long planned security drill. and ktvu's claudine wong has our report. >> reporter: at nia jackson waited for her amtrak train today she couldn't help but notice, tsa, homeland security, amtrak police all patrolling the station. >> it concerned me, i wanted to know what was going on. >> reporter: it's called operation rail safe. the idea is pretty simple. get uniformed officers from federal, state and local agencies to patrol stations and keep awareness high. it's not in response to any specific threat. but it is being done nationwide in conjunction with rail action day. and there is also a similar effort under way in europe today. >> this is the first one in the west coast. we'll have more coming up, and they'll be unannounced to the public. >> it's effective for me because i never know when they are here. i'm surprised to see you here

searching the trains. i can see it's a nice show of force to keep the trains safe. >> reporter: local agencies did not hesitate to help out. >> here is where i'm impressed. i'm impressed at the local police agencies that joined us in this effort. we had very little notice to put this together, but with some phone calls and e-mails all our local parties jumped on board. ready jumped on board to assist us today. >> reporter: many people we spoke to this morning were certainly caught off guard with the operation. but nia jackson says she was happy they were there. >> i feel safe, but i feel safer. >> reporter: today's increased security was well publicized and it was talked about, but amtrak says there will be more operations like these in the future but those will be unannounced. claudine wong. president obama is speaking

out over the noble prize winner. it reportedly infuriated the chinese government who has incarcerated the recipient. mr.obama this morning called on the chinese to release him and they called an eloquent and supporter of human rights. i'm paul chambers live in oakland in front of a restaurant that was destroyed by fire. the flames were put out by a boat who's been in retirement for years. i'll tell you who put it into retirement and why, coming up. it's not just about jet fly bys. find out why fleet week is focusing more on emergency scenarios.

it's a tragedy, it's a huge loss. he's talking about this fire overnight that destroyed a long time bay area rest restaurant in the east bay. firefighters say what helped them put out the flames was a piece of equipment that was taken out of commission a few years ago. paul chambers is live in oakland with our report. >> reporter: the fire is considered to be suspicious fire and we're told that oakland police are now doing an open investigation on this arson. now take a look for yourself right now, they are ruling as arson as of right now. you can see there's a lot of damage inside. the roof has collapsed in some areas, it's considered a total loss. the interesting thing is that the fire was put out by a boat that's been out of service since 2003. around 11:15 last night. oakland fire department got a call that pier 29 was on fire. once crews arrived on scene, the two alarm fire was burning

out of control. firefighters called in back up. >> there were several attempts to extinguish the fire from the bridge using land based apparatus, i believed the chief felt the best cause would be for the fire boat. >> reporter: this is the first time that batallion chief says he remembers the boat being used to put out a fire. that's when budget cuts made by jerry brown and the city council were made. >> we need to use the fire boat to pump water into our portable water system, then we would use it for that purpose. >> reporter: today arson investigators and the atf were out surveying the area. no one was injured during last night's fire. however the owner of tiki tom's, his boat was tied out back, it also caught on fire and was destroyed. until now the cause of the fire

is not reported. and it's considered to be a total loss. >> it was a great place to hang out. >> reporter: a seafood restaurant built back in the 1960s. but a few years ago, it was bought out by a new owner who changed the name to tiki tom. >> i came by to have dinner about shortly before 11:00 and there was a sign saying closed today will reopen friday. >> reporter: now of course the building is closed. the damage is estimated to be around $700,000. the property owner was out here earlier, he did not want to talk. now as for the owner of the restaurant, many people call him tiki tom, no one has heard from him at all. we also found out that the operators of the boat they are only two operators in oakland that knew how to operate that, and luckily they were working last night to use the boat.

paul chambers, ktvu news. kelly low, karen ramirez and michael shumacher pleaded guilty this morning in exchange for prison sentences of 30 years or more. anthony waders was not at the hearing. the victim escaped and made his way to a near by health club wearing a shackle on his ankle. 19-year-old marcella barasa must attend parenting classes after pleading guilty. barraza later told police that the little girl grabbed the marijuana brownny before she could stop her. it's not what most people think about when it comes to fleet week, but along with the

spectacle of the sky, they are partnering with the city. >> reporter: the city's big fleet week celebration included an unusual event today as marines came from the uss island behind me came ashore today to practice saving the lives of san franciscans. everyone at jet pilots prepared this week, other servicemen were preparing for the worse. >> we are going to see if we can get people out of those holes without doing too much digging. >> reporter: marines came to pressure island this morning for a search and rescue seminary thought by civilian firefighters. >> they are quick to learn, they are willing to learn and willing to do anything we asked of them. >> reporter: they learned how to respond to a bay areadisaster, similar to the

loma prieta earthquake. >> they are training marines and sailors how to do search and rescue just in case they have to come in and dig us out. >> reporter: basically called the search cam. >> reporter: marines use firefighters gear to learn to listen for survivors trapped in rubble. >> all right, lift. >> reporter: a lift exercise explained how to remove wreckage without injurying victims. wrecked cars challenged soldiers to find survivors without getting injured themselves. >> going through the rubble piles going through things like chemicals and other things that could cause a marine to have a casualty. >> reporter: the exercise was made in a facility run by navy firefighters just 18 years ago. >> the structures out here are remarkable. they are put in a way that marines can understand. >> it is ironic and very

fitting. >> reporter: pleat >> reporter: fleet week is also highlighting -- the william j. clinton foundation is donating half a million dollars to a haitian relief organization put together by sean penn. he says the money will help provide health care, education and job training to the tens of thousands of people displaced by the earthquake that hit haiti in january. penn's organization's is working to relocate 55,000 people who lost their homes in the capital of port-au-prince. a popular diet drug is coming off the market. which one and why, next. we're going to be very aggressive to help them with that and california is going to benefit from that. the country which governor schwarzenegger schwarzenegger wants to help create a new

to help that nation build its own silican valley. the governor says no one is better equipped to help russians than business people from our own silican valley. >> so we're going to be in there, the first ones in and we're going to be very aggressive to help them with that and california is going to benefit from that. >> governor arnold schwarzenegger's trip is a follow up to russian president's trip to silican valley back in june. miscalculations by the government is giving emission rules extra time to go into effect. the board staff over estimated pollution created by construction equipment, buses and trucks so now they are giving companies more time to come comply with the new rules. a california appeals court will not exempt dura logs from

spare the air bans. the company is now required to relabel it's producting to notify customers of the restrictions and provide contact information for consumers to check the burn status. adalab says it's voluntarily withdrawing the diet drug miridian. the withdraw leaves only one drug for long term weight loss and it is not widely used. health regulators say the modest weight loss from miridia did not justify the risk. a study from the university of chicago has found that those getting more sleep lost more weight. now it was a small study, only 10 adults over weight adults on similar diets. they were assigned to sleep either 5.5 or eight hours a night. after two weeks, the people sleeping eight hours a night

business for 20 years. example, mi pueblo has 18 california stores who started from a single san jose butcher shop. it's clean, colorful, festive and fun. >> all the stores are layed out as an open mercado in mexico. >> reporter: mi pueblo has grown as the hispanic base grows. all from the amount of spices used in their prepared foods all to serve new nontraditional customers. >> everyone second generation, cross over american, asian, this is a good example: you will see vietnamese products. >> mi pueblo addressing that issue. >> if we had this back home i would shop here. i would -- being the tourist that i am here, i actually had my camera out and was taking pictures of all the fresh produce.

>> reporter: foods go and fresh and easy are two chains bringing full service discounting to under served communities such as east oakland. ranch 99 are small asian food chain that is have lots of live seafood. sprouts is the poor man's whole food. henrys is division of smart and final. target's expanding it's grocery operations to get people in to buy more than just groceries. and the wal-mart will emphasize groceries. >> very attractive prices right now. >> reporter: but says grocery expert reynolds with it's hundreds of california stores, safeway is always ready to do battle. >> it will guarantee that they have a continued large share of the business. >> there are 40,000 items in our stores and we have more than 2, 2,000 organic items. i think our goal is to make

vehicles used by federal workers on the job. several auto makers are expected to submit bids, the vehicles could begin appearing in the fleet next spring. eight new charging stations for electric cars are being installed in marin county and they're not costing the communities there anything. campbell is providing them under a federally funded program. the company has already installed 20 other charging stations in the bay area. the new ones will be in san rafael, millvalely, fairfax, salsalito, tiburon, and marin county. it is absolutely beautiful. bill, i keep thinking about what tonight's helicopter views are going to look like of tonight's game. >> the network comes in and takes shots of our beautiful city. you love seeing it but tonight it's going to be spectacular. it's going to be outstanding. temperatures outside are going to be in the 60s. it's mild right now. lots of 60s. it was mild today, you can see

some of the cooler temperatures up north of redwood city. a little bit of fog creeping over the inlands. these were the highs from today. they were warming than yesterday. we talked about it. these are some of the finest weather, for my money some of the finest weather we've seen all year. when fire danger is high, -- the temperatures for both games in the 70s. mid-70s. beautiful weather for football. and then you have the blue angels, do not anticipate any issues with cloud cover. of course that has been a problem in the fast. you see some fog in here but i don't think that will be an issue. there might be a little patchy fog in the morning, but once the aerobatics start it shouldn't be a big deal.

this high is going to stick with us throughout the day. tomorrow take a peak at your day. 7:00a.m., 47 degrees, that's cool. so when you wake up tomorrow morning, some areas in the bay area will be in the 40s. lunchtime you're in the 60s and 70s. then we can go mid-80s by late in the day tomorrow. that's your saturday forecast of a broad brush. specifically when you're looking for some of the warmest cities tomorrow, fairfield. santa rosa, nevado, low 80s. not bad, 83 in pittsburgh, no fog, good air quality. nice day. 83 in morgan hill, my buddy mark tamayo is in here saturday and sunday and he'll be compiling all the information. but i suspect we're going to see 80s and 90s. the only thing i guess we're going to be watching on sunday is going to be the fire danger.
