the crowd. you can see they are hear standing. they say they are out here for derrick jones. jones was killed on monday. his sister said he wanted to have this rally so people can learn more about her brother. she says she's not happy and wants oakland police to say. >> we have called the officers in to work this protest and hopefully it'll all go peaceful. we're here to protect people's first amendment rights and that's what we're going to do today. >> reporter: he was talking about what police are doing. you can see officers right here on stand by just in case anything happens. they want to make sure everything is peaceful. so far it's been a very peaceful protest. the people walked from the shop where jones was killed down here to the fruitvale bart station. as you can see i said officers were out here on stand by. i've been told there's no problems, no issues whatsoever going on. i do believe we have an

opportunity now to hear from the sister to hear what she wants to happen to oakland police. >> you know i want them to do jail time. they murdered my brother. i am appalled and shocked at the same time that something of this caliber would occur on the heels of the sentencing of mehserle. >> reporter: now once again we are live at the fruitvale bart station which has been closed for almost an hour now. the reason why is the protest, people are still right here having their voices be heard. police are allowing they will just to talk. just let them vent and get everything out. it's been a peaceful protest. there's been no problems whatsoever. the people are, as you can see have -- it was closed at 5:10 here at the fruitvale bart station. we do know bart is running a shuttle between the coliseum and lake merit to bring people back over here if they need to get their cars or things like

>> reporter: 51-year-old craig valen to the best tino first called a radio station then called police. he told police he had explosives and a gun. police said he was upset because he thought his wife was cheating on him. >> he seemed very agitated. he was very upset, very angry. and the discussions in which were taking place between chp and the suspect. >> reporter: valentino finally got out of the vehicle waving what seemed was a gun. he then told his daughter that he loved her and to go. after two hours after tense moments, police negotiators talked him into negotiating. the gun was later determined to be fake and no explosives were found. valentino later told police that he used to work for the red cross and is now security. it wasn't until about 9:15 when the bridge reopened. >> it was nervewracking and it

outside the home of christian selv era you can tell from his many trophies, he's a neighborhood soccer hero. but tonight he's a recovering surgery patient. so we appreciate the time to talk to us about what he's gone through as well as expressing the gratitude for the man who his family calls his guardian angel. >> reporter: 15-year-old sophomore christian salv era, a week ago he collapsed, had trouble breathing and his heart collapsed. >> i can't remember anything. after that morning, i can't remember anything. >> reporter: coach perez is a 20-year-old veteran paramedic and knew what to do. with the help of christian's teammates saved his life. >> i realized his breathing was irregular. i moved him to another part of the floor and realized he had

no pulse. at that time cpr was initiated probably within the first minute. >> reporter: last night doctors surgically inserted a defibrillator to jolt the heart when needed. >> his coach did an amazing thing for him and did it in a very quick manner with a level head. that's the most important thing. >> there's no word to describe or express a thank you for someone who saves your child's life. you just can't put it into words. over and over doctors kept the telling us how lucky we were that he was there. >> i'm so lucky that that happened, but it is -- that doesn't happen to very many people. >> reporter: and just a little while ago, we talked to coach perez and told him that christian was getting better. everyone though coach perez says that he is not a hero, he says that is his reward for what he did.

former state senate don perrada conceded today. perrata led on election night but fell behind when thousands of second choice votes were counted on oakland's first ever ranked first election. >> i won by 11,000 votes on the popular vote. and i defeated jean qaun in 78% of the precincts in oakland. >> i think it was a more democratic process and allowed more people to have more discussions. >> quan says she's planning for the transition. she spent her first day as new mayor elect with veterans.

mcnerney conceded today -- >> this is where congressman jerry mcnerney gave his victory speech late this afternoon. it was in his dublin campaign headquarters. as you can see now this office is completely barren. it is done, this race is over. >> the campaign workers have waited nine days to hear victory declared in one of the closest congressional rations in the nation. >> the votes are in, voters have chosen me to be the next congressman. >> reporter: mcnerney campaign says they have a lead over harmer. while 11,000 votes are yet to be counted, mcnerney says the trend is clear.

>> the lead is unsurmountable. >> reporter: we heard from harmer's campaign and they said they had no comment. the office was closed for the holiday. and the campaign will continue to monitor the vote count which will be complete before the thanksgiving holiday. >> job creation and the economy is job one and i am laser focused on creating jobs throughout our country but especially right here in our district. >> reporter: all along the 11th congressional district it was expected to be a tough fight. what has long been a republican held seat in this district. that is prior to congressman jerry mcnerney. governor arnold schwarzenegger is calling a special legislative session to deal with a $6 billion deficit

in budget. the new figure emerged a month after lawmakers find a new budget. the legislative analyst office project the congress office will balloon over the next 18 months. that includes a $6 billion shortfall in the budget package already signed in october. the session is set to begin december 6 when new lawmakers are sworn into office. a crippled carnival cruise liner inched into san diego today after spending three days adrift in the pacific. thug boats and coast guard cutters helped tow the ship back in. passengers were stuck on the splendor with no power after a fire on monday. passengers had to live without air-conditioning, hot water, telephone service and working toilets. passengers seemed very glad that the ordeal is over. >> the smell of the rotting food was just awful. it was just god awful. we had no lights for four days.

more live pictures now of the bart fruitvale situation. it is shut down by protesters upset about a shooting. you can hop on a bus that will take you back to the fruitvale station. from what we understand, no problems so far. police are letting these folks express their anger and hopefully once the rally winds down. the fruitvale bart station will reopen. we'll update you if we get any current information during this newscast. america's war veterans are being honored with events that are both solemn and patriotic. veterans, politicians and school kids all turned out for the veteran's day parade through downtown san jose. it's one of the oldest veteran

and so he died instantly. >> reporter: jessica lonjevine is talking about her husband john. he was killed with four other soldiers in afghanistan three years ago this week. he was 23 and jessica was six weeks pregnant with their taughter zoe. >> daddy. >> where is daddy? >> in heaven. >> i am thankful that we were pregnant and i have a little bit of him left over. >> reporter: jessica used his insurance money to buy this home and open a day care. she built a contractor to build a retaining wall. but last year's rain sent the a landslide. she couldn't get her day care license and fell behind with her mortgage. >> we can get this lined up for

that the fruitvale bart station in oakland is now reopened. it has closed down a short time ago because of a rally and march there. but we have just learned the fruitvale bart station back open at this hour. all right, let's talk about our weather now, because the word tonight is cold. >> yes, you bet, frank. frosty as well in the inland valleys. it's been a cool start to the year. we were talking about the snow making in the mountains. what we're going to see to be the in these inland bay valleys. i'm just kind of drawing some stuff in here. i want you to get a feel of where the frost and cooling temperatures. you get the picture, it's going to be real cold tonight. tomorrow morning when you wake up you will notice it. these were the highs from today. highs tomorrow will come up a few more. about two, maybe three degrees. you may top out at 70 degrees, 69 degrees something like that. but a warmer day tomorrow. and warmer into the weekend. but what's happening is the winds kind of calm down and as the high pressure sits over us

it's really beginning to cool. and so in those inland valleys, we're seeing patchy valley fog and cold frosty temperatures. it's not freezing, it's not a freeze warning but it's as we transition to winter, these temperatures are cooler than you might expect for this time of year. just be prepared. 36 in napa. that will get you frost. i'm sure if you go up towards forestville, you will hit a 62. 38 in livermore, when you leave the house tomorrow morning for school or work, you will notice it. it'll warm up quick, daytime highs tomorrow are going to come up. there was a few clouds today. high pressure is strengthening. there's no coastal fog to speak of. as the air goes offshore it actually sinks. out of this high pressure the air is sinking, so this pressure system will allow for our temperatures tomorrow to warm a few degrees. so lots of upper 60s and low
