>> i'm heather holmes. we start tonight with developing news in the north bay there. is late word from witnesses in napa who say a man was shot and killed by police. police haven't commented on the shooting yet. witnesses though at scene say swat officers surrounded a house between two and three this afternoon. when a man came out of the house he was shot. it's not known why the police why called to the house or if the man was armed. other news, it's a mad dash back to the bay area after the long holiday weekend. improved economic outlook prompted more to hit the highways and the airports. we are live at sfo with more on the trip home. >> reporter: hi. here at sfo passenger travel is up about 4% this holiday but you don't see evidence of it

today. about 50,000 passengers are passing through, about the same as a normal dame officials say they are surprised. >> it's actually been unusual. this year our busiest day was monday when it seemed like everybody left on that day. >> reporter: airport duty manager said sunday used to be the busiest day with people returning at once. people's plans have spread out on both ends of the holiday. >> i came in tuesday evening and i came in through jfk and it was fine. >> it was pretty easy. security went quickly. >> reporter: returning from chicago she said passengers breezed through the stepped up screening. >> glad to see that the whole protest didn't pan out . >> reporter: planes are take off and lengthing on time in clear skies here at sfo unlike yesterday when weather caused delays but no major problems.

since the saturday passenger load was the lightest of the holiday. if you are looking for crowds hit the california roads and. an 11% increase of drivers according to aaa. >> we were stuck in traffic, like hours of traffic. >> reporter: amanda drove nine and a half hours to take her friends to mill bray. to skirt the crowds some aren't even tied to the idea of the holiday being thursday. katie will spend tomorrow with her mother in sacramento. >> wanted to avoid the traffic, holiday traffic so i will leave to see her today and tomorrow. >> reporter: aaa credits a boost in consumer confidence with fueling the slight up tick with most of the action by car because it's cheaper for families to drive than to fly. as far as other bay area airports go the sunday afternoon the holiday is normally not a busy day and at

oakland things busy but running smoothly. live at sfo, ktvu channel 2news. >> well it was slow going for drivers heading out of the sierra today. this is what it looked like on a caltrans traffic camera at interstate 80 junction. this is about 3:30 and as you can see westbound traffic is backed up. earlier than usual snowstorm brought skiers and snow boarders to the sierra for the holiday. >> at least it's not snowing there right now. the weather cooperated with dry conditions. mark is here with details and chilly temperatures expected for tomorrow. >> reporter: that's right. the clearing skies, temperatures dropping off quite rapidly. here is the forecast at least in the short term. mostly clear skies, chilly numbers, inland around 40 degrees, around the bay mid40s and the coast in the upper 40s to around the 50-degree mark. that's setting the stage for a

very cold monday morning. the upper 20s toward santa rosa, livermore 30. you can count on patchy frost especially in those areas. oakland around 36. san francisco in the lower 40s. in the spot forecast for livermore -- right around the 30-degree mark, by 7:00 -- by 12:00 o'clock 49 and temperatures around 54 degrees. we are starting out in the 20s, 30s, and 40s. put it in motion and you can see where we are going into the afternoon. there is that green contour. the entire bay area in the low to mid50s for tomorrow. clear skies for today. the batch of high clouds moving through the area earlier this afternoon. there is activity in the upper left portion of the screen toward the north and west and we could talk about more rain chances coming up. i will highlight the timing of the next one, especially for one part of the bay area. >> three people are without a home tonight after an early

morning house fire in oakland. it broke out around 2:30. firefighter was able to keep the flames spreading to neighboring homes. firefighters believe a broken water heater may be to blame but the cause of the fire is still under investigation. oakland firefighters also assisted in putting out a house fire early this morning in piedmont. it start add round 3:00 a.m. they put out a call to oakland for help. crews from both department was able to put out the fire quickly. no injuries reported here and no word on the cause. >> three men in the hospital after a drive by in the pacific heights neighborhood. shots rang out just after two this morning in san francisco. the victims say they were being followed by another vehicle which pulled up next to them and someone inside opened fire. investigators say it's not clear what happened prior to the shooting.

all three victims are expected to survive. so far no arrests have been made. >> those trying to get home may want to watch the speed. the highway patrol is out in force to catch those who are a little to anxious to get home. john is in marin with the live report. >> reporter: this is highway 101 where many drivers are heading home after a long weekend. now that the holiday season is here the patrol is cracking down. >> cited for speed. 82 in a 65. >> reporter: around the bay area this is a maximum enforcement period when officers say 80% of the available force is out on the streets. this driver was stopped near san quentin. in santa rosa these officers ran a speed drop with one of them spotting the speeders and radioing to the others.

>> white, ford explorer, 79. >> reporter: officer john sloat went after violaters. >> lot of people are anxious to get home. >> reporter: in just one hour they busted about 20 drivers in one hour. >> blue station wagon, just passing us now. >> reporter: in some cases drivers got off with a warning. this man was just that lucky after getting stopped for liting 81 miles an hour. >> i try to keep up with traffic and there was a guy i thought was going slow so i kind of took off around him and that's all it took. >> reporter: officers say this area near highway 12 is a rough spot for traffic. >> around this corner it backs up all the time so you get people going 90 and suddenly it's stopped traffic.

>> reporter: while dui arrests are up officers have seen improvements. >> we have seen a reduction in fatal crashes and crashes in general. that's shows this kind of enforcement does pay off for us and the public. >> reporter: while the holiday is a big weekend for this effort christmas and new year's will be as big if not bigger. . >> the highway patrol is also checking to make sure everybody is sober. dui arrests are up but driving deaths are down statewide. the highway patrol arrested 1419 drivers for being under the influence. last year's total for the same period was 1314. 249 of those were here in the bay area, there have been eight traffic deaths statewide. the patrol continued its program through midnight tonight. >> a water main break-in san

ramon caused minor flooding. the main broke along the iron horse trail. the water flooded the lawns of two homes, at least the landscaping. officials tested the water going into the creek. the results aren't available but they say there is no danger to drinking water. the recycled water usually irrigates parks, golf courses and other landscaping. police asking for help in finding a suspect in connection with an attempted rape. it happened on thursday but details just now being relaced. the victim was walking around 12:30 thursday morning a man pushed her down and then tried to take off her pants. she was able to fight him off and he was last seen running down the street. he is described as 6'1'', weighing about 175 pounds in his late 20s or early 30s, short dark hair and a well

groomed goatee. anyone with information is urged to call the police. >> whole foods joined a cheese recall today and it's pulling seven types of cheese. here is a list of cheese at the center of the recall. they are packaged in clear plastic wrap and have a sticker on them. they are part of a factory wide recall announced last week by bravo farms after state officials found listeria. >> state health officials cracking down on hospital medical errors and we will tell you how. also an arson at a mosque in oregon may be connected to last week's terrorist bomb plot. >> washington is blasting new reports by wikileaks. why and what they contain. >> hear from the top senator not only against repealing don't ask don't tell but he thinks its working just fine.

. a fire at an oregon islamic center was arson. it started early this morning. it's the same mosque the suspect attended. he is the teen charged with plotting to bomb a christmas tree ceremony friday in portland. the fire was contained to an office at the mosque. there was a lot of evidence left. the 19-year-old will appear in court tomorrow. he planned to remotely detonate what he thought was a van packed with explosives where thousands were gathered for the tree lighting. he was allegedly under the impression he was working with fellow terrorists who were in fact fbi agents. he is a united states citizen. the fbi said he has been in touch with an unnamed individual believed to be in pakistan. >> the release today of thousands of pages of sate department messages has upset washington.international community. the white house condemned the

leaks as reckless and dangerous and other united states officials agreed. >> leaking it is horrible. i agree with the pentagon that the people could have blood on their hands. >> the website came under cyber attack today shortly before the release but five outlets including the new york times had received the documents and published portions of them today. the messages include candid views of leaders as well as sensitive information on terrorism and nuclear development. a counter terrorism official called them devastating and said relations with several countries will suffer. the president said its time for a real and honest discussion on taxes. that debate set to start this week when leaders take on the white house over proposed tax rate hikes. holly has details from washington. >> reporter: the main point of contention is what to do with

the tax rates for american families making fore$250,000. republicans want to extend the bush tax cuts for everybody but the president and democrats say the government can't afford to loose that tax money and want to extend them for people making $250,000 or less, that's about 98% of taxpayers. he said that democrats and republicans need to work together on this and other issues to keep the economy moving forward. >> i have invited the leadership of both parties to the white house for a real and honest discussion. i believe if we stop talking at one other and start talking with one another we can get a lot done. >> reporter: the top republican who is expected to attend tuesday's meeting said democrats should make this issue their top priority but they aren't. in a statement he said democratic leaders plan to use the last few days that lawmakers expect to spend in

washington focusing on everything but preventing the tax hike which will cost us more jobs. immigration, repeal of the don't ask don't tell, reorganizing the fda, more environmental regulation. this out going congress will return for one more scheduled week of work in a lame duck session. the bush tax cuts expire at the end of this year. in washington. >> the debate continues over the plan to lift the ban on gays serving openly in the military. a couple of senators today expressed opposing views on the issue. senator mccain said the obama administration is making a mistake while the missouri senator said the military wants to make sure everybody can serve with integrity. >> we should remember where it started. there was no up rising, no problems with don't ask don't tell. it was a political promise. it wasn't a problem. you didn't have -- it's called

don't ask don't tell. if you don't ask -- we don't ask and they don't tell. >> i think we should move forward to make sure that any person who stands up and says i'm willing to die for our country can do so with honor. >> a report on the impact of lifting the ban is set for release on december 1st. health officials don't believe new stats from almost 90 california hospitals. those hadn't hospitals claim they didn't have a single significant medical error over the last three years. officials have given them until tuesday to review their records. 87 hospitals filed saying they were error free, that's about 20% of the 418 hospitals required to submit reports to the state. hospitals face fines of up to $100,000 for errors. >> its been quiet, that is until now. now china is calling for

president prepares for his son to succeed as leader after decades of rule. we have the latest from the penninsula. >> reporter: tensions are running high in the area and we had a up close and personal view of the crisis today. we were a part of a group of reporters checking out the island -- the place hit by north korea last week leaving several dead and injured. just as we landed shots were heard and flashes were seen along the north korean coastline. authorities were worried enough to send locals in to bomb shelters, limited our movement. they wanted to avoid problems. no shells in fact landed on that island today. one reason behind the tension, the start today of the military exercises. that's involving the george washington, south korean ships

and troops. it's happening in the yellow tree. it's the cause of the tensions we witnessed today. north korean state television continues to put out images of its leader and his son. it's thought the succession with in the government is a part of the saber rattling we have been seeing hearing the government. also the need for attention and maybe for aid and in fact late today an envoy for china offered the idea that international talks should be started again concerning north korea. that idea has been getting a lukewarm reception from the united states and other allies, the standoff continues. >> china is proposing emergency talks to try to resolve the crisis. in the wake of the attack last week china is calling for six party talks that would include

the united states. though the president has acknowledged the importance of china's role there was mixed reaction in washington. >> i'm only encouraged by action that would bring north korea to a point where they would abandon their aggressive behavior. that can only really be done right now by china. >> china calling for a resuming of the six party talks is important. normally we have been wanting six party talks and china hasn't been as excited. >> the joint military exercises in the yellow sea -- said last week it opposes any military acts in its economic zone. >> in other news in belgium the european union agreed to give $113 billion to ireland. the rescue package was approved this morning. irish leaders say they will take a portion to boost the

capitol receiving of its state backed banks, the rest will cover their deficits during the next four years. the european union also hopes the bailout will help restore the market's confidence in the euro. in haiti the election ended with allegations of fraud. almost all major candidates called for it to be voided. there are reports that large numbers of voters were turned away from polling stations leading to protests. today's election as the country tries to overcome january's quake and then the outbreak of disease. more than 1600 people have died from that. and in brazil police and soldiers charged in to one of the most dangerous slums taking over an area long controlled by drug traffickers. they went into the complex

. tomorrow is cyber monday and retailers are using the latest technology to try to do a little online shopping. we have details in this live report. >> reporter: if you checked your e-mail you probably already saw it. just about every e-mail in this inbox has a cyber monday deal or promotion. the national retail federation said nine out of ten stores it surveyed said they plan to do some sort of cyber monday deal and many kick off at midnight tonight. black friday 2010 and swarms of early morning shoppers. now retailers hope it continues to bite people as they search online. >> we have been trying to do more and more online shopping just because i particularly don't want to go out to the stores so much. >> reporter: seth is looking for a new tv. >> thin things are getting pretty cheap. >> reporter: he considers

community is sparking debate. it was put up by an atheist organization. those groups widening their campaigns against religion. >> reporter: at first look it appears to be celebrating the christmas season. the manager, three wise men and the star. this add is from america atheists appealing to what they believe are millions of nonbelievers just going through the motions during in season. >> get them out of the closet so they can say, hey, i'm the person you already know. i'm the nice person, the wonderful person who gives to charity, who pays his taxes, who is part of your family, part of your friend. i'm going to break this chain. i'm going to be the first person that you know who is an outed atheist.

>> reporter: other groups include the freedom from religion foundation. in tv and print adds nationwide the american humanist association quotes the koran and bible to show how religion is a root of conflict. 15% of american americans have no religious association. >> one mistake i think that is made in some of these trends in assuming that the 15 to 20% of americans who now say they have no religion are in fact atheist and strong sense of that word. >> reporter: while the groups widen their campaign the united states remains one of the most religious nations in the western world with some of the highest rates of religious attendance. it's their tolerance that accepts people of all faiths, and no faith. in new york. lauren green.

>> this week foster city parks department is expected to take a stance on whether to fine people who break the city's dog park rules. since august there have been at least two incidents including one where a man was bitten by his own dog as he tried to pull two fighting dog as part. quiet now is whether to fine people who break the three dog per person rule. visitors today seemed undecided on whether the city should fine. > on the one hand people come with more than three dogs that are very responsible. on the other hand you will have some folks that come here with more than three dogs and never take responsibility for them. >> the city's parks committee is expected to vote wednesday on whether or not to recommend the fines. >> san francisco officials are crediting the city's year old composting law for a big

california. here say quick look at the current temperatures and we can show you at least the readings, looks like the system is locking up a bit -- temperatures in to the 40s across parts of the bay area. up in the north bay. napa48 degrees, those areas back down in to the upper 20s first thing tomorrow for monday. this was the scene today across the bay. few high clouds but through the area but a nice day. chilly for tonight. it'll be dry for monday. the extended forecast. we are tracking rain chances -- the relatively quiet weather pattern. quite a bit of activity in the north and west. there will be a factor into wednesday. for monday fair skies, tuesday partly cloudy, we are expecting to persist across the system. this system moves in, most of the cloud cover and shower activity focused to the north of the bay area. we have to bring in the slight

chance of a few light showers. highist chance for the north bay. we do head into friday and bump up the shower chances across the entire area. more clouds by midweek. first thing tomorrow morning fair sykes, patchy frost, temperatures from around 32 to 45 degrees, probably by five or six we will have the upper 20s showing up in santa rosa, napa, possibly fairfield and then we will put it into motion. you can see what happens. partly to mostly sunny. we could have a few high clouds drift through and temperatures not a big change from today from around 54 to 57 and wind speeds pick up again. winds could be from around ten to 20 miles an hour. the projected numbers, after a cold start bundle up, at least until 10:00. afternoon in the 50s. santa rosa around 56, antioch

settlement to fund a settlement for the years of discrimination. many are managing to stay in a hard business by getting back to their roots. >> reporter: in a tight economy and with federal funding sometimes tough to get, some black organic farmers still struggling to stay going. robbie knows about it firsthand. she was born into organic farming. now she runs a farm in ga with her husband hilton. >> even when i was growing up the black farmers didn't get the same attention that other farmers got. i haven't seen any changes in it even up today. >> reporter: so she got help where she could. >> when i was told no i kept going. i visit my county agency and i took a class in georgia.

>> reporter: resources offered to black farmers. >> so organization came about as a request of farmers and not knowing how to go through the process, about the programs that are available about the funds that's available, the training that's available. >> reporter: growing organic came naturally for many. >> when you go back and you look at african americans in the agricultural industry a good many of what was called conventional farmers at that time were growing organicly with the use of cow manure and the reason was another economic reason, they couldn't afford the soil. >> reporter: today they say they are able to operate better
