death following what looked like an early morning accident turned out to be no accident at all. >> we was laying in bed asleep and all of a sudden we hear a car hit the wall. >> jerry killingsworth gathered his wife and kids and left the home. nobody inside the home was hurt but the person inside the car is now in life support, but not as a result of the accident. police say the unidentified man suffers from at least one gunshot wound. the crash created another problem that caused the evacuation of about ten homes. >> he hit the meter and the gas and when you went out the back door, all you could see hear was shhh real loud. >> the cap is capped. there's still a crew on the scene, pg&e crew.

meanwhile the killingsworth family waits on a transit bus. it's the warmest place for them right now. not only do they want to get back in their home but commuters need to get through here has increased. police have now i see stopped the traffic about a block from here. that the detour is going to be easier when the cars are coming down here and turning right behind me, the streets are very narrow here, so they've got a fix four that one problem right now. time now, 7:04678 the gym at claremont middle school will be off limits after a fire. firefighters rushed to the school shortly after 2 a.m.. the fire was kept to the roof of the school's gym but it caused alet of smoke there. no injuries have been reported but the gym suffered a lot of water damage. firefighters say they suspect an

electrical problem may be to blame. santacruz police have released a sketch of a man suspected trying to assault a taej girl. he's described between 27 and 33 years old, about 5'9", weighing 150 pounds. police say the suspect tried to attack a 15-year-old girl in oceanview park but she managed to get away. our time is now 7:04. johannes mehserle remains in jail this morning. ktvu's claudine wong is in the newsroom telling us what is next for the former bart officer. >> reporter: in between weeks, things could change because of a bail hearing will be held in this case and johannes mehserle's lawyer is hoping his client will be set free on bail. his attorney has promised to file an appeal to appeal his client's involuntary manslaughter conviction and he will ask for mehserle's release on bail. in the meantime every day

mehserle spndz behind bars goes toward his two-year sentence. it's likely he will only spend 7 months behind bars. that's because he gets credit for time served. where he will serve that time is unclear but his attorney has said he is concerned about his client's safety and legal analysts say that is a very real concern. >> i think he's going to face a lot of difficult time of he may not even be -- they may have to send him out of state but this record is going to follow him around. he's going to have -- i mean, it's a dangerous situation. >> the protest did follow that sentencing and some organizers are promising more protests. 150 people are facing charges of unlawful assembly following the protest. the judge also acknowledged the

polarization in the community. the downtown businesses are feeling the effects. some businesses will reopen for the first time since friday. again, some did close down on friday over fear of what protesters could do and some did have to spend the weekend cleaning up after demonstrations caused damage. damage was minor compared to what we saw after the verdict in july but the community is hoping to turn frustration into a positive force for change. >> now that would have been something great and we'll do it all in honor of oscar grant. what a tremendous legacy oscar grant would leave for the city of oakland. >> the grant family says it's going to continue to work for change. they believe the system has failed and they're hoping the system will work and get the justice department to take on this case. in court friday, mehserle's attorney argued this should not have been a criminal case, rather a civil one of the bart

occasion. a huge line of cars on 580 westbound this morning because of a crash that was there in the valley at pop yard road on -- hop yard road. these are pictures taken from news chopper 2 of the crash earlier. for a while they were blocking the three lanes there. they dragged those cars out of the y. a big rig was involved and the backup is stretching back to the altamonte pass. if you're driving 580 westbound, you need to give yourself extra time. the only upshot is that if you drive on 680 south right now the traffic is kind of light. most people are stuck on 508. get on your 680 commute early and beat the crowd there. bay bridge is backed up for about 15 to 20-minute wait. once you get on the bridge it moves well into the city. this is a look at interstate

sglrvgts some of the streets closed by that deadly gas line explosion in san bruno are scheduled to reopen this week. the city manager says claremont and fairmont drive could open as soon as tuesday. but the actual blast site will remain closed. the september 9th explosion created a # 2-foot crater that. area is fenced off and patrolled by guards. repairs to a 10-inch crack under the san mateo dow jones industrial average have been very expensive. the price tag is $1 million and the pay area toll authority says it could be even higher if more work is needed. the crack was discovered during a routine inspection on october 13th after four days of work it was fixed when crews put in new steel plates. cal trans still does not know what caused the damage. revenues from bridge tolls will

pay for the repair. time now 7:24. sal, do we still have that major mess on 580? >> we do and unfortunately we have a new problem, northbound 880. look at 880, it's at a stand still because of a motorcycle accident at 23rd avenue near the 23rd avenue offramp, nine vehicles in that crash although it doesn't seem there are major injuries. there are injured people and traffic is at a stand still. i know at least one person on the way into ktvu that will be plate this morning because of the backup. you might want to think of perhaps using international boulevard. it is a huge mess. this monday isn't starting off well. we talked about livermore, 580, we had a crash that blocked two lanes arrest almost an hour near the hopyard exit.

the majority, it's taken 10 rounds of number crunching to determine the low # highest voters. pa rata's lead was 10% until rebecca cap lan's votes were distributed and quan stepped ahead by a little mosh a point. cap lan had 20,000 votes, 15,000 to quan and 5,000 to perata. >> there's a lot of advantages that people talk about with ranked choice voting. one is eliminates the need for a primary so everything is compressed into one election. that's certainly one advantage. the other advantage is since you eliminate that june primary and you have one election in november, the turnout is always higher so you get many more people voting for mayor in november than you would in june. >> reporter: we've been trying to get hold of the alameda

latest election results as soon as we get them on our channel 2 website. just go to ktvu.com, click on the election 2010 tab. it is 7:36. >> that's right. and university of california students are expected to find out today how much of a fee hike they will soon face. uc president mark yudof will present a meeting today. the daily cal reports students are already to protest the meeting. food vendors are in front of city hall to support two pieces of legislation today to make it easier for street vendors to operate in the city. vendors say the current permit process is too complicated and fees are too high. but some restaurant owners say food vendors don't have to deal with things like rent and other expenses. ubt the new rules, vendors would be required to notify businesses

before they set up shop and restaurants can air any concerns they have at a public hearing. muni is addressing a recurring problem with its train. according to the examiner, muni has been experiencing about 12 mechanical malfunctions a month. muni says the three main causes have been software, digital sensors and discorruptions in the communication system. they say trains should be noticeable bly better in the coming months. 7:37. we want to check in once again with sal. first there were problems with 580, now problems with 880. >> there's a multi vehicle blocking the two left lanes, 880 northbound at high street. it's additional to the 23rd accident where we had the nine-car pileup, so the traffic is at a stand still on 880. it's backing up into hayward so, again, we haven't had days like this and we come in on a monday,

we have the livermore commute implode and now we have 880 where we have an accident that's going to be there until 8:15. are you kidding me? this is a really bad commute. 580 is your alternate but 580 is getting crowded. it appears the traffic gods are trying to keep you from going to work on this monday. as a result the bay bridge is lighter because people aren't getting through. there is a little bit of a backup. if you look over to the left, the 880 ramps are not having a lot of cars come through. i wonder why that is? and traffic is going to be light. this might be your opportunity to get on to the bay bridge if you're north of high street. and one last thing, this is 580, we've mentioned it, westbound 580, that accident is gone now but traffic is going to be busy as you drive through the area. 7:39, here's steve. thank you, sir and a very good morning you to. for some it's sunny for everybody, a little chilly to

sebastian janikowski taking a live look at the big board on stall street, the major u.s. stock market is falling in morning trading after finishing last week at their highest levels for more than two years. a lot of traders taking a look at the rally that pushed the levels to not seen. while technology companies falling a relatively mild .1%. the dow currently down 57 at 11,386. 7:44. high unemployment in california is pushing the state further into debt. the "los angeles times" reports the state has borrowed almost $9 billion from the federal government so far in order to pay out unemployment benefits. some of that money will have to be repaid by next september. currently one out of every eight californians is without a job. the continuing borrowing means a hike in unemployment taxes for employers. time now 7:45. the federal government has

handed out billions of dollars? stimulus money but ktvu learned that some bay area cities that need the money aren't getting it. rio vista has not received any stimulus funds. this small town is deeply in debt. it can't afford to fix its roads. its city hall is closed to its citizens every friday. >> we've gone from close to 60 employees to 38. we don't know who else to cut. >> san francisco on the other hand received almost a billion stimulus dollars, most that have going to the new trans bay terminal project of the money was distributed based on population. as of now, all of the stimulus money has been handed out, but there's more relief reportedly coming from the obama administration in the form of tax breaks. 7:46. temp ares are flaring on the peninsula because of the tracks for high speed trains.

opponents gathered at the cal trans station in burlingame yesterday to protest what they call a high speed boondoggle. they say the 24-foot tall track will slice neighborhoods in two. >> 25-foot or more wall across our neighborhood. it's breaking it intoo two pieces. >> high speed rail! >> several local officials urged protesters to lobby tir state representatives to oppose the elevated tracks. many want the rail authority to reconsider the plan to put tracks in tunnels. the city of san jose isn't quite cover the costs of the new terminal at manetta san jose airport. the price tag is $1.3 million and now the city is $110 million short. city leaders say it's a of getting higher credit limits

travels abroad mean more jobs for americans back home. even though it's chilly out there, the sun has come out, which means the temperatures will warm up a little bit. but are we done with the rain yet? good morning, welcome back to morning's on 2. time torii campbell. >> and i'm dave clark. it's monday, november 8th. some of the streets are starting to reopen now after an overnight shooting that led to an unusual chain of events. at one point a shooting victim crashed into a house and that triggered a gas leak. ktvu's kraig debro has been out there all morning. he's live back with more on what investigators are doing right now. good morning, kraig. >> reporter: good morning, dave. high street now open. it was closed from about 2:00 this morning until just about five minutes ago. that's good news for commuters.

you can see the vehicle that crashed into that greenhouse is gone. that man in that orange and yellow vest, that's a pg&e crew member. he's checking to see if that house is safe to enter. the family that lived in that house was an a transit bus this morning. the bus is gone and i saw the outside the house, so that's good news for them. that began at 2:00 this morning. that white car that you saw earlier in the show crashed into that house, it was parked in an alley nearby. just heard from this police. it's still not clear if the person was shot and drove off or perhaps was driving off and then was shot, but according to police, the person did take some evasive actions by cracking up into the tree and losing control and then crashing into the house. wasn't the only problem police had on their hands. >> he hit the meter and the gas, when i went out the back door all you can hear was shhhh real loud. >> officers smelled gas on the

scene and they immediately evacuated the occupants of the house and looked at the vehicle and observed a male slumped in the driver's seat of the vehicle. >> reporter: the car smashed into the house had ripped open a gas line. people in homes nearby had to be evacuated. you saw just a second agatha the family is here and they're trying to fix the gas line, so the people could go back in their homes. as for the person that was shot originally police thought it might have been a hit and run, the person crashed into the house and ran. when they inspected the car, they found the person was inside and had been shot one time. as of two hours ago, they had not been able to contact the registered owner of the car. that person does not live in oakland. that car had not yet been reported stolen when i spoke to the officers last, who knew

about that, about five in the morning. right now, high street back open again, one family remains out of the house. it seems they might be getting back in in just a minute but there is a mystery here as far as the oakland police, they want to know who the person was that was shot and who shot him. it is 3 minutes after 8:00. the gym at claremont middle school in oakland will probably be off limits today following an overnight fire. we just called the school and left a message to find out for sure. firefighters rushed to the school on college avenue shortly before 2 a.m. the fire was contained to the roof of the school's gym but generated a lot of smoke. no injuries are reported but the gym has a lot of water damage. firefighters say they suspect an electrical problem may be to blame. in vacaville the search continues for a second suspect after a school was robbed. police arrested 18-year-old tyler barker saturday morning

after a brief foot chase. officers recovered two computers and a monitor believed to be stole frn orchard elementary school. a second suspect got away f you have have any information, you're asked to call vacaville police. santacruz police have release ad sketch of a suspect of assaulting a girl. the suspect is between 27 and 33 years old. he's about 5'9", weighing 150 pounds. police say the suspect tried to attack a 15-year-old girl in oceanview park but she managed to escape. johannes mehserle remains behind cars bars this morning of he is awaiting his next court date. ktvu's claudia wong joins us from the newsroom. >> reporter: yes, in two weeks things could change. that's because a bail hearing haerg is going to be held in this case and johannes mehserle's client is hoping his client will be set free on

appeal. his attorney has promised to appeal his involuntary manslaughter conviction and will is for mehserle's release during that process. meanwhile, mehserle is accruing time towards his between-year sentence. where he is going to serve his sentence is still unclear. his attorney has said he's concerned about mehserle's safety and legal analysts say that is a very real concern. >> i think he's going to face a lot of difficult time. he may not even be -- they may have to send him out of state but this record is going to follow him around. they're going to know who this is, so he's going to have -- i mean it's a dangerous situation for him. >> reporter: you're looking at voted from right after the sentencing and the protest that is followed. some organizers are promising that there will be more protests. now in this rally there were 152

people that ended up being charged with unlawful assembly. mehserle's attorney says the former officer knows the relationship between the community and police have been damaged by his actions on the bart platform back in 2009. the judge also acknowledged that there has been polarization in the community. certainly the community is still feeling the effects. this is what it looked like when businesses left their businesses in downtown oakland. we do expect some of them to reopen for the first time today since friday. they had closed down because they were concerned about what protesters would do and some had to spend the weekend cleaning up after protesters did some damage. that damage was minor compared to the violence we saw after the verdict last july. the religious community also getting involved. they are hoping to turn any frustration that came from this sentence into a positive force for change. >> now, that would have been something great and we'll do it all in the honor of oscar grant. we'll do it in his memory. what a tremendous legacy oscar grant would leave for the city

of oakland. >> reporter: for the family of oscar grant this isn't over. this was them walking out of the courthouse after the verdict. they believe the system failed but they are still hoping that the justice department will answer their pleas and will take on this case. in court friday, mehserle's attorney argued it should not have been a criminal case but a civil one. there are civil suits pending. bart did settle one for grant's daughter but there are still more including one filed by oscar grant's mother. we have continuing coverage of the case on our website, ktvu.com. time now 8:08. on a lighter note this morning, bart is collecting on a world series bet. >>  my love waits there in san francisco above the blue and windy sea   >> nice guy, but he can't see. that's gary thomas saying i left my hart in san francisco.

other traffic information. let's start with 880 northbound, because of a crash it's not going to be clear in the next -- or it's going to be cleared in the next time to ten minutes. 88 northbound, huge delays coming out of hayward. if you look at the poll plaza, people haven't been getting through, it's a little lighter than normal and that ramp from 880 is empty as people aren't getting through at the same frequency they normally do. on highway 101 at university avenue, there's a crash there. look at 101 palo alto, it's awful and take a look at the east bay, traffic on 880 is very slow in both directions. and if you're driving in contra costa county there was an accident of a the venetia bridge. sal, thank you, sir. very happy monday. now, mostly clear skies after yesterday's system, pretty good rain, pretty good punch for

some. i'll show you some total here in second. rather brisk, northwest wind, though has kicked in for many especially along the coast, 20 mile-per-hour. sunny but breezy and cool today, clouds increase tuesday and late rain tuesday. this will be a weaker system coming in tuesday night into early wednesday. the 7-10 day outlook after we get past wednesday morning, all signs point toward sunny and warmer, possibility of being much warmer. both our forecast model are showing. everything will be diving into the middle of the country and high pressure will be right over california. today everything is coming out of the northwest so it's a cool pattern. couple of rain totals, hidden valley lake up in lake county, 2 and a quarter inches of rain. so some had some pretty good rain here. canfield an inch and a half, san francisco inch and a third. oakland 1.26, that's good.

crockett almost a half inch of rain. red wood city, .31, and in the santacruz mountains and coast, 1 to 2. sunny but cool and breezy, 50s, 60s and 60s. there won't be much of a spread from those on the coast, inland or around the bay. started off 44 for antioch. along the great highway, it's rather windy as we talked about, so sunny, 52 right now. we'll go for a high of 59. then start dropping i think after the noon hour. 40s and 50s, napa and santa rosa, 45. palo alto is 50. they were 47. 25 up in tahoe, sacramento was down to 41 so they had cool air in southern california. there's that next system right there. it will dive right in on us from the northwest tomorrow, so cool

welcome back. time now is 8:15. we've got an update for you on a hearing happening in washington d.c. this morning where investigators arein r unveiling a tentative report on the cause of the gulf oil spill. the oil spill commission is in charge of figuring out what caused this spill back in april that killed 11 workers and released more than 200 million gallons of crude oil into the gulf of mexico. so far this morning the commission says its investigation did not find any

instances where any company cut corners on safety in order to reduce costs. several democrats in congress accuse bp of sacrificing safety to cut costs in designing that oil well that failed. the commission's final report is expected in january. 8:16, president obama is wrap up his 3-day visit to india. he just delivered a major address to india's parliament and as ktvu's allison burns reports, he's touting new trade deals. allison burns joins us live now from our washington d.c. bureau. good morning, allison. >> reporter: good morning to you, torii. president obama is emphasizing that even though se overseas, his focus is on jobs here at home. here's a look at the president's arrival at the presidential palace in india a few hours ago. he's obviously here with the first lady. se using the 3-day trip to

promote trade to india. he announced $10 billion in trade deals that will support 54,000 jobs in u.s. including plans for india to buy i will tear and commercial -- military and commercial planes from boeing. president obama earlier secretary of defense trade is a win-win for both countries. >> it is my firm belief that the relationship between the united states and india bound by our shared interests and our shared values will be one of the defining partnerships of the 21st century. >> reporter: there have been in lights moments on the trip. they're at a state dinner now. they'll spend the night and leave for jacarta in the morning. 8:18. the ceo of qantas airlines says the fleet of jets

will remain dwrunded indefinitely after new problems with the plane's engineses were uncovered over the weekend. the planes were grounded after a plane burst into flame after a landing. now qantas officials say three leaks have been found on three different airbus jets. a bizarre and very disturbing story, a french newspaper reports al qaeda in iraq tried to blow up planes headed here to america by surgically planting bombs inside of dogs. then putting those dogs on the planes. the plot failed but the bombs were so badly implanted inside those dogs, the dogs died. american soldiers working in baghdad's airport cargo area noticed the dogs had died and soon found the bombs inside of them. 8:19, san bruno police tell ktvu news they've increased patrols outside capuchino high school this morning.

that's where some members of the westboro church took their campaign begins gays. the group if kansas also picketed picked outside of youtube headquarters. they claim both youtube and san bruno schools strongly support gay rights. just this past weekend, this same group stage ad protest outside the funeral of a fallen u.s. soldier in westen, missouri. sergeant first class c. j. sadell was killed in an attack in afghanistan last month. the topeka, kansas, kurch believes u.s. deaths in afghanistan and iraq are punishment for the country's tolerance of homo sexuality. a new controversy over california's lethal injection penitentiary. the department of corrections says it has enough of these drugs to carry out up to four executions. however, some death penalty opponents are questioning where

the state got those drugs. that's because a judge called off a scheduled execution back on september 30th because the state's supply of lethal injection drugs had expired a corrections department spokeswoman would not say where the state found the current supply of those drugs. it is 8:20. it's been a dangerous couple of days in pedestrians for freemont, the intersections where two people lost their lives. a very big bill for a small crack on the bridge. 880 is still not a great commute. coming up, we'll tell you what the best way to get around this mess is.

83-year-old salim nosrat friday morning. police say the suspect was in a light colored 1995 toyota ava lon similar to this one. if you have any information you're asked to call freemont police. repairs to a 10-inch crack under the san mateo bridge have been expensive. the price tag is a million dollars. the toll authority say the price could be higher. after four days of work it was fixed when the crews put in new steel plates. cal trans still doesn't know what caused the damage and revenues from bridge tolls will pay for the repairs. check in once again with sal and traffic, a lot of problems out there. >> it's not good. as a matter of fact, we've had one of the worst monday commutes that i can remember. let's go and take a look at the

register's office and we've been told 30 to 40 workers will be in the office doing what they have been for a week. the winner may be revealed today. for the first time ever, oakland voters ranked their top three choices. that created an interesting shift in votes since no one's got a majority. it's taken ten rounds of number crunching to narrow the choices. cap lan had more than 26,000 votes, 15,000 of which went to quan, 5,000 to per rat:the ranked voting is supposed to eliminate the runoff process which can be costly. >> there's a lot of advantages that people talk about with rank choice voting. one it eliminates the need for a primary so everything is

compressed into one election. the other advantage is since you eliminate that june primary and you have one election in november, the turnout is always higher so you get many more people voting for mayor in november than you would in june. >> reporter: also the 11th congressional district seat is still undecided this morning. only 421 separates democrat jerry mcnerney and republican david harmer. 3,000 ballots have still yet to be counts they had this race and today will be the first full court hearing where republicans are challenging the contra costa county registrar about signature verification of mail in nfls. we'll have more on this on noon. also no one has been declared the winner yet in the race for state attorney general. the latest numbers, here they are. they show los angeles district attorney steve cooley pulling ahead of san francisco direct

attorney kamala harris. cooley has 46.1%, harris 45.6%. state election officials say this race may stay too close to call as they finish counting mail-in, provisional and damaged ballots. we'll post the latest election results as soon as we get them on our channel 2 website. just go to ktvu.com, click on the election 2010 tab. oakland police are investigating the motive in the shooting death of two teenagers in west oakland. officers say the victims were attacked while sitting in a car on 8th street saturday afternoon. police are not releasing their names but say one victim was a 17-year-old from hayward, the other was an 18 year from east oakland. police say they were shot from someone outside the car and decided at the scene. >> it's not right at all, that all these people around here did nobody see nothing, that's not right. >> police say the car was not

registered to either shooting victim. so far no arrests have been made. a man accused of brutally attacking an elderly woman three years ago is due in a san mateo county courtroom today. prosecutors say they will select a jury today in the case of 31-year-old josi perez gonzalez. he's accused of beat the woman with a crow bar. aarraignment is scheduled today for a richmond woman accused of abandoning her 18-month-old son. 41-year-old sandra samuel was. investigators say the mother told them she was not fit to care for her son. the little boy is in protective custody. university of california students may find out today how much of a fee hike she'll

sooning paying. uc president mark yudof will hold a briefing this morning. he'll talk about the items presented to the board of regents during a meeting next week. the daily cal is reporting students are preparing to protest the meeting. san francisco food cart vendors are parked outside of city hall right now. they are there to support two new pieces of legislation discussed today that would make it easier for street vendorses to operate in the city. they say the current permit process is too complicated and fees are too high. >> i mean it's really a long process that can take months. we worked on it for in between anywhere from 8 to like 12 months just on getting the permits and then you're talking about ault fees that come in. >> permits could cost up to $10,000, which some restaurant owners complain that food vendors don't have to deal with rent or other expenses. there's also concern they may not undergo the proper health inspections if they operate

illegally. under the new rules, vendors would be required to notify businesses before they set up shop so restaurants can air any concerns they have at a pub hearing. muni says it's fixing a recurring problem with its trains. according to the examiner, muni has been experiencing about 12 mechanical malfunctions every month which adds to delays. muni says the three main causes have been software, digital sensors and disruptions in the communications system. it says it's been fixing those problems and says train service should be noticeably better in the coming months. gasoline prices are holding steady here in the bay area but creeping up a little bit across the rest of the country. the national average for a gallon of regular is now 2.85 according to triple a. that's up a nickel from last week n oakland and san jose the average is close to $3.17. san francisco still has the highest price for gas in the country, $3.24 a gallon.

this one, though. 50s, 60s, that's it. five-day, clear cool, mostly cool, clear. clouds increase tuesday, it's gone thursday and sunny and warmer weather. dave. time now 8:40. a marin county firefighter is being called a hero. he helped res two people stranded at sea. now, the boaters ran into trouble yesterday when their boat came dangerously close to rocks near rodeo beach. luckily a firefighter was surfing nearby. he convinced them to get off the boat and helped them swim to safer waters where they were rescued by the coast guard. federal investigators are investigating this, a cause of a plane cash in so noma county. this plane went out saturday afternoon shortly after it took off. a man who was a passenger on the plane is in the hospital in serious but stable condition. the pilot who's from san

it is 8:44 and bring you up to date on some of the top stories we're following now. streets are back open right now after this overnight shooting and crash in oakland. this shut down high street near culver. also caused a gas leak in the area and 10 houses had to be evacuated. we just heard from school officials at claremont middle school they're telling us the school's gym is closed following an overnight fire that started on the roof of the gym. classes are not affected. the cause of the fire is under investigation. some of the streets that were closed by that deadly gas pipeline explosion in san bruno could reopen by this wednesday. however, the crater on glenview

drive that was created by that blast, that's going to keep that particular street closed until the investigation is complete. 8:45, high unemployment from california is pushing the state further into debt. the "los angeles times" reports the state has borrowed almost $9 billion from the federal government so far in order to pay out unemployment benefits. some of that money will have to be repaid by next september. currently one out of every 8 californians is without a job. washington has handed out billions of dollars in economic stimulus money but ktvu has learned that some bay area cities that need the money are not getting it. rio vista, for example, has not received any stimulus funds. the small town is deeply in debt. it cannot afford to fix its roads and city hall is closed every friday. >> we've gone from low to 60

employees to 38. >> on the other hand, san francisco received almost $1 billion stimulus most of that goes to the trans bay terminal project. tempers are flaring unat peninsula over plans for elevated tracks for the proposed high speed train. you can see opponents gathered at the cal train station in burlingame yesterday. they were protest whag they called a high speed boondoggle. they say the 24-foot tall track will run through the heart of burlingame and slice some neighborhoods in high. >> 25 foot or more wall across our neighborhood. it's breaking it into two pieces. >> high speed rail! >> several other local officials urged protesters to lobby their state lawmakers to opposed the elevated tracks. many want the rail authority to reconsider a plan to put tracks

in tunnels. that idea was thrown out earlier this year because of high costs. the city of san jose is having trouble covering the costs of the new terminal at the san jose airport. the price tag is $1 -- the city officials say it's a matter of getting higher credit limits from the bngs. they say they're confident they can get credit extensions from some of the loan holders. africa does not have enough inspectors to check out all 5600 restaurant and food preparation facilities in the city according to the public health department. the hept defendant has 19 trained inspectors right now. there are supposed to be 23. all facilities must be inspected at least twice a year. but the staffing shortage means some restaurants are only

inspected once a year. the health department says it takes months to hire and train new inspectors. yale researchers say fast food marketing to kids is increasing and the featured meals are extremely unhealthy. the worst of all kids meal combinations came from dairy queen and included a cheeseburger, french fries, a suggestion shf sweetened soft drink and a dilley bar for a total of 973 calories. out of the 3,000 meal choices only 12 met nutritional guidelines for preschoolers. the best of the bunch was subway's veggie delight with 100% juice and apple supplieses. people who didn't get a message about the glitch in the iphone may be getting up an hour late this morning. apple warned iphone users that repeating alarms may not recognize the end of daylight saving time and users should delete repeating alarms and set

them manually until after november 7. they say if you recreate the alarms today, everything okay. some researchers warn men using a laptop on your top could leave you infertile. they studied 30 men using laptops and found an increase in their scrotum. high temperatures can damage sperm. one in six american couple experience trouble conceiving. a group of sanford grad students has helped design a laptop computer that can be easily recycled. the stanford daily newspaper reports that the laptop can be taken apart in a matter of 30 seconds. that compares to 45 minutes for most laptops. students say it makes it easy to separate it makes it likely it will be recycled rather than
