i'm dave clark. >> i'm tori campbell. a 4-year-old boy from the central valley was taken right out of his grandmother's arms. just in the past 20 minute, jade hernandez got new information. here's more. >> reporter: good morning. the search for this little boy continues this morning. we're live here in san jose because authorities initially believe that the boy could have been driven here. authorities say this man's mother lives in san jose. 27-year-old jose esteban rodriquez is accused of kidnapping 4-year-old juliani c ardenas. rodriquez is considered dangerous. he was last seen wearing c heckered shorts and a beanie.

4-year-old juliani has not been seen since yesterday around 4:0 0. police say he ripped the boy out of his grandmother's arm arms. the mother says the couple broke up in september and rodriquez is mad and hurt just like she is when she heard what he did. >> i just -- i didn't want to hear it. i don't know what happened. i just want him back! >> reporter: now, rodriquez was last seen driving a silver toyota corolla with the california license plate number 6 hbw 445, with oversized, all

casino and hospital. it was a routine traffic stop. the officer pulled over the car near where that silver car is near the gas station. when he pulled over the car, one of the gentleman got out of the car. the officer asked the person to stop. he didn't. he ran around the gas station with the backpack. the officer told him to stop. then the man throws away the backpack. when he gets to the hedge, he jumps over the hedges. now, before or right after he jumped er the mentales, he was tased. the two -- over the hedges, he was tased. >> at that point, the officer observed the suspect had a handgun in his waistband. the officer ordered the suspect to comply with his orders. >> reporter: police say the orders were not complied with. in fact, the lieutenant told me when the suspect pulled out o f

-- pull thed out his gun, he slapped it away. the suspect died at the scene. police would not give us his name this morning. but he says he's a 33-year-old man from southern california who was up here visiting the f riend -- some friends. the other people in the car are said to be cooperating with law enforcement right now. we don't know of any charges pending against them. the police say there will be three investigations, one by them. bun by the d.a.'s office and one into the -- one by the d.a.'s office and one by the sheriff i 's office. there is another business across the street and i'm going to try to find more people who saw this last night. reporting live in san pablo, kraig debro, ktvu channel 2 n ews. >> okay, kraig. thank you. 7:05. an oakland man is being investigated for animal cruelty investigations after more than two dozen dogs were found locked in crates at his

home. animal control officers went to his home on capistrano drive after getting complaints of noise and foul orders. inside, dog crates were found stacked on each other and 33 d ogs were living in their own waist waste -- own waste. >> some of them were cramped or confined that probably they couldn't walk. >> many of those dogs were just too sick to be saved. others were described as too aggressive. now, the ones that survived, t oe, are living in new homes. officials say the suspect identified as yancy could have more charges timed against h im -- filed against him if it's determined the dogs were used for fighting. 7:06. this morning, san f rancisco- based wells fargo reported fourth quarter profits up $3.4 billion. that's in line with what a nalysts had expected but it t opped revenue forecasts with $

21.5 billion. wells fargo says all segments contributed to earnings as the economy starts to improve. other banks dragged the stock, the industry down, rather, goldman sachs disappointed investors this morning with their report. there is a major development tied to the pipeline disaster in san bruno. today's "chronicle" reports that pg&e faces a march 15th deadline to turn over important documents detailing the s trength. pg&e may have to test or possibly replace some pipeline and that could affect thousands of power lines for -- affect power lines for thousands of customer. the police commission is due to meet tonight to find a replacement for george gascon. he left the chief's position to

westbound 580 commute. westbound 580, a little bit of traffic coming into the altamont past. once you get into livermore and dunn lin, it's moderate -- dublin, it's moderate. a little bit of slowing in orinda. lafayette looks okay. at the bay bridge toll plaza, it's backed up. but not that deep. there's about an eight to t en- minute wait. not a lot of traffic. so far today is turning out to be a decent day here. let's go to steve. >> thank you, sal. a little pattern change. there's still some fog. sanjose, patchy fog, mainly out towards eastern solano county but the wind has picked up. in fact, sfo in the last half hour, gusts to 0 miles an hour out of the west, something we -- 30 miles an hour out of the w est. something we haven't talked about for a while. that will not give us rain. that will help disperse the

describing his horrifying ordeal after his wife was shot in to ton. mark kelly says for about 20 minutes, he thought she was d ead. he says he broke down in tears after watching tv news reports that said his wife had been fatally shot. kelly says he then learned she was alive when he called g iffords's mother outside the operating room. he now feels his wife is on the road to to a slow but steady recovery. >> she gets a little bit better each each day. every day i see her, she looks better. as long as she stays on that slope, i'm confident she will make a full rye coverry -- recovery. >> kelly said president obama was the first to call him when he got to the hospital. he thought the president's speech at the memorial was moving and one of the best speeches he had ever heard and thought it was a perfect statement for the time.

7:17. a san francisco man who identified a crime suspect for the police says he is now -- he has now received a disturbing letter from the suspect. jarome said he saw olson trying to set a fire at an apartment building back in november. now he sent jerome cuffy a letter in jail saying, "messed up my wife." >> i'm outraged. i'm concerned for my safety. you know, i don't know what this guy is capable of. he's capable of setting a fire, who knows what he's capable of later on down the line. >> it's still not clear how olson, who is still in jail, got cuffy's information. it's against the law to give such personal information to a defendant. >> we contacted olson's attorney but he wouldn't talk about the case. the judge in the chauncey

bailey murder trial says a t racking device on a car is not a privacy issue. police planted the device on b ey's car because they say he was a suspect. prosecutors want to use evidence to show that bey was parked outside of bailey's house. the judge says he sees little difference between undercover police and computer tracking devices when it comes to t racking a suspect. at a time when california is cutting programs, a new audit shows improper spending and incompetence by workers costs the state more than $ 500 million. the audit is the result of tips to a whistle-blower hotline. one example, it took managers three years to investigate and remove a psychiatrist in the corrections department who was accused of improperly p rescribing medications. in the meantime, the

psychiatrist was paid $600,000, including two merit salary increases. >> what we would like to have seen and i'm sure californians would want to see is that the -- something as serious as this, the investigations take it and give it a high priority. >> this is a very complex, very resource intensive investigation which the department did accomplish within three years as prescribed by state law. >> two caltrans engineers left early to teach classes at local colleges for six weeks but were paid for full days and a general services manager was caught u sing a state car for his daily commute for nine years. 7:20. a man in the central valley hit the jackpot. a $32 million lotto jackpot. 53-year-old jim katouchi was with his family when he picked

investigators in philadelphia want to know what caused a deadly gasline

explosion. it was a horrible scene that brought back horrible memories of the explosion in san bruno last september. yesterday's blast killed one person, injured five others and forced the evacuation of dozens of people. the powerful explosion sent a 50-foot fireball in the air and could be felt miles away. the owner of a residential hotel in oakland is due in court tomorrow. richard earle singer is accused of trying to hire an arsonist to burn down the hotel menlo on 13th street so he could collect insurance money. investigators say singer was willing to pay $65,000 to anyone who would gut his hotel. a new study is out that shows side air bags do, indeed,

save drivers as lives in l eft- side car crashes. the insurance institute for highway safety report as driver with a car that's rated good inside -- in side impact crashes is 70% less likely to die in one of those crashes. side impact crashes account for 27% of accident deaths. in pittsburgh, pennsylvania, it's an icy -- ouch. that hurt -- it's a mess there this morning because of overnight snow and freezing r ain. now, the highway crews s aturdayed salting the streets early but there was still a lot of dangerous ice on a lot of roads. in this case, an out-of-control suv smashed right into a house. the driver has -- had only minor injuries. but it was even hard for the

appened. 4-year-old julianicardenas was ripped from his grandmother's arms yesterday around 4:00 by the man who is believed to be the biological father. authorities say jose esteban rodriquez kidnapped the boy. he has an extensive criminal record and is considered dangerous. he was last seen wearing c heckered sports -- checkerted shorts and a beanie. >> he's never been like this in the past. this is really out of the ordinary for him. >> reporter: that was juliani's mother, tabatha. she's eight months pregnant with rodriquez' child. rodriquez was last seen wearing

along 680. investigators say they were originally there for a drug raid at a unit rented by an u nidentified woman. but once the search started, the focus quickly turned to those -- quickly turred to those pipe bombs. >> they didn't need a warrant. she was in the place with the door open when i went up to talk to her. >> now, the bomb squad was c alled in and four pipe bombs were detonated right there at the scene. the chp closed traffic periodically on interstate 680 during the evening commute just to protect drivers for any possible takers from those explosions. the woman who rented the unit was taken into custody. the bomb squad was called in again as we were telling you. they were -- four pipe bombs were detonated at the scene. now, again, the investigation into this case will continue. now, the city of vallejo is now moving ahead with a g et- out-of bankruptcy plan.

the plan comes more than two and a half years after vallejo filed for bankruptcy. it calls for the city to defer payments of more than $ 50 million in debts until 2013. the plan still has to be a pproved by the city's c redito. the city of berkeley's city council has delayed a vote on the plan to use taxpayer money to pay for sex change operations for city employees. the proposal calls for $20,000 to be set aside every year for gender reassignment surgery. some of the residents argue cit argue on more pressing issues. vote is set for february 14th. the state -- the fate of schools in mount diablo will be debated tonight. the district is considering closing the schools to save $ 1.5 million. glenbrook middle, silverwood elementary, holbrook elementary, rehn avenue and

monty gardens m could be affected. trustees are expected to vote on a plan on february 8th. university of san f rancisco's radio station is demanding answers this morning after its programming abruptly went off air. kusf former spot 90.3 fm was sold by the university but the radio staff said they were not told about the deal until m inutes before their signal went dead. kusf will now only be available online. the station has 200 volunteers and they plan to discuss the matter with school officials tonight. 7:36. well, a decision may be made today about a controversial paint job. it's at a new pizza parlor in san rafael. tara moriarty has been out there all morning long. you are back out there again. show us why people are so upset ter: well, all you have to do is look, dave. here you go. this is a very bright shade of

yellow. a lot of people say hey, it's colorful but others say it's overkill. if you take a look down the street, we're on 4th street, this is historic downtown san rafael. a lot of these facades are brick. it's very historic looking and people say this yellow simply does not fit in, that it's an eyesore. sanrafael has no specific requirements for downtown structures but it turns out that the city's design review board is supposed to approve any big changes to storefronts. so it looks like it will be put to vote but no word yet on whether it will affect the pizza parlor's opening which is slated to open next week. we spoke to one resident who said he thinks the paint job adds spice to the area. i think -- i think it's a g enous. i it. i think it's great. >> reporter: now, just around the corner, up lincoln street,

now, a female classmate who was shot in the head is listed in critical condition this morning. a 15-year-old boy who was shot in the neck, he's listed in fair condition. the fbi is looking for the person who left a bomb along the route of a minged parade in spokane, washington. the backpack was discovered with the explosive device inside on monday. this forced organizers to change the route of the parade. the fbi says the bomb was fully functional and would have been capable of killing many people. later on today, workers at napa state hospital will stage a rally right outside the gates of the psychiatric hospital. they will demand new safety rawls and -- rules and call for more protection after violent attacks. one hospital staff member was

killed. another was the victim -- em -- employees say more needs to be done. in a story you will see only here on channel 2, federal investigators are looking into a dark side of the nation's mortgage crisis. the fbi is investigating whether the unscrupulous investors are inspiring to keep prices low when these are sold at auctions. fbi agents raided the realty office. and the fbi said it will only day it's looking into competitive practices. people at the fruitvale avenue office are not saying anything. >> can you confirm that the fbi was here? >> i can't confirm anything. >> no one in this video of a

in stanislaus county and is back with an update. >> reporter: the stanislaus county sheriff deputy said they are in a holding pattern. they've received leads but no leads have panned out. no sightings have been in -- have been in. this little boy has not been seen since yesterday around 4:00. he was ripped by his grandmother aarms by taba that you's e x-boyfriend -- tabitha's e x-boyfriend. now, authorities say 27-year- old jose esteban rodriquez kidnapped juliani and is driving with the boy, possibly to the bay area. rodriquez has an extensive criminal record and is c onsidered dangerous. he's about 5'9", 180 pounds with black hair and brown eyes.

bring the little boy to the bay area. now, coming up you are gonna hear from authorities this morning. they will have an update for you in this case. reporting live, jade hernandez, ktvu channel 2 news. >> thank you, jade. it's one minute after 8:00. a routine traffic stop last night ended in a deadly police shooting in san pablo. kraig debro has been on the scene all morning and joins us with more on information you just got from police. good morning, kraig. >> reporter: yeah. just got this press reless from police. it may provide a motive everybody. a reason the suspect ran in the first place following what you said was a routine traffic stop. it happened on san pablo road. behind me is the gas station. this is just off 80. the officer pulls over a car with three people in it. it was a 1990 honda. he pulls them over, just going back to check on driver's license. two people in the car jump out of the car. he orders them back in but one of the passengers in the car

takes a backpack out and runs around this gas station running with his backpack. now, following that, the officer gave chase ordering the suspect to stop. the man threw away the backpack. the officer then used his taser before both men fell to the ground, wrestling until the suspect broke free as he started to pull a gun from his w aistband. a witness tells us there was a break in between some of the shots. >> there was a few small short pauses and then we heard a few more shots after that. >> reporter: the suspect died at the scene. according to the police, he was a parolee at large and had an extensive criminal record. police say his gun was load and ready to fire. the two other people in the honda are cooperating with police. the officer is on paid leave. recording live in san pablo, kraig debro, ktvu channel 2 n ews. thank you, kraig. several dogs are recovering after being rescued from some

horrific conditions in the east bay. animal control officers went to the home on capistrano drive after receiving complaints of noise and foul orders. inside, dog crates were stacked on top of each other and 33 dogs were living in their own waste. >> some of them, maybe they were also cramped or confined because they -- probable -- they couldn't walk. >> many of the dogs were too sick to be saved. others were described as too aggressive. the ones that did make it true the ordeal with living in new homes. the owner of the home is facing animal cruelty charges. officials say he could have more charges filed against him if it's determined that any of the dogs were used for fighting. 8:04 -- 8:04. this morning san francisco- based wells far reported fourth quarter profits of $3.4

gas transmission line. pg&e may have to test or possibly replace some pipelines. that would affect power supplies to thousands of pg&e customers. san francisco is moving closer to appointing a new chief of police. the police commission is scheduled to meet tonight to discuss finding a replacement for george gascon. he left his post earlier this month to sean the -- accept the job of san francisco's city attorney. ed lee will get three names and have the final say on approve -- naming the chief. the municipal transportation agency board was about to consider a fine paying employees who don't pay $80 for a monthly payment. however, the chairman asked for a delay last night. the agency says the issue could come up for discussion in the

in tucson last week helped a grieving nation cope with this tragedy. a san francisco man who identified a crime suspect for police say he fears for his safety after getting a d isturbing letter from the suspect. jerome cuffy said he witnessed the suspect, john paul, trying to set a fire at an apartment building back in november. now, olsen has sent a letter to cuffy saying in part "you messed up my life." the letter included cuffy's n ame, address and cell phone number. >> i now understand why people don't want to come forward, in instances like this. i mean, god forbid, this was a shooting. >> it's not clear how he got his private information. it's illegal in california to provide such personal information to a defendant. we contacted olson's attorney but he would not discuss the case. the judge in the chauncey bailey murder trial says a t racking device on the suspect's

car is not a privacy issue. police planted the device on yusef bey iv's car because bey was a suspect in a kidnapping investigation. prosecutors want to use evidence from that device to show that bey was parked outside bailey's home just hours before his murder in august 2007. defense attorneys say it v iolated their client's privacy rights. the judge says he sees little dips between undercover officers and computer tracking devices when it comes to following a suspect. 8:18. at a time when california's c utting state programs because of the budget deficit, there is a new audit that shows improper spending and incompetence by workers cost the state $500,000. the audit is a result of tips to a whistle-blower hotline. it here's one example. it said is took managers three years to investigate and remove a psychiatrist in the c orrections department who was accused of inappropriately

nidentified woman. but once the search started, the focus quickly turned to the pipe bombs. >> we began a search of the storage unit and we opened you it up and found pipe bombs. at that point, everything was found for the safety sake. >> a bomb squad was culled -- was called in and four pipe bombs were detonated on the scene. chp closed traffic periodically on 680 nearby to protect drivers from any potential dangers from the blast. the woman who rented the unit was taken into custody. the man accused of raping his 80-year-old relative at knifepoint is scheduled to be charged. 44-year-old anthony square faces felony charges included force -- including forcible rape, elder abuse and the charges were filed yesterday. but the victim told police the

went off inside a backpack and injured two students this morning. the district's incoming superintendent says the school failed to do enough random searches. a 15-year-old girl shot in the head is in critical condition this morning. a 15-year-old boy who suffered a neck injury has been upgraded to good condition. a 17-year-old who had the gun will likely face charges of assault with a deadly weapon. the fbi is searching for who left a boom aen ho the route of a martin luther king day parade in spokane, washington. a backpack was found monday morning with an explosive device inside. the discovery of the bomb forced organizers to change the route of the parade. the fbi says this bomb was fully functional -- and it would have killed a lot of people if it went off. on monday, someone vandalized a facebook page h onoring dr. king. the page was filled with racist images and messages. the page is hosted by the

martin luther king center in atlanta. a spokesperson says he wishes most people spent monday remembering dr. king's dream and not spreading online hey threat. more protection is demanded now following incidents. here's tara with more. >> reporter: in about two hours, a group of psychiatric technicians and other work es will be marching in front -- marching in the front gate. those are in memory of a worker who died here last fall after she was attacked by a patient. did you know donna cross? >> i did. she was a wonderful person and
