there was extraordinary security in martinez today. that's where sheriff's deputies escorted into the courthouse, the seven men charged in the alleged two-hour gang rape of a 16-year-old girl at richmond high school during a homecoming dance october 2th last year. inside a preliminary hearing began to determine if there is enough evidence for the seven men to stand trial on charges of forcible rape and rape by a foreign object while acting in concert and robbery. most of the defendants are teenagers and all but bun -- all but one face enhancements that could send them to police in life. >> i can't make any comment on it. >> reporter: the first witness, was the first officer on the scene. he broke down crying describing the victim, "i thought she was dead when i first saw her." but when he took her, "she moaned." he said the girl was

unconscious under a picnic table naked from the waist down. the officer said he when he pointed his flashlight, the males a ran away but he couldn't identify them. he said her cell phone rang and one of the suspects picked up. phone and it was the victim's daughter, and he told him, how good his daughter was at certain sexual acts. manual ortega said. i just want to pimp her out and said go ahead and kill me. the officer saw her with scratch on her back moaning and vomiting. >> i'm anticipating approximately 20 witnesses and

i assume it will take probably two to three weeks. >> reporter: the teenaged girl police say was gang raped was not in court here today and is not expected to testify in this hearing. reporting live in martinez, rita williams, ktvu channel 2 news. lawyers for johannes mehserle are trying to get him out on bail pending an appeal of his manslaughter conviction. the former b.a.r.t. police officer was sentenced to two years in prison for shooting unarmed passenger oscar grant at the fruitvale station on new year's day 2009. johannes mehserle, seen her in an exclusive jailhouse interview with ktvu, is due to return to an l.a. courtroom in december for the hearing. his lawyers must prove he's not a flight risk or a danger to the attorney and this is not just a delay tactic to get him out of serving time. in tiburon, police say another early-morning chase may be connected to one last week. the chase started at 2:00 a.m.

when a car crashed. when officers approached the driver, he took off leaving him and he ran off in the bushes. police believe he's part of a group behind burglaries and darr thefts in the area -- car thefts in the area. >> one of the suspects in that case sounds very similar to the man we're looking for tonight. >> a yard-to-yard search came up empty. people are being asked to call police if they have any information that may lead to an arrest. kraig carlos valentino entered not guilty pleas. he's charged with several crimes, including kidnapping, felony child endangerment for holding his teenaged daughter and another felony for making a false bomb threat. the highway patrol said he's

lighting systems. in reversing that decision the high court noted that the benefits at issue are offered to u.t. citizens. some consumers groups and citizens are not happy about those full-body scanners being used at airports and the debate is being fueled by an incident at an airport. >> reporter: san jose international airport had their full body scanners installed in june and what has some travelers upset, they feel as though these kind of pictures are an invasion of privacy and they say the alternative of the body searches are even worse. the busy travel holidays are approaching but now some consumer groups are calling on travelers to boycott the tsa's full body scanners and demand

pat-down searches be done in a separate room. they call this an invasion of privacy. >> people who think it is should be able to put that out there and take another line. >> reporter: complaints escalated after a man recorded and posted his encounter with tsa in san diego after refusing a scanner check and being told his option of a pat-down includes a search of the groin area. >> if you touch my junk, i'm gonna have you arrested. >> later, the man was told if he refuses both procedures he can't fly. >> i don't understand how a sexual assault can be made -- >> this is not sexual assault. >> it would be if you weren't the government. >> there is a tradeoff here between having the full comfort of going through like you might have done 30 years ago and the tradeoff -- tradeoff today for security reasons. >> as long as i'm aware of what i'm doing.

million californians are not buckling up. let's go to bill martin and see what the changes are that are coming. >> you get warm days like today and you get cool weather by the end of the week. i will show you the system that i'm tracking. it's up here in the gulf of alaska. it's still forming but it's gonna make its way down to the coast. as that goes, mild, some breezy conditions in the hills. not as warm tomorrow and then a cool -- and then a cooling trend. today we saw low 80s. tomorrow we saw mid-70s. overnight lows will had been mild. if you were with us, frost advisory, near freezing temperatures. it's not gonna be that cold. mid- to upper 40s the next couple of days but those temperatures will come down as well. high pressure has been the big story right through the weekend. we had record heat yesterday. a couple of records today in

the north bay. the offshore winds are gonna die down. tomorrow the winds are gonna start to come onshore. as this system gets closer, a big cool weather system for your bay area weekend. this system, because it is coming from the gulf, will produce snow levels probably down around 4,000 feet. it's gonna be cool. there's gonna be snow accumulations like in the mountains, make a foot, maybe more. that's good news for those considering thanksgiving and the skiing of that time of year. we'll watch it closely but the real story, warm, then cooler and then wet at the end of the week. so the computer model, i start us on wednesday. you will see the showers, kind of offshore but then friday -- this isn't real heavy-duty rain. it's cool and drizzly. here comes the rain on saturday. it wants to stick around on sunday and monday as well. it looks as though the end of the week, early next week, wet and cool. forecast highs tomorrow you get the picture. a lot of os -- a lot of 60s.

the five-day forecast is nice for a few days. it's a slow gradual trend and we're into it on the weekend. not a major, major storm but a cool storm so it will feel like winter. san francisco police have lowered the boom on a street performer who used a fake grenade in his act. he eight parentally used a replica grenade. for a brief time the police closed down the street and called the bomb squad until it was determined there was no threat. police have cited wolf for misdemeanor possession of an illegal weapon. on wall street, stocks finished narrowly mixed. the markets lost most of their gains. it came with a reported rise in retail sales. it closed at 11,202. the nasdaq fell 2 points to finish at 2514. palo alto of based facebook
