we'll explain why. there's been more violence on the streets of oakland with three separate shootings in just the last 24 hours. and live pictures as you wake up to one of the coldest days this week. we're tracking temperatures this morning in neighborhoods that dipped in the 30s. a party supply store heavily damaged in an overnight fire. the fire started on east santa clara street in san jose just after 3:00 this morning. you can see the pictures there. it quickly went to two alarms. jade hernandez is out there right now with the latest on how the firefighters were able to save some nearby buildings. >> reporter: good morning, dave. the reason they were able to save nearby businesses is because of the proximity of the fire station to this fire. in fact that proximity allowed firefighters to arrive in about four minutes. you are taking a look at the contents of this party supply store. you can see all of the stuff was smoldering and firefighters had to pull it out. police have actually blocked off the sidewalk. we're live at 26th and santa clara. the fire investigator has determined this was not intentionally set but that won't soften the blow to that owner. there's substantial damage to the business. but firefighters were able to

contain flames to the one business which was next door to the printing business. this is why the person walking by called 911. smoke billowed from the building. after the call, the good samaritan captured and reported these pictures. no one was inside the building when the flames sparked. fortunately there is a fire station very close, about ten blocks away, which meant quick response. firefighters also called for two-alarm backup because they were worried about those flames spreading. >> the fire came in at 3:14 and under those circumstances there's no one really around to see what's going on, to call the fire department and call 911. they did see some slow and some fire coming from the building. firefighters had to pull the contents out of the store because they were still smoldering. those firefighters left about an hour ago.

firefighters contained this fire within ten minutes and they wrapped up here, ace mentioned -- ace mentioned within the -- as i mentioned, within the past hour. this store has been here for quite sometime. it's a party supply store. you can see these the contents of the building inside. fortunately, nobody was hurt and there was no damage to the businesses nearby. jade hernandez, ktvu channel 2 news. >> thank you. police in fairfield right now are searching for four suspects who burst into a house and gunned down one person. now, police were called to a house on hamilton drive about 9:00 last night. they found a man who was shot four times. he died later at a hospital. witnesses told police four men with ski masks on burst into thehouse. one of the suspects shot the victim. we don't know the victim's name and the investigation continues. >> this morning, oakland police are looking for the people

responsible for three separate shootings in less than 24 hours. five people altogether were hurt. one of the shootings happened yesterday moving. the other two late last night. officers say a woman came to the police administration building just before 11:00 last night with a gunshot wound to her stomach. she said she was shot while driving at 52nd avenue and east 12th street. about two hours earlier, police found two men with gunshot wounds near eighth street and mandella parkway. police say their injuries were not life-threatening. and a road rage incident led to the lockdown of a school near east 12th and 2nd. dewey academy is nearby. no one was hurt. but two shooting victims drove themselves to a hospital. no word on their condition or any arrests. 7:08. this is a big day because in just a couple of hours, tesla officially kicks off the

to get back on the campaign trail. she went in the hospital yesterday in southern california. she's being treated for an infection for the reconstruction surgery she had had over the summer for breast cancer. no word when she will get out of the hospital. but her camp says she plans to maintain a full schedule of events. barbara boxer issued a statement, "wishing fiorina a speedy recovery and well wishes to get back to her normal schedule soon." it appears we can expect continued negative attack ads in the governor's race. >> would either of you or both of you be willing to make a pledge that you would end the negativity? system. his navigation failed and he couldn't see because the bad weather. they had to redirect several flights to clear out the airway. the plane landed safely and almost on time. the air force is insisting the public was never in any damager when it lost communication with 50 nuclear weapon the over the weekend. this happened at an -- weapons over the weekend. this happened where the nuclear arsenal is stockpiled. alison burns is live in our washington, d.c. newsroom with all of the detales. >> reporter: good morning. this is such a big deal because it raises critical questions about whether america's nuclear weapons are safe and in working order. now, the air force says an equipment failure, not foul play disrupted communication at the warren air force base center. the break lasted about an hour

city officials in roseville have confirmed fire sprinklers were shut off during a big fire that swept through the westfield galleria mall last week. now an investigation has been launched to tell them who to turn it off. the mall plans to reopen in stages before thanksgiving weekend. 23-year-old alexander pagay is accused of starting that fire. well, bp has agreed to pay

$20 million over the next three years to help out the fishing industry in the gulf of mexico to convince people that their see food is safe to eat. the money will had go to increased seafood inspections and marketing efforts aimed at restoring public confidence in the safety of seafood in the gulf of mexico. new figures show an unexpected jump in home sales this morning. the commerce department just reported that new home sales rose 6.6% in september to $307 -- 307,000 homes that were sold. economists had predicted a weaker 2% to 4% rise in sales. august also saw a slight rise in new home sales but the three months before that were the slowest since 1963? next year you can leave your car at home. that's when the nation's first

ktvu.com. we have some surveillance video to show u. some frightening robbery of a san jose medical marijuana dispensary. the police want your help this morning in threing to identify the -- in trying to identify the suspects. paul chambers joins us live in san jose. >> reporter: good morning. we've moved from the area where the robbery took place. this is a busy stretch of road. this is where the robbery took place in it area. we went to the building. it's a nondescript building. the people probably had to know where they were going. the police need your help finding the two people responsible. this happened last month but look at this surveillance video that police just released. it shows the two brazen men robbing the marijuana dispensary. they forced the two employees on the ground before police say they tied their hands and took their personal belongings. the robbers made off with cash

and marijuana. the victims were not harmed during this incident. now, take a closer look at the two suspects. suspect one on the left is an african-american man believed to be in his late 20s to early 30s. approx which 6'2", probably 220, 230. with a goatee and tattoos it on both arms. he was last seen wearing a baseball cap and black jeans. his race is unknown. he's approximately 5'7", he was last seen wearing a camouflage shirt, jeans and police say the two men left the scene in a four-door honda. this all took place, once again, in this busy stretch of the intersection. police are hoping someone saw what happened. we're live in san jose, i'm paul chambers. ktvu channel 2 news. >> thank you, paul. 7:35. well, one man is dead, another

still in the hospital following a double sheeting in berkeley. the man who died was gary ferguson junior, the son of a well-known antidrug counselor. he was killed yesterday morning before sacramento and russell. ferguson's father was the head of berkeley's sobriety through education and support program. police are not sure what led up to the shooting but they say this was not a random attack. 7:36. prosecutors are seeking prison time for former b.a.r.t. police officer, johannes mehserle. he will be sentenced one week from this friday. he was convicted of involuntary manslaughter and using a gun in the shooting death of oscar grant, in 2009. he faces four years in prison. in court papers, prosecutors argue that he deserves a prison

sentence but did not specify for how long. johannes mehserle's attorney is asking for the gun charge to be thrown out and wants a new trial. rita williams sat down with johannes mehserle inside the county jail. thursday night for the first time you will hear from johannes mehserle himself on the shooting and what he thinks should happen on next week's shooting. our exclusive report airs tomorrow night on the 10:00 news. 7:37. it's been one year since the horrifying gang rape of a 16- year-old girl outside of a homecoming dance outside of richmond high school. tonight, the west contra costa school will meet to discuss the lessons learned. police say the victim was robbed, beaten and raped on a poorly lit part the campus. seven people have been charged. security lights were installed.

villages 7:53. the family of the truck driver would was killed in an accident on the bay bridge s-curve is suing caltrans. the man of hayward died back if november of last year when his big rug went over the side of the s-curve and dropped about 200 feet below on yerba buena island. the lawsuit is seeking monetary damages and it says the s-curve served as a concealed trap that surprised drivers. state officials say he was going too fast and they are defending the design of the s- curve. well, in the meantime, work on the signature tower on the new eastern span of the bay bridge is making progress. the second of four steel columns was lifted into place yesterday. caltrans expects to have all four of the columns of this

truck a bicyclist off camden north of highway 85. the windshield is shattered where the victim struck it. police describe the driver only as latino about 40 to 50 years old. investigators are looking for a white or tan pickup used for carrying scrap metal. witnesses say the license plate is similar to 59 u 771. there's no word yet on the victim's conditions -- condition. we have a crew on the scene and we'll bring you an update. back to you. >> thank you. in other big news, the big game, still less than nine hours away but at&t park did already buzzing. a lot of activity as the giants and rangers get ready for game one of the 2010 world series. kraigcy bro is out there and he says folks and giants are all battling -- are already

this afternoon following a 4:00 edition of the ktvu channel 2 news. the owner of a party supply store heavily damaged in an overnight fire has just arrive at the scene. this fire started on east santa clara street in san jose shortly after 3:00 a.m. it quickly grew to two alarms. >> reporter: firefighters had had a hard time getting ahead of the owner. they weren't able to. but police were. you will hear from had her in a second. she and her husband pulled up here. didn't know what was going on. very emotional. the proximity of the fire station to this fire really allowed firefighters to arrive quickly, within four minutes. that saves nearby businesses. and we're live at 26th and santa clara. the fire investigator has determined that this fire was not intentionally set. but that doesn't really soften the blow for this owner this

morning. there's extensive damage inside. that's one of the reasons why the owner was so upset this morning. the stories, wendy's party supplies, firefighters were able to contain flames to that one business. right next door is a printing base -- printing base -- business, they were able to save that business but wendy's has extensive damage inside. a person walking by the store called 911. you can see this around 3:15, smoke billowed from the building. after that phone call, the good samaritan capture and recorded these pictures. there is a fire station nearby. firefighters called to two- alarm backup because they were really concerned about flames spreading to businesses next door and throughout the strip mall. >> the fire came in around 3:13 this morning. under those circumstances, there's no one really around to 10 what's going on, to call the fire department, to call 911.

in this case, luckily, there was someone walking by that did see some smoke and some fire coming from this building. >> the police call me and say my store on fire and i just ran over. >> reporter: that woman you heard from was the owner. she's had this place wendy's for 19 years. although she did tell me this morning, she does have insurance, it is very little and there is a lot of damage inside. and i think what worried her the most is that firefighters had to pull a lot of the content of the store out to the sidewalk because any were smoldering this morning. they wanted to make sure that they didn't reignite over the last couple of hours.

fairfield police are searching for four suspects who burst into a house and gunned down one person. police were called to a house on hamilton drive around 9:00 last night. they found a man shot four times. he died later at a hospital. witnesses tell police that four men wearing ski masks burst into the house and one of the suspects shot the victim. we don't know the victim's name or the motive for the shooting. 8:07. there is actually a reason -- a reason to celebrate. tesla officially kicked off the opening of its factory in fremont. this factory will be the only auto assembly plant in all of california. it's 8:08. we want to check in again with tara filling in for sal. a new accident near 680?

fiorina is thankful for all of the prayers and is anxious to get back on the campaign trail. she went in the hospital for an infection following her breast reconstructive surgery. her campaign says the candidate plans to maintain a full schedule of events. her opponent in the race, incumbent democratic senator, barbara boxer issued a statement wishing fiorina a speedy recovery and well wishes to return to her normal schedule soon. it appears the negative attack ads will continue between meg whitman and jerry brown in the governor's race. >> would either of you or both of you be willing to make a pledge that the you would end the negativity.

the pilot lost its navigation system. he could not see because of bad weather. air traffic controllers had to redirect several flights. southwest said the plane land safely and almost on time. the air force is downplaying the possible dangers of losing communication with 50 nuclear missiles. this happened over the weekend. alison burns is live in our washington, d.c. newsroom tracking some of the fallout from this. good morning, alison. >> reporter: well, good morning to you, tori. this is a big deal because it raises critical questions about the capabilities and condition of america's nuclear weapons. now, the incident happened at the launch control center at warren air force base in wyoming. a large part of the nuclear arsenal. the icbm missiles are stockpiled there. the air force is reporting that an equipment failure on saturday disrupted communication between the control center and 50 missiles. but officials insist they were still able to monitor and

potentially launch them. i just talked to a military analyst who says the public and u.s. nuclear capabilities were never at risk. >> you want to have a fail-safe system. you want to have redundancy. just at that facility he you had had two squadrons fully functional. we have submarines launching nuclear weapons if they had had to. >> reporter: i talked to a homeland security official and they say this is a wakeup call and in fact a military whittle- blower says there has been -- whistle-blower says there has been miscommunication in the past. a federal lawsuit is claiming negligence led to deaths at the santa clara valley medical center the paper

to cancel the gold's gym affiliation when the contract comes up for renewal in 2012. that's because of a $2 million donation to karl rove's conservative political organization by the owner, robert rallying. that has sparked controversy about whether gay members will be angry about rove's connection. $7 million will install four switching stations for taxis used in san francisco and san jose. that provides a place for heavily used cars to swap a worn-out battery for a freshly charged one. toyota is starting to a -- is starting a recycling business for the nickel used in

24 hours. five people were hurt. one of the shootings happened yesterday morning. the other two late last night. officers say a woman came to the police administration building just before 11:00 last night with a gunshot wound to her stomach. she said she was shot driving at 52nd avenue and east 12th street. about two hoursertier, police found two men with gunshot wounds at 8th and della parkway. police say their injuries are not life-threatening. a road wale rage incident sparked a shooting that led to the lockdown of a school. this shooting happened around 9:20 yesterday morning near east 12th street and 2nd avenue. dewey academy is nearby. no one at the school was hurt. but two shooting victims drove themselves to a hospital. there was no word on their condition or any arrests. 8:34. one man is dead. another one is still in the hospital following a double shooting in berkeley. the man who was killed was gary ferguson junior, the son of a

well-known antidrug counselor. he was shot just before 9:00 yesterday morning near sacramento and russell streets. ferguson's father also named gary was. head of berkeley's sobriety through education and peer support program before it shut down a few years ago. police are not sighing ashe -- are not saying what led up to the shooting but they say it was not random. prosecutors are seeking police -- are seeking prison time for johannes mehserle. he will be sentenced one week from this friday. mess was convicted of involuntary manslaughter and using a gun for the shooting death of b.a.r.t. passenger oscar grant on new year's day, 2009. he faces up to 14 years in prison. in court papers, prosecutors argue that johannes mehserle deserves a prison sentence but did not specifically say for how long. johannes mehserle's defense attorney wants the gun conviction tossed out and is asking for a new trial or

in new home sales after the worst summer in five decades the commerce department reported that new home sales rose 6.6% in september to 307,000 homes sold. economists had predicted a weaker 2% to 4% rise in sales. august also saw a slight rise in home sales but the three months before that, were the slowest since 1963. well, next year you may decide to leave your car at home. that's when the nation's first regional bike sharing program will start right here in the bay area. the metropolitan transportation company is expected to approve most of the funding for that program today. the almost $8 million pilot project will provide 1,000 bikes in san francisco and along the caltrain core re-- corridor. you would pay a membership fee and check out a bike and ride it to any station in this network. >> that might not be a bad option this morning.

game? word's coming in now that a possible tornado has hit north carolina, demolishing three homes and injuring 1 1 people. this is all part of a powerful storm moving east. now, yesterday really severe weather battered the midwest. winds topping 70 miles an hour recorded -- roared through missouri, illinois, indiana, wisconsin and ohio. the national weather service hoose now confirmed. eight tornadoes touched down in indiana yesterday. three of them touched down in ohio. now, wind advisories in chicago are expected to cause a second day of travel headaches in that area. this is what it looked like at o'hare international airport yesterday. planes were grounded. people slept in the airport. thousands of passengers were left stranded. travelers headed to the chicago area today are hoping to -- or hoping to, you better check with the airline first to make

the two-alarm fire that badly damaged the party supply store in san jose early today on east santa clara street is still being investigated. no injuries have been reported. there's no word on what caused the fire but firefighters say it was not intentionally set. and fairfield police say one person was shot and killed overnight after four masked men burst into a home. this happened on hamilton drive about 9:00 last night. so far, no arrests have been

made. it is 8:45. in san jose, a police search continues for two men wanted for armed robberies at two marijuana dispensaries last month. surveillance video shows the suspects robbing a dispensary on monterey road on september 29th. employees were forced to get on the ground and then they were tied up and robbed of their personal property along with cash and marijuana from the dispensary. investigators believe the same two men robbed another san jose dispensary on september 18th. if you have any information, you are asked to call san jose police. well, one of the richest men in the world is giving a million dollars to the campaign to pass proposition 19. that's the measure to legalize the recreational use of marijuana here in california. billionaire finance' george soros says he believes the current marijuana laws are doing more harm than good. soros says police spend a lot of time and resources trying to

enforce the law but it's done nothing to reduce marijuana use. and some bay area storeowners say they look forward to the day they can openly sell marijuana. leslie hennessey says he would offer marijuana at his wine and specialty foods store in san francisco. he says he won't wouldn't want the federal government to allow it first and then get the approval of his neighbors. but after that, he says, he believes the people of san francisco would welcome the chance to go to a store and buy their marijuana instead of from illegal sources. 8:47. we've learned new information on a story we first brought you yesterday. "the new york post" is reporting that actor charlie sheen was with an sebastian pineiro court when police found him naked and drunk inside a trashed hotel room. the paper -- the paper reports that the woman calmed police while locked inside a bathroom. sheen was not arrested but checked himself into a hospital. sheen's ex-wife is making the media rounds to promote her new

book and tv show. and she doesn't want to talk about sheen in order to protect their daughter. well, univision is reportedly seeing an audience boom. some say that network could be on track to do better than the major english language networks. the new census is expected to show a rise in the population of the latino people. that word from your sonser ises you see on tv, it's getting shorter -- sponsors, you see on tv, it's getting shorter. now 15-second ads are becoming more common. they made up about a third of all tv ads last year. that's up more than 770% in the last five year. that means more rapid fire ads for consumers and a way for advertisers to save some money. there's an easy way for parents to keep track of their little ghosts and pirates out trick or treating this weekend. it's a smart phone app called the trick or tracker. it allows parents to program a

eight minutes before 9:00. we've following developing -- developing news out of afghanistan where police say 65 people have been killed in the northern part of that country when a roof collapsed during a wetting celebration. police say the house was overcrowded at the time and the building was made out of mud bricks. most of the dead were women who were celebrating separately from the men on the top floor. twelve children also died. the fbi is now investigating several shootings at military buildings in the washington, d.c. area. the latest happened monday night at a marine corps recruiting station in a northern virginia shopping center. someone fired two shots through

the window of the recruiting station and one through the window of a nail salon next door. the national museum of the marine corps and the pentagon have also been shot at recently. the fbi has determined the same gun was used in bloat of the earlier incidents. 8:53. two english tourists were swept out to sea in carmel by a big wave but only one of them survived. take a look at pictures from a rescue there. angela jewel is at -- is in fair condition in the hospital after being rescued by lifeguards at carmel river state beach. she and her friend, ann, were swept away by a large wave on monday as they stood on the sand. a lifeguard pulled ann out but she later died a the hospital. the eruption of the mount meraipi volcano and the earthquake that triggered a

tsunami on the remote islands in independent -- independent doe knee shaw have rescuers starting to arrive. they increased the number of people killed to 272. rescuers have still not reached the most remote villages after rough seas hampered relief operations, planes and helicopters are delivering medicine and other supplies for the first time today. and rescuers are searching the slopes of the volcano for survivors after an eruption that killed 20 people and left many others with serious burns. among the volcano slopes were though than 11,000 people -- where more than 11,000 people, everything is caked with ash. a series of faultline thats -- faultlines that are prone to that activity. bp will pay $20 million over the next three years to help the gulf fishing industry convince -- to convince people
