anthem blue cross says it will also raise rates for california customers in april this time by an average of 10%. the move comes after an october rate hike and a failed proposal to raise rates by 40% last year. anthem also says some members will see their benefits reduced. we have breaking news from the south hayward b.a.r.t. station. here is what we know. two men suspected of shooting a dog in a near by neighborhood ran into that b.a.r.t. station. one man was taken into custody in a parking lot, the other taken into custody on a b.a.r.t. train. right now police officers are searching the parking lot, we believe what they are looking for is the weapon that was used to shoot that dog. san francisco mayor gavin newsom is nearing a decision on who will become the city's next

district attorney. earlier today, president david chu said he is withdrawing his name for consideration for that position. he had been rumored to be the front runner to fill the post held by camela harris. >> we never knew he was interested. >> reporter: newsom meth with several candidates this afternoon but wouldn't name any names. he says he hopes to make an announcement earler tomorrow. today the apparent front runner for mayor of san francisco released a statement. >> i love this city and i will agree to serve for mayor. >> reporter: that statement from lee was read at a china town celebration. he is currently out of the country but he says he will take the job if it is offered to him. if lee is appointed, he will be the first chinese american to be mayor of san francisco. oakland mayor quan said

today she is planning weekly meetings with the press to break ron dellums practices who hardly talked to the media. what the new mayor is doing to keep people safe. shut down for good. that's what city leaders in san jose want to do after a violent new year's eve fight at club wet. but the club says all of this is being blown out of proportion. janine de la vega has the

story. >> reporter: this is video shown on wet club website. >> at least two other females attacked her, knocked her to the ground. kicked her repeatedly and as a result of that attack, the female victim sustained a through and through puncture wound through her cheek. >> reporter: the heel also punctured the woman's neck and at one point was choking on her own blood. she was told by club workers that she would be better off driving herself to the hospital, because a ambulance would have expensive. >> they never called police. >> reporter: a you tube video showed a massive fight, city attorney rick boyle says he wants to shut it down. >> we had constant monitoring and they still had problems with the police. and we just can't continue to

do this. >> reporter: employees from wet did not want to appear on camera but did tell us that the new year's eve incident is being blown out of proportion. they say the club never refused medical attention or lied about calling police. >> we want to continue to work with the police not be in an adversary relationship. >> reporter: there will be a hearing with city officials and the owner of wet to determine whether the club should still operate. reporting live from san jose, janine de la vega. a judge has cut off phone contact between the garridos. the couple is accused of kidnapping jaycee dugard and holding her captive in the backyard of their home near antioch for 18 years. and police are looking for a suspected robber who ran off

after a police chase. they received a call reporting three burglary suspects loading stolen property into a white van. police found the van, chased it over a bridge and cornered it on humble street in san pablo. two of the three suspects were taken into custody, one ran away and hasn't been seen since. remember all that stolen art found in a tenderloin hotel room. the man behind the thefts will spend a year in jail for the crime. terry helbanks stole thousands of paints and prints from san francisco gallies -- galleries. he will serve a year in jail, when he gets out he has to stay away from art galleries that he stole from. some state senators are criticizing governor brown's choice to head the state board

of education. honig stepped down after he was convicted on interest charges with a business his wife ran. -- is separate from the education department or state superintendents office. this news comes on the same day tom turleckson declared a saying the $18 million of cuts over the last ten years have taken a toll. and that 172 school districts are on a financial brink. carlos moreno will retire at the end of next month. the 62-year-old justice has submitted his resignation to governor brown. he is the only state high court

justice picked by a democratic governor. moreno is on president obama's short list for the u.s. supreme court opening that was eventually filled by kagan. and it all has to do with a new garbage company now in charge with servicing hundreds of thousands of customers. ktvu's sal castaneda is in san carlos with the latest on what's happening. sal-- >> reporter: julie, let me show you these are the old garbage cans. these are the new garbage cans. some people don't like the new garbage cans and some say their garbage hasn't been picked up at all. starting monday, new garbage company recology took over garbage pick up in palo alto. some complain trash has been missed. pick updates and times have been missed and the new garbage containers aren't big enough. >> the new one, my wife puts the garbage on the top and it's full. you can't even drop the lid on it. >> reporter: some people say the garbage truck driver has

not picked up trash inside apartment building or done backyard pick ups like the old company used to. the company says it doesn't have a problem with special requests but it will take time to get that information to drivers. >> of course we'll do it. we just need to know about it. some of that information didn't come with our records. our drivers didn't know a certain house may have had backyard service. >> reporter: authorities think the new company with its new state of the art truck, and bin systems will mean more items being recycled and diverted from landfills. >> we're seeing a large amount of recycling being brought in. >> reporter: the company says they are listening and want to correct the problems as soon as possible. >> i think that that's a great attitude for them to have i hope they stick to it. >> reporter: now company officials say some of the confusion could be because pick up times have changed and the garbage is not picked up -- is

now picked up in stages instead of by one truck. and the company says after a while the residents should get used to the changes. and an odor of gas is still a mystery tonight. a pipeline crosses south of jack lindon square. pg & e crews have been into the area three times in the last nine months twice in just the past two days. >> the smell came from some where. there was a gas odor some where i think we need to find it. >> we do smell, you know what our customers are smelling. it is not natural gas. >> reporter: pg & e says it is committed to working with local agencies to try and determine the source of that smell. a bay area organization that helps blind people across north america is right now facing a deadly problem. also ahead, the proposed

outside the 11-acre guide dog center was shut down today. >> we've isolated those dogs, we're getting extraordinary care to every one of those dogs and keeping it contained. >> reporter: although 150 puppies currently on-site, 25 of them have come down with parvo that attacking the immune system. five have died. >> it naturally occurs, it's everywhere. >> reporter: officials here say they are not concerned with any animals over four months of age because all those animals are now fully inoculated. that's when dogs receive their final parvo immunization shot. veterinary walters says he's been in business since the year of the last parvo outbreak. >> i can remember having i.v.s hanging from all the light

see yet another dense fog advisory. not in the big valley. but i think that advisory is going to creep into the eastern parts of the bay area tonight. so tomorrow morning, it's your friday morning, as you're coming into work. if you had an issue with visibility. you will have that same issue again tomorrow morning. might everyone see fog tomorrow. there's not much wind out there and it could allow for spontaneous formation. some of the fog tomorrow morning could pop right into those inland valleys. the fog footprint, there it is. the fog doesn't lift much it stays right on tight near the water. tomorrow with the fog trying to work it's way into the valley, a little more fog formation in individual valleys out by concord and walnut creek and petaluma and san rafael. until it rains which isn't until monday or tuesday, until something changes, we're going to have fog. this is right through the weekend too. this forecast is going to

linger. high pressure starts to break down, tomorrow through sunday like it's been. monday and tuesday, and tuesday pardon me tuesday wednesday, this weak weather system comes in, blows out the inversion, should get rid of the fog, the spare the air nights, and get into a pattern where there's systems rolling in here again. because when you get stagnant like this this is how you get. i grew up in the central valley area, i can remember two or three weeks at a time without rain and that valley fogs building builds up. you may remember the reports of car pile ups, because the fog gets really dense. it's like a science fiction movie. there's something to blow it out, it just getting big. >> all right, thanks bill. a large bay area company is trying to help a coworker

suffering from leukemia. many employees with sales force.com had their bone marrow tested at the company's offices in san francisco and san mateo today. the odds are long on finding a match with one in only 20,000 people compatible for transplant. >> even if they're not a match with john they're still going into a registry which is still important. because more than ever we need a lot of people to get into this registry so we can get matches for other people. >> reporter: sales force is working with the be the match foundation which is conducting that testing. the l.a. district attorney says he will appeal today's court decision to throw out the sixth felony convictions that follow the drug related death of anna nicole smith. a judge ruled that howard stern never attended to commit fraud when he obtained prescription drugs for smith under his name.

the search is on for california's first dog the governor and his wife have been taking care of a corgie owned by mrs. brown's sister who is moving to chicago. governor brown's dog dharma died last month and they have been looking for a pet. there's word that cogie may become the first dog of california. and we have a lot of people happy tonight. >> they're probably toasting. because andrew luck announced today he is in fact, returning to stanford for one more season. luck was considered the number one pick in the upcoming nfl draft and that could translate to $50 million.

no doubt several issues influenced his decision to stay. he loves college life, he knew drafted he would go to the carolina panthers. and there's question whether the nfl will have a lock out and no games will be played any way. andrew luck will stay on the farm for the 2011 season. now andrew's college coach jim harbaugh is getting more calls than 911 right now. sounds like san francisco 49ers, they're not the front runner in the harbaugh bowl right now at least. it's reported miami offered him more than $8 million a year. expect miami still has a head coach and they still haven't interviewed the required minority candidate today. plus with luck returning, that may convince jim to stay. plus denver broncos still want to visit harbaugh. the 49ers appear to be just
