complete bay area news coverage starts right now. this is the 10:00 news on ktvu channel 2 news. still counting. the election race is still too close to call after a week after voters cast their ballot. good evening everyone, i'm heather holmes. i'm ken wayne and five days since the election and a seat in congress to the state attorney general some key races are still too close to call, but we may learn the result of the race for mayor for oakland. ktvu's mareen naylor is live in oakland with details. >> reporter: ken, election

officials process ballots until 7:30 this evening watching several close races. they will be back here at 8:30 tomorrow morning and say by this time tomorrow night we should have a clear picture of some winners. a team of election workers this evening opened thousands of yellow vote-by-mail envelopes and processed the ballots in scanning machines. tonight members of its 11th congressional district campaigns kept a close eye on these red bins, which contain the remaining 3,000 ballots in this county for the race which is still too close to call. 421 votes separate mcnerney from harmer. >> about 90,000 dropped off the polls, but of course, that is till double and trip the workload, because every ballot or every envelope, rather, has at least two ballots inside it. >> reporter: in a stuffy, quieter room election workers

have verifying the last 2,000 provisional ballots. ane quan leads don perata and for the first time oakland voters ranked their top three choices. because nobody got the majority it's taken ten rounds of number- crunch torque eliminate the eight low-vote getters and distribute these to the remaining candidates. >> it gave me a lot more options and there is a lot more nuance how i could vote and it wasn't a matter of simply trying to pick one person who was absolutely perfect. >> i think it should be one or two and not split them up and give a little more here or there. it's not fair. >> reporter: here is what is next. alameda county is expected to release its latest figures at 4:00 tomorrow morning and tomorrow the full-court hearing for the 11th congressional district where republicans are challenging the contra costa

registrar by signature verification. maureen naylor, ktvu channel 2 news. an analysis of self-funded campaigns by the san josi mercury news found that four other people outspent meg whitman when it comes to money spent per vote. many his bid for election as new york city mayor, michael bloomberg spent $188 per vote, adjusted for inflation. and in the 1998 california democratic gubernatorial primary, al checchi spect $53 per vote, but saw grave davis win that primary. with $144 million of meg whitman's money spent on campaign, she specialty about $43 on each vote. much of the bay area is drying out after a storm

people who are familiar with that law, but yes, you are supposed to have your raleighs on in the rain and rain conditions. >> reporter: the rain kept away the crowds and brought out bargain-hunters at the flea market in san francisco. >> police figured most people would be indoors and we wanted to take advantage of the flee- market bargain prices. >> reporter: it might be harder than she thinks. flea market dealers say because there are fewer vendors in the rain, she has very little competing to the goods. how is the weather affecting business today? >> remarkably it's been a good day for me. >> reporter: across the bay, about 21,000 pga pga customers were in the dark in piedmont and oakland this afternoon when a power substation broke down. it was unclear whether the outage was caused by the rain. >> i was worried about the frozen stuff. good thing it didn't take too long. 35 minutes is all right.

>> reporter: gabriel villaman was home when the power went out. >> i took a shower in the dark. it was spooky, but okay. >> reporter: it's business as urmagain here in montclair. in the oakland hills, are priya davis clemons, ktvu. the highway patrol was very busy in the south bay. the light to moderate rain was enough to trigger serv crashes. as of 8:00 this evening there had not been any fatal accidents. the on-again, off-again rain did not have affect on flights at mineta san josi airport. the south bay didn'tet get a whole lot of rain and other areas got a real soaking. with a look at today's rainfall totals let's check with in meteorologist mark tamayo. >> heather, a poeten cold front continues to move out the bay area. this is the radar loop and you can see the totals for santa rosa, .93 and san francisco and oakland both over 1" of rain. we have more totals we have

tallied up for you. concord, livermore, hayward and san josi around .16" over the past 24 hours. as far as the rainfall right now, we do take a look at live stormtracker 2, the main action to the east and, in fact, snow levels come down it 5500-6,000- feet. bulk of rainfall around the fresno area, but in the bay area we could have a few leftover sprinkles. for the most past we have partly cloudy skies. coming up we have some chilly overnight lows and break down the timing of our next rain chance that could push back into the region over the next few days. the national weather service issued a storm warning for the sierra. chains are require tonight on interstate 80 from kingvale to donner lake and on highway 50 from kyburz to myers. a survey point at 8400-feet, 10" of snow fell. another 2-4" are expected overnight. the storm warning is in effect until 6:00 a.m. tomorrow. you can find the latest

website, ktvu.com. just click on the tab near the top of the homepage. police today released the ages, but not the names of the two teenagers fatally shot yesterday in west oakland. investigators say the victims were 17 and 18 years old. the two were in a car that was not registered to either of them at the time of the attack. police say they were shot by someone from outside the vehicle and they died at the scene. investigators are still looking for a motive and no arrests have been made. one person was seriously injured and apartment heavy damaged after a fire broke out in antioch. the victim suffered burns at the fire on lone tree way. when firefighters arrived after 3:00 this morning they say several apartments on the floor above the carports were fully engulfed and that flames had already reached the third floor as well as the roof. the cause of that fire is still under investigation. fire officials blame work on a new roof for friday

afternoon's fire at the spanish 7" day adventist church. crews were installing a new roof on the church when investigators say the fire from a tar pot ignited the structure and then caused a propane tank inside the church's annex to explode. no one was injured and firefighters were able to keep the flames from spreading. now last year a fire at the church destroyed a building housing a youth chapel, dining room and kitchen area. investigators never determined a cause for that fire. not in your backyard. the moment against high-speed rail and how the election could have an impact on california's plan. your help is needed. what somebody did to some birds and what you can do to aid in the rescue efforts. and fresh off the election, republicans look to make good on a campaign promise. the 10:00 news continues in 90

the rain didn't stop critics of california's high- speed rail from lining up against the increasingly controversial project. as ktvu's diane guerazzi reports peninsula homeowners and elected officials gathered to try to keep that project off- track. >> reporter: people from as far away as gilroy huddled together this afternoon in between signs

saying "here comes the high- speed rail, there goes the neighborhood." >> no elevated structures in our city! >> reporter: 25-feet or more across our neighborhood. >> it's breaking it into two pieces. >> reporter: opponents fight the estimated costs that shot up from $33 billion to $43 billion and the one-way ticket price to los angeles that was $50, but now almost double. >> where did you get these numbers and how did you come up with them? >> reporter: the republican who will head the house transportation committee says he with ans to reexam the grants for high-speed train service. another ray of sunshine for this crowd came from the high- speed rail authority announced it will begin construction in the central valley and not here. >> the fact that somebody told you that they are going to spend all the money in the central valley doesn't mean that the san francisco peninsula isn't right in the

crosshairs of a boondoggle of a project. >> reporter: they issued i statement "saying that we cannot forget that the voters of california said yes to and continue to support high-speed rail because it provides jobs, decreases air pollution and provides us with a cheaper, faster and more convenient way to travel." >> if you look at how deeply the federal government is in debt, is this really the best way to put our money? >> reporter: the protesters took their message through downtown burlingame. the community coalition on high- speed rail plans an agenda of lawsuit and lobbying, talking to newly elected officials to block the plan. in burlingame, diane guerazzi, ktvu channel 2 news. the smart computer train project is closer to becoming a reality. a scaled-down plan was approved

yesterday by the sonoma-marian district board of directors. that is a shorter system than the 70-mile line approved by voters in 2008. the voter-approved planned called for a quarter sent sales tax for a rail line that included cloverdale. the board said the poor economy demanded that the $395000000 plan be scaled down. a north bay man remains in serious condition after a small plane crash. single-engine plane crashed shortly after takeoff from sonoma sky park. 68-year-old mark johnson, the passenger is hospitalized at john muir medical center. the pilot from san francisco was treated for his injuries and released. federal investigators are looking into the cause of the accident. we're learning tonight that the elderly man struck by hit- and-run driver in fremont friday morning died from his

injuries. fremont police say 83-year-old salim nosrat was at the intersection and authorities say a person driving a light- colored 1985 toyota avalon, similar to this one here, struck and killed nosrat and then drove away. if you have any information about the accident or the driver, you are asked to call fremont police. well, a new study from the triple-a foundation finds that 5500 fatal accidents a year are caused by drowsy drivers and that is about 17% of all fatal crashes in the u.s. the researchers say their survey found about 40% of drivers admitted to falling asleep behind the wheel at some point, and one in ten drivers said they had done so in the last year. past research suggests people who drive after being awake for 17-19 hours performed worse than those with a blood-alcohol level equal to what is considered drunk in most western european countries. and off-duty bay area firefighter is called a hero

after rescuing two crabbers after rodeo beach. rich racich was going to surf when he saw the crabbers losing control of their boat in a rough water. while a ranger called the coast guard, racich paddled out and persuaded the couple to abandon their boat and kick away from nearby rocks. acoast guard vessel picked up the unidentified man and woman. they were treated for mild hypothermia and released. someone has collared at least five birds in the bay area with bee cans. the cans interrupt preening and made it harder for the birds to eat. the wildlife rescue tracked a gull, but couldn't get close enough to rescue it. the group says it needs a net- launching device to properly capture the birds and remove the collars. for information how to donate to the effort, you can go to ktvu.com. in washington, republicans are gearing up to try to repeal healthcare reform. one of the key promises made

during mid-term election campaigns. democrats are digging in and saying that the hard-won legislation will go forward. reporter april williams has the latest. >> reporter: fresh off their midterm election gains, top republicans like minnesota governor tim pawlenty quickly set their sights on preobama's healthcare reform program, enacked into law earlier this year. >> i think obamacare is one of the worst pieces legislation passed. >> reporter: he is not alone. several republicans are vowing changes in the law or scrapping it together. republicans have maintained the so-called reforms are being financed by money that the country doesn't have and puts the government in charge of vital healthcare decisions. still, they concede it's an uphill battle with the president holding veto power. >> it will be difficult with him in the white house, but if we can put a full repeal on his desk and replace it with the kind of commonsense reforms we were advocating to reduce

stimulate the economy by paving roads, creating jobs and the like has now been locked in or spent. now we went line-by-line through a list of all 101 bay area cities to see who got the most, who got the least and what they did with the hundreds of million of stimulus dollars? our julie haener with tonight's special report. >> reporter: welcome to little rio vista. this small town, 86 on the list of 101 bay area cities has just under 8,000 people living along the banks of the sacramento river in solano county. >> how do you get the infrastructure costs up to day over 100 yards? >> reporter: the metropolitan transportation commission has flunked rye yo vista for having

the worst roads. rio vista spent some $33 million on a state-of-the-art sewage treatment plant, but as it turns out, it really didn't need one and it remains mostly unused. nevertheless, rio visittans have seen their water and sewer bills more than double to $135 a month, because the hundreds of homes that the sewage plant was designed to service were never built. >> we were $4 million in the red on the water and sewer bills. >> reporter: because rio vista is essentially broke, city hall is essentially closed to its citizens every friday. >> we've gone from close to 60 employees to 38. we don't know who else to cut. >> reporter: if after an american town needed to be economically stimulated, it wouldn't be hard to argue rio vista is it, but only rio vista, unlike 100 other bay area towns it that took hundreds of millions of dollars has never received money in federal stimulus funds and never spent a penny of the

billions available. on the other hand, there is the city and county of san francisco, which got almost $1 billion in stimulus money. that is more than $1200 per san francisco resident, the most for any place in the bay area. the single biggest chunk of money, almost $400 million is going to the new transbay terminal project, but millions of dollars have gone to other projects, such as repaving pot- holed streets. >> san francisco is both a city and a county, so there are considerations there. >> reporter: tonic winnicker is mayor newsom's press secretary. >> we're a major economical and cultural center for the region. >> reporter: but doesn't getting the most money mean that san francisco is in the most pitiful condition? >> we're the densest city outside of manhattan. we have a transportation network with more boardings than anyone in the country. muni received tens ever millions of dollars in stimulus

money. >> reporter: although the stimulus money for projects, such as roads, jobs and research is accounted for, there is still one ill unknown chunk of money coming from the obama administration, another $34 billion in tax cuts are still on the way coast-to-coast in the ongoing and controversial attempt to fully restore the health of the american economy. i'm julie haener, ktvu channel 2 news. on top of all its budget problems california is sinking further into debt to play unemployment claims. the los angeles times finds that the state is borrowing $40 million a day from the u.s. for unemployment checks. so far the debt adds up to $ 8.6 billion with first payments due to washington next september. continued borrowing means payroll costs will go up to $21 per worker per year. unemployment claims have more than doubled since 2007. bay area rapid transit say it cost a million dollars to

south and to our east and that front will continue to move in that direction for tomorrow. so for your monthe storm moves out and partly cloudy skies and temperatures around the 60- degree mark. into tuesday, a fairly weak system will impact our weather. there is a possibility we could have a frost advisory for the the valley and a chance of shower primarily in the north bay by tuesday afternoon, but this is a very weak system. in fact, here is our forecast model. we'll tut it into motion. it's dry for your monday and we'll take this into your tuesday and by the afternoon hours, there is a possibility of air sprinkle up in the north bay, up towards sonoma and mendocino counties. and extending down to the south bay by tuesday night into wednesday. into the afternoon hours we'll stick with the partly cloudy theme, but a bit a breeze kicking in about 4:00 with temperatures in the upper 50s
