>> reporter: good morning. we are in the neighborhood where the suspect lives. people in this neighborhood had little idea that the suspect in the crime had already a conviction and another sex crime from a few years ago, they were warned or a couple were warned in 2007, still very few say they have little but the vaguest idea that anything like that happened. if you haven't heard what happened after i tell you u you are going to wish i hasn't said anything. police are shocked by the circumstances. >> in my 25 years i never seen anything this brazen and heinous. this is as bad as it goats. -- gets. >> reporter: the dollar tree store, a 2-year-old girl was shopping with often and grandmother when the oler family members went down a aisle to return an item to the shelf. they left the 2-year-old alone. another man came, that man was identified later as eugene

melendres ramos. it takes a second, you heard that phrase. this is problem lane example. the girl was out of sight for 20, 30 seconds or a minute at the most. when they rounded the corp.er to the aisle, that's when the grand mother and aunt found the little girl being raped by a 36 year-old man. police arrested eugene melendres ramos with the help of customers. he had a sex cyme from 2007. according to police he completed parole and he was not required to report whereabouts. the neighbors had only the vaguest idea they were living to a convicted sex offender. i'm not going to show you the house he lives in but we will talk to the neighbors. another thing i'm going to do is go to the house and see if i can talk to somebody inside the

home. the neighbors i spoken to said they would have appreciated knowing more about eugene melendres ramos from the family members. kraig debro, ktvu channel 2 news. flames just damaged five boats in con tacosta county. investigators will be at the scene most of this day. firefighters were called to dutch slew road if unincorporated part of oakly. they found three boats on fire with flames spreading to other boats. two people who live nearby saw the smoke and the flames they dove in to the water. they were rescued by the coast guard. one person was treated for minor injuries. five boats, a total of five were damaged. the cause of the fire is still being investigated. it is 7:04. it's another critical day in the bart police shooting case. this afternoon mehserle goes before a judge in los angeles. the former police officer will ask the judge to release him on

wong is in los angeles where the hear willing take place and live coverage at noon. time is 7:05. we haven't seen much of governor elect jerry brown since last month's election. jerry brown organizing a budget forum to be held in sacramento next wednesday talking about $25 billion budget deficit. the legislator is invited as well as various government officials and even the media. two more forums on education, and on health are also in the works. jerry brown is set to be sworn in as governor january 3rd. the world champion san francisco giants are striking while the iron is hot. in just a couple of hours this morning, giants will start selling a limited number of single game tickets for the 2011 season. >> reporter: good morning.

that's right. the san francisco giants world champs wanting to strike while the iron is hot as you mentioned. we spoke to the head of finances for the team and they are excited about this offer because tickets for next season are going on sale and this is being offered earlier than they ever have before. in less than 3 hours, dugout stores across the bay will be selling tickets to a limited number of games starting today through december 12th. giants want to keep the momentum going since they clinched the world series a month ago. the tickets are not offered until the february fan fest usually. lower box, bleacher seats will be available from april through june including match ups against the dodgers and braves. >> with the holiday here, why wait until february. let's get going now. spring training is going to be here. it's always baseball season here. >> reporter: also on store

shelves december 14th are available for preorder. the video of the world series champs, one hour dvd is narrated by comic rod schneider, $20 on amazon.com. it's offered by sports illustrated. part of a package for about $90, which inclues the magazine subscription for a year, dvd and world series baseball and book. the giants also have a video out which includes the entire season starting with spring training, again as far as tickets go, they will be available on line or dugout stores throughout the area. there is one here at the ballpark and daily city, palo alto and santa clara. two members of the giants will be appearing at sunday's san jose holiday parade.

50 degrees, we have the clouds and fog and spots of drizzle across parts of the bay area. i'm tracking a storm. more on that in a few minutes. time is 7:14. latest jobless numbers came out a couple of hours ago, america's unemployment rate climbed to 9.8%. this is putting a spotlight on congress and whether they are going to extend federal unemployment benefits. carol joins us live with the details. >> reporter: good morningday. let me take you immediately live inside a hearing on capitol hill, lawmakers are getting provided by the main numbers man at the labor department about what went wrong in november. analysts expected better news, instead we found out that the unemployment rate has now climbed to a 7 month high of 9.8%. part of the problem, hiring

slowed especially in the retail sector. nationwide employers added 39 jobs in november down from the month before. putting pressure on congress to extend the jobless benefits that expired december 1st. negotiations are underway to extends unemployment benefits for a full year something democrats want as long as congress extends bush era tax breaks for everyone including the wealthy. something republicans want. if congress does not act quickly, 2 million unemployed workers will lose benefits during the holiday season. >> reporter: yesterday house democrats pushed through a vote extending tax cuts only for the middle class not for the toperners. tomorrow in a saturday session the senate will hold votes on two similar bills, they are not expected to pass. we are watching closely to see if a deal might be worked

out this weekend in the big fight over who should get a tax break next year. they expire the end of this year. yesterday the house voted to extend the cuts permanently. only to those making less than 250,000 dollars a year. republicans want to extend the cuts for everybody including those who earn more money. it is 7:16. a very harsh penalty for a long time member of congress. >> the house is resolved representative rangle of new york be censured. >> charles rangel became the 23rd house member to be censured for financial misconduct. the vote came after the new york democrat was found guilty of ethics violations, he admits he made mistakes but says he is not corrupt and had pleaded with colleagues to avoid this

humiliating experience. a man who head more than 30 threatening phone calls to house speaker nancy pelosi has been sentenced to 21 months behind bars. gregory just te reached a plea deal with prosecutors, he was sentenced yesterday but he already spent 7 months at the santa rita jail. he told pelosi she would not have a home to come home to if she voted for health care reform. his attorney says her client has been repenttant for harassing nancy pelosi. a woman charged with vandalizing trees at a park contends she was doing a public service. she is facing civil and criminal charges after being accused of illegally cutting several trees near mc near's beach in august. officials say she cut the trees to improve her view of the bay.

she claims she cut the trees because they could fall over. the case is scheduled to go back to court next month. foster officials are moving forward with a plan to limit the number of dogs this can be brought to the dog park and other parks. parks and recreation officials voted to recommend police have the ability to enforce a 3 dog rule. officials may also turn it in to an ordinance next february, which could mean citations and fines for violations. less than three hours from now what is left of san francisco's tranceway terminal will be demolished. cameras are pulling back, this is a live look at the terminal. the wrecks ball shows up and starts smashing it to dust at 10:00. all the equipment is out there. demolition was supposed to start at 8:00 a.m.

the crews need time to get everything prepared. items of value were removed from inside there and donated to the state and to a museum that includes brass railings and wooden benches. the transit hub expected to open in the year 2017. in watsonville police are investigating a early morning stabbing at a bar. it happened before 1:30 at the villager bar on east lake avenue. police say that a man was stabbed in the neck during a fight outside the bar. officers say he was transported by air to a san jose hospital, his condition is unknown. they are interviewing witnesses but so far no arrests have been made. we have new details on the attempted robbery overnight. it happened around 10:00 at the panda express on oak grove road. police say one employee and two teenage customers were inside when two gunmen banged on the

restaurant's just locked door demanding to be let in. the teenagers refused to open the door and called police. gunman got away but police are looking for two white men in the late teens or early 20s. no one was hurt. even though the people had a gun the teenagers did the right thing by not opening the door. we got to tell you the story about a local high school athlete really went the extra mile at the state championships. she had to crawl to get there. why she was so determined to finish that race. some drivers in the golden state could cut car insurance costs if they are willing to talk about how much. traffic at the toll plaza is getting a little bit more crowded but still not as bad as normal. we will tell you more about the trends is morning coming up.

a local high school athlete who collapsed during a race showed incredible strength and commitment as she crawled across the finish line. 16-year-old holland reynolds of the university high school was ranked third in the state in cross country, second in a race on saturday at the state meet in fresno when she collapsed short of the finish line. she had a slight cold and may have been dehydrated but finished for her coach, jim tracy who was recently diagnosed with lieu gehrigs disease. >> i started to slow down a lot. i couldn't feel like i could run anymore. >> when kids are determined that nothing will stop them, you wonder, you go, that's coming from deep inside. look at her. it shocked me. >> i went in there,. >> if she placed high enough her coach would win the division five title. a state record which happened after the team won the title.

new survey out, shows the number of american familys with life insurance coverage is at a 50 year low. only 44% of american families have a individual life insurance policy. more than 40% of families say they haven't purchased life insurance because they got other financial prioritys. nearly the same number would have immediate problems paying expenses in the families primary earners should die. term insurance premiums dropped significantly since ten years ago. starting february, california drivers who cut back on their mileage could pay less for car insurance. the department of insurance approve a new rate structure for state farm insurance and the aaa automobile club. rates were pay as you drive plans, based on mileage and up to 10% lower than current

parent of a 2 year-old boy shot and killed while playing with a gun are facing felony child endangerment charges. it happened yesterday at a home on lemon tree court in antioch. police say the 2 year old and his 4-year-old brother were watched by their grandmother when the shooting happened. she was in the living room while the boys were in a bedroom and heard a gunshot. the boy's mother recently bought the gun and father loaded it and took it out of the safe yesterday morning. the boy's uncle is shocked. >> the kids were pretty much well taken care of. they were fine. i just really wouldn't expect something like this to happen. >> tragically yesterday was his second birthday. his parents were not home when the shooting happened. they were both arrested on suspicion of child endangerment and reckless storage of a gun. the father is facing charges on

suspicion of being a felon in possession of a weapon. in 90 minutes from now a convicted sex offender accused of raping a 2 year old girl is due in court. it happened in union city wednesday afternoon. investigators say the little girl was inside the dollar tree store with her aunt and her grandmother, when she became separated from them. the grand mother took her eye off the child for less than a minute when she spotted the suspect raping the little girl in the middle of the store aisle. two samaritans chased and captured the man outside the store. we talked to the family of the accused suspect, eugene melendres ramos. he has a long history of rape and other crimes. union city police say 36-year- old eugene melendres ramos was convicted of attacking a 7-year- old in 2003 and ordered to register as a sex offender. he was not under court

for bail at 1:30 this afternoon, while they seek to overturn mehserle's involuntary manslaughter conviction. his attorney says he should be released and hopes he will be fully exonerated. think there are very very important issues on appeal that ultimately result in the conviction being set aside. >> reporter: oscar supporters said they will protest if he is released on bail. they are hoping in the protest materializes it won't affect the evening commute. >> i hope it doesn't. last time it did. i had to catch a bus over here. >> reporter: some legal analysts are also weighing in saying it is unlikely he will be released on bail. some businesses aren't taking chances. some are preparing for for possibility of a protest in in case that does turn unruly.

up from 9.6 in october. the dow is down 10. nasdaq though is down one, sp down two. day two of a hearing on the repeal of the don't ask, don't tell military policy. members of the senate armed services committee are hearing testimony on a review of the military's gay ban. here is live look at the hearing going on now. top commanders for the army, navy, air force, marine corp.and coast guard are all testifying. some offered negative views of a possible repeal. yesterday, defense secretary gates and chairman admiral mike mullen said the military can and should repeal the ban. loud tv commercials may be a thing of the past. the u.s. house has approved a measure that would force the federal communications commission to set new lower volume standards for the

final campaign finance report shows senator barbara boxer beat -- and outspent her. democrats were worried she would pour personal wealth. barbara boxer spent $28 million. fiorina spent 22 million. she loaned her campaign a million dollars that has since been repaid. california lawmakers continue to enjoy certain perks despite the state's financial crisis. that includes taxpayer provided cars. new report shows the state spep more than $5 million for the latest suite of vehicles. lawmakers pay a percentage of their vehicles cost, 10% for less expensive cars, more for higher end models.
