it is considered a federal hearing. take a look at this. we can show you this afternoon the caravan roll into san quentin before the tour began this morning. today u.s. district judge jeremy fogel toured the death chamber with a handful of print reporters. it was expected to last an hour. it was suppose to remedy the problems he found in 2007. judge fogel said the procedure included an out of date facility and poorly trained staff. despite not being able to tour the plant today our cameras toured part of the facility before. we got to speak with those who toured with judge fogel. >> he has to determine whether this chamber addressed the

concerns he had last time. >> he is a very much a constant professional and he's called himself a fact finder a collecting facts. he's taking note and that is pretty much all he expressed was his interest. >> reporter: now today out of san quentin a rally began. they are not antideath penalty they are antispending. >> so when we talk to our legislatures, they say, where do you want us to cut? so we start thinking about it we figured here's a good place to cut. they are about to start a project that will poor $65 million into an expansion of death row. the costs are $1.6 billion over the next 20 years. so why are we doing this? >> reporter: we learned today judge fogel had a court reporter with him when he looked through this facility. he asked a lot of questions but

miles up the road. ktvu has learned where they are going and when they will be moving. kraig debro. >> reporter: first it is sun and now it's facebook. facebook announced it would move to this facility at 84 and willow road. if you look around here to my right you can see a few cars. there is a handful of oracle workers that are still here. that will change this summer. for facebook the building is what it was looking for. an open environment which will help people create new ways to communicate for menlo park who doesn't want to be associated with a business that has half a billion members. >> facebook is facebook. it's global. it's known everywhere. it's a dynamic company. it brings that branch to our side. >> reporter: neither side will talk about the money involved. facebook says it has a 15 year lease on the old building at highway 4 and willow road with

an option to buy after five years. the largest networking site of the world said it will move all of its bay area employees into the building by june of this year. >> we were attracted to the campus to the location in menlo park with its central accessibility from around the bay area. >> reporter: but satisfying local residents said some problems will be arise. two major concerns traffic and the environment. company says it's contracted with the environmental defense fund to do an environmental impact report. facebook says the building is next to easy accessible roads. the deal was done without the promise of tax breaks. neither can quantify what the deal will mean to menlo park. >> there will be a value to that. it could be in exchange for different types of development or different types of planning and it also could be in revenue. we have to have this discussion. >> reporter: facebook also

bought a 22-acre track which is adjacent to this property. it's connected to this campus by a tunnel. they don't plan to use it now but the company cfo said the company is grow at a rate of 50% a year. they will need to open that campus sooner rather than later. reporting live kraig debro. >> thank you. the man accused of stocking facebook founder mark zuckerberg is scheduled to be in a courtroom this month. zuckerberg filed a restraining order last week. he sent facebook messages to zuckerberg including one that said please help me. i'm ready to die for you. this morning he tells celebrity website tmz.com he wanted to get zuckerberg's advice on a personal problem. he's accused of showing up at the facebook offices and at zuckerberg's home trying to contact him.

wikileaks founder julian assange was back in a london courtroom today. his lawyers are trying to stop a judge from sending him to sweden. this comes after assange's controversial website has come up with a new way to raise money by selling branded merchandise. they launched an online store yesterday. they can choose from several items including tee shirts, hoodies, mugs and tote bags. former msnbc olbermann is heading for a new job. the outspoken olbermann left his job after host of countdown. he will host a weeknight prime time news and commentary show which will begin late this spring. olbermann says it will be similar to what he had been doing at countdown. just ahead changes could be becoming to a law that could make teenagers in one state

day labors walked a noisy picket line this morning demanding a worker be paid for a job. jose cruz is owed over $6,000 for roofing and general contractor. cruz filed a complaint who has ordered the contractor to pay him for unpaid wages, penalties, and interest. john was not available to comment on the claim. they say they want to make sure employers pay for work and treat day workers with dignity. this is new from the past hour. the u.s. government just released new findings that

confirm earlier reports that toyota electronics are not to blame for sudden unintended acceleration problems. u.s. transportation secretary rayla hood said what he called an extensive study. after looking at 300,000 lines of software code the investigative team said mechanical problems are to blame. and they have recalled 12 million vehicles. >> first some toyota floor mats entrap drivers gas pedals while their vehicles were in motion. second so-called sticky pedals made some toyota acceleration too slow to release. >> the study was launched at the request of congress following consumer concerns about the possibility of faulty

electronics. there is a new sign million americans are feeling more confident about the economy. for the first time in two years americans are charging more on their credit cards. borrowing rose 3.5% during december. that is a sign some americans are becoming more confident about the economy and their jobs. as cal train prepares to make millions in budget cuts, a new report out today finds the agency ceo is the highest paid transit boss in the state. he made over $400,000 last year. the salary report is out just days before the cal train board is set to declare a fiscal emergency. the report shows scanlon makes more than bart. he also made more than los angeles metro ceo that runs the largest transit agency which is 15 times larger than cal train.

>> why not give him a bonus later on if you can achieve these accomplishments here is your bonus? >> the cal train board is considering raising fares and closing down stations. vice president joe biden has announced a $53 billion investment in high-speed rail projects. it's part of an effort to create jobs by spending on infrastructure projects. he made the announcement this morning in philadelphia. the funding will be part of the budget president obama will present to congress soon. he says the plan would dedicate $53 billion to continue building a national high-speed rail network. there is no word yet on how much of the federal dollars might end up helping to fund california's high-speed rail project. tonight the oakland city council will continues its debate on whether to move

forward on a controversial policy on pot farms. however one key player will not be part of the discussion. city attorney john russo is fed up with the councils determination to license large- scale pot farms. russo sent the council a letter saying he will no longer represent them in this case siting ethical rules. it is a blustery day for some bay area residents especially for people in the hills. the chp issued advisories for bay area bridges earlier today. you can see the strength of the wind from some flags this morning. one man also had a strange story about gusty winds outside of his home. >> it was blowing very hard until about 4:00 this morning. it was still dark outside. it blew my front door open. it blew a whole pile of leaves down the hallway. >> the wind also caused problem

in the monclaire part. the forecast calls for windy conditions throughout the afternoon. good afternoon as tori mentioned it will be a windy one giving you a look at san francisco you can see that wind really blowing that flag around and on those bridges it will be quite gusty. you may be holding tight to the wheel at least throughout the afternoon. other winds are expected to die down in most cases throughout this evening. you can see the valley with wind even through a wind advisory. fairfield is reporting winds to 22 miles an hour gusting to 40. san francisco checking in right about 22 miles an hour. take a look at napa 33 miles an hour right now with the gust to nearly 40 in many cases. if we slide in areas around concord and oakland reporting winds to 20 miles an hour. i showed you san francisco a

second go. and livermore reporting 15 miles an hour. livermore reporting gusts to 25. concord reporting gusts to near 30. we have wind blowing in redwood city. 15 in areas around san jose. these winds will continue to blow. even though our temperatures are continuing to warm it feels cool out there with breezy conditions. the winds between 20, 30, and 40 miles an hour. our hills very gusty as well. the north and east bay hills could see the winds up to nearly 50 miles an hour at times. talking about what is happening here we are watching just a dry weak wave move through. that is kicking up our winds. we will be cooler today than we were yesterday. we have the upper level winds driving right down the stay of california, nevada, down the center there and kicking up the winds relaxing by tonight. temperatures right now sitting in the upper 50s to low 60s.

of meetings to close three schools to save $1.5 million. tonights meeting starts at 7:30 and will be held in the gym. new changes could be coming to a texas law. the law has to deal sexting. that's when they send a sexual picture of themselves. teens caught sexting in the state of texas face harsh punishment including registration of a sex offender. it would make the act a misdemeanor. marin county health officials now know what caused dozens of students and adults to get sick on a five-day field trip last week. they all tested positive for the norovirus. the illness is spread from person to person.

and it's believed that one child was sick and the disease spread from there. updating a story we first told you about yesterday. bounce houses are now banned from walnut creeks city parks. the inflatable houses have been allowed in parks if the users received a permit from the city. the workers said too many people did not bother to apply so there was no proof of insurance. land skip crews also complained the houses damaged the grass. a marin catholic high school baseball player that playing with his team once again. 17-year-old gunner sandberg and his teammates held their first practice of the season. it has been almost a year since he was hit by a line drive. he suffered a fractured skull. concerns were raised that the metal bat used by the batter was partially to blame for his injuries. this season, all marin county athletic league teams will use
