up in flames. a live report from san carlo coming up. >> reporter: good afternoon. we begin with the investigation into a fatal officer-involved shooting in oakland. the shooting happened at 9:30 near trask and bancroft avenue. it started with a domestic dispute at a local laundromat. kraig debro is live with more. >> reporter: good afternoon. in about an hour from now, the oakland police are going to give more information about this case they are working on. ktvu has already spoken to two people who said they saw everything and we've spoken to some family members of the person who they say was shot and they say they've already drawn a conclusion about what happened. >> nobody deserves to be murdered. know one. >> reporter: is it a murder for

you? >> it's a murder. we're gonna prove that. >> reporter: police are not ready to call the man the victim. they say he was a suspect with a domestic dispute, when two officers confronted him on bancroft and seminary. >> he asked the girl to leave a thousand times. she refused. the girl was the aggressor. >> reporter: late this morning, a memorial of balloons and flowers started to grow at the front door. late last night police say two officers shot and killed him less than 100 yards away from the shop. >> as officers were investigating a disturbance, it was involving a man and a woman. the man fled the scene. other officers responded to the scene to assist located the man and there was a foot chase. during that foot chase, officers discharged their firearms, striking and killing the man. >> reporter: eyewitnesses say they saw jones hide between two

cars on trask as officers gave chase on foot. the officer spotted jones. one of them grabbed them. according to our witnesses, jones broke free across the street and tried to jump a fence. he couldn't make it and fell to the ground. witness says jones was rolling around on the ground because he was hurt in the fall. that's when the officers opened fire eight times from five feet away. >> right now we've not located a weapon. he's not been searched. we're waiting for the coroner's office to come out and do the search. everything is still pretty on in the investigation. >> reporter: of course, that was last night. this morning, officer thomason said they had not found a weapon initially. late this morning, a a gathering -- a gathering formed outside of derrick jones's home. the family was at the house celebrating his mother's birthday. >> he would not have called the police. any time he's called the police

in the past, they take him -- him away. >> reporter: jones 'says ter said he was on patrol -- sister said he was on parole and did not want to go back to jail. officers involved are on paid leave pending an investigation by internal affairs and the county d.a.'s office. now, in the past officers have been very careful when they fire. they are very careful to tell the suspect not to move but if the suspect moves, they retain the right to defend themselves according to oakland police department and other departments across the street. in about an hour from now, the police will be giving us a live news conference and we'll have that live at 5:00. back to you. >> thank you. a man accused of robbing and kiming a woman -- and

killing a woman in her apartment had had an arraignment today. he did not enter a plea. the public defender asked for more time to assign the case to a more senior defense attorney. prosecutors say october 29th, holland gained access to the woman's department after claiming he was checking on a gas leak. he's charged with murder, burglary, robbery, and attempted rape. the district attorney has not decided whether to pursue the death penalty. >> there's three charge, murder during the commission of a robbery, murder during the commission of a burglary and attempted rape. >> the suspect is currently being held at the jail. right now, firefighters are trying to salvage memorabilia

from the singer neil jones at the warehouse where the items were stored. jade hernandez has more on what investigators are saying now. good afternoon, jade. >> reporter: good afternoon. the musician is legendary. his music still inspires. but neil young's memorabilia, band equipment, painting, vintage cars were almost all destroyed in this warehouse that you see behind me because fire ravaged the warehouse. ♪ heart of gold ♪ >> reporter: neil young is like everyone else -- saving his prized possessions storing them away in a safe place. but overnight that place, a san carlos storage warehouse went up in flames. >> it will be a significant amount that they will be salvaging. the structure. we had -- we have about $1 million loss to the structure

and similar amount to the items. >> reporter: the department arrived and captured this video as they arrived. half a dozen cars, band equipment, all destroyed here housed in the nearly 12,000 feet of space. young had representatives out here surveying the damage. no one would comment on where the items would be damaged. firefighters said the representatives were very grateful. >> they were very grateful to the fire department that we saved a vast majority of mr. young's equipment and also the way the firefighters took good care of a lot of material and film thnever be replaced. >> reporter: firefighters saved about 85% of what was inside. rock n' roll hall of famer lives in la honda. back in the '60s, he formed a

bond with crosby, stills and nash. this fire was not deliberately set but it is under investigation. we're told the building didn't have a sprinkler system. firefighters say if there there was a sprinkler system inside, much more would have beenal advantaged. back to advantage -- been salvaged. a man is in the hospital after being struck by a train around 10:20 at whipple avenue near el camino real. the man has been taken to the hospital and is expected to survive. service has been restored in both directions. cal train is investigating the incident. >> it could be several more days before final results are released in the oakland mayor's race. the latest results still show jean quan leading don perata by

fewer than 2,000 votes. the registrar of voters plan to announce a winner, but they are still counting ballots. can you find more election coverage by clicking on the "election 2010" tab at the top of our home page, ktvu.com. today, the san francisco board of supervisors will ask its staff to come up with a plan for replacing mayor newsom when he takes office as the new lieutenant-governor. voters will not be asked who they want to finish up his office. if that were to happen, a special session would have had to be called. newsom will be sworn in on january 3rd. his term lasts through the end of next year. university of california students are facing another 8% tuition hike come this fall. that's on top of a 32% increase that took effect earlier this

year. the newly proposed tuition hike would amount to an extra $822 for undergraduates. university officials are also proposing raising the retirement age from 60 to 65 for future employees. the uc system faces a $1 billion shortfall but students say they are already struggling. >> i'm gonna have to take out more loans in order to come to berkeley and i think that's a reality for too many students here today. >> the uc board of regents will vote on the plan next week. fliers are already circulating calling for students to shut down the region. and the cal state system is also considering raising tuition. >> trustees meet tomorrow to vote on boosting tuition for the second half of the school year. the other would increase the tuition by an additional $440.

the pentagon has a missile mystery on its hands this noontime. take a look at this. a news helicopter shot this video last night of what appears to be a missile streaking across the sky off the southern california coast. so far, it is unexplained by anyone in the military. the defense department, department of defense says it did not launch any test missiles last night and the navy and air force say it wasn't them either. president obama and first lady michelle obama are now in south korea after a quick stop in indonesia where the president had spent four years of his

apologizing for using a fake name when trying to join an online discussion group about the company's smart meters. william devero is the director of the smart meter program. he tells ktvu that he is responsible for finding out what the public thinks about the smart meters. he used a different name but his real name came up with his e-mail address. the moderator recognizes him. some called it spying and unethical. tomorrow, the metropolitan transportation commission could approve taking the first step to building a new bridge across the bay. a midbay bridge is being discussed as a way to take traffic off the san mateo and bay bridges. it would link peninsula cities near sfo and the east way to

on live stormtracker2, a few light showers make their way into lake and mendocino county. the leading edge is still to the north. a few showers will inch in here in the next couple of hours. it's already cloudy in ukiah. sunshine and clouds. clearing tomorrow morn, it will be still be a cool day tomorrow but then friday into sunday looks warmer as we head towards sunday and monday. not much going on yet but the clouds are getting closer. this is a wider shot. it shows that system just starting to move in. it's very week. after this system it look like high pressure comes in for a while. sunshine, then clouds, more towards the north and the south. temperatures staying below average. last week was warm, we were muggy, we were 10 to 15 degrees. we're staying below. 62 oakland. 57, santa rosa. that's noticably below. san jose, 63. should be 66 this time of year.

taking a live look at the big board on wall street, stocks pulling back as traders retreated from a rally that brought indexes to their highest level since the peak of the financial crisis in september of 2008. the dow, you may remember, surged 2.9% last week after the fed announced a $600 billion stimulus package for the u.s. economy. gold, crossing $1400 an ounce, to another record, as traders look for safe places to park money. the dow is down 59, at 11,347. today, chevron announced the latest acquisition in the energy center. the oil company announced it's buying atlas energy of pennsylvania. chevron will pay $3.4 billion for atlas and take on an additional $1 billion of that company's debt. natural gascon sum shun is expected to grow in the -- gas
