we have team coverage of the preparations under way in anticipation of the judge's decision. ktvu's tara moriarty is downtown where police are getting ready in los angeles. but we begin with the update on what is happening there. good morning, claudine. >> reporter: good morning. yes, it appears there will likely be four members of the family of officer grant speaking at the hearing this morning. it also appears that yohanes mes leer -- yohanes messerly himself will be making a statement. he could get up to 14 years in jail. really, anything in between. now, in the past week, ktvu han grant about the sentencing. and here's what the grant family said about what they will say to the judge. >> i will tell him how i have

to watch my sister cry. how i have to watch her health deteriorate. you know, how, when i have to explain to somebody about my nephew being shot, you know, the lies that people say that -- about it. i have to explain to them, well, this is not how it happened. this is how it happened. >> it's no satisfaction to be found in that courtroom. but what i don't want the courtroom is to just say, oh, go home. i want the courts courts to do what they are supposed to do. and do the law -- abide by the laws that have been put in place. you know, there will never be any satisfaction. he could get 100 years and i still will not have oscar here with me. >> since the verdict in july,

mehserle has been behind bars. we talked exclusively with him about what he thought he should get for the conviction. he said he was surprised when the verdict was announced and said this about his sentencing. >> do you think you should go to prison at all? >> no. it was an accident. i didn't intend to shoot mr. grant. >> but you were found guilty of involuntary manslaughter and use of a gun. >> uh-huh. i understand. it's just sometimes, you know i'm not -- i'm not sure that -- you know, why those decisions were made. but like i said, i'm going to i know i'm going to keep fighting it. i'm not going to give up. because i know what's right. and i know it's for the right reasons. >> reporter: a judge has a few

things to consider this morning when this gets under way. the defense is also asking that a gun enhancement be dropped from the charges. that would add more time possibly to yohanes messerly's sentence. we talked to a legal expert about what he expects to happen with those issues and with the sentencing. and we'll have more on that coming up at 7:30. all right, claudine, thank you. time now, 7:03. it will certainly not be business as usual today in downtown oakland, as business owners brace themselves for the mehserle sentencing. ktvu's tara moriarty joins us live. >> reporter: reaction is mixed. some businesses are boarding up like this one. but others are not. you can see an artist was busy painting this mural of oscar grant holding his daughter. the sentencing is expected to take place in just two hours.

and no one knows just how high emotions will run. >> reporter: plenty of hammering and drilling could be heard yesterday, as crews nailed plywood to store fronts. merchants want to prevent any damage, similar to what happened back in january 2009, just days after grant's killing. then again in july, when the verdict in the mehserle trial game down. they smashed windows, stole merchandise. damage ran into the thousands. now, a nonviolent demonstration is set for 2:00 this afternoon in front of city hall and a rally at 4:00. >> people are going to need an outlet. our guess is the sentence is going to be as unjust as the verdict was. so we are going to be angry. particularly we want to give young folks of color, if they choose, someplace else to go. >> it happens to coincide with

two other main events. an art gallery and a sold-out at fox theater. some are closing early. others are shutting down for the entire day. back here live, you can see a picture here of a memo that was actually sent out to kaiser permanente employees, encouraging them to telecommute to work from home. but the city's standpoint is that business should continue as usual. we're live in oakland, tara moriarty, ktvu news. >> there are no cameras allowed inside for the sentencing this morning. but our news crew in los angeles will give us live coverage of the judgment as soon as we get the word. you can also follow developments at our website, ktvu.com. two men ran away this morning, after plowing their car into a home. it happened around 2:00 a.m., near almanca and capistrano. you can see the car smash into the garage. the owner of the home was in the house at the time but she

was not hurt. police are still investigating what caused the crash. a bicyclist hit and killed by a big rig in san mateo county has been identified. the california highway patrol says 47-year-old lauren ward was riding on alpine road near interstate 280 when she was hit, just after 3:30 yesterday afternoon. the chp says the driver stopped right away and did not show any sign of impairment. they believe the driver just didn't see ward as she was riding alongside his rig. cyclists say the area can be very dangerous. >> right in this section here, there's no -- i mean, if you look out here, where should a cyclist go? it's really kind of up in the air, unfortunately. >> the chp is still looking for witnesses to come forward. all right, time now. 7:07. sal is busy. he's watching the drivers. but also what is happening with amtrak. >> that's right. the amtrak train has stopped in richmond here.

ktvu's jade hernandez' crew has this picture up for us. i want to let you know, the train reportedly hit a pedestrian here in albany, in the 600 block of cleveland avenue. you can see that there are some people. this is a live picture. these are people who are still basically sitting on this train as the investigation goes on. you can see some people are just basicay working. maybe they have their laptops open. because they're not going anywhere for a little bit. again, ktvu's jade hernandez is gathering people from the scene. but again, this is affecting amtrak's capital corridor service in and out of the bay area from sacramento. a lot of people do use that service. and right now, trains are not getting through. let's geto the toll plaza now. westbound bay bridge backed up for about a 15-minute wait getting into san francisco. northbound 280, that traffic is also slowing down, getting up to highway 718. it's 7:08. >> and for those of you, you

hear me but don't always watch. there you go. there's your day. high clouds. fog back to the coast. it will be cooler there. if you live by the coast, live in the city, work in the city, you'll go from really mild, muggy conditions last night. we had record highs. i'll show you some. there's a cold front, actually a low -- all right. it's off the screen. i'll show it to you in a second. yesterday, 85, gilroy. record high. san jose, 85. if you're in the san jose and thought, it's warm. well, it was. richmond, 81. oakland airport, 81. look at southern california, though, yesterday. little san diego was 100 degrees. ucla, 97. l.a. downtown. and l.a.x. both 96. and santa maria, 93 degrees. most of the records that they beat were from 1976. including ours, which was an extremely dry year for us, one of the driest ever for rainfall. high rain clouds will continue to work their way in. the low is right there. this will continue our cooling trend for saturday.

it's heading more towards central and southern california for us. the system behind that for sunday is taking aim at us. and that will bring us some rain. until then, we see temperatures on the coast. 60s and 70s and out of those 80s yesterday. and the record highs. 50s right now. 54, san francisco. this time yesterday, they were 62. that's a pretty good drop. 30s in the mountains. 52, sacramento and uky a. clouds -- ukiah. clouds keeping warmer. l.a. to san diego and palm springs. they will cool down, but probably not until saturday. stronger system to the left of the screen, coming out of the gulf of alaska. that's our rain sunday. fog returns. cooler by the coast. high clouds. still kind of muggy outside. you'll notice humidity, with upper 70s, kind of hazy skies. cooler on saturday. we cloud up and set your clocks back. and a cool, breezy day on monday. torei and -- tori and dave.

we're following breaking news from the richmond-albany border. ktvu's jade hernandez is live at the scene. she joins us live now to tell us what is going on now. good morning, jade. >> reporter: good morning. i can tell you right now.

we have confirmed with police, this is a fatality accident, involving an amtrak train and a person. this train is stopped here. we have been told that accident happened about a quarter mile down the tracks. at 600 block of cleveland. now, albany and richmond police both responded. albany police taking the lead on this. we are live in albany, just off the buchanan exit. we're told this affects amtrak's capital corridor service, coming from sacramento. we noticed that the train has stopped. but we don't know for how long. we know that the passengers have been sitting and waiting patiently inside. when we arrived, police were surveying the tracks inside. it's still pretty dark. this is a fatality accident, involving a person and a train. i called albany police just moments before this live report, and they referred us to union pacific. in a few minutes, hopefully i'll get more information information and pass that along to you. right now, we are in front of

an amtrak train involved in a fatality collision. reporting live, jade hernandez. more breaking news now. we are just getting word from local television stations reporting that a qantas jetliner has returned to singapore with an engine problem. shortly after takeoff. this is flight qf6. it turned back after a problem with engine 1. they gave no other details. you may recall, if this sounds familiar, just yesterday, a qantas airbus a380 super jumbo made an emergency landing in singapore, after one of its four engines suffered a blowout. it was taking a flight to amsterdam with over 450 people on board, and that prompted the grounding by qantas of all the a380s. that does not affect san francisco. there are no a380s flying in and out of sfo. but again, another problem with an engine on a qantas plane. and no one was injured. the flight did return safely to singapore.

a we get more information, we'll bring it to you. time now, 7:15. and new this morning, the highly-anticipated monthly unemployment report came out in the last hour. let's go to alison burns in our washington, d.c. newsroom with president obama's response. good morning, allison. >> reporter: good morning to you, dave. president obama is using this latest labor department report to reach out to the newly- elected republican congress saying he is open to any new idea to turn things around and boost job growth. for the third straight month, the unemployment rate is holding steady at 9.6%. employers added about 151,000 jobs, the most in five months. at the white house last hour, president obama touted the increase in hiring. but as he heads on his asia trip, he says he wants to do more to create jobs and open overseas markets to u.s. products. >> an encouraging jobs report doesn't make a difference if

you're still one of the millions of people who are looking for work. and i won't be satisfied until everybody who is looking for a job can find one. >> reporter: as for who is hiring, healthcare, retail, food services, employment is up. manufacturing and government hiring has stayed about the same with a little bit of a dropoff in local government hiring. reporting live from washington, d.c., alison burns, ktvu channel 2 news. i want to show you something that happened about 10 minutes ago. i want to show you president obama. he was boarding air force -- here he is right there. about 10 minutes ago. boarding air force one. he was followed by first lady michelle obama. they're beginning a 10-day trip to india, indonesia, south korea and japan. the president says a major goal of this trip is to open up business -- there's the first lady right there, walking up the steps with him. it is a major part of this trip to open up business

opportunities for american companies in asia. now, at the president's first stop in mumbai, india, he will stay at the taj mahal pal as hotel. you remember that name. it was attacked by terrorists two years ago. very secure now. some officials are not happy that the president will be spending three days in india. but he will not be stopping in pakistan. it is 7:17 this morning. toyota announced its second quarter profits are four times higher than they were a year ago. the world's biggest automaker reported quarterly profits of $1.2 billion. that's despite being hurt by strong yen, compared to other currencies, and lingering worries from the massive recall of toyota earlier this year. keep an eye -- the stock of tesla. the palo alto based company gained yesterday. the gain came after panasonic's announcement that it is

investing $30 million into tesla. right now, stocks are down about 2 1/2%. earlier this year, toyota also put $50 million into the tesla company. time now, 7:18. consumer advocates worry that pg&e may pass on the cost for the san bruno gasline explosion to their customers. the pg&e filed regulatory papers this week. they said the cost could top $1 billion. that includes up to $450 million to install automatic shutoff valves on the gas pipes and $150 million more for pipeline inspections. it also includes as much as $400 million in liability expenses for deaths, injuries, as well as property damage. meantime, pg&e's liability is growing. there's yet another lawsuit filed this week. 18 families, representing 52 individuals, are included in this particular lawsuit. it says that pg&e failed to

take corrective and life-saving action to prevent the blast. and it is seeking unspecified damages. at least 30 families are now suing pg&e. some of them filed just days after that blast on september 9th. eight people were killed. 37 homes were destroyed. 7:19. 75 san francisco ballots that disappeared on election day were found. floating in the pond, at the palace of fine arts. the poll worker accused of taking the ballots is due in court today. 50-year-old carl nicholas faces three felony charges. but there's still no motive in the case. elections officials say it's still not clear whether the ballots will be counted. they were in a plastic bag. but they still got wet. this afternoon, we'll get an update on the status of the oakland mayor's race. the alameda registrar of voters will release the preliminary results of the ranked choice ratings at 4:00. in the first round of voting, don peratta took the lead with

35% of the vote. followed by jean quan and kaplan. oops but a -- but a winner cannot be declared until someone gets at least 50% of the votes. so they will release the new ratings, based on the second choice. scientists fear an after effect of the bp oil spill. they're still called blue jeans. but levis says it is creating a new brand that it says will be greener. good morning. it is a little slow in the south bay -- pardon me right now. traffic is going to be slow in some other areas as well. we'll run it down and have a complete traffic update minutes ahead.

we're now hearing about an oil spill. federal scientists say they found dead and dying coral near

the side of the blownout bp oil well, that spilled millions of barrels of oil into the gulf of mexico. the scientists say this photo shows a colony of dying coral, seven miles southwest of the oil head -- at the well head rather. and 4600 feet at the surface. they say they still need to run tests on the coral to determine exactly what caused it. a sunken tugboat leaked oil. this is a photo by the u.s. coast guard. they placed boons around the oil after receiving reports of the spill on the southeastern shore of winter island. it's unclear how much oil was spilled. but state game officials say so far, it appears no wildlife has been affected. levi straus is rolling out a new brand of jeans that it says will be greener. they say the average pair of jeans uses 42 liters of water to obtain what most people

consider a good finish. that's the same as running a hose for an hour and 46 minutes. now, levi says it will use a different process that uses much less water. the line called "waterless" will be available after the first of the year. it is 7:24. we want to check in once again with sal and more breaking news. >> concord bay point. highway 4. i want to show you this right away. highway 4, there was a car fire on the side of the road. you can still see a little smoke coming from it. chp had temporarily stopped all traffic. this was at the bay point side of willow pass. you know, there are two willow pass road exits on highway 4. so if you're a highway 4 driver, please give yourself extra time. you'll see the fire crew. this car was blazing away. in fact, you can still kind of see some of that smoke. and i think some of the nearby brush caught on fire. so give yourself more time. you'll need it. let's move along and take a look at westbound bay bridge. 16 -- did i say 16?

15- to 20-minute delay, before you actually make it onto the bridge. and this morning, if you're driving on the peninsula, southbound 101. northbound 101 looking good. it's been pretty quiet there. if you're heading down to the north bay, it is pretty slow getting up to highway 17. happy friday. coast and bayside in the form of fog. the city last couple of days. there it is, speaking of. going from 78, the last couple of days in downtown san francisco. i went 65 today. you'll notice a pretty dramatic drop. a lot of the higher clouds inland will keep some humidity in the mix. so still warm. not as warm as yesterday. we had record highs. and the cooling pattern will take us into saturday. and looks like rain sunday. tm today, temperatures still above average. except san francisco. oakland airport, 72. that fog continues to increase. i may drop that a little bit. santa rosa, 70s. mountain view, 76. san jose, 77. not near records, but they are

above average. 50s right now. had a let of 60s the last couple of days, due to these clouds and very warm conditions. 30s in the mountains. it will not be as hot in southern california. l.a. was hot yesterday. san diego was 100 degrees. just incredible heat. low spinning is diving toward central california. but that will continue to usher in cooler weather for us as we head to saturday. and sunday, that system coming out of the gulf of alaska brings rain. 60s, or low 70s. inland, those high clouds still mean upper 70s. we have a cooling trend on tap. rain, along with setting your clocks back for sunday. cool, breezy, blustery day monday. >> time now, 7:27. we're following breaking news this morning. an amtrak train, struck and killed a pedestrian in the east bay. you're looking at a live picture of where it happened. you can actually see some of the investigators on the track. ktvu's jade hernandez is out there. she's getting all of the new information and will have a

live update. a well-known san francisco woman, found dead in her home. this morning, we're learning more about her last hours alive. also, the sentencing hearing. a of -- of former bart police officer johannes mehserle. we'll have details.

well, good morning to you. time now, 7:30. the sentencing hearing for bart officer yohanes mess johannes mehserle will cart? just one hour. ktvu's claudine wong is joining us with all of the details. good morning, claudine. >> reporter: good morning. yeah, things are getting busy year -- busier here. we're on the corner here, just near where johannes mehserle will be headed into courted this it'd courted this -- into the court. there are a couple of issues for the judge to decide today. it is highly unlikely this judge will grant a new trial, which is something the defense is asking for. and analysts say it's very likely we'll move very quickly to the issue of sentencing. when it comes to sentencing. here are the options facing

this judge this morning. johannes mehserle has been convicted of involuntary manslaughter for the killing of officer grant. that carries a sentence of 2, 3, or 4 years. but this jury also found that a gun was used in this crime, which means a judge could add three or four or 10 more years to the sentence. the defense wants that gun enhancement thrown out. because they say mehserle was a police officer who is allowed to carry a gun. and because the defense says mehserle thought he had his taser and not his gun when fired that deadly shot. mehserle could be looking at anything from probation to 14 years in jail. >> the judge has several ways to go in that manslaughter has two, three, or four years. separately, the gun charge brings 10 years. the jkd say i want -- could say, i want him to run four

years for manslaughter, and four years for the gun. they could run consecutively or concurrently. he could be out sooner than that because in california you don't have to serve your full amount of time. >> reporter: the family of officer grant will also have the chance to tell the judge how grant's deh has affected them. we have talked to a couple of parents of grant's friends. say they some of them want to make a statement to the judge. although it's unclear yet if they will also be able to do that. this hearing starts at 8:00 this morning. what -- 8:30 this morning. i'm going to hethe courthouse. seats are very limited. at 8:00, they'll also have a lottery to give away any public seats. keep in mind, we haven't been able to show you the inside of the courtroom throughout this proceeding because they blocked cameras. they've done that again today. seats is very limited inside this courtroom, this is a very old courthouse.

encouraged to plan an alternative commute, just in case. for more information, go to ktvu.com and look for the web links section. 7:34. and we're following breaking news from albany. an amtrak train hit and killed a pedestrian ts morning. ktvu's jade hernandez is live on the scene now with an update on what is going on with the investigation there. good morning, jade. >> good morning, tori. we're learning a lot more about this accident that happened earlier this morning. this is the amtrak train involved. amtrak aoperations just arrived he told us he is assessing the situation right now. we're hearing that this accident involved two young men walking along this track. police have confirmed, one person has died. the other is talking with police this morning. and this accident again involves an amtrak train and a young man on the tracks. and we arrived. police had their flashlights

out. we're checking the train tracks. the collision happened about a quarter of a mile away. you can see near the 600 block of cleveland here in albany. you can see this is affecting amtrak service this morning. it's affecting the capital corridor service, coming from sacramento. we don't know how long passengers will have to wait here. as for details about this accident. the train normally goes to speeds of 70 miles per hour. we don't know at this point if the conductor had time to brake before the collision. but again, one person has died in this accident. as soon as we get more information, we'll pass that along to you. reporting live in albany, jade hernandez, ktvu channel 2 news. time is now 7:36. early this morning, in pittsburgh, firefighters battled a warehouse fire. it was on leslie drive, near railroad avenue, started about 2:00 a.m. the warehouse has been empty for sometime. no injuries have been reported. the cause of the fire, still not known. in brentwood overnight.

this fire destroyed a family's home. now, it started about 12:30 this morning on lone tree way. an elderly woman and her daughter were sound asleep when one of their barking dogs woke them up, probably saved their lives. they got out safely. however, another dog in the home passed away in that fire. the house is a total loss. the cause of the fire is under investigation. 7:36 this morning. san francisco police will update their investigation into the death of a russian hill woman. 46-year-old kate horn was found -- horan was found has inside her apartment. officers say they received a call to check on her well being. according to the san francisco examiner, she had just returned from a trip to argentina, a few hours before she was killed. she was a fashion buyer and publicist for several san francisco companies. her family says she was also involved in several charities. >> she was a person who didn't

simply speak of causes, but always anxious to get involved with civic functions. >> police say violence in this neighborhood is very rare. visitors to the 36-unit apartment building need to be buzzed in through a call box. our time is now 7:37. let's go back to sal. a lot has been going on in our commute this morning. what are we looking at now. >> starting dave and tori, in contra costa county. checking up on the car fire that blocked the freeway for a little bit. looks like the car fire is completely out now. but people are slowing as they always will do. even though right past the scene, the traffic by that point is evened out. getting up to the accident scene is a different matter entirely. it's pretty slow, coming out of antioch and heading to that area. and people are -- because they can see it. that's all. and traffic is going to be busy. let's move along and take a look at the commute here, as you drive on westbound bay bridge. the traffic is backed up for about a 20-minute delay. and this morning, if you

are driving out of the livermore valley, not too bad. westbound 580 looks good through pleasanton. if you're driving on the peninsula, 101 is also looking good through the airport. 7:38. let's go to steve. >> sal, thank you. good morning. happy friday, everybody. you know, november -- usually, you're not talking about 80- degree temperatures and warm, muggy nights. but that's what we've had. everything is changing, though. the fog is increasing. and it will rain sunday. saturday will continue the cooling trend. looks like it starts in the north bay in the morning. and pretty good rain even make its to the south bay by the evening hours. if you haven't noticed already, south bay hasn't had much rain this season. north bay has had a lot. complete reversal. higher clouds will completely drift over the area in the next, oh, i'd say, six to 10 hours. they're getting bumped along by an upstream low, which is on its way. yesterday, though, those warm and muggy record highs. gilroy at 85. san jose, 85. for november, that's hot. that's hot. 82 in mountain view. richmond, 81.

and the oakland airport, 81 degrees. look at these. these are just a few down in southern california. san diego, 100. ucla, 97. l.a. and l.a.x., both checked in at 96. there were a bunch of others. santa maria was one i put in as well. usually, you don't see 93 any time of year. but they also set a record high. a lot of higher clouds getting helped along by this guy right here. this is going to go into central and southern california. but it will continue the onshore wind and take that fog and start ramping it up over the next 24 hours. temperatures, which were way above average yesterday, they should be around 65 to 68. we're in the low and mid-80s. including napa. and 83 yesterday. 75 today. 65 in san francisco. down 13. walnut creek. still warm to kind of warm, with 70-degree temperatures due to higher clouds. they'll cool down tomorrow. 68 in oakland. and the fog is back. 54 in san francisco. there were 62 at this time

yesterday. so therein lies the problem. the fog is pretty thick. palo alto, 52. 30s in the mountains. 50s and 60s, down in southern california. one more day of rather toasty conditions in southern cal. but they'll cool down saturday, as a system right there, this low, heads down toward them. that will cool them. our rain on sundays. it's looking better and better, as we get closer to it. fog returns. cooler, coast in the bay. if you live inland. you work in the city. you'll notice a big difference in the temperatures today. cooler coast. 60s there. maybe even upper 50s. 60s, 70s, around the bay. and over the hills and not too far away, we'll still find warm, muggy conditions. set your clocks back sunday morning. and rains and wind picks up sunday as well. and a cool, breezy day monday, tori. >> thank you, steve. it's 19 minutes before 8:00. hurricane tomas is flooding a haitian town that is already in ruins from january's earthquake.

the national hurricane center is predicting dangerous storm surges along the coast and possible flash floods and mudslides in the mountains. many of the 1.3 million haitians made homeless by the january quake have no place to go. the death toll has now topped 120 after the latest eruption of indonesia's mount merapi volcano. soldiers joined rescue operations overnight. the volcano has been erupting for more than a week now. police in vallejo not only want to know who is knocking down and robbing elderly women. they also want to know why the suspects have chosen those victims. it attracted an estimated 1 million people. but the giants' victory parade also created an unexpected problem for san francisco police. world series champion brian wilson is getting the betty white treatment from fans on facebook. ah, focus group. so what are we testing here?

taking a live look at the big board on wall street. despite the best jobs report in five months coming out this morning, the five-day rally that has taken place on wall street appears to be petering out. it is certainly not helping things now with the jobs report. and microsoft and travelers dragging down the dow. it was in negative territory for a while. but it's in the black at moment. nasdaq up 1. s&p up 4 1/2. 7:45. thousands of california prisoners will be moving out of state. some 5,000 inmates will be sent to private prisons, under a new

contract signed yesterday. many will go to michigan at a cost of $60 million a year. there's no specific word on how much money this will save california. in the past four years, almost 10,000 california prisons have been sent out of state to reduce crowding and control costs. time now, 7:45. vallejo police are busy investigating a troubling series of attacks on elderly women and teenage girls may be the attackers. ktvu's kraig debro joining us live from vallejo. and kraig, i know one of those attackers was caught on camera. >> yeah, it was caught on camera. you gotta see that in just a second. we are waiting for a lieutenant to come out here and speak with us. what we want to find out if there have been any attacks overnight. or perhaps any arrests. these four robberies have taken place in the past two weeks. police believe three teenage girls are responsible for all of them. and they're being held by a fourth person who drives a getaway car. one of the crimes was caught on

videotape. this might not be the worst of the crimes, but seeing a helpless woman attacked by three young people and robbed of her purse is hard to watch. they push the woman, she falls to the ground, and they take her purse and run off. police say three females exited a dark gray, four-door car, and grabbed the purse of a 51-year- old vallejo woman. when the victim struggled to keep her purse, the three girls punched her five to six times for leaving the scene and the car without the purse. >> i have to tell you, it's highly unusual. i haven't heard of this happening before, at least in our city, that you have young teenagers, female teenagers, that were attacking senior citizens and even young girls. this is an unusual event. >> reporter: suspects in all four of the incidents are described as black females. they're juveniles between 17 and 19. the first victim told police

they were about 5'2" to about 5 feet tall. and at least in one of these crimes, one of the girls was seen leaving in a mid-1980s volvo with damage on the side. that is being described as being driven by a black male. three of the victims were elderly women. and the fourth was a 14-year- old girl. we'll have more information overnight and if anybody has been caught. reporting live in vallejo, kraig debro, ktvu news. some of the people who went to the giants world series victory parade never came back home. san francisco police reporting several missing persons report connected to wednesday's parade, which, as you know, attracted about a million people. may be of those reported missing happened to be troubled teenagers who may well have been battling with their parents or their guardians.

it is 7:48. we're following breaking news out of cleveland right now. a nasa research center, located next to cleveland's airport is under lockdown. amid reports of a possible gunman. police are withholding details on how they're handling the situation. an airport spokeswoman says its operations are unaffected. this research center has more than 3400 employees. and contract workers that recently develop key components of a new moon rocket. and once again, an airport spokeswoman says operations are unaffected there. but once again, a gunman reported at the nasa research center in cleveland, ohio. and we'll continue to follow this story and bring you new updates as they become available. time now, 7:49. the head of 7-eleven stores offering to send a slurpee to the white house. after this exchange between a

welcome back. we are now hearing nobody survived a plane crash in cuba. this killed all 68 people on board. no americans were among the passengers. this cuban airliner was traveling to the capital city of havana, when the pilot declared an emergency. then the plane went down and crashed, bursting into flames in a mountainous region. there's yet another delay in the launch of the space shuttle discovery. now, at 5:30 this morning, engineers found a fuel leak that forced the cancellation of the launch scheduled for this afternoon. this is the fifth time there's been a problem getting discovery off the ground. nasa says the earliest liftoff now would be sunday. if the mission can't be launched by monday, the mission will be postponed until early next month. discovery is scheduled to take supplies and a new robo naught to the space station.

some economists say there is a new sign from the auto dealerships that the economy may be picking up. the number of trucks, minivans and suvs last month sold were higher than the number of cars. they outpaced cars by a 54-46% margin. and that's the widest gap in five years. economists say it is an indication that businesses are investing and people are willing to pay more for their vehicles and are not worried about higher gas prices. tesla wants to be in on that trend. they hope to have an suv called the model x in about four years. it would use the same technology as the model s sedan. but would have a slightly modified battery pack. ceo elan musk says it would also use some models. time now, 7:54. san francisco giants pitcher brian wilson is everywhere these days, like betty white.

the tension is rising outside the courthouse in los angeles. the sentencing of johannes mehserle begins in just 30 minutes. just got new information from ktvu's claudine wong who is inside the courthouse. a pedestrian is hit and killed by an amtrak train. this is a live picture, folks. we'll have an update on this situation coming up in a live report. well, for november, very warm, muggy, and record heat continued yesterday. but today, everything is changing. the fog is back. how will that play into the weekend forecast?

second hour on "mornings on 2 ." good morning. william come back to "mornings on 2 ." i'm tory campbell. >> -- tori campbell. >> and i'm dave clark. the hearing -- sentencing hearing for former bart officer, yohanes mehserle -- johannes mehserle will begin shortly. you're looking at a live picture outside will take place. judge has a lot ofly way -- of leeway. he could sentence him to 14 years in prison. or release him to time already served. legal experts expect something in between. i'd be very surprised if the judge goes to either extreme to give probation or to

give the full 14 years. i think would be pretty shocking. i think most people are betting that he'll come up with some sort of a middle ground, something around four years in prison. ktvu's claudine wong is inside the courthouse. just called us from inside. no cameras are aloud -- allowed. she told us that mehserle has arrived, along with the prosecution team. the family of grant has also arrived at the courthouse. we're going to hear from claudine, live later in this hour. it will not be business as usual today, in downtown oakland, as business owners brace for any reaction, after any sentencing is announced. ktvu's tara moriarty joins us live with that part of the story. >> reporter: the city's official stance is that businesses should stay open. but some are closing early. some are closing altogether. others, like this one, are taking preventive measures.

>> reporter: several downtown merchants spent the day yesterday, boarding up their store fronts. the wounds still fresh from unrest in the wake of the mehserle verdict in july. and then protest in january of 2009. you'll remember troublemakers splintered off from peaceful demonstrations, causing thousands of dollars in damage. by smashing windows, setting fire and looting. last time was ugly. very ugly. our neighbor next door got the windows busted and everything. so hopefully it's not going to happen. but we're still worried. >> reporter: oakland police say they are prepared for any potential unrest. more officers will be out on the streets. they will call on outside agencies for help if needed, and they will also be monitoring the crowds from a distance. >> if they get too dysfunctional or start breaking the law to the point where it's problematic for businesses, then we'll come in and address

them. >> reporter: the city did send out letters to alert businesses about today's sentencing. there are two other events going on. an art gallery walk. and a soldout concert at the theater. police say they will send out updates using twitter and the city's website. bart is also taking steps to alert riders, in case service is interrupted by protests related to the mehserle sentencing. there will be a rally at 4:00. and again, as we mentioned, in less than half an hour, that sentence for mehserle is supposed to come down. we're live in san francisco, tara moriarty. the judge is not allowing cameras in the room. but our ktvu news crew is in los angeles and will provide live coverage of the judge's decision, the moment we get word, we will bring it to you live on the air. you can also follow developments by going to our channel 2 website, ktvu.com.

time now, 8:04. we're still following breaking news for you out of albany this morning. a pedestrian, hit and killed by an amtrak train. ktvu's jade hernandez has been out there all day. what's the very latest, jade? >> an amtrak spokesman told me there are about 53 passengers on this amtrak train that was involved in this collision. no one on board was hurt. these passengers were coming from sacramento. and they've already boarded another train and are headed onto their destination. we're being told that this collision involved two young men, walking along train tracks. now, the train collided with one of the men and killed him. we don't know if this train, which usually runs at speeds around 70 miles per hour, had time to break or not. the amtrak spokesperson did call the young men trespassers, since they were on the train tracks when they were not supposed to be. this second train, you can see it here, pulled up about 20 minutes ago, to take passengers

onto their final destination. the train left about five minutes ago. amtrak's assistant superintendent of road operations is still out here this morning. he could not go on camera and talk to us about the collision. but he was assessing the situation. and we still don't know how long the track here will be closed due to the investigation. but we do know that this collision involved an amtrak train this morning and a young man. that young man did not survive the accident. and of course, all of this is still under investigation this morning. reporting live from albany, jade hernandez, ktvu channel 2 news. time now, 8:06. a wild scene at oakland earlier today. oakland police say two men ran away early this morning, after plowing their car right into a house. it happened about 2:00 a.m., near almanza, and capistrano. look at these pictures. the car smashed into the garage. the owner of the house was at home at the time, but she was not hurt. the police investigation in this continues.

8:06. a bicyclist hit and killed by a big rig in san mateo county has been identified. the california highway patrol says 47-year-old lauren ward was riding on alpine road near interstate 280, when she was hit just after 3:30 yesterday afternoon. the chp says the driver did not stop right away, and -- stopped right away, and did not show any signs of impairment. they believe the driver just didn't see ward as he was riding alongside the rig. >> if you look here, where should a cyclist go? it's really kind of up in the air, unfortunately. >> the chp is still looking for witnesses to come forward. time now, 8:07. things are going well on the roads now. how are we looking, sal? >> dave and tori, we're looking okay. i was about to say mellow. maybe i've been hanging around with brian wilson too long.

television stations reported a quantas, boeing 747, with 437 people on board, returned to the singapore airport this morning, with an engine issue. it happened shortly after takeoff this morning. this comes just one day after qantas grounded all of its jumbo jets, when an airbus 380 jumbo jet made an emergency landing in singapore, after one of its engines blew out. and we now have an update for you on that breaking news from cleveland, ohio. looking at a live picture here. this nasa research center, which is located right next to cleveland's airport was under lockdown. just minutes ago. well, loud speakers have just announced, everything is clear. the emergency is over. apparently, with some sort of security exercise. and officials now say there never was any danger. 8:14. new this morning, the highly anticipated monthly report of unemployment came out this morning. and there is a little good news.

let's go to ktvu's alison burns in our washington, d.c. newsroom. with president obama's response. good morning, alison. >> reporter: good morning to you, tori. and the big news here is that more companies are hiring again. job growth is up for the first time in 5 months. but it is not enough to bring down the unemployment rate. it holds steady at 9.6%. employers added 151,000 jobs last month, mostly in health care, retail and business services. now, at the white house last hour, president obama used the report to reach out to the newly-elected republican congress, saying our future depends on putting politics aside, to find new ways to boost the economy. >> i am open to any idea, any proposal, any way we can get the economy growing faster so that people who need work can find it faster. >> president obama is also reaching out to political leaders over overseas --

leaders overseas. he left this morning for his asia trip. and he says one of his major goals is to open more overseas markets to u.s. products. reporting live from washington, d.c., allison burns, ktvu channel 2 news. >> all right. thank you, allison -- alison. and we have video to show you of the president leaving to go overseas. the president and first lady michelle obama boarded the plane. they will visit south korea and japan. some officials in pakistan is not happy that the president is spending three days in their rival and neighbor india, but not stopping in pakistan. meanwhile, we just got word there is a second bombing at a mosque in northwest pakistan and several people have been wounded. toyota just announced, its second-quarter profits are four times higher than a year ago. toyota, reporting quarterly

profits of $1.2 billion. that's despite being hurt by a strong yen, compared to other currencies. and also lingering worries about the massive recall of toyotas earlier this year. also, keep an eye on the stock of tesla. the palo alto stock gained 15% yesterday, closing at just under $25. yesterday's big gain came after panasonic's announcement that it is investing $30 million in tesla. we'll give you the latest on tes la in just a couple of minutes. by the way, toyota put $50 million into the company. advocates are worried that pg&e will pass on the costs for the san bruno explosion to customers. the utility filed papers saying the costs could be up to $1 billion. taincludes efforts to install automatic shutoff valves on

pipes and more for pipeline inspections. it also includes as much as $400 million in liability expenses for deaths, injuries, and property damage. in the meantime, pg&e's liability is growing with an additional lawsuit this week. 18 families, representing 52 individuals are included in the suit. it says pg&e failed to take corrective and life-saving action to prevent the blast, and seeks unspecified damages. at least 30 families are now suing pg&e. some filed just days after the september 9th blast that killed eight people and destroyed 37 homes. time now, 8:18. 75 san francisco boating ballot -- voting ballots that disaer 52ed election day, -- disappeared election day, they were found floating in a pond. the person accused ever taking them is being charged. it is still not known why he

took them. they were inside a plastic bag, but they still got wet, so no word if they will be counted. also, we will get an update on the status of the mayor's race. the registrar will release the preliminary results of the rank choice voting at 4:00 p.m. on the first round of voting, don peratta took the lead with 35% of the votes. followed by jean quan. however, a winner can't be declared until someone gets more than 50%. so election officials are now distributing the second-choice votes of the candidates under this rank choice system. just released. a new government study that shows lower mortality rates among heavy smokers who get annual ct scans. the national cancer institute found a 20% drop in lung cancer deaths for those patients. they believe it's the scan's ability to detect tumors at an early stage.

there are risks, however, because ct scans expose patients to more radiation than x-rays. they're also more expensive and also not covered by experience. a u.s. appeals court has ruled that starbucks does not have to pay a woman $3 million. 76-year-old rachel maltner sued the world's largest coffee chain, after she burned herself with tea two years ago in new york. she said the tea spilled when she tried to take the lid off the cup. she said the cup was placed inside another cup and the design had a defect. time now, 8:20. in the north bay, there is a very unique company there. and it is attracting the attention of former british prime minister tony blair. new concerns in the gulf of mexico. the evidence of what scientists have of what they fear is an after-effect of the bp oil spill. 2:37. -- 237. traffic is slow there. we'll tell you about the morning commute straight ahead.

well, there's word today. possibly new damage. they say they found dead and dying coral near the side of that ruptured bp oil spill. which spilled millions of barrels of oil into the gulf of mexico. now, the scientists say look at this photo. it shows a colony of dying

coral, seven miles from the oil well and 4600 feet below the surface. they say they need to run more tests on the coral to figure out exactly what killed him. well, the shoreline near antioch is being very closely monitored now, after a sunken tugboat leaked oil. take a look at this photo. this was taken by the coast guard. they put booms around the boat yesterday after getting reports of the spill off the southeastern shore of winter island. still not clear how much oil was spilled. but state fish and game officials say so far, it appears no wildlife has been affected. it is 8:24. former british prime minister tony blair helped dedicate a first of its kind solar energy project, at sonoma wine company. blair showed up at the winery west of santa rosa. he is working as a senior adviser to the silicon valley fund. the new system will allow the winery to get 30% of its

we're about a block away from the courthouse. and the reason is, a lot of the media have obviously descended on this area. so they've pushed us back quite a bit. i spoke with the lapd this morning, and they said they are on level 1 alert. and that is just one step above their normal day-to-day operations. concern that there could potentially be demonstrations or protests onut here. we have heard there was a protest or demonstration scheduled at 8:00 this morning. that is put together by the coalition for justice, the same organization that puts together a lot of the protests and demonstrations with regards to this case, up in oakland. they had scheduled one in july as well during the conviction. but there wasn't really a large- scale protest back then. they were not able to galvanize enough people to gather a big protest out here. so the lapd doesn't expect that there will be any sort of trouble out here. they are prepared. they have a few more officers

out here on patrol, outside the courthouse, but certainly not a huge presence outside the courthouse. we do see a number of people holding signs and perhaps maybe a dozen or so. and obviously a lot of reporters out here as well. but as it stands right now, things are peaceful out here. we do expect that this sentencing phase, which gets under way at 8:30, 9:00 this morning, will probably take sometime. because the defense tern -- attorneys will be introducing a couple of motions first. a new trial and then the gun enhancement charge. >> thanks for painting the picture outside. appreciate it. ktvu's claudine wong is inside the courthouse in los angeles. claudine, what's happening right now? >> 9th floor of this courthouse, just outside judge robert perry's courtroom, where this trial was. where the sentencing hearing is going to get under way any minute. judge perry has been punctual,

very, very punctual throughout the entire trial and proceedings. it doesn't appear, though, that things have quite started yet. we have a number of people in the hallway. dozens of people. the biggest issue has been when this trial has been down here is seating. a lot of people want to go in and see what is happening inside and watch the proceedings. and there just aren't enough seats. there are basically three rows of seats in there. so they let a handful of the public, five or so people in. the family did not get as many people as they had hoped. there are friends of officer grant who are in the hallway as well as their parents who did not get in. and there are people and other reporters sitting in the hallway because they are not allowed inside while this gets under way. we did watch as the mother of the officer and -- oscar and his uncles walked in. she had a couple of typed pages in her hand, which i assume are the pages she plans to read to

the judge today. again, there are a couple of things today. mentioned a couple of motions before they actually get to the sentencing and the victim impact statements that may take a little bit as well. we do know that there were a couple of other people who wanted to speak. we do not know if they can get to speak. but we know at least one friend of officer grant who was there that night and also make a statement to the judge. right now, things are starting to quiet down. they just let one more person into the courtroom. and we expect these proceedings to get under way very, very soon. of course, we have a reporter inside. we have reporters outside. we have crews all out here. and we'll, of course, keep you updated on any developments that come across during this. we'll update you here on ktvu. that saturday latest on the 9th floor of this courthouse. we'll send it back to you. >> claude -- claudia wong, just confirming that they are back

battled a warehouse fire. it was on leslie drive, near railroad avenue. started about 2:00 a.m. the warehouse has been empty for a while now. no injuries have been reported. the cause of the fire is still under investigation. now, in brentwood overnight, this fire destroyed a family's home. started about 12:30 this morning. on lone tree way. an elderly woman and her daughter were sound asleep. but one of their barking dogs woke them up and probably saved lives. the mother and daughter escaped safely, but another dog in the house died in the fire. the house was a total loss. the cause of the fire is under investigation. >> san francisco police are investigating a deadly shooting in the bay view district. the body of a 21-year-old man was found on kirkwood avenue. around 8:40 last night. investigators sealed off the area as they searched for evidence and questioned witnesses. we don't yet know the victim's name and the investigation continues. this morning, san francisco police will update their investigation into the deaths

ever a woman -- death of a woman who lived on russian hill. 46-year-old kate horan was found inside her chestnut street apartment. officers say they received a call to check on her well being. according to the san francisco examiner, horn -- horan had just returned from a trip to argentina, a few hours before she was killed. her family says she was also involved in several charities. >> she was a person who didn't simply speak of causes but always anxious to get involved with civic functions. >> police say violence in the neighborhood is rare. visitors to the 36-unit apartment building need to be buzzed in through a call box. time now is 8:37. let's get you to where you need to go. sal is watching everything in our commute. sal? >> well, dave and torei. thing -- tori, things are getting a little easier now. by the way, you can always send

boeing 747, with 430 people on board. that plane returned to singapore, with an engine problem, shortly after takeoff. and the sentencing hearing for johannes mehserle is now under way. you see oscar grant's family going into the courthouse right now. several people are gathered outside the courthouse in los angeles. the judge just walked into the courtroom about 5 minutes ago. this judge will decide mehserle's punishment for the fatal shooting of oscar grant. joining me live to talk about what the judge could decide during the hearing this morning is legal analyst michael cardoza. most legal experts, including yourself, say mehserle will not get the maximum sentence of 14 years. >> i don't see that happening. he's a police officer. he's doing his duty. he made a horrible mistake, whether you believe he was frightened at the time because of the circumstances, no judge

to my mind, will give him 14 years. >> but oscar grant's family says he didn't immediately apologize. he did not admittedly make a mistake. so they feel that should have a sway. >> what to keep in mind. he lawyers up right away. the police officer's association gets to him right away. and i would imagine he would want to apologize. but i would tell my client, you can't talk right now. and where he made a mistake was not talking to the authorities and staying mute at that time. he should have talked to the district attorney's office. it would have given him some help. but as for apology, it was not the time for that. i've read the motion for new trial. and they've got a shot at it. >> really? >> more than most. most motions for a new trial are really jousting at windmills more than anything.

this one has a shot. >> why is that? >> because part of the district district attorney's argument in the case was this has every happened in the united states before. this type of situation has never happened. in fact, after the trial was over, they located a case back east, i think tennessee, where a police officer did almost the exact same thing, to show that yes, this type of thing can happen. so that may have some sway with the judge. >> all right. we'll see what he has to say. but assuming he does not rule for a new trial, we'll hear from family members in court. will that have any influence on the judge? >> it will have some influence. that's victim impact. but that will be after the argument about whether he's going to impose the gun enhancement or not. but what they get the victim impact, it will be very emotional on both sides. mehserle's family will have a chance to talk, his friends and oscar grant's family. it will have some impact on the judge. but keep in mine, this is -- mind, this is a seasoned judge who has dealt with murder trials before and understands

the situation. >> what would you say? >> if i had to bet, i'd guess seven years. but i'd not be surprised if he throws the gun charge out. what the injury said was he intended to use the gun but not on oscar grant. >> i'll tell you, they will have to decide to give guidance to our lower courts. >> all right. you'll stick around to talk to us after the sentencing is announced. >> i will. >> thank you. we appreciate that. and stay with ktvu news. our cruc will provide -- crews will provide information as soon as we get word. vallejo police are busy investigating a troubling series of attacks on elderly women and teenage girls may be the attackers. ktvu's kraig debro, live in vallejo now, with the latest. good morning, kraig. >> good morning, dave.

elderly woman and one 13-year- old girl was also robbed by the same group of teenage girls in vallejo. three of these attacks took place on october 22nd. these teenagers, police say, are responsible for all four robberies. and here they are. in a surveillance videotape during one of those robberies. the girls approach a woman, push and then punch her before ripping the woman's purse from her shoulder and hand. this happened just as the woman was about to enter a condo complex. the first attack took place in the early afternoon, october 22nd, near city hall. the second, miles away, near american canyon. the thieves attempted to rob a woman waiting for a bus there. none of the victims have been seriously hurt. but what's happened may have been a psychological blow to the people who can't believe the most vulnerable people are being targeted. >> i can't say that these types of incidents never happen before. but it is highly unusual in the sense that all of our victims

are usually elderly, handicapped. and the fact that the suspects are females is a little bit unusual as well. >> reporter: the 13-year-old had a backpack stolen from her. the suspects in all four incidents are described as black females, between 17 and 19 years old. the first victim told police, they were 5'2" to 5'5" tall. one of the women received injuries. the vehicle being driven by the fourth suspect, described only as a young black male. reporting live in vallejo. kraig debro, ktvu channel 2 news. time now is 8:50. some of the people who went to the giants' world series victory parade, never came home. san francisco police report a flurry of missing persons reports, connected to wednesday's big parade that attracted about a million people. many of those reported missing are troubled teenagers. they may or may not be battling

with their parents or guardians. the city of half moon bay is considering its options, now that voters have rejected a 1- cent increase in the local sales tax. city council held an emergency meeting to discuss how to close an $800,000 budget gap that created the need for ballot k. they raised it to 10 and a quarter percent, which could have added $1.4 million a year to the budget. now they're looking at either cutting or disbanding the city's police department. >> just don't know how many more challenges we can take. >> we were defeated unfortunately. and so now, i think the community is going to realize we're going to make very, very severe cuts. >> yesterday's meeting was only information. the council is scheduled to make a decision on what to do early next month. officials at cal state east bay at hayward are considering their options, after a judge blocks a plan for new dorms and a parking garage. the university was ready to

begin construction on a five- story garage and four new dorms. but neighbors' groups sued, saying the school failed to address other concerns about traffic, air quality and emergency services. the judge put the project on hold until the issues are addressed. the university is considering an appeal, compliance, or some sort of compromise. time now, 8:51. the head of 7-eleven stores is offering to send a slurpee machine to the white house. this after a reporter asked president obama a question during his post-election day news conference. >> i want to ask if you're going to have john boehner over for a slurpee. but i actually have a serious question. >> i might serve them. they're delicious drinks. [ laughter ] >> if you're wondering what he's referring to, it comes from earlier comments by president obama, who repeatedly said that democrats are pushing a car out of a ditch, while republicans stand by, sipping a slurpee. now, the president said he might hold a slurpee summit. and 7-eleven said they would be
