course not too far from morgan hill and traffic is backed up for miles. the driver was taken to a nearby hospital after complaining of neck and back injuries. the wreckage forced authorities to shut down all but one lane of traffic again on highway 101 in the southbound direction. we will continue to follow this and bring you any new details as we get them. the san carlo city counsel making tough decisions right now involving public safety. at issue is whether it will outsource another department. first it was the police department, now it's the fire department. ktvu's christian kaplan joins us now, he's in san carlos with the details and reaction. christian. >> reporter: the san carlo city counsel is set to begin their meeting any moment. we will take you inside council chambers. the city council is considering dissolving its fire department and outsourcing emergency services. with sales in property taxes down, san carlos is looking to outsource fire and emergency services as a way to cut $1

million out of the bottom line. >> the issue is cost and if you look at basically cities around california, everybody is downsizing all your sectors of your business except for safety and especially fire where you've added more people and it's more expensive. >> reporter: san carlos has shared fire and emergency services with neighboring belmont since 1979, but this year san carlos opted to dissolve that partnership. san carlos now has one year to figure out how it will cover fires and emergencies. tonight the council will review a consultant's report and weigh some of the options including the possibility of a new partnership with cal fire or partnerships with other peninsula cities. the city says citizens shouldn't see a difference in services or response times but many san carlos residents like kristin pepper and kathy haggerty size there are more unknowns -- say there are more unknowns than knowns. >> we'd like to know so we can

figure out what that means for us. >> reporter: san carlos has already outsourced police services at the end of the month police officers will be absorbed into the san mateo county sheriff's office and may not be the last bay area to outsource the emergency services. they have told me other cities here in the bay area have contacted them about the possibility of dissolving their police and fire departments, although he wasn't specific about which cities. we are live in san carlos, christian kaplan, ktvu channel 2 news. the body of a marin county native who disappeared in mexico in august has now been found and a suspect in custody. according to mexican authorities the body of 46-year- old real estate developer lane gilbert was found friday in a home that he owns south of oaxa. a suspect, andres martinez has been arrested. police believe martinez used a machete to kill gilbert but still trying to determine a motive. gilbert was a naturalized citizen of mexico but grew up in san an sell beau.

changes may be on the way for california prosecutors after a recent report laid out hundreds of cases of so-called misconduct. a report by the northern california innocence project shows misconduct by prosecutors across the state ranging from small technical mistakes to deceptive tactics. the report says the majority of prosecutors use fair methods but that many can still operate with little chance of being penalized. >> what are we doing with the system that not only gives prosecutors a path, not only tolerates misconduct, but, you know, it really fosters misconduct. >> the state bar association is now reviewing the records of prosecutors cited in the report. batter is using the baseball -- bart is using the baseball playoffs, social media and prizes to try to get more riders. recent hikes in transit fairs and job losses are taking their toll on mass transit ridership. tom vacar joins us now at the alameda ferry terminal with a look at who is riding and who

is not. tom. >> reporter: where the san francisco ferries doing is -- ferry is due in in about two to 5:00 minutes. it used to be this was a very busy place and now there's about 15% less people and a parking lot that's got lot of spaces. if you don't need to take transit to work, if you don't have a job. the bart ridership off 7% from a year ago. bart says a big increa in ridership over the last few months is a leading indicator of better times ahead. >> we are two months ago at 334,000 riders a day. we are at about 354,000 riders a day. that's 20,000 more riders, that means 20,000 more people with jobs so the economy is moving in the right direction. >> reporter: amtrak says ridership on its capitol corridor up 4% since may. caltrans says its ridership up 2% year over year. folks we met generally liked the bay area's overall transit systems. >> it worked well.

prices, it's okay, it's not too much, but it's been higher. >> reporter: the bay area works pretty well. it would be nice if it was more coordinated. he says the new but problem prone cross transit clipper pass system needs improvements. >> the bus system in san mateo county doesn't do it. that is a pain. that is a problem. >> reporter: but other transit agencies are challenged by flat or declining ridership. ac transit up less than half percent. the south bay's bta down 11%. ss muni down 4%. sam transdown 3.4%, even the bay bridge traffic down 2%. >> probably a combination of the people that are working don't want to ride it and the people that aren't working can't afford it. >> reporter: how tough is that employment situation and all that transit trouble? look at this. this is san francisco chronicle. there is not one, not one job offering in here in the classified. in fact, there are hardly any classified at all times.

reporting live, consumer editor tom vacar, ktvu channel 2 news. an east bay man arraigned today on felony sexual assault charges told the judge he was not guilty. the charges are in connection with an attack at the regency park apartments in walnut creek. sheriff's deputies arrested 51- year-old william yellcum last week. he lives at the apartments and investigators say he knew the victim. he is due back in court to enter a plea on october 28th. authorities have also released a sketch of a man they say is responsible for the most recent assault attempt on october 2nd. he's described as white, 5'8" to 5'9" with a medium build with brown hair along with facial hair. the victim in that attack injured herself as she fell down a stairway while trying to escape. and in august sheriff's deputies arrested 22-year-old antonio mouton at berkeley in connection with three other

assaults in the summer. the contra costa fire department was called to a house fire just after 2:00 a.m. this morning in the 2600 block of o'hare avenue. firefighters say they found what they initially thought was an unconscious man. later, though it was determined he was dead. the san pablo police department is now investigating that death. supporters and opponents of gays in the military are awaiting a ruling promised tonight from a federal judge. the justice department has asked u.s. district judge virginia phillips to issue a stay with her order doing away with the current "don't ask, don't tell" policy. judge phillips said she would issue a ruling by the end of the day. phillips says she was inclined to deny a request by the military to delay an order that stopped the ban on gay service members. government attorneys say if phillips refuses to delay her decision, they will go to a higher court to try to block it. there are now just two weeks to go until the november 2nd election and that has candidates doing everything they can to rally last minute

support. gubernatorial candidates republican meg whitman and democrat jerry brown took off the gloves during three recent debates and showing no signs of toning down their remarks. >> it's ridiculous that terry brown is asserting that i'm running for governor to make money. anyone in their right mind would not spend $140 million to save $15 million. >> she can talk all she wants. but the truth is she wants to enrich herself and her contributors and the very wealthiest people in our society. >> president obama is expected to visit the bay area this week for some fundraising and campaigning. air force 1 is set to touch down mid-afternoon thursday at san francisco airport. the president is set to attend two events, one for attorney general candidate harris and the other for the democratic

national committee. if you want to vote in the upcoming election hopefully you have already registered because the deadline is now hours away and when it comes to the election, looks like more and more voters are mailing it in. ktvu's jim vargas is live in oakland tonight with more on this. >> reporter: statewide nearly 60% of the ballots issued for the june election was mail-in and it looks like this election is going to shape up to be another big vote by mail election. there was a steady line of people at the alameda county line voter registrars line this morning who were asking about voting by mail. >> better than coming out to the polls, standing in line, things of that nature so i like doing mine at the comfort in my home. >> some states now do all their voting by mail. oregon and washington have been doing this for a long time and it's cheaper and higher turnout. >> reporter: one good reason to vote by mail is the length of some ballots. some cities have increased the size of their ballots because of rank choi voting in which

people cast a ballot for their first, second and third choice candidates. register star dave mcdonnell says it also costs more because of the unusual postage to return. >> because of the extra ballots, voters need to put 78 cents postage on their envelope. if they don't, the post office will still return it to us and we will take the extra postage. >> make your voice heard and vote in the november 2nd elections. >> reporter: although young people have historically voted in small numbers, the economic realities of higher tuition of public colleges and universities seems to be creating increased interest in this election. the registration table at uc berkley was busy today. >> it affects our school so i think it's really important to have a voice in what happens. >> back in 2006 this campus registered about 2500 students and we are now up to 4200 this morning. >> reporter: there are now about 16 million californians registered to vote.

sutter health. with you. for life. there are new concerns today over privacy issues with facebook, even if you keep a close tab on your personal settings. according to a report some facebook applications had been improperly sharing personal information with outside companies. that's a violation of its

privacy policy. in response, facebook said today it is talking to application developers about how to better handle personal data. >> could be used for nefarious purposes. i'm not saying that this is what the advertising networks are going to use it for but once it goes out to one party, it can then be transferred to a third party, a fourth party and so on. >> the "wall street journal" says all 10 of the most popular applications on facebook including farmville and mafia wars had at one time transmitted personal data. upbeat news for banks sent stocks soaring today, reverse in anxiety about the way some banks may have mishandled foreclosures. stocks for all banks soared after citigroup announced the number of customers who defaulted on loans went down. the dow jones closed up 80 points, the nasdaq up 11. the number of first class seats on airlines is disappearing. the economy means fewer corporate travelers can afford the seats which can cost thousands of dollars. for example, airtran now says it may drop first class seating

when its buyout deal with southwest becomes final. and united airlines has been revamping its cabin since 2007 and installing more coach seats. wine makers and grape growers in sonoma and napa counties are coming off wa may be one of their most difficult seasons on record. grape production down, the harvest is several weeks late and it's not over yet. ktvu's patti lee is in sonoma right now with a live report. >> reporter: i am live at windsor oakes where you can see these vines are filled with grapes and according to wine makers they are about as good as it gets. the question is when to pick them. at windsor oakes vineyard wine makers and grape growers are hedging their bets. >> it's been quite a year. some people are calling it the harvest from hell. >> reporter: they are trying to decide whether to pick what's left of the harvest ahead of rains predicted for later this week. >> are you going to be bold and think we could survive a little bit of rain or a lot of rain.

>> reporter: this assistant wine maker declares his grapes close to perfect, another week on the vine and they could be, but is the wait worth the risk? wine maker julie says sometimes it's not wise to test mother nature because of this summer's fog and sunburn, grape production across napa and sonoma counties is already down 10 to 30%. >> the last little rain, that was nothing on sunday. but if there's another storm rolling in it could be a three or four day storm, it's time to go. >> reporter: so will the grape shortage lead to higher wine prices later? according to wine makers who say unless you're buying rare wines you may not notice much of an increase when the grapes become available in bottles in a few years. reporting live in sonoma county, patti lee, ktvu channel 2 news. the city of oakland is busy getting ready for the rainy season beginning today, sandbags and plastic sheath will be available -- sheeting will be available for residents free of charge. each household is allowed a

maximum of 20 sandbags and 50 feet of plastic sheeting. during the last few months city crews have been working to release debris from storm drains and other weather related issues. a little rain yesterday. >> amazing how quickly the seasons change. i say that every year but wow yesterday the showers, today kind of cool, tomorrow cold in the morning. right now we have got a little bit of fog out along the beaches. take a look at san francisco, 60 degrees. these are the highs from today. temperatures were warmer but still -- last week we were doing 90s. not this week. we had record heat and the week before that. we have had real hot days but not today. it was 73 into concord, 67 in fremont, patchy fog along the coast and the big question is of course the giants playoff weather. we have got three games coming up here and right now the weather looks great. tomorrow's forecast 75 degrees for most of the bay area.

i take a computer model and i go give me a basic number for the bay area. mostly sunny and warmer as we move into tuesday. it's going to be cold in the morning hours. this 45 in santa rosa, 45 in napa, that looks like november morning wake-up temperatures to me. 51 in concord, 49 livermore. not freezing but that is chilly. s you head -- as you head off to work or school you'll notice the cooler weather. the forecast tomorrow, these winds kind of slip offshore, temperatures up a little bit. breezy along the coast but -- pardon me in the upper hills as these winds go northeast but fire danger is down. we had some rain and this is not a real hot offshore event or not a real strong offshore event. it changes rapidly with this low pressure center it rolls in here on thursday, more clouds, maybe a sprinkle thursday night into friday, should not affect giants playoff baseball at the at&t. so that's good news. the forecast tomorrow, you looking for reds, those are 90s, not tomorrow. you're going to see oranges,

want to recap our top story now. a massive traffic jam on 101 southbound near the coyote creek golf course in morgan hill. a truck carrying wax, you see it there, overturned. essentially three lanes of the southbound 101 are closed, only one lane is allowing traffic to get by and the last word we have from the chp is that this situation could be going on until after midnight. so if possible, stay away from

that area. the problem is it's very difficult and time consuming to transfer all of the wax from that truck that overturned to another truck that is now on the scene. again, the latest estimates, this situation could be going on until well past midnight. the giant and the phillies were back out on the field today but it was all just for practice. >> the two teams are preparing for game 3 of the national league championship series. ktvu's joe fonzi live from at&t park now there on the field. hey, joe. >> reporter: hi, frank. you know, playoff baseball means you don't get much rest. the giants and phillies played last night then got on their charters and headed across the country, arriving in the wee hours here today and then back on the field today but everyone will take that because that's what playoff baseball is all about. when you have an extra day to talk about things, you talk about the pitching matchups. for the giants that means matt cain. cain hasn't pitched in almost a week and a half now. his last outing in that friday night game. he had no decision in the national league division series against the braves. he like most of the giants staff pitched his best in

september and he likes to make -- the makeup of his team. >> feel like we have guys that have stepped up big during the season and they have done the same thing now. you know, we feel like we have got a group of guys that, you know, find ways to get stuff done and with a couple of guys that we do have that have the experience in the playoffs, you know, they have rubbed off on us that haven't you know to try to keep us calm and having fun with it and depo out and enjoy the whole experience. >> reporter: the phillies were on the field today working out before the giants. their starter will be cole hamels. he brings a 12 12-11 record into the ball game. he had an up and down year. two years ago he was the world series most valuable player but he, like cain is pitching his best late in the season. >> things aren't going to be easy in life and especially in the game of baseball but the people that get through it are the ones that make the adjustments and try to strive to be better and i think it's

taught me with pushing myself a little bit harder if it's getting physically stronger or mentally trying to prepare better for a game. >> i think he's grown up a lot from just the part of experience of going through a tough year and i think the fact you put him on the team we added roy halladay and i think he's got a better work routine and i think he's learned a lot from roy. >> reporter: so hamels against cain tomorrow afternoon, a couple of other baseball notes, the american league championship series going on now, texas with 2-0 lead over the yankees in the 4th inning. that series a game each and there's a report tonight that tony la russo is about to signed up -- sign up for another year with the cardinals. you can vote on these teams this week for game of week: those are the five games you can vote o go to the ktvu website and vote.
