60s. that is it. it will be a cool breezy day. if you're along the coast or higher elevations maybe a little windy. traffic is moving along pretty well. southbound 101 traffic looks good heading toward the toll plaza million. also this morning we're looking at westbound bay bridge. traffic is slow there. it's 6:00 let's go back to the desk. thank you. in oakland police are investigating a shooting at a car crash overnight. police say the victim was found in his car on high street and that incident also set off a gas leak right now as we're speaking a handful of people still are out of their homes. ktvukraig debro is live at the scene. good morning. >> reporter: good morning. that person is on life support right now in a hospital behind me. this is the car that crashed into the house person inside had been shot. meanwhile those people that you mentioned had to be evacuated some are still out of their

homes because electricity is not back on. high street is blocked. police got a call around 2:00 a.m. this morning. a car crashed into the house around east oakland. they found a man inside the vehicle. slumped over on the driver side of the car. the man police soon realized had been shot the man behind the wheel had been shot. when they first arrived police had a different theory. >> first they thought it was a crash. officers arrived on scene. smelled gas. they immediately pants of the h looked at the vehicle and observed a man slumped down in the drivers seat of the vehicle. >> reporter: police say the car is not registered to an oak laundries kept. they haven't been able to reach the registered owner. the car has not been reported stolen. pg&e says it has capped the leak but the electricity is still out in those homes.

been the caused. in vacaville the search continues for a suspect in arrest. officers recovered two computers and a monitor believed to be stolen from orchard elementary school. a second suspect got away. if you have any information call vacaville police. a marin county firefighter is being called a hero after he rescued two people stranded out to sea. they ran into trouble yesterday. luckily an off duty firefighter was searching nearby he convinced them to get off the boat. the boaters were treated for mild hyper thermae. yeah hans in mehserle remains -- johannes mehserle remains in jail. friday a los angeles judge

sentenced mehserle 22 months ago. judge robert said he believes mehserles testony that he grabbed his pistol instead of his pistol. >> this fellow deserves jail i'm. i'm not sure it's worth. >> it's still a very harsh punishment. >> now the judge gave mehserle credit for the time he's already served behind bars. that means mehserle will be eligible for reedes -- release. a day of peaceful protests ended in an angry confrontation. police in riot gear arrested 152 demonstrators. officers say the march turned into a melee.

50s and 60s not very warm. increasing clouds tuesday just light rain will make it on tuesday night and wednesday. sunny and warmer. >> thank you. 6:08. the votes are still being counted in two neck and neck bay area political races. in the oakland mayors race it's the new ranked choice voting that kind of stalling the results and making for some very interesting twists and turns. ktvu jade hernandez is joining us live. good morning. >> reporter: good morning. we are live at city hall where the race for mayor took an unexpected turn. who is going to be the next mayor of oakland? we may soon find out. gene quan leads don perata 51% to 49%. alameda county expects latest figures to be released around

4:00 with results no later than tomorrow. oakland voters ranked their top three ballots. it has created an interesting shift in votes. it's taken ten rounds to eliminate the eighth lowest vote getters. perata's lead was by 10%. quan stepped ahead by a little more than a point. it is supposed to eliminate the runoff process. alameda county received an unprecedented number of vote by mail ball lots. >> it's right up there for the most we have ever seen. about 90,000 dropped off at the polls. of course that is still double and triple the workload. every ballot or envelope has two ballots inside. >> reporter: also the 11th congressional district seat is

still undecided. only 421 votes separates them. 3,000 ballots are yet to be counted in that race. today will be the first full court hearing where republicans are challenging the register about signature verification of the vote by mail envelopes. more on that coming up. we're live in city hall. jade hernandez. >> all right. there is still no declared inaner state attorney general. cooley is pulling ahead now. cooley has 46.1% to harris 45.6%. state election officials say this race may stay too closed to call for several more weeks. we're going to pose the latest election results as soon as we get them on our channel 2 website. just go to ktvu.com and click

president obama has just wrapped up a major speech to the parliament of india. ktvu alison burns reports he's talking about new trade deals with the united states. allyson good morning. >> reporter: good morning to you, dave. that is right. president obama is making clear that even though he is overseas his focus son jobs here at home -- his focus is on jobs here at home. he is passionately promoting india is as a global economic power. he announced $10 million trade deals with india that will support 54 million jobs in the u.s.. president obama says increased trade is a win-win for both countries. >> it is my firm belief the relationship between the united states and india bound by our shared interests and our shared

values. will be one of the defining partnerships of the 21st century. >> there has been light moments of the three-day trip to india. here are the president and first lady dancing with kids at a trip to a local school. they will be attending a state dinner in their honor. we'll have live coverage. reporting live in washington, d.c.. we have a disturbing story this morning. a french newspaper is reporting that al qaeda in reich tried to blow up planes headed to the u.s. by surgically implanting bombs inside dogs before the animals were placed on the planes. the plot failed because the bombs were so badly inserted the dogs died. there is a new controversy over california lethal

injection. they have for up to four executions. but some death penalty opponents are questioning where the state got those drugs. that is because a judge called off a scheduled execution on september 30 because the state supply had expired. they would not say where they found the drugs. u.s. defense secretary robert gates is urging congress to act quickly to repeal the don't ask don't tell policy. secretary gates says the current congress should take up the issue before new members of congress will take their seats. the house of representatives had approved lifting the ban but it was blocked in the senate. back here at home a new acting police chief is in charge in san jose. chris moore is in the top spot after rob davis retired. moore grew up in marin county.

he's been ons police force since 1982. the city manager has been holding public hearings to pick a permanent police chief. supporters of legalizing marijuana say that are already gearing up for a come back proposition. even though it fail in last tuesday's election it is now only a matter of when not if marijuana will be legal. they say they will use what they learn in this election cycle to help them craft a better campaign message. it has been debated for years. now plans to build a smart commuter rail is ready. build the first part. that is less what voters more or less what voters were

promised two years ago when they approved a quarter cent sails tax increase to help pay for the project. the rail line was supposed to go from ferry to cloverdale the railroad says the poor economy has reduced the sales tax revenue. the first train segment is expected to be finished in 2014. sal is watching problems in the livermore valley what is going on? >> it will be a tough problem to get over this westbound 580 crash has slow traffic already. westbound 580 in pleasant ton it will be effected by a crash. you can see traffic is already slow. all the way back into livermore. it's a huge deal for the valley this morning apparently the big rigs are damaged. the big rig is damaged. another pickup truck is damaged. this is a terrible way to start the 580 commute.

we have big problems in the livermore valley area. we have a truck accident blocking the two left lanes or the two right lanes. 580 westbound traffic is backed up all the way into the livermore valley. if this is your commute you need to leave the house early or postpone your trip. 580 is a mess right now. we'll have details straight ahead. the sierra storm warning was lifted a few minutes ago. we just checked. chains still required on highway 50 but you don't need

them on interstate 80. a foot of snow has fallen on the highest areas of the sierra. you can find the latest weather conditions by listening to steve and get storm watches or warnings by going to our channel 2 website. just go to ktvu.com and click on the weather tab. high unemployment is pushing the state deeper into debt. the state borrowed almost $9 billion or $40 million a day from the federal government just to pay unemployment benefits. some of that money will have to be repaid by next september. right now one out of every eight californians is out of a josh. washington has handed out billions of dollars in economic stimulus. some bay area members that need the money is not getting it. the small town is deeply in debt. it can't afford to fix its

roads and city hall is closed every friday. >> we have gone from close to 60 employees to 38. we don't know who else to cut. >> san francisco on the other hand received almost $1 billion stimulus dollars. the funds were drinked based on population. there is relief coming from the obama administration in the form of tax breaks. johannes mehserle remains in jail but he will go back before a judge for another critical court date very soon. also. the opening bell is about to ring on wall street. pam will bring you all of the early stock numbers.

we will check in on the numbers in a minute. >> we will go ahead and say good morning to you. i turned my microphone off. >> all right. good morning thank you for joining us it is monday november 8th. it is now 6:31. and we are following a story in oakland. police are investigating a shooting that set off an unusual chain of events. police say a victims car crashed into a house on high street. kraig debro just talked to witnesses. what did they tell you? >> reporter: i just talked to the family inside that house. you see that whitish color car i talked to the family that has two teenagers. an step-year-old and nine-year- old. very frightening moments for that family. they are now sitting inside a ac transit bus down the street until police make it okay to go back in the house. it all happened on high street just a few yards west of i-80.

they got here around 2:00 a.m. this morning. they found a man inside the vehicle slumped over on the drivers side of the car. the man police soon realized the man had been shot when they first arrived police had a different there are theory. >> i believe it was just a crash. when the car crashed officers arrived an sewn smelled gas. they immediately evacuated the occupants of the house and looked at the vehicle and observed a male slumped down in the drivers seat. >> reporter: police say the car is not registered to an oakland resident. they have not been able to reach the owner. most of those people i would say all expect the family i smoke to you back in their homes. they have capped the leak. that came two hours ago. the electricity is now on inside the homes here. the people from some of the

homes are trying to wait out the disruption on this ac transit bus. i mentioned the family that is where they are right now. they herd the crash around 1:30. the impact pushed the fireplace all the tie into the home. to hear the loud hissing and smelling the gas. thinking any spark could set it off. this is a main thorough fair through the western part of oakland. that could be an issue later rob for sal. we're going to keep an eye on that. reporting live in oakland kraig debro ktvu channel 2 news. 6:33 santa cruz police just released a sketch of a man trying to sexually assault a teenage girl. here it is. this is the sketch. he's described as being 27 and 33 years old. he's about 5'9" tall. weighing 150 pounds.

the suspect tried to attack a 15-year-old girl in ocean view park. she managed to escape. okay landless are investigating -- police say the victims were attacked while they were sitting in a car on eighth street saturday afternoon. police have not released their names but they say one victim was a 17-year-old from hayward. the other victim was an 18-year- old from east oakland. they were shot by someone from outside the car. they died at thscene. the car was not registered to either shooting victim. so far no one has been arrested. fremont police want your help to find a hit and run driver that hit and killed an elderly man. 83-year-old sarene was at a crosswalk on fremont boulevard when he was hit. the suspect was in a car like this a light colored 1995 toyota avlon similar to the one on your screen.

if you have any information please call fremont police. former bart police officer johannes mehserle remains in the jail this morning. a los angeles judge sentenced him to two years in prison. ktvu claudine wong is joining us live. she's in the number now to tell us what is next. good morning. >> yes. this isn't over. it i peers we can still see more protest over the sentence. that is when a bail hear willing be held and johannes mehserle attorney already promised to appeal and hoping his client would be freed on bail during the bail hearing. in the meantime, every day johannes mehserle spends behind bars goes to his two year sentence. it's likely he will spend only seven months behind bars because he does get credit for

time served. while some community groups are promising more protest in coming 152 protestors are preparing to deal with the legal fallout for their arrests. they are facing charges of unlawful assembly. also this morning we are expecting some of the stores you're looking at downtown oakland to reopen for the first time since friday. some did close down as you can see they bordered up their windows for fear of what protestors would do. some had to spend the weekend cleaning up. although that damage was minor comparison to the violence we saw after the verdict in july. also this morning a call for positive change from the religious community. >> now that would have been something great. we will do it all in honorover oscar grant. we will do it in his memory. >> reporter: the oscar grant family said they will continue to work for change while they say the system has failed, they are still hoping the system

we have traffic that is really slow this morning. these are live pictures from news chopper two showing it all. not showing very good news for you if you drive on 580. the reason we had a crash to block two lanes on 580 westbound. believe it or not it took them almost an hour. they are still up there cleaning it up. it took them almost an hour to get it out of the way. it was a crash with cars all over the place. right now your best bet is to take bart or give yourself plenty of extra time. you will stuck in a one hour traffic jam. there is a live picture of the remainder of the accident. chp still on scene. here is a quick look at the other stories. oakland police are

investigating a shooting that played some part in a crash on high street overnight. here's the car that was involved in it. it set off a gas leak in the neighborhood. ten people were force the to reeve their homes. the shooting victim is in grave condition. johannes mehserle remains in the l.a. county jail. they will probably remain there until the bail hearing in two weeks. on friday a judge in los angeles sentenced mehserle to two years in prison for the fatal shooting ofst os -- shooting of oscar grant. polk said he backs india's push for a permanent seat on the u.n. security council. it has been almost a week since last tuesday's election but two bay area races remain undecided. jade hernandez is following the

latest results. she joins us from outside oakland city hall. it's still not clear who will occupy the mayor seat. >> reporter: good morning. that county outlet has been extreme busy. we're live in front of city hall this morning. who will be the next mayor of oakland. we may soon find out. city council woman gene quan leads don perata 51% to 59%. alameda county expects latest numbers to be released by 4:00. oakland voters rack their top three choices at the ballot box. that has created an interesting shift in votes. perata's lead was by 10% until oakland city council member votes were distributed. quan stepped ahead by a little bit more than a point.

election workers have been sorting and counting furiously. the ranked voting is supposed to eliminate the runoff process which could be costly. what do oakland voters think? >> i like the ranked voting. it gave me a lot more options. it wasn't a mat over simply trying to pick one person that was absolutely perfect. >> i think it should be one or two not split them up and give a little more here and there. it's not fair. >> reporter: the 11th congressional district seat is still undecided. only 421 votes separates jeremy and david. today will be the first full court hearing where republicans are challenging the contra

one time. 580 is backed up into livermore. our live pictures are showing it all. i think we will get a lot more people coming in using bart this morning. we will get people who are stuck in traffic calling in. people taking the eighth train. you can see how long this back up will be. we will be on it all morning long. if you are just waking up and use 580 you need an extra half hour. give yourself an extra 30-40 minutes. let's move along and take a look at the bay bridge. the metering lights are on. getting into san francisco not a huge day. if you're driving into santa rosa. no problem once you get into the valley. 6:51 let's go to steve. mostly clear out there. it's cold. not cold, cold we could be colder. we're seeing a lot of upper 30s and 40s. you can see why after
