a san jose pot club. it started a few hours ago at the club on drake street. one witness says he knows e xactly how the fire started. kraig debro joins us now with this live report. good morning, kraig. >> reporter: good morning, tori. the witness says he knows how it started and another business owner says this was preventable, first the house on drake street. you can see om of the debris out here. it took firefighter a long time to put all of this fire out. know, the witness says this -- now, the website says this power line, he heard it when it broke free, around 3:04 this morning. what he heard was a lot of h

issing and this was not the closest fire station that came here. they don't have an engine. so the truck company that came from that station does not have water in the truck. so they had to wait for another station further away to get here before they started to put out the fire. >> when that truck did get here. it was about four or five m inutes later, according to a firefighter i spoke with, that could make all of the difference in a life-or-death situation. he says that four minutes in san jose is gambling. the reason they didn't have an engine there is because of budget cuts. they are fiing to get those -- fighting to get those trucks back. i'm gonna talk to some business owners. they've been shy about talking but i would like to know how

much they lost. back to you. >> thank kraig. 7:02. an earthquake that rattled monterey county overnight was felt by some people here in the bay area. magnitude .5 earthquake struck at 12:51 this morning. six miles south of san juan batista. it was followed by a series of aftershocks. the usgs received hundreds of reports from people who felt shaking in san jose and as far as the the north bay. sarah palin is responding to what she is calling a media attack on her by releasing a new eight-minute video. she posted it on her facebook page. now, the controversy involves tea party rhetoric and a controversial map that sarah palin posted online that some are blaming, saying that they inspired that mass shooting in

assassination attempt for gabrielle giffords who remains in the hospital. there are new details coming out this morning about jared loughner. the new york times reports police responded to his family's home more than once before that rampage on saturday. right now, we don't know the nature of those police visits. and one friend described loughner to the new york times as a skilled gunman, someone who thrived on chaos. loughner is being held in jail without bail. 7:04. a san francisco club is being ordered to increase security following the death of a 33- year-old medical student. police say the victim was k nocked unconscious at temple nightclub sunday morning. he was taken off life support yesterday. there was another fight at the club the other night and police are not saying if the two are related. the club must order

surveillance and cameras. we're learning that a b otched kidnapping attempt that triggered a shootout at a club this weekend. police say it happened when three men barged into the mexicali club and they were there to target the club -- club owner because of a debt. police are looking for suspect. one of them is hector, the alleged get away driver, the second suspect's name has not been released. in just a couple of hours, we should have the latest report on whether congestion s plicing -- pricing on the bay bridge is actually helping to cut down on congestion. claudine wong joining us live. she's in san francisco now with those details. good morning, claudine. >> uc berkeley experts weigh in on whether or not congestion pricing is actually making a difference. if it's actually doing what it

is supposed to be doing. i just spoke to the bay area authority and they've said they've talked to commuters. we've done the same thing at from mont, asking people who get off in this area if they think it's making a difference. the reviews are mixed. the experts say this is supposed to change the way you commute because if you charge more in the peak hours, which is 5:00 a.m. to 10: 10:00 p.m., the mtc w anted to see if this was really working because they are really not sure at this point. we know the pricing went into effect in july. computers-- com-- commuters -- >> no. i come out. i haven't really noticed any difference. >> reporter: it hasn't changed now? >> yeah. you just pay, exactly. it has not changed too much in the early -- early mornings.

any observations with the congestion pricing at the -- >> i thinkis helped a little bit but i think there could be compounding variableses like fewer people have work. since july 1st. , we've seen fewer cars. let's go out and take a look at it now. for example -- you look at this picture, and in days past, we used to have a backup stretched beyond the 880 road. let's move along and take a look at the commute on northbound and southbound 880. that traffic is moving along very well. no problems heading south to highway 92. this morning's commute on the

south bay, northbound -- let's move this down a littleby. northbound 101 looks good. 7:09. here's steve. >> thank you, sir. a little different pattern here. we had the system, not much in the way of rain. a couple 1/100ths. a lot of low level cloudiness. it's not as cool. temperatures are up a good 20 degrees from just monday. sanfrancisco currently 47. the coolest, twin peaks, coal valley at 45 oops. china basin -- at 45. china basin, 50 degrees. the pattern is showing every sign of having extremely cold air. starting on the weekend and going into next week. for us it's going to be ho-hum. now, for some, it will be warm. for others the fog in the valley is just too victory --

four people. vice president joe biden just left agriculture and is arriving in pakistan. he says the goal of the u.s. is to work with pakistan to help restore and strengthen sovereignty in those areas of pakistan where extremists have violated it. back here at home, the mayor of hercules, who was the target of a recall effort, now says he's stepping down. at last night's city council meeting ed balico says he will retire to spend more time with his families. he and two other officials were accused of not being able to for basic services. the city council approved a plan to split the $00,000 from

the san bruno explosion among dozens of families. this has triggered and emotional controversy. many victims say the city came up too long to come up with this plan. one frustrated woman who did not want 0 to show her face told us how she feels. >> i shouldn't have to stand up in a room full of people and ask and beg. it's there. people donated it to them. it should be given to them. >> $6,000 will be given to the dozens of homes whose homes were completely destroyed. $4,000 for each home that had moderate damage. $1,000 goes to those homes with minor damage. next week, the city will start to send out the checks. meanwhile, a los altos man tied to a pipeline scam will spend three years in prison.

yesterday, daniel stancebury was in court and he pretended to be a spokesperson to get a rental car and other perks. a san francisco man is about to become a free man after spending 18 years in prison for a double murder. he was convicted of killing two people in hunter's point back in 1989. a judge has ordered his release after ruling he had been wrongly convicted because a witness lied on the witness stand. that witness has since died. now, conley's lawyer says it took years to prove the police allowed a key witness to lie on the witness stand about getting money and protection from investigators. what's clear is that these police were willing to take s ure -- take shortcuts and violate the done sty tuesday in order to get -- constitution in order to get convictions. >> now, it was george gascon's decision to officially drop the charges in this case. the state's prison guard

union is blaming overcrowding for an attack at pelican bay prison. the prison is in lockdown after yesterday morning's attack. authority say two inmates from los angeles attacked three guards with homemade weapons. the guards are being treated for gashes and puncture wounds. the prison is designed to house just over 2,000 prisoners but is almost housing almost 500. >> wow. 7:20. well, the battle over those smart meters really heats up. the act of defiance now has two women facing misdemeanor c harges. the fish and game department says it solved the mystery of the dead birds in sonoma county.

it is 7:23. we have new information on this dead bird mystery in sonoma county. investigators now say the 100 birds found near highway 101 were likely hit by a truck. the fish and game department says they all suffered broken necks. there were no signs of gunshots. chp officers found the dead b irds saturday on a highway between healdsburg and geyserville. two bay area women are f acing misdemeanor charges this morning after their arrest in rohnert park for protesting against pg&e's smartmeters. >> i have four grandchildren. they are getting killed from this radiation. >> that's deborah tavares 61- year-old -- 16 years old.

and whether it leads to aggressive or even criminal behavior such as the shooting in arizona. paul chambers joins us live with more on this story. good morning, paul. >> reporter: good morning, tori. sarah palin posted -- posted an eight-minute video talking about the tragic incidents on this weekend -- over the weekend. she says she's heartbroken about the incident. she did say dangerous acts were possible, even though she did not know something like this would happen. >> people need to realize the rhetoric and people -- firing people up. for example, we're on sarah palin's target list. but the way she has it depicted is crosshairs. they have to realize there's consequences to that action. once again, giffords was injured along with 16 others.

appened. we're live in san francisco, paul chambers, ktvu channel 2 news. >> thank you, paul. there is a more optimistic prognosis for gabrielle g iffords. we have new photos showing her husband right there holding her hand while she's in the h ospital. doctors say the congresswoman is breathing on her own but she's still ona ventilator as a precaution. meantime, investigators are busy searching for a black bag that the accused gunman, jared l augher in, was seen taking into the desert the very day of that shooting rampage. authorities say that bag may contain clues about the motives. arizona's governor has signed emergency legislation to preven controversial church from staging protests at the funerals of the tucson s hooting victims. williams of the -- members of the westborough baptist church of picketing the funeral of 9- year-old christina greene. the church claims saturday's killings were god's punishment

for america's wrong. residents of tucson are how to set up a human shield. a candlelight vigil in d owntown oakland tonight will also honor the mass shooting victims in arizona and condemn acts of violence. the vigil is scheduled from 5:00 to 6:30 outside oakland's city hall on 14th street. the east bay democrats club organized the gathering. the club says the vigil is a n onpartisan event and everyone is invited to attend. 7:34. in the south bay a busy stretch of highway is open again after a fatal overnight crash. the crash happened just after 2:00 a.m. on eastbound highway 237 just east of lawrence expressway. the chp says at least four cars were involved in this. somehow a victim who was killed ended up in the westbound lanes. now, the highway was closed for almost four hours but it did reopen about 6:00 a.m., the

traffic is moving three there again. a man who oakland police say led them op a brief chase in a stolen car is in custody this morning. now, the chase ended on east 4th street last night about 10:30. police say the suspect crashed into a parked rv. now, officers on a routine patrol discovered that the car was stolen after running the license plates. they say the suspect fled when they tried to pull them over and they found suspected narcotics inside that stolen car. a grim discovery on a freeway onramp in fairfield has led to a homicide arrest. two homeless people found the body of a 44-year-old man yesterday afternoon near interstate 80. police say they believe he died as a result of injuries suffered in a fierce fistfight sunday night. the other man, suspect, brian peck. an online news conference

closer to the earthquake center with an update. >> reporter: i'm here in p runedale. i'm actually 15 miles southwest of san juan batista. it hit a 4.5 magnitude. i've been here all morning t alking to people at the s hopping center. half of them tell me they didn't feel it. the other half that did feel it, say it was quite a jolt, quite powerful. it happened around 1:00 a.m. in the morning. it woke up several people. [no audio ] >> we lost our signal there, telling us about the 4.5 earthquake that hit near san juan batista. 7:42. it was one year ago a massive earthquake rocked haiti. we'll have a live report from port-au-prince to learn how the recovery effort has gone so far and how far they still need to

people are missing since heavy rain began back in november. it was one year ago today that a magnitude 7 earthquake hit haiti. >> killing people and d evastating the -- hit haiti, killing people and devastating the country. we're live there with more. it's been a long struggle, hasn't it? >> reporter: good morning. haitians are commemorating this very difficult and sad anniversary, a year ago that this earthquake, this powerful earthquake struck port-au- prince and that day was the beginning of what has been a truly disastrous year for the poorest country in the western hemisphere. it's been a year since the earthquake shook port-au- prince. michelle is still reeling from that day. the earthquake destroyed his home and then his mother died

in a camp for the homeless. he still lives in one these camps. the earthquake killed close to 250,000 people. it left national symbols like this catholic cathedral in r uins. in october, disaster struck again in the form of a deadly epidemic of cholera. the death toll, more than 4600 people dead and climbing. on november 28th, haitians went to the polls. dispute over the residential election turned violent and triggered a political crisis still s immering. foreign governments pledged billions of dollars to help haiti. but survivors like this man say they haven't seen a penny of that help. >> translator: one year, nothing has changed here. many people are suffering and we don't know why. >> reporter: for him and so many other haitians, this has been a year of misery.

tori, some of the ceremonies we have seen, yesterday, for example, the government had rows of cross planted on the o utskirts of the city where count les victims were laid in the graves in those overwhelming days after the earthquake. we see haitians today, many p aying their respects for the loved ones we lost. reciting some prayers, overnight church vigil services. i talked to one person who said she was going to visit the ruins of the house on january 12th. she said she's sad but grateful that her children survived that awful catechism. tori? >> obviously in the last year little has been done. is there any sign of progress b eing made in the recovery right

now? >> we've seen some investment, a factory recently opened. one of the markets rebuilt, but really if you walk around this town, you still see ruins from collapsed buildings, nearly on every street corner on every street. you still see people living in tents, next to the ruins of their houses and sprawling -- sprawling tent cities like the one behind me right at the -- right next to the seat of the government. we have close to a million people still homeless one year after the earthquake and one year after international donors pledged billions of dollars to try to help these people. still no sign of real progress. ivan watson live for us in haiti after the earthquake. thank you. well, a 66% income tax hike has just been approved by illinois state lawmakers to help cut the budget deficit there. now this goes to the democratic governor, pat quinn, who has already said he supports it. the measure would temporarily set the personal tax rate at

5%, rising from 3% now. corporate taxes would also go up in illinois. here in california, jerry brown wants voters to decide if several temporary tax hikes should be extended to help close the budget. voters would be asked to maintain an increase of 1.25% in the state income tax, 1% in the state sales tax and .50% in the vehicle license fee. san jose police are asking for the public's help in finding a bank robber responsible for five hold yous -- holdups. they released security camera of a man attempting to rob one of the banks. police believe he's hit banks in santa cruz and santa clara county. there are more surveillance photos of the man. two men are pleading guilty to

stealing more than $90,000 electronically. the defendant was sentenced to seven years in prison and 31- year-old zammonyon was o rdered to five years in prison the they admitted to putting a skimmer on credit card read, at several bay area gas stations. they collected card information and later stole the money from 2 00 bay area residents. michael jackson's doctor will have to stand trial for i nvoluntary manslaughter. a judge decided that yesterday, following system that dr. murray administered a lethal toes -- lethal dose of a powerful propofol. the judge also suspended his medical license. a first in the nation, the big opening tomorrow dedicated

welcome back to "mornings on 2." i'm tori campbell. >> i'm dave clark. it's wednesday, january 12th. well, topping our news at 8:00, the investigation c ontinues right into an -- right now into an early-morning fire that happened at a pot club in san jose at the herb-appeal pot club on drake street. now police are taking an active role in this investigation. kraig debro is live with the very latest. good morning, kraig. >> reporter: good morning, dave. there are dozens of pot clubs all across the city of san jose but i just spoke to a detective with the san jose police department and he says none of them are legal. he says the city council has not enacted any laws regulating them. so the owner of this club could be in trouble. you can see the building is boarded up. i want you to take a look at this. we shot this about 15 minutes ago.

this is the man who has i dentified himself to police and firefighters at -- as the o wner/manager of the business. he didn't speak to us but he told the detective that he had a business license but the detective simply told me that anybody can get one of those and it doesn't mean that this is legal. now, this fire started around 3:00 in the morning. the call came in around 3:04. which was second alarm at 3:23 and was knocked down by 3:25. it's interesting because the station that responds to this fire at 3:00 this morning, is station 30. budget cuts have eliminated their engines. truck companies don't carry their own water. the engines do. the fire department spokesperson this morning told me it didn't make a whole lot of difference. >> the truck was here at 3:a 9. the engine got here at 3:10. >> reporter: what was the response -- i mean, was it a

>> reporter: good morning. we don't expect them to give us the full picture. we do expect some data. there's not enough of it right now. we're on university avenue as you approach the bridge. we came here because the only information we have so far about congestion pricing comes from this area. university avenue down to the bridge. numbers from here say the commute has gone from about 27 minutes to 23 minutes since the congestion pricing went into effect. that's a four-minute i mprovement. it's still hard to say if computers are noticing. remember, the idea behind congestion pricing is, if you raise tolls during peak hours, in this case, 5:00 a.m. to 10:00 p.m., then fewer people will hit the roads during that time and the commute should get easier. is it working?
