not much. some patchy fog will work its way back to the delta. now here is my good friend sal. good morning, right now traffic is moving well heading down to the toll plaza or heading down to the middle of central san rafael as we look at central 101. as you are heading to the richmond bridge so far it's a good drive. we are talking about the san mateo bridge toll plaza. traffic is good there. let's go back to the desk. topping our news. shocking reports of second graders engaged in sexual activity inside an oakland classroom. ktvu channel 2 reporter tara moriarty is live at markham elementary school. what happened and where was the teacher? >> reporter: at this point we don't know where the teacher was exactly inside of the classroom or if he or she saw anything. we don't know either where the two students were inside of the classroom. i'm sure these are the questions that parents will be asking when they drop their

kids off at school here in a couple of hours. now parents did receive notices from the principal yesterday afternoon telling them that initial findings confirm two second graders had oral sex inside the classroom last week. there was another incident in the same classroom last week with several students with at least partially undressing. >> no. >> i don't know how it can happen. >> they are imitating what they are seeing. they didn't learn it at school. >> reporter: ktvu first broke this story yesterday. a spokesman with the oakland unified school district said it all came to light when students told a teachers aid who told the school principal. district officials will not say if any teachers have been suspended just that action has been taken. the students are being offered some councilling. we are live here in oak land i'm tara moriarty. in just about an hour police dive teams are going

back to a canal in the central valley town of patterson. they will search an under ground section of that canal. the witness says he spotted a silver car plunge into that car just 45 minutes after tuesday's kidnapping of juliani cardenas. last night juliani's mother spoke directly to her four-year- old son. >> tell jose you want to come home. tell jose you want your mom. maybe he will feel bad. i'm hoping that he can get him to be remorseful. >> there have been dozens of possible sightings of the missing boy and his kidnapper. but investigators say there is no electronic trail here, no cell phone calls, no credit card purchases. take a lock at the surveillance video of the silver toyota coral la. it was taken 45 minutes after

the kidnapping. the driver went inside and purchased some beer. authorities have just told us the amber alert in this case will continue indefinitely. the highway signs are still on. they are asking everybody keep an eye out for the suspects car and take a look at the california license plate. it's 6hbw445. a scary warning from oakland. officers have issued a community alert for people that are living and working in the lake merit area. kraig debro has a story of what happened to one woman and why there could be more victims. >> reporter: good morning, pam. they have issued a community alert. i'm trying to find out where it happened. they say it happened somewhere off of lake shore avenue. a neighborhood off of lake shore avenue. they have not told anyone exactly where this robbery and sexual assault took place. this is what police say happened. tuesday night in the early

evening a woman walks in the residential area is approached by a man. the man robs and assaults the woman. a couple of women we spoke with this morning say knowing that would help them respond. >> i think it would make people more aware and so we would pay closer attention as well as make sure we are walking together. walking in groups and ready to do what we need to do to be protective. >> we've had the conversation been. she used to walk out here alone this time of morning. a lot of us recommend that she not do that. she does it anymore -- and she doesn't anymore. >> reporter: police are trying to connect what happened here on tuesday to a pair of similar robberies and sexual assaults that happened last september. in those crimes women on their way home both robbed and sexually assaulted. police believe those two crimes are linked because they happened in the same area of town just hours apart. of course, the method of operation is similar.

like the tuesday night crime, right now the assay lent and victim are among the very few people that know where this happened on tuesday night. reporting live from oakland kraig debro channel 2 news. a police search continues for a burglar that held three women hostage inside a home near napa. it happened on mettledale road. police say the women all in their 70s interrupted the intruder when they returned home. they called 911 and said they were being held hostage. a swat team was called in. they did not find the suspect. >> one of the victims were able to get out of the home on their own. the other two locked themselves in their bedroom. they were all in good condition. >> police only have a vague suspect description. police tell us here at ktvu they do not know if he got away with anything because the victims were house guests at

that house. an evidence team will be back at the the home. a big victory for santa clara basketball team lead to a wild overnight street celebration near the campus. as you can see dozens of rowdy fans gathered outside of the frat house. several bonfires it will up the streets. the street party lasted several hours until the police came in and broke up the crowd. the police are telling us no one was arrested. now the trouble this streets followed santa clara's biggest victory in years. santa clara beat gonzaga. this was the biggest upset. police in vacaville want your help this morning. they are trying to find a man that suffers from dementia. he has been missing since wednesday. we talked to police in the past hour. they are telling us that 57-

year-old jose valdez is still missing. valdez was driving from southern california to lake tahoe but became lost around vacaville. he was driving a silver 1995gm jimmy. with a license plate of 3pky412. in san francisco today a crucial hearing is scheduled in the federal perjury case against barry bonds. the defense team is expected to ask a judge to throw out key evidence. it's an attempt to build upon their legal victory over federal prosecutors last year. a judge barred much of the evidence they hope to use against bonds. the trial is scheduled to start in march. let's go to sal to see what is happening on the roads. >> just how we hear of a crash in san francisco northbound 280 south of geneva where that little yellow indicator is on your map. we don't know much about it. chp is on the way.

base in tucson. from there they will fly her to houston. the mayors of oakland and san francisco are at the white house again this morning. ktvu alison burns joins us now from our washington, d.c. newsroom with the tough message the mayors are getting from the president. good morning, alison. >> reporter: good morning, to you. and mayors from all over the country are actually beginning to be at this reception at the white house this morning. they are getting a tough message from president obama not to expect much in the way of federal funding next year. the stimulus dollars that have been flowing to cities are coming to an end. the republican takeover of the house and the focus on cutting spending has mayors what to expect. we talked about it with san francisco interim mayor ed lee that is hoping for continued cooperation from congress. >> once they learn the facts, no matter what side of the aisle they are on san francisco is about delivering the goods.

>> reporter: now mayor lee tells us he has been meeting with members from the bay area congressional delegation. some top administration officials about boosting to local projects. we will very on the agenda of mayor gene quan next week during my next update in an hour. for now we are live in washington, d.c. i'm alison burns. a new poll shows an overwhelming majority of americans like president obama but has not done enough to change the economy or the way washington o. the press poll shows 83% of americans say the president is likable. 34% say the president has not lived up to his promise of change. still several new polls do show his popularity overall is up. threatening graffiti

messages have been found in southern california. the graffiti was found spray painted on walls. they included a swastika and a threat to kill the governor on february 14th. there has been a series of hate- filled gray fee toe walls throughout the area. time now 6:16. a new fiscal emergency declared by governor brown will give lawmakers more time to solve california's budget crisis. the emergency declaration is largely a procedural one. what it does is resets a clock that gives lawmakers 45 days now to agree on a budget plan. if there is no deal lawmakers will be acted upon any other matters that is not related to the budget. the first building phase of a new death row has been delayed since february 19th. the department of correction says it needs more time to brief the new brown

northbound 280 at the geneva accident. this crash we told you about it. now it's word there is at least minor injuries. they have to send out the medics just to check on someone. it doesn't sound like it's major injuries. it is slowing on 280 northbound. no problems here on westbound highway 4 coming up to the willow pass grade. and this popped up on my screen as we were talking. we have word of a serious accident now. also in contra costa county. now it looks like a couple cars got into it. we are sending medics. we don't know what we have here. we will have more for you later. and this mornings commute on the bay bridge you can see it's zooming in on the incline section there. traffic is getting busy on that incline section and it may be that things are -- there may be a stalled vehicle up there we don't know about. we will keep you posted.

6:19 let's go to steve. sal, we have clear skies. some of the fog has decided to creep in by the delta. otherwise it's just clear and cold. we don't have to worry about any rain. not even today or the weekend. the wind is localized. it's mainly above the oakland berkeley hills. it's not nearly as strong as yesterday. a little breezy. everyone is saying calm now. it's cold. a lot of 30s showing up here. including concord. fairfield. san ho sigh is in the 40s. the city is the warmest. cold mornings. patchy fog. sunny and mild to warm. it's a dry pattern. e storm track stays to the north. that fog is going to start playing back into our weekend forecast nights and mornings. at least the days will be sunny to warm. we will have temperatures in the 60s for many. low for some. let's push a couple to the 57-

60-degree range. lots of sunshine. a few high and then. a dry pattern. this morning bank of america reported a fourth quarter loss of $1.2 billion. the bank was hard hit by write downs of mortgages without the charges related to home loans they would have seen a profit of 657 million for the quarter. san francisco bids times reports a building on brandon street sold for $33 million. which is 12% more than it sold for the year before the recession started. the new owners say they have leased most of the space. rental agencies in the area report rents are losing quickly as tenants move in from the south bay. time now 6:21. president obama will highlight economic success stories when he pays a visit to a general electric plant in new york. he will put a new spotlight on a new ge deal.

he will announce that ge ceo jeffrey will be heading up a new white house council on jobs and competitiveness. the president wants them to help generate ideas from the private sector to speed up economic growth. a city in debt. the bad news for some people that are owed money. also state investigators are look for whoever made the frightening call to send hundreds of east bay students into a state of emergency.

good morning. traffic is moving along realtively well. it looks like we have slow traffic getting into san francisco. as i'm look agent the board chp doesn't know of anything yet. it looks like there could be something on that span. san mateo bridge traffic looks good as you head up to the high- rise. let's go back to the desk. thank you. the unsolved murder of a tgif murder in san mateo is still haunting his family and friends. three years ago today 36-year- old doug castillo was found beaten to death. they have exhausted all leads

and it's unclear if robbery was related for if he knew his attacker. a $45,000 reward is being offered for anything leading to the arrest of his killer. about 11:30 yesterday morning police got a 911 call saying at least 40 students at the school for the death and blind have been shot. it turned out to be a prank but nobody knew that at the time. the school went into lock down mode and dozens of fremont police and chp officers went out searching for a gunman. >> the emergency coordinators in each building are aware of their responsibilities. and they need to make sure that everybody is calm, everybody is safe. >> we run drills on this all the time. so students and staff know what to do. they lock their doors, they lored their blinds. >> school officials are trying to put a good light on this

scary incident. they say this was more realistic than usual test of emergency response. the city of vallejo which filed for bankruptcy last year has a new plan to pay off its debt. the city wants to pay its creditors as little as 5-20% of what is owed. most are current and former city employees for unpaid sick leave and vacation time totals more than 400 million. the have to agree to the plan first. the world champion san francisco giants are proving success comes with a price. team owners are expected to spend roughly $115 million on player salaries this season. that's the first time the giants payroll has climbed to the mid 90s. nearly every player from the 2010 championship team will be back this is with the exception of quan uribe. sex in the classroom

i'm dave clark. >> and i'm pam cook. researchers are going back to a canal looking for that missing boy. jade hernandez just got information from the amber alert. >> reporter: they have the authority to call on this amber alert. we have learned initially the sheriffs office was told they need to justify how long they kept this alert alive. now they have been told they can keep it up as long as they deem necessary. this is the delta canal where the dive team search was called off yesterday after a silver stolen lexus was pulled from the water. tire tracked found in the canal are being compared to the tire treads on the lexus today. if they match it will confirm the witness that saw a car roll into the water the day that juliani was captured was not the car that rodriguez was

driving. they are bringing in sonar equipment. >> it's something new. we are not sure it will work 100%. the goal is to check the water to make sure there is nothing else that could be in the area we were unable to check. >> reporter: last night ktvu brought you new cell phone video of the four-year-old juliani cardenas. he was abducted by 27-year-old jose esteban rodriguez. rodriguez's own mother that lives in san jose said she is scared and nervous. she doesn't know how this will turn out. the family has a new facebook page which they hope will lead to more clues where the two might be. i want to bring you back out live. you can see the sheriffs mobile center is here. this arrives around the time in the morning we have been told that sonar equipment is expected to arrive here shortly as well. they hope to be in the water

around 7:00. the state-wide amber alert continues this morning for missing four-year-old little boy. shocking reports of second graders engaged in sexual activity inside of a classroom. investigators are investigating the allegations inside of markham school. school officials say a girl and a boy both second graders engaged in oral sex in a classroom last week. also under investigation reports that students from that same classroom partially undressed and that the teacher was in the classroom at the time. >> right now we are trying to determine how something so incredibly transgressive could have occurred while an adult was present. obviously that is unacceptable. >> the district says the teacher is now on leave while the allegations are being investigated. councilling is being offered to

students and parents with questions. they can contact the principal. we have posted a letter sent home to the parents on our channel 2 website. you can read it as ktvu.com just click on the bay area news tab. time now 6:33. a student is doing well this morning after becoming sick during an science experiment at school. this all happened tomorrow after the boy politicalled bleach and vinegar on his desk. he started could having and had trouble breathing after inhaling the mixture. he was rushed to the hospital just as a recaution. ten of his classmates went home sick too. a teenager accused of bomb attack. investigators say alexander youshock was armed with ten pipe bombs and planned to kill

the type teachers and students. a teacher tackled him to the ground and held him until police arrived. youshock has pleaded not guilty by reason of insanity. an innocent game turned ready by a union city boy was attacked by pit bulls. his father used his hands and a piece of wood to fight off the dogs. the boy had gone into the yard after hitting his ball in the fence. the pit bulls are being held by police. the boys and father recovering from cuts and bruises. a berkeley animal shelter celebrates its reopening. this morning a devastating fire there killed more than a dozen cats at the berkeley east bay humane society last may. the shelter is still rebuilding. the city is allowing them to operate in part of the building. residents people want to be able to bring their pets to shelter for spay and neutering services can do that. the shelter is also resuming

adoptions on the weekend. let's go back over to sal to check in on the commute. sal. >> we are getting new information. i want to ask the guys in the control room if they can put up the map first even though that was not on the schedule first. we are getting word of a possible fatal accident on san pablo dam road. at first we heard it as a crash between three vehicles. now it could be very serious injuries. obviously we are hoping that this person can survive. but we are getting pretty grim news about the possibility of that here. on san pablo dam road. i drew it on the map there for you. we are trying to investigate. this is bad news. it's a popular shortcut for people that drive from the eastern contra costa area. we are on top of it. we will let you know. rest go out to the toll plaza

the elserbronta area. it's a three-car accident when they first reported it one person inside one of the cars was not moving. now they have started the coroner that way. this is a popular shortcut for people that come in from the contra corsica area. they use it to get to 80. this will be a big delay for those drivers. we recommend that you use highway 24 or stay on 80. at 6:43 let's go back to the desk. >> okay. here is a quick look at some of the top stories we are following for you. three women are safe after a burglar held them hostage for awhile during a home invasion. this happened about 8:00 last night. that suspect got away and is still on the loose this morning. a big victory for santa clara mens basketball team lead to this. a wild overnight street

off of lake shore. she is walking home she is approached by a man. the man robs her and sexually assaults the woman. the police did not release the street or exact time. people that we talk to want to know where this happened and they want more protection. >> of course i think it's awful. i don't know why we don't have more lighting or coverage or police protection. >> reporter: people may be trying to connect what happened tuesday to a pair of similar robberies and sexual assaults that happened last september. a lot of people i talked to say they remember that. police actually posted a flier with a description of the suspect. police believe those two crimes -- these two crimes are linked because they happened in the same area of town. of course the method of operation is similar. what i want to know from police is if the crime that happened

on tuesday is linked to the ones in november. more than 120 suspected mobsters are facing charge this morning after one of the biggest busts in the history of the fbi. u.s. attorney general erik holder says the suspects are members of several east coast organized crime families. about 800 federal agents and police officers in three states work together to carry out yesterdays arrest. the suspected mobsters face a variety of charges including murder and extortion. a pleasanton university raided by federal agents reportedly help provide fraudulent visa related documents to foreign students. immigration and customs enforcement agents seized evidence. that same day that raided the ruby hill home of the schools president. they report that school issued more than 900 visas and made millions of dollars. the university is now closed. funeral plans are being

made for a 15-year-old boy who died at a reno area ski resort. 15-year-old mason ortiz fell and struck a tree while walk down a slick mountainside on wednesday. he was taken to the hospital with serious head injuries. he died yesterday. family members say he had just taken off his helmet after snow boarding. time now 6:46. a zap -- a san ramon man will serve prison sentence. he came to the attention of police after neighbors saw him look into the windows of teenage girls he admitted he was attracted to. police found 13,000 images of child porn on his computer. lobbiest in the colorado state legislature has been charged with breaking into his ex-wifes home and placing raw chicken parts in the heating ducts and pouring bleach inside

of a piano. 57-year-old ronald smith is charged with felony burglarly and criminal mischief. his former wife says she suspects her husband because she has been harassing her. smith so far has not entered a plea. we want to go right back over to sal. he has an update on a serious crash. sal. >> that is right. this crash reported just after 6:15. now getting word it's a fatal accident on san pablo day road. there is a travel light there. this intersection is completely shut down. a lot of people use it as an alternative to highway 24. they will use it as an alternative to the caldecott tunnel. this morning i would not plan on that. there is just side roads to get around. that is the only main road through there.
