stepping up activities, sending postcards and letters like this one to the los angeles judge who will decide what, if any time in prison, the former b.a.r.t. police officer will spend for shooting and killing oscar grant. >> we expect johannes mehserle to go to prison. >> reporter: oscar grant's uncle was one of several people urging folks to turn out saturday for a rally beginning at noon at oakland city hall. they demand that mehserle receive the maximum 14 years in state prison. backing the rally are bay area long shoremen who say they were first galvanized to protest police killings and san francisco police killed two striking long shoremen in 1934. they say their protest will shut down the oakland port. if workers can stand up for justice for oscar grant, they can stand up for justice in this country and it can happen

and i hope to hell it happens this saturday. >> reporter: the 4,000 postcard and letters to the judge were sent. a coordinated cam pain has generated it. shooting a young man in the back as he is lying on the ground is the most horrifying crime. >> reporter: as of today, the los angeles court says that it's received 76 letters or cards on behalf of the prosecution and 75 supporting probation for mehserle. >> most of the letters that he have i have seen are -- that i have seen are from people who believe there should be no further jail sentence. >> they are flying a flag at mccovey coefficient. they are creating an online petition with more than 600 signatures. >> the jury found it was an

accident. jury, by convicting him of the involuntary clearly understood he did not intend to shoot oscar grant. >> reporter: oakland police just told me that they canceled some leave and will have on duty saturday enough officers for what they say they hope will be a nonviolent demonstration. reporting live in oakland, rita williams, ktvu channel 2 news. across the bay a heartbreaking situation in san francisco this afternoon where a number of people living inside an apartment complex say they lost everything. it appears that many of them don't have insurance. this comes after a massive fire destroyed their complex early this morning. patty lee is live on the scene with more on what happened. patty? >> gasia, fire crews tell me that the building is on the verge of collapse. it may not look that fragile but the wood structure

underneath is demolished. >> i'm looking at my building and it was like this is somebody else's nightmare, not mine. >> reporter: stephanie heinz escaped the fire that startd in her building around 5. you go to bed, climb out your window without your shoes on. >> reporter: the fire may have started small but it quickly swallowed the 8-undercomplex and damaged adjacent building. >> the stairwell had collapsed between the second and third floor. we made the decision to pull everybody out and go defensive on it. three people were transported to nearby st. fran cyst hospital and treated for smoke inhalation but no one was seriously hurt, at least not physically. >> you find something, that's good, guys. >> reporter: financially, that's another matter. these band mate were among the people evacuated. their instruments were in there. >> i'm working, working, everything is gone. everything is burned down. i have nothing. >> reporter: the red cross is

helping at least 40 displaced residents to find temporary accommodations so they can focus on replating their possession and rebuilding their lives. supervisor david chu tells us that many of the displaced are renters and some without insurance and they are now relying on the red cross for help. in the meantime, this stretch of hyde street could stay blocked off until long past 8:00 with security to be posted until this building comes down. reporting live in san francisco, patty lee, ktvu channel 2 news. president obama is in california today just two weeks before the vote on whether to legalize marijuana. his visit comes on the heels on attorney general eric holder saying that it the feds oppose legalizing marijuana. the drug czar says that this

may do more bad than good. >> we look at the numbers. more people are going into treatment in california than anywhere else the government says it will not support legalizing marijuana, about half of california state think they are leaning towards voting in favor the prop 19. according to a survey by the public policy institute of california released last month, 522% of californians say they favor the measure. that compares to 41% who say they are currently against it. >> the 9th circuit court of appeals in san francisco is about to become the center of the battle over gays openly serving in the military. the obama administration has asked the 9th circuit to put a hold on the ruling. the judge in the case refused yesterday to stay her ruling while the administration prepares it appeal which will also be heard in the 9th circuit.

president obama says he wants to end the law which bans gays from serving openly in the u.s. military but the president says that he wants to do it through congress rather than through the courts. looks like the san francisco giants playoff run is throwing the obama administration a bit of a curveball. president obama's visit on thursday would have coincided with game 5 of the nlcs potentially causing major traffic delays in the city. now the fund raising event has been moved to the peninsula. president obama will also host the democratic national committee reception in a fundraising photo op for attorney general candidate pamela harris we are now less than an hour away from the first pitch of game 4. the giants your just two wins away from the world series. fans are fired up, including members of the giants world series team from 1989. mike mibach has more on the

los gatos police are trying to determine the reason nor a horrifying accident that left a woman dead. the suv hit the tree so hard that it sheared it in half. investigators say that speed may have been a factor. we checked with the santa clara medical examiner's office just a short time ago but, at this time, the name of the victim still has not been released. we want to remind drivers about something we first reported on the 10:00 news. cal tran has decided to delay work to install section of a tower on the new eastern span of bay bridge. caltrans had originally planned to put together the tower sections at 4:00 this morning

cancer. several cancer survivors said that they had hormone therapy before their cancer. >> i took it. i wish i had not. i was unsure about it the whole time. >> reporter: 60-year-old jennifer morales diagnose add year ago after taking hormones. >> i had the mammogram months before that. it's actually the tumor grew within that four months. >> reporter: an 11-year study followed 16,000 women who took combination estrogen marketed as prem pro. >> this appears to have the most aggressive cancers. the death rates was higher. >> combination raised the women's risk of lung cancer as well. the effect was not seen with estrogen alone which doctors say may protect women from doctor as well as dementia, bone loss and other problems post menopause. >> we have alternative to this

the emeryville city council rejected ikea's plan to expand its warehouse operations. customers would have gone there to pick up large items but some neighbors objected, saying they didn't like the idea of cars and big trucks coming and going from that warehouse 15 hours a day, 7 day as week just real quick, we are getting some word here from ap that the federal appeals court said the military should keep in place the don't ask, don't tell policy for now. that has been in dispute for many years. the federal appeals court said
