6:24 am
6:25 am
6:26 am
we have reports that an amtrack train has been in a collision with a pedestrian and we're not sure exactly what the state of injuries are if the pedestrian was hit full on or sideswiped by a train. but we do have ktvu jade hernandez on the way. this is in richmond very near the border of albany. albany and richmond authorities were on the track there is. they are trying to figure out who's jurisdiction is but they are also giving aid to the person that was hit. we do have a reporter on the way. now let's go back to the desk.
6:27 am
>> thank you. some people that went to the giants world series victory parade never came home. san francisco police report a flurry of missing person reports tied to wednesday's parade. and that atracked an estimated 1 million people. many of those reported missing are troubled teenagers that may have been bat balling -- battling with their parents. cases in oakland are not being examined. crime scene technicians say they need more than $2 million in extra funding to double their staff and keep up with all the cases. one that remains unsolved is the fatal shooting of a 13-year- old boy. he was killed two months ago in east oakland. >> i feel like it shouldn't take this long because they shoot the police and find them in a matter of seconds. they shoot a child a 13-year-

6:31 am

6:32 am
8:30. we do expect security to be tight. we talked to security this morning. they told us johannes mehserle will be arriving in one of the county jail buses. within the last several minutes we shot this video of the buses starting to arrive. there is several coming in and out of here in the last half hour dropping off inmates. we don't know if mehserle is here yet but again that is what security told us this morning. now as far as what he could look at today as far as his fate he could be lookings at probation to 14 years. judge robert perry has several issues in front of him. they are asking for a new trial. second they ask the gun enhancement be dropped. johannes has been convicted of manslaughter. they also found that a gun was used in this crime. the judge could add three or four or ten more years. the defense wantsth gun
6:33 am
enhancement thrown out because johannes was a police officer able to carry his gun. the judge has lot of discretion with how he uses it. >> the judge has a loathes of ways to -- the judge has lots of ways to go. he starts off two or four years for manslaughter. the judge could toss out the gun enhancement entirely or go low leo and say three years but he could make it concurrent with the manslaughter. so in effect the gun enhancement doesn't add anything to the time in prison for mehserle. >> reporter: mehserle will get a chance to speak to the judge today. the family of officer grant will be anal to tell the judge how it impacted them. we also talked to johannes
6:34 am
mehserle. live here in los angeles claudine wong congress. >> before you go i know we talk the about last time. mostly it was peaceful protests. a lot of people that go out and lute the store and do damage. i don't know how they care about the case they are out there as an excuse. we were wondering if police are considering one more reason more people might be out tonight regardless of the sentencing. >> reporter: certainly that is something they are considering. there was a lot of tk when this date was set that it was a friday that people could plan for it. they didn't have to work the next day. and people were worried police officers were worried that would cause more people to come out. the verdict we didn't know if it would come in two hours or two days. it was a little hard to predict. however when we talk to the police chief and talked to other officers that are in charge of monitoring the situation. they have been watching the
6:35 am
energy. and they said the energy level as far as certain kinds of events isn't what it was around the verdict time. they are certainly hoping whatever they decide in court to play a factor. they are certainly hoping that things stay safe. >> thank you. >> congrs cock live in los angeles. back here at home police officers and business owners they are bracing for today's sentencing of johannes mehserle. now as you can see here storm windows are boarded up this morning. some of the owners have posted notices saying they would be closed today. other businesses called kizer are advising their employees work from home. >> last time was ugly. very ugly. our neighbor next door got the
6:36 am
windows busted and everything. hopefully it's not going to happen. >> oakland police say their officers have had additional training since july. they will monitor crowds at a distance. a peaceful attribute for oscar grant is scheduled at 2:00 this afternoon right in front of city hall. that will be followed for a speakout at the park. as we mentioned, the sentencing hearing for mehserle starts at 8:30 this morning. the judge is not allowing any cameras inside the courtroom. ktvu news room will provide the moment we get the word. you can also follow developments by going to our channel 2 website ktvu.com. oakland police are trying to figure out what caused a driver to plow into a home. that happened at 2:00 a.m.. police say the driver fled the
6:37 am
scene after somebodying into the garage. we're also learning about the innocent victim of that deadly crash in oakland we told you about yesterday morning. investigators say the driver of a car fleeing from the chp hit and killed mark aragon. police say the 32-year-old man was headed to one of his two jobs that he works to support his wife and three stepdaughters. his family is devastated. >> it's hard. every day that's their dad. that's their dad. that's their friend. he's a friend to everyone. >> the driver of the car fleeing from chp also died in the crash. authorities identified him as 18-year-old from oakland. the officer was justified in chasing the speeding car.
6:38 am
let's go live to washington, d.c.. president obama is speaking live talking about the economy. >> based on ideas of both parties and the private sector i am open to any idea any proposal any way we can get the economy growing faster so people who need work can find it faster. this includes tax breaks for small businesses like deferring taxes on new equipment so they got an incentive to expand and hire and make it cheaper for entrepreneurs to start companies. this includes building new infrastructure. it includes creating incentives like the clean energy economy. it includes keeping tax rates low for many low class families.
6:39 am
extending unemployment benefits for those that are hardest hit. it's also absolutely clear that one of the keys to creating jobs is to open markets. to american goods made by american workers. our prosperity depends not just on consuming things, but also on being the maker of things. in fact, for every $1 billion we increase in exports, thousands of jobs are supported here at home. that's why i set a goal of doubling america's exports over the next five years. and that is why on the trip i'm going to take i'm going to be talking about opening up additional markets in places like india so american businesses can sale more products abroad in order to create more jobs here at home. this is a reminder as well the most important competition we face in this new century will not be between democrats and republicans. it's the competition with countries around the world to
6:40 am
lead the global economy. our success and failure will depend on whether we can come together as nation. our future depends on putting politics aside to solve problems to worry about the next generation instead of the next election. we cannot spend the next two years mired in gridlock. other countries like china are not standing still so we can't standstill either. we have to move forward. i'm confident if we can do that if we can work together than this country will not only recover but prosper. i'm looking very much forward to helping pry markets open. help american businesses and put people back to work. >> we were just listening to president obama talking about jobs. of course that is after we received that monthly employment report this morning. a little better than expected. during the election day most of
6:41 am
the candidates running talking about jobs and creating jobs. hopefully we will see that happen. >> the president leaves today to go overseas. he will try to pry open the market overseas to try to create more businesses and jobs here. we'll have more details on that. sal is here. what has been going on with that amtrack train? one thing we know for sure on the borderline of albany and richmond on cleveland avenue we do have an amtrack collision with a pedestrian. that is right near the border of richmond and albany. the city of albany and richmond is there. we do know that amtrak services have been stopped by the quarterly line because of a train that hit a pedestrian 45 minutes ago flow. train service has been stopped and this is going to mean big delays for amtrak services down to oakland and the rest of the
