good afternoon. we begin this noontime with arizona's immigration law being debated at a san francisco courthouse. the 9th circuit court of appeals covers seven states so. know, this issue brought out a lot of protesters vocally expressing their views. claudine wong has more. >> reporter: good afternoon. the hearing lasted for about an hour. it's over now. protesters filled both sides around me. inside this debate went on before a three-justice panel. several blocks from this church to the 9th circuit court of appeals this morning. once there, they met up with hundreds of others from both sides of this debate. >> i have nothing against immigrants but they should come here legally. they shouldn't be allowed to sneak in here and bring their crime. >> my parents were born here. >> reporter: each justice will hear from each side and decide if arizona's law is constitutional. that law includes a requirement that police while enforcing other laws must check the status of the person they are questioning is in this country legally. >> how long does i.c.e. have to get back? 24 hours? 48 hours? >> no. i think -- i think probable cause is less than 24 hours. and the truth of it is, the experience, you can look at all

of the statements that have been submitted. they usually get an answer back from i.c.e. within 11 minutes. >> if you have reasonable suspicion, if it's practical to do so, if it won't interfere with the investigation, run an immigration check. >> if it says you will pursue immigration in a way you won't pursue any other -- >> reporter: also watching the proceedings was arizona's governor, jan brewer. >> we need more help, more support and the federal government needs to do their job so arizona doesn't have to. [ chanting ] >> reporter: the hearing ended about 10:00 this morning, just about 15 minutes before the hearing ended, protesters spilled out on the streets blocking 7th street for a short time. police stopped traffic and made traffic go around. that street has been cleared

for traffic now and everything is going back to normal. now, a decision in this is not expected for a few weeks. live in san francisco, claudine wong, ktvu channel 2 news. >> thank you, claudine. san francisco police now say a 3-year-old gunshot victim and two other injured adults will all survive a halloween shooting. they say the gunfire happened at 25th and connecticut streets. police say the girl and her 52- year-old grandfather were shot outside their apartment on the way home from a halloween event. they say the child was shot several times and her grandfather was injured trying to shield her. >> the information that we have is the 3-year-old and the 52- year-old were not the targeted victims. they were innocent individuals who happened to be caught in the crossfire. this incident is believed to be

gang-related. >> reporter: the third victim was a 20-year-old man who was shot on dakota street nearby. police are looking for the gunman. they are describing him as a black male between 18 and 25 years old. wearing a black hoodie and dark- colored pants. oakland police are offering a reward for the arrest of a gunman who shot nine people at a halloween party. it happened early yesterday morning at sweet's nightclub where a party dahled the fright fest was being held. a man who was shot in the back is believed to have been the target. police say other victims were hit by stray bullets with their arms and legs, none of the injuries are life-threatening. tomorrow is election day and that means the candidates are feverishly doing some campaigning. meg whit man campaigned in menlo park. she will head south to an appearance in san diego. her opponent, jerry brown, is

campaigning in the south bay with other appearances zelled around the state today -- scheduled around the state today, including san diego, salinas. he plans to get out the vote rally here in san francisco. and barbara boxer plans to follow him and she also has aston? he toluca -- stops planned. she will stop in toluca lake first. and carly fiorina stopped at a senior group and said she -- the race for attorney general, which pits san

a big rig crash in vallejo killed the driver this morning. the chp says the truck was taking an exit from interstate 80 at columbus parkway when it lost control. the big rig hit a dirt embankment and caught fire. that shut down the exit for several hours. it was still closed when we checked just a few minutes ago. san jose fire investigators are looking for the cause of a four-alarm fire this morning. the fire broke out in the 1000

block of north 10th street. it comes after a dozen small fires within a week of that same street. as jade hernandez reports, investigators are looking into any possible links. >> reporter: blankets protected the business owner from the cold, not the reality of what they faced. >> their income, it's not grandparents' source of real income. it's a tragedy right now. i don't even know how to look around it. >> reporter: this man's grandparents bought this building decades ago and opened up the club. recently, they had been renting out the building. but after flames ripped through both businesses overnight,the fire did not leave much behind. several fires grew to a four- alarm fire. >> the fires were to the rear of. building. both -- to the rear of the building. both buildings are destroyed. >> reporter: by sunrise, the investigation had already begun

into the cause. the arson investigator says there's been about a dozen smaller suspicious fires here along north 10th within the past week. >> he doesn't know if this fire is connected to those others. but he says he is looking for a link. the investigator also said the fire started outside either one or both of the buildings, possibly along the train tracks behind the businesses. a business owner across the street point to transients who live near the tracks. >> most transients -- transients live down there. >> reporter: the investigation into the cause of the fire continues this afternoon. in san jose, jade hernandez, ktvu channel 2 news. we're learning new details from formerly jailed uc berkeley graduate sarah shourd about her capture.

it her home, she said the three detoured off a road after a border guard motioned r them to come. we just learned moments ago that the trial has been delayed for shane bauer and josh fattal. both are accused of spying. shourd was released from iran last month due to health concerns after being detained for almost 14 months. the u.s. and some international allies are issuing a mail advisory today about the possibility of bombs, bemailed from oversees. this -- being mailed from overseas. investigators have identified the 28-year-old al qaeda member as the suspect. they believe he's in yemen and is suspected of developing the underwear bomb that a terror suspect wore on a u.s. flight last christmas.

a top counterterrorism official says the u.s. is focused on eliminating the threat. >> we're working very close with the yemeni officials and we will had destroy that organization as well as destroy the rest of al qaeda. >> the packages were bound for a synagogue in chicago but they believe the bombs were supposed to blow up midflight. they say packages with no postage should be screened. meanwhile, the woman arrested for this crime on saturday has been released. officials say someone used her identity in signing the shipping documents for those two packages. today, former u.s. representative gary condit testified in chandra levy's trial. today, they called condit to the stand knowing that the defendant's lawyer may try to

to disband its police force to save money. ac transit riders are having to deal with longer waits since new service cuts took effect. the transit agency implemented the reductions yesterday to almost 70 lanes. some of the big changes include reducing frequency under 28 lines and eliminating service to the orinda b.a.r.t. station. ac transit expectings the cuts -- expects the cuts to save almost $11 million. still ahead -- why police shot and killed annal annal -- an animal.
