richmond to the bay bridge or even just to oakland. you should have a pretty decent drive right now. it's getting more crowded by the minute. we're looking also at interstate 880 as we often do. traffic there looks very nice coming into the downtown oakland area. now at 5:59 let's go back to the desk. sal, thank you. we're going to start with a shooting apparently over a cell phone. it happened shortly after 11:00 last night at 15th street and madison. not far from lake merit. we have some new details. ktvu's kraig debro live in oakland with those details. good morning, kraig. >> reporter: good morning, dave. we just spoke to a witness who heard, saw and then almost experienced the shooting. it happened just behind me at 15th and madison on the northwest corner of this intersection next to that apartment building. now according to our witness multiple shots were fired. but not all of them hit the intended target. the victim wasn't the only thing hit with gunfire. a bullet pierced a window in the building next to where the

shooting took place. the victim got the worst. he was shot more than once and taken to highland hospital. his name and condition are not known but our witness says the victim was well enough to sit on a parked car until help arrived. this all happened around 11:15 last night. the woman said she heard arguing between one or more people and then five or six shots. >> it was kind of scary because there were all these shots and at first i was like is that really a gunshot? i'm not sure what that sounds like. and then i actually went to the floor which is strange because i'd never had to do that before. >> reporter: she says she's lived five years and doesn't believe she's ever heard gunshots here. according to the information we have right now the thief or thieves shot their victim over a cell phone. our information is not complete. we've not been able to confirm the number of assailants involved or if they got the cell phone. i'll be calling the robbery homicide division to see if i can get more details fill in missing information. right now looks like you've got

someone being shot over a cell phone. reporting live in oakland, kraig debro, channel 2 news. and san francisco police are investigating a deadly shooting where one man was killed in the city's richmond district. police were called to an apartment building on 23rd avenue about 9:00 last night. they say they found a man who'd been shot inside one of these apartments. paramedics were called to the scene, but the man died at the scene. we don't know his name at this point. police will only say he's between 20 and 30 years old. and so far no arrests have been made. and there's still no suspect information released by the police. pleasant hill police are searching for a man who pepper sprayed two radio shack employees during a robbery. that happened shortly before 9:00 last night on contra costa boulevard. now police say the suspect pretended to be a customer and asked to see some merchandise. the suspects then pepper sprayed the employee and took off running towards the door with some of the items. police say a second employee tried to stop the suspect but

was also pepper sprayed. the cause of a house fire in san mateo is now under investigation this morning. crews rushed to a home around 7:00 last night. firefighters say when they arrived flames were shooting out of the back of the two story home. they were able to keep the fire from spreading and no one was hurt. this is going to be a tough holiday season in one san bruno neighborhood. it was three months ago that that gas pipeline exploded in the area killing eight people and destroying dozens of homes. now one man who grew up in the neighborhood set up a christmas tree on one of the empty lots. it's complete with solar powered lights. rob says it's his way of trying to get past the pipeline tragedy. time now 6:03. if you remember last month's police standoff on the bay bridge, today we're finding out that the commuter frustration over that day didn't end with the arrest of the suspect. details are coming in. ktvu's claudine wong is out there now. she'll have a live report with the details in just a couple of

minutes. in the meantime, bart is giving away thousands of free gifts this morning. 120,000 bart tickets will be given away to bart riders just to encourage everybody to ride bart when they do they holiday shopping. now each free ticket is for a one way trip during the next three weekends. the give away started at 6:00 this morning. it will continue until 9:00 a.m. in san francisco at the embarcadero, montgomery, powell and civic center stations. in oakland the free tickets will be given at bart's 12th street station and berkeley's downtown station. time now is 6:04. back over to sal to check in on the commute. right now we're doing pretty well in most areas. as a matter of fact, we're looking at the toll plaza. it's getting more crowded now. you can see some people are showing up. about ten minutes from now is when they usually switch on the metering lights which may sit for a bigger back up at the

toll plaza. and people always ask why do they put the metering lights on then? it's because they don't want the bridge itself to get too crowd and had don't want the merge where it merges from 20 lanes or so to five to become unmanageable. so there's your answer. no major problems this morning on 101 in san francisco or going the other way. and speaking of 101, let's go down the peninsula. i want to show you redwood city via maps. the maps will show traffic is moving along pretty well. not only on 101 but also on 280. across the bay 880 also looks good in both directions. 6:05. let's do to mark. hi, sal. we have clouds in place in the bay area. chance of a few light showers highest chance will be up in the north bay. around the bay we could have a few sprinkles or maybe some mist or drizzle out there. south bay just some higher clouds moving into the region. but it should be dry say for san jose, morgan hill and gill roy. current temperatures not

talking about extreme cold out there. basically just quite a few 40s in santa rosa, synura fell, oakland, livermore the cool spot checking in 39 degrees with clouds in place. in fact you can see the source of the clouds out here in pacif so far heavy rainfall up to our north up along the north coast. this system moves to the south a little bit for today. as a result we bring in the chance of few light showers primarily up in the north bay. could have a few sprinkles for friday right into saturday and by sunday for the second half of the weekend we do boost up the shower chances. for this morning though, partly to mostly cloudy. temperatures upper 30s to upper 40s. there's the rain line primarily north of the bay area. and then into the afternoon hours mostly cloudy skies. the chance of a shower especially up towards sonoma county. and once again we could have some drizzle or sprinkles right around the central portions of the bay. temperatures this afternoon mid- 50s to right around 60 degrees. and here's a look ahead your five-day forecast into friday and saturday once again we could have a slight chance of a light shower not a big deal. these are all weak systems. and then showers likely for the

second half of the weekend. partly sunny skies by monday. another weather update in just a few minutes. okay, mark. time now 6:06. we were telling you a couple minutes ago referring back to last month's standoff on the bay bridge. now we're finding out the frustration the commuters had on that day did not stop when the suspect was arrested. let's go to ktvu's claudine wong out there right now to explain what we're talking about. good morning, claudine. >> reporter: good morning, dave. yes. thousands of bay bridge commuters had to deal with the traffic mess thanks to the standoff back in november are apparently still dealing with it. this time the headache's coming via mailbox. it's hard to forget the pictures. it was a mess. november 11th heart of the morning commute and a man held police at bay for hours in a standoff on the bridge which led to chp shutting the bridge down. it took hours to get commuters turned around on the bridge. to do that the chp had to turn them around at the toll plaza. technology often doesn't take into account extreme

situations. and as far as fast track system was concerned those fast track users weren't trying to get out of the way of police action, they were simply cheating the tolls. so those folks are now getting tickets in the mail. this is according to the examiner. the mtc says it's not going to charge the drivers turning around that day. but drivers we talked to this morning says they should go one step further. >> i would expect some type of payment. you're paying so much for fast track. >> reporter: you don't want a ticket, you want them to pay you? >> yeah. pay me something back. >> reporter: back live here on the toll plaza that is not likely to happen. however, if you are one of the folks on the bridge that morning and you did get one of those automatically generated tickets in the mail, the mtc says just let them know that that ticket was issued during the standoff. they say they will make that headache go away as quickly as possible. live at the bay bridge toll plaza, claudine wong, ktvu channel 2 news. oakland police are offering a $30,000 reward to help them find two men wanted in

connection to three rapes. now take a look at these sketches of suspects police are looking for. they are both described as african-american men in their 20s. now police say the men robbed and sexually assaulted a 26- year-old woman at gunpoint on market street last month. then police say they forced her to take them to her home where they robbed and raped her roommates. >> this is a very terrifying event that took place involving three women. they were sexually assaulted, robbed and we need to get the suspects off the street. >> the victims say that the men got away in a 1993 or 1994 black honda civic with a square spoiler. again, there are the sketches. oakland police are asking anyone with information to give them a call. time now 6:09. santa rosa man arrested in connection with an attack that ended with a standoff at a motel. police say 31-year-old christian valdez had a knife with him when he followed a man

outside of a bank on mcdowel boulevard. the man was punched several times before the suspect ran to a motel room across the street. you can see the s.w.a.t. teams moved in. they surrounded the motel for hours. but it took a police dog to get him out. valdez is being held now on $40,000 bail. well, a tahoe restaurant owner came face to face with a charging bear. how that restaurant owner responded and how he feels about it now. plus why the supporters of prop 8 want one judge off the case. and the house votes today on extending those bush era tax cuts for the middle class. i'll show you how today's vote could hurt the chances of a compromise between the white house and republicans.

welcome back. good morning. time now 6:12. the house of representatives will start voting today on how to deal with bush era tax cuts that expire at the end of this month. allison burns reports the tax rates go up for everybody if congress doesn't extend them. and the hopes seem to be fading for a compromise on this. allison, good morning. >> reporter: good morning to you, dave. you know our tax rates for next year are still up in the air. president obama was hoping to reach a deal with republicans. here's his treasury secretary in talks with republican and democratic representatives

yesterday. but this morning the chances of a compromise seem to be diminishing by the minute. here's why. first the house is forcing a vote today to extend the tax cuts just for the middle class. but not for the rich. republicans want the tax cuts for everyone. the senate gop is vowing not to take up any other issues like extending unemployment benefits until the tax issue is resolved. >> we need to show the american people that we care more about them and their ability to pay their bills than we do about the special interest groups legislative christmas list. >> reporter: now even if democrats can muster enough votes in the house today to extend those tax cuts just for the middle class, it seems doomed in the senate. reporting live from washington d.c., allison burns, ktvu channel 2 news. well, also today the house of representatives will vote on a possible punishment of senture for new york democratic congressman.

if as expected the house approves the censure, the 80- year-old will have to walk in front of the chamber to receive his punishment. house speaker nancy pelosi will read a resolution condemning his behavior. he's accused of a long pattern of filing misleading financial disclosure reports. he insists he never meant to violate house rules. supporters of proposition 8 have asked a federal judge to step aside and remove himself for a hearing -- from a hearing scheduled for next week. they're questioning the judge's impartiality because his wife is an outspoken critic of proposition 8. the judge's wife has taken part in legal proceedings against the ban on same sex marriage. the judge is one of three judges on a panel scheduled to hear arguments monday. if he excuses himself, another judge would be chosen at random. that hearing would probably be postponed. san francisco mayor says he plans to make another round of budget cuts before leaving the

mayor's office to become lieutenant governor in january. san francisco currently faces a deficit of $379.8 million for the next fiscal year. yesterday he gave department heads until december 21st to come up with 10% in additional budget cuts. he also said he'll let harris decide who replaces her as san francisco's district attorney. she won the race and she'll join him in sacramento next month. her term runs through the end of next year. ktvu contacted harris' office. her spokeswoman seemed to be surprised by his comment. she says there's no word yet on who she would want to finish out her term. time now 6:16. a tahoe restaurant owner says he was in a life or death situation and was forced to take matters into his own hands after a bear broke into his restaurant and charged at him. the 500-pound bear broke into his restaurant four times in

the same week. and on one of those breakins the bear broke through a window and ate two 3-gallon tubs of ice cream. hunter says he tried ye the bear to scare it away. then he went and got his gun when that bear charged at him. >> i don't regret shooting him because it was necessary. i feel bad about shooting him because he was such a beautiful animal. >> hunter says he called wildlife officials twice before the shooting, but they never responded. he says now he's working on getting some electrified fencing installed around his property. 6:17 is the time. let's check in with sal for any trouble spots. hopefully not this morning. looking pretty good so far, pam and dave. right now traffic has been getting more crowded. we can't really prevent that. they have switched on the meeting lights. that means that people paying cash for sure have been slowing down. but there are no problems reported on the bridge or for that matter on any of freeways

about the extreme chill out there. santa rosa this morning 13 degrees warmer than yesterday at this time. right now 45 degrees. san francisco at 49. and san jose right around 40. here's our forecast model. we'll take this into the afternoon hours by 12:00 we begin to see at least possibility of few light showers up in the northern portions of sonoma county. and then by 4:00 and 5:00 and 6:00 that shower chance does spread to the south. maybe a few sprinkles or drizzle around san francisco or oakland by mid to late afternoon. forecast highs you can see 50s in the warmest locations in the 60s. san jose 61. morgan hill 61. just a chance of a light shower or sprinkle for friday. and also into saturday we bump up the shower chances by sunday and then partly sunny skies by monday. another weather update minutes away. thank you, mark. in about an hour we're going to find out if the housing market is still slumping. the national association of realtors will release its

report on pending sales of previously owned homes. analysts predict a range from either a 3% gain all the way down to a nearly 5% drop during october. most say that home sales likely slipped since the government tax credit expired at the end of september. the fcc has unveiled a controversial proposal that could result in heavy internet users paying more for their service. if the plan is approved internet providers could charge those who spend a lot of time watching videos or down loading files more than other users. the fcc will vote on the plan later this month. time now 6:20. a new report today says almost 50,000 prison inmates all over the country claim tax refunds this year. and they never provided the irs with any wage information. more than $130 million in refunds were claimed by the inmates. now this new report doesn't say the claims were fraudulent but it says the irs needs to do more investigation of it. the berkeley grad released

budgetary reasons. >> we asked our teachers if we could turn on the heaters and they say they don't control it that the district does. but what can help is that we bring coats and stuff and like scarves and gloves. >> reporter: now the district does control the heat through a centrally operated system, but that's not the issue. it's that the heating here at brick middle school is antiquated and just didn't fire back upthe way it should have. >> obviously the system is not working as it should. so it needs revision. that's something we're discussing. and over christmas we'll be handling it differently. we don't expect a repeat of this. >> reporter: now parents are obviously upset. and the district is apologizing. the heat should be restored by 11:00 this morning. live in oakland, ktvu channel 2 news. police investigating a diamond heist that happened in downtown. police say four people wearing ski masks robbed two out of state diamond dealers tuesday

afternoon. the dealers had just left the store on first street and were getting into their car when the robbers pulled up along side them in a sedan and stole their diamonds. no one was hurt. but police say the diamond dealers have made several stops in the bay area to visit clients. the parents of a 12-year- old boy accused of molesting two mill valley boys are now facing a lawsuit. the suit alleges that the parents allowed their son to baby sit 2 and 4 year old brothers without telling their parents he had a history of sexually deaf i can't behavior. the 12-year-old was prosecutorred earlier in the case. we're getting new details because oakland police are searching for the gunman involved in a shooting and attempted robbery. this happened shortly after 11:00 last night not far from lake merit. kraig debro's out there now with the latest. >> reporter: this is one block north of 14th street which is kind of the main thoroughfare

through downtown oakland. it happened behind me the intersection of 15th and madison. there was just one shooting victim last night. but there could have been more than one person on the list. one of the bullets came dangerously close to somebody living inside one of the apartments there. according to multiple accounts one or more assailants confronted a man at the intersection of 15th and madison around 11. madison around 11.(.ecl) 15:00 last night and tried to rob him. the heaves wanted the cell phone. when he balked to refuse he was shot multiple times. the man was well enough to stumble over to a parked car and sit on the hood until help arrived. not all of the bullets hit their intended target. a witness says at least one bullet came dangerously close to someone sitting in their home. >> one of them went through my neighbor's window which was kind of scary. i was worried about her. and she didn't text me back right away so i was really worried about her until i saw her come out to talk to police. >> reporter: the victim's name and condition are not known. he was taken to highland

hospital. witness says two or more people argued just before 5:00 or 6:00, shots rang out. it's getting later in the morning here. people are starting to stir a little bit. i'm going to try to talk to a couple more people out here for amongs on 2. reporting live in oakland, kraig debro, ktvu channel 2 news. your time now 6:34. well, the state supreme court has ruled the murder conviction of a san francisco woman in a 2001 dog mauling case will stay in place. margarine was sentenced to 15 years to life for the second degree murder of her neighbor. in 2004 the judge reduced the charge to manslaughter and she was released from prison. but a different judge later reinstated the murder conviction and sent her back to prison. her attorney could still appeal the decision in federal court. there's a major back up in california's criminal justice system. the state supreme court says it's all because of a critical

shortage of attorneys willing to take on post conviction challenges made by inmates on death row. there are more than 700 inmates on death row here in california. almost half are still waiting for a lawyer to be appointed for them. the average wait is ten to 12 years. criminal defense attorneys say it's all because of inadequate state funding. and also the emotional toll representing a client that's facing execution. 6:35 is the time right now. back over to sal check in on the commute. sal. and we're doing pretty well so far. today has been a little lighter than usual on the front end of the commute. that really means no guarantee for the rest of the commute. right now it looks pretty good as far as accidents or stalled vehicles. a couple disabled cars here and there. but right now traffic is looking good westbound on the bay bridge until you reach the 880 overcrossing. then there's about a five to ten minute delay. looks worse than it really is. i'm looking on the bridge to see if anything east going on.

raping three female roommates in west oakland last month. san francisco mayor making one more round of city budget cuts before he leaves for sacramento in january to become california's new lieutenant governor. the mayor told his city department heads to send him ideas for 10% budget cuts before december 21st to help deal with a budget deficit of more than $370 million. there is some surprising new information about last month's standoff on the bay bridge. the commuter frustration did not end with the arrest of that man responsible. ktvu's claudine wong joins us now with details and the surprise many people got in the mail. good morning, claudine. >> reporter: good morning, pam. if you can only imagine how you'd feel if you were one of those commuters stuck on the bridge for hours. had to be turned around by chp. a couple weeks later for all your trouble you get a ticket in the mail. that's apparently what's been happening. i want to show you the pictures

back on november 11th because they're certainly hard to forget. this was the traffic mess that happened during the morning commute. a man stopped his car on the bridge and held police at bay for hours. it shut down the bridge. did take them a long time to get commuters turned around at the toll plaza. to do that they had to kind of work them back through and u turn them. technology doesn't take into account these extreme situations. as far as the fast track system was concerned, those fast track users weren't trying to get out of the way. they were simply cheating the toll. those folks are now getting automatically generated tickets in the mail. this is all according to the examiner. told the office they're not going to charge the drivers for turning around in the toll plaza. the drivers we talk today this morning said they would not be happy to get something like that in the mail. >> i would be a little aggravated i think. once i calmed down i think i would try to understand and hope for the best. >> reporter: i'm sure the folks

the whole room engulfed in flames. >> he and his two daughters were rushed to the hospital. diamond suffers nerve damage to one leg. you can see it's been burned. 30% of her body. the bill for her medical care is more than $5500. the hayward animal elter by the way is accepting donations to help pay for those medical bills. >> reporter: the central valley city of lodi is hoping to overcome it's christmas tree curse in time for its annual holiday parade tonight. now the city has tried and failed twice to get a christmas tree set up before the parade. first someone cut off the top ten feet of a 20-foot tree while it was being transported from the sierra. then a man offered to give the city a 60-foot redwood tree from his front yard but the branches fell off as it was being moved. now the city is hoping someone will bring them a 30-foot tree before the parade starts tonight. an early christmas for pat

burl. he's coming back to the worlds champion san francisco giants. he agreed to a one year contract. we don't have official word on how much money he's being paid, but it's expected to be a fraction of the $9 million he got last season. the 34-year-old outfielder had some struggles during the post season but he still hit several clutch home runs during the regular season. well, about 24 hours from right now a big giant wrecking ball will take a swing at the old transbay terminal in san francisco. the demolition work is scheduled to start at 8:00 a.m. near fremont and mission streets. the old terminal shut down over the summer. and those work crews are making room at the old site for a new $4 billion transit center. that new center by the way is due to open in the year 2017. time to go back over to sal. we understand it's crowded at the toll plaza right sal? pamela, yes it is. very crowded here.

if you are heading to lake tahoe for this weekend, tomorrow and saturday mostly clou skies. could have an isolated rain or snow shower. then we bump up the rain and snow at least the probability once again for the second half of the weekend right around lake tahoe. back here in the bay area for today here's our forecast model. put this into motion. you will see this at 12:00 this afternoon we begin to bring in shower chances up in the north bay. by 4:00 that gradually to the s nothing major. this could be just some drizzle by late this afternoon into the evening hours for san francisco and also into oakland. so for later on today at least for this morning upper 30s to upper 40s into the afternoon hours. temperatures around 55 to 60 degrees and that's when we do bring in that shower chance. forecast high you can see santa rosa 57. san francisco 56. pacific a 55. san jose lower 60s. look ahead five-day forecast chance of a light sprinkle or light shower right through saturday. we bump up the chance by sunday. another forecast check in just a few minutes. all right.

thank you, mark. this morning japan's antimonopoly watchdog approved a deal between yahoo japan and google. yahoo japan and google already have more than 90% of the search market in japan. the search engine will continue to monitor the companies to continue to see if they offer distinctive and separate services. checking on numbers. nice gains this morning here in the u.s. and europe overnight in asia as well. couple things are happening. retailers report pretty strong sales in november thanks to some very early big discounts from some of the stores. that's helping a lot of stocks and sentiment among investors. and also the european central bank says it will extend some special measures to get ready cash to banks as it responds to the debt crisis there across the region. dow jones up 44 points to 11,299. the sacramento kings are suing three companies after one of its players was injured while using one of those stability balls used in gyms.
