a restaurant owner in san jose is going to wake up to an unpleasant surprise. we're going to show you what happened too his business and what investigators are saying. a man ant underway for an inmate who escaped from jail. the surprising way he made his get away. the morning news continues. good morning to you. welcome to thursday march 3rd. i'm dave clark. good morning. i'm pam cook. let's go to steve paulson for a look at weather today. how does it look today, steve? okay, pam. better than yesterday. few light showers mainly on the peninsula over towards the south bay and along the san

mateo coast. the good news is it's going to be rather mild. we have temperatures in the 50s now. end up with a mixed bag of sun, clouds, high low to mid-60s for some. here's sal. traffic moves well in marin county if you're heading south trying to get to the 580 interchange no major problems. also the morning commute looks good on southbound 101 heading down to the golden gate bridge. now let's go back to the desk. we're following overnight news in san jose where a fire broke out a couple of hours ago at a trip mall. ktvu is live at the scene where some of those damaged businesses are being boarded up. good morning. >> reporter: good morning, dave. that's right. if you take a look right here there are workers here and they're cutting up boards to secure the business here. only one business was effected. you can see they have brooms still here on the scene because they were sweeping up broken glass. if you take a look inside it's

just a mess. lots and lots of smoke damage here to the ceiling and all throughout the building. the fire broke out just before 1:30 a.m. at the restaurant on story road. firefighters were on another call nearby but they were able to knock it down in about an hour and a half. and it did not spread to the other businesses. investigators already believe they have a cause for this even though they're still looking into it. but they don't think it's suspicious. they think the cause is electrical and that it happened somewhere in the back of the restaurant where there was a storage unit. >> there's heavy smoke damage to the restaurant. it will not be able to open today or any time soon. they pretty much are out of business for now because of the heavy fire and smoke and water damage. >> reporter: fire officials tell us there is a total of

$200,000 in damage here. firefighters tried to contact the owner of the restaurant. they called all the phone numbers but they have been unsuccessful in contacting him. so it's probably going to be a very unpleasant surprise to him when he drives up here -- he orache drives up here this morning and takes a look. the doors will be chained up. there will be boards up here probably within the next half an hour. not going to be very happy at all with this. reporting live from san jose, ktvu channel 2. police have arrested a man they say gained access to an underground cal trans tunnel at the bay bridge toll plaza. chp says he was arrested about 8:00 last night following a routine traffic stop. but when officers asked the man to get out of his car, he apparently dropped a semi- automatic gun and ran towards a toll booth. then he ran into a tunnel used to enter the cal trans administration building. the building was surrounded and

the man was found hiding under a forklift. well, alameda county sheriff deputies want to know how an inmate at the jail in dublin managed to walk out of jail. 21-year-old was brought back to the jail from court tuesday night but somehow ended up in the inmate release room and was let go. he's still missing this morning. he was in jail on suspicion of car theft. time now 6:04. this morning albany police are searching for a missing teenager who may be armed. 16-year-old john scott was reported missing yesterday morning. his father says a gun and ammunition are also missing from their home. albany schools were locked down just as a precaution because school officials were concerned about this run away teenager. police believe he's angry about some recent problems. protesters have left the uc berkeley campus after attempting to take over a building. during yesterday's day of action police say about 50 protesters gathered outside

wheeler hall. police say when it started getting dark, demonstrators moved inside. but when it was time for the building to close, a small group of protesters locked arms and formed a circle in the lobby. >> the building's closed to public. and we've given them opportunity to voluntarily leave the building and they refuse to do so. >> police in riot gear were brought in to get the demonstrators to leave the building. police say 17 people were arrested and cited for trespassing. no injuries are reported though. now yesterday's national day of action protests were a call by students to stop planned cuts to education. time now 6:06. san francisco police taking action now in response to a surge in gang violence in the mission district. latest violent incident happened yesterday broad daylight 24th and harrison. investigators say a gunman fired at least 15 shots at a rival gang member standing on the sidewalk. now one man was hurt. and a stray bullet pierced a

nearby house. this was the fourth incident of gang violence in the mission area since saturday. that triggered an emergency meeting last night. >> we're going to make a concerted effort to let the gang members know that you're involved in gang activity or narcotic activity in the city we're not going to tolerate it. >> well, police will immediately start increasing their patrols in the mission district. police officers are also meeting with political and community leaders to try to find some ways to stop this violence. the work continues this morning on the new bay bridge tower. take you live little look at the bridge there this morning where the construction is taking place. cal trans wants to have four sections of the new tower in place by tomorrow. the rainy weather and winds have made that project a bit challenging but cal trans tells us the work should be done in time. very impressive. >> yeah. >> time now 6:07. sal's watching our commute and highway 24. everything else, sal. that's right. we are looking at traffic

that's getting a little busier now that we're getting to the start of the commute for a lot of people on highway 24 it looks pretty good here through lafayette. again, it is better today than it was because of the weather being just a bit better for driving. getting up to the oakland area it looks good. this is a look at the bay bridge toll plaza at about 6:15 or so they turn on the metering lights and the traffic is going to be okay. i want to mention a crash that just doesn't go away. this is 880 northbound. see the red triangle there at coleman avenue. car went off the roadway. problem is it damaged a fence and also have to cut down some trees that were damaged because they are now dangerous. they're waiting for the crews to arrive. it may be a little bit slow traffic in that area. so give yourself time especially if you're going to the airport this morning. 6:08. let's go to steve. sal, thank you, sir. we have partly cloudy day today. mild conditions, few light showers. waiting for the weekend when this mess right there will start to get closer. tomorrow looks okay and temperatures continue to warm up a little bit.

for a few yesterday there was hardly any rain. south bay, peninsula. for others north bay marin county north it was not too bad. san raphael 1.92. sonoma county airport almost an inch and a half. san francisco a quarter inch and sfo concord .12. hardly any. little bit of rain trying to work its way in towards san mateo, santa cruz mountains and south bay. not much there. there are occasional showers and everything continues to roll in from the west- southwest. our pattern gone from really cold on the mild side. we don't expect this to stop any time soon. partly to mostly sunny today. scattered showers. tomorrow's a dry forecast. mostly sunny and a little warmer. a lot of 40s and even mid-ooze. hayward says 54. 45 santa rosa and 48 livermore. temperatures trying to cool if you get any breaks in the clouds and today occasional showers really what we're looking for next couple of days there's a quieter pattern. but by the weekend saturday rain moves in to the north baby sunday for everybody. and it looks to be one of those patterns where the north bay takes the bulk of the

well, good morning to you. welcome back. time now 6:12. this is the final day of those federal hearings investigating the san bruno pipeline explosion. it has been an eye opening two days of testimony already. ktvu's allison burns has been covering the hearings for us from washington d.c. what can we expect today, allison? >> reporter: dave, making sure it doesn't happen again. today investigators are looking at new pipeline technologies. how leaks are detected, integrity protected. pipeline regulators and pg&e are under the microscope this

week for how pipelines are maintained and inspected. public safety advocates say the agencies responsible for pipeline safety are under funded. they also caution against possible conflicts of interest. >> we just need to make sure we're giving them the resources to actually do their jobs. a lot of it is resources and whether they get too cozy with the industry they regulate sometimes. >> reporter: san bruno's fire chief testified yesterday he did not know there was a pipeline until it ruptured. investigators say pg&e needs to do a better job informing the public of pipeline locations and risks. and first responders need to seek out the information too. now we've also learned from documents released this week that a pg&e inspector expressed concern about a sewage line installed just inches from the gas pipeline. the installation in 2008 involved intense ground shaking. and investigators want to know if that compromised the gas pipeline in any way. reporting live from washington d.c., allison burns, ktvu

channel 2 news. all right. we'll be following today's hearing throughout the morning for you. you can get the latest information on our channel 2 website at ktvu.com. just look for the gas line explosion tab for all of your coverage. new reports from libya of more air strikes today by forces loyal to gadafi against rebel forces. reportedly the target is the same as yesterday. the oil town where rebels have been able to fight off the government forces so far. some rebel leaders are asking for international help to impose a no-fly zone over libya. but u.s. defense secretary robert gates is hesitant saying that it amounts to an act of war because it would require the u.s. to attack libya and destroy its air defenses. a dutch ministry spokesman says three dutch marines are being held in libya after they were captured by forces loyal to gadafi while trying to evacuate dutch workers.

a spokesperson says intense negotiations are underway with the libya government to secure the marines' release. time now 6:15. also word the president of yemen has agreed to a plan now from opposition leaders that includes him stepping down by the end of the year. now for weeks now thousands of protesters have been calling for the president who's been in power for more than 30 years to step down immediately. it's not clear if that plan to allow the president to stay in power for nine more months will actually be supported by all of the protesters. the army has filed almost two dozen new charges against the army private suspected of turning over tens of thousands of classified documents to wikileaks. the new charges against private first class bradley manning include aiding the enemy. that's a capital offense. but prosecutors say they won't seek the death penalty. private manning has # has been held in a military jail since july. time now 6:16. a scientist quoted in the new

york times making it tough this morning for the parents who believe in the five second rule. there are some parents who think if you pick up something off the ground within five seconds like a pacifier it's not really dirty enough because of germs on the ground. but an infectious disease scientist in new york says that's not true. he says if it's contaminated, it's contaminated immediately. all right. 6:16. sal told us he's checking on highway 4. what's going on there, sal? it is doing okay, pam, as you're driving up to the willow pass grade. in fact the entire commute seems to be okay. better than it was yesterday as we look at a live picture here of our live camera network highway 4 is one of these cameras here. in antioch it's going to be a bit slow as you drive up to the pittsburgh area. here in bay point it has evened out. moving along and taking a look at 101 san raphael. remember yesterday we had that horrible accident with the truck.

horrible for the commute anyway. this morning things are much better driving from novato to san raphael. on the peninsula 101 traffic looks good. burling gap, 101, 2 0 also looking good. across the bay hayward, union city fremont that traffic looking very nice. 6:17. let's go to steve. thank you, sir. 40s in the north bay but areas of fog. san raphael reporting fog. napa airport and also sonoma county airport, santa rosa as well. towards the south and especially on the peninsula and south bay some light showers and partly to mostly cloudy skies. there are a few breaks in the clouds. looks like things are starting to thicken on the north coast towards eureka and crescent city. not a lot. again, a much quieter day than yesterday. stretching across the san mateo coast and then over towards santa clara valley very light rain. 40s and 50s. 50s for mountain view and also for hayward. and everything will be kind of

a partly sunny, partly cloudy day few light showers on friday the system to the left of the screen will work its way in by the weekend. sun and clouds showers a little warmer today. 40 toss few low 50s. won't take much to get into the 50s to upper 50s and low to mid- 60s. probably more towards the santa clara valley with some 62, 63 to 64-degree readings. average on the temps took a long time to get there but we're there now. most sunnon friday. everybody gets in on the rain sunday and showers monday. time now just turning 6:19. a critical deadline is tonight. this could be bad news for both 9er and raider fans. ktvu's kraig debro live in san francisco now getting reaction about a possible pro-football lockout. good morning, kraig. >> reporter: good morning, dave. i just got word that commissioner roger goodell and the nfl's negotiating team has arrived at a federal mediator's headquarters in washington d.c.15 hours ahead of the debt

line. of course just because that's happening in d.c. they're talking about a lockout doesn't mean fans of a popular radio show are even thinking about not seeing a football until at least september. that's when football starts. spring training and whether or not barry will be a pitcher on the giants later this year are basically higher on the caller list. talking to owners and players in virginia broke off yesterday but the two sides are scheduled to resume talks today. i just told you the nfl's negotiating team has arrived. the owners want to double their share in the league revenue to $2 billion. that would require players to take a pay cut of 18%. the lockout which would begin tonight at midnight would probably hurt the 49ers according to experts more than it would hurt the raiders. and one of the reasons for that is according to paul of the show is because the 49ers just got a new coach, they're not settled on a quarterback whereas the raiders even though

they have a new coach as well they had an offense that began to click last year. they won a lot of games and scored a lot of points. there's some continuity there whereas with the 49ers they're basically starting all over again. the lockout might not happen tonight. it's a right that the league has if they run out of collective bargaining agreement which expires tonight at midnight the players can counter by decertifying the union which would not prevent the strike but would prevent owners from locking out players. live in san francisco, kraig debro, ktvu channel 2 news. two bay area businesses top the new list of fortune magazine's most respected companies. apple takes the top honors. google is second. hat iowa, johnson and johnson and amazon round out the top five. several other bay area companies are also on the list. wells fargo and e bay all in the top 50 of fortune magazine's most admired companies. this morning the world's largest beer maker reports a

24% drop in fourth quarter profits. anheuser-busch inbev profits hit $968 million but that is down from nearly $1.3 billion a year earlier. one bright spot under all the circumstances u.s. budweiser plan posted a 1.7% increase in sales and that's the first time bud sales have been up in about 20 years. time now 6:21. a ktvu investigation there are government agencies that purposely have overlapping functions. this may be costing taxpayers millions of dollars. could smoking one joint keep you from getting a job? the courts just ruled on whether an employer can refuse to hire someone who has ever tested positive for marijuana. good morning southbound 101, 280 traffic also looks good. more about the morning commute straight ahead.

change the rules about how weather towers are built following the death of a pilot who hit one of them and died in the delta. ntsb investigators say 58-year- old agricultural pilot steven allen probably never saw the 198-foot tall tower while he was seeding a field back in january. investigators say those towers are narrow, they're not marked and they're colored gray which make them almost invisible in certain weather conditions. a one strike rule for people who have ever tested positive for marijuana or other drugs was upheld by a san francisco federal appeals court. ruled that the longshoreman's union one strike rule does not discriminate against rehabilitated addicts. the ruling came as a result of a lawsuit filed by a man who applied for a 2004 longshoreman's job in long beach. he says he didn't get the job because of a drug test that he failed in 1997. well, one of governor jerry brown's ideas for saving the

state money is to consolidate some of the hundreds of so- called special districts across the state. now in the nine county bay area there are almost 400 of these special districts. in marin county alone there are 30 special sanitary districts. each with a budget, executive director, a staff, offices and vehicles. >> if you are redundant, it's unnecessary expense, then you have to compromise and consolidate. i think we can consolidate a number of special districts. >> people say that we're the worst of it and those people have an agenda. i don't know what their agenda is. >> some analysts say one consequence of the 30 separate sewage districts in marin is the county's theories of raw sewage spills into the san francisco bay. with so much fragmentation no one agency is in charge and has not been able to fix the pipes that keep dumping sewage into the bay. now, it's not just marin county. contra costa apparently has the most special districts in the

to put a stop to it. latest shooting happened yesterday on 24th and harrison. it was right about noon. ktvu's jade hernandez is in the city to tell us about the emergency police had and what they're doing and saying about the problem. >> reporter: that's right. police are saying yesterday's shooting happened seven blocks from the spot where we're standing this morning had to do with pay back for someone messing with this memorial here. the memorial of a known gang member. this retaliation triggered a string of shootings. the report at noon is going to survive. a gunman fired 15 rounds at a rival gang member standing on the sidewalk at 24th and harrison. bullets struck the man and a nearby home. the member hit by a bullet was the fourth victim. we drove by the area this morning. it was quiet. no signs of any violence. that didn't stop san francisco police chief from meeting with the head of the gang task

force. san francisco supervisor and other city leaders. it was an emergency meeting. an outreach director told us that the gang war is the result for reducing intervention and several years of peace between rival groups. the police department has stepped up their controls. >> i'm very concerned about the shootings. that's why i'm putting mission station, crime suppression units in mission the next couple of weeks and we're going to make a concerted effort to let the gang members know that you're involved in gang activity or narcotic activity in the city we're not going to tolerate it and we're going to come out and find you and you're going to go to jail. >> reporter: we've contacted the police department this morning. and we have not heard back from the spokesman. but we're trying to find out what the department also plans to do besides amp up their patrols. we also understand a peace rally is being scheduled by people concerned in the community about the recent string of shootings. reporting live, jade hernandez, ktvu channel 2 news. new charges may be pending against the one time commander

of the contra costa narcotics task force. norman is being investigated on suspicion of helping to conduct the false arrest and kidnapping of a teenager. investigators believe he took drugs from the teenager and pretended to arrest him to scare him straight. he's also accused of selling drugs that were stolen from the county evidence room. a videotape is now at the center of the investigation targeting a half a dozen san francisco police narcotics officers. the city's public defender's office has released a videotape that it says proves they illegally searched two south of market apartments. there are also allegations that some of those officers falsified police reports and committed perjury on the witness stand. >> without knocking or announcing themselves, burst into the room all four officers. and then later lied in a police report. >> clearly there's something

wrong that goes to the very heart of the criminal justice system. >> now both of the police department and the d.a.'s office are looking into these allegations. but the public defender's office are calling for an outside investigation. time now 6:34. there's a warning this morning about a health inspection scam. fake inspectors have been calling restaurants setting up fake inspections. first they give restaurant owners a special code. then the owners get an automated phone call prompting them to enter that code. once they do an account with the national auction service is created. now police say this account leads to even more fraudulent activity that can be linked to the restaurant. health officials are warning this morning that real inspectors never set up inspections in advance. an eighth grade math teacher remains on paid leave after one of his students called 911 during class.

>> my teacher he's going crazy. knocked over a table and just screaming at us. he's going crazy. >> police say that student was apparently scared when her teacher rattled the table and used profanity. she left the classroom and called police in the bathroom. the teacher was apparently upset because the students didn't know the answer to a problem. >> when you have a situation where a student makes an allegation that they feel threatened, then we feel a strong obligation to investigate what are the actual facts of that case. >> well, when police officers arrived there at the school they say the teacher and his class were calm. investigators say none of the other students appeared to be bothered by what the teacher did. now the redwood city school district is investigating that incident. the san jose school that was the target of arsonists last year has become the victim of another crime. two former officers of a parent-

teacher group are accused of embezzling more than $50,000 from trace elementary school. ann was arrested at the school yesterday. officials say vanessa is still at large and may now be in southern california. the two are accused of using the money to buy clothing and take trips among other things. now last july a fire at trace elementary school cost more than $10 million in damages. two teenagers were charged with arson in that part of the case. time now just turning 6:37. this morning cal train will be holding a public hearing on how to reduce a $30 million budget gap. we're looking live now at burl game right now. some of the ideas being considered are eliminating weekend service, reducing the number of trains it runs on weekdays, raising fares and possibly closing as many as seven stations. that hearing begins at 10:00 a.m. at the cal train offices in san carlos. a lot of people watching for that. >> i know. all right. let's check in with sal for the rest of the commute.

sal. all right. pam and dave, right now traffic looks pretty good around the bay area especially if you're tuning in and comparing it to yesterday's commute which was not that great. westbound 237 though looks like we've had some showers there in the last few minutes. steve did indeed say we might have some showers in the morning drive. traffic is looking pretty good here though. little bit of slowing but you don't have to worry about that too much. this is a look at 880 north and southbound. the traffic is moving along very nicely. and it's not nearly as windy today. in fact no wind advisories for any of the bay area bridges or causeways. move along to the toll plaza. we're getting a bit of a crowd here which i guess is not unusual. westbound traffic coming into san francisco once on the bridge looks okay. now let's go to steve. sal, thank you. we have some light rain around but here's your day. some breaks in the clouds. some low clouds. some fog and also light showers. looks like most want to take aim around san mateo and santa cruz coastline and over towards san jose and santa clara

valley. we will have little bit quieter day than we had yesterday. and tomorrow looks even better. things start to change again as we get towards the weekend. mix of sun and clouds today. a few showers. it's on the mild side. might be cooler in the morning. in the afternoon sun breaks get into the low to mid-60s. patchy fog will be back. a lot of moisture in the air. tonight and tomorrow see fog forms even though it's late in the season. mostly sunny on friday. clouds increase on saturday. looks like rain for the north bay. saturday night and rain returns for everyone on sunday but heaviest amounts so far want to take aim towards the north bay just like yesterday. you can see how everything's coming around that big low in the [ sounds of gulf of alaska. far cry from what we had in february when it was coming straight down out of the north. yesterday from about marin county north there was a lot of rain. in fact san raphael two inches. kentfield 1.85. sonoma county airport almost an inch and a half. then san francisco quarter of an inch. sfo concord .12.

down towards parts of the peninsula and south bay only trace amounts. watch right there that rain over has since moved off. occasional showers zipping in under the west-southwest direction. jet stream still funneling in some moisture. scattered showers today. partly to mostly sunny. dry forecast for friday and slightly warmer. look at the temps. 40s and 50s. cooler to the north, warmer towards the cloud cover and rain especially towards the south bay. we're waiting for that system on the weekend and there it is. we have a couple days to fine tune that. but also signs are pointing towards heaviest rain being on the weekend in the north again just like yesterday and temperatures will stay very, very mild. 44 to 54. fog, clouds, some breaks in the clouds. few showers. partly cloudy, partly sunny, few showers by noon. overall more clouds than anything else. 58 to 65 today. some low to mid-60s on these temperatures especially towards the east bay, peninsula and south bay. temperatures near average for the first time in a long time. mostly sunny friday. clouds increase friday. rain to the north and rain for

good morning to you. welcome back. here's a quick look at some of the top stories we're following right now at 6:43 strip mall businesses being boarded up in san jose after an early morning fire. investigators are still trying to figure out what started that fire. this morning alameda county sheriff deputies are searching for this inmate who escaped from jail in dublin. the 21-year-old somehow ended up in the inmate release room. he was allowed to go by mistake tuesday night. and today is the third and final day of that hearing in washington d.c. investigating the san bruno pipeline explosion. today's testimony will focus on pipeline technology and what can be done to prevent this kind of explosion that killed eight people in san bruno last

september from happening again. crews in new zealand have given up hope of finding anymore survivors from last week's 6.3 earthquake. they are now working to recover bodies from the rubble. 161 bodies have already been recovered but police say the final death toll will likely be as high as 240. no one has been found alive since last wednesday, the day after that big quake. time now 6:44. today mexican president meets president obama at the white house. now the meeting between the two leaders comes at a pretty tense time between our two countries. just three weeks ago a u.s. immigrations and customs enforcement agent was killed. another one wounded. the suspects drug gunmen in mexico. that agent was the first u.s. law enforcement official to be killed in the line of duty in mexico in more than 20 years. a lead police investigator in oakland agrees that identified gang members need restrictions. he testified at the men's

movements that they need to be restrictive within a two square mile zone in the fruit vale neighborhood because he says they claim the whole area. that injunction's being debated would make it illegal for the 40 suspected gang members to gather in a large part of the fruit vale neighborhood. now critics say that injunction could lead to racial profiling. this morning police are saying a 13-year-old girl reported missing was actually hiding from her family. the sheriff's department says the girl was found safe in a hotel yesterday afternoon. police say she was angry about an arranged marriage that had been set up in pakistan. now she and her three siblings are in protective custody. so far no arrests have been made. cases of sexually transmitted diseases are on the rise in san francisco. health officials say preliminary reports show that gonorrhea and class mid ya cases are up 10% and that syphilis cases jumped 27%. they say it could be a sign of

the commute is you know i think it's much better today. we do have a crash though northbound 101 car spun out and a little bit of slow traffic coming up there. watch for it if you're driving on 101 soon through redwood city and palo alto near the wood side road turn off as well. let's move along and take a look at live pictures westbound bay bridge. that is backing up to about the middle of the parking lot and those metering lights are now on at the bay bridge. if you're in san francisco getting across there northbound 101 looks good. so does southbound 101 and the extension is clear. 6:48. let's go to steve. thank you, sal. we have a few breaks in the clouds but also some showers especially towards peninsula, south bay. then some fog towards the north bay. but overall we're in the 40s and 50s. and we will have some partly sunny, partly cloudy skies. can't get rid of those showers completely. but nothing like yesterday. pretty good showers on the go up towards the north coast. but for us there's a couple

breaks in the clouds but the showers highway 237 sal showed that last traffic you can see right there little bit of rain. still more coming in on the san mateo santa cruz coastline and heading up towards the mountains. not a lot but a little there to wet the windshield or streets for a while. everything continues to roll in off the west-southwest. partly to mostly sunny partly cloudy today with scattered showers. tomorrow looks good but deal with fog in the morning. little late in the season but still enough available moisture with 40s and 50s. a lot more milder air mass over us right now. but 54 hayward and mountain view. makes sense with the cloud and rain that way. sun and clouds. few showers around more towards peninsula, south bay and east bay than north bay. lit 8 warmer just a little any sunshine will help get some upper 50s and low 60s for others. today calming down a bit more so on friday after patchy fog in the morning and then warmer as well. we cloud it up saturday rain in the north bay looks like it

result in an 18% pay cut for them. the lockout which would begin tonight at midnight would probably hurt according to the experts the 49ers more than the raiders. >> the raiders are going to enjoy a little bit of continuity and continuing on in a direction that was beginning to work for them last year whereas 9ers in my mind have to go back to square one and rebuild again. >> reporter: lockout is a right management has under labor law. they could shut down businessings when the collective bargains agreement expires. employees -- employers can call a strike and that's what happened two other times in 1982 and in 1987. players could prevent a lockout by decertifying the union. but that's later this year. i'm going to try to get more fan reaction when it comes to football and doing that. reporting live, kraig debro, ktvu channel 2 news. retail sales are better than expected. an average increase of about 3.5% last month. but this morning limited brands

which includes victoria's secret and bath and body works both reported a 12% increase in sales. macy's and teen focused retailers wet seal also ahead of prediction. target though had an increase of less than 2%. all right. let's check in on wall street. take a look at this. dow jones live look at the big board up almost 160 points. retail sales numbers definitely helping things out. but the rally started earlier overnight in asia and then this morning in europe on some positive thoughts about the jobs reports. we have the unemployment, the weekly numbers coming in this morning. and then tomorrow we have the monthly numbers. there's some optimism about those reports and then we have the retailers coming in with pretty good numbers. that's helping wall street today. one of the founders of twitter says the miniblog plans

welcome back. time now 6:55. a vallejo employee recovering this morning after being stabbed on the job. this happened tuesday night while the victim was dealing with three troublemakers at the restaurant. now he had asked them to leave the restaurant but one of the men pulled out a knife and stabbed that worker several times. the injuries are not life threatening. so far no arrests have been made. police say they've made their third arrest now using technology from recently installed security cameras. police say they arrested a suspect in a car theft tuesday after the car's license plate image was detected by one of those cameras. a 27-year-old man from san

francisco was stopped just west of downtown after the car he was driving triggered an alert. it was photographed leaving town because that car had just been reported stolen. uc berkeley scientists say the current rate becoming extinct close to what happened when the dinosaurs disappeared. if the number of species disappearing continues at this pace, 75% of all of the known types of animals and plants will be gone in 300 years. now that's considered a very short time in geologic terms. well, the eastern cougar is officially extinct. yesterday the u.s. fish and wildlife service confirmed the belief that the eastern cougar has been wiped out by man. they say there's no evidence of cougar and probably has been extinct since the 1930s. their decision paves the way for the eastern cougar to be removed from the endangered species list. a little stray puppy in oklahoma has triggered an adoption frenzy after surviving
