kraig debro. >> good morning. i'm tori campbell. it is thursday, october 21st. we begin with breaking news in san jose. a tense standoff continues near tampa way on seminole way. police say a suspect who is wanted for attempted murder, is holed up in his car, after firing shots at police officers this morning. ktvu's tara moriarte is live in san jose, with how all of this started. . >> good morning. we're actually two blocks from where this man is. and he is again hunkered down in his car, in this direction. and police have cordoned off a very large section of the neighborhood because they don't want any of stray bullets perhaps from the shooting that occurred earlier to rear its ugly head again. so joining me live, sergeant ronnie line. he is here to give me an update over what is going on. this is still an active scene

here. >> yes, it is. about 1:50 this morning, officers attempted to stop a vehicle. the suspect fled. they did follow-up investigation and found that the individual was wanted for attempted murder out of san jose. they developed some leads that took them to this location, tampa and seminole in the east side of san jose. they located his vehicle, put a game plan together and attempted to contact him. the suspect brandished a firearm, discharged his firearm several times at the officers. the officers returned fire. one of our officers was injured with just glass debris. he was transported to a hospital. minor injuries. he's since been released. the suspect is still in the vehicle. he's moving around. we evacuated approximately 15 people. and now what we're trying to do is take him basically into custody hopefully as safely as possible. >> who is this guy? do we have any idea? >> he is a 34-year-old male, san san jose resident. we are holding off on putting details until we can develop more into this investigation.

>> reporter: and lastly, without giving away any important details, obviously, what is your strategy at this point? >> quite frankly, we want to prevent any further life- endangering situations. we want to take him into custody as quickly and safely as possible. and that's going to consist of methodical, tactical deployment. our special operations team is here. and hopefully we'll resolve this quickly and safely. >> thank you. and once again, this is an area off of seminole and waverly way that has been completely blocked off. you cannot get through it there. people are not letting in. people could be in danger if this individual who is holed up inside of his car, apparently armed, decides to shoot that weapon again. we're live in san jose, terra moryartdy. -- terra moriarte. it's another big day in this incredible season for the

giants. san francisco earned another one-run victory in dramatic fashion last night. a win tonight sends them back to the world series. >> reporter: and that's exactly what happened, kraig. the phillies would like to take it back home. the giants definitely want to make sure they take care of it tonight. the giants are just one game away from potentially heading to the world series. >> i don't want to go back to philly. i want to clinch it here, hopefully in front of the fans. we have been out here every night. ready to go. >> reporter: last night's game was a nail biter, coming down to the 9th inning, where it was tied, 5-5. but that all changed, thanks to juan uribe's sacrifice fly. and winning a score. 6-5. >> that has to be an instant classic right there.

get up early, and this has been set up as a pitchers duel all around. but this was an offensive display. gotta give them credit. they kept coming back, kept coming back. and we did the same. >> reporter: now, a win tonight by the giants will send the phillies packing and have them in unfamiliar territory. instead of playing in their third consecutive world series, the phillies will be at home, where they will be watching the giants play. >> we can all go and take it for granted. we have to go out there and play. and don't think, we have this easy. we're going to go out there and fight. >> reporter: now, a win today will have the giants clinching their fourth national league pennant since moving out west. this will be game 1 of the series with tim lincecum taking on the giants, taking on roy

fundraiseer at google executive marissa mayer. the price for admission there, $30,000. most people didn't even know the president was coming. >> there were a lot of people at the home, standing around at the driveway. and we were walking our kids to school. so we knew something was going on there. so now it's wonderful to hear that's what it was. it's an honor. >> i didn't know, but it's pretty cool, man. i'll tell my mom and she'll be excited. >> the president is expected to land at sfo at 3:00 today. in ather ton at 5:30. he'll spend the night in san francisco before heading to l.a. tomorrow for a speech at usc and a fundraiser for senator boxer. this morning, firefighters are still standing it watch -- standing watch at a san francisco apartment fire. it displaced 75 people. the academy tells ktvu that at least 12 lived at the school. and the school is helping to get them back on their feet.

the cause of the fire is under investigation. 7:07. it's hoped a statewide earthquake drill this morning will help people get ready for the next big quake. more than 7 million people are expected to take part in the second annual great california shakeout. that includes schools, businesses and government agencies in the bay area. at exactly 10:21 this morning, participants will be asked to drop and cover, and practice how to protect themselves from falling bilitieses during -- objects during an earthquake. and b.a.r.t. will stop trains for one minute this morning as part of the drill. bart remained a vital service after the loma prieta quake. it is hoped this will be a reminder to people to learn what to do when an earthquake hits again. not a question of "if" but

"when." let's go to sal. got a lock at -- look at the toll plaza. >> and kraig, that was me. not a robocall. good morning. traffic is doing well. no major problems this morning. if you are getting into san francisco, via the toll plaza -- let's go to the toll plaza. it has been a little better than usual. usually, it's backed up all the way out to the maze today. and you can see the 880 ramp is not quite full yet. hopefully this is a sign of the way things will stay or maybe improve after the rush, which is now until about 8:15 or so. this is the rush hour, the peak of the commute. moving along and taking a look at interstate 880, that also looks good here in front of the coliseum. that's northbound 880 on the right there. you can see traffic is moving well, heading into downtown oakland. and northbound 280 is beginning to back up quite a bit. getting into highway 17 area and into the valley. i'm looking at the list here, not a lot of commissions --

collisions or really anything to report in the northbound direction. northbound 101 at fair oaks, there's a tire in the third lane from the left. and getting word of a new crash in alamos, two cars in the gore point. they're sending a paramedic vehicle to check on someone there. again, that's 680 southbound at the stone valley exit in alamo. and high clouds coming in. it's going to be a mostly cloudy and cooler day. local drizzles possible. and light rain in the north bay from our first little front here. looks to be one out of three. mostly cloudy and cool. not only today, but also into friday. now, saturday, stronger system comes in. rain in the north bay. cloudy to the south. now, we could fine-tune this tomorrow. just giving you some heads up. looks like by sunday, rain will move south. and everybody should be in on this. unless you're farther to the south. does look like okay rain. decent rain could make it into the north bay. first system is right there. now, it's not much. but it is there. and it's going to continue to

move inland. as it does, it picks up that low cloud deck and lifts it around 2,000 feet. at the same time, it will squeeze out drizzle and light rain. the system in southern california gave a lot of rain and is being bumped out. this system stretches itself out. so it loses a lot of energy. and it is swinging to the north, which is why we focus it mainly on the north bay. highs start to come down yesterday with the enhanced fog bank. and they'll really slide down further side. 50s and 60s for all. 59, if you're going to the game tonight, dress the exact same way you did last night. 60s in walnut walnut creek. napa, 64. one of the keys is mount tam, 14 degrees cooler than yesterday at this time. 46. low clouds have lifted, the cooler air is coming in. 51 to 55. cupertino, 55. temperatures have gone up. sunol niles, 53. pleasanton at 55. 32 in tahoe.

50s, instead of 40s for yreka and ukiah, due to the cloud cover. and 60s in southern california. that system moves out. but there's the first system, getting closer. the low in southern california has moved into arizona and utah and new mexico. there's our system for tonight, not much because it isn't much. but the stronger system for saturday is right there. and that has a lot more going for it. it will give us a lot of clouds, windy conditions and some rain saturday. local drizzle possible. 50s, 60s, maybe a couple of very low 70s. but not very warm over the next few days. we clouded up big time. and sunday and monday, looks like everybody sees some rain moving to the south. >> thank you, steve. it is 7:12. opening up a lead. one candidate is pulling ahead in the race for governor. the specific group that is helping move the polls. election day is still a week and a half away. but many americans are already casting their ballots. and the main group who is voting may surprise you. we're continuing to monitor

they tried to contact him, officers returned fire. but one was hurt by flying glass. police say the suspect is wanted for attempted murder. ktvu's tara moriarte is at the scene and we'll have a live report coming up at 7:30. a new poll in the california governor's race shows democrat jerry brown has opened up a lead over republican meg whitman. with just 12 days to go. last week, it showed brown in a virtual tie with whitman. but now, brown has an 8-point lead. 44% for him. 36% among whitman. support among latinos is being credited for brown's lead. and incumbent democrat barbara boxer's lead over carly fiorina was 7 points. it's now 5. 43% support boxer. 38 are for fiorina. according to the los angeles times, hewlett packard

benefited from state tax breaks while carly fiorina was ceo, even though she said that california has a tax structure that is hostile to business. according to the report, hp was aare ward -- awarded refounds -- refunds, even though it made billions. a spokesperson for fiorina says hp followed the tax laws of the state of california and was subject to the decisions made by the state's leaders. here in california and in other states across the country, voting in the november 2nd election is already under way today. more than 3 million americans have voted so far. ktvu's alison burns is in our washington, d.c. newsroom, tracking some of the results. good morning, allison. >> reporter: well, good morning to you, kraig. that's right. the early voting is under way. and you might be surprised at who is getting the biggest

turnout. in all 36 states and washington, d.c. have some sort of early voting. and so far, nationwide, democrats are casting more pre- election day ballots. but republican turnout is up over the 2008 elections. we saw senate majority leader harry reid cast his ballot this week. other voters are mailing them in. in california, about 600,000 ballots have already been cast. the secretary of state is not revealing whether they're from democrats or republicans. but with democrats fighting to keep control of congress, a number of states are expecting a record midterm election turnout. reporting live from washington, d.c., alison burns, ktvu, channel 2 news. >> thank you, allison. it is 7:18. this just in, the pentagon says it expects to have new guidelines with gays serving in the military later today. 9th circuit court of appeals

ordered the don't ask, don't tell policy to stand, at least for the time being. a federal judge in riverside had ruled the ban against gays in the military was unconstitutional and ordered it suspended. then the obama administration appealed. the president has said he wants the policy repealed, but only after a review and an act of congress. toyota announced another recall this morning. this time, the notice affects nearly three-quarters of a million cars and suvs in the u.s. and 600,000 in japan, for problems with brake fluid and fuel pumps. the affected cars are 2005 and 2006 model year avalons. 2004 through 2006 nonhybrid highlanders. and lexus rs330s and 2006 lexus gs300, is250s, and is350 vehicles. toyota has recalled more than 10 million vehicles worldwide

restaurant might not be safe from demolition, but it could be relocated. san francisco's planning commission meets tonight on a $130 renovation plan for the fairmont hotel, which has housed the tiki style restaurant since 1945. the remodeling calls for tearing down a tower and permanently shutting down the famous restaurant. now, a prominent buyer wants to relocate the tonga room. also, people are invited to share their thoughts on the school district's plan. they are considering cutting pay for administrators and shutting down swim facilities. district officials say cuts could be avoided if voters approve a partial tax. but a partial tax measure was on last june's ballot. and that would have allowed funding. however, it fell short of passing. more help for victims of the san bruno pipeline disaster is coming from sacramento.

governor arnold schwarzenegger has signed an emergency bill into law. it provides disaster relief funds for the families and businesses affected by the september 9th disaster. the relief bill will also provide more money for the city of san bruno. a machete attack at a scott's valley shopping center was sparked by a road rage incident, according to police. highway patrol officers say two drivers pulled into the scott's valley junction center yesterday afternoon. police say one driver chased the other driver through the shopping center, with the two- foot-long machete. the victim suffered minor cuts. the suspect, identified as 36- year-old cheyenne young, was arrested on suspicion of assault with a deadly weapon. 7:24. time to go to sal again. he has his eye once again on 280, as well as toll plaza, right? >> that's right. it's getting busy. traffic is 280 northbound is slow getting into the valley from downtown. it's kind of typical this time of year.

nevertheless, you have to deal with it. moving along to problem just off the san mateo bridge. this is in foster city, westbound 92 at mariners island boulevard. it's a noninjury accident, but it's blocking one of the right lanes in front of that shopping there, the shopping district there. traffic is going to be slowing down, once you get there. but it's not slowing on the bridge just yet. and a live picture of the toll plaza shows you about a 50- minute delay westbound coming into san francisco. but once you get there, there are no major problems. again, a reminder, this evening, another game at at&t park at 5:00. and that means just after 3:00 this afternoon, you're going to see a crowd getting into san francisco via the bay bridge. 7:25. here's steve. >> change is already starting. and a lot of cloud cover. most locations cloudy to mostly cloudy. although livermore seems to be the last standing clear. if you're out there, you can always tweet me. sp weather.

san jose was clear. they're cloudy. rain is on the way. this first system is a weak system. mostly cloudy, cool. saturday, rain in the north bay looks very likely. cloudy everywhere else. and breezy. sunday does look like the strongest system sunday afternoon, taking us into monday. there's your first system. weakening as it comes in. but that really picked up the fog and enhanced that. not only low clouds. it's mostly low clouds and fog. look for a mostly cloudy day. cool and breezy. 50s and 60s. not very warm. that's for sure. 54 seems rather popular. livermore, concord, palo alto, san jose. one low in southern california moves out. there's our first system. it's drifting northward. but still could give us local drizzle or light rain from san francisco, golden gate north. mostly cloudy, cool and breezy. the big news will be coming in saturday and sunday. 50s and 60s on your highs mainly today. starting to question myself on some of those. there's just too much cloud cover coming in. mostly cloudy.

san jose police say a suspect wanted for murder is holed up in his car, after firing shots at police officers this morning. ktvu's tara moriarte is live in san jose, on what police are doing to try to end this standoff. >> well, we have just learned that this suspect is a 34-year- old man from san jose. as you mentioned, he has hunkered himself down, inside his car, two blocks from where we're standing. here off of tampa way and waverly avenue. these are some live, exclusive pictures that we have of the actual car, where we are told that it's this red car that you see here. and the suspect is actually perhaps lying down, it looks like, on the passenger side of the car, the passenger side window has been blown out. and he is apparently waving his hands out of the window every once in a while. so we are see something movement there. now, police said that they were

actually making a routine traffic stop early this morning around 2:00. and the car took off. now, after investigating, police found out that that driver was wanted on attempted murder charges. they began to track him down and discovered him in this east san jose neighborhood, inside his parked car, around 4:00 this morning. the suspect immediately grabbed a weapon, gunfire erupted. and some neighbors say they heard as many as 50 shots. >> he's already exchanged gunfire with an officer. we are trying to do this as safely and securely as possible. we want to obviously prevent further life endangerment. >> now, one officer was hurt during the shootout, he was injured by some flying glass. he was taken to the hospital with nonlife-threatening injuries. dozens of officers have swarmed this neighborhood all morning long. at least 15 people have been evacuated for safety reasons. now, they are hoping that the suspect surrenders.

he, as we mentioned, has been moving around his car. he has been responsive toward officers. but no word yet on whether he has been injured. police say that normally in a standoff like this, it would take 45 empties to -- 45 minutes to an hour to apprehend the suspect. but in this case, they are actually waiting for some negotiators to negotiators to arrive on scene. so it could take longer than that. we are live in san jose, tara moriarte, ktvu, channel 2 news. 7:31 this morning. the labor department had better than expected news on unemploy. -- unemployment. first-time unemployment claims dropped. economist his expected first- time claims to increase. continuing claims also dropped by 9,000 to 4.44 million. that indicates fewer people are losing their jobs, but does not show many new jobs are being created. president obama will be in the bay area today. but he's not making any public appearances.

he is here to raise money for democrats ahead of the november 2nd election. ktvu channel 2 reporter jade hernandez is in palo alto, where she is talking to people who are just finding out the president is coming to their neighborhood. good morning, jade. >> reporter: good morning. i just spoke to a man who just found out that president obama is coming to dinner tonight. he knows he doesn't have the funds to cough autopsy what he need -- cough up what he needs to sit down with the president. but he says he also understands the need for fundraising for president obama. i want you to take a look at this neighborhood here in palo alto. the cost of taking a picture with the president is $6500. for 50 democratic big spenders who want more time with the president than just a picture, they'll meet with mr. obama at a fundraising dinner at google executive marissa mayer's home tonight.

price tag on that one? $30,000 a plate. the dinner was originally scheduled to be in san francisco at four seasons. but that was moved. speculation is that the giants hoopla in the city forced a change of plans. we came to speak to residents of palo alto. and the neighbor we spoke to lives down the street from the google exec. says he understands the need for funds in the weeks before the election. >> i know they need to raise money. and i get letters all the time from my friend, barack obama. turns out, i got one yesterday, which was stamped "personal" on the front of the letter. >> you're looking at the president's visit in the state of washington. he's flying from there to sfo this afternoon, around 3:00. after both fundraisers, he is expected to spend the night in san francisco. reporting live, jade hernandez, ktvu, channel 2 news. >> jade, thanks again for that

update. police have arrested a staffer in connection with a burglary at a palo alto home. detectives have arrested jose hernandez for a burglary. police believe fernandez entered a home through a window. they say he took several items, including the keys to a car. the family was home at the time but sleeping. the car was later recovered. police say the suspect works at a university dining hall. police have arrested four east bay teenagers in connection with a string of armed robberies. carious hall, kevin polk, and twin brothers, michael and mikhail glover. police say they robbed five victims last week as the victims were out for a walk. the oakland tribune reports that two home-invasion-style robberies in east oakland are linked. the first happened shortly

before 1:00 a.m. tuesday morning on east 22nd street. the other happened less than a mile away. this is around 10:45, tuesday night. in both incidents, police say two men who were armed took cash and electronics. no one was hurt. so far, no arrests have been made. the nfl's labor pains are having an effect on the 49ers, $1 billion plans to build a stadium in santa clara. judd york says the ongoing contract dispute between the players union and nfl owners has made it tougher to secure financing. and the opening of the new stadium is likely to be delayed a year. that means the first niner game in santa clara would not be played until 2015. and that's at the earliest possible date. 7:36. the giants are now just one win away from the world series. that's after last night's thrilling victory in the bottom of the 9th, at at&t park. >> and carry home the winning run in game 4. giants won it, 6-5.

thank you, claudine. it is 7:47. san francisco's finances are looking up. according to the san francisco examiner, higher-than-expected revenues could leave the city with a budget surplus of more than $20 million. mayor good afternoonin newsome wants the money to go into reserves to help with a fiscal budget deficit next year. according to new polls, californians oppose this proposition that would suspend the climate change law. 48% of likely voters oppose prop 23. 37% support it. prop 23, which suspends the greenhouse gas law from being implemented until the state's unemployment rate falls to 5 1/2% for the entire year. the unemployment rate is currently 12% in california. microsoft cofounder bill

holed up in his car after firing shots at police officers this morning. ktvu's tara moriarty is live in san jose to give us the latest. good morning, tara. >> good morning, torei. that's right -- tori. that's right. tense moments here. there is a very heavy police presence here in this neighborhood. if we pan over here, we can see there are cop cars blocking off the section here near king and waverly avenue. and back over here, we have more police vehicles, as well as emergency vehicles, including an ambulance, as well as people from the fire department. we are just two blocks from where the gunman is hunkered downed in of -- down inside of his car. we want to take a look at these exclusive pictures of the suspect's red car, where he has been moving around inside for the past four hours. at times, he has been waving his hands out of the window. and it appears that he has been lying in the passenger's side of the car, and that car window, on that side, has been blown out. we're not sure if the suspect

has been shot or not. now, this all started around 2:00 this morning, when police were making a routine traffic stop. the driver took off and when investigators ran his license plate number, they discovered that he was wanted on attempted murder charges. they tracked him down, two hours later nthis east san jose neighborhood. when they approached the car, the man took out his weapon and gunfire erupted. some neighbors say they heard as many as 50 shots! we would consider this to be pretty much a full, tactical callout. we're trying to take this individual who is obviously armed and has exchanged gunfire with an officer, into custody as safely and quickly as possible. >> now, 15 neighbors have been evacuated as a safety precaution. the one officer was injured by flying glass during the shootout. he is at a nearby hospital with nonlife-threatening injuries. now, again, the suspect is described as a 34-year-old from san jose, wanted on attempted murder charges. he is still involved in a

it's an honor. >> i didn't know, but it's pretty cool, man. actually, i'll tell my mom and she'll be pretty excited. >> reporter: the president is expected to land at sfo at 3:00 today. he'll be in atherton at 5:40. then he's scheduled to have dinner in palo alto at 7:00. he will spend the night in san francisco before heading to l.a. tomorrow for a speech at usc, and a fundraiser for senator boxer. this morning, firefighters are still standing watch outside of a san francisco apartment building that was destroyed by a four-alarm fire. the fire started around 5:00 a.m. yesterday, and displaced 75 people. the academy of art tells ktvu that at least 12 of its students lived in the destroyed building. and the school is working to help them get back on their feet. the shelter has been open for fire victims at the recreation center. the cause of the fire is under investigation. it's hoped a statewide earthquake drill this morning will help people get ready for the next big quake. more than 7 million people are expected to take part in the second annual great california

shakeout. that includes schools, businesses, and government agencies in the bay area. at exactly 10:21 this morning, participants will be asked to drop and cover and practice how to protect themselves from falling objects during an earthquake. and bart will stop trains for one minute as part of this morning's drill. bart carries about 360,000 passengers every day and remained a vital link to passenger service after the loma prieta quake years ago. it is hoped it will remind people what to do when a quake hits. so if you're riding bart and it suddenly stops at 10:21 -- >> not a problem. just a drill. >> right. that's right, kraig and tori. it is getting a little slower on southbound 101, as you drive down to the 580 interchange in marin county. we have not had a lot in the way of accidents and stalls. the backup isn't that deep. but i want to let you know that it's there.

the scene. and she will join us with a live update at 8:30. a new poll in the california governor's race, shows democrat jerry brown has opened up a lead over republican meg whitman with just 12 days to go to election day. last month's public policy showed brown at a virtual tie with whitman. but now, brown has an 8-point lead. 44% to 36% for whitman. following the issue with her housekeeper, latinos are being credited brown's lead. 43% support boxer. 38% support fiorina. according to the los angeles times, hewlett packard benefited from state tax breaks, while carly fiorina was ceo. even though fiorina said that california has a tax structure that is hostile to businesses. in 2005, hp was awarded $13

later today. that's after late yesterday, the 9th circuit court of appeals in san francisco, ordered the don't ask, don't tell policy to stand. at least for the time being. a federal judge in riverside had ruled the ban against gays in the military was unconstitutional and ordered it to be suspended. then the obama administration appealed that judge's ruling. the president has said he wants "don't ask, don't california -- tell "repealed but only after an act of congress. this time, the notice affects 1.3 million. the affected cars are 2005 and 2006 model year avalons. 2004 through 2006 nonhybrid highlanders. and lexus rx330s, and the 2006

the historic tonga room restaurant might not be saved from demolition, but it could be relocated. san francisco's planning commission meets tonight on a $131 million renovation plan for the fairmont hotel, which has housed the tiki style restaurant since 1945. the remodeling calls for tearing down a tower and permanently shutting down the famous restaurant. now, a local restaurant owner wants to buy and relocate the tonga room. details can be released at tonight's commission meeting. also tonight, paramedic -- parents in alameda are sharing their thoughts on plans to cut the budget. the district is considering closing several schools, cutting pay for administrators, and shutting down swimming facilities. district officials say cuts could be avoided if voters approve a parcel tax next march. but a parcel tax measure on

fire on officers early this morning. ktvu's tara moriarty joins us live from the scene with more. tara? >> negotiators have just arrived on scene here. and they are trying to get this gunman to surrender. we are told this could take quite sometime. there is a heavy police presence here. we are just two blocks away, from where the gunman has hunkered down inside a car. we are on the corner of waverly lane and stampa way. we want to show you pictures of the suspect's red car, where he has been moving around for the past four hours. at times, he waves his hand out of the window. and it appears that he has been laying on the passenger's side of the car and that window has been blown out. this all started around 2:00 this morning, when police were making a routine traffic stop. the driver took off. and when investigators ran his plate numbers, they discovered he he was wanted on attempted murder charges. they tracked him down to a parked car in this neighborhood.

>> they put a game plan together and attempted to contact him. the suspect brandished a firearm, discharged his firearm several times at the officers. the officers returned fire. >> reporter: now, 15 neighbors have been evacuated as a safety precaution. one officer was injured by flying glass during the shootout. she is at a nearby hospital. again, the suspect is a 34-year- old man from san jose. wanted to attempted murder charges. currently in a standoff with police at this hour. we are not sure if he is injured or not. but it appears that he is, indeed, injured. we are live in east san jose. tara moriarty, ktvu channel 2 news. this morning, the labor department had better-than- expected news on unemployment. first-time unemployment claims dropped 23,000 to 452,000 last week. economists had expected first- time claims to increase.

continuing claims also dropped by 9,000, to 4.44 million. that indicates fewer people are losing their jobs but does not show many new jobs are being created. those numbers are helping wall street right now. there is also good news coming in about strong batch of earnings that has helped push the dow up, close to its highest level of the year. the dow rose, after earnings reports from caterpillar, travelers insurance company, and mcdonald's, all beat expectations, and at&t. the dow is currently up 642, at 11,170. president obama is coming to the bay area today to do some fundraising for democrats. ktvu's jade hernandez is live in palo alto. she's talking with people there about the president's visit. good morning, jade. >> good morning. we came to downtown palo alto to talk with residents about the president's visit, as you mentioned. because the neighborhood where the president will be later tonight will not be blocked off until around 10:00 this

morning. but we did get a chance to speak to a man who actually lives down the street from where the president will be having dinner tonight. and he knows he doesn't have the funds to cough up what he needs to sit down with the president. but he says he knows the importance of fundraising for the midterm elections. president obama is scheduled to attend a fundraiser for district attorney camilla harris in atherton this afternoon. at former state controller steve wesley's home at 5:00. the cost of taking a picture with the president there is $6500. and for 50 democratic big spenders who want more time with the president, they'll meet with mr. obama at a fundraising dinner at google executive marissa mayer's home. the price tag is $30,000 a plate. the dinner was originally slated to be at mayer's four season hotel apartment, but was moved. they speculate that the giants hoopla forced the change of plan.

san francisco. reporting live in palo alto this morning, jade hernandez, ktvu channel 2 news. >> thanks very much. time now, 8:33. police have arrested a stanford university employee, in connection with a recent burglary of a palo alto home. the arrest of jose luis fernandez on hamilityon avenue earlier this month. police believe fernandez entered through the home through an open window. they say he took several items, including the keys to a car. the family was home, but they were sleeping. the suspect works at a university dining hall. police have arrested four east bay men in connection with a string of armed robberies. police identified them as carious hall, polk, and twin brothers, michael and mikhail glover. police say they robbed five victims last week, as the victims were out for a walk. and that the suspects used a

shotgun to threaten their victims. oakland review reports the two home invasion style robberies in oakland are linked. the first happened shortly before 1:00 a.m. tuesday morning on east 26th street. the other happened less than a mile away oon east 20th street, 10:45 tuesday night. in both incidents, police say the men took cash and electronics. no one was hurt. so far, no arrests have been made. labor pains. team president jed york says the ongoing contract dispute between the players union and nfl owners has made it tough are to secure financing. and the opening of the new stadium is likely going to be delayed a year. that means the first niner game in santa clara would not be played until 2015 at the earliest. the mavericks surf competition is set to go on again this season. but this time, under new management. that's because of a group

would legalize marijuana is losing support. the poll numbers come from the public policy. it found 46 in favor of prop 19. but down from 52% in december. 49% say they now oppose it. meanwhile, a new poll shows californians opposing prop 23. it would suspend the state's landmark climate law. the public policy shows 48% of likely voters oppose prop 23. 37% support it. prop 23 would suspend the greenhouse gas laws from being implemented until the state's unemployment rate falls to 5 1/2% for an entire year. the unemployment rate is currently around 12%. microsoft cofounder bill gates is giving $700,000 to the campaign against prop 23. he is joining other high-tech billionaires and contributing to the no on prop 23 campaign.

good morning. it's 8:43. let's get you updated on some of the top stories right now. let's go to san jose, a short time ago, negotiators are arriving on the scene. we are hearing that ambulances have now been called to the scene. and we could be coming close to a conclusion. of course, we're going to keep an eye on this for you, until we get a conclusion and bring the update to you as soon as we can. more than 7 million people are expected to take part in a statewide earthquake drill, called the great california shakeout this morning. at exactly 10:21, participants will be asked to drop and cover, practicing how to protect themselves during a major quake. and giants are now just one win away from the world series. san francisco scored the winning run to defeat the philadelphia phillies. 6-5. giants now lead three

regular season, the manager of memo's also told us, that usually, this time of year is what they usually call the tumbleweed season, where streets and sidewalks are pretty empty. they are calling this play-off season a blessing. and of course, everyone wants to wear the orange and black. giants memorabilia is hot. and this is video from the temporary store they had to open across the street. that used to be a borders. now, you can see it's a giants dugout with merchandise inside. according to the chronicle, sales of giants souvenir overall are about 150% higher now. and about 20% of those sales are for post-season merchandise. especially fans of tim lincecum and buster posey. those two are topping the sales charts. and a lot of people want to get in. cabbies fought to have a temporary stand there. they make sure anyone who needed a ride could get one. they won that battle. if you need a cab in the park today, they will be there waiting. and let's not forget anyone at home.

still in prison in tehran. she said she now knows the anguish everyone felt about her. she asks her supporters to help out in whatever way they can to help get the release of bower and vital. permanently closed the doors of a controversial nightclub, called suede. in february, a man was shot to death outside the club. and four others were wounded. it was the final straw, after several incidents at the club. university, a superior court judge approved an injunction, prohibiting the club's owners from reopening at the fisherman's wharf location. it also includes a $20,000 payment to the city. in the meantime, hip-hop promoters are reportedly no longer welcome at san francisco's cafe kokomo. the decision follows a shooting inside the club that seriously injured a man. club managers say the venue had been rented out to outside promoters ask that other events, including weekly salsa

night, have been trouble-free. a judge has been set to decide yo hanes messerly's fate. he is scheduled to be sentenced november 5th for his involuntary manslaughter conviction. he could be sentenced to as much as 14 years in prison or as little as probation, with credit for time served. yesterday, grant family john burris read from some of the just 4,000 letters and post cards given to him in advance of sentencing. >> please don't endorse this shooting by giving less than the maximum sentence in this case. >> a lot of students. and a lot of just community individuals, church groups, community groups, all of whom have expressed an interest. >> i think most of the letters that i've seen are from people who say that they don't believe there should be further jail sentence, that this is a case where probation should be given.

>> ktvu news received these new numbers from los angeles superior court. there have been 76 letters and post cards sent to the judge. 75 on behalf of messerly. a 25-year-old female crinologist student is being called one of the bravest in mexico. she is the only one to accept the job of police chief in a violent border town in el paso, texas. it is only 35 miles outside of ciudad. she said the job needs a woman's touch. she will oversee a small force that will be mostly female and unarmed. former jet blue flight attendant steve slater may be going to court, but this time, as a plaintiff, rather than a defendant. they say that his brother burglarized his apartment while he was in court tuesday. slater was making a plea deal for his emergency chute exit in

and we're following late- breaking developments in the scene of a police standoff in san jose. that's where ktvu's tara moriarty is now. tara, is it over yet? >> reporter: well, the five- hour standoff has finally come to an end. just moments ago, the suspect surrendered, after the negotiation team took over. they sent in one of those robots to talk to the gunman. the suspect has been hunkered down in his car since 4:00 this morning.

on the corner of seminole way and tampa way. right now, they are loading the suspect into an ambulance. we understand he was shot during the gunfire that erupted around 4:00. this gunman, 34-year-old from san jose, wanted on attempted murder charges. he is now in custody. also, a san jose police officer was also injured in the shootout. flying grass struck him. he has been transported to a nearby hospital with nonlife- threatening injuries. he is expected to be treated and released. that is the last of this five- hour standoff coming to an end. a 5-year-old boy stabbed by his mother's boyfriend, is in critical condition at santa clara valley medical center. 29-year-old ser vino perez and his brother took the boy to a remote canyon in monterey county and stabbed him at least 20 times. investigators say the attack followed a fight perez had with

his girlfriend. perez initially reported the boy had been kidnapped. but clearly that's not the case. the brothers are in jail. the elder is charged with attempted murder. 8:55. angry protests continue tonight. the anger over raising the retirement age in france. it would go from 60 to 62 as part of a pension reform plan. and many students are joining labor unions and violent protests outside airports and oil refineries. that's caused major fuel shortages that have closed gas stations and prompted a warning to travelers about delays and disruptions. and lady gaga has postponed two shows in france because of the unrest. her website says she was worried her tour trucks would not be able to get through to the concert hall. the crisis could continue for several days, with a senate vote unlikely until the middle of next week. time now is 8:56. and let's go over to sal one last time. and he's got a report about the
