home. a deadly overnight crash shut down a very busy bay area freeway is both a tragedy and a mystery. and there's one thing you should not do on this chilly first day of december. "mornings on 2" starts now. well, good morning to you. welcome to "mornings on 2." i'm dave clark. >> i'm tori campbell. it's tuesday, december 1st. extended unemployment benefits start running out today for 2 million americans. that's after congress missed the midnight deadline to extend. alison burns is live in our washington, d.c. bureau with more. >> reporter: good morning, tori. that's right. we're talking about an average of $300 a week that people who are unemployed get from the

government but that money stops today for many of them. let's take a live look at the senate floor. we are waiting to hear if there are any new plans today to give another lifeline to the l ong- term unemployed. congress failed to act before last night's midnight deadline. that means benefits run out today for 800,000 people. 2million americans, including 5 00,000 californians, will lose their benefits by the end of the year if congress does not okay another extension. >> anybody who thinks that the unemployed are being lazy and taking advantage of these systems are no grip on reality. there are 15 million unemployed people right now. and there are 3 million opened jobs. >> reporter: now, republicans and democrats who are blocking this benefits extension say they would be billing to change their minds if congress figures out a way to pay for it without adding to the deficit.

negotiations are going on at this hour -- at this hour. how to do that is really up in the air at this point. alison burns, ktvu channel 2 news. >> thank you, alison. 7:02. well, oakland police chief anthony batts is in washington, d.c. looking for mine to make oakland schools a safer place for everybody. ktvu's jade hernandez joins us live. she's got all of the details. >> reporter: good morning. anthony batts is not going to be at police headquarters today. he's in washington, d.c. on a mission. he's collaborating with oakland unified school district superintendent tony smith to come up with a way to strengthen bonds and stuneds. the police department -- bonds and students. the police department would place six police officers at four schools. this would help deter crime and help to build better r

elationships with students on the verge of joining a gang or straying from school. today, chief batts is in d.c. lobbying for funding which needs 6 million in funding. we attended a press conference on monday, where the chief discussed kaiser's $10 million grant. >> the middle schools are l ooking to become our ground zero to make an impact in community policing in the city of oakland. >> reporter: this program would not take officers off the streets. it would, in fact, allow the department to hire back some of the officers laid off during the summer if they received summer. mayor-elect jean kwon -- jean quan >> we have to work to create jobs in this economy and that we have to deal with public

safety and that includes but for for me that's -- but for me that's community policing. >> reporter: we tried to get reaction from both the police department and school district. we'll let you know what they had to say coming up. in an hour we'll be hive at a middle school, one of those middle schools where officers would be placed if funding is garnered in washington, d.c. reporting live in oakland, jade hernandez, ktvu channel 2 news. >> thank you, jade. it is 7:05. overnight, a car crash in burlingame killed a ped and shut down a busy highway. it happened just before 1:30 a.m. on northbound highway 101 just north of broadway. highway patrol officers say a prius hit a man who was walking in the roadway for unknown reasons. he die -- he died at the scene. lanes reopened just to -- r

eopened to traffic just before 3:00 a.m. the investigation continue. this morning, testimony resumes in that richmond gang rape case. today is gonna be one big change outside the courthouse in martinez. the seven men accused of g ang- raping a richmond girl will no longer be paraded across the street, as you see here. that's because the county found courtroom place space in the n ewer courtroom right next to the jail. >> i think it is, you know, far more humane, the way they are b eing treated right now. and-- but i think the damage has been done. >> reporter: now, the preliminary hearing will be held at the newer courthouse for at least the next week. the judge is trying to determine if there is enough evidence to put the seven defendants on trial for last year's horrific gang-rape case that attracted nationwide attention. coming up at 7:30. we'll detail some of the graphic testimony.

7:06. in san jose, the overnight search for a mentally unstable woman has come to a happy e nding. they found her around 2:30 this morning. that was 11 hours after she disappeared from her san jose care home. so far, investigators have not revealed where or how she was found. but she appears to be in good health. the cold weather has police in san jose shifting their focus for the homeless. a fire near the river warns police will be asking those people in the area to leave in heaps of getting them into -- hopes of getting them into shelter today. last night, 80 blankets were passed out to help them stay warm in the freezing t emperatures. today is a winter spare the air day. it's in effect. as we look outside our window right now, there is a pretty picture, but it also means it's illegal to burn wood, fire

very nicely northbound 280 traffic looking good getting up to highway 17. 7:08. let's go to steve. we have mostly clear skies. we'll start off with sun, cold this morning. a lot of low 30s. about 95% of the observation says somewhere around 32, 33, 34, just a few in the up are upper -- just a few in the upper 20s. there's been pretty good rain up north. it will eventually drop south and hang out over us. today looks pretty good. clouds to the north, sun to the south. a little warmer, even though we're starting off with the low 30s or mid-30s for some. we'll end up with upper 50s to a few low 60s. santarosa, yesterday, 55. we'll go 57 today. 58 in san francisco. danville and oakland in 59. 62 in san jose. 30s for many. 33 palo alto, 33 san rafael, 24

"the l.a. times" said her grandson confirmed she died in her home. she was married to governor g oodwin night. after her husband lost the 1958 governor's race to pat brown, they moved to return to los angeles. virginia night was -- knight was 92 years old. severe storm threats. the strong weather system is on the move. the damage it caused and where it is headed now. and a way to mark world a.i.d.s. today in san francisco. and parents can sue their children's schools if they are not providing a certain service.

the east coast is preparing for more severe weather as heavy rain, thunderstorms and strong winds pushed toward the region. tornado watches are posted in the virginias. they are handing out sandbags to fight flooding in the d.c. area. yesterday, the storm brought four tornadoes to mississippi. some had winds up to 137 miles per hour. 32 people across that state were hurt but none of the injuries were serious. 56 homes were damaged in north georgia and a rock slide in tennessee blocked the highway between knoxville and the airport. the search doesn'ts for a hiker missing for five days now near mount whitney. 37-year-old christen mining of

portland is the focus of the search. in san francisco today, world a.i.d.s. day will be observed at the national a.i.d.s. memorial grove. the grove located in golden gate park was illuminated for the first time last night to celebrate the 20th anniversary of the ryan white care act. ryan white was diagnosed with a.i.d.s. at 13 fought a courageous battle with a.i.d.s. discrimination in the late 1980s. ryan's mother spoke at the e vent. >> it isn't just about ryan. there are so many families that have been through this epidemic. they felt the same suffering and pain that i went through. >> during today's noontime on

-- observance there will be a memorial for ryan white. 7:16. now that the pentagon has released its report on the don't ask/don't tell policy, senate democrats want to hold a vote on repealing that policy this m onth. defense secretary robert gates, wants the senate to act before it adjourns this month. gates says there is an urgency to act because the courts could invalidate the policy without warning, leaving the military with no time to prepare for the change. >> i'm determined to see if the

law is repealed, the changes are implemented in such a way as to minimize any negative impact on the morale, co heren and e ffectiveness of combat units units that are deployed, about to deploy to the frontlines. >> that pentagon report c oncluded that revealing the ban on bays -- gays serving openly. senate democrats have s cheduled -- have scheduled hearings on repealing the policy beginning tomorrow. money seized from illegal pot farms is helping the mendocino county budget. officials say legal marijuana gardens could ward off future cuts. the sheriff says he will spend more than $450,000 collected primarily from pot busts to o ffset the department's overtime budget. supervisors voted to lee dues the number of proposed job cuts in the sheriff's office budget from 14 to 7. a program that issues p ermits allowing medical marijuana cooperatives to grow could generate more

than $ 600,000 for the budget next year. today, the san francisco board of supervisors will consider cost increases in the construction of a new police headquarters. city officials already approved plans for the $243 million b uilding last year before george gascon took over as police c hief. gas con is calling for security improves that would cause an additional $3 million. parents can sue their children's schools over a lack of education. this comes after a parent in the albany school district forced to sue cornell school to offer the required education. the code required elementary schools to offer 200 minutes every ten days. albany school district officials say they are

complying. 7:18. the food industry could soon face the biggest change in food safety standards in more than 20 years. it is now up to the house of representatives to approve a new bill on food safety a ftermakerring its way past the senate. now, if it becomes law, most food producers would have to document and trace their p roducts from the field all the way to the consumer. small farmers who sell their goods locally would be upset.

the fda could be -- dash would be able to conduct more inspections. those in favor of the stricter regulation and accountability say recent e. coli and salmonella outbreaks show as lack of authority and shortage of resources that the fda has to handle the cases. house democrats say they plan to accept the senate version and sent is to the president before the end of the week. new york university r esearchers say ruts of a new study are shocking. they examined 200 medications that included those for cold, allergies pain and stomach u pset. they found dosing -- dash dosing instructions are confusing. and 25% of the medications don't include a dosing device or a cup or a dropper.

the irs has $700,000 worth of refund checks for taxpayers. the irs is holding on to refund checks for more than 2,000 people in the bay area. in most cases, the agency says

the checks were returned because the taxpayer moved and did not update their address for the post office or the irs. well, pg&e is asking for help from its customers on the peninsula and it is willing to pay. pg&e is offering $25 debit cards to customers in san francisco and san mateo county who lowered their use of natural gas this month. the pg&e has been running gas through its pipelines at a reduced pressure. now that it's getting colder, the company is worried, they won't be able to do that. customers who help out by c utting -- by cutting back on usage compared to the last three decembers will be rewarded. some drivers on highway 101 in sonoma county may notice something different. a higher speed limit between santa rosa and windsor. the speed limit has been raised back to 65 miles an hour. the limit was lowered to 55 miles an hour two years ago because of a construction project to widen highway 101 to

slower. you question -- you can see it's pretty slow which is unusual heading up -- heading down to highway 87. peninsula looks very good, 101 and 280 and marin -- in marin county. we are beating slowing on southbound 101 to highway 37. 7:25. let's go to steve. clear, mostly clear. it will be a mostly sunny day. temperatures rebounding from the immediately low 30s. some rain has made it up on the low coast. crescent city. other observer ron says the front has gone through but down to fort bragg, shelter cove, looks to be in line for showers and rain today. that system will eventually drop south. the timing on it is very difficult. there it is. we'll start off with sunshine today, and then up from the southwest later on today. late morning, early afternoon and then we'll get higher clouds

good morning. clear skies. sanjose is 36. that's mostly clear skies. there were a few upper 20s, lower 30s. we'll have sunshine today. high in san jose, 62. the cold weather has police in the south bay shifting their toe focus to the homeless now. claudine wong is in san jose where a homeless encampment can be moved today. >> reporter: good morning. the cleaning crews are out here. evidence that someone was making the river their home. there are a lot of people who will tell you that there are a lot of homeless to be found in

here. that could be the subject of the sweep today as city officials start focusing on these frigid conditions and the people who are living out on the street. now, we do know there is has been a lot of outreach towards the homeless, the homeless ministries making an effort to address their needs. dozen lined up at st. james park to get a blanket. people did say they are s truggling to survive. sometimes they fear they will not survive. >> it gets frozen here. once in a while, it gets -- you get a breeze from south and north. >> reporter: last year, 44 people died on the streets of dollar county. it's still unclear when the sweep will start today. we didn't see a -- we did see a flier last night saying people needed to clear their belongings out of here or they would do it for them.

people want -- the group wants them out bass of the conditions. more graphic testimony expected in the richmond g ang- rape case. a judge is deciding now whether there is enough evidence to try the seven men accused in the gang rape of a teenaged girl outside of a richmond homecoming dance last year. yesterday, one defendant identified the 19-year-old who was the first to force sex on the 16-year-old victim. police say a mob attack in the south bay is probably g ang- related. two men are recovering from injuries after police say they were attacked by a group of at least 15 men. the men used bats, chain, even metal rods. police laterrested several suspects and three juveniles were taken into custody. police say some of the attackers may have gotten away.

if you have any information about this case, contact the mountain view police department. prosecutors in the san joaquin valley have video that is disturbing. the 16-year-old boy entered a gym to ask for help two years ago today. he was dirty, emaciated and w earing only boxer shorts. he also had a chain around one ankle. the they helped the teen and called authorities. >> he quickly came up and said, will you help me? they are coming for me. help me. can i hide behind here. >> three adults pleaded guilty and face prison sentences of more than 30 years. a fourth man laces fife in prison after a jury convicted him last week. 7:34. the attorney representing barry bonds in his perjury trial now has the backing of one of the world's largest law firms.

allen ruby has signed on to become a partner of silicon valley-based law firm. and bonds has pleaded not guilty for testifying that he never knowingly used p erformance-enhancing drugs. the trial is currently scheduled for march. the city planning commission will consider a proposal for a new ballpark near jack london square. kraig debro joins us live now with more on the story. good morning, tori. >> apparently there's pluses and minuses. some of the excitement over the possibility of keeping the as in oakland will be heard in the planning commission meeting but some of the heartache will be heard there too. the city will push the site for a new stadium for the as at the meeting. the planning commission meeting will go forward with an

environmental impact report and that's the most important first step. the city is hoping to convince the as to stay in oakland with a 39,000-seat ballpark which the city says fits in the overall redevelopment of the area. this includes the waterfront development and the jack london square. if it is built here, 16 businesses would have to go. the list includes a training center and the 80-year-old coffee company. >> that's true. they need a mud stadium. i-- i -- they need a new stadium. i think it could be a shame to lose pierless. >> or choose. >> don't make me to do. major league baseball wants the team to build a smaller arena. lou we'll wants to -- lew wolff and mayor reed says a committee formed has not yet been issuing any recommendations. so they are declining to move forward. they would need those recommendations by 2:00 p.m. today if you want to get specific in order for that ballot initiative to get on next spring's ballot. later this morning, we will try again to talk to some people who frequent some of these businesses who think -- who think what they think about s eeking another alternative.

central valley towns. one congressman says not so f ast. they want the federal government to step in. dennis cardoza wants the t ransportation secretary to investigate rail authority. he says voters who approve the funding for the project didn't think the first segment would be built between two small towns. this $43 billion project is eventually supposed to connect san francisco and anaheim by the year 2020. won't it take like three hours or something? >> yes. >> let's check in with sal. let's see how traffic is moving. he said it's -- it's going okay so far, still? >> it's going okay. we just got word of a new accident. it just came in on marsh creek road in contra costa county. i'm trying to figure out a cross street. let's go to some of the pictures here. mostly sunny 280 looks pretty good -- northbound 280 looks pretty good here.

we haven't had too many major issues here as you drive up to the valley. it's been a little better. this is a look at the westbound been, traffic is moving well g etting into san francisco with no major problems. once you get on the bridge. it's a 20-minute delay. plan accordingly. this morning's commute on highway 4 in contra costa county busy coming up to concord, southbound 680, concord to walnut creek some slowing there. let's go to steve. a very good morning. sunshine, a few high clouds. but overall, mostly sunny and temperatures cold again but it does look like maybe the pattern is changing. maybe the pattern is changing as we get a more milder pattern. rain up on the north coast. this system up there is p rojected by some of the forecast models to slide south over the next 36 to 8 -- 36 to 48 hours. if you are heading south, you

might encounter rain. some partly cloudy skies, mostly sunny. more sunshine toward the peninsula, south bay and east bay. mostly sunny today. clouds north. warmer to the south. clouds increase tomorrow. they will come down from the north. one forecast model has rain on it tomorrow evening. clouds increase. it does look like some rain. after that all bets are out. i'm thinking the next system in the pipeline will go over southern california, not over u s. just have a plan-b in your back pocket for the weekend in case this whole scenario melts down. what we're looking at today is to the north. we'll start off with sunshine. our mountain view target forecast started off 34 cold degrees. we'll go for a high of 60 which would be near normal for this time of year. temperatures they've been below for the longest time. 55 yesterday in santa rosa. we'll go 57. a few more clouds to the north but more sun to the south.

one thing i've noticed though, is, when putting together these temperatures they are falling short of projections. upper 50s. only mid-50s for many. it's tough this time of year. the temperature drops fast, about 4:30, 4:45, 31, napa, santa rosa. 30s for everyone here except san francisco at 34. oakland, berkeley holding onto 39. palmsprings, 38. 24 in tahoe. 24 in reno. tahoe two days ago was 9 below. things are coming up a little bit of cloud cover and breeze. 37 monterey, l.a.x. has a little bit of a breeze. that's why they are in the 5 0s. two things to look at. one would be this system. if you are a contractor and you work outside, everything is good today. i think you are all right tomorrow. this should slide south. that one right there. that slow, i think thatted is slides into southern california sunday. was the -- that's the way it

the dow up sharply. this after a report that small businesses are hiring more workers than economists e xpected. they added 93,000 jobs in november. commits were expecting an increase higher. cyber sales topped 1 million for the first time. 7:46. well, on the flip side, novarro, the drug company, will cut 1700 sales jobs from the payroll. they announced all will come from the general medical sales force. the business will be hurt, they say, when the patent on its high blood pressure medication expires. it's not saying where the workers will be laid off or

history as the first woman and first minority in california to hold that position and we now know the final results of another close race with the november 2nd election. with all of the votes counted, incumbent democrat jerry mcnerney has less than 48% while david harmer has just under 47%. the margin of victory came down to just 2600 votes in contra costa, alameda and santa clara county. harmer received most of his v otes in the more conservative san joaquin county. we told but this story yesterday, wells fargo will donate $5,000 to help replace equipment stolen from a school in belmont. police say burglars broke into the school over the weekend.

today. highs today 50s and very low 60s. with the cold weather we've had, it has police in the south bay shifting their focus towards the homeless. claudine wong is in san jose. there's some special efforts happening right now to help those in need. good morning, claudine. >> reporter: good morning, dave. i just got off the phone with the san jose police department where we're learning more about exactly what they are gonna do regards to homeless out in the guadalupe parkway and elsewhere. this is a situation where a lot of homeless live in encampments along the river. we've seen people pull out blankets and san jose police tell me this morning,ty used to actually come out here -- they used to actually come out here and they would do the cleanup in the metro unit. because of budget cuts. what they do instead is help t he -- whoever is in charge of that pacific air -- specific area, help them with the c leanup. they are gonna do that on saturday. this weekend they are gonna put

everyone together. the san jose police officers are gonna help with basic security at that -- as that cleanup. they go in encampment and tell the people who are there you can stay if you want. after the cleanup is over, you can come back. this is what they consider a city-wide effort, a community effort. there was actually a program last night to give out free blankets, that was happening at st. james park. we were there when dozens of home les people lined up to g et -- homeless people lined up to get blankets. that was done by the outreach program and it was just trying to help the homeless stay warm. certainly the nights have been very, very brutal and make it through. some have been making it to shelters and some have not. this is a cleanup effort that's underway just to kind of clean up the -- clean up the debris that's been around these areas. they say they are gonna clean
