i'm dave clark. >> i'm tori dam bell. it's tuesday -- campbell. it's tuesday, february 2nd. we're following developing news of the four americans who we learned just within the last hour were found dead on their yacht. as sandra endo reports from washington, d.c., apparently they were killed by their captors right as u.s. forces were negotiating. >> reporter: good morning, tori. the quest, that yacht, carried four americans taken hostage on friday by somali pilots. u.s-- pirates. the u.s. believes 19 pirates were involved. and the four americans on board include the owners, jean and scott adam, and phyllis mckay, whose mother and niece live in the bay area, and one more

victim, bob riggle. all four were shot to death by their captors early this morning. that's when u.s. officials say a navy ship trailing that vessel and, in fact, were involved with negotiations with the pilot for release of the hostages. responded to the gunfire. and what we know at this hour is that four pirates are dead. 13 others are in custody right now, but again, not the ending that u.s. officials wanted to see from this hostage situation. tori? >> sandra endo, live for us in washington, d.c. obviously a story we will continue to follow throughout the morning on "mornings on 2". we also want to bring you developing news. we've been following this all morning. an earthquake devastated in new zealand, a a -- a powerful earthquake. this is the scene above

christchoift -- christ church, new zealand. the shaking has not stopped hitting that city. we know of at least 65 people who are dead. several residents in the city are still missing. >> the best estimate that i can get is learnly -- is certainly more than 100 people could be trapped in collapse buildings around the city. it could be more. >> now, the airport in christchurch has been closed. the hospital in the city was closed for a while but it's since reopened. phone and electrical service remains cutoff. the new zealand earthquake is trending on twitter. a lot of people posting pictures of the widespread damage. one person posted a before-and- after picture of the church

crude oil prices are at a two- year high. crude oil features for april delivery are up more than a dollar right now at nearly $107 a barrel. the price topped $108 earlier in the day. libya is the third largest oil producers in africa. hours oak oakland police cash cash hours ago -- hours ago, oakland police issued a message to shoppers. here's more. >> reporter: this is a crime trend that happens after people go grocery shopping at some oakland grocery stores. about ten minutes ago i spoke to opd and the woman said the good thing so far, no victims have reported any weapons being used in the robbery. but he said how the tren works and -- trend works and this is

video of the safeway off redwood road. police say it appears two robbery suspects hang out in the parking lot. they spot someone finishing up their grocery shopping and they follow the shopper home. police say they robbed the person of their person and belongings. now, again, as we just told you a little while ago, police say they do not are have any -- do not have any reports of any weapons used. police say in the past month there have been at least seven robberies, many originating from the safeway. but one of the lieutenants we spoke to said some of these robberies may be originating after other people leave other oakland grocery stores. police are warning anyone who goes shopping in oakland to be aware of their surroundings and to be aware of who may be watching them in the parking lot of those stores. more thing to add. all of the victims have been

line of duty in that city in less than a month. >> we're still healing from the first tragedy and it's gonna take some time. >> now, police say officers were called to the city's downtown area about 10:30 last night for a suspicious person. when the officer approached the man, gunfire was exchanged. that officer was shot several times. it's still not known if the suspect was hit. but he did escape from the area. last month, two st. petersburg police officers were killed as they help to serve a warrant. it's 7:16. a decision by the san jose police department to redefine racial profiling is getting the hums up -- thumbs from minority leaders. "the mercury" reports that it will be a violation for a police officer to show bias at any time during an encounter with the public. it used to be considered a

violation only if the officer initiated contact because of racial bias. ten oakland police officers are back on the job this morning. they were among 80 laid off over the summer. jeanquan announced earlier this month that she was requiring -- rehiring ten of the laid-off officers based on seniority. the force now stands at 663 officers and that's just three fewer than 669. the rehires still have to go retraining before they can hit the streets. we have breaking news from the u.s. supreme court. the high court just upheld limits on lawsuits filed against drugmakers over childhood vaccinations. that's a major case that's been talked about for years.

again, the u.s. court has upheld limits on lawsuits filed on childhood vaccines. last week's filing deadline has prompted california lawmakers to introduce more than 2,000 new bills. among them, a proposal that would require driver's licenses or i.d. cards of sexual predators to contain coded information -- coded information that could be read by police. a bill written by tom you a me you a know would -- amiano would give pay -- would put in place pay standards for housekeepers. consumer financial protection bureau reports

cancelled yesterday and there's already a back dg lock from that -- backlog from that. we just checked with sfo, though, and so far no delays there. the heavy snow proved to be too much for a grocery store roof to handle. security cameras captured yesterday's roof collapse -- there it is -- at the food 4 less in pontiac, michigan. the store's owner said it happened around 2:00 a.m. when the grocery store was closed. obviously no one inside so no one was hurt. residents in san francisco's tenderloin district are pleading for more public bathrooms. they are complaining the homeless are using their streets and sidewalks as a public toilet. now, ktvu news actually shot this video you are looking at in the neighborhood this morning. one local community group recently opened a new public bathroom and even paid a worker to keep track of how many

we are continuing to follow tragic venning news this morning. the four americans hijacked on a yacht by pirates near somalia have been -- have all been killed. we all know that a u.s. navy ship had been shadowing the yacht. negotiations were underway, when gunshots were heard. navy personnel boarded the yacht and found the four americans dead. the other top story we're following for you this morning,

the devastation in new knee zand, an earthquake hit at 1:00 a.m. new zealand time. it killed at least 65 people. more may be trapped in the rubble. the new zealand is now trying to respond to this earthquake. in fact we've heard in the -- later today, cabinet members will hold a meeting and that's when cabinet members offer help to search for these missing people. kraig debro is live with the only reporter in the bay area to talk to the man who has family there in new zealand. kraig? >> reporter: right behind me, we came to talk to seismologists about the new

zealand earthquake. what happened in new zealand could and has happened here. >> everybody is gonna be affected. it's gonna be awful. >> reporter: profess mcgee grew up in new zealand. he said if you add up the dead and injured, the quake will touch many lives. mckee spent the last few hours glued to his laptop looking and listening for friends he cannot confirm or say. he reached his family close to midnight, they are okay. the quake could hardly have come at a worst time. >> there was already massive problems from the earthquake from last december. but that happened -- i forget now exact dli what time but -- exactly what time but they say about 3:00 in the morning. everybody was at home and in bed and quite safe. officials say the number of the dead will likely rise.

the 6.3 quake struck during lunchtime, about ten to 1:00. falling debris made it dangerous to try to pull trapped people from the wreckage. mckee says he's okay but his not being there worthers him -- bothers him. >> there's a certain level of guilt not being there. my father had a heart attack last july. i'm actually planning to go back in april. >> reporter: now, lester says his family was not affected by the last earthquake they had there in september. he did tell me that he heard fromunders just hours before this most recent earthquake struck. an those friends had just had their house condemned from from the last earthquake. he has no word on what happened to their home in this earthquake. we're gonna try to get in the

-- >> there will be a candlelight vigil for the two teens tomorrow night. it's scheduled for 6:00 p.m. on wednesday at shell ridge open space in walnut creek. that's where the two boys often went hiking. 7:33. just about 90 minutes ago, a new report about home prices in december came out. the new case schiller report says the selling prices for homes in the 20 largest real estate markets were down 1%. now, this is the fifth month in a row the overall prices have been down. only washington, d.c. showed a slight price increase. prices in 11 of those markets, including seattle, new york, las vegas and detroit hit their lowest levels since the housing bust in 2006. well, dozens of san jose grocery workers who lost this jobs are now suing a supermarket chain and its parent company. more than 50 men and women at

the su vianda supermarket chain found themselves south of a job when they went bankrupt. there will be a news conference at 11:00 this morning. the city of san jose wants to rekoch $500,000 in tax pay -- recover $500,000 in tax money that it invested in 2008. mountain view could become the only city in santa clara county to specifically allow medical marijuana dispensaries. the city will discuss the proposal at today's meeting but the vote could be delayed. the dispensaries would be required to operate as nonprofit and would have to be a certain distance where certain people gather. police were responded to home as a -- to homes at a break-in. instead of burglars, they found a stash of marijuana worth

$400,000 and more than 1500 pot plants. police say no official medical marijuana documents were found in the home. so they arrested the man who lives there. 7:35. the city of east palo alto says they have seen a huge drop in crime in the past five years. the city's police chief will be holding a community meeting tonight to talk about the reasons why and he will talk about a new program that will bring gang members face to face with the police. that's march 1st. that will be where identified gang members will be offered a choice -- stop the violence and get some help or been the primary of law enforcement. tonight's meeting is at 6:00 p.m. a judge will hear more testimony about oakland's controversial plan to crack down on violent street gang. that judge is deciding whether to prevent suspected gang members from hanging out together in the city's fruitvale neighborhood.

there will also be a 10:00 p.m. curfew imposed. now, the oakland city attorney says the similar plan has reduced well in reducing gang violence in north oakland but the critics of the plan say it promotes racial profiling. foster city will consider toughening regulations at some of the -- at some of the city's dog parks. there is a three-dog limit for visitors. many have been ignoring that rule. park and rec officials have been hoping that people would enforce things themselves. but since that hasn't happened, they will consider an amendment that could mean fines up to $400. we talked to one dog owner. he's what he had to say. >> i think some people may be overreacting to it. i think it's perfectly fine. >> the three-dog limit rule applies to six of the city's parks and is enforced between 5:00 and 8:00 a.m. on weekdays and 5:00 and 9:00

a new threat this morning from wisconsin's governor. he says state employees could start getting layoff notices as early as next week if his bill eliminating most collective bargaining rights is not passed soon. he did not say which workers would be targeted but that the layoffs would not take effect immediately. wisconsin is facing a projected 3.6 billion budget short fall. there have been eight days of massive protests over the possible loss of collective bargaining. senate democrats left the state last week. that means the senate doesn't have a quorum. so no vote can be taken on a measure. governor walker says he will not negotiate. >> the local and state unions and teachers have agreed to give governor walker every single penny he's asked for to balance the budget.

he should take this offer so we can come back to madison today and vote on it. >> if you don't make the changes in this bill, you are making it difficult for the years to come. >> three republicans would need to join the democrats to block the bill. governor walker says not passing the bill by friday would make deeper cuts necessary. here in the bay area, hundreds of workers say they are encouraged by what's happening. pam cook has more from the newsroom. >> good morning. concord's mount diablo school board employees will start today rallying. the district is accused of using the need for budget cuts to get rid of collective bargaining over benefits, hours

and wages. at 10:00 this morning, there will be a joint news conference where representatives from the unions and the district are both expected to speak. now, the employees say they have offered proposals that -- proposals that would save the district millions of dollars but that further cuts would affect the children's education. the district says current budget cuts leave them no choice. union workers will hold a candlelight vigil on the west steps of the capitol building in sacramento. that will be in support of those employees in wisconsin. the event is part of a call for a nationwide demonstration and support of collective bargaining rights, where nurses and firefighters are asked to join in as well. they say without those rights they don't have the power to negotiate with large cities' school district. across the board school

them of their purse. >> i try to stay aware. it's heightened definitely. i try to stay aware. >> reporter: in most of the case the the shoppers have been coming from this safeway on redwood road but one lieutenant says there may be other instances of robbers following people from other stores in oakland. they don't want people who shop elsewhere to get a false sense of security. they want everyone to be aware. the one thing that's good, they don't have reports of it robber or robbers using any weapons. back to you. >> thank you. it's 6 minutes after 8:00. as we mentioned at the top of the hour, four americans were found dead on their yacht off the coast of -- the coast of

soma yaw -- somalia. sandra endo has more. there's reports that the four americans were killed right when there were negotiations starting for their release, is that right? >> reporter: that's right, tori. for days now. u.s. officials say they were in negotiations with somali pirates i would hijacked this yacht on friday. in the midst of all of this they responded to gunfire they heard on the yacht. that's when they found out these fatal results this morning. >> reporter: their journey started out as a group yacht fewer in thailand. but when four americans left mumbai, india, they took a different path. pirates hijacked the yacht. monday, u.s. officials say a u.s. navy ship was trailing the yacht and negotiates were -- negotiations were underway to free the four american. tuesday, u.s. forces responded to gunfire and found all four

hostages shot dead. >> they were two pie rights that were dead on board the vessel when they boarded it. as they were clearing it, there were two more pirates dilled -- killed in the clearing process by the boarding team. friends say the couple had looked forward to their trip. >> scott and i had lunch together at the end of the laugh year -- at the end of last year in marina del ray and we discussed the process someone would go through to make the decision to go through this area. what he had said was he had a strong desire to sail with his boat around the world. shane was having a very hard time with the heat in the tropics and wanted to get to the european waters and see europe by boat. this is a very common route for european voters -- boaters to take as a last leg to get home. >> reporter: u.s. officials say

in all, 19 somali pirates were involved in the hijacking of the vessel. besides the four dead, 15 others are in custody. we should mention that phyllis mckay's mother and niece is from the bay area. again, devastating news to report, four hostages, all americans shot dead -- dead by their pirates. the officials had a briefing to talk about the details about how this unfolded but not the news they wanted to hear this morning. >> remind us why there's so much activity of piracy in this part of the world? >> reporter: well, the coast of soma yaw is known -- somalia is known for a lot of activity. somalia is a country that has not really seen official leadership so that's why poverty and piracy is running

shortly after 11:00, the couple came out of the house and peacefully grave up. to -- gave up. no one was hurt. 8:18. a decision by the san jose police department to redefine racial profile something getting the thumbs up from minority community leaders. "the mercury news" says the department will consider it a violation for a police officer to show bias any time during an encounter with the public. it used to be didded -- considered a violation only if they initiated contact because of racial bias. this change comes after chris moore took over at police chief, which in the past has been accused of racial profiling. ten oakland police officers are on -- are back on the job. oakland mayor jean quan announced earlier this month that she was retire -- rehiring ten of the laid-off officers bayed on seniority.

more travel delays in the midwest thanks to the snow and ice. at minneapolis-st. paul, airport, 45 minutes delays for arriving and departing flights that. there's already a backlog of passengers after hundreds of flights had to be cancelled yesterday. minneapolis is suffering. they are digging out after more than a foot of snow fell. chicago, detroit, philadelphia, also reporting travel delays. sfo is telling us koig arrivals are delayed up to 30 minutes. >> security cameras inside clap churred ad's roof collapse right there. that's the food 4 less store in

i live tw or three ice -- i two or three miles from the hayward fault which is part of the andreas fault zone. >> reporter: now, doing some rich in the earthquakes in the area, we found that since about:59 p.m. on monday, that's about 50 minutes after the new zealand quake, there have been five earthquakes that we've found that have been a 4.7 or higher, 4.7 to 5.7, in that same region. so, a volcano island in japan. a place in japan, australia, there was a .7 in the northern territory. and a sixth one in the phillippines as well that measured about 5.3. i want to speak with robert erhaimer about that and what that means for us. as a matter of fact, there was

we're calling for in this bill, you are making it very difficult for local governments in the years to come. >> governor walker says not passing the bill by this friday would make deeper cuts necessary. tonight, the the mount diablo school board will consider to close yet another school. silver bood and west -- sill rememberwood and westwood in concord are reportedly at risk. the school board reported to close two schools to save some money. some district employees say they will stage a rally. they say they've been encouraged by the worker protests in wisconsin and are hoping to call attention to stalled contract negotiations. >> union workers ear will be holding a candlelight vigil on the west steps of the capitol building in support of those employees in wisconsin tonight. this is part of a nationwide call to demonstrate in support
