the demonstrators are headed to the fruitvale station. paul chambers is live with more on this. >> reporter: we are live at the fruitvale bart station. there are vendors selling things to many people. within the last several minute, police came in here and told the vendors to close shop and to move out. the reason, let's show you from chopper 2. today's march is in support of derrek jones. jones was killed by police. marchers in this family members of jones and grant. the families are now connected. >> he could have been shot to be subdued, but he was shot to be killed. >> all they knew he is allegedly assaulted a woman,

and they wanted to make contact with him to investigate, he ran and they opened fire. >> officers think they can manufacturer the same generic story. >> reporter: the families gathered outside of jones barbershop which is where the near of where she was killed. today's march is to give more insight of the man who was her brother. >> a young black male who was respected in the community. had a huge clientele. >> reporter: oakland police say they are sensitive to jones' shooting. jones sooting is the fourth officer involved shooting, and the third where the suspect died. >> we want people to obey what officers command are. if the officer says stop, put your hands up, we want people

to obey that. >> reporter: we have officers near by just in case the march does not end peacefully. the coroner's report says jones was not shoted in back as reports said he was. and i believe they will have a couple of words out here and of course anything that happens within the time period of our show. we will bring it to you live in the fruitvale bart station in oakland. i'm paul chambers, ktvu. it was one of the worse traffic jams on the golden bridge. tonight we're learning new details about what may have led up to all of this. sal castaneda is live in yerba buena island with more on this. >> reporter: frank, let me show you where the man stopped his car. right here you can see the bay

bridge. he stopped his car about a mile from treasure island where we are in the right lane. minutes later police rushed by stunned commuters with guns drawn in the westbound bridge was closed. thousands were stopped at a huge traffic jam. police first became aware of the problem when the man was still driving and telling police dispatchers he was going to blow himself up and that he had his 16-year-old daughter with him. as the man drove his suv across the bay bridge, he pulled over about a mile past treasure island. police closed the lower level of the bridge almost immediate yachtly after they saw -- immediately after they saw the man holding what appeared to be a weapon. >> he pointed it straight in the air. from the police standpoint, it seemed to be a real weapon. >> reporter: police coaxed the man to letting his teenage

daughter then surrendered himself. the guns were later found to be fake. many more had to find a way to get into san francisco. >> to me was outrageous. the traffic was backed way up. >> reporter: 51-year-old craig valentino of antioch. police say he was distraught bauds of marital and financial problems. valentino is being held in san francisco, a restraining order was issued this morning to keep him away from his family. many we spoke to say they are reminded how one man's problems can cause havoc to others. >> it's horrifying how one person can bring things to a standstill in that way. >> reporter: it's interesting throughout the entire time, the upper deck was closed, but authorities never did close that lower deck of the bridge. police say they didn't believe that the bomb threat made by

investigating an early morning shooting that led a man to the hospital. crime scene investigators examined several bullet casings, a neighbor says that there was an event at a near by bar and there was a lot of people in the area at the time of the shooting. >> i was asleep and i heard some gunshots, four or five gunshots. then may grandson got up, he looked outside and saw a man laying over there in the sidewalk. >> the victim's injuries are not considered life threatening. the tesoro isle refinery is back open. the fire led to a shelter in place. last night all six of the refineries flairs were burning off fuels during the outage and there was concerns about all of the smoke and particulates in the area. i want to show you a live

suddenly in more demand than ever. today her first day as oakland's new mayor elect. in one of the first duties, a veteran's day salute to retired members of the military living in an oakland seniors community. >> mrs. ruby pain from the army. >> reporter: on election night nine days ago, don perrata seemed to be the victor. easily winning the most first place votes, but since he didn't cross the 50% threshold under oakland's ranked choice system. second and third choices were factored in. yesterday it became official that those votes pushed quan into the race. >> have you congratulated quan? >> i have done, i have done. >> i won by 11,000 votes on the popular vote. and i defeated jean quan in 78%

more pressing problems, they both say it's time to move on. randy shandobil, ktvu. someone here knows a thing or two about bay area qualitities is speaking out on ranked choice voting. willie brown says don perrata is the victim of a flawed system. brown says he disagreed on the choice voting and making the process unpredictable. >> how can you say if you can't vote for me first, vote for me second, if you can't vote for me second, vote for me third. none of that makes sense, in a democracy it's the winner takes all. ranked choice voters allowed oakland residents to select a first, second and third choice. perrata had more first choice votes but quan had more

combined first and second choice votes. cooley is in the lead with a .10% of the vote. a new poll suggests that most americans favored more tax cuts but oppose a repeal of president obama's health care reform legislation. 53% of those questioned said the tax cuts that are about to expire should be extended for everyone including the wealthiest americans. 44 of those support tax cuts but only for those making under $250,000 a year. for all of the latest on last week's election you can always go to our website ktvu.com and click on the local politics tab on the home page.

back now to breaking news, our top story, we mentioned just a moment ago that the fruitvale bart station is now shut down because of a demonstration going on. paul chambers is live now with more on the situation. >> reporter: there are a lot of protesters, they finally just got here recently. they made it to the area. they have shut down the bart station within the last 10 to 15 minutes. as you can see there are a lot

of protesters and a lot of officers just in case something happens. so far there's been no issues whatsoever. but just in case something happens, police will stay out here. as you can see from our chopper, i'm not sure exactly what you can see from the chopper because a lot of people are within this bart station right here. bart has closed it down. we also know the ac transit has stopped running bus service through this area. they have removed everyone who is on the bart platforms out of the area. they got them away safely and they have shut down the bart station. as of right now they have a candlelight vigil going on. police say they are very sensitive to this case. they understand the hostility and is why they are going to allow people to speak and say what they have to say. and hopefully this will end up peacefully. we'll have another report

coming up in the 6:00 hour. reporting live in oakland, i'm pall chambers, ktvu channel 2 news. medical marijuana patients in marin county may soon have the option of getting home delivery. they will begin deliveries next week. fairfax approved the service back in june. now has insurance in place to protect itself and the city. couriers will carry no more than 5-ounces of marijuana at one time. and applicants would have to undergo extensive background checks, provide security and pay any bad taxes. it's unclear how the state or federal government will respond as medical marijuana is still illegal under federal law. tesoro is starting up their refineries one more time. but it is lacking something

yesterday. now there's serious questions. >> reporter: we gave tesoro every opportunity to answer this question, is this plant really safe enough to put back into service? during yesterday's flames, flairs and toxic releases, tesoro refinery spokesperson said something shocking. >> there's not enough system as far as back up type units to man a refinery like this in this situation. this is an emergency situation with a total loss of power. so we don't have those type of generators on hand. >> reporter: in other words if pg & e's power goes out this could happen again and again, and the neighbors such as those here in clyde don't like it. >> they should have some back up generator that if the power goes out, they don't have to

put those flairs. because it's release toxins into the air. >> how could they not have a backseat up plan? other refineries do it quite differently. >> we have to have the right kind of equipment to be able to isolate ourselves so we don't cause problems inside the refinery. >> reporter: three other major refineries, chevron as well as valero and shell have their own big power plants that generate 90% of the power they use. and even if they're power shut down, they can still produce power. >> it's important to generate our own power. we have ways to make up some additional power and we have procedures in place. we can get the refinery into a

stable condition. we don't know if the rodeo based conoco facility does or does not have back up power. the refinery did not go back up because of the veterans day, but it's something to consider. this isn't the first time tesoro has faced a problem at one of its refineries. the last time the refinery in martinez was forced to shut down because of a fire was back in march of 2006. the tesoro plant is also under an investigation. that explosion killed four workers. you can go to ktvu.com and click on the bay area news tab. stranded at sea no more. the stranded crew is over. now the nows of passengers on board a doomed carnival ship

golden gate ferry riders will not be facing significant fare hikes in the near future. district officials have backed down from a plan that would have raised fairs for some riders as much as 32%. that's after they received more than 400 e-mails and letters complaining about the proposed increased. a new proposal raises fares for some ferry riders by about 10%. a pg & e executive involved

in a controversy involving the smart meters has resigned. debreo is in charge of the $2.2 billion smart program according to pg & e he has apologized for his actions. the dmv has run into a roadblock in it's plans to roll out new driver's license licenses. the state has rolled into a new system to send out licenses. the dmv is issuing temporary licenses that are good for 60 days. that will give the state time to work out the case. an 80-year-old woman now reunited to her dog named deuce. she is exstatic to have him back. the dog was stolen two weeks ago during a purse snatching. >> he rubbed his head on the carpet when he first went in. he drank water and wanted a treat. things are back to normal. >> boy does she look happy or

right now. it is a major inconvenience for commuters. you are looking at live pictures now from live chopper 2. they are supporter of a man who was shot and killed by police last week. and they have marched, they are talking ability -- talking about the man who was killed. at this point we know that trains are not stopping at fruitvale, instead your opportunities to get on or off would be at lake merit or at the coliseum oakland airport station. we also just heard from bart that they had set up a bus bridge. taking picture from the coliseum station to the fruitvale station. but again trains are not stopping at fruitvale. the reason that the people chose the fruitvale station, the shooting happened in east oakland, fruitvale is important to them because they are drawing a direct line of what

happened to derrick jones and what happened to oscar grant, the man who was shot and killed by bart police on new year's day of 2009. we will stay on top of this story and let you know when fruitvale reopens. some people slept under the stars, they weren't camping but they are raising attention on what it would be like to be homeless. craig debro has their story now from san jose. >> reporter: it's called poverty under the stars. every year for five years now, san jose state university students pinched tents and sleep outside to highlight poverty and homelessness. they soon learn a night outside is nothing compared to a life on the street. >> it got really cold. and it just, it makes you think. if we're cold, wearing a jacket and a scarf in a sleeping bag in a tent, how do people feel not having any of those. >> reporter: the 9-year-old son

of the group's faculty advisor has spent one night here since he was in kindergarten. >> i think the government should provide health care, food and housing for the poor. >> reporter: according to santa clara county, more than 7,000 homeless people were counted here last year. merely 5,000 of those were unsheltered homeless. people who sleep every night like these students did last night outside. >> poverty is not only for people who are identified as a guy with a long beard and sleeping on the street. it encompasses the whole community. >> reporter: a day before they set up their tents, the students found out that they too would have to pay a little more if they want to attend school next year. the cal state university system yesterday announced a 15% tuition fee hike for next year. >> there could have been better
