we begin with local reaction about the news that jobless benefits will expire. congress is in a fight about how to fund those benefits. ktvu's kraig debro joins us more on what this means for some residents in oakland. good afternoon. benefit checks are in the mail right now. if you are planning to get them in the next few weeks, you will get them. after that, it's up in the air. the president and leaders met at the white house to to try to resolve this. but the bipartisan that everybody thought would happen in congress, it's already fallen by the wayside. so far the two sides have not agreed on an extension.

>> i think by taking the money and -- away, some people relied on it. but i'm looking for a full-time job, part-time job. i come here every day. >> reporter: this morning, the people who stand to lose the lost of benefits continue to work. senate republicans have blocked several attempts throughout the here to -- year to extend benefits in an an effort to prevent this. >> never in the history since we've been keeping statistics, have extended unemployment benefits been cut off. >> the expiration of benefits will stop payment to 2 million

people. richard had stopped to use his money -- >> this is me trying to find a job with benefits. >> reporter: the same benefits that expire today could have already been extended -- or would have been extended up to 99 weeks so far. there's no good time to cut off benefits to 254,000 californians who need them. but three weeks before c hristmas, says one person, is about to the worst time to do i t. kraig debro, ktvu channel 2 n ews. >> there is some good news today about job growth. payroll processor adp says payrolls increased by $93,000 in november. analysts had expected only an increase of 70,000. it is the 10th consecutive month of increases. nearly 80,000 of those jobs were service-related jobs. while the goods production sector added 14,000 jobs. taking a live look at the big

board on wall street. that job growth in the u.s. and signs of global manufacturing extension sent stocks sharply higher today. also, european stocks got a boost after the bank suggested the bank could buy bonds by struggling countries and all major automakers except toyota saw strong sales. the nasdaq and dow are up 3. oakland police are looking for two men they say robbed and sexually assaulted three women. investigators released sketches police say in the early morning hours of november 20th, these men robbed a woman to -- on

market street and took her to her home where they robbed and sexually assaulted her. oakland police are offering a reward up to $30,000 for information that helps convict the men. oakland's police chief is in washington, d.c. this noontime where he's meeting with lawmakers and administration officials. anthony batts is trying to get get federal money to help make oakland's schools teacher. oakland police officers tracked down a truant high school student after he jumped in this truck. for this very reason, anthony batts says the department needs to focus on students at the middle school level before they begin to get in trouble. the chief spoke about the need. >> we are looking to make an

impact on the community policing with the schools. >> reporter: they want to place six polices each at four different middle schools, including this school. two of the officers would be a signedded to the "our kids" or the "okay program." >> schools are very vulnerable at this age. that's the age they decide whether they are gonna be in a gang or resort to violence. >> reporter: back home, parents and students at westlake middle school are proposal. westlake is another school benefiting. >> that's good. he we need the protection for the people.

>> people get in trouble, yeah. >> reporter: this sixth grader sees the need for the police officers. it's up to lawmakers to see these police officers on his campus. jade hernandez, ktvu channel 2 news. a victory for proponents of physical activity after an appeals court overturned an earlier ruling and stated that schools must provide the m andated -- mandated amount of time for p.e. claudine wong spoke to that parent and joins us with reaction from this ruling. >> reporter: good afternoon, tori. we're at cornell elementary school where all of this started and this is the 28th page petition from the court of appeals that goes over this issue of physical education with our kids. this is the issue we're talking about, kids outside playing. the kids are entitled to p.e.

it's in the code, they shall get 200 minutes of p.e. time for every ten days they spend in school. it's even more for middle school kids and high school kids. but one attorney says that wasn't happening at kordell elementary in albany. instead of 200 minutes, they were getting about 120. >> what's lacking is movement. kids are sitting in classes hour after hour, day after after -- day after day. i went to the school board t wice. they basically said nothing. they didn't respond. >> reporter: so last year he s ued the albany school district and lost. the court said the code is a guideline and not a mandatory duty and further said parents don't have legal standing to force districts to follow it. but the appeals court in a

decision filed yesterday disagreed. saying the code means what it says and that while individual school districts may have discretion as how to administer their physical education programs. those programs must satisfy the 200-minute per ten-day school minimum. but clearly this court decision is a big win who says he just wants his kids moving an act dash moving and active. >> i want the school district to be reasonable to understand that there is a law that needs to be followed and to follow the law and that law protects the children and keeps them healthy. >> our calls have not been returned today but that attorney is quoted saying the district's stance -- it's not a situation where they are not meeting their requirements. it's a debate how they are interpreting their requirements. at this point, because of the ruling from the court of a

ppeals, this case heads back to the trial court as this league battle over p.e. continues. claudine wong, ktvu channel 2 news. >> thank you. san rafael authorities are investigating an arson that damaged a boat repair business. firefighters responded at a fire at the bay area boat works on third street yesterday morning. they got the fire out in 15 minutes. but they say there were several points of ignition inside the shop indicating it was intentionally set. damage is estimated at $50,000 for the building and $10,000 for the contents. they also say there were no signs of a break-in. people around the globe are marking world a.i.d.s. day. we'll tell you what some bay area people are doing. it's a special day for hundreds of inner city children in the bay area. most of them putting on ice skates for first time. we'll tell you if the chilly bay area chps -- temperatures will be replaced by rain. it would be easier to move

a car crash in burlingame killed a pedestrian and shut down an early highway this morning. the accident happened on northbound 101 north of b roadway. highway patrol officers say the driver of a toyota prius hit a man who was walking on the r oadway for unknown reasons. he died at the scene. the driver of the prius was taken to the hospital with minor injuries. the lanes reopened with traffic to -- to traffic just about of about 3:00 a.m. word a.i.d.s. day is being observed at the national a.i.d.s. memorial grove. the grove located in golden gate park was illuminated for first time to celebrate the 20th anniversary of the ryan white care act. boulder will be unveiled today, honoring the late ryan white and his mother. it also recognizes the late senator kennedy who was the lead sonser -- lead sponsor.

these people are pedaling on bikes and their goal to raise $ donations. one rider asked why she's doing it. >> i have friends and friends' families who are directly a ffected by this. i have friends who can't get the medication they need. they have to travel a long way. they are part of a team that will participate in the a.i.d.s. life cycle ride from san francisco to los angeles next june. they hope to hit today's goal by nightfall but they plan to ride until midnight. bay area cities are showing their support for world a.i.d.s. day. oakland city hall will be illuminated to raise awareness about a.i.d.s. and h.i.v. sanfrancisco city hall will also turn red tonight to commemorate world a.i.d.s.

day. more than 30 countries plan to light lights. prosecutors in the san joaquin county have released dramatic surveillance video of a -- of a teenaged torture victim moments after he escaped captivity. we want to warn you you may find the video disturbing. he entered a gym to ask for help two years ago today. he was dirty, emaciated and w earing boxer shorts. employees helped the teen and called authorities. he quickly came up and said please help me. they are coming from me. help me, can i hide behind mere. three adults pleaded guilty and face prison sentences of more than 30 years. a fourth men faces life in prison after a jury convicted him last week. the public will get its first chance to comment tonight on a plan for a new stadium for the oakland as. the oakland city planning commission is scheduled to hold a public hearing for the stadium proposed for the

to fall up along the north. ukiah says cloudy skies. not a lot to this system but it's produced okay amounts up there. we do have mostly sunny skies. we could see a band of higher clouds there. right there starting to get closer. the web camera from the meteorology department, showing over san jose a band of the higher clouds. that's just high and mid-level cloudiness that will play into our forecast today, tomorrow and probably saturday. there is a little bit warmer today. clouds increased tomorrow ever so solely. it looks like light rain. not a big deal. but it looks like a gray day. tomorrow that system so the -- to the north will start to drop upon us. it's very weak. it will be partly to mostly cloudy. it will get closer and closer and there's another system that will inch its way toward us. today, temperatures they are warming up. it's been a long, long time since we saw temperatures that

are average or even slightly above. most of these are near average. sanjose, 62 forecasted high would be above average. most of november we were below average. temperatures about as close as you can get, 52 to 54. sanfrancisco, 52. but napa, santa rosa, 54. palo alto, san jose in there as well. oakland berkeley close. most of the lows are around 32, 33, 34, there were a couple of upper 20s. 50 in tahoe. 48 ukiah. 60s down in southern california but there were 30s at palm springs and las vegas. it's cold down there. one little weak system to the north. the stronger one -- the old friday in the own ointment is this one. that's gonna come close to us thursday and friday and then i think it will split and head into southern california by the weekend. it's my hope that's what it d oes. sun and clouds, a little the warmer but more sun giving way toy a few clouds in the

take tag live look at the -- taking a live look at the numbers on wall street. shoppers spent more money. investors like that. the dow is up 11,261. the irs has 700,000 worth of refund checks for bay area taxpayers just waiting to be delivered. according to the san francisco examiner, the irs is holding on to refund checks for more than 2,000 people in the bay area. in most cases, the agency says the checks were returned because the taxpayer moved and did not upgreat their address -- update their address for the post office or the irs. today, a judge ordered wesley snipes to begin a t hree- year sentence next week. he was convicted of tax evasion in 2008. his first appeal failed. he's now appealing to the u.s. supreme court. his attorney claims two jurors

were bias ahead of time about his guilt. but he's still expected to surrender by noon by d ecember 9th to a prison in pennsylvania. today is the 55th anniversary of a pivotal moment in the u.s. civil rights movement. on december 1st, 1955, rosa parks refused to move to the back of a city bus in m ontgomery, alabama and was arrested. that led to a year-long boycott by the city of the bus. some called her the mother of the civil rights movement. she died five years ago at the age of 92. the first day of hanukkah starts later today. governor schwarzenegger got an early start to the celebrations. the governor danced and handed out gifts yesterday as part of the 17th annual menorah l ighting ceremony. hanukkah begins at sunset and lasts eight days. pup at 5:00, a fight has
