representatives. when congress convenes in a new session tomorrow, john boehner becomes the new house speaker as republicans become the majority part in the -- party in the house. four years ago, nancy pelosi made history when she became the first female speaker of the house. we'll have live coverage of pelosi's news conference coming up in the 8:00 hour. we want to give you an u pdate on the developing overnight story from the san mateo county coast. we've been talking about this one. you are looking at a live picture of the distressed ship. right now, the coast guard is closely watching this 65-foot fishing boat. it's filled with thousands of gallons of diesel fuel. it's off the half moon bay state beach. there are real concerns. some of that fuel could leak into the ocean waters. earlier this morning, the coast guard came to the rescue of three crab fishermen who were on that boat. they apparently fell asleep

after several days at sea. now, jade hernandez is in half moon bay. she's been out hear for hours getting all of the new information from the coast guard -- been out there for hours g etting all of the new information from the coast g uard. a suspected gang member is accused in an attempted murder, and the marin county sheriffs and santa rosa police department have been scouring the area. they've been using helicopters and search dogs trying to track down the suspect. now, authorities say the u nidentified man is connected to a new year's eve stabbing outside of the home in santa rosa that left a 23-year-old man injured. a hit-and-run crash sent a san jose teenager to the hospital. the driver is still on the loose this morning. the incident happened about 6:00 p.m. new year's eve on monterey highway. a car driven by 17-year-old k

adan collided with another car. police say it appears when kadan went to exchange information with the driver, a third vehicle hit him and drove off. kadan's parents arrived a the scene minutes later and his stepmother treated him in the middle of the road until an ambulance arrived. >> i think it's terrible that someone could just hit someone and not have the decency to check to see if they are okay and drive off. >> kadan is recovering from gashes on his head and a bruised lung. witnesses describe the vehicle that hit him only as a dark suv. there could be an award for information leading to an a rrest. well, parking tickets issued to drivers in san francisco may help muni balance its budget. the chronicle is reporting the agency is facing a projected $ 21 million budget deficit. however, the chronicle says the agency doesn't plan to make more cuts or fares.

>> instead parking control officers will reportedly be r eassigned to help raise the number of parking tickets handed out. transit officials also plan to sell more taxi tickets to try to fill up that budget gap. >> lines could be long for m ega-million tickets. the jackpot is up to $0 million for tonight's drawing -- up to $ 330 million for tonight's d rawing. we talked about this last week. i guess no one won it. >> reporter: we did. we did. we talked to a woman who said she hadn't checked her ticket from last week but i assured her she did not win. i doubt anybody is more enthusiastic than those people here. look at the past winners on the mall. and there's no shortage of hope against the astronomical odds.

so they are going all the time. reporting live in hayward, kraig debro, ktvu channel 2 news. >> all right, kraig. serious business. yeah, it is. hey, sal, can we hit the jackpot in the commute? >> how's it going? >> i think today it's gonna be different this in the last few weeks. we've had a commute underway. we haven't seen this for a w hile. regular commute is back. it's backed up to about the middle of that parking lot. that's about an eight-minute delay, maybe ten minutes. once you get on the bridge, it's more crowded on that span. that's why they had to switch the metering lights on to hold the traffic. we're back to patterns. it's easy to get used to the good stuff for the last few weeks. yesterday a lot of people had the day off. today it's obvious fewer people do. on the san mateo bridge, traffic is moving well to the high rise. not all schools are back. some schools are back next

week. so we may have more traffic to deal with next week. northbound 280 getting up to 880. we have slow traffic. so definitely the traffic patterns have changed and there's going to be -- going to be a real commute today if you are going to work. by the way there is an accident in hayward. this one i'm looking at here. northbound 880 at west tennyson. this one just came in with a paramedic vehicle on the way. northbound 880 at tennyson road and hayward. a new injury crash. right now there is a damp cold out there that we didn't usually feel or so. some of that fog can be slow to burn off. but current temperatures, sonoma is at 32. pleasanton, 35. morgan hill to gilroy, 35. vallejo is 35 with the foghorn sounding out towards benicia.

vallejo, crockett, san carlos, 38. if you thought it was cold out, it is. had a little system going down the coast. it will sit down to southern california and then eject in towards southern california. it's not our problem. it's just sitting out there and spinning. but the pattern has changed. the rain looks -- i mean, just like that we -- high pressure is building in. we have cold mornings, foggy, cold mornings. but hazy sunshine. tomorrow, more of the same, the rest of the week will start off with cold and fog. but there's no rain in the forecast to the five-day. i could probably do a ten-day. 31 napa, santa rosa and fairfield, that's cold. that's cold. 4, livermore, and concord -- 34 livermore and concord. sanrafael at 36. your san jose forecast, fog, cold and then temperatures w arming up a little bit. 57, sunny, later on today after some of that morning fog burns

15 minutes ago that captain owen honors will be stripped of his duties. we'll take a look at what got him into hot water in the first place. a a virginia newspaper first broke the story of the captain starring in several lewd videos complete with -- complete with gay slurs, simulated sex acts and even a shower scene. the video was made about five years ago when he was second in command of the uss enterprise. navy top brass -- >> i got the sense from him and other crew members that this was kind of an admittedly or acknowledged kind of goofing off being funny as a way to -- as -- on a big ship at sea. >> while gay rights troops are

warrantless pieces of property that are immediately associated with the person arrested. brett far, around his f ormer -- brett far everybody around his team -- brett favre and his team are being sued by two massage therapists. they say that favre referred to one of them in a sexually suggestive text message that he sent to a third massage therapist. just a week ago, favre was fined $50,000 for not cooperating into the investigation into allegations he sent lewd text messages and photos to another former jets' employee. it's designed to help spare the air during chilly winter days. well, now california's highest court is weighed in on the bay area no burn rule. living with lions. why a florida man will spend all of january hanging out with two big cats.

firefighters in new jersey still dealing with a huge fire at a condo complex. they've been trying to fight these flames all night. but we just found out they are letting the fire just burn itself out. just too dangerous to send firefighters into this. the flames mostly burned the top floor and the roof of a f our-story complex there. the building we're told was vacant. it was still under construction. so no one's been hurt. the cause of this guy gantic fire is still under investigation. it's gonna remain illegal to burn duraflame fireplace logs o n -- on spare the air

wake up in the morning. let's check in with sal. how's traffic? >> have you noticed you are looking at the traffic pictures and it's different than it has been for the last two and a half weeks or so. westbound bay bridge backed up for about a 15-minute wait c oming into san francisco. yesterday, we didn't have this. we haven't had it for two and a half weeks. it's not unusual for a typical commute. remember, not even all schools are back. some schools are back. so they will be back next week. we're getting a nice robust commute. i see smoke there. i assume that's the smoke that comes from this area. they have something that smokes up for a while. we'll check it out to make sure it's not a fire. we'll check it anyway. i do see an emergency vehicle headed that way. also this morning's commute is moving along pretty well on the peninsula here. southbound 101, northbound 101 looking good. on the south bay commute,

northbound and southbound 101 looks okay driving past the 880 interchange. let's go to steve. cold out there. in fact, noticably colder. damp, cold, this morning. and also some pockets of fog. after that burns off. fog and 34. i mean, that's tough. it's tough. but we do have some areas where the sun will start to warm things up a little bit. but first, sonoma. pleasanton, 35. vallejo's in there as well. losgatos, 37 and 38 san carlos. the low that went down the coast is sitting off the southern california coast. it's not a problem. it will probably be there by the end of the week. a lot of 30s. fairfield, napa, santa rosa. it's tough to warm up when you get these kind of temperatures. the days are still relatively short. 27 in redding. 3 eureka. 3 las vegas. it's cold on the -- 33 in las vegas. the pattern has changed a

a crab boat is creating some serious environmental concerns. it's still rocking in the rough waters of half moon bay state beach. that's near kelly avenue. jade hernandez has new information for us. >> reporter: we're live at flan sis beach. within the last few minutes, this boat that's been upright for hours hast just fallen in

the ocean. now that it's daylight you can see debris in and around this bet. in fact, the u.s. coast guard has told us they are gonna try to keep the walkers and surfers 500 feet away from the boat. everyone this morning is w ondering is this fishing vessel salvageable? the other big concern this morning, the biggest one is k eeping the vessel from leaking as it's pulled from shore. this boat's owner just told us he didn't want to talk to us on camera. but he did us his son was captain. and he and other fishermen are all right. the coast guard said the can't reported puts the -- putting the boat on auto pilot. the coast guard received the call about this vessel, which the u.s. coast guard, said may have capsized around 1:00 this morning. when they arrived, the boat was

upright. someone called for help after noticing that 65-footsiesle -- vessel on-- 65-foot vessel on shore. there was crab on board. we're not sure what will happen to the crab. >> we don't believe at this time that it's discharging any fuel. so the pollution threat is minimal. however, like i mentioned b efore, there's 2,000 gallons of diesel. we don't have the means of p ulling the vessel off the b each. we don't do salvage. we have to talk to the owner. >> reporter: the boat's owner is worried about this fishing boat worth about $400,000. the u.s. coast guard says they are waiting for salvage crews that could get here later this morning. they are trying to determine whether or not to pull the diesel fuel off the boat. reporting live, jade hernandez,

with 50-year-old angela kay west swinging a metal pole at police officers, throwing milk at them and kicking one officer in the groin. west is charged with four merchandise and is being held on $25,000 bail. well, the federal agency that's investigating that deadly san bruno gas pipeline explosion issued an urgent call to action. the ntsb is demanding that pg&e immediately conduct a thorough search of the records to make sure it knows then conditions of all of the pipelines. jackie speier says this extraordinary move reflects what she calls a crisis of credibility. >> it really draws into q uestion, the credibility of pg&e and the entire system. and i'm not willing to sit here while they consider what their options are and put more

taxpayers are getting an automatic extension to file their 2010 taxes. it's only a few days. the deadline is monday, a pril 18th. that's because emancipation day, a legal holiday in washington, d.c., falls on friday, a pril 15th, which, of course, would be the normal tax d eadline. >> reporter: good morning. good morning. a hearing is scheduled to start at 9:00 expecting to go for a couple of weeks. normally these type of hearings are pretty boring with the small amount of people being called i n. prosecutors are calling 35 witnesses to take the stand. now, inside today it's gonna be hectic.

inside michael jackson's family, fans and a lot of reporters. now, the purpose of today's h earing is to determine if there is enough evidence to take this case to trial. one of the key witnesses for the prosecution is kenny ortega, the producer for michael jackson's "--" this is it "tour. he's expected to talk about how dr. murray showed a reckless at titted toward michael jackson's health. dr.murray faces charges of i nvoluntary manslaughter. puree's attorneys are expected to say jackson killed himself when murray was out of the room and that murray only gave michael jackson 25 milligrams on the day he died and that it would have taken a lot more to fill jackson. murray has pleaded not guilty. if convicted, he faces up to five years in prison. that hearing is scheduled to

gallons of diesel fuel. sufferers-- surfers and swimmers, you are being told to stay away from there. ktvu's jade hernandez has been following this story since about 5:00 this morning. she's back with the very latest. good morning, jade. >> reporter: good morning. we were reported all morning that there was a low likelihood of diesel fuel leaking from the vesselle b you -- but the u.s. coast guard has brought a chopper out here to survey the ocean water. this boat capsized about an hour ago. that really worried the coast guard. park police even ordered surfers out of the water. initially the coast guard and police are trying to keep washingtonners and surfers about 500 feet from this area. the u.s. coast guard sent a chopper up to survey the ocean. the captain and two other fishermen who were on board when the boat ran aground are all right this morning. the coast guard said the

captain reported putting this away from the beach. salvage crews are supposed to be on their way to start cleanup. the crews may have to pump the 2,,000 gal gal dash 2,000 gallons of diesel fuel before c ragging -- dragging it back in the ocean. this is forcing some people to stay out of the ocean. >> yeah. just concerned about the pollution that the -- that the boat is sleeving in the water. when you add the surfing -- it's cold enough now. and when you have all of the debris in the watt he, it makes it dangerous. >> it's an accident. this is where we come, you know, every day to check the surf. it's funny right where we come is where the boat is beached. >> half moon bay fire department received a call about the boat which the coast guard said may have cap sized

sales figures of the carmakers. it's a very big indicator on how the economy is looking. in the last half an hour, general motors posted a strong sales report for the december month. it's the first one in, in fact, the best sales month of the y ear, up 16%. now, for the year in total. it was also a very good year as analysts predicted, better than last year. gm execs say -- say they sold 2.5 million of vehicles in c hina. that's up nearly 10%. here in the u.s., december sales are up 7.5%. we're still waiting to hear from the other big names in the industry. ford is expected to post strong numbers as well and possibly the biggest increase. in particular, sales for small suvs are picking up after two very tough years. analysts expect toyota to be only major car company to r eport -- to report because of
