about two hours ago as a convicted felon. smiling, barry bonds and his lead attorney shook hands after the conviction, then he autographed a baseball for a fan. >> he has wanted very much to address you directly. but as you saw, the case isn't over. >> reporter: that's because it was a split decision in court. jurors announced they were hopefully deadlocked on three counts or charges against him or lying to a grand jury about knowingly using steroids or being injected. neither bonds nor his mother showed any outward emotion as jurors unanimously found bonds guilty of one count of obstruction of justice. >> allege steroids which allege needles which allege human growth hormone, those were

mistried. there was no conviction, no verdict, no finding adverse to barry bonds. >> reporter: u.s. attorney afterward did not speak to the media. she issued a press release saying she respected the jury's decision. quote, we are gratified by the guilty verdict. taking an oath and promising to testify truthfully is a serious matter. we cannot ignore those who choose instead to obstruct justice. there has been no decision yet on whether to retry barry bonds on the counts the jury did not reach a verdict on. people ask, could he go to prison? yes, of course he could under the guidelines for sentencing, but that is considered unlikely. reporting live in san francisco, channel 2 news. >> barry bonds legal team immediately asked the judge to throw out the guilty verdict. the question tonight is, are

there grounds for an appeal? david stevenson was inside the courthouse today when the verdict was read. he joins us live from san francisco with what legal experts are saying tonight about the next step. david? >> reporter: the federal jury inside the courthouse behind me convicted him of a single count of obstruction of justice. he said he'd never knowingly used steroids in his career. the jury took four days to reach that one unanimous decision after nearly three weeks of testimony about his alleged steroid use. the conviction means bonds misled or impeded a grand jury hearing about steroid use by athletes. at the start of this case, he originally faced 9 charges whittled down to four. the verdict made sense given the complexities of the case, but the defense may have grounds to have the conviction

overturned on appeal. >> they'll be studying appellate grounds to study the guilty verdict. >> it's a verdict that makes some sense. it's a compromise verdict. there are jurors who couldn't agree on perjury. it only requires an attempt to obstruct justice. this some sense, it requires less evidence of knowing, you know, perjury. it requires simply an attempt to mislead the grand jury. >> reporter: outside the courthouse this afternoon, jurors told us the evidence presented indicated bonds was evasive in his testimony. bonds defense team and u.s. prosecutors will be back in court on may 20th for a status hearing and possibly set a sentencing date which could be three to four months away. >> so once again, the jury in

the barry bonds trial delivered a split decision. deadlocked on three counts of lying to the grand jury about his use of steroids. on count one, the vote was 8-4 for not guilty. on count two, 11 jurors voted to convict. one held out for not guilty. on count three, it was 9-3 for not guilty. and on count five, the jurors unanimously found bonds guilty of obstruction of justice. a number of jurors spoke afterward and talked about that split decision. >> we went one way, we went another way. upon looking at all the evidence that was in front of us, we made a decision. >> the evidence that he did steroids might have been there. did he knowingly do steroids was the question. we couldn't prove that beyond a reasonable doubt. >> beyond a reasonable doubt is always a really tough call for most jurors to make. >> one juror explains a deadlock by saying there was a

piece of the puzzle missing. we'll hear more from the jurors coming up at 5:30. >> the giants are taking on the dodgers tonight, but it's the former giant who's generating all the talk. reaction from fans and also what the team is saying tonight. >> reporter: fans are just starting to trickle into tonight's game 3, the concluding series here at att park. many of them had just heard about the verdict. their reactions are decidedly mixed. bonds is one of the greatest players to ever put on a uniform. he's the game all-time and single season leader in homeruns. he hit number 762 in 2007 to set the all-time record. he's also part of what can only be described as baseball's steroid era. one of the most exciting times in giants history, but the team

disstanced itself from what was going on in the courtroom. this case is on going. we expect it will proceed in a fair and orderly manner. accordingly, we have no comment at this time. what it does is it put fans in a tough spot. they're not sure where they should put him in terms of baseball history. >> it creates a little bit of a black spot on our history. >> i think it's personal business. i think it's unfortunate that something got him here for a reason. he's done a great job for the giants. appreciate it. >> i think it was a total waste of time. i think the prosecutor was trying to make a name for himself. i'm not saying i know he didn't do anything wrong, but there's so much he said, she said regarding this situation. there wasn't a lot of real hard, cold what you might call criminal facts that came out that i could tell.

i think it was a total waste of time. >> reporter: kind of like the way the giants were this weekend. they had a lot of circumstance to get this behind them and play routine baseball. they would rather not have this be number one topic as far as the team is concerned. >> another prominent figure in the barry bonds saga has been his former trainer anderson. the 45-year-old refused to testify. the same thing that happened back in 2006 during the federal grand jury investigation. back in 2005, he was sentenced to three months in prison. jurors did hear a tape recording in which he described injecting bonds.

afternoon. joseph nasa didn't enter a plea and his personal finances were one reason why. >> reporter: he did not even say a word inside court. it was about a 20-minute appearance. attorneys argued that we couldn't come in, the judge ultimately ruled yes. >> i have a criminal complaint filed against joseph naso. >> reporter: he looked up, saw the camera, and covered his face. >> i'm not going to comment on the case or the details. it's going to be brought out in court. >> reporter: on the other, joseph naso. naso did not enter a plea. he does not have an attorney. he has a million dollars in assets and is not eligible for

a public defender. the judge ruled he would give naso two weeks. he read to naso the charges in the complaint. in it, charged with killing four northern california women. 18-year-old roxene. 2-year-old carmen. 384638-year-old pamela. >> the case is on going in an investigative posture. we have the counts we believe the evidence is sufficient to prosecute at this point. >> reporter: prosecuted the last death penalty case back in the 1980s. he's looking to seek the death penalty against naso. >> everything will have some bearing on what our ultimate decision is. >> reporter: naso's next court

appearance, april 27th at 9:00 a.m. >> investigators in the case are also talking to authorities in new york about a series of killings called the alphabet murders. the schoolgirls at rochester new york alphabet case had first and last names that began with the letters. they have not found any connection with naso. >> what we're thinking or wondering is if this is a copy cat off the rochester murders. >> new york police have not linked him to the alphabet case, they say they have not ruled him out as a suspect. prosecutors released gruesome details about the death of a san francisco teenager in court. andy was killed over the weekend in san francisco.

two teens charged in the case were in court today. the 15-year-old boy charged with murder did not enter a plea. jim my lay pleaded not guilty to accessory to murder charges. prosecutors say the two discussed dismembering the boy but decided to use gas to burn the body. neighbors called 911 after reporting the smell of gasp. general manager resigned today. dorothy dugger has been under fire for several months. she will reportedly receive a severance package worth nearly $1 million. the board of connectors will begin searching tomorrow for her replacement. proposed budget cuts have students and staff marching across several campuses. why they say they need your help to be heard. a few sprinkles this

hundreds of people gathered in oakland today for the funeral of a well-known restaurant owner shot and killed last friday. they walked with the family and friends. they went from the restaurant, his restaurant to st. elizabeth catholic church for funeral mass. he was shot during a robbery attempt. there is a $32,000 reward connected with his death. angry students and family marched on campus today. live at san francisco state with why one teacher says the education system is failing its students. >> reporter: it's all quiet here now, but a few hours ago,

students and staff marched through the administration hall here. they're holding protests to talk about the proposed budget cuts to education. >> our future. >> reporter: with millions of dollars being slashed, students and faculty marched saying the solution is not cutting education, but finding more revenue. >> the money is there. it is a question of priorities and will to use it. >> it's clearly not within the university's power to print money. >> reporter: in the past, educators were laid off and had furlough days. students and faculty say this comes with a price. >> some of the teachers we have, you know, they're worried about their jobs. >> we're going to produce really very not well educated citizens. >> reporter: the message was

similar at campus. cutting education isn't putting thing in a proper perspective. university officials say they understand the frustration of students and staff and they want it to be known everyone in this fight together. >> it's time for the taxpayers of california to decide how they want their money to be spent and what level of support they'd like to give to the future. >> reporter: organizers say today's event was successful, but it's not enough. contact your local lawmakers. new restrictions in place for medical marijuana shops in the largest city. in a sharply divided vote, tentively approved limits on where medical marijuana clubs can operate. they would be restricted to industrial and commercial zones. thatment cos after more than a year of debate.

the council did not support the mayor's plan to shut down more than 90% of the medical marijuana operations. if the health director has his way, there's one group of people that won't be eligible for jobs with the county health department -- people who smoke. draft a policy that would exclude smokers from jobs in his department. it would make monterrey the first county health department in the state to hire only non- smokers. the board of supervisors would have to approve it before that policy could take place. the rain returned to the bay area this morning. as the showers came down, the umbrellas went up. here's what it looked like in oakland around 9:00 this morning. most of the rain fell between 8- 9:00 a.m. this was the wet scene on the streets of san francisco. here's a look at the east bay city of pittsburg as the rain

kobe bryant was fined $100 thousand for cursing and using a homophobic slur last night. the commissioner said the comment was distasteful and should never be tolerated. bryant issued a statement and said his words came out of anger and do not reflect his feelings on gays and lesbians. a young boy survived a horrifying accident. his mother intentionally drove the family van into the river. >> he rolled down one of the power windows and climbed out the car door window and swam to

shore. >> police and fire crews in new york still seem shaken as they described how a 10-year-old boy managed to escape from the sinking van. she drove her van to into the hudson river. armstrong died along with her two little boys and her 11- month-old baby daughter. >> if that child had not escaped this car, this could be a missing persons. this entire family could be missing. we would not be able to see that car from the shore. >> a passer by found the boy and took him to a near by fire station. they were unable to save armstrong and her children. a critical incident stress debriefing team has been called in to council the emergency responders. as for family members, they are

now caring for the surviving boy. video of a six-year-old girl being patted down at the airport is raising eyebrows tonight. it happened last week in new orleans. someone captured it on video and posted it on youtube. the aclu questions whether the pat down was necessary. the girl's father says his daughter was confused by the search and started crying afterward because she thought she had done something wrong. children have been used to carry explosives in some places, says the tsa. last week's show because she was overweight. ashleigh coffman says they arrived early to get seats down front, but told they would have to move because she was too heavy. american idol producers say there is no truth to the allegations. coffman says she wants an

decision convicting him of one charge of obstruction of justice. the jury failed to reach a verdict on three counts that he knowingly used steroids and lied about that to a grand jury. a mistrial on those three counts. prosecutors need to deseed whether to retry bonds. most experts seem to think he will not spend any time behind bars. >> late this afternoon, several of jurors spoke out about what happened in the jury room and what it took to get that one verdict. we're live at the federal courthouse with their stories this their own words. >> reporter: the jurors came out through this front entrance of the federal building to speak with reporters after deliberating for four days. six of the 12 jurors, decide a mood of frustration before deadlocking on three other

counts. the jurors who spoke with us included the jury foreman and a 19-year-old college student. they told us why they deadlocked on all but one count. >> you're convicting a man to be guilty, you need to be beyond a reasonable doubt. one piece would support it but this other person's testimony would contradict that so you have doubts. >> you think his demeanor ever hurt him? >> there's this perception of arrogance. >> he was evasive and didn't answer the questions clearly. that was our evidence, we used that. >> reporter: he hopes the one guilty verdict will deliver a message. >> i like to see a level playing field out there. my daughter plays soccer. i wouldn't want my daughter out there competing against somebody that's on steroids or performance enhancing drugs. >> reporter: when we asked what punishment he should face, the

jurors said it's up to the judge. reporting live from the courthouse here in san francisco. >> the giants are preparing to play the dodgers at att park less than two hours from now. we're at the ballpark asking fans what they think about the verdict today. >> reporter: i've watched a lot of fans go in here as the fans are starting to come in in preparation for the dodgers game tonight. you can't help but wonder how relevant given what happened last year the whole barry bonds situation is to the fans right now. there's no question about the fact that he was one part of one of the most exciting and most controversial eras in baseball history. how you put that all into historical perspective is the thing we all wonder about. the fans were all talking about the verdict today. >> i think he deserves it.

i mean, i think he's a great guy, great ballplayer, but got what he deserves. >> hey, everybody makes mistakes. got to forgive and forget. >> you're still a barry bonds fan? >> of course. always. go, barry. >> it was a stained era. i mean, they said a lot of players used performance enhancing drugs. we want our kids to do better and not use those drugs. hopefully we can learn from this lesson and move on. >> reporter: the team issued a statement saying it's an on going statement. they're confident it will be handled fairly, but with the exception of that, they have no further comment. reporting live for ktvu channel 2 news. >> historical relevance, barry bonds was born in baseball royalty. he lived in san carlos. he excelled in baseball, basketball, and football. his father was a three-time all-

star and close friend of willie mays. bonds played ball at arizona state university. he made his major league debut in 1986 and returned to play for the san francisco giants in 1993. the bonds case actually began with the bay area laboratory cooperative. the founder and four other men would eventually plead guilty to federal charges for distributing two undetectable steroid compounds called the cream and the clear. the scandal would affect bonds and as many as other 30 major league players. among them, track star marion joans was sentenced to six months in prison after confessing to her use of performance enhancing drugs. we have much more coming up in 25 minutes coming up at 6:00.

you'll find more coverage on our website including more comments from the jurors and from bonds himself as well as a history of the case. go to ktvu.com. the faa says early this morning a medical flight pilot tried to contact the patrol tower, but the loan controller on duty happed fallen asleep. that controller has been suspended along with a handful of others around the country who have also fallen asleep on duty. last month, two planes were forced to land without help in washington. >> in response, the faa will beef up its tower staffing in the overnight hours. they will add a second controller on the midnight shift at 27 airports. ktvu contacted the faa.

they said no bay area airports will need the extra staffing since san francisco and oakland have two controllers over night. four california airports will get an additional control. the u.s. economy improved in every region of the country this spring, according to a federal reserve survey that also says higher oil prices remain a concern. the survey says factories are busier, consumers are spending more, and companies are hiring more people. workers are seeing limited pay raises, if any. news from the u.s. labor department is also encouraging. it says businesses in february posted the largest number of job opening in the more than two years. hiring is picking up as the economy grows. >> stocks overcame early losses and edged higher today.

however, financial stocks declined after jp morgan reported it was still struggling with mortgage losses. the dow finished the day up 7 points. a foreclosure fumble. what a number of lenders and large banks are being ordered to give to homeowners. an inmate died with staff was subduing him. the preliminary findings on his cause of death.

the federal government today ordered 16 mortgage lenders to reimburse homeowners wrongly foreclosed on. the companies including san francisco based wells fargo and citi group and u.s. bank and hire auditors to determine if they wrongly foreclosed on any other customers in 2009 and 2010. the preliminary cause of death of an inmate who died in custody. william robling died from artery disease and an enlarged heart. the napa sheriff's department says he died monday night after being subdued by staff members following a fight. earlier this year, workers at the hospitals were demanding more security because of a tax

on employees. cal osha released their findings. it is now fining the hospital $100 thousand for several deficiencies, the lack of inadequate alarm systems and an ineffective injury and illness prevention program. the hospital has until may 15th to correct those violations. calling on governor to push for immediate improvements. in a letter yesterday, state senator wrote it is time we have laws, regulations, and on- site practices employed that reflect this new reality for our state hospitals that is a far cry from the mission when napa state hospital was built more than 137 years ago. if you take a vitamin every day, you're not alone.

the department of transportation is taking on one of the biggest complaints about the air travel industry. set to release a new rule later on this month that will require

airlines to refund baggage fees if a bag is either lost or not delivered in a timely manner. some industry experts believe with this refund rule. they make money off baggage fees and should spend more to improve tracking technology. president obama revealed his plan to cut the federal deficit. find $4 trillion in savings over the next 12 years. it's how he plans to do this that's getting some lawmakers upset. >> reporter: calls his plan a balanced approach, combining spending cuts with new revenue. on the cuts side, the president wants to reduce spending on defense and domestic programs t. biggest savings would reform medicare and medicaid, but he didn't embrace the deep cuts republicans are seeking by turning medicare into avoucher program. then came talk of taxes. >> we cannot afford those tax

cuts. >> reporter: besides closing tax loopholes, he wants to end tax breaks for wealthy americans. for every tax dollar collected, they cut $3 in spending. republicans including those from our area say they'll put up a fight. they say it really hurts small business owners. >> we can't tax the very people that we expect to reinvest in our economy and to create jobs. washington has a spending problem, not a revenue problem. >> reporter: some lawmakers insist a financial sound budget plan must involve bringing home our troops, a move they say saves $1.5 trillion. >> it's a bum deal for taxpayers. >> there is going to be a flurry of financial activity for the next few days. tomorrow lawmakers will vote on this year's budget to avoid another shut down threat and

then there's next year's budget. the house will be voting on a republican-backed plan but expect a big push back from democrats. >> taxpayers get a few extra days this year to file their returns. the filing deadline has been pushed back until midnight on april 18th. by law, local holidays in the nation's capitol affect deadlines. marks the occasion when abraham lincoln signed a law to eliminate slavery. donations to repair an unthinkable act of vandalism at a historic cemetery. assessing the damage to more than two dozen headstones at the city cemetery. they cut chain locks and then used a vehicle and a rope to topple some of the headstones. the historic cemetery was established back in 1850. it's the final resting place

to a head in washington tomorrow. strip millions of dollars from planned parenthood and similar clinics. >> we're not going to cut into the heart and soul of our country and that includes womens health programs. >> planned parenthoods and its affiliates receive $263 million of its nearly $1 billion in public funds. today a group of democratic female senators rallied to save the money for those services. >> we will be here as long as it takes to protect women and their families and we will not allow women and their families to be held hostage. >> they say no federal funds go to abortions and that planned parenthood provides critical womens health care services. even if they lose tomorrow's votes, they will try again in future budget battles to end
