60s. mostly sunny to sunny. yet north bay flirting with clouds. temperatures there will be slightly cooler. talk about that rain in five minutes. now here's sal. steve, right now at the toll plaza getting more crowded: we're going to check to see if there's anything on the bridge itself that may be causing a slow down. also this morning we're looking at traffic on interstate 880. that looks good near the oakland coliseum. it's 6:00. let's go back to dave and pam. topping our news this morning, a homeless encampment in the south bay that was the target of kindness last night could be the target of a police sweep today. ktvu's claudine wong is in san jose to tell us why the homeless may soon be moved out. good morning, claudine. >> reporter: good morning, pam. yes, we're at st. james park this morning where just hours ago blankets were given to the homeless. it is very, very cold out here this morning. it's hard to imagine what it is like for the homeless who have to survive out here in this day after day and night after night. the homeless will be the subject it appears of some kind

of sweep this morning. as we talk more about these frigid conditions homeless ministries have been making efforts to address the needs of the homeless. the community homeless alliance ministry handed out free blankets and dozens lined up last night. some told us they are struggling to stay warm in the frigid temperatures and sometimes fear they won't survive. >> it's hard to get blankets and sleeping bags and everything else. >> why don't you go into a shelter or armory or as well as? >> i was supposed to go to the armory last night but i didn't want to go because my friends needed help out here. >> reporter: last year 44 people died on the trees of santa clara county. ktvu found fliers out here saying there would be some kind of city wide sweep in the area of the guadeloupe river. it's still unclear when that will get underway and where the homeless will be going if they will take them to shelters or make sure they move out of the area where the encampments are based. we'll keep you updated here on

the channel 2 news. time now 6:02 just just hourings a a deadly crash killed a pedestrian and a busy highway had to be closed down for a while. this happened just before 1:30 on northbound highway 101 just north of broadway. the chp says a prius hit a man who was walking in the road for still unknown reasons. that man died there at the scene. the driver of the car was rushed to the hospital with minor injuries. lanes reopen to traffic just before 3:00 a.m. investigators still want to know why that man was in the middle of the road. oakland police chief is in washington d.c. this morning. he's looking for money to bring back home. specifically his goal is to make several oakland schools safer places for everyone. we'll have more on that report in just a little bit. well, a search is continuing this morning for a hiker missing for five days now near mt. whitney. the 37-year-old from portland is a focus of this search.

several hikers told investigators that he spent last thursday night at lower boy scout lake. the next morning he told them he planned to head back down the trail. but he hasn't been seen since. today the city of oakland will step up its fight to save the a's. the planning commission will consider a proposal for a new 39,000 seat ballpark near jack london square. it's one of four proposed sites in oakland. a's owner says he's still planning to build a new stadium in san jose. however, san jose has suffered a set back in its effort to become the new home for the a's. mayor reed it's unlikely to be able to put that on the marge ballot. that's because a major league baseball committee hasn't decided whether the oakland a's should be allowed to move. that committee was created almost two years ago. heads up for you. a winter spare the air alert is in effect today.

this is a live picture right outside our doors right now. you can see this is what it looks like right now. the spare the air alert means it's illegal to burn wood, fire logs, pellets or any other solid fuels in fireplaces, woodstoves or other wood burning devices. they stay in effect until midnight tonight. all right. i guess the toll plaza is getting pretty crowded if you haven't set out for the day spare the air, take bart if you can. >> that's right. bart is doing well and are other public transit systems. we haven't been hearing of any delays. as a matter of fact at the toll plaza it's more crowded. usually doesn't get this way until about 6:15. it's only a little bit early. it's not like it's a big deal. but if you follow patterns you'll know it's going to be more crowded that means about 6:30 it might be full and most likely it will be when they'll turn the metering lights on any time now. let's move along and take a look at san francisco

southbound 101 coming into the downtown area. big billboard at the bottom with the four handsome gentlemen there. you can see them there. the morning commute is okay on 280 northbound as you get up to highway 17. that traffic is moving smoothly. that's northbound 280 on the right. here's a handsome man himself, here's steve. thank you, sal. rain will slide south on thursday and probably arrive here by friday morning. i say probably because this is one -- usually you get within 48 to 72 hours forecast models are very good. no pun intended they're all over the map today. it's been a challenging morning here trying to put everything together. today's all right. sunny to mostly sunny. clouds to the north and sun to the south. temperatures coming up a little bit. we'll have upper 50s and low 6 0z. one mountain view at 60 close to climatology. it's been a while since we've been near average on temps or

above. we've been below for the longest time. 54 at noon. go for a high of 58 which would be five warmer than yesterday. makes a tad nervous. that will be average as well. temperatures under mostly sunny skies coming up a bit. starting off with a lot of 30s. 33 napa, concord, livermore, palo alto. temperatures again continue to be cold under mostly clear skies. a lot of high clouds yesterday. it's warmed up. bookends for lake tahoe and reno. rain and clouds, 51 towards eureka. must be some wind towards lax because they're at 52 and everyone else around them is in the 30s and 40z. las vegas is cold. 35 degrees. plenty going on out there. problem is where is it going? the system to the north will slide over us for very light rain on friday. it's up near the oregon border now. it will start to drop tomorrow. this system out here looks like it's on its way to southern california by sunday. see. see what i'm dealing with here

today. sun and clouds a little warmer. so today looks all right. upper 50s and low 60s. partly sunny, partly cloudy to the north. temperatures though again with the days so short the upper 50s, low 60s don't last long. but it will be a nice day today. and mostly cloudy tomorrow. rain develops in the north bay and then drops over us and stalls out. and therein lies the tough part of saturday, partly cloudy, partly sunny. don't be surprised if there's rain in southern california. all right. thank you, steve. as we've been reporting oakland police chief is in washington d.c. this morning. and he's looking for money to make oakland schools safer for everyone. ktvu's jade hernandez is at oakland police headquarters with the story. good morning, jade. >> reporter: good morning. oakland police chief is not going to be here at police headquarters today. he's in washington d.c. on a mission. he's collaborating with oakland unified school district superintendent tony smith to come up with a way to strengthen bonds with police and students.

the two helped devise a pilot program on the middle school level. the police department would place six officers at four middle school campuses. madison, west lake roosevelt and brick. they would impose safety, steer kids away from crime and help build better relationships with students on the verge of joining a gang or straying from school. today the chief is in d.c. lobbying for funding for this program which needs nearly $6 million. we attended a press conference on monday where the cheer discussed a $10.5 million grant for oakland youth health care and targeting at risk teens. he explained why starting at this level is so critical. >> i also get on an airplane to go back to washington d.c. to ask for the funding so we can focus on middle schools in the city of oakland. the middle schools are looking to become our ground zero to make an impact in community policing. >> reporter: the chief will

welcome back. live pictures of the white house. a rainy day in washington d.c. that's why the camera looks funny. but we're looking at that giant red ribbon hanging on the white house. the reason it's there it's marking world aids day. at the same time international organizations are saying there's mixed news about the fight against aids. the u.n. says while there's been a reduction in new hiv infections, cases involving children in eleven asian nations have actually increased in the past decade. parts of africa continue to be effected the most by the aids epidemic. unemployed workers from all over the country will rally in washington d.c. today. we go to ktvu's allison burns to explain how it involves a

critical deadline that passed at midnight last night. good morning, allison. >> reporter: good morning to you, pam. and local members of congress, nancy pelosi and george miller among those leading today's rally calling for another lifeline for unemployed workers. the senate failed to meet last night's midnight deadline to extend federal benefits for the long-term unemployed. that means about 800,000 people are going to stop getting their money today. two million americans will lose their benefits by the end of the year if congress does not act. republicans and some democrats are blocking the extension because they say it will add to the federal deficit. but democratic leaders are ridiculing that argument. >> it doesn't make any sense. our economy still has a long way to go on the road to recovery. there are five job seekers for every open position today. the unemployment rate stands at 9.6%. and senate republicans really think that now is a good time

to cut families off from the support that they depend on? >> reporter: the average weekly pay for people who get federal unemployment benefits is about $300. reporting live from washington d.c., allison burns, ktvu channel 2 news. now that the pentagon has released its report on the military's don't ask don't tell policy, senate democrats are moving to hold a vote on repealing the policy this month. defense secretary robert gates wants the senate to act before it adjourns this month. gates says there's an urgency for congress to act because the courts could invalidate the policy without warning leaving the military with no time to prepare for the change. >> i am determined to see that if the law is repealed, the changes are implemented in such a way as to minimize any negative impact on the morale, cohesion -- >> the pentagon report includes that repealing the ban on gays serving openly in the military would present only a low risk to the armed forces ability to

carry out their mission. senate democrats have scheduled hearings on repealing the policy starting tomorrow. the founder of wikileaks is now on the most wanted list at interpoll. the international police agency. being soug warrant in a rape case involving two women in sweden. the exact whereabouts are unknown but he's believed to be somewhere in britain. he's denied the rape charges and says the complaints against him are the result of a u.s. smear campaign. in an interview with time magazine, he called on secretary of state hillary clinton to resign. he said and i'm quoting "she should resign if it can be shown she was responsible for ordering u.s. diplomatic figures to engage in espionage in violation of international covenants." today secretary clinton is in

cast pakistan. kazakhstan. some containing very blunt of foreign leaders. cited by american diplomats in those released cables. for example,s country's defense minister described as someone who enjoyed "drinking himself into a stupor." time now 6:16. check in on traffic this morning. how's the commute, sal? any trouble spots? so far it looks pretty good out there if you are driving to work any time soon and using the bridge for example. just a small delay. nothing major. in fact it's looking like maybe a five minute delay at most before you actually make it on to the bridge. and that's -- i'm being a little conservative there. let's be a little more liberal. three minutes. just say three minutes. 880 north and southbound traffic moving well in both directions. here at the oakland coliseum no problems there. also the morning commute looks okay on westbound interstate 580 coming up through the

livermore castro valley area. and across the bay on the peninsula highway 101 looking good. always a bit of a slow down this time of the morning on 280 southbound. just after 280 for a little while that clears up by the time you reach billing game. thanks, sal. mostly clear skies. cold. a lot of 30s. 33, 34, 35 for most. there's a few upper 20s. but for most it's a clear morning. some rain to the north. in fact our observer, ron, up in crescent city said the front went through but not before they picked up an inch and a quarter of rain. that system actually sags south. it's going to be a slow mover. by tomorrow the north bay could be in line for some rain and i think maybe everybody by friday morning. but by the time it arrives here it will probably not do much but give us some light rain and gray skies. clouds to the north. sun to the south. but a little warmer. forecasted to temperatures rebounding from yesterday. i mean it's been tough to get out of this 53 and 54-degree

good. we don't have any major accidents on major bay area freeways just yet. all right. thank you, sal. now that the u.s. senate has approved a new food safety bill, it goes to the house of representatives ich is expected to pass it and then send it for the president's approval before the end of this week. if it becomes law, this would be the biggest upgrade in food safety in more than 20 years. most food producers would have to document and trace their products from the field all the way to the consumer. small farmers who sell their goods locally would empt. and many bay area restaurants and farmers say they already track the foods they sell. >> with our produce and with our seafood, we know exactly where we get it from. the boat it comes from. the farm it comes from. and the farmers who get it for us. >> we're creating a food system where we know where our food comes from. we know who grew it and that is really the model that will and should prevail. >> the fda would also be able to conduct more inspections and have the ability to order recalls. the first day of hanukkah

starts today. but governor schwarzenegger got an early start to the celebrations. the governor danced and hand out gifts at the state capitol yesterday as part of the 17th annual my noria lighting ceremony. it begins at sunset and lasts eight days. testimony resumes in the richmond gang rape case. today there's going to be one big change outside the courthouse in martinez. the seven men accused of gang raping a 16-year-old richmond girl will no longer be paraded across the street as you see them right here. that's because the county found courtroom space in the newer courthouse right next to the jail. >> i think it is far more humane the way they're being treated right now. and -- but i think the damage has been done. >> now the preliminary hearing will be held at the newer courthouse for at ast the next week. the judge is trying to determine if there's enough evidence to put the seven defendants on trial for last year's horrific gang rape case

which attracted nationwide attention. starting today the window for the mavericks big wave surf contest near half-moon bay is officially open. 24 of the world's best surfers will wait for the right conditions to be called and their on 24 hour notice to compete between now and february. there will be some changes though this year. people will not be able to watch the competition from the beach to prevent what happened in february when huge waves swept away spectators, injuring 13 people. sacramento authorities and f.b.i. say they have uncovered a massive movie and music bootlegging operation with ties to the bay area. they say they seized $2 million worth of counterfeit disks in a san jose warehouse and found bootlegging set ups in sacramento and modesto. many dvds with copies of movies still in theaters and not yet released to the public. the investigation into the ring began in august. but they say this bust may be the tip of the iceberg.

so far four men from sacramento, one from modesto and one from more sed have all been arrested. google says it will attempt to answer questions posed by european union anti-trust investigators. investigators want to know if google manipulates its search results to cut competition. google is accused of funneling traffic to its own services including online price comparisons. analysts predict google will fight hard to not reveal what mathematical formulas it uses to determine where recommendations fall. well, making sure kids get their exercise at school. what a new court ruling says parents can do if they think their children's schools have not followed the law. >> reporter: in these cold temperatures today there will be a new focus on the homeless in the south bay. we'll tell you who will be looking for them and what they're telling them coming up. and the opening bell is about to ring on wall street. we'll tell you what's happened overnight that bodes well for our markets today.

have to move. claudine wong is in san jose to tell us why dozens of homeless may be forced out today. good morning, claudine. >> reporter: good morning, dave. we're at the guadeloupe river. it stretches along downtown san jose along parkline. people have said there are a lot of homeless encampments around this area. certainly that will be the focus today it appears of a sweep that tries to get the homeless out of the frigid conditions. now the homeless ministries have been making efforts to address the needs of the homeless out here as they try to survive in these types of conditions. the community homeless alliance last night handed out free blankets to the homeless. and as the word got out about that free blanket give away, dozens of people lined up. in fact we found about 80 people waiting in line to get to those blankets. some people told us that they are struggling in these frigid conditions. and they are sometimes worried they won't survive. >> it's hard to get blankets and sleeping bags and everything else. >> why don't you go into a

shelter or armory or somewhere else? >> i was supposed to go to the armory last night but i didn't want to go because my friends needed help out here. >> reporter: it can be deadly out here on the streets of san jose and across the bay area. last year in santa clara county 44 people died on the streets. that is certainly a concern of both the outreach programs and the city officials. now ktvu found some fliers last night that warned people there would be some kind of sweep today and asked them to clear out their belongings. we've looked for more fliers this morning. we have not seen them. but, again, the focus will be on getting people along the guadeloupe river who have used this area to camp out to clear out to take their belongings with them and hopefully get into a shelter. live in san jose. claudine wong, channel 2 news. two men recovering this morning from what police are calling a gang-related mob attack in the south bay. mountain view police say a group of at least 15 men attack today other men on california

street sunday afternoon. those men used bats, chains, even metal rods during that attack. police say the attackers fled the scene but police officers later arrested several suspects at gunpoint. 12 adults and three juveniles were taken into custody. but police say some of those attackers may have gotten away. if you have any information about this case, contact mountain view police department. prosecutors in san joaquin county release some dramatic surveillance video of a teenage torture victim moments after he escaped captivity. i've got to warn you this video may be disturbing. the 16-year-old boy, look at this on the bottom right, entered a gym asking for help two years ago today. he was dirty, he was emaciated only wearing boxer shorts. he also had a chain around one of his ankles. employees there helped that teenager and they called the authorities. three adults have pleaded guilty in this case. they are facing prison sentences of more than 30

years. a fourth man faces life in prison after a jury convicted him last week. oakland police chief is in washington d.c. this morning. he's there to lobby for federal funding to pay for police officers in four of the city's middle schools. now it's part of a pilot program designed to help steer young students away from crime and gangs. oakland's police department needs about $6 million to run the program. madison, west lake, roosevelt and brick middle schools have been chosen to participate. san francisco police are in the beginning stages of a pilot program to reduce the rampant illegal pill sales at a troubled tenderloin intersection. according to the san francisco examiner, police are performing biweekly nighttime stings. they're also working with the district attorney's office to stiffen the consequences for repeat offenders. and police are working with the drug enforcement administration to bust the law breaking doctors and pharmacies. time now 6:34.

parents can sue their children's public schools over physical education. all of this comes after a parent in the albany school district sued to force cornel elementary school to offer the required physical education. education code requires elementary schools to offer 200 minutes every ten days. albany school district officials say they are complying. a baseball player well known to bay area fans has become the newest member of the world champion san francisco giants. former a's star miguel that ha da just signed a one year $6.5 million contract with the giants. he's 36 years old but the giants see him a very reliable shortstop and strong hitter. they just lost juan uribe. he signed a three year deal with the dodgers. all right. 6:35. let's check back in with sal for traffic.

sal. where's sal? >> he's checking traffic. all right. pam and dave, let's go outside. here i am. check out what we have. we already have some busy traffic believe it or not on the east shore freeway westbound traffic is busy. we've had a couple stalled vehicles on the upper deck of the bay bridge. so therefore the toll plaza is getting more crowded because whenever there are stalled vehicles on the bridge they turn those metering lights onto extra slow and there's going to be a bigger back up now at the toll plaza. there it is. it's backed up all the way out to the 880 overcross and a little beyond that. if you're going into san francisco give yourself extra time. the stalls have made it much worse than it normally is already. and on the peninsula we're looking good if you're driving to the airport let's say or heading south out of san francisco. there is a little bit of slow traffic on 101 at 280. and then at 380. nothing major. i'd say still a decent drive. 6:36. let's go to steve. sal, thank you, sir. we have mostly clear skies. little cold out there for many.

ktvu's kraig debro joins us now from oakland with the story. good morning, kraig. >> reporter: good morning, pam. well, we're a long way from a new stadium in the city of oakland. but if they get their victory court site, if it's finally approved, the stadium is finally going to be put in, that could mean the relocation or shutting down of 16 businesses including the coffee company just a couple stones throws away from ktvu. a three unit live work building three facilities belonging to bart and the college district. proponents say victory court is a winner. the stadium in the site would sit between fourth street and the embark deare. the ballpark fits into the redevelopment part of the area which includes waterfront development and jack london square. the city of oakland settled on the site named after a street inside the boundary, after considering a couple other sites. the planning commission will represent their recommendation at tonight's mitting.

bomb factory has now been declared public hazard and they're going to burn it to the ground some time next week. authorities say the home was so full of dangerous materials it has to be destroyed. the same type of chemicals used in suicide bombings were found inside that house earlier this month along with hand grenades. the man who lived in the house is now in jail on $5 million bail. san francisco district attorney harris is now officially the state attorney general-elect. harris officially declared victory yesterday over her republican challenger los angeles district attorney steve coolly. she beat him by less than 1% of the vote. >> congratulations. >> now harris laid out her priorities as the state's top law enforcement officer during her victory party last night. the 46-year-old pledged to focus on mortgage fraud, the state's high recidivism rate and issues. she will make history as the

first woman and first minority to hold that position. we now know the results of another close race from the november 2nd election. with all the votes counted in the eleventh congressional race incumbent democrat mcnerney has justles than 48% of the vote while his challenger has just under 47%. mcnerney's marginal victory came down to 2600 votes. thanks to supporters in contra costa, alameda and santa clara counties. harmer received most of his votes in a more conservative san joaquin county. a california congressman is demanding investigation into the state's high speed rail authority. representative is asking the u.s. transportation secretary to intervene in the plan to build 65 miles of track in the central valley. the rail authority board is set to vote on it tomorrow. but voters who approved funds

for the project did not think that the first segment would be built between two small towns. the $43 billion project is eventually supposed to connect san francisco and anaheim with trains running by the year 2020. well, let's speed right over to sal. see what's happening in our commute. sal. yeah. it's very crowded now at the toll plaza because we've had a couple earlier stalled vehicles. we had some hazards up there. cal trans got up there quickly and got out of the way. you can see that traffic here is much more crowded than it normally is. this is already a 20 minute delay. we're not even to 7:00 yet. so if you work across the other side from oakland to san francisco, give yourself an extra ten minutes to do it for you. and then you'll be back on schedule. let's move along and take a look at 880 north and southbound. that traffic is still looking good here in front of the oakland coliseum. this morning's commute on the freeways in burling game that traffic is moving along very

60. san jose 62 average this time of year is also 60. so finally came above on the temps. low 30s, upper 20s. only a smattering. more 32 and 33s. napa, concord, livermore, palo alto, all in there around 32, 33. walnut creek. san jose at 38. san francisco at 44. warmer tahoe and truck key the past couple of mornings. 50s with rain in eureka. lax is warmer. san francisco cold week for many in california even down to southern california. this system will drop south over the next 48 hours and give us rain. low right here i think will swing into southern california on sunday. that's my story and i'm sticking with it. sun and clouds a little warmer, high clouds cool to mild for some. still rather chilly. but temperatures at least near average for this time of year. so upper 50s to a few low 60s. clouds will be dropping south on thursday.

light rain can make it in the north bay thursday night more likely friday morning for everybody. and then partly cloudy, clearing on saturday. all right. thank you, steve. 6:50 is the time right now. lowe's home improvement stores recalling 11 million window blinds and roman shades. the recall involves all styles and sizes from roman shades and roll up blinds sold by lowe's. the consumer product safety commission report says two children got tangled in the exposed cord found on those window coverings. neither child seriously hurt though. but the recalled shades and blinds have been sold at lowe's stores dating back to 1999. anyone with those products should stop using them immediately and obtain a free repair kit. let's check in on wall street. here's a live look at the big board on the new york stock exchange. very nice opening as expected this morning with the dow jones up almost 200 points. it started today just barely above the 11,000 level. now it's at 11,201. the nasdaq and s&p 500 are also

up significantly. the nasdaq actually up almost 2% right now. and that is on a couple of things european markets recovering this morning a bit. and some upbeat economic news out of china overnight. definitelysheds some optimism on the global market. swiss drug company plans to cut hundreds of u.s. jobs by january 1st. 1400 american sales floor jobs will be cut. no word yet if any of those jobs will be here in the bay area. it will offer support to the laid off workers including help finding a as december begins to it's the first of december, some people want to look back and put the whole year in perspective. one bay area company is already looking at what it's customers thought was worth searching for in the year 2010. plus the nation's third largest faddier shane is facing a local lawsuit. what some movie goers want to force them to do. 0!ockñ?çóxo?ñ=çñññçvxqx?ñññ?óioy
