up in just a little bit. the scales of justice tipped in favor of the defendants tonight. robert handa is live at the courthouse in san jose. robert. >> reporter: gasia, it was a very emotional day here at the courthouse and for some the end of a four year public nightmare. the woman dubbed jane doe cried outside the courthouse after a jury decided not to award her any damages in the rape trial. >> we're very proud of our client. she's a brave person, thank you. >> reporter: 17-year-old jane doe claimed she was gang raped while drunk by nine men. eight from the dianza college baseball team. she sued after then dolores carl decided there wasn't enough evidence for a criminal

trial and triggered ongoing community protests. only two players ended up in court, others were dropped or turned legal matters over to insurance company: one parent blamed the court system and jane doe. >> she brought this all on herself then cried wolf. >> reporter: the attorney for the other player agreed. >> we didn't know if we would end up with a sympathetic background. >> reporter: one descending juror said -- >> took advantage of a very young, young girl. and in that case no, justice wasn't served. >> reporter: one father said everyone though his son was droped from the lawsuit, the family needed this verdict. >> and we always knew that he was completely innocent. and waited for the day that he would be completely exonerated. >> reporter: in a statement issued this afternoon, district

attorney jeff rosen said he would make his own decision about criminal trial within the next six months. live in san jose, robert handa ktvu news. the legal battle here is not over. it looks like jane doe is now the one who may have to pay thousands of dollars. >> we have a sizable bill that we will be presenting that she'll have to pay for. >> reporter: attorneys for the now cleared defendants in this case say they are going to file what is called a memoranda of cost. the attorneys say after four years in court, that will be in the ballpark of $125,000. in a surprised move, convicted sex offender phillip garrdio pleaded not guilty. garrido was expected to plead guilty instead his attorney set a motion to set aside the grand

jury inindictment for her client. garrido's codefendant, his wife nancy garrido also entered a not guilty plea. the two are also accused of holding dugard hostage for 18 years. the next hearing has been scheduled for may fifth. -- may 5th. ktvu's rob roth with frustrated officers who are counting down until a new high tech system is put in place. >> reporter: many officers tell us they never know when they get into those cars whether the police radios will actually work. >> it's a lifeline for us. it's critically important that it's operational. >> reporter: just before 8:00 this morning it happened again. the radio systems to the police

and fire departments crashed and stayed crashed for more than 90 minutes. officers could not communicate with dispatchers or each other. the fire department used a back up system. police used a contingency plan. >> we used alternative means of communicating on the field. we were still able to dispatch officers in pairs. >> reporter: those means had officers meet. for police this is a number of radio glitches. and as we told you a few weeks earlier, this system crashed during a high speed chase in which officers shot one of the suspects. >> we're trying to be patient, but we also want to make sure we get it fixed and we get stability in the radio system.

>> reporter: anthony batts has expressed displeasure with the system. >> that's why i have a team that meets every week on it. but i also know it's an old system so i don't know, what else can i do. >> reporter: mayor quan says she expects the new system to be up and running this summer. the city it specialists says today's problem was tracked to a controller system that failed. governor jerry brown signed the bill last night exempting victims from state taxes on their recovery money. owners who sold their homes to pg & e will not have to pay taxes on their sale if the money is used to buy another home within five years. two top pg & e executives are resigns after the utility reorganizers. chief operating officer john keenan and president of the

engineering and operations edward salas are leaving. the california republican party kicked off it's california speaks out tour today. lawmakers will hold a number of town hall meetings beginning tonight in fresno. they plan to talk about the budget and why they are against putting tax extensions on the budget. >> i am very much open to their input. their ideas and suggestions because after all they are california. >> the tour comes just as governor brown is heading out to gain support for the extensions. >> reporter: the situation is

this, if there's a shutdown show down, folks who receive social security checks want to know. will my check show up? for millions, social security checks are a lifeline, and their social security benefits represent economic life blood as it does for this man's sister. >> i would hope that she would keep getting her checks. but if it stops, i don't know what she's going to do. hopefully they'll solve it. >> how important are those checks to her. >> she lives on them. if she didn't have that she wouldn't have anything. >> reporter: we wanted to settle this issue once and for all. will they get their checks no matter how long the government is shut down. >> they will get their checks. the printed checks as well as those in direct deposit. but applications will be delayed and other functions are not assured unless they are considered absolutely essential like air traffic controller and prison guards. >> we'll have to leave that decision up to our commissioner to decide on which services if

any that are so essential. >> reporter: even office managers don't know the fate of their personnel and themselves. >> we're just waiting for instructions to come. we know what we'll share with the staff and with our community. >> reporter: hundreds of thousands of federal employees still remain in the dark. >> it's really bad. because even a day of not getting paid is pretty significant for any of us. >> i think they are playing like children. you know they are there to get a budget put together, and they're entrenched and they're not going to compromise. >> so far the social security website has not posted any information on what will occur. tom vacar, ktvu news. congressional leaders are at the white house trying to work out a last minute budget.

the bill also calls for $12 billion in cuts. president obama has promised to veto it. >> i want to express to the president my disappointment that he said he would veto it. >> the president is right, we cannot continue to bail out one tax after another. a bill to box in big box retailers like wal-mart has cleared the senate finance economy. the bill would have super stores to go before a review before constructing. all signs of things may be getting better. the u.s. labor department says

10,000 fewer people asked for unemployment benefits last week. dropping the jobless claim to $375,000. that is just 1,000 more than the two year low. consumers opened their wallets in march. targets revenue declined but by less than expected. analysts say these are signs that shoppers are feeling better about spending. and americans borrowed more in february mainly to buy cars. borrowing increased $17.6 billion. but consumers did cut back on credit card spending. all of the good news was not enough to help stocks recover from a slide when another earthquake hit the northern quake of japan today. stocks started to regain ground. at the end of the day the dow gained 17 points.

the dow closed down about 3.5. major new develops on a b.a.r.t. driver caught texting and driving. pinpointing the hot spots in san francisco's mission district. the 10 blocks where most of the violence is happening.

funeral services were held in oakland this morning for cora green known to many simply as mom. the former nurse worked with firefighters and police for more than 40 years. collecting food and clothing for the needy and volunteering in schools. green's casket was carried in a fire engine draped with black bunting. barry bonds fate is now in the hands of the jury.

the prosecutor recapped his evidence and 25 witnesses. including an audio tape of greg anderson saying how he injected bonds and bonds positive drug test. the defense says the prosecution witnesses are not to be believed. for more click on the bonds trial tab. and the list of the 10 most dangerous blocks in the mission district. mission local reports that over 30% of the violent crime has taken place on the 10 blocks shown on this map. most of them have occurred on mission between 16th and 17th which made number one on that list. a nummi bus driver is in serious trouble tonight after her supervisors aired cell phone video we aired last

night. that video shows her texting while driving a bus. david stevenson is live where supervisors told him is happening now. >> reporter: supervisors tell us that seeing that video today prompted them to try to terminate a driver along this rout. officials moved to fire the driver in this cell phone video shot in mid-february. >> what the video shows is inappropriate behavior. >> reporter: the unnamed driver is described as a latino with an orange-red bleach job. >> the driver has been around a decade. from a customer service standpoint the record has been very good. normally that would make a great deal of difference in a discipline case. >> reporter: but nummi officials say what's shown in

the video demands immediate termination. a representative told us by phone late today, i would like to think all operators drive safely. it is amazing how people are all up in arms when a driver drivers and texts. the man who shot the video and filed a complaint with nummi says the agency needs to take a close look at its operators. >> nummi needs to take a total assessment of all their drivers. because there's some great nummi drivers out there and there's some really bad ones. >> reporter: nummi officials told us they suspended the driver for 30 days when she told them she pulled the bus over to text. she's now suspended again with pay as agency officials launch a termination hearing. reporting live in san francisco, david stevenson, ktvu channel 2 news. a big aftershock struck japan today rattling nerves in

the already rattled company. it was one of the strongest aftershocks since the 9.0 earthquake and tsunami hit japan on march 11th. operators at the tsunami nuclear plant said the aftershock did not cause any new problems. search crews in japan are racing to find the remaining bodies of earthquakes and tsunami victims. they brought in heavy machinery to find the bodies before they begin to decompose. governor jerry brown has sent a letter to president obama asking them to declare a major disaster in california. the declaration is in response to the tsunami surge that hit the coast of california last month. it caused more than $38 million in damage. governor brown's letter is

asking for additional federal help. and out of solano county we had a severe thunderstorms warning for southern solano county. this is out toward fairfield. as you can see the video, we did have a quite of reports of penny sized hail. we also had reports of lightning strikes, cloud to ground lightning strikes. you can see what happened in fairfield with these storms moving through the region. pretty impressive with the reports right there. we still have quite a bit of activity as we come in tighter. you will notice those yellows and reds still flairing out. there's one intense cell i've been watching, and right now it's targeting martinez producing heavy rain. quite a few reports of thunderstorms, so we'll continue to keep an eye on this. also in the concord area right around downtown concord we have some yellows.

everyone reds showing up. also up in napa county, napa also approaching solano county we still have quite a bit of activity here. in the meantime, the showers and thunderstorms will continue to be part of the forecast. for tomorrow morning, variable clouds. a bit chilly out there: the cold air remains in place. coldest locations in napa. 33degrees, oakland 43 and san jose right around 40. here it's a winter like storm that moved into northern california for today. this will be tracking to the south as we do head into your friday. for tomorrow, with this system heading to the south the significant weather moves to the south after that chilly morning. but just with the proximity of this system we have to move ár we have to hold on the a chance of showers. for the most part a sun-cloud mix. here's our forecast for this evening. still rain showers out there and thunderstorms. notice the trend as we approach the 9:00 hour. it does begin to move to the south as we take this into

old irishman who started earlier today. watch one another man match 65. that man is elviro queros. he birdies the 17th hole then the 18th to tie mcilroy. two head of koreans chang and troy. and jays played small ball today in toronto. no this is not giant's third baseman sandoval. the a's tie it. cocoa crisp strikes out but the ball bouncing past toronto elsibia. and that allows a tie. after cocoa steals both second and third base. cocoa scores the game winning run. they had the 2-4 over all record. weather in minnesota pretty decent for the weekend. we'll have more sports tonight
