>> reporter: good morning. we are in the neighborhood where the suspect lives. people in this neighborhood had little idea that the suspect in the crime had already a conviction and another sex crime from a few years ago, they were warned or a couple were warned in 2007, still very few say they have little but the vaguest idea that anything like that happened. if you haven't heard what happened after i tell you u you are going to wish i hasn't said anything. police are shocked by the circumstances. >> in my 25 years i never seen anything this brazen and heinous. this is as bad as it goats. -- gets. >> reporter: the dollar tree store, a 2-year-old girl was shopping with often and grandmother when the oler family members went down a aisle to return an item to the shelf. they left the 2-year-old alone. another man came, that man was identified later as eugene

melendres ramos. it takes a second, you heard that phrase. this is problem lane example. the girl was out of sight for 20, 30 seconds or a minute at the most. when they rounded the corp.er to the aisle, that's when the grand mother and aunt found the little girl being raped by a 36 year-old man. police arrested eugene melendres ramos with the help of customers. he had a sex cyme from 2007. according to police he completed parole and he was not required to report whereabouts. the neighbors had only the vaguest idea they were living to a convicted sex offender. i'm not going to show you the house he lives in but we will talk to the neighbors. another thing i'm going to do is go to the house and see if i can talk to somebody inside the

home. the neighbors i spoken to said they would have appreciated knowing more about eugene melendres ramos from the family members. kraig debro, ktvu channel 2 news. flames just damaged five boats in con tacosta county. investigators will be at the scene most of this day. firefighters were called to dutch slew road if unincorporated part of oakly. they found three boats on fire with flames spreading to other boats. two people who live nearby saw the smoke and the flames they dove in to the water. they were rescued by the coast guard. one person was treated for minor injuries. five boats, a total of five were damaged. the cause of the fire is still being investigated. it is 7:04. it's another critical day in the bart police shooting case. this afternoon mehserle goes before a judge in los angeles. the former police officer will ask the judge to release him on

slowed especially in the retail sector. nationwide employers added 39 jobs in november down from the month before. putting pressure on congress to extend the jobless benefits that expired december 1st. negotiations are underway to extends unemployment benefits for a full year something democrats want as long as congress extends bush era tax breaks for everyone including the wealthy. something republicans want. if congress does not act quickly, 2 million unemployed workers will lose benefits during the holiday season. >> reporter: yesterday house democrats pushed through a vote extending tax cuts only for the middle class not for the toperners. tomorrow in a saturday session the senate will hold votes on two similar bills, they are not expected to pass. we are watching closely to see if a deal might be worked

she claims she cut the trees because they could fall over. the case is scheduled to go back to court next month. foster officials are moving forward with a plan to limit the number of dogs this can be brought to the dog park and other parks. parks and recreation officials voted to recommend police have the ability to enforce a 3 dog rule. officials may also turn it in to an ordinance next february, which could mean citations and fines for violations. less than three hours from now what is left of san francisco's tranceway terminal will be demolished. cameras are pulling back, this is a live look at the terminal. the wrecks ball shows up and starts smashing it to dust at 10:00. all the equipment is out there. demolition was supposed to start at 8:00 a.m.

suspicion of being a felon in possession of a weapon. in 90 minutes from now a convicted sex offender accused of raping a 2 year old girl is due in court. it happened in union city wednesday afternoon. investigators say the little girl was inside the dollar tree store with her aunt and her grandmother, when she became separated from them. the grand mother took her eye off the child for less than a minute when she spotted the suspect raping the little girl in the middle of the store aisle. two samaritans chased and captured the man outside the store. we talked to the family of the accused suspect, eugene melendres ramos. he has a long history of rape and other crimes. union city police say 36-year- old eugene melendres ramos was convicted of attacking a 7-year- old in 2003 and ordered to register as a sex offender. he was not under court

minute. >> inattentive parents and grandparents, these were grandparents there, close proximity, and literally this happened as the child rounded a aisle in the store. >> reporter: he has a prior conviction for a sex crime in 200,036,789 attempting to rape a 7-year-old girl in hayward. until recently police say he was required to report in grave detail his whereabouts to authorities. when that window expired authorities would not follow him as closely as they had before. many people in his neighborhood say they only the vaguest idea that he had a history. >> he warned me, be careful. >> did he tell you why? >> he told me he raped somebody. >> when we tried to look it up, that house has never been marked. >> do you have kids?

karzai by video conference. we will bring you more details as we get them. the latest jobless numbers are out americas unemployment rate climbed to 9.8% this once again puts the spot spotlight on congress and whether they will extend unemployment benefits. most analysts expecting better news instead we found out that the unemployment rate climbed to a 7 month high of 9.8%. part of the problem, hiring slowed. especially in the retail sector. hiring in manufacturing and construction remained flat. nationwide employers added 39,000 jobs in november, down from the month before. when asked how long it would take for the economy to bounce back the main numbers man for the labor department had this to say. >> we had the pick up in the

unemployment rate reflecting the job growth is not strong enough to start reducing it. it makes it impossible to calculate how long it's going to take. we will need stronger job growth to start lowering unemployment. >> this is putting pressure on congress to extend federal jobless benefits that expired december 1st, a deal is in the works to extend them as long as bush era tax cuts are also extended for everyone. while unemployment remains high in the east bay, a study shows the area has a chance of having a brighter future. increasing access to good child care is an important factor in helping more parents become wage earners. the report put together by two organizations says the quality and availability of child care services remain uneven in the east bay with costs being a

the 2 year old and 4 year old brother were being watched by the grand mother. she was in living room and the boys were this the bedroom. the boy's mother bought the gun and their father loaded it and took it out of the safe yesterday morning. the boy's uncle says he is shocked. >> the kids were pretty much well taken care of. they were fine. i just really wasn't expecting something like this to happen. >> yesterday was his second birthday. his parents were not home when the shooting happened. they arrested on child endangerment and reckless storage of a gun and the father is also arrested for suspicion of being a felon in possession of a weapon.

an attack happened inside this store wednesday afternoon. the little girl was inside the dollar tree store when she became separated from her aunt and grandmother. the grandmother says less than a minute later she actually spotted the suspect raping the child right in the middle of the store aisle. two good samaritans chased and captured the man outside the store. >> i caught him by the shirt, and he tried to break off like square off with me. i arched back. i tackled him. i tackled him and sat on him. i dialed 911. >> the suspect eugene melendres ramos is facing several felony charges including rape, sexual acts with a child and false imprisonment. the police want any witnesses to come forward. we talked to the family of the suspect, eugene melendres ramos, we are told he has a long history of attempted rape

is when you have been con vilgted of a felony you do not have a right to bail pending appeal. it's possible. the factors are you a flight risk, danger of the community, in the judge feel there is is a substantial question raised that might lead to reversal of the conviction or reduction of the sentence, that could justify bail as well. >> what about the community who could be angry. people are not happy. >> that's a wild card as well. two sides to the coin. a lot of folks were angry about the verdict. they looked at the situation and said they should have been convicted of murder in the second degree. that was not the result. secondly they say he could have gotten 14 years on the invon you will tear manslaughter the gun enhancement.

the question is should the judge take in to i a count the fact that a lot of people second guessed the process and going to be angry at the idea of a low sentence and bail, the answer is under the law the judge is not supposed to take in to account that kind of community sentiment. the judge is supposed to look at the factor that feed in to the bail decision. >> you mentioned the judge tossing out the gun enhancement charge. does the da have a right to appeal that. >> absolutely. that's something people haven't been focusing on. the district attorney has a equal right to appeal. if the jury come in and said not guilty, no appeal by the district attorney, but to the extent the judge tossed out the gun enhancement the da has a right to go to the court of appeal says the judge got it wrong. in addition to tex at the present time the judge went to the low end of the involuntary

manslaughter scale, the da is entitled to go to the court of appeal and say we think the trial judge blew it and you should impose a more serious sentence. >> what do you think is going to happen today? >> bottom line is mehserle has a uphill battle trying to get bail. he is only looking at several months additional being behind bars in connection with his conviction, given all the circumstances, is judge is unlikely to second guess his own decision. i don't think this appeal is going to be successful by mehserle and probably be stay behind bars. stay with ktvu for continuing coverage. the bail hearing is set for 1:30 this afternoon. a news crew in los angeles and live coverage on ktvu channel 2
