good morning, thank you for joining us on this friday, april 8th i'm pam cook. >> and i'm dave clark. there is a lot to talk about with weather and traffic. let's go right to steve. >> all right thank you. on this friday it's a cold friday morning out there. still reign showers and possible hail again. possibly peninsula parts -- and parts of the east bay. watch what happened on the peninsula here coming right over to the san mateo and dumbarton bridge. woodside, menlo park, mountain view a few showers. a couple more lingering here

this morning. improving weather this weekend. here is sal. steve, right now traffic is moving along okay. it's getting more crowded. you will see more people getting into san francisco. really any time after 6:30 i think we will start seeing a bigger crowd. this is a look at interstate 880 in front of the coliseum. let's go back to the desk. we begin with developing news this morning in oakland. right now police are on the scene of a shooting at 39th and international. we will be heading to the scene this morning where a man was shot after a robbery attempt. we are told that victim is in grave condition and police are still on the scene looking for suspects. again, we have a crew on the scene. we will update you with new information throughout the morning. our time now 6:01. new this morning a chp officer is in the hospital right now. a man is under arrest after a bad crash in san jose.

the chp says the officer was helping someone with a disabled car. a car stopped on 880 northbound about 2:00 this morning. when another car hit him. police say that driver was arrested on suspicion of drunk driving. the area was also hit by a burst of wet weather that included hail and freezing rain. >> we got some calls with the hail. it looks like it's in this area right here. down the street. >> the investigation continues. that chp officer you see him being taken into the hospital there. he's recovering and being treated for a broken leg. in overnight news a hayward sushi restaurant has been damaged by a fire. that started after 1:00 this morning. firefighters reported heavy smoke when they arrived on the

scene. they say the fire started in the kitchen. the hayward fire department has not released any information on any injuries. overnight fatality on the cal train tracks will not cause delays for the morning commute. cal train says an adult man was hit and killed on the tracks near 25th avenue near 1:00 a.m.. 62 people were on board that southbound train at the time. tracks were closed in both directions for about an hour while an investigation was conducted but again cal train says this mornings operations will not be impacted. this is cal train's fifth fatality of the year. no confirmation of why this person was on the tracks. this mornings fatality does comes a day after they proposed a series of cuts. but now cal train is asking its

staff to find others way to close that $30 million deficit. our time now 6:03. we are watching the clock. time is running short for congress to pass new legislation by midnight tonight to prevent a government shutdown. coming up at 6:15 we'll have a live report from washington, d.c. for you on how the negotiations are going. a government shutdown wouldn't be the same for every department, office, or online. the revenue service will stay active online. the department that oversees the irs would not. some sites they would be able to stay online because they have money set aside. meantime democratic state lawmakers here in california they are painting a picture of what california could look like if the legislature is forced to take an all cuts approach to

try to deal with our budget deficit. now at a hearing yesterday senate democrats raise the prospect of closing university california campuses and shortening the school year. republicans accuse democrats of using fear tactics to scare the public in balancing the budget. the case eight years in the making could come to an end today. jurors will begin deliberations this morning in the barry bonds' perjury trial. kraig debro joins us with closing arguments jurors heard before being sent off to decide this closely watched case. >> reporter: the jury now has the case and this morning they will begin their first full day of deliberations. according to federal sentencing guidelines on a single count it could bring 15-20 months in jail.

barry bonds' is facing three counts of perjury and one count of obstruction of justice. originally he faced 14 counts and at the start of the trial there were four counts of perjury and now there is just three. you heard the phrase bonds never knowingly took steroids. he never said that exactly. here's the exact exchange from his grand jury testimony from back in 2003. the prosecutor says did you ever get any pills that mr. anderson described as testosterone pills or fast acting steroid pills that he called beans? did you ever get anything like that from him? bonds no, not that i know of. i mean he gave me a package of pills. >> i think a long shot would be all guilty, all not guilty across the board. there is so much evidence on both sides and so many points made on both sides. that would be the most

surprising. the most likely would be a tough verdict. it's tough to walk a verdict out of a guilty case with all not guilty counts. >> reporter: the prosecution said barry bonds' is motived -- motivated to lie. the defense says the prosecution did not prove their case and the case was full of witnesses with people with access that grind against barry bonds'. this morning we will be looking at more of that grand jury testimony. reporting live in san francisco kraig debro. and stay bus here at ktvu channel 2 for continuing coverage of the barry bonds' case. if the jury reaches a verdict today, we will bring that to you right away. the bay area was hit with a powerful spring storm yesterday. for some people the weather was plain wild. the national weather service confirmed a weak tornado

toucheddown in rockville just outside of fairfield. knocked down a fence like that one there. caused minor damage. in fairfield the storm dumped an inch or two of hail coating cars. there was even enough out there to build a snowman and have a snowball fight. some of the people we talked to say they were expecting rain but nothing like they actual saw. >> that is incredible. 6:07 is the time right now. we have been talking about developing news. a shooting after a burglary attempt or robbery attempt. >> those are the reports we have. our crew is on the scene of a police accident at 39th and intercasual. it happened in front of 38 and 72 international boulevard. we have a crew on the scene. here we are. these are the live pictures. the police are on the scene again. this was reported as a shooting

and a robbery. we have not received official confirmation from police. there is definitely a crime scene and investigation. this is developing news. they are looking for two men who allegedly shot someone in the course of a robbery. the police are there. we will find out little bit more from them at the scene coming up again. this is 3872 international near 39th and international. it looks like the buss are running through there. let's go back to the traffic. westbound bay bridge that traffic is backed up to about the middle of the parking lot and the metering lights are coming on any time now. caster valley a crash 580 westbound. a couple of lanes blocked but they are moving them to the shoulder. traffic isn't too bad right now in this area. let's go to steve. thank you, sir. a very happy friday. just not very warm. at least it will be a little better today than yesterday. even though yesterday was not bad for awhile. in the afternoon things went

crazy. today have the giants home opener. it will be mostly sunny breezy and cool. lingering showers in the morning. i think we are already by the afternoon hours as the low moves south. again bundle up at times. the wind will be at the north, north west. it's giving us showers east bay, san jose, few until the santa cruz mountains, and on the peninsula. redwood city, attar ton and some might turn to snow. 31 fairfield. 35 napa. 38 santa rosa. 38 now in livermore. as this system clears a little bit,s temperature -- a little bit, the temperature is drops off the table. a big old high is trying to build in but it won't be until this weekend. it's a cold morning out there. bundle up. chilly and breezy.

>> reporter: president obama said last night if there was going to be a budget deal, it would likely come this morning. but nothing yet. the chief of staff worked at the white house until 3:00 a.m.. senate majority leader harry reid said that the biggest sticking point is the poll sayish -- is the policy issue whether the feds should help planned parenthood. i talked to barbara lee who calls their demands outrageous. >> it's clear to me they want a shutdown. when they put forth these types of measures that don't make any sense. they have come more than half way. they keep push, push, pushing. >> reporter: this will be the 17th government closure since 1977. in 1995 it cost taxpayers $100 million a day. this one is expected to be even

more expensive. 800,000 workers would be furloughed. furlough notices have already gone out on capitol hill and government agencies across the country. the big question is, is he going to be able to broker a last minute deal? reporting live from washington, d.c. alison burns. we continue to follow developing news in oakland this morning. right now police are on the scene of a shooting at 39th and international. here's a live picture of the scene with police responding. now we understand a man was shot after a robbery attempt and we were just told the victim is still alive was rushed to surgery but is in very serious condition. again police still on the scene collecting information looking for suspects. we do have a crew there trying to get more information and we will bring that to you as soon as we can.

again a shooting investigation in oakland. four more journalists have been captured in libya by forces loyal to moammar gadhafi. two of the captured journalists are americans. witnesses say they were taken away along with two photographers from spain and south africa. there are reports the four journalists have been located and they are on their way to tripoli where they will be released. former president clinton is back in haiti today. he's scheduled to tour a school and announce a cholera campaign. his visit follows haiti's recent presidential election. back here a home a residential -- it could be a

is on pace to jump as close as 20% this year. the costs could go higher for tech companies that want nice brick and beam offices. one leasing agency says it feels similar to 1999. mortgage rates held steady this week with the average. 4.87%. rate on 15 year loans are up. but the low rates are doing little to boost home sales with developers continuing to report declining orders for new homes. time now 6:23. it's a story we have bonn following for the -- we have been following for the past month. and the los angeles dodgers are promising a sea of blue at their next home game.

good morning, right now traffic will be busy on the upper deck of the bay bridge. remember later today it's the giants home opener. 40,000 plus sold out at & t park. it's already busy getting into the city. here's a story you will only see on 2 this morning. two men suspected of breaking into east bay storage units have been arrested. ktvu first broke the news last month. 47-year-old gregory rented a storage locker he and 41-year- old james bounds broke into other lockers. investigators say the break in the case came when an employee at public storage noticed one of the them loitering on the property and called police. the alameda county sheriffs department is trying to find the estimated 30 owners of more

than 1,000 stolen items. >> i didn't expect to get anything back. i was surprised when i got the phone call to come over here. >> detectives say there may be more arrest to come and they are checking to see if this case is tied to others dozens of others here in the bay area. 6:27. the brutal beating attack against giants fan bryan stow is leading the dodgers to step up their security. charlie beck said yesterday additional officers will patrol the stadium. he will only say fans will see a sea of blue. lapd blue. time now 6:28. a chp officer hurt and a man has been arrested after an early morning crash. the strange weather that played a role in that crash. also we are looking live at oakland. a person in critical condition after a shootout.

live picture. we have a crew on the scene that will continue to follow what is happening and bring you new information throughout the morning on what is happening. meantime it's 6:31. other news coming from overnight. a hayward sushi restaurant has been damaged by a two alarm fire. that fire started just after 1:00 this morning. the restaurant called the naked fish. firefighters when they got on the scene reported heavy smoke. the fire michigan in the -- began in the kitchen of the restaurant. the fire department has not released any information about possible injuries. muni is taking action against that driver that was caught on camera texting behind the wheel. the video was recorded by a passenger. the agency initially suspended the driver after she said she pulled the bus over to take care of a family emergency. but after seeing the video, hewn nigh says that was not --

muni says that was not the case and she will be fired. a man accused of driving drunk sent a chp officer to the hospital. paul chambers is live. >> reporter: you can see the roadway right here has been clear for several hours. we are at interstate 880 onramp. cold wet slick roadways caused headaches for many. the icy runways believed to lead to an accident that involved a chp officer. that accident shut down the interstate for two hours. he saw a car on the side of the row went to help the driver that's when a white vehicle came up and struck the officer. >> he was disabled on the right shoulder. one of our officers came and assisted. i believe he was helping with a tire i don't know yet.

but then another vehicle came from the slow lane and struck the officer and knocked him in front of the vehicle. >> reporter: now the officer was taken to a nearby hospital where he's recovering from nonlife threatening injuries. it's believed he has broken leg. the driver of the vehicle that struck the officer was arrested for driving believed to be driving under the influence. a storm came through this morning leaving this slushy looking area. the roadway seems pretty safe right now. it was slick and rainy earlier this morning. just use extra precaution as you are heading out. in just about two hours the jurors in the barry bonds' perjury trial will start deliberations on a verdict. closing arguments were presented yesterday. coming up in ten minutes, we

will go live to san francisco for an update on the deliberations beginning today. a new twist in the case of the man accused of kidnapping jayce dugard. phillip gore row doe did -- garrido did not testify in court yesterday. outside of court the public defender raised issues about the macup of the -- makeup of the grand jury that indicted the couple. >> before you plead to the sheik as we say it would be unethical for me to not look at every possibility. >> the judge set an august 1st trial date. time now 6:35. a san carlos man accused of molesting his friend's daughter is out on bail right now. 46-year-old yung chu entered a

not guilty plea yesterday. chu was a tech. the girls father called the police after the father found text messages from chu. as the giants increase security around at & t park they are also taking time to honor brian stow. today's game is dedicated in his honor. storemans in the hospital recovery -- stow remains in the hospital recovering from his injuries. if you plan to attend the dodger portion of the opening home stand for the giants, expect tighter security all of this after last weeks attack on bryan stow. a spokesman for the giants is

telling ktvu that there will be additional officers on patrol during those three games which begin on monday. they will be inside and outside of at & t park. the giants are asking all fans to respect the rivalry between the teams and show some good sportsmanship as well. meantime this afternoon a sea of orange will be flooding into at & t park. ktvu tara moriarty is already there at the stadium right now. and she is into it. she's down on around the field and smiling as well. tara. >> reporter: oh yeah there is a lot to smile about. there is a lot of excitement in the air today for the giants to come home and play. as you take a look behind me you see the sun coming up on the field. the coveted world series trophy. pretty exciting stuff. gates open in 3.5 hours. we have three sellouts against the st. louis cardinals.

there. the former naval hospital in oakland. it will be imploded between 10:00 a.m. and noontime. ktvu will be there. we will take you live when the actual implosion happens. we will stream it live on our channel 2 website ktvu.com. all eyes will be on a san francisco courthouse as jurors begin deliberations on the barry bonds' perjury case. kraig debro joins us. >> reporter: good morning, pam. of course barry bonds will be here in less than two hours. the jury's first full day of deliberations. bonds did not testify in his own defense. the jury in this case will be able to look at that and consider it and decide whether or not bonds is guilty or not guilty. two prosecution witnesses saw or knew that bonds was

injecting steroids in 2000 pep when asked if he did that bonds told the grand jury in december of that year if he did take steroids he didn't know he had. bonds admitted that he got cream and oil. the defense is countering claims that bonds injected steroids. here is bonds' testimony from 2003. it says bonds did not ingest steroids because he does not like ingesting steroids. i only let my own personal doctor touch me and my own personal doctor came up and drew my blood. >> some counts hang. i think think will be some -- i think there will be some disputes for the jury.
