a deadly accident in the peninsula as a commuter train hits a car. we're learning new details tonight about what caused the accident. good evening i'm julie haener.

>> and i'm frank somerville. the husband was able to get out of the car but the wife was not able to. >> reporter: we've just been told this intersection will remain closed until tomorrow morning when the last train goes through. this intersection is one of the deadliest in the country. tonight a visiting out of the state couple found themselves stuck in palo alto with tragic results. >> they were on the track. the bells were activated. they were on the track. you can't go forward, you can't go back. >> apparently not. >> reporter: the commuter train could not stop. the couple described as in their 60s were from indiana. >> the wife was driving. the husband managed to get out of car and get clear. the wife was not. she was pronounced dead at the

scene. trains in both directions were stopped until 8:00 tonight. a bus bridge was established between mountain view and palo alto. >> i'm just going to wait because i live in the city. there's no other way to commute expect to catch the train. one woman watching at the scene said it didn't have to happen. >> reporter: i feel like people have to be more cautious about what's going on around them and start paying my attention to everything and their surroundings and not just focus on one thing. >> don't go on the track until you know there's enough room on the other side. it's not an uncommon mistake. >> reporter: today's death makes six for this year. live many palo alto, lloyd lacuesta. there was another fatal train accident in san francisco. an amtrak train hill a male adult in port costa about 6:15.

the train was on union pacific track and union pacific is the lead investigator. so far there's no word on the identification of the victim. nancy pile said the number of dispensaries keeps growing as the council trying to figure out how to regulate them. next tuesday san jose city council is scheduled to once again discuss imposing the limit on the number of dispensaries in the city. a follow up to the stories tonight we've brought you this week. we've now obtained video of a nummi driver kicking a family off the bus. it shows a woman taking a seat with a toddler in her arms. she gets up to stop the bus driver from leaving without her companion who is carrying a

stroller. the driver and man then exchange word about him boarding late. >> have a nice day. you get off my train. >> the operator inappropriately kicks a family off of the bus and that's something we take very serious and want to take action on. >> reporter: ktvu news reported the driver was fired. the driver had been on the job for five months and was still on his probationary period. a court of madero man is arrested for taking over a bank of america bank. he will face four years behind bars. new at 10:00, a rally in

san francisco to bring attention to the beating of a transgender person. >> reporter: at tonight's rally activists handed out signs such as this one they read stop the violence, stop hate. >> we will not only survive but we will thrive. amen. >> reporter: 28-year-old mia told the crowd that [ bleep ] the person who had attacked her on the áf because of her sexual orientation. san francisco district attorney george gascon attended the rally. his office has charged two men with the hate crime. >> we're very concerned that there's people doing many hate crimes in the last two months. >> we just want to support people in our neighborhood. >> reporter: one transgender college student tells us safety is a concern.

working as a truck and gillroy coach. no students were in the van at the time. harrison was stripped of the 2011 olympics. the oakland unified school district is facing fines thanks to a former state administrator. the san francisco chronicle is reporting that ward has been charged with fiscal mismanagement. now the state is asking the school district to pay the bill. local officials regained control of the district in 2009 and they say they shouldn't have to pay for ward's fiscal mistakes. new numbers show the state unemployment rate for march dipped to 12% that's the latest

level since 2005. 12% unemployment is nothing to celebrate. >> mike underwood has been coming to this unemployment office for the past six years who says in the past he's found good jobs but this time it's different. >> i haven't had good luck lately. >> reporter: the state added 250,000 jobs in just the six months. but nate williams says the jobs that are being created aren't the kind of jobs on which workers can rely. >> you can find like temp agency jobs you know which last for a little while. a lot of people are only hiring part time. you don't get benefits. >> reporter: williams says he's been under employed since 2009. that means he's had to expand where he looks for job. >> i've had so many jobs where i've spent six hours for five

hours work. 25 bucks for a 15 hour day. >> i still feel like it's just kind of at a standstill. yeah. >> reporter: it has to be frustrating. >> it is frustrating. but you can be the give up. you have to pay the bills. >> reporter: the state employment department says the key is perseverance that's one of the reasons why they gave me this, a stack of notices about upcoming job fairs here in san francisco, in the east bay and on the peninsula, all of them happening over the next two weeks. in san francisco, christien kafton, ktvu channel 2 news. here's a look now at bay area unemployment county by county. marin remains the lowest in the region at 8%. the highest solano county is at 12.3%. it is the only bay area county with a jobless rate higher than the entire country. san rafael based beacon

economics says bay area employment isn't likely to recover until 2015. the company issued a report saying san francisco and the east bay will see a quote slow but steady recovery. san francisco's prerecession unemployment rate was 5.5% while the prerecession rate in the east bay was between seven and 8%. procrastinators are getting extra time to file their income tax returns this year. today is april 15th but the tax deadline is april 18th this monday. california extended its deadline to help avoid any confusion. state officials say last minute taxpayers expecting refunds should see their checks in about three weeks. if you haven't filed your taxes go to our website ktvu.com. scroll down to the right now section, we have links to some of the forms you might need. on wall street, stocks ended the week on the plus side. the nasdaq was up four. the dow was up 56.

the federal government has shut down three of the biggest online poker sites and is

accusing the operators of fraud. ktvu's john sasaki found gamblers with money now frozen on the site. and john joins us now in emeryville. >> reporter: we've been out at the oaks card club. where it's was very busy. the sound of the chips, the raising of the heart. they all come with live poker games. but online people can play at home alone. >> online poker has become part of the youth culture for poker players. >> reporter: today two of the biggest poker sites were handed a losing hand. try to log on and this is what you will see. an ominous message from the justice department about the companies and their customers. >> i think it's ridiculous. i think it's absurd.

casinos. live in emeryville i'm john sasaki, ktvu channel 2 news. a $5,000 reward is being offed in connection with the robbery of human hair. surveillance cameras at a salon called hair divas caught two men breaking in. running off with arm fulls of hair. salon owner anne davis says the hair is very valuable and that it comes from women in india. and she says it's not going to be difficult for the men to sell it. >> as my hair is a rare high end specialty hair and like i said i'm the only one in the bay area that distributes this hair. >> davis says she invested every dime into her store and is very angry at the robbers. police say they are confident that those customers will be caught thanks to the images on the surveillance tape. union city police are looking for a 14-year-old boy

not seen since he left home for school. michael santos is 5'2" tall and weighs about 120 pounds. and stow is the san francisco giants fan beaten outside dodger stadium two weeks ago. yesterday doctors stopped the flow of medicine that was keeping the 42-year-old in a coma. a hospital spokeswoman said stow is now pleatly off that medication but it's -- completely off that medication but it's quote hard to know if he will wake up. doctors say the next few days will be critical. the police department has released new sketches of the resemi resemblance of the men. one key witness could have

changed the outcome of the barry bonds trial but barry bonds personal trainer greg anderson has always refused to testify. but now that the trial is over does the government have anderson in its radar? >> reporter: he had just become a convicted felon for obstructing justice. barry bonds gave a thumbs up then a v for victory. while bonds doubts that the prosecutors will retry him. the spotlight has been off his childhood friend and personal trainer greg anderson who's silence legal analysts said made prosecutors job more difficult. >> what's be interesting is to see if the government will decide to prosecute him. >> reporter: that's right

there's a chance for showers, mainly for late on sunday. overnight lows are mild tonight in the 50s. 51 in concord. your saturday morning starts off mild. tomorrow is going to be a lot like today. the showers are going to stay north and we're going to see just cloudy conditions, mostly to partly cloudy with temperatures easily into the upper 60s and low 70s. i'm going to bring back the computer model. powerful storms roared through half of the country today. a state emergency has now been declared in 14 counties in mississippi. the storm system first hit late yesterday in oklahoma then pushed its way across four other states including arkansas and louisiana. seven of the 10 deaths were reported in arkansas. cbs pharmacy is paying millions to california and nine

other states to settle allegations that it overcharged medicaid programming. the justice department announced the settlement today. cbs allegedly over billed medicaid when it filled prescriptions for medications who had other insurances. the drug giant will pay $17.5 million to the states. the whistle-blower who alerted will receive more than $2 million. and what is traditionally tax day serves as a rally cry. the message these protesters wanted to get across. plus it turns out injured congresswoman gabrielle giffords has been getting more than just get well cards. what else people are sending her.

house republicans counter president obama's fiscal plan with one of their own today. they passed a $3.5 trillion

budget for next year. it includes extending the bush era tax cuts and transforming medicare into a voucher program. harry reed a democrat says it doesn't stand a chance in the senate. tea party members rallied across the bay area today to protest governor brown's proposed tax extensions. ktvu's ken pritchett reports. >> reporter: the tax day rally this evening in san francisco was just one of many planned for this weekend. tax day weekend. perhaps the largest took place in pleasenton tonight. two of the bay area's largest tea party groups joined forces and said they will have more of

increase their numbers to have more power in the bay area. if wounded congresswoman giffords decides to run for reelection she will have the money in the bank. supporters have donated $350,000 for her reelection campaign. bringing the total to more than half a million dollars. she has been undergoing rehabilitation after she was shot in the head. it's still unclear if she will be able to go back to congress or run for reelection. the last rebel held city was attacked. more precision attack aircraft are needed to avoid civilian casualties. nato says forces disguise themes as rebels and are using

human shields, and the u.s. times reports that they are now using shield bombs. that's the daughter of gadhafi rallying supporters in tripoli today. she said the idea of her father steps down outrages all libyans. she says libya wasn't defeated then and won't be defeated now. what i'm doing right now just sitting here on the sidewalk could be illegal in berkeley if some community leaders get their way. we'll explain what the controversy is all about. also a protest without sound. why these students kept quiet to get their point across.

voters passed san francisco controversial sit, lie ordnance in november. but implementation of that law has yet to get off the ground. now another bay area city is considering a similar law. janine de la vega is in berkeley a city that's usually known for tolerance. >> reporter: we're here on telegraph avenue. even here at night it is still a popular area to shop and eat. but it's still frequented by homeless people. and now some people are considering making it illegal to sit and lie during the evening hours. some are fed up with people who set up camp on the sidewalk. >> i think it brings down the entire neighborhood. that it's terrible for berkeley

business and especially for tourism. >> reporter: the manager at the restaurant says they were vandalized. the berkeley chamber of commerce is in talks with city leaders to clean up the area and make it more inviting. >> it's ridiculous, everybody needs a place to be. i didn't think that not having a house was a crime. >> reporter: city councilman max anderson thinks it's a waste of time for police to impose time on people who are loitering but recognizes something has to be done. >> the solution is what we're most concerned about. because a solution that is humane is respectful of people's constitutional rights. >> reporter: but business worry the homeless are driving away customers. they pointed out several empty

store fronts. >> it's worth giving it a shot. if it doesn't work we can always change it back. >> reporter: we did see a police presence in the area but many of the homeless told us that even though they are told to move, they just come back to another area along the street to sit back down. reporting live from berkeley, janine de la vega, ktvu channel 2 news. in oakland homicide detectives hope that a surveillance video will shed light in the shooting death of a 25-year-old man. taylor is seen walking down the boulevard at 3:00 mt. morning. around the same time police were called to the area and found taylor suffering from a possible gunshot wound. he was pronounced dead at the scene. police tell us they are going to take the video to an expert so that it can be analyzed. a san jose woman is recovering tonight after being attacked by two pit bulls. don wilson tells ktvu news she

was riding a bus when the pit bulls attacked her dog shadow. wilson is concerned that the dogs may attack again. san jose animal service workers tell us they are currently looking for those two pit bulls. an east contra costa county agency is cracking down on roadside memorial. the bright house authority is expected to start removing the shrines. the concern is those makeshift memorials can be a traffic hazard. the policy goes into effect immediately. they are often left alone because of their sensitive nature. lawyers are representing two same-sex couples who sues to have their measure

overturned. they are asking the court to lift the seal that's been in place since the 2008 trial. bay area students made their feelings about bullying loud and clear today by saying nothing at all. ktvu's robert handa tells us how this rally gave gay and lesbian students a voice. >> reporter: the group of the billy frank center is trying to make a loud statement about silence. students marched through downtown san jose this evening to support a day of silence aimed at what supporters call the silencing of lesbian, gay, and transgender students. the event was just one of many today. students put tape over their mouths and put their messages on flyers. >> the community hate every day.

a recent spike in break-ins has people in districts installing security cameras. the owner of vivian's salon showed ktvu the door that was knocked down to enter her business. police tell us they have strong leads and a possible suspect. they are asking shop owners not to leave money in their stores overnight. honda says it is extending production slow downs at its 11 u.s. factories for two additional weeks. the show downs are due to parts shortages following the tsunami in japan. despite the slow downs honda says none of its 21,000 north american factory workers will be laid off. in news of the world tonight, in japan hundreds of police recovered more bodies today from the evacuation zone around the crippled nuclear

plant. those who used to live there said an offer of $12,000 in compensation from the plant owner was far too little. today the government said that payment would be more in the future. in syria, anti government activists released video of what they say is protests across the country. another piece of video appears to show security forces kicking and hitting people who are handcuffed. a group human rights watch claims that children are being beaten and tortured during the recent protests. in baghdad, a new power plant went online today. the $150 million facility was built and paid for by iraq's neighbor and former enmy. iran. iraq still suffers from a shortage of power supplies. there are frequent outages and most baghdad residents only have electricity for five hours a day. iran plans to build five more power plants in iraq.

we all know stanford stanford university is a great place to get an education. now it's the perfect place to ride your bicycle. sanford has about 13,000 bicyclists. it was singled out for its cycling network incentives and bike programs. out of 32 schools that applied for the result, stanford received the only platinum award. almost there. the milestone, the new bay bridge span reached today and what's next for the project. and if you like today boy you could really like the weekend. our chief meteorologist bill martin will tell us which day is going to be the warmest.

a fish rescue along the sacramento river that we told you about earlier this week has

been declared a success. agents rescued 46 sturgeons, salmon and many bass. the fish were trapped behind two large bans after heavy rains. when the water level receded the fish were stuck and could not get back to the river. many of those fish are labeled as threatened or endangered. b.a.r.t. has proposed an extension. a second phase of the south bay extension still needs approval. it would go another 6 miles into santa clara and include four new stations. another key piece of the new bay bridge tower is safely in place tonight. ktvu's jim vargas tells us there is now one more section of the tower left to be installed. it's called the grillage

and weighs 200-tons. it keeps the bay bridge together and makes sure that the towers are supported by its legs. >> it's 200 feet of steel going into the air, so you don't want to -- >> when it's raised to the top of the tower next month the suspension cable will be thread through it. then suspend cables will connect to the traffic decks below. eventually the bridge will be finished. >> we have been over the last year placing all the elements of the tower that's really going to hold the weight of this bridge and we're finally at the top portion of that now. >> reporter: while the grillage may be in place. it'll take 6,600 bolts to

secure it. on treasure island, jim vargas, ktvu channel 2 news. your weekend is starting. we go outside to live storm tracker 2. you see those clouds that linger to the north of us. they're going to be out there all weekend. and they're going to make their way south in the next 48 hour. sunday night i think we're going do see showers around here. cloudy day tomorrow, what you had today is what you're going to have tomorrow. sunday a little more sunshine. highs tomorrow a degree or two warmer in some places. we could see a 75 out there. santa rosa will come up a few degree but a really nice saturday and really nice sunday. the weekend looks good. this high pressure hasn't really firmly established itself yet. so the ridge of high pressure or the -- i'm sorry the jet stream is sinking a little further south than you might expect for late in april like

this. as it breaks out. this high begins to go away and this moves in. not a big deal but it will bring clouds, more clouds sunday night afternoon in the north bay and scattered showers. i think a good bet that most of us will see a few sprinkles. that's monday. let's worry about the weekend. that's more important right now. partly to mostly cloudy in concord tomorrow. a beautiful day. temperatures easily into the mid-70s. you wake up at 52. 72degrees in downtown concord. the computer model bears that out pretty nicely. pay attention as we go into saturday afternoon. some clearing partly cloudy, partly sunny. now we go into sunday. you notice there's fog right along the coast.

we see fog across half-moon bay and bodega bay. here come a few clouds. sunday afternoon there's the rain. snow in the mountains, there's the snow there. you see clouds as far south as santa cruz area. so it's not a big deal but it definitely will have an impact north of the bay area. there's your showers sunday night into monday for the bay area forecast. it is a good chance as you get into monday morning for some wet roads on your computer. so forecast highs tomorrow 73 in the antioch. heck of a nice day. not the perfect sunny weekend but for my money. it's going to be real nice, that sunday night deal looks like we're going to get a few sprinkles in the afternoon. mainly in the north bay. monday commute could be a little damp. >> thanks, bill. >> thank you bill. it is a big oops for the united states postal service. a new stamp features an imagine of the statute of liberty.

but it turns out it's not the real statute of liberty, it's a replica outside the new york new york hotel in las vegas. the postal service says it will live with the error. and there are millions of other stamps that are the real thing. tomorrow happens to be national record store day. it's believed to be a new record. not that kind of record. someone is paying $2 million for this football helmet. the signatures that make it so valuable.
