good morning. i'm kraig debro. dave dark is off today. >> i'm tori campbell. we begin with developing news. san francisco firefighters are still on the scene at an early- morning fire at a four-story apartment building. ktvu's jade hernandez joins us

with more from the scene. >> reporter: good morning. the fire chief walked over to us just a few minutes ago to tell us that the fire is not contained but they are still fighting hot spots on the back side of the building. this area is very smoky this morning. and residents we spoke to said they grabbed what they could and ran out. >> when i ran down you, just saw the fire coming from -- a friend of mine that lives in the building. it's really -- scare me to death. >> reporter: san francio police officer told me that there had been some minor injuries, smoke inhalation and the fire chief confirmed that this morning. two came from the initial fire building, the building that was on fire. another injury came from an

adjacent building. this was an eight-unit, four- story building that caught fire this morning near hyde and bush. the point of origin where the fire seems to be the most intense is the fourth floor. i want you to listen to what she said she saw when she first arrived. >> when i pulled up on the scene, the fire was rang. crews went to work and when we went to make a defensive attack on the building, everybody came out accordingly. we're still working to make sure we can keep everybody as safe as we can. >> reporter: firefighters are still working on hot spots, as i mentioned. i was told by the chief that firefighters are gonna be out here this morning. they will bring out a building inspector that this structure they were worried about -- they were worried about how stable the building was.

firefighters said it didn't seem safe enough to keep firefighters inside. we don't know how many people have been displaced. but at this point we're hearing about two dozen people. that's probably not even counting the adjacent apartment buildings on either side of the building that caught fire. we'll continue to update you. yee been talking to residents -- we've been talking to residents. we'll have more coming up. jade hernandez, ktvu channel 2 news. >> thank you, jade. oakland police are looking for two suspects in a home invasion robbery that happened overnight. they say the youngest victim is just 3 years old. ktvu channel 2 reporter claudine wong is live on the scene with the latest. good morning. >> reporter: good morning. yes. this investigation continues. police are still working for the two suspects responsible for terrorizing this family overnight. this morning, we are continuing to look into several things, whether this is possibly connected to other crimes. we do want to tell you what happened last night. it was about 11:00 last night. one of the victims told ktvu a

family member was outside their home smoking near the intersection of 20th avenue and 20th street one of the -- the two suspects approached the family member. they were wearing hoods over their head. one suspect was carrying a silver revolver. one family member was held at gunpoint while suspects stole cash and electronic equipment, including a computer. there were 12 victims inside this house when all of this happened. they range in age from 3 to 70. now, fortunately, nobody was hurt and the two people sped away in a silver infiniti. one of the victims said they did see the two men in the area monday night and think they may have been casing the neighborhood. we're also told by police that this could be connected to similar incidents in the area. we have been calling oakland police this morning. i have yet to get ahold of them. we're gonna head there to to

see if we can -- there to see if we can get an update. back to you. >> thank you. in los gatos roads remain closed after an overnight fatal accident. it happened after:00 this morning at union -- after 3:00 this morning at union hill. police found a car that had had driven off the roadway and into a tree. the driver was killed. there were no passengers inside. police have shut down a number of streets as they investigate and they have yet to rule out alcohol as a factor in the crash. and the officer and the pedestrian accident, the security guard is in critical condition. investigators are trying to determine if the victim was in a crosswalk when he was hit. anyone who -- who witnessed the crash is asked to call san jose police. later today, the giants and phillies battle it again at

the -- at:00 p.m. -- at 4:00. suspension of the landmark suspension tower on the eastern plan of the new bay bridge has been delayed. caltrans says an essential piece of equipment must be repaired before a second set of massive sections for the tower can be lifted in place. instead of starting that work, caltrans says it will start sunday. the work are be hard to miss once it starts but caltrans is focusing drivers to stay focused on the road. >> always good advice. let's check in with tara filling in for sal. what's the best way to navigate that fire in san francisco? >> well, the fire is on hyde street between sutter and bush, right where this circle is. now, california is an option or this, where the arrow is, then a lot of people would take o'farrell maybe to downtown. if you want to stay far away from the fire, the scene of it,

you could actually take golden gate instead. those are some of the options for you. at the bay bridge toll plaza, we have major backup. it's been like this at 5:30 this morning. this is a 15 to 20-minute delay backed up to the maze. at the 280/880 interchange, we're seeing a lot of traffic. here's steve. tara, thank you. we have a lot of fog. for some, it had be slower to burn off. southern california dealing with rain. they had record rain yesterday. palm springs had .38 and their high was 75. not only was that the most rain for the day, it was the coolest day. for us, it's fog and there's plenty.

the results in alameda for the election could be delayed because of the complications of ranked system voting. that means outcomes of mayor races in oakland and san leandro and council races in all three cities may not be known on election day. in the governor's race both meg whitman and jerry brown have attacked each other for being too much like current governor, arnold schwarzenegger. brown released a new tv ad showing whitman repeating some of the same words as

schwarzenegger when he ran for governor. all of the governor schwarzenegger bashing could make things awkward when the three are scheduled to appear together on stage in long beach for a discussion about governing. 7:14. the pentagon is now directing the u.s. military to accept openly gay recruits for the first time in the nation's history. pam cook joins us from the newsroom with the continuing legal wrangling about the don't ask/don't tell policy. >> good morning. a federal judge refused to lift her injunction, telling the military to immediately strike down the policy. we're now hearing, though, at least three military service members being discharged for being gay have begun a reenlistment process. but they are cautioned that a successful appeal of the judge's decision, which could still happen, might put don't ask/don't tell back in place. >> the reason we're advises

caution is for the active members is because it's also unclear if the military would use the information, if the don't ask/don't tell is put back in force. president obama has said he wants to repeal the don't ask/don't tell policy. but the administration also wants the courts to put the policy back in place until congress resolves the issue. now, the pentagon says recruiters have been told to accept applicants who say they are gay but they've also been told to tell potential recruits that the moratorium on the policy could be enforced at any time. pam cook, ktvu channel 2 news. the third quarter earnings topped analysts expect takeses but not everyone is happy with

out. >> council surprised many residents and sided with them voted unanimously against the warehouse plan. 7:17. san francisco supervisor john everybody have lows -- avalos is introducing legislation to hire all city residents for contracted projects. right now, he says they should make a good-faith effort to hire those who live in the city for at least half of those construction jobs. but a recent survey says only 20% are hired. a new study suggests california's community colleges are preparing to -- are failing to prepare the work force. a study at cal state sacramento shows 70% seeking degrees at california's community college either did not finish or did not transfer to a four-year university within six years.

research says it points to a troubled system that needs constant revamping. in some cases, parent volunteers are in positions previously held by employees the union says the school board can't do that and the president said both sides need to sit down and work out a solution. a northern california college student is behind bars and a warning is going out to other students on campus. and the reason some people are not happy about santa clara's tough, new crackdown on smoking.

investigators say they've not ruled out homicide as the cause of death. san lee andree police are asking anyone with information to come forward regarding this male body found. santa clara is moving ahead with tough, new restrictions ahead with smoking. the council approved three ordinances, one would ban smoking at county parks and hotels and motels. the second would ban smoking at apartments and could be --

condos. tobacco owners are upset about requiring having a permit each year. >> you are making that more difficult for us when you impose taxes on us to do business. >> the supervisor will delay the ordinance. 7:23 now. now several accidents are in the east bay. tara? >> that's correct. we have several accidents in the east bay we want to show you. if we take a look at the maps we can point out the first one. 24 west at the 580 west connector also showing some connection. 880 southbound at oak street. you can see the yellow there. that's causing delays as well as 680 southbound at treat boulevard.

highway 24, if we look at traffic on the right-hand side, you can barely make it out there because of the fog. in the other direction eastbound, we have an accident before the caldecott tunnel which could be causing some delays. 7 in -- 237 in milpitas. very sluggish at this hour. here's steve. >> thank you, tara. nelson over here. we have a lot of fog. temperatures very close to yesterday's reads but i think they will be slightly cooler. what's interesting is the fog really starts to enhance about 6:00, 7:00 in the morning. it wasn't so bad at 5:00 a.m. mild to warm highs after the fog burns off. we see an increase in the fog and maybe some drizzle. friday's system looks weak with some light rain but sunday into

monday could be a moderate to heavy rain. we'll deal with this in the next couple of days. i would expect some changes as we head into the weekend, especially those of you in the wine-growing business. fog, then sun, mild inland. a lot of rain in southern california from that low that paid us a visit on sunday. it's down there giving them all sorts of rain and cool temperatures. for us, 60s, 70s and mid-70s. fog will burn off. not a problem there. san jose, 54. the change in our weather is right there to the left of your screen. that will be in late thursday to friday for a little bit of rain. areas of fog. sunny, 50s, 60s. 60s, os around the bay -- 70s around the bay. we cloud it up thursday night. rain thursday morning, a break friday night. looks like rain sunday into monday. tori? kraig? >> we're continuing to follow a

firefighters are still dousing hot spots at an apartment building. the four-alarm fire started at 4:00 at sutter and bush. even the fire chief is on the scene. ktvu's jade hernandez joins us live with another. >> reporter: good morning. residents woke up to banging on their door. >> this place is on fire. you need to get out of hee. i was like -- out of here. i was like oh, my god. i said to my brother, we need to get out of here. grab your wallet, whatever you need, then go. >> reporter: san francisco fire chief hayes has been updating us and she told us they are still working to contain

flames. they have a lot of hot spots. she also told us that three residents were hurt. two residents from the apartment building that caught fire and that one person sufficiented from smoke inhalation from the apartment building nearby. this fire broke out a couple of hours ago, around 5:00 and it quickly grew to a four alarm. we were told by the chief that firefighters were pulled out of the building. they were trying to fight flames from inside. but she quickly pulled them out when she realized the building was not safe. i wanted you to listen to the chief. but we don't have the sound from her. i do want to tell you that we were able to speak to teresa edison, who is the clinical director of st. francis memorial. at the corner of hyde and bush, we can show you this is a medical building from st. francis right here and right

across the street, right here is the emergency department department for the hospital and right inside of that building. ms. edison told me that the red cross is operating out of their er, they are right now working to help 40 displaced residents. in fact, earlier this morning, they had quite a few residents waiting inside taking refuge from the cold this morning and, of course, the fire. she said they also had pets, cats and dogs that were with them, that they were trying to take care of. of course, the red cross will continue to try to find homes for the people who clearly can't go home this morning. we'll continue to update you. we'll bring you sound from the fire chief in just a little bit at the top of the hour. we'll continue to update you. reporting live from san francisco, jade hernandez, ktvu channel 2 news. >> thank you, jade. 7:31. two armed robbers still on the loose suspected in a bold home- invasion robbery last night. it happened at 11:00 at 20th

avenue and 20th street. police say two men with hoods over their heads and one carrying a silver resolver approached one of the victims outside, and forced them in the house. police say they stole electronic equipment. one of the family members were held at gunpoint throughout the whole ordeal. police say there was a similar home-invasion robbery in the same area monday night. the "panelexaminer" report two transients are responsible for a near 30% increase in violent assaults. more officers have reportedly been assigned to deal with the population boom. signs have gone up around parks warning that cam subpoena not allowed. san francisco general

hospital is asking the public to help identify a female patient in critical condition. the woman was found on the embarcadero. this is a picture of her. she's 4'6" weighs 93 pounds and is in her 50s and 60s. if you recognize her you are asked to call general hospital. a nonprofit says the investigation needs to be moved to maryland for hassani campbell. that's where louis ross lives, his foster dad. ross was arrested but released after prosecutors did not file charges. oakland police say ross, though, remains a prime suspect. the game is still hours away but the excitement is really building in at&t park this morning.

the giants are two wins away from the world series. paul chambers joins us live. >> reporter: good morning. the giants returned home yesterday, they had a big win, which, puts them in the driver's seat and gives them the upper hand when they shut out the phillies. people around the town are extremely excited. >> this was a big game. we needed to take it, the first one of the home stand. we did it, we are gonna do it tomorrow, we're gonna do it on thursday. see us in world series. see ya! >> reporter: and this guy, former giants star barry bond led them there and he was on hand for the game yesterday which brought on a crowd of 43,000, fans wearing their orange to watch the giants shut out the phillies. the giants are just two win ace

way from appearing in the world series, something the club has not done since 2002. if you can't make it inside the ballpark, fans have many options. some are watching from the china basin, boats at mccovey cove and others are watching from local bars and restaurants. but some fans say being near the same underand being -- stadium and being apart of this is enough. >> we saw people offshore out there. i think they are paddling to get here. >> everybody is into it out there! >> reporter: the lights are on at the ballpark. the game starts at 4:57 with joe blanton on the mound for the phillies and madison bumgardner for the giants. when game starts, there will be a ton of boats out here checking out the game.

operations, saying they are putting legitimate charitable bingo halls out of bit. >> we do a lot of things to try to help the kids off the street and without the money, if we don't have a -- a way to bring the money in, it's just gone. >> city officials say the owners of two of the facilities have agreed to meet with the city attorney on thursday. it's believed both sites will be closed for good following that meeting. today, jerry mc-- jerry mcnortheasternny will make the announcement at noon today about the money.

all right. 4:57 this afternoon is the first pitch of the giants game but because we've had a lot of people taking mass transit this morning, so they can avoid driving around the city, is that right? >> yes. they are gonna be running longer trains. so it's the perfect time to take mass transit around 5:00, some will be getting off work, others will be heading to the game. right now we're gonna take a look at our maps and show you where we have a three-car crash south of the san mateo bridge. this is 880 southbound at industrial parkway west. crews have cleared the accident scene but you can see traffic is bumper-to-bumper from san lorenzo through hayward. up next, we're seeing a lot of slowdown at gilman street. you can tell it's just crawling along there toward the maze. give yourself extra time. at the bay bridge, same story

this rain season. they've already had had had two good systems and another one up there. same could be said in reno. for us, we're on the northern edge of it. so we don't have have worry about it. stockton is reporting fog. so the fog will be hanging out by the coast but a very similar pattern. on the coast, 50s and 60s, temperatures close to yesterday. a little bit more fog and more of a breeze. napa, 75. we'll go 74. >> so we're close. but mount tam is at 60. that's still warm air aloft. high pressure is over us. so smashing that fog upper 40s to low 50s. cupertino, pleasanton 54 and vallejo and san carlos. 28 up in tahoe.

monday. >> thank you, steve. this in morning -- new this morning, indianapolis police have arrested colts punter pat mcafee on public intoxication. police say the 23-year-old athlete had a blood alcohol level nearly twice the legal limit. his arresting officers say they asked him how he got wet. he reportedly told them it was raining and it wasn't. apology request, 19 years later. anita hill's response to a voice mail message from the wife of supreme court justice clarence thomas, including why she first called police.

the dow crossing back and for the in the 100 mark in positive territory. the big reason stocks are up this morning, regaining much of the ground loss is because of strong earnings reports of manufacturing. u.s. airways posting a third quarter profit. right now the dow is up 100 at 11,079. the nasdaq is up 16, s&p is up 9 1/2. greco is recalling 2 million of its older model stroll injuries after reports of children being strangled after slipping between the tray and the bottom seat.

the recall involves those made before 2008. they were sold in walmart, sears and other stores. there is a link from our website to the full list of serial numbers of the strollers being recalled for a refund. the woman who accused supreme court justice of sexual harassment 20 years ago says she has no intention of saying i'm sorry. anita hill says she received a voice mail from thomas's wife asking for an apology. alison burns is following this story. does it seem like justice thomas knew what his wife was doing? >> reporter: no, kraig. at this point, it's really unclear whether justice clarence thomas knew that his wife had had made that phone call. and this is not the attention that anita hill wanted. take a look at this video of

reporters swarming her car as she went to work this morning. she did not expect that call from virginia thomas. in fact, when she got the voice mail, she thought it was a prank. she contacted the university where she worked. they contacted the fbi. it has been 20 years nearly since the clarence thomas confirmation hearings. thomas called the proceedings at the time lynching. anita hill received a voice mail asking her to apologize and pray about it. later she said "i did place a call to anita hill in hopes that we can get what happened so long ago." anita hill has told reporters she has no intention of apologizing.

she stands by her claims and she thought that phone call was inappropriate. reporting live from washington, d.c., alison burns, ktvu channel 2 news. >> all right. thank you, allison. it is 7:47. state senator leland yee from san francisco says he believes he's being punished by other democrats in the state senate because he was the only democrat not to vote for the budget. now yee has been told he's being stripped from his post as the number two ranking member of the senate and lawmakers killed a budget review he introduced to provide sax relief to those -- tax rye leaf to those victims of the san bruno explosion. five familys that suffered devastating losses in the san bruno disaster have filed separate lawsuits from pg&e. the families are seeking money. they also want pg&e to remove the gas line from the neighborhood. the lawsuit says pg&e's pipeline was a ticcing time bomb that the utility negligently maintained.

so far there's been no comment from pg&e. >> one of san francisco's largest apartment complexes has a new owner. the previous owner located near san francisco state defaulted on the mortgage. it's been taken over by fortress in new york. the previous owner will had continue to mack the complex -- manage the complex. the san francisco labor board is looking into allegations that they violated their contract. san francisco hyatt regency accuses the union of using contributions that are supposed to be used for child and elder care. a facebook user is suing zinga claiming zingaa

inappropriately shared people's information with advertisers. the lawsuit wants monetary confirmation and wants zinka to stop the practice. zinka makes six of the ten most popular games on facebook. the oakland as are considering buying from flagship radio station. they are in the early stages of the possible deal to purchase extra sports 860. behind the station, the as have had had three different flagships in the last five years. ten minutes before 8:00. critics say it was too close for comfort. ktvu bill martin with his own camera captured the scene.

whooping cough has claimed the life of a 10th baby this year. the latest victim was a 6-week- old baby in san diego county. more than 5,000 people have been diagnosed with whooping since january. state anti-drug officials say they took in a record amount of marijuana plants. they report seizing 570,000 plants during a recent effort. that's up from about 140,000 plants last year. santa rosa police are looking for this man geraldo

cancrola. detectives say they found 225 pounds of marijuana and also arrested his wife during the raid. a federal court sentenced three men for allegedly hunting deer in yosemite park. this is a picture of a game warden who tracked the poachers. he's holding thantlers of one of the three who were killed. they will have to pay nearly $60,000 in fines. there is a lot of talk on the internet about a youtube video taken during fleet week in san francisco. a united airline 7 7 was part of the -- 747 was part of the show and appears to come awfully close to the golden gate bridge. it looks like it's skimming the top of the towers. but in reality there was no danger. the faa said it was just the camera angle and the plane was

about a fire 245 destroyed an apartment -- that destroyed an apartment building in nob hill. jade hernandez has more. >> reporter: we've learned that firefighters had be out here until at least 8:00 tonight monitoring hot spots. three people were treated for smoke smoke inhalation. no firefighters were hurt. but i want you to hear why the chief was so concerned about particular building -- about this particular building. >> it traveled pretty quickly. i do want someone from the department of building inspection come out. midway through the -- through fighting this fire, i pilled the members out because it became structurally questionable. >> reporter: we were just updated about 15 minutes ago. the this -- this building is on hyde, near hyde and bush.

the flames spread through and the flames shot out of the bay windows that remain of wood. the cause this morning is still under investigation but the fire department has pulled in a building inspector. again, they don't know the cause of the fire but they believe that it started on the first floor and then just spread. the red cross is helping about 0 residents -- 40 residents find shelter this morning. we spoke to a couple of residents who initially heard noises and then they realized what was going on. >> we heard a bunch of alarms going off. we came out here to check it out. when we got here, we saw a lot of black smoke coming out and we saw fire boom out of the window. >> i just saw the fire coming from one of the -- a friend of mine in the building. it's really -- it really scared me. it really broke my heart. >> reporter: the basics of the

this morning, police are still searching for the people responsible for this home invasion that happened around 11:00 last night. one of the victims told ktvu that a family member was outside the house, smoking when that person was approached by two suspects, suspects police say were wearing hoods over their heads, forced that family member back in the home. at least one of them was carrying a silver revolver and one family member was held at gunpoint during the entire ordeal when the suspects went through the house. again there were 12 victims inside. but fortunately, nobody was hurt. the suspects got away in a silver infiniti. what we don't know is why the house was targeted. one of the victims did tell us that they saw these two men in the neighborhood the night before. so we're not sure if they are from the area or if they are looking for opportunity. we are also told by police that there were other similar crimes in this neighborhood.

jade hernandez has more on how many people were displaced in this fire that started this morning. >> reporter: about 30 to 35 people is the estimate that were displaced. you can see firefighters still on that apartment building right now. they are fighting hot spots at this point. the four-story building has been destroyed by flames and when we arrived, flames shot out of the building. the residents inside, up to 40 people are being assisted by the red cross. san francisco's fire chief told

us that the fire quickly grew to a four-alarm fire. that's the reason why so many firefighters were out here this morning. two residents and a next-door neighbor were treated for smoke smoke inhalation. residents are lucky that the building is located near the medical center. many evacuees were able to take shelter in side the hospital. the chief of operations told us that fire crawled through the stairwell of the apartment building spreading flames fast. we saw firefighters climb to the roof to try to fight the fire from the outside all morning. we've spoken to residents and next-door neighbors at one point, people gathered at the intersection where we're leecated just to watch firefighters fight the hot spots. others describe their horrific wakeup call.

fatal car accident in los gatos overnight. it happened just after 3:00 this morning at union avenue and blossom hill road. new video of that crash shows the extent of the damage with the front of the car completely smashed. the car was the only vehicle involved. it a apparently driven off the road and into a tree. >> we saw that there was a single vehicle that had collided into the palm tree here at blossom hill and union. single female occupant. she was pronounced dead at the scene. >> the driver has not yet been identified. we understand no passengers were inside that vehicle. police have some streets closed off in the area while they investigate. these are live pictures of the scene. you can see the cars still there. police also say they have yet to rule out alcohol as a factor in the crash. a homeless migration is being blamed for a jump in crime in san francisco. the san francisco examiner reports transients who were
