police, filled out a police report and explained what happened. this fedex driver told me, he pulled up to this home to deliver a package. a package for christmas. and when he was getting off his truck, a man came up from behind him. pushed him out of the way, the keys were still in the ignition truck, the man drove off with his truck and all of the packages still inside of it. there were at least 60 packages inside of that truck. fedex security team has been contacted and they are trying to track down that vehicle. however, that truck did not have a gps tracking device. now coming up a little later on this evening, we're going to try and get in touch with police and find out a little bit more about what happened. get a little more information, but for now the fedex driver who had this stolen car with 60 packages inside, says he would like to explain to all of the customers out there, he is very sorry because he knows a lot of

those people will not be getting those gifts for christmas. allie rasmus. a long time argument between the city of san francisco and the 49ers has come to an end. it was an argument with millions of the dollars at steak. now the question is will this agreement help keep the 49ers from moving to santa clara. david stevenson is live now in the city with our report, david. >> reporter: julie, today the mayor of san francisco told us the city and the 49ers have reached a tentative truce over the run down conditions here in candle stick park including the parking lot, luxury boxes and seats. >> 49ers, that is san francisco. >> reporter: 49ers fans at san francisco's oak greenburg's bar cheered news of the agreement. keeping the team here while they clean up the park. >> litigation goes away, the threat goes away. >> reporter: in addition to the 49ers dropping a maintenance

today, it said -- we are pleased that our negotiations with the city of san francisco have resulted in a tentative agreement. >> i don't mind that park. >> reporter: now mayor newsom tells us the $13,000 will come from existing rent credits owed the team. along with $3 million in funds from the cities litigation account. reporting live, david stevenson, ktvu channel 2 news. san jose's police say the a man was killed when a man slammed into a pole. the man was driving at a high rate of speed down south tenth street near east alma avenue just before 6:00 a.m. when he lost control. the driver was thrown from his car, another car dragged his body several yards down the street. parts from another vehicle was

spotted several blocks away. it is unclear tonight if the driver of that vehicle is being sought for hit and run. another unusual car accident is under investigation in san jose. a man in his 30s who plowed his car into a dental clinic is undergoing a medical examination this evening. the accident happened around 9:30 this morning on the 1700 block of hasra road. >> initial interviews with the driver of the vehicle who was a patient did not have a recollection of what led to the accident, what happened or what occurred before the accident. he was questioning us as to what we were doing there. >> reporter: the last thing the man remembers is driving the work. the driver had been a patient of that clinic. and crews are patching up a water break. the valves broke around 7:30

this morning creating a huge geyser at niagra boulevard. the department says the break did not affect any water customers and the geyser did not flood any near by homes or cause any road closures. the fbi has been called in to help investigate how a sewer pipe failed in marin county sending thousands of gallons of raw sewage into a near by creek. now crews are rushing to fix that problem before the water reaches the residential areas. jim vargas has the story. >> reporter: 200,000-gallons of

sewer water spilled. a contractor recently installed close to a mile of replacement pipe. but it's unlikely the contractor dumped the sewage water into the creek. >> the only other explanation we can come up with is a sort of malicious intent. black asphalt roadway, we're talking about thick pieces of rubber. some of them measuring 42- inches long, pretty heavy. >> reporter: only salespeople who live near by say the district -- some people who live near by say the crews may have acted quickly, but they say no one warned them of the spill. >> not until we saw it, until we noticed it on wednesday and specifically asked them is this raw sewage and they answered us

it's tough to find parking but it certainly can be done. and the stores are loaded with customers. three new bright and shiny economic indicators show that how well add things are, better things lie ahead. >> reporter: on the eve of christmas eve, the great mall of the bay is bustling. >> there's a whole lot of spending going on. people are buying lots of presents and i just can't believe how much they are buying. >> so far everything has exceeded expectation, so we are very pleased about the traffic, the sales in general. >> reporter: today the u.s. department of commerce reported consumer spending increased for the fifth straight month through november with this month not everyone concluded. >> we're seeing a more confident shopper now. even a month ago, consumers told us they spent about a

percent more than they did last year and they are spending more like 5.5%. >> reporter: but people we spoke to were not sure about all this positive news. >> i don't think that's true about california. maybe nationally but not california. >> it's going to take a long time to recover. the economy has to get a lot better. >> nobody seeing people hurting below. >> reporter: but even this truck driver sees improvement. >> we're hiring, because we're picking up accounts that other people lost. >> reporter: the third indicator, credit card issuers are increasing the credit card offers and incentives as they look to going back to

borrowing, something they got out of. home sales were down 10,000. and the labor department said today that the job market is showing signs of new life. the number of people applying for unemployment benefits fell to 420,000. that is the second drop in applications in three weeks. analysts call that a sign of modest job growth but they say that the number would need to fall to 375,000 to amount to a significant decline in unemployment. wall street closed the trading week flat after reaching two year highs on

rainless. clean up is under way at the san diego river where it crested at its highest than in 28 years yesterday. >> we had a couple of neighbors trapped across the street. so my brother, my father and i were trying to get them into our house which was higher up. at that time i saw that my car was starting to move back ward. >> 1,800 homes remain without water in laguna beach. and in san bernardino county, rivers of mud poured through neighborhoods after two creeks there overflowed. the mud seeped into dozens of homes and damaged cars and trucks. a bridge also collapsed and 250 homes were also evacuated. the area was declared a

disaster area which opens it up for federal assistance. if you're headed to the sierra most mountain passes are open and there are no chain requirements on interstate 80 or highway 50 or 88. sections of state route 89 are closed due to avalanche warnings. here in the bay area, we had a nice break from the rain. in fact, we got to see some sunshine tonight. bill joins us now in the weather center to look at the forecast. >> sunshine, clear skies tonight. it's going to get cold. you knew that. and we're going to see more valley fog, we had some this morning but not much. up in black point we had fog. more fog will show up tonight and tomorrow morning. so traveling in the valley nights and morning will be kind of a bear. right now what we have is a jet stream that's focused north of us. it's kind of doing this. i'm going to put a system, there's a little bit of energy out here. that's going to slide into the

bay area as we move into saturday mid-morning. but it's going to stay offshore for a little while. so here's how it breaks down. temperatures outside right now, mainly in the 50s and 40s. it's kind of cool, and the foggy spots are going to come into the north bay. the dewpoints are in the 40s. dewpoint in napa i should check, i'll check in a minute but i think it's 45 degrees. so when it hits 45 degrees tonight, boom fog. dewpoint is the temperature. once that temperature is obtained you have fog. if there's enough moisture from these storms. with travel which is big right now, it'll be a little bit dicey especially in the central valley. we have rain back in the forecast next week. not similar to what we just saw, looking forward to it

will be affected. toyota has agreed to pay $10 million to the relatives of a chp officer who died in the crash of a run away lexus. the accident happened on a suburban san diego freeway. officer mark sailor, his wife, daughter and brother-in-law were all killed when their lexus es360 accelerated out of control, rolled over and burst into flames. the gas pedal got jammed under the car's floor mats. toyota later recalled the cars to replace the floor mats. it's considering a ten hour driving limit for long haul truckers. that will reduce the current limit by an hour. the federal motor carrier administration says it's accepting comments from truckers and others on the proposed rules for 60 days if they are accepted, the rules

today, ktvu news confirmed a third victim died at the hospital. ktvu sal castaneda is near the scene now with more information, sal. >> we're hearing report that is that shooting may indeed been a feud between a san bruno gang and a san francisco gang. san bruno police left after meeting here with south san francisco officers. it was tense today in the south san francisco neighborhood be the shooting occurred. six people were hit in a drive by shooting. two died at the scene, a third victim died later at the hospital. one of the dead is 18-year-old gonzalo avaloz. avalos 16-year-old brother giovanni was also hit but survived. he says the police do nothing

but arrest and harass people here but they couldn't stop this from happening. ramon almost says avalos was a good and caring person who was just at the wrong place at the wrong time. >> it is overwhelming, but i'm just thinking of all the good memories that i had with my brother when he did live with me and when we were younger. >> reporter: today the coroner released the name of another victim, 19-year-old omar cortez also from south san francisco. the name of the third victim has not been released. at today's impromptu gathering, openly criticized the police. >> when are the police when you need them? when you need them they are not there. >> reporter: police say they are looking for three men driving an early 2000 chevrolet impala. a brown impala with at -- with tinted windows. they also say the shooting may have been carried out by gangs,

but they would not say if these victims were targeted. sal castaneda. pg & e is trying to determine what caused a power line to fall. it happened around 11:00 this morning on virginia drive. that's not far from highway 4. the energized wire came down on the pickup truck that was parked on the side of the road. no one was injured -- no one was inside that truck. firefighters had to wait about 30 minutes for pg & e to shut down power in the area before they could butt the fire out. neighbors say they heard loud pops. the amtrak station has been a popular choice among many holiday travelers inside california. >> right here. >> it appears amtrak has been growing in popularity, seeing a rise in ridership during this year's thanksgiving holiday.

arrivals. the quick silver park is more than 4,000 acres and has many busy hiking trails. a near by landfill accidentally dumped toxic chemicals into the cream in the park. >> reporter: we're here at one of the main trances to the santa clara park. and as you can see it's not really an entrance anymore as park rangers try to keep people out until they know for sure it's safe to go hiking or near the water. >> reporter: the parks department says there could be toxic chemicals, so until further notice the north section of the park and it's popular trails will be closed to the public. >> i'm kind of disappointed that i can't run through this area. i guess i'm just going to have to settle for the other streets

francisco to san jose by $7.75 to $8.50. caltrans will eliminate two trains, but will add baby bullet trains on the weekend with trains making seven stops instead of the 20 made by commuter trains. all of the changes are aimed to close a budget deficit. new numbers today show traffic on the bay bridge may be easing. the transportation commission says in the past fiscal year from july 2009 to june 2010, 38.6 million cars crossed the bridge. that's a drop of 3.7%. car pooling on the bridge has slowed by an even bigger margin. 4.2billion car poolers used the bridge. that's down 7% from the year before. the next time you are in traffic and you see a driver

boulevard you couldn't see five feet ahead of you because the fog was so thick that night. >> reporter: the plane carrying graham and two passengers crashed into the mall at macy east. >> people were crazy, running through the mall. >> reporter: because it was december 23rd, santa claus was here posing for pictures with kids. the people standing in line were among the 77 people injured that day. dozens of people suffered severe burns. those who were there that night will never forget it. >> every holiday that comes by, i come to the mall, and i think about that. you can't help it, you live by the airport. >> reporter: some people that saw the crash feel lucky that day. >> i had just come out of macy's. went to my car and heard the explosion. >> just reflecting, i think wow, how lucky. unfortunately for the people that were here in the building

to our chief meteorologist, bill, seems like we're not out of the woods yet. >> the pattern is still fluid out in the pacific. there are showers headed our way. for the weekend, we've been talking about it but we got the break today. it was beautiful. we got a break and increased rain: there will be some valley fog in some of the inland locations. so be prepared for that. that starts tonight. you'll see by 10:00, there'll be patches of it. temperatures will be in the mid- 40s, low 50s. some where around 4:00 a.m. it peaks. that's the valley fog. it impacts you as you're heading to san francisco, everyone if you're going down by morgan hill and shooting out that way down toward hollister you will find some of that. that's sort of the story for tonight. as this next system tees up,

that's an active pacific system. five little spinners, those are all areas of instability. there's not a lot of moisture tied in with this but it's a nice little looking storm. here's how it breaks out. low clouds, and then you can see as we get into saturday, about 12:00 to about 6:00 it's raining. raining, windy, and winter storm weather in the mountains. we'll be looking at wind gusts up to 45. a little more wind, quick hit. not a gully washer. we're not going to see flooding. it's moving rapidly through. saturday at 8:00 a.m. then, get some stuff done maybe. all of a sudden there you are at noon, christmas day and it's raining. then it's raining right through the afternoon and here's the back edge of it. it lingering right into the mountains. i suspect sunday is going to look a lot like yesterday, remember what yesterday looked like with the scattered

a purse made famous because of a frightening incident early this month has been auctioned off for a good cause. the purse was used by a florida school member to try and disarm a gunman who stormed a meeting on december 14th. wow, it sold for $13,000 on ebay. the money plus a matching $13,000 from the purse manufacturer will go to a charity run by the security guard who was shot by gunman clay duke just before duke turned the gun on himself. hundreds of needy east bay
