good news for drivers about the east bay bay bridge retrofit plan. more on that coming up. what started as a routine crash became a lot worse. a driver involved in a spinout ended up losing her life this morning after making a critical mistake. for some another rainy day. but for others it's not so much the rain but the fog. how will that play into the forecast? and a busy fast food drive through became a crime scene overnight. the investigation up next here on the ktvu morning news. welcome. good morning to a brand new day. thursday december 9th. >> let's see if it will be a rainy start. for some. cloudy skies, foggy conditions and very mild to warm.

just received a tweet from robbie in morgan hill. she said my goodness it's 60 what's going on? all this moisture coming up from just north of the hawaiian islands. rain will make it north and stay there. fog, mist and drizzle. for others temperatures upper 50s to low 60s, here's sal. traffic is moving okay on highway 24 westbound. up to the tunnel no major problems as you can see traffic is okay at the bay bridge toll plaza. there is a bit of a back up forming and a little bit of fog also on the stand. be careful and have caution on those bridges. an update in about six minutes. thank you, sal. this morning we have good news from cal tran. new span of the bay bridge may open months earlier than expected. ktvu channel 2 reporter jade hernandez at the toll plaza this morning to tell us why. but there are also some challenges still ahead. jade. >> reporter: all right. it is nice to report some good news this morning. four to six months earlier,

that's how much earlier drivers will see that east span open up. that's what cal tran say they expect this morning. it seems as if the incentives work. bay bridge officials offered an incentive package in december to speed of manufacturing of the bridge's steel deck and towers in china. steel delivers have arrived on time or ahead of schedule. and the single tower which will support the suspension span will soon be up. this sunday a new shipment of steel including the third of five tower sections to be hoisted up will arrive. plus two more pieces of the bridge jack. if all goes as scheduled, the steel should go up before christmas. drivers will see a tower higher than the top of the island. cal trans has found a way to open the whole bridge in both east and westbound directions in 2013 instead of 2014. which means addition to the early arrival of steel, cal

trans has to or question strait a series of manufactures and traffic changes. the cost of the changes is unknown, but cal tran says it shouldn't use more than what's set aside in the contingency fund. what does that mean for drivers? let me bring you back out live here at the bay bridge toll plaza. the westbound approach to the existing bridge as well as the eastbound landing will take a turn to the south. it's a change that will emerge some time in may or june. we are reporting live from the bay bridge toll plaza this morning. jade hernandez, ktvu channel 2 news. time now 6:03. this morning walnut creek police are out there searching for the gunman who robbed a busy sandwich shop. this happened yesterday evening at the quiznos on oak grove road. police say the gunman cleaned out the cash register and stole the owner's wallet. no customers were robbed. police in pittsburgh investigating a shooting late last night at a taco bell. now we just got off the phone with police. they say two young men who came to pittsburgh to buy drugs

ended up being shot at by the two people they were supposed to buy the drugs from. police say all four met up at the taco bell on century boulevard around 10:00 last night. one person was shot in the neck. he's being treated for his injuries in concord. police haven't made any arrests yet in connection with the shooting. a toddler remains in critical condition after falling into the famous fountain at the hyatt regency in san francisco. tara joins us now with more on the story. tara, you just found out why the toddler's family went inside the hotel. >> reporter: right, pam. well, you can see it's sprinkling a bit right now. but yesterday afternoon it was pouring rain. that is why a mother brought her twin toddlers inside of the lobby of the hyatt hotel regency that you can see right behind me here. it was to escape the wet weather. what happened next could have happened to anyone. here's a look at the fountain inside of the lobby where the woman's toddler son was found

after he went missing for about ten minutes. hotel surveillance video shows the boy breaking out of his mother's arms and running away. we spoke to a hotel official moments ago who said it was truly every parent's worst nightmare. >> the woman immediately started screaming and all the employees were excellent and every employee looking for him. >> reporter: the boy was found in a trough of the fountain in about 29 inches of water. paramedics tried to rhesus resuscitate him at the scene but were unsuccessful. we are expecting an update later today. now we did speak to a hotel official just a few moments ago who says that the hotel's risk assessment team will meet with police later today to discuss the incident. nothing like this has happened in the 37 year history of the fountain. they were definitely going to be speaking with their lawyers and reviewing everything that happened. and meanwhile no one is being allowed inside of that lobby unless they are a registered

guest of the hotel. live in san francisco, ktvu channel 2 news. well, a funeral will be held this weekend for a 3-month- old boy killed while in foster care. his foster parent is now accused of shaking him to death. the 53-year-old pleaded not guilty to a homicide charge. prosecutors say he shook the baby to death last week. now the baby's relatives say child welfare services put the baby in foster care shortly after he was born because he tested positive for methamphetamine. >> hurt and angry because i thought i could depend on county to help me. and they just let me down. >> christian's uncle and aunt say they were trying to get custody but claim their case was put on a back burner when the social worker on the case

went on vacation. it's a tragedy and all foster parents must undergo background checks. a retired teacher recovering this morning after being burned inside a santa rosa classroom. phyllis was helping with a candle making project when the wax caught fire. the 61-year-old classroom volunteer was burned on her face and neck. no students were there in the classroom at the time. >> she started the fire somehow with the candle wax. it ignited. she realized she needed to remove it from the classroom so she picked it up to take out the front door. >> another teacher who witnessed the accident rushed over to put out the flames. she was taken to santa rosa memorial hospital for treatment of her burns, but she has since been released. some important privacy changes are just down the road for the bay area's estimated one million fast track users. several new safeguards will take effect january 1st. they're designed to make sure the private information of drivers remains private.

that includes increased efforts to undercover security breeches. drivers who sign up for fast track have to provide a credit card number, e-mail address and phone number. our time now 6:07. there was an earlier horrible situation on the road in san leandro. sal, are you still following that? >> yes, we are just going to tell you that the fatal crash occurred just after 3:00 this morning near washington avenue and 880. a woman's car spun out and once she got out of her car she was hit by another vehicle. she was pronounced dead at the scene. several southbound lanes were closed for almost two hours but they have reopened. police say the safest thing to do is if your car can't be moved out of the lanes, stay inside your car until help arrives. these are pictures of the earlier crash. again, all lanes are now open on 880 in both directions. move to 880 a little bit closer to the coliseum. traffic is moving along okay. it's still wet out there from the overnight rain. but you should be okay. we don't have a lot of collisions i should say right now. and you should be fine if you

drive carefully. if everyone did that we'd be much better off. this is a look at westbound 80 coming up to the macarthur maze to the toll plaza. east 80 just a vehicle got into an accident we just found out about that. 280 north and southbound that traffic in san jose is okay. looks like it's been wet there in the last few minutes. 6:08. let's go to steve. sal, thank you, sir. in the 6:00 observations napa, santa rosa say light rain. everyone else says cloudy/fog. couple 100s petaluma, napa, that's where most of the light rain will be today. it will be moving north over the next 24 to 36 hours. doesn't mean san francisco, oakland points south could get light rain but nothing compared to yesterday where we had the steady rain added up to nearly two inches of rain. some totals 24 to 36 hour.

petaluma had a half inch of rain. crockett our observe a third and an inch. and palo alto only a third. mountainview had a quarter of an inch. so from sfo's .82. palo alto a third, mountainview a quarter. san jose .15. this is again this year i've noticed the north bay getting the rain, santa cruz mountains getting the rain, east bay, but not the peninsula. pretty much most stays north of sfo or the santa clara valley. they're running behind whereas others are running above normal. there is a back edge. so the pattern's lifting. a lot of moisture in place. very mild warm conditions. upper 50s for some. this moisture coming up from almost the hawaiian islands. it's a tropical feel. 50s, 55, livermore concord 57. oakland berkeley 57. stream of moisture finally starting to lift up north. not before a cloudy foggy day with some light rain by tomorrow the rain will move north but the fog will be all over the place especially

[ cheering and applause ] the motion is adopted. >> now the dream act measure is aimed at undocumented immigrants who came to the u.s. before the age of 16 and have been in the country for at least five years and graduated from high school. they would have a chance to gain legal status if they join the military or go to college. political observers say though it's not likely democrats will get the 60 votes they need to advance that bill to the u.s. senate. the white house is issuing a dire warning for the economy if congress does not okay the president's plan to extended bush era tax cuts.

as allison burns reports, it's the latest high pressure tactic to try to sway skeptical democrats. good morning, allison. >> reporter: good morning to you, pam. i got an e-mail from oakland congresswoman barbara lee's office also head of the congressional black caucus. she says this tax cut deal would disproportionately hurt poor and low income families. but the white house has a different message. white house economic advisor larry summers surprised a lot of people when he said there is a recession threat if congress doesn't act. he says it would materially increase the risk the economy would stall out and we would have a double dip. some economists are issuing similar statements and a new report from analytics predicts a tax cut deal could cut the unemployment rate to 8.7% from its current rate of 9.8%. president obama's talking about lobbying democrats who don't want to extend the tax cuts for the rich. >> it is inaccurate to

characterize democrats with large as feeling "betrayed." i think democrats are looking at this bill and already have had a whole bunch of them who said this makes sense. >> reporter: and a top senate republican tweeted this morning that a vote is coming soon. we just don't have any official word yet about when that is going to be. reporting live from washington d.c., allison burns, ktvu channel 2 news. well, flags at the state capitol will fly at half staff to honor a monterey county soldier killed in afghanistan. the 45-year-old staff sergeant died in a noncombat incident. he leaves behind his wife and their 6-year-old daughter. he visited his daughter's school just last month for veteran's day and received a standing ovation when he was introduced. well, it now looks like the senate won't vote on starting debate on repealing the military's don't ask don't tell policy until after dealing with the tax cut legislation.

senate leader harry reed canceled a procedure vote yesterday after republican leader susan collins asked for delay in exchange for her support. collins says the republicans want the senate to take up tax cuts before working on anything else. time now 6:17. the 21-year-old accused of trying to detonate what he thought was a bomb that a military recruiting center in maryland was reportedly looking for help and that's how he got caught. according to documents presented during the court appearance of antonio martinez yesterday, he had talked about his plans to attack the recruiting center with four people. two of them refused to help him. one tried to talk him out of it. another one contacted the f.b.i. martinez told an informant that after hearing about the teenager arrested in the oregon sting he was worried but still wanted to go ahead with his plans. a san francisco police captain says many of his officers were reluctant to give tickets to drivers in the weeks

leading up to the november 2nd election because they wanted the public support in rejecting proposition b. that's according to a report in the san francisco examiner. the paper says the number of citations issued by officers in the angleside district dropped 28% in october compared to the year before. proposition b would have required city employees to pay more for their health and retirement benefits. it was rejected by the voters. time now 6:18. sal's going to help you get to where you need to go particularly if you've got to go over bridges. >> that's right. we're hearing of fog advisory for one of the bridges just found out about that. that's because the fog is going to be thick especially on the bay bridge. but it's also foggy on the golden gate bridge. a little bit of fog. the advisory for the bridge has been issued -- actually i'm just reading this as i go so pardon for the stumbling around. let's go to the bay bridge.

to the south. tomorrow improving conditions but a lot of fog. carry that into the weekend. inland areas especially with the coast sunny, warm near 70 on sunday. all right. thank you, steve. insurance giant aig is taking a key step towards paying off its government bailout. the largest of the financial crisis. executives say they will pay off a loan from the federal reserve bank of new york. and that will clear the way for the treasury to sell off the government's stake in the company. some homeowners are in foreclosure by mistake. there are no official statistics, but lawyers, real estate agents and consumer advocates say their ranks are growing. homeowners in florida, nevada, texas and pennsylvania have filed lawsuits claiming they are victims of mistaken foreclosure. in california and kentucky, class action lawsuits have been filed on behalf of homeowners who alleged that they made all of their payments but the banks took control of the property any way. time now 6:22. in the south bay a plan to boost school performance there, but this could come at the

good morning. right now traffic is moving along okay if you're driving on bay area bridges. but they have turned on the metering lights at the bay bridge. it's very foggy. in fact it's so foggy we can't see the richmond bridge although traffic is okay. san mateo and golden gate bridge traffic looking good. 6:25. back to the bridge. thank you, sal. tonight the san jose unified school board will consider a proposal to slash funding for adult education. the mercury news reports the money saved would go towards boosting academic performance among k through 12 students. the district is considering creating a middle school academy, restoring summer school and restoring five days of instruction. however, to do that funding for adult education would have to take deep cuts. in san pablo, some parents and students staged a noisy rally in a last ditch effort to keep their school open. lake elementary school is expected to close in june unless the contra costa county

school district can come up with $300,000. contributions from the city of san pablo over the last two years have kept lake elementary open, but the city's mayor says it can no longer afford to help. time now 6:26. this week's rainfall is adding to a rainy season that's been slow and steady so far. but it is helping the bay area's water supply. in the south bay reservoirs are 10% above average. that's in part thanks to last year's healthy rain totals. after several storms saturated the ground, the santa clara valley water district can now start capturing runoff. >> rainfall in san jose is about three quarters of average to date, but in the mountains it's been about average. so we're just starting to see runoff into our reservoirs. >> the most significant rains come between january and march. there have been rumors for months. and this morning howard stern

looks like a very good day today because of the weekly jobs numbers that came in surprisingly good. we'll talk about that in a moment. we will. we'll say good morning to you. thank you for joining us here on the ktvu morning news thursday december 9th. i'm dave clark. >> good morning. i'm pam cook. time now 6:30. in the news for you this morning, a little boy remains in critical condition after a horrifying accident at the hyatt regency hotel in san francisco. ktvu's live now to tell us what's going to happen in just a couple of hours. good morning, tara. >> reporter: well, good morning, dave. the hyatt's risk assessment team is going to be meeting with police later this morning to discuss exactly what happened with this fountain incident. now it was actually the weather that set off a tragic chain of events yesterday afternoon when a mother carrying her twin toddlers stepped inside of the lobby here at the hyatt regency near the embark dare to escape the rain. here's a look at the still photos of the fountain an 18- month-old boy wandered into.

surveillance video shows the boy broke free from his mother's arms. she's frantic and yelling. moments later a hotel worker finds him in the trough of the hotel in about 30 inches of water. >> a two feet wall if a small child were to lean in there and fall in they would be behind the endless fountain. so you wouldn't see them behind the wall of water. that's why it took so long to even find him. >> reporter: both officers and paramedics tried to revive the boy but were unsuccessful. he was rushed to the hospital and is now in serious condition at ucsf medical center. now i'm speaking with hotel officials this morning they say they can't remember anything like this happening since the fountain went in in the early '70s. you'd have to imagine after this morning's meeting there may be some talks of getting rid of that fountain altogether. live in san francisco, ktvu channel 2 news. all right. thank you, tara. one person has died after being

hit by a cal train in san mateo. this happened yesterday afternoon and it caused delays through the evening commute. it's the eleventh death on the cal train tracks this year. officials say cal trains is in the process of improving their rail crossing safety to prevent these deaths in the future. also oakland police say a bicyclist hit by a truck was riding the bike the wrong way on a one way street. this happened about 7:30 last night near the intersection of lakeside drive and 19th street right near lake merit. the fire department told us the bicyclist suffered head injuries and was rushed to highland hospital. we don't know his condition. berkeley police are still out there searching for the masked gunman blamed for a bold takeover robbery at a fast food restaurant. this happened early yesterday morning. we were telling you about it yesterday morning. at this mcdonald's on san pablo avenue. police say he demanded one employee clean out the cash register and hit him on the head with his pistol.

they also say he ordered the worker and three others to get inside a walk-in refrigerator. that robber left the scene in such a hurry that he left a trail of money outside the restaurant. and police in fairfield hope you'll take a look at this surveillance photo. it may lead to the arrest in a bank robbery. investigators say this gunman with the ski mask went into the bank on oliver road about 1:15 yesterday afternoon, demanded money from a teller, then escaped with an undisclosed amount of cash. witnesses spotted him getting into a silver ford taurus. a walnut creek animal shelter is trying to determine who is responsible for a horrible act of animal cruelty. someone severely burned the ears of this cat. a 13-month-old cat. workers at the animal rescue foundation are now caring for her. she was found in a box at the concord bart station a few days ago. workers have named the cat valentine. they hope to find her a home by february. america's most famous shock

jock will remain in the satellite radio booth for the next five years. just hoursing a howard stern announced he signed a new deal with siriu s xm radio. terms have not been disclosed. he left broadcast media five years ago to sign up with the satellite radio network. at that time his deal was worth reported $500 million. time now 6:34. let's see what's happening on the roads now. the latest is it's still wet out there. it's not as bad as it was yesterday when we had a lot of crashes at this point. right now we're doing okay. we have some fog issues on the bridge if you've been driving across the bridge or going to drive across the bridge soon you'll know that it's somewhat hard to see especially on the lower deck but also on the upper deck as well and back up at the toll plaza. metering lights have been on for about 20 minutes now. moving along and taking a look at 680 southbound. not too bad. a lot of our pictures are foggy. steve will give us an update on the fog and how it's moving around.

we've had a couple stalled vehicles out there. nothing major when it comes to accidents. highway 101 looks good if you're on the peninsula. no major problems there. and no problems this morning on 280. it's 6:35. let's go to steve. all right, sal. we have some areas of fog. light rain continues mainly to the north bay. pattern has no doubt about it changed. remember how cold it was in november? now it's very mild. upper 50s for lows. i mean we were having a hard time to get a high of 55, 56 degrees for a while there in november. everything came right down out of the north. this is all coming up from the west-southwest. the air is saturated which is why there's fog. if a sea gull flies by and flaps its wings that creates enough dynamics to give rain to the north bay. i'm embellishing a little bit. you know what i mean. oakland had an inch of rain plus. same for san francisco. sfo .82. dublin and napa picked up a half inch. san jose only .15. our observer in blossom hill

had .08. not much. there were higher amounts towards the higher elevations in the santa clara and santa cruz mountains. some of these are 36 hour totals. so that's our observer one inch even. palo alto picked up a third of an inch. mountain view a quarter of an inch. cloud cover will continue. rain line is advancing northward and will continue to do so. the problem is this is going to give us a lot of cloud cover and very tropical feel especially towards the santa clara valley. light rain, foggy, then cloudy. 50s and 60s on the temps. and antioch starting off at 52, fog. and kind of a cloudy mostly cloudy day and light rain off and on but not as much as yesterday. 53 to 57. we're starting off rather mild. wouldn't take much to get into the tropical feel that we already have. 40s and 50s. look at reno 51. sacramento 54. the moisture will continue to move north but it's going to take a couple days to clear it out. the fog is not going anywhere.

welcome back to the morning news. i want to take you live to london this morning where we have been monitoring a situation. protest over tuition hikes really getting violent this morning. clashes with police in riot gear. we have understand this is at parliament square. that area's been blocked off with fencing so the pedestrians couldn't get near there. but the protesters have gotten close. they've torn down the fencing, handed it over their heads trying to get closer. riot police are there now this morning. you can see a number of security vehicles there all lined up. this is not far from westminster abbey. and, again, these are student protests over a vote on tuition

to talk about a proposal to cut the funding for adult education. the money that will be saved will reportedly go towards boosting academic performance in k through 12 schools. later this morning a san diego county house described by authorities as a bomb factory is scheduled to be destroyed. yesterday a federal judge approved a controlled burn to remove dangerous chemicals from the house. the home belongs to george accused of making bombs and storing highly explosive chemicals. you can see crews putting up a 16-foot wall to protect nearby homes. people who live in the area have been asked to leave. time now 6:43. governor-elect jerry brown says the state's budget deficit may be even worse than predicted. he's calling on republicans and democrats to get over partisan politics and get the job done. >> we can't keep going on the way we have. it's getting worse. and therefore people will have

in each puff causing cellular damage in nearly every organ. the surgeon general also says inhaling even a little secondhand smoke could be enough to block your arteries and trigger a heart attack. now, you could soon see more electronic cigarettes on store shelves. that's because an appeals court has ruled that the food and drug administration can't stop imports of e cigarettes. the fda wanted to regulate them as a drug device but the court says the e cigarettes should be treated like tobacco products. electronic cigarettes deliver a blast of nicotine vapor instead of smoke. time now 6:45. a controversial anti-bullying curriculum will remain mandatory in schools in vallejo despite calls for an opt out choice. >> basically my right as a parent is being taken away. you're going to just force this on my kids. >> last night the school board got an earful from some pretty angry parents about the respect for all program. it consistents of three films

the sign that is flash just before you get on the bridge are warning you about the fog. so just take it easy if you want to give yourself an extra few minutes that may be okay. remember high beams are the worst in the fog. they don't work. they make your visibility worse. just keep the low beams on and drive carefully. go to interstate 880 here. also foggy near the coliseum as you can see from this line of picture no major problems. go to contra costa county. highway 4 of course is slow. now remember yesterday instead of just being slow in antioch it was slow the whole way to concord. we've seen some improvement. this is a look 880 southbound at 880 clearing an accident right in the middle of traffic heading south toward union city. and in the south bay we have a new crash northbound 101 at tully road. that traffic is going to be busy coming in from the blossom hill valley. 85 also slow approaching 17. it's 6:47. let's go to steve. >> sal, thank you, sir. we are in a very foggy san

>> it's important to see the expansion of economic activity and jobs, but it's not something that is going to have a permanent effect. it will have a temporary effect. >> supervisors selected the northern waterfront rather than the more expensive southern site that had been under consideration. organizers of the bid told supervisors they got to act quickly because a decision on where to hold the prestigious race is expected by the end of the month. federal aviation officials say they're worried about the increase of people pointing lasers at aircraft cockpits. this year there have been more than 2200 incidents. that's up from less than 300 incidents five years ago. look at this. the laser's very intense light can actually distract and even temporary blind a pilot. a lot of cases pilots had to hand over the control of the planes to their co-pilots. the spokesman for the faa says there have been dozens of
